Native American and Native Hawaiian Cultural Heritage Protection Act of 2018 This bill prohibits the sale and exportation of tribal cultural items of American Indians, Alaska Natives, and Native Hawaiians that were obtained illegally and provides for the return of the items, including voluntary returns.

This bill amends the International Financial Institutions Act to require: (1) the Department of the Treasury to instruct the U.S. Executive Director at the International Monetary Fund (IMF) to support the use of the IMF's administrative budget for technical assistance that strengthens the capacity of IMF members to prevent money laundering and terrorism financing, and (2) the National Advisory Council on International Monetary and Financial Policies to report on the effectiveness of such assistance and on the efficacy of U.S. efforts to achieve this goal.

This bill requires the Department of the Treasury's Office of Terrorism and Financial Intelligence and the Financial Crimes Enforcement Network to establish anti-money-laundering and counterterrorist-financing policy priorities. Financial institutions must incorporate these priorities into existing anti-money-laundering and counterterrorist-financing programs.

Full Military Honors Act of 2018 This bill provides full military honors for the funeral of an eligible veteran who: is first interred or inurned in Arlington National Cemetery on or after enactment of this bill, was awarded the medal of honor or the prisoner-of-war medal, and is not entitled to full military honors because of such veteran's grade.

Firearms Interstate Commerce Reform Act This bill removes certain restrictions on interstate firearms transactions. Among other things, the bill does the following: permits a licensed firearms dealer to sell firearms at an out-of-state gun show, subject to compliance with state laws; and specifies the particular states in which a member of the U.S. Armed Forces, or his or her spouse, is a resident for purposes of federal firearms laws.

Integration of Baseball Commemorative Coin Act This bill directs the Department of the Treasury to mint and issue $5 gold coins, $1 silver coins, and half-dollar clad coins in recognition and celebration of the 75th anniversary of the integration of the game of baseball. All sales of such coins shall include specified surcharges. All surcharges received by Treasury shall be distributed to the National Baseball Hall of Fame, with the understanding that the Hall of Fame shall work with the Jackie Robinson Foundation to develop and operate education programs about the integration of the game of baseball and to preserve artifacts related to the integration of the game.

AG and Legal Workforce Act This bill establishes a new H-2C nonimmigrant visa for aliens coming temporarily to the United States to perform agricultural labor or services. In addition, the bill (1) directs the Department of Homeland Security to create an electronic employment-eligibility confirmation system modeled after the E-Verify system, and (2) mandates the use of such a system by employers.

FinCEN Improvement Act of 2018 This bill amends the duties of the Financial Crimes Enforcement Network (FinCEN). FinCEN must work with tribal law enforcement agencies, protect against terrorism regardless of origin, and coordinate internationally on matters involving emerging technology and virtual currency.

Save Community Newspaper Act of 2018 This bill allows community newspapers to elect to apply certain alternative minimum funding standards for single-employer defined benefit pension plans that meet specified requirements. "A community newspaper" is a newspaper that primarily serves a metropolitan statistical area with a population of at least 100,000.

Treaty of Guadalupe-Hidalgo Land Claims Act of 2018 This bill establishes the Treaty of Guadalupe Hidalgo Land Grant-Merced Claims Commission to conduct a hearing on each qualifying petition that shows the claimed boundaries of a land grant-merced. A "land grant-merced" is a specified community land grant, or a community, village, town, or settlement, the land of which was granted by Spain or Mexico between 1689 and 1854 within the Territory of New Mexico, which now includes New Mexico, Colorado, and Arizona, to the community, village, town, or pueblo, or to a person to found or establish a community, village, town, or settlement. After a hearing, the Commission may recommend as restitution any one of the following possible restitutions: convey federal land; grant stewardship rights to all or part of federal land; grant priority access and use rights to such lands for the harvesting of natural resources, such as timber and minerals, grazing and watering of livestock, or hunting and fishing; grant priority rights to leases, special use permits, and easements on federal land, to acquire federal lands that may become available for disposal, or to obtain new, unused, or unrenewed grazing allotments on federal lands. The bill prohibits the impairment of the rights of any acequia located on federal land as the result of enactment of this bill, including the right to the use of water by valid water right owners and access to the acequia for maintenance and improvements to its easement and infrastructure.

