Supporting Opportunities to Build Everyday Responsibility Act of 2022 or the SOBER Act of 2022 This bill directs the Department of Justice to establish a grant program to provide funding for 24-7 sobriety programs. It also directs the National Institute of Justice to evaluate the policies and procedures used by grant recipients to reduce crime, recidivism, and incarceration attributed to use of alcohol or controlled substances.

Protect Minors from Medical Malpractice Act of 2022 This bill makes a medical practitioner who performs a gender-transition procedure on an individual who is less than 18 years of age liable for any physical, psychological, emotional, or physiological harms from the procedure for 30 years after the individual turns 18. Additionally, if a state requires medical practitioners to perform gender-transition procedures, that state shall be ineligible for federal funding from the Department of Health and Human Services. Gender-transition procedures generally include certain surgeries or hormone therapies that change the body of an individual to correspond to a sex that is discordant with the individual's biological sex. They exclude, however, interventions to treat (1) individuals who either have ambiguous external biological sex characteristics or lack a normal sex chromosome structure, sex steroid hormone production, or sex steroid hormone action; (2) infections, injuries, diseases, or disorders caused by a gender-transition procedure; or (3) a physical disorder, injury, or illness that places an individual in imminent danger of death or impairment of a major bodily function.

Keep Kids Fed Act of 2022 This bill provides funding for and makes changes to school meal programs and the Child and Adult Care Food Program (CACFP). It also rescinds certain funds provided under the American Rescue Plan Act of 2021; the Consolidated Appropriations Act, 2021; and the Coronavirus Aid, Relief, and Economic Security Act (CARES Act). Specifically, the bill increases the reimbursement rate for school lunches by 40 cents and for school breakfasts by 15 cents for the school year beginning in July 2022. Further, the bill changes income eligibility for school meal programs for the school year beginning in July 2022. The bill extends the authority of the Department of Agriculture (USDA) to waive certain requirements for the school meal programs and the CACFP to address COVID-19, including by extending authority through September 30, 2022, for USDA to grant waivers related to summer food service programs. The bill authorizes USDA to establish a nationwide waiver of statutory and regulatory requirements under child nutrition programs for the 2022-2023 school year. Additionally, the bill increase the reimbursement rate for meals and snacks under the CACFP by 10 cents for the school year beginning in July 2022. Further, the bill increases the reimbursement of tier II family or group day care homes to tier I amounts for the 2022-2023 school year. The bill rescinds certain funding provided to USDA, the Department of Education, and the Small Business Administration.

Educational Choice for Children Act This bill allows individuals and corporations a new tax credit after 2022 for charitable contributions to tax-exempt organizations that provide scholarships to elementary and secondary school students. Such students must be members of a household with incomes not greater 300% of the area median gross income and be eligible to enroll in a public elementary or secondary school. The bill excludes from the gross income of taxpayer dependents any scholarship amount for the elementary or secondary education expenses of eligible students. It also prohibits governmental control over scholarship granting organizations.

Right to Trial Act This bill addresses the constitutional right to a jury trial, including by (1) outlining additional factors that a court shall consider when imposing a sentence, and (2) authorizing a court to impose a sentence below the mandatory minimum.

Chase COVID Unemployment Fraud Act of 2022 This bill addresses fraud and overpayments of pandemic unemployment assistance, including by allowing states to retain a specified percentage of recovered funds and prohibiting the Department of Labor from allowing blanket waivers of overpayments.

Securing Our Students Act This bill authorizes local educational agencies and nonpublic schools to use certain COVID-19 emergency relief funds, services, or assistance for school safety uses, that is improving school conditions for student learning by planning and designing school buildings and facilities, installing infrastructure, providing safety education, and implementing technology or other measures that strengthen security on school premises.

