Preserving Access to Home Health Act of 2023 This bill repeals certain payment adjustments for home health services under Medicare that are based on behavioral changes. It also requires the Medicare Payment Advisory Commission to incorporate certain information into its evaluations of the financial performance and impact of home health agencies, including trends under Medicare Advantage, Medicaid, and other payers with respect to home health services.

Better Collaboration, Accountability, and Regulatory Enforcement for Animals Act of 2023 or the Better CARE for Animals Act of 2023 This bill modifies enforcement provisions under the Animal Welfare Act, including by allowing the Department of Justice (DOJ) to bring civil actions against violators of the act for appropriate relief, such as removing animals, revoking violators' licenses, or issuing civil penalties. DOJ must use the penalties to pay for the temporary care for animals pending the disposition of civil or criminal proceedings that allege violations of the act with respect to such animals.

Public Housing Fire Safety Act This bill creates a grant program, to be administered by the Department of Housing and Urban Development, for public housing agencies to install automatic sprinkler systems in certain public housing projects.

Tax Fairness for Workers Act This bill allows an above-the-line tax deduction for union dues and expenses. (An above-the-line deduction is subtracted from gross income and is available whether or not a taxpayer itemizes other deductions.) The bill also reinstates the miscellaneous itemized tax deduction for unreimbursed expenses attributable to the performance of services as an employee (Under current law, all miscellaneous itemized deductions are suspended through 2025).

Rebuild America's Schools Act of 2023 This bill provides support for long-term improvements to public elementary and secondary school facilities. First, the bill sets forth allocations to states and establishes a need-based grant program for local educational agencies (LEAs) to improve school facilities. Further, the bill specifies allowable uses of grant funds, including carrying out major repairs, improving indoor air quality, and making facilities accessible to disabled individuals. Additionally, the bill requires LEAs that receive funds for new construction, modernization, or renovation projects to comply with hazard-resistance building codes and performance criteria under the WaterSense program of the Environmental Protection Agency. Further, the bill requires such LEAs to adopt certain green practices (environmental standards) and requires the use of iron, steel, and manufactured products that are made in the United States (Buy America). The bill restores school infrastructure tax credit bonds. The bill also sets forth reporting requirements, including annual reports on grant program projects and a report by the Government Accountability Office that requires a study of the geographic distribution of projects, the impact of selected projects on student and staff health and safety, and the accessibility of projects to high-poverty schools. The bill also establishes the Office of School Infrastructure and Sustainability within the Department of Education. Next, the bill extends through FY2028 the Impact Aid Construction program. Finally, the bill establishes a grant program to assist LEAs with repairing or replacing concrete foundations affected by pyrrhotite (an iron sulfide material linked to crumbling foundations).

Promotion and Expansion of Private Employee Ownership Act of 2023 This bill accelerates to the enactment date of this bill the deferral of tax (currently, after December 31, 2027) on sales of employer stock to employee stock ownership plans (ESOPs) sponsored by S corporations. It also eliminates the limitation on the amount that may be deferred. The Department of the Treasury must establish the S Corporation Employee Ownership Assistance Office to foster increased employee ownership of S corporations. The office must provide education and outreach about the benefits of employee ownership of S corporations and technical assistance to assist S corporations in sponsoring ESOPs. The bill directs the Department of Labor to appoint an Advocate for Employee Ownership.

Break the Cycle of Violence Act This bill establishes federal grant programs and related entities to support violence intervention initiatives. Specifically, the bill directs the Department of Health and Human Services (HHS) to award grants for coordinated community violence intervention initiatives in communities disproportionately impacted by homicides and community violence. HHS must also establish several related entities, including an Office of Community Violence Intervention to administer programs and activities related to violence intervention; the Community Violence Intervention Advisory Committee to advise and assist the office and HHS; and the National Community Violence Response Center to provide training and technical assistance, coordinate research, and develop data collection policies. Additionally, the bill directs the Department of Labor to award grants for job training and workforce programs in communities disproportionately affected by gun violence to connect youth ages 16 to 24 to in-demand occupations.

Expanding Seniors' Access to PFAS Testing Act This bill provides for Medicare coverage of testing for perfluoroalkyl and polyfluoroalkyl substances (PFAS) with no cost-sharing. (PFAS are man-made and may have adverse human health effects. A variety of products contain the compounds, such as nonstick cookware or weatherproof clothing.)