Weigh Habitats Offsetting Locational Effects Act of 2018 or the WHOLE Act of 2018 This bill amends the Endangered Species Act of 1973 to revise the process by which the Department of the Interior or the Department of Commerce, as appropriate, reviews an agency action to determine whether the action is likely to jeopardize the continued existence of an endangered or threatened species or result in the destruction or adverse modification of the critical habitat of the species. Specifically, the bill requires the appropriate department, when making such a determination, to consider the offsetting effects of protection or conservation measures that are already in place or proposed to be implemented as part of the action.

Ensuring Meaningful Petition Outreach While Enhancing Rights of States Act of 2018 or the EMPOWERS Act of 2018 This bill amends the Endangered Species Act of 1973 to revise the process for listing, delisting, or reclassifying a species under the Act. Before submitting to the Department of the Interior or the Department of Commerce, as appropriate, a petition to list a species as a threatened or endangered species, the petitioner must notify each county and state in which the species is located of the intent to submit a petition. Upon finding that the petition may be warranted, the appropriate department must solicit advice from each county and state in which the species is located. If a state or county advises that the listing is not warranted, then the appropriate department may not proceed with the listing unless the department demonstrates that the information submitted in support of the advice is incorrect and that the listing is warranted. The bill expands requirements regarding providing notice of a proposed regulation that determines whether a species is endangered or threatened, including by requiring the appropriate department to provide notice to each person who requests a notice. The appropriate department must justify a final regulation that conflicts with the advice of a state or county.

Localizing Authority of Management Plans Act of 2018 or the LAMP Act of 2018 This bill amends the Endangered Species Act of 1973 (ESA) to revise requirements governing cooperative management agreements to manage areas established for the conservation of endangered or threatened species. Under current law, the agreements are between states and the Department of the Interior or the Department of Commerce, as appropriate. This bill allows the appropriate department to enter into: (1) agreements with local governments, Indian tribes, or nonfederal persons; and (2) agreements to manage areas established for the conservation of species that are candidates for listing. The bill exempts the actions of preparing, approving, and entering into an agreement from environmental review requirements under the National Environmental Policy Act of 1969. The departments may: (1) delegate authority under the ESA to states that establish and maintain an adequate program for the conservation of endangered or threatened species that reside in the state, and (2) provide financial assistance to a state that has entered into an agreement with the department or to a state with delegated authority.

Less Imprecision in Species Treatment Act of 2018 or the LIST Act of 2018 This bill amends the Endangered Species Act of 1973 to revise the process for removing a species from the endangered or threatened species lists. The Department of the Interior or the Department of Commerce, as appropriate, must remove a species from the endangered or threatened species lists if Interior produces or receives substantial scientific or commercial information demonstrating that the species is recovered or that recovery goals set for the species have been met. The publication and notice of a proposed regulation to remove a species from the lists must consist solely of a notice of the removal. The bill establishes a process for removing species from the lists if they were erroneously or wrongfully listed. The bill prohibits a person from submitting a petition to list a species as a threatened or endangered species for 10 years if the person knowingly submitted a petition with information that was inaccurate beyond scientifically reasonable margins of error, fraudulent, or misrepresentative.

Ending Duplicative Permitting Act This bill prohibits the Department of the Interior from requiring an operator to obtain a federal drilling permit for oil and gas activities on non-federal surface estate if: (1) less than 50% of the subsurface mineral estate to be accessed by the proposed action is federally owned, and (2) the operator submits a state permit for such activities on the non-federal surface estate.

Common Sense Permitting Act This bill revises the approval process for certain oil and gas activities by requiring additional categorical exclusions from National Environmental Policy Act of 1969 (NEPA) requirements. (A categorical exclusion under NEPA is a category of actions that do not have a significant effect on the human environment and for which neither an Environmental Assessment nor an Environmental Impact Statement is required.)