Leaker Accountability Act of 2022 This bill establishes a new federal crime for the unauthorized disclosure of confidential information by officers or employees of the Supreme Court. Specifically, the bill prohibits an officer or employee of the Supreme Court from knowingly publishing, divulging, disclosing, or making known in any manner or to any extent not authorized by law any confidential information coming to that officer or employee in the course of the employment or official duties of that officer or employee. A violation is subject to criminal penalties—a fine, a prison term of up to five years, or both.

Competition and Transparency in Digital Advertising Act This bill limits certain large digital advertising companies from owning multiple types of advertising exchanges or brokerages and imposes certain duties with respect to the interests of the customers of such brokerages. Advertising exchanges and brokerages generally facilitate advertisers and publishers in buying and selling advertising inventory through an automated bidding process. Specifically, companies with more than $20 billion in annual digital advertising revenue are prohibited from owning more than one type of service within the digital advertising marketplace. For example, a company, such as Google, may not own a digital advertising exchange and provide software that assists publishers of online advertisements in selling advertising space on their websites. Additionally, companies with more than $5 billion in annual digital advertising revenue that provide brokerage services to buyers or sellers of digital advertisements must act in the best interest of their brokerage customers. The bill also establishes transparency and privacy requirements for such brokerages. The bill provides for enforcement of these requirements by the Department of Justice, state attorneys general, and private right of action.

Babies Need More Formula Now Act of 2022 This bill addresses the regulation of infant formula, including by authorizing the Food and Drug Administration (FDA) to waive certain requirements related to importation. The FDA may waive labeling requirements related to the importation (or distribution or sale) of infant formula from a country with requirements that provide a similar assurance of safety as U.S. requirements. The FDA must, when appropriate, enter into arrangements to harmonize U.S. regulatory requirements pertaining to infant formula with the requirements of other nations. The bill imposes time lines for the FDA to respond to submissions for market approval for new infant formula. The FDA must also issue guidance as to what types of changes in the ingredients of infant formula, if any, may not require a new growth study to meet FDA requirements. The bill also authorizes a person to import, without prior notice to the FDA, up to a three-month supply of infant formula for personal use from a country with formula safety standards similar to U.S. standards, such as Canada. Before recommending or requiring a recall of infant formula due exclusively to a labeling deficiency, the FDA must ensure that the recall will not negatively affect the supply of formula in the United States. The bill also requires the FDA to (1) notify Congress no later than 24 hours after initiating a formula recall, and (2) provide certain information to formula manufacturers about restarting production after an inspection of a manufacturing facility impacted by a recall.

Water Data Act This bill requires federal departments and agencies involved in water resources management to jointly develop and implement a National Water Data Framework and establish an interagency council, advisory committee, and grant program. Specifically, the bill requires the departments to jointly develop and implement a National Water Data Framework for integrating, sharing, and using water data to support water resources management and access. The departments must (1) develop and adopt common national standards for water data, (2) integrate water data and tools through common approaches to data infrastructure and platforms, and (3) harmonize and align water data policies and programs. The bill further requires these departments to establish an interagency Water Data Council to support the development and implementation of the framework. The bill also requires the Department of the Interior to establish an Advisory Committee on Water Information to advise Interior, the departments, and the council on the framework. The advisory committee members must include those involved in water-related activities across different sectors (e.g., state and local governments, Indian Tribes, water agencies, private sector entities, and nonprofit organizations). Finally, the bill requires Interior to establish a Water Data Grant Program in coordination with the council for nonfederal entities to carry out the purposes of this bill.

This resolution condemns the unauthorized leak of a draft Supreme Court opinion concerning abortion and the related violence, property damage, and attempted intimidation of Supreme Court Justices by activists. It also encourages the enforcement of federal criminal laws that prohibit protests and picketing outside of the homes of federal judges, jurors, witnesses, and others involved in the U.S. court system.