Conrad State 30 and Physician Access Reauthorization Act This bill modifies the Conrad 30 Waiver program, which incentivizes qualified foreign physicians to serve in underserved communities. It also extends statutory authority for the program for three years from this bill's enactment. Aliens coming to the United States under a J-1 nonimmigrant visa to receive medical training typically must leave the country and reside for two years abroad before being eligible to apply for an immigrant visa or permanent residence. The Conrad program waives this requirement for individuals who meet certain qualifications, including serving for a number of years at a health care facility in an underserved area. The bill increases the number of waivers that a state may obtain each fiscal year from 30 to 35 if a certain number of waivers were used the previous year, and provides for further adjustments depending on demand. An alien physician may be employed at an academic medical center to meet the Conrad program's employment requirements if the alien's work is in the public interest, even if the medical center is not in an underserved area. Employment contracts for alien physicians under the Conrad program shall contain certain information, such as the maximum number of on-call hours per week the physician shall have to work. Certain alien physicians (along with the physician's spouse and children) shall be exempt from the direct annual numerical limits on immigration, including those physicians that have met certain requirements related to visas for physicians to serve in underserved areas.

9-8-8 Implementation Act of 2023 This bill modifies programs and activities that support access to behavioral health services, with a focus on crisis services and the 9-8-8 telecommunication system that provides callers with mental health or suicide crisis support and resources. For example, the bill establishes a national suicide prevention media campaign and grant programs to support crisis call centers and the behavioral health workforce. It also requires the Department of Health and Human Services to convene a panel to develop recommendations for 9-1-1 dispatchers on how respond to callers experiencing behavioral health crises, including with respect to utilizing the 9-8-8 system. The bill also expands coverage under Medicare, Medicaid, the Children's Health Insurance Program (CHIP), private insurance, and insurance programs for members of the Armed Forces, veterans, and federal employees to include crisis response services.

Scientific Integrity Act This bill revises provisions regarding the release of scientific research results by federal agencies. Each agency that funds, conducts, or oversees scientific research must (1) adopt and enforce a scientific integrity policy that includes certain requirements, such as restricting scientific conclusions from being based on political considerations; and (2) submit such policy to the Office of Science and Technology Policy (OSTP) for approval. Agencies must make their policies public, submit them to Congress, and periodically update them with OSTP's approval. The Government Accountability Office shall review implementation of the policies. Each agency shall (1) appoint a Scientific Integrity Officer, (2) establish a process for dispute resolution consistent with the scientific integrity policy, and (3) establish a specified training program for current and new employees.

Treat and Reduce Obesity Act of 2023 This bill expands Medicare coverage of intensive behavioral therapy for obesity. Specifically, the bill allows coverage for therapy that is provided by (1) a physician who is not a primary care physician; or (2) other health care providers (e.g., physician assistants and nurse practitioners) and approved counseling programs, if provided upon a referral from, and in coordination with, a physician or primary care practitioner. Currently, such therapy is covered only if provided by a primary care practitioner. The bill also allows coverage under Medicare's prescription drug benefit of drugs used for the treatment of obesity or for weight loss management for individuals who are overweight.

Pathways to Health Careers Act This bill provides funding for, reauthorizes through FY2028, and makes a variety of changes to certain grants administered by the Department of Health and Human Services that provide education and training to low-income individuals for health care occupations, including by establishing a new competitive grant for projects designed to train low-income individuals in allied health professions.

Accelerating Kids' Access to Care Act This bill requires state Medicaid programs to establish a process through which qualifying out-of-state providers may enroll as participating providers for five years without undergoing additional screening requirements, unless the state has an agreement with other states that governs coverage of children with medically complex conditions that is in accordance with specified guidance from the Centers for Medicare & Medicaid Services (CMS). Among other requirements, a qualifying provider must (1) serve individuals under the age of 21; (2) have previously been screened for Medicare participation or for participation in the Medicaid program of the state in which the provider is located; and (3) have been determined by the CMS or state Medicaid program to pose a limited risk of fraud, waste, or abuse.