Transporting Livestock Across America Safely Act This bill requires the Department of Transportation to amend regulations on hours of service for commercial drivers who transport live covered animals (i.e., livestock, honey bees, insects, fish, and crawfish) within a 300 air-mile radius from where the on-duty time of the driver begins. The regulations must: (1) exclude from the driver's on-duty time certain activities, such as loading or unloading a commercial motor vehicle; (2) change the driving time requirement to a maximum of not less than 15, and not more than 18, hours within a 24-hour period; (3) permit the driver to take one or more rest periods during the trip, which shall not be included in the calculation of the driving time; (4) require the driver, after completion of the trip, to take a rest break for a period that is five hours less than the maximum driving time; (5) exclude from the calculation of the driving time up to two additional hours, if the driver is within 150 air-miles of the point of delivery; and (6) make inapplicable the requirement that the driver take a 10-hour rest period before driving.

Counter Terrorism and Illicit Finance Act This bill (1) increases the threshold dollar amounts above which financial institutions are required to file currency-transaction and suspicious-activity reports with the Financial Crimes Enforcement Network (FinCEN), (2) directs FinCEN to establish a process for no-action letters, and (3) modifies other provisions related to anti-money laundering and counterterrorist financing.

Family Member Access to Burn Pit Registry Act This bill amends the Dignified Burial and Other Veterans' Benefits Improvement Act of 2012 to allow a family member to participate in the Department of Veterans Affairs Airborne Hazards and Open Burn Pit Registry on behalf of a deceased veteran or service member. (The registry is a database designed to allow certain veterans and service members to report deployment exposures to airborne hazards such as smoke from waste disposal burn pits, oil-well fires, or pollution, as well as other exposures and health concerns.)

Education and Energy Act of 2018 This bill amends the Mineral Leasing Act to require excess revenue from new mineral and geothermal leases to be provided to the states in which the revenue is generated to supplement the education of students in kindergarten through grade 12 and to supplement public support of institutions of higher education. The bill applies to revenue from new leases that are in excess of the Congressional Budget Office's estimated revenue for the leases in the prior fiscal year.

Village of Santa Clara Conveyance Act of 2018 This bill directs the Forest Service, upon request by the Village of Santa Clara, New Mexico, to convey to the village approximately 1,520 acres of National Forest System land at market value.

Burn Pits Accountability Act This bill requires the Department of Defense (DOD) and the military departments to evaluate whether each member of the Armed Forces has been (1) based or stationed where an open air burn pit was used to dispose of waste, or (2) exposed to toxic airborne chemicals. Members located where an open burn pit was used or exposed to toxic airborne chemicals must be enrolled in the Airborne Hazards and Open Burn Pit Registry, unless the member elects not to enroll. The evaluations must be included in periodic health assessments, physical exams conducted immediately prior to separation from active duty, and deployment assessments. DOD must share the results of the evaluations with the Department of Veterans Affairs.

National FFA Organization's Federal Charter Amendments Act This bill revises the charter of the National FFA Organization (Future Farmers of America). Such revisions include (1) making it a purpose of the organization to be an integral component of agricultural, food, and natural resources education, and (2) removing the Secretary of Education as the chair of the National FFA Board of Directors.

Environmental Compliance Cost Transparency Act of 2018 This bill requires the Bonneville Power Administration, the Western Area Power Administration, the Southwestern Power Administration, and the Southeastern Power Administration to include in monthly billing statements sent to each customer estimates of the customer's share of such administration's direct and indirect costs for compliance with any relevant federal environmental laws impacting the conservation of fish and wildlife. Each administration must report each year on: (1) estimates of its total direct and indirect compliance costs, and (2) sources of replacement power.

Coach-Only Airfare for Capitol Hill Act of 2018 This bill prohibits the use of funds appropriated or otherwise made available for the official travel of a Member of Congress or other officer or employee of the legislative branch for airline accommodations which are not coach-class accommodations. Such prohibition is inapplicable for an individual if the use would be permitted for an employee of an agency subject to specified federal regulations for temporary duty travel allowances.