Improve Management, Programs, Resources, and Oversight for Vital Entrepreneurs the SBA Act or the IMPROVE the SBA Act This bill makes various changes to the Small Business Administration's (SBA) programs and operations, including prohibiting the SBA from making direct loans under the 7(a) Program and requiring annual appearances before Congress to provide information about the effectiveness of specified SBA programs. The bill also prohibits the SBA from providing assistance under its programs to certain organizations, including (1) entities primarily engaged in lobbying, (2) entities established to conduct public policy research or advocacy, and (3) the Planned Parenthood Federation of America Inc. or its affiliates.

Protecting Charter Schools from Federal Overreach Act of 2022 This bill prohibits the Department of Education from finalizing or implementing its March 14, 2022, proposed rule (or any substantially similar rule) that revises priorities, requirements, definitions, and selection criteria for the Charter Schools Program.

No Timber From Tyrants Act This bill prohibits the importation of wood and related articles from Russia and Belarus. It also directs the Department of the Interior and the Department of Agriculture (USDA) to replace these prohibited imports with timber production on certain lands. Specifically, the bill directs the President to prohibit the importation of all wood and related articles from Russia and Belarus. The President may terminate this prohibition upon certification to Congress that certain conditions have been met, including that Russia or Belarus (or both, as applicable) reached an agreement to withdraw forces in Ukraine. Additionally, the bill directs Interior and USDA to authorize timber harvest in an amount sufficient to equal the volume, with respect to calendar year 2021, of imports of wood and related articles from Russia and Belarus. Interior may authorize timber harvest only on public lands and USDA may authorize timber harvest only on National Forest System lands. The bill generally prohibits Interior and USDA from approving a plan that reduces the allowable sale quantity of timber.

Competency-Based Education Act of 2022 or the CBE Act of 2022 This bill creates a framework under which students participating in competency-based education programs may receive federal student aid. Competency-based education refers to education that measures academic progress and attainment (1) by direct assessment of the student's mastery of competencies, (2) by expressing the student's mastery of competencies in terms of equivalent credit or clock hours, or (3) through a combination of both methods in addition to credit or clock hours. The bill also prohibits the Department of Education from enforcing certain regulations related to the definition of credit hour.

John W. Walsh Alpha-1 Home Infusion Act of 2022 This bill provides for Medicare coverage of treatment for alpha-1 antitrypsin (AAT) deficiency (a protein deficiency that raises the risk of lung and other diseases). Specifically, the bill provides for coverage of at-home augmentation therapy for beneficiaries with emphysema as a result of severe hereditary AAT deficiency. Treatment must be provided through qualified home infusion therapy suppliers; beneficiaries must be under the care of a physician, nurse practitioner, or physician assistant.

Promoting Energy Independence and Transparency Act This bill requires the Department of the Interior to take certain actions related to parcels of land that have been nominated for future sales of onshore oil and gas leases and related drilling permits. Specifically, Interior must (1) report to Congress about the status of the parcels, (2) publish on its website information concerning expressions of interest in nominated parcels and drilling permits, and (3) issue certain pending applications for drilling permits within 30 days.

This resolution supports the preservation of the stepped-up basis tax rule that allows recipients of inherited assets such as land, equipment, or buildings to adjust the cost basis of the assets to reflect their fair market value. The resolution opposes any efforts to impose new taxes on family farms or small businesses and recognizes the importance of generational transfers of farm and family-owned businesses.

Employee Rights Act This bill makes various changes with respect to the collective bargaining process and labor relations. For example, the bill permits an employer to refuse to collectively bargain with a union within 90 days prior to the expiration of a collective bargaining agreement if the employer receives evidence that the majority of the employees in the bargaining unit do not support the union. The bill requires support from a majority of the employees in the bargaining unit (not just a majority of the employees voting) when electing union representation. The bill also requires unions to provide bargaining unit employees with the right to vote by secret ballot, including when voting whether to engage in a strike or refusal to work. Further, union dues, fees, assessments, and other contributions may be used for only collective bargaining or contract administrative functions. Additionally, the bill establishes a process for nullifying executive orders that the Office of Management and Budget determines are likely to result in an employer ordering a plant closure or mass layoff.