Freedom to Vote Act This bill addresses voter registration and voting access, election integrity and security, redistricting, and campaign finance. Specifically, the bill expands voter registration (e.g., automatic and same-day registration) and voting access (e.g., vote-by-mail and early voting). It also limits removing voters from voter rolls. Next, the bill establishes Election Day as a federal holiday. The bill declares that the right of a U.S. citizen to vote in any election for federal office shall not be denied or abridged because that individual has been convicted of a criminal offense unless, at the time of the election, such individual is serving a felony sentence. The bill establishes certain federal criminal offenses related to voting. In particular, the bill establishes a new criminal offense for conduct (or attempted conduct) to corruptly hinder, interfere with, or prevent another person from registering to vote or helping someone register to vote. Additionally, the bill sets forth provisions related to election security, including by requiring states to conduct post-election audits for federal elections. The bill outlines criteria for congressional redistricting and generally prohibits mid-decade redistricting. The bill addresses campaign finance, including by expanding the prohibition on campaign spending by foreign nationals, requiring additional disclosure of campaign-related fundraising and spending, requiring additional disclaimers regarding certain political advertising, and establishing an alternative campaign funding system for certain federal offices.

Social Security 2100 Act This bill modifies the Social Security system, particularly with respect to benefit calculations, fund administration, and beneficiary resources. For example, the bill temporarily increases the primary insurance amount for Social Security benefits for all individuals (from 90% of a certain portion of average indexed monthly earnings to 93%). It also modifies benefit calculations for certain individuals, including by temporarily (1) increasing benefits for widows or widowers in two-income households; and (2) allowing children of a deceased, disabled, or retired worker to remain eligible for benefits through age 25 if they are full-time students. Additionally, the bill temporarily eliminates (1) the government pension offset , which reduces Social Security benefits for spouses, widows, and widowers who also receive government pensions of their own; and (2) the windfall elimination provision , which reduces Social Security benefits for individuals who also receive a pension or disability benefit from an employer that did not withhold Social Security taxes. The bill also modifies the financing and administration of the Social Security trust funds. For example, the bill (1) subjects income over $400,000 to Social Security payroll taxes, and (2) combines the Federal Old-Age and Survivors Insurance Trust Fund and the Federal Disability Insurance Trust Fund into a single Social Security Trust Fund. Finally, the bill establishes requirements relating to Social Security services and resources, including by prohibiting the closure of field offices unless certain conditions are met (e.g., public hearings).

Senator Paul Simon Study Abroad Program Act of 2023 This bill expands access to study abroad for U.S. undergraduate students. It revises the Increase and Diversify Education Abroad for U.S. Students program (commonly known as the IDEAS program) and formally renames the program as the Senator Paul Simon Study Abroad Program.

John W. Walsh Alpha-1 Home Infusion Act of 2023 This bill provides for Medicare coverage of treatment for alpha-1 antitrypsin (AAT) deficiency (a protein deficiency that raises the risk of lung and other diseases). Specifically, the bill provides for coverage of at-home augmentation therapy for beneficiaries with emphysema as a result of severe hereditary AAT deficiency. Treatment must be provided through qualified home infusion therapy suppliers; beneficiaries must be under the care of a physician, nurse practitioner, or physician assistant.

PrEP Access and Coverage Act of 2023 This bill requires private health insurance plans to cover prescription drugs that prevent HIV, including related screenings, diagnostic procedures, administrative fees, and clinical follow-ups, without any cost-sharing obligation for the plan holder. Further, insurance plans must not impose any preauthorization requirement for this coverage. These coverage requirements also apply to public health insurance programs, including Medicare, Medicaid, and the Children's Health Insurance Program. Additionally, the bill prohibits denying, limiting, or qualifying coverage or increasing premiums for disability insurance, long-term care insurance, or life insurance policies based on an individual taking medication for HIV prevention. The bill further requires the Department of Health and Human Services (HHS) to award grants to states, or directly to eligible local organizations, to provide uninsured individuals and underinsured individuals access to prescription drugs and related services that prevent HIV. The Centers for Disease Control and Prevention also must develop a public awareness campaign that focuses efforts in communities with a high need for HIV prevention treatment. HHS, the Department of Labor, and the Department of Treasury must enforce and report on private insurers' compliance with the bill's requirements.

This resolution expresses support for (1) equal rights and protections for all people, regardless of actual or perceived sexual orientation, gender identity, or sex characteristics; and (2) the designation of LGBTQI+ Equality Day to commemorate Supreme Court decisions handed down on June 26 in 2003, 2013, and 2015. The resolution also acknowledges the need for further legislation to ensure that people in the United States are free from all forms of discrimination on the basis of actual or perceived sexual orientation, gender identity, or sex characteristics.

