Allows the form to be used even if income includes: (1) social security benefits; (2) distributions from qualified retirement plans, annuities, or other such deferred payment arrangements; (3) interest and dividends; or (4) capital gains and losses.

Fair Tax Act of 2013

Fair Tax Act of 2013 - Repeals the income tax, employment tax, and estate and gift tax. Redesignates the Internal Revenue Code of 1986 as the Internal Revenue Code of 2013. Imposes a national sales tax on the use or consumption in the United States of taxable property or services. Sets the sales tax rate at 23% in 2015, with adjustments to the rate in subsequent years. Allows exemptions from the tax for property or services purchased for business, export, or investment purposes, and for state government functions. Sets forth rules relating to: (1) the collection and remittance of the sales tax, and (2) credits and refunds. Allows a monthly sales tax rebate for families based upon criteria related to family size and poverty guidelines. Grants states the primary authority for the collection of sales tax revenues and the remittance of such revenues to the Treasury. Sets forth administrative provisions relating to: (1) the filing of monthly reports and payments of tax; (2) accounting methods; (3) registration of sellers of goods and services responsible for reporting sales; (4) penalties for noncompliance; and (5) collections, appeals, and taxpayer rights. Directs the Secretary of the Treasury to allocate sales tax revenues among: (1) the general revenue, (2) the old-age and survivors insurance trust fund, (3) the disability insurance trust fund, (4) the hospital insurance trust fund, and (5) the federal supplementary medical insurance trust fund. Prohibits the funding of the Internal Revenue Service (IRS) after FY2017. Establishes in the Department of the Treasury: (1) an Excise Tax Bureau to administer excise taxes not administered by the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF); and (2) a Sales Tax Bureau to administer the national sales tax. Terminates the sales tax imposed by this Act if the Sixteenth Amendment to the U.S. Constitution (authorizing an income tax) is not repealed within seven years after the enactment of this Act.