COI Elimination Act This bill limits U.S. contributions to the United Nations pertaining to the U.N. Independent International Commission of Inquiry on the Occupied Palestinian Territory, including East Jerusalem, and Israel. Current law imposes a cap on the annual U.S. contribution to the U.N. budget. The bill lowers that cap by 25% of the amount budgeted for the commission. The bill also states that it shall be U.S. policy to seek the abolition of the commission and combat systemic anti-Israel bias in international bodies.

Human Trafficking Prevention Act of 2022 This bill requires the Department of Transportation to seek to provide for the posting of contact information of the national human trafficking hotline in the restrooms of each U.S. aircraft, airport, over-the-road bus, bus station, passenger train, and passenger railroad station.

Ensuring Sound Guidance Act This bill generally requires investment advisors and fiduciaries of employer-sponsored retirement plans to make investment decisions based only on pecuniary factors (i.e., factors that a fiduciary prudently determines are expected to have a material effect on the risk and return of an investment based on appropriate investment horizons consistent with the plan's policies and objectives). The bill allows nonpecuniary factors to be considered in certain situations, such as when a customer specifically requests that these factors be considered or when selecting investment options for certain participant-directed retirement plans.

This resolution rejects and opposes engaging Russia as a main intermediary for reviving any nuclear agreement with Iran. The resolution rejects and opposes giving Russia any sanctions exemption or waiver as a condition to any nuclear agreement with Iran. The resolution rejects and opposes any agreement that lifts sanctions on Iran and legitimizes the regime's illicit nuclear program amidst an International Atomic Energy Agency investigation into undeclared sites, facilities, and material in Iran. The resolution also reaffirms that any nuclear deal with Iran reached by the Biden administration without congressional approval or Senate ratification as a treaty is illegitimate; to take every legislative opportunity to overturn such an agreement; to restore every single sanction, restrictive measure, designation, waiver, or general license the Biden administration removes; and to limit the Biden administration's or any future administration's ability to issue waivers and licenses for Iran sanctions, designations, or restrictive measures.

They Had Our Back We Have Theirs Act of 2022 This bill provides specified levels of educational assistance and federal student loan forgiveness to children and spouses of eligible public safety officers. An eligible public safety officer is a public safety officer who died or was permanently and totally disabled from an injury sustained in the line of duty.

This resolution urges the government of Argentina to bring the perpetrators of the March 17, 1992, terrorist attack on the Embassy of Israel in Buenos Aires to justice (in 1999 the Supreme Court of Argentina found that the transnational terrorist organization Hezbollah was responsible for the attack). The resolution commends the Argentinian government for designating Hezbollah as a terrorist organization and urges other U.S. allies and partners in Latin America and the Caribbean to do the same. The resolution urges these allies and partners to condemn and counter regional governments in the hemisphere that aid and abet Iran and Hezbollah. The resolution also commends the Argentinian government for adopting the International Holocaust Remembrance Alliance working definition of antisemitism and encourages other partners and allies to do the same. Finally, the resolution commends the Secretary General of the Organization of American States for appointing a Commissioner to Monitor and Combat Anti-Semitism in the Western Hemisphere.

Record of Military Service for Members of the Armed Forces Act of 2022 This bill requires the Department of Defense (DOD) to create the Certificate of Military Service. The Certificate of Military service will be a standard record of military service for all members of active and reserve components of the armed forces to encompass all duty, including that of National Guard and Coast Guard duty. Under the bill, the document must (1) be standardized, (2) be the same for all members of the armed forces, and (3) replace and serve the same function as a discharge certificate or certificate of release (DOD Form DD-214). The bill also requires that a current record of service be issued to members of the reserve components upon the occurrence of any of the following events: permanent change to duty status (e.g., retirement or transfer to active duty), discharge or release from temporary active duty orders, specified promotions, and transfer to another state National Guard.