Customer Non-Discrimination Act This bill prohibits discrimination based on sex, sexual orientation, and gender identity with respect to public accommodations and facilities. Specifically, the bill defines and includes sex, sexual orientation, and gender identity among the prohibited categories of discrimination or segregation. The bill expands the definition of public accommodations to include places or establishments that provide (1) exhibitions, recreation, exercise, amusement, gatherings, or displays; (2) goods, services, or programs; and (3) transportation services. Protections against discrimination based on race, color, religion, sex, sexual orientation, gender identity, or national origin shall include protections against discrimination based on (1) an association with another person who is a member of such a protected class; or (2) a perception or belief, even if inaccurate, that an individual is a member of such a protected class. The bill prohibits the Religious Freedom Restoration Act of 1993 from providing a claim, defense, or basis for challenging such protections. The bill prohibits an individual from being denied access to a shared facility, including a restroom, a locker room, and a dressing room, that is in accordance with the individual's gender identity. The bill also prohibits the provision of less favorable treatment with respect to pregnancy, childbirth or related medical conditions as compared to other physical conditions.

National Flood Insurance Program Reauthorization and Reform Act of 2023 This bill generally revises the National Flood Insurance Program (NFIP) and reauthorizes the program through FY2026. The bill addresses NFIP coverage, cost, and availability, including by generally prohibiting the Federal Emergency Management Agency (FEMA) from raising certain premiums, surcharges, and fees more than 9% a year for five years; revising flood insurance coverage limits; establishing a means-tested program to provide financial assistance to low-income households through policy discounts; and revising standards and certification requirements for flood insurance rate maps. The bill also revises administrative provisions of the NFIP, including by allowing for the continuous operation of the NFIP during a lapse in appropriations, and prohibiting the Department of the Treasury from charging FEMA interest for NFIP debt for five years. The bill sets forth requirements for Write Your Own companies related to reimbursements, agent commissions, and penalties for underpayment of claims. (A Write Your Own company writes and services federal standard flood insurance policies in its own name.) The bill establishes state or tribal government revolving funds for flood mitigation activities and also provides for loans, grants, and other incentives regarding mitigation. The bill also requires the creation of an appeals process for disputing NFIP premium rates.

Summer Meals Reaching Every Area's Child Hunger Act of 2023 or the Summer Meals REACH Act of 2023 This bill permanently extends certain modifications to the Summer Food Service Program that were authorized and implemented to respond to COVID-19. The changes generally expanded the program, which provides free meals to children in low-income areas when school is not in session. Specifically, the bill permanently makes all children eligible to participate in the program. This includes requiring reimbursement to camps for meals served to all children. The bill also specifically allows for non-congregate meal distribution, which is meal distribution outside of the typically required group, or congregate, setting (e.g., grab-and-go meal service). Further, the bill expands eligible service institutions by allowing for on-site or off-site food service monitoring.

Promoting Respect for Individuals' Dignity and Equality Act of 2023 or the PRIDE Act of 2023 This bill requires the equal treatment of same sex married couples for tax purposes. It permits such couples to amend their filing status to married filing jointly for tax returns outside of the statute of limitations and modifies tax rules relating to married couples to include same sex couples.

Helping Emergency Responders Overcome Act or the HERO Act This bill establishes a series of programs relating to the behavioral health of law enforcement officers, first responders, 9-1-1 operators, and other public safety officers and health care providers. The programs include a public safety officer suicide-reporting system at the Centers for Disease Control and Prevention, a grant program for peer-support behavioral health and wellness programs within fire departments and emergency medical services agencies, and a grant program for behavioral health and wellness programs for health care providers.

Fair Accounting for Condominium Construction Act This bill exempts certain residential construction contracts from the requirement to use the percentage of completion method of accounting. The percentage of completion method is a tax accounting method in which the revenues and expenses of long-term contracts are recognized as a percentage of the work completed in a particular period.

American Worker and Trade Competitiveness Act This bill reauthorizes and revises specified U.S. trade programs and provisions. Specifically, the bill reauthorizes through FY2030 and revises the Trade Adjustment Assistance Program, including by expanding program eligibility to additional workers, establishing a child and other dependent care allowance, and increasing the maximum benefit of wage insurance. It also permanently extends the tax credit for health insurance costs and increases the percentage of the credit. The bill extends through December 31, 2026, the Generalized System of Preferences (GSP), which provides duty-free treatment to products imported from designated beneficiary countries. The bill makes changes to the GSP, including by (1) adding other criteria for designation as a beneficiary developing country, (2) requiring a review of laws relating to worker and gender rights, and (3) requiring a study on rules of origin and GSP utilization rates. Additionally, the bill provides through December 31, 2024, and retroactively applies to 120 days before this bill's enactment, temporary duty suspensions or reductions to eligible imported products. This authorization is commonly known as the Miscellaneous Tariff Bill (MTB). The last version of the MTB was enacted in September 2018 and the temporary treatment for those products listed in the MTB expired on December 31, 2020. The bill extends the American Manufacturing Competitiveness Act of 2016 for two future MTB cycles (one in 2023 and one in 2026). This extension allows the U.S. International Trade Commission to conduct the MTB petition, review, and recommendation process for those additional cycles.