Education Savings Accounts for Military Families Act of 2018 This bill amends the Elementary and Secondary Education Act of 1965 to direct the Department of Education to establish a program to provide children with parents on active duty in the uniformed services with funds for specified educational purposes. Children of active duty service members who reside in a local education agency that receives payments under the Impact Aid Program or who reside within the boundaries of a federal military installation are eligible to receive funds.

United States-Israel Security Assistance Authorization Act of 2018 This bill extends Military Financing Program grants for Israel through FY2023. The Department of Defense shall conduct a joint assessment with Israel regarding: (1) precision guided munitions needed by Israel in a sustained armed confrontation with Hezbollah and other armed groups and terrorist organizations, and (2) related U.S. assistance and resupply planning. The President may utilize the Special Defense Acquisition Fund to transfer precision guided munitions and related defense articles and services to reserve stocks for Israel. Authorities for loan guarantees and the war reserves stockpile for Israel are extended through FY2023. The Department of Homeland Security shall establish a seven-year grant program with Israel to support: (1) cybersecurity research and development, and (2) commercialization of cybersecurity technology. The U.S. Agency for International Development may enter into memoranda of understanding with Israel to advance common goals on energy, agriculture and food security, democracy, economic growth, education, and health. The National Aeronautics and Space Administration (NASA) shall continue to work with the Israel Space Agency to pursue peaceful space exploration and science initiatives. The President may enter into a cooperative project agreement with Israel to carry out research and joint production of defense articles and services to detect and destroy unmanned aerial vehicles (i.e., drones) that threaten the United States or Israel. The bill states that it is U.S. policy to ensure that Israel maintains its qualitative military edge.

Iranian Revolutionary Guard Corps Economic Exclusion Act This bill expands sanctions against Iran's Islamic Revolutionary Guard Corps (IRGC). The President shall report to Congress regarding: foreign and domestic supply chains that significantly aid the IRGC; Iranian state-owned entities that provide support to terrorist entities, including Mahan Air; and foreign persons owned or controlled by the IRGC, including companies listed on the Tehran Stock Exchange or companies with a value in excess of $100 million. The bill states that it is U.S. policy to prevent Iran's membership in the World Trade Organization and similar international bodies as long as Iran remains a state sponsor of terrorism.

Revitalize Rural America Act of 2018 This bill requires the Department of Transportation to establish a Revitalize Rural America Grant Program to facilitate infrastructure projects in rural areas. Priority must be given to projects for which nonfederal contributions exceed 25% of the costs of the project and projects in an area with an unemployment rate that exceeds the national average. The bill requires that the set-aside of funds for states under the surface transportation block grant program be used for the Revitalize Rural America Grant Program.

Child Tax Credit for Pregnant Moms Act of 2018 This bill amends the Internal Revenue Code, with respect to the child tax credit, to allow the credit to be used for an unborn child if the child is born and issued a Social Security number before the due date for the tax return (without regard to extensions) for the taxable year. The bill defines an "unborn child" as a member of the species homo sapiens, at any stage of development, who is carried in the womb. If a child is not taken into account for the credit for the year immediately preceding the year of the child's birth, the bill doubles the amount of the credit allowed for the year of the birth.

Permanent Tax Cuts for Americans Act This bill makes permanent the provisions of subtitle A (Individual Tax Reform) and subtitle B (Alternative Minimum Tax) of P.L. 115-97 (commonly known as the Tax Cuts and Jobs Act) that are currently scheduled to terminate on December 31, 2025.

Ultrasound Informed Consent Act This bill amends the Public Health Service Act to require abortion providers, before a woman gives informed consent to any part of an abortion: (1) perform an obstetric ultrasound on the pregnant woman; (2) provide a simultaneous explanation of what the ultrasound is depicting; (3) display the ultrasound images so the woman may view them; and (4) provide a complete medical description of the images, including the dimensions of the embryo or fetus, cardiac activity if present and visible, and the presence of external members and internal organs if present and viewable. The bill establishes civil penalties for violations. It prohibits construing this bill to require a woman to view the images or penalizing the provider or the woman if the woman declines to look at the images.