Change of Ownership and Conversion Improvement Act This bill revises the application and review process for institutions of higher education (IHEs) to change ownership or for a proprietary (i.e., for-profit) IHE to convert to public or other nonprofit status, including by establishing a pretransaction review application and requiring an IHE to pay an administrative fee for such transactions or pretransaction reviews. The Government Accountability Office must report on the implementation of this bill's provisions.

Prohibiting Oil Trade with Venezuela's Tyrant Act This bill requires the President to prohibit the importation of petroleum products from Venezuela. Petroleum product means crude oil, residual fuel oil, or any refined petroleum product, including natural gas liquid product. Further, the bill authorizes the President to use appropriate authorities to impose civil or criminal penalties as necessary to enforce the prohibition. The prohibition shall terminate after the Department of State certifies that Venezuela has held free and fair elections and all political prisoners have been released.

Direct Investigations on China, Take Action To Oppose Russia Act of 2022 or the DICTATOR Act of 2022 This bill requires the Department of State to report to Congress on entities in China that assist or have assisted Russia's efforts to evade sanctions imposed by the United States following Russia's invasion of Ukraine. The bill also requires the relevant federal agencies to brief Congress on U.S. efforts to (1) identify and sanction such entities, and (2) economically isolate Russia from outside support and economic assistance from China.

Stop the Nosy Obsession with Online Payments Act of 2022 or the SNOOP Act of 2022 This bill modifies requirements for third party settlement organizations to eliminate their reporting requirement with respect to the transactions of their participating payees unless they have earned more than $20,000 on more than 200 separate transactions in an applicable tax period. A third party settlement organization is the central organization that has the contractual obligation to make payments to participating payees (generally, a merchant or business) in a third party payment network. This reverses a provision in the American Rescue Plan Act of 2021 that lowered the reporting threshold to $600 with no minimum on the number of transactions.

Israel Anti-Boycott Act This bill prohibits participation by certain entities and individuals in boycotts or requests for boycotts imposed by international governmental organizations (i.e., the United Nations and the European Union). Specifically, the bill applies to covered persons the prohibition of specified actions in compliance with or in support of a boycott against a country that is friendly to the United States and that is not itself the object of a U.S. boycott. The bill defines a covered person as a domestic concern, the U.S. government or a state government, or a representative or official of such domestic concern or government. The bill also adds to the list of specified prohibited actions the act of furnishing information to any foreign country or international governmental organization that furthers an imposed boycott. Under current law, a person who violates the prohibitions against such boycotts may be subject to a monetary fine or imprisonment; however, the bill removes imprisonment as a potential penalty for certain violations.

American Energy Independence from Russia Act This bill addresses U.S. energy security, the production of oil and gas, and the importation and exportation of oil and gas. Specifically, the President must submit an energy security plan that (1) evaluates U.S. crude oil, petroleum products, and natural gas imports and exports; (2) assesses the energy security risks of such imports; and (3) includes strategies to encourage increased domestic production of crude oil, petroleum products, and natural gas to offset Russian imports. The bill also approves the TransCanada Keystone Pipeline in Phillips County, Montana for the import of oil from Canada to the United States. In addition, the bill grants the Federal Energy Regulatory Commission the authority to approve or deny applications for facilities to export natural gas from the United States to foreign countries or import natural gas from foreign countries. The President and federal agencies must obtain congressional approval before (1) prohibiting or substantially delaying certain new energy mineral leases or permits on federal lands, or (2) withdrawing certain federal lands from mineral and geothermal leasing activities. The Department of the Interior must resume issuing oil and gas leases on federal lands and offshore submerged lands in the Outer Continental Shelf as specified under the bill. Finally, the bill limits the drawdown of petroleum in the Strategic Petroleum Reserve until the Department of Energy develops a plan to increase the percentage of federal lands leased for oil and gas production.

This joint resolution nullifies the rule issued by the Centers for Disease Control and Prevention on February 3, 2021, that requires the use of face masks on planes, trains, buses, and other public conveyances and at transportation hubs to prevent the transmission of COVID-19.