Gun Violence Prevention and Safe Communities Act of 2023 This bill increases by .5% the excise tax on firearms, including pistols, revolvers, and shells and cartridges. The bill establishes the Gun Violence Prevention Trust Fund into which the increased tax revenues are deposited to fund gun violence prevention programs. The Trust Fund creates separate accounts for violence prevention, gun violence research, hate crimes data collection and enforcement, and firearm forensics. The bill also requires an inflation adjustment to the amount of the special tax on importers, manufacturers, and dealers in firearms and the transfer tax on firearms.

Amputation Reduction and Compassion Act of 2023 or the ARC Act of 2023 This bill provides for coverage of peripheral artery disease screening tests without cost-sharing under Medicare and Medicaid for certain at-risk individuals. It also requires the development of certain educational programs, a payment model, and Medicare quality measures to reduce amputations relating to such disease.

Equality Act This bill prohibits discrimination based on sex, sexual orientation, or gender identity with respect to businesses, employment, housing, federally funded programs, and other settings. Specifically, the bill expands Title II and Title VI of the Civil Rights Act of 1964 to prohibit public accommodations and federally funded programs, respectively, from discriminating based on sex, sexual orientation, or gender identity. It also includes stores, transit services, recreational facilities, and establishments that provide health care, accounting, or legal services as public accommodations under Title II. The bill also expands Title IV (desegregation of public schools) and Title VII (employment discrimination) to specifically include sexual orientation and gender identity. (The Supreme Court held in Bostock v. Clayton County that Title VII's prohibition of employment discrimination based on sex also prohibits employment discrimination based on sexual orientation or gender identity.) The bill similarly expands the Fair Housing Act (discrimination in public and private housing) to include sexual orientation and gender identity. It also prohibits discrimination based on sexual orientation or gender identity by creditors and with respect to jury selection. The bill defines sex for purposes of the aforementioned provisions to include sex stereotypes, pregnancy, childbirth, sexual orientation, gender identity, and sex characteristics.

Lifting Immigrant Families Through Benefits Access Restoration Act or the LIFT the BAR Act This bill repeals certain limits on the eligibility of noncitizens who lawfully reside in the United States for federal means-tested programs, including Medicaid, the Children's Health Insurance Program (CHIP), programs funded through Temporary Assistance for Needy Families (TANF) grants, Supplemental Security Income (SSI), and certain nutrition and housing programs.

Opt for Health with SNAP, Close the Fruit and Vegetable Gap Act of 2023 or the OH SNAP, Close the Fruit and Vegetable Gap Act of 2023 This bill reauthorizes, and provides increased specified funds for, the Gus Schumacher Nutrition Incentive Program (GusNIP) for FY2024-FY2028 and each fiscal year thereafter. GusNIP provides competitive grants for projects that increase low-income consumers' purchases of fruits and vegetables by providing (1) incentives at Supplemental Nutrition Assistance Program (SNAP) points of purchase, and (2) produce prescriptions to SNAP/Medicaid participants.

Lady Liberty Act of 2023 This bill sets a floor of 125,000 for the maximum number of refugees who may be admitted into the United States each fiscal year. Under current law, the President sets the annual cap on refugee admissions at the beginning of each fiscal year. (The cap for FY2023 was 125,000, but in some years it had been lower. For example, the cap for FY2021 was 15,000.)

Hate Crimes Commission Act of 2023 This bill establishes the United States Commission on Hate Crimes. The commission must investigate and report on whether hate crimes have increased; factors that contributed to an increase in hate crimes, if one is determined to exist; policies or actions that law enforcement agencies might adopt to reduce the commission of hate crimes; the impact of underreporting on hate crimes statistics and prevention; ways to improve hate crimes reporting and ensure full and complete participation in the National Incident-Based Reporting System by local law enforcement agencies; bias prevention efforts and responses to hate crimes that are successful and possible through coordination with nonprofit organizations, local education agencies, and government entities; and the prevalence and rise of online hate crime incidents.