Averting the Fiscal Cliff Act - Title I: Job Protection and Recession Prevention Act - Subtitle A: Job Protection and Recession Prevention Act - Job Protection and Recession Prevention Act of 2012 - Makes permanent: (1) the Economic Growth and Tax Relief Reconciliation Act of 2001, and (2) provisions of the Jobs and Growth Tax Relief Reconciliation Act of 2003 that reduce tax rates on capital gain and dividend income. Extends through 2013 the estate, gift, and generation-skipping transfer provisions of the Tax Relief, Unemployment Insurance Reauthorization, and Job Creation Act of 2010. Amends the Internal Revenue Code to extend through 2013: (1) the increased expensing allowance for depreciable business assets, and (2) the increased alternative minimum tax (AMT) exemption amount for individual taxpayers. Subtitle B: Pathway to Job Creation Through a Simpler, Fairer Tax Code Act - Pathway to Job Creation through a Simpler, Fairer Tax Code Act of 2012 - States that the purpose of this Subtitle is to provide for the enactment of comprehensive tax reform in 2013. Defines a "tax reform bill" as a bill of the 113th Congress that is introduced in the House of Representatives by the chair of the Committee on Ways and Means not later than April 30, 2013 (or the first legislative day thereafter if the House is not in session on that day), the title of which is "a bill to provide for comprehensive tax reform." Requires the chair of the Joint Committee on Taxation to notify the House and Senate upon determining that such an introduced bill contains proposals to: (1) consolidate the 6 current individual income tax brackets into a maximum of 2 brackets (of 10% and not higher than 25%), (2) reduce the corporate income tax rate to not more than 25%, (3) repeal the alternative minimum tax (AMT), (4) broaden the tax base to maintain revenue between 18% and 19% of the economy, and (5) change from a worldwide to a territorial system of taxation. Provides for expedited consideration of such bill in the House of Representatives and the Senate. Title II: Sequestration Replacement Act - Subtitle A: Agriculture - Agricultural Reconciliation Act of 2012 - Amends the American Recovery and Reinvestment Act of 2009 to terminate the increase in the value of supplemental nutrition assistance program (SNAP, formerly the food stamp program) benefits for Puerto Rico and American Samoa on the date of enactment of the Averting the Fiscal Cliff Act. Amends the Food and Nutrition Act of 2008 to limit categorical SNAP eligibility to households receiving specified other program benefits in cash. Eliminates the requirement that a state agency using a standard utility allowance provide such allowance to a household that receives assistance under the Low Income Home Energy Assistance Act of 1981 or other energy assistance program if such household incurs out-of-pocket heating or cooling expenses exceeding such assistance. Eliminates: (1) administrative cost sharing to states for certain employment and training programs, (2) state bonus programs for effective SNAP administration, and (3) indexing for the nutrition education and obesity prevention grant program. Reduces FY2013 funding for employment and training programs. Authorizes FY2013 appropriations to carry out the Food and Nutrition Act of 2008. States that this title and the amendments made by this title shall take effect on enactment of this Act, and shall apply only with respect to certification periods that begin on or after such date. Subtitle B: Committee on Energy and Commerce - Amends the Patient Protection and Affordable Care Act (PPACA) to repeal provisions: (1) appropriating funds to the Secretary of Health and Human Services (HHS) to award grants to states for activities (including planning activities) related to establishing an American Health Benefit Exchange (a state health insurance exchange), (2) establishing and appropriating funds to the Prevention and Public Health Fund (a Fund to provide for expanded and sustained national investment in prevention and public health programs to improve health and help restrain the rate of growth in private and public sector health care costs), and (3) appropriating funds for the establishment and operation of the Consumer Operated and Oriented Plan (CO-OP) program (designed to foster the creation of qualified nonprofit health insurance issuers to offer qualified health plans in the individual and small group markets). Rescinds any unobligated balance appropriated under such provisions. Amends title XIX (Medicaid) of the Social Security Act (SSA) to: (1) extend the reduction of the threshold level of permissible state taxes on health care providers before federal funding to the state for Medicaid is reduced; (2) reduce the state disproportionate share hospital (DSH) allotment for FY2022; and (3) repeal provisions prohibiting states from reducing eligibility levels for Medicaid. Amends SSA title XXI (Children's Health Insurance Program) (CHIP) to repeal provisions prohibiting states from reducing eligibility levels for CHIP. Repeals provisions that increased Medicaid payments to territories though FY2019. Decreases the federal medical assistance percentage (FMAP) for Puerto Rico, the Virgin Islands, Guam, the Northern Mariana Islands, and American Samoa. Repeals provisions providing bonus payments to states for enrollment and retention programs for children covered under Medicaid and CHIP. Subtitle C: Financial Services -- Amends the Dodd-Frank Wall Street Reform and Consumer Protection Act (Dodd-Frank) to repeal Title II (Orderly Liquidation Authority), including the Orderly Liquidation Fund, and to restore any federal law amended by it as if title II of Dodd-Frank had not been enacted. HAMP Termination Act of 2012 - Amends the Emergency Economic Stabilization Act of 2008 (EESA) to terminate the authority of the Secretary of the Treasury to provide new mortgage modification assistance under the Home Affordable Modification Program (HAMP), except with respect to existing obligations on behalf of homeowners already extended an offer to participate in the program. Declares unavailable after the enactment of this Act for obligation or expenditure under HAMP any amounts made available for HAMP under EESA title I that: (1) have been allocated for use but not yet obligated, and (2) are not necessary for providing HAMP assistance on behalf of those homeowners already extended an offer to participate in HAMP. Directs the Secretary to study: (1) the extent to which HAMP is used by homeowners who are active duty members of the Armed Forces (or their spouses or parents), veterans, or Gold Star-eligible widows, parents, or next of kin of Armed Forces members who died in military operations; and (2) the impact of the program on them. Amends the Consumer Financial Protection Act of 2010 to repeal the obligation of the Board of Governors of the Federal Reserve System (Federal Reserve Board) to transfer quarterly to the Consumer Financial Protection Bureau (CFPB) the amount of funds determined by the CFPB Director to be reasonably necessary to carry out CFPB authorities. Repeals the Consumer Financial Protection Fund and the Consumer Financial Civil Penalty Fund. Repeals the exclusion of CFPB funds from construction as government funds or appropriated monies. Subjects the CFPB funds to the annual congressional authorization and appropriation process. Amends Dodd-Frank to repeal the Office of Financial Research. Subtitle D: Committee on the Judiciary - Help Efficient, Accessible, Low Cost, Timely Healthcare (HEALTH) Act of 2012 - Sets forth provisions regulating lawsuits for health care liability claims concerning the provision of health care goods or services or any medical product affecting interstate commerce. Sets a statute of limitations of three years after the date of manifestation of injury or one year after the claimant discovers the injury, with certain exceptions. Limits noneconomic damages to $250,000. Makes each party liable only for the amount of damages directly proportional to such party's percentage of responsibility. Allows the court to restrict the payment of attorney contingency fees. Limits the fees to a decreasing percentage based on the increasing value of the amount awarded. Authorizes the award of punitive damages only where: (1) it is proven by clear and convincing evidence that a person acted with malicious intent to injure the claimant or deliberately failed to avoid unnecessary injury the claimant was substantially certain to suffer, and (2) compensatory damages are awarded. Limits punitive damages to the greater of two times the amount of economic damages or $250,000. Limits the liability of manufacturers, distributors, suppliers, and providers of medical products that comply with Food and Drug Administration (FDA) standards. Provides for periodic payments of future damage awards. Subtitle E: Committee on Oversight and Government Reform - Increases federal employee contributions under the Civil Service Retirement System (CSRS) and the Federal Employees' Retirement System (FERS) by 5% of salary over 5 years, beginning in calendar year 2013. Increases retirement contributions for: (1) Members of Congress in CSRS and FERS and for congressional employees in CSRS by 8.5% (by 7.5% for congressional employees in FERS) of salary over 5 years, beginning in calendar year 2013; and (2) Members of Congress and certain federal employees who begin federal service after December 31, 2012, and who have less than 5 years of creditable service for retirement purposes (revised annuity employees). Requires any excess contributions made by an employee of the U.S. Postal Service (USPS) or the Postal Regulatory Commission (PRC) to be deposited to the credit of the Postal Service Fund, rather than the Civil Service Retirement and Disability Fund. Modifies rules for determining government contributions to CSRS and FERS made after December 31, 2012, and requires any excess contributions to FERS to be used for reducing the unfunded liability of CSRS. Eliminates the annuity supplement for FERS employees hired after December 31, 2012, except for certain law enforcement officers, firefighters, nuclear material couriers, border protection officers, and air traffic controllers. Allows federal employees (including employees of USPS and PRC) and Members of Congress in CSRS or FERS to deposit any payment they receive for accumulated and accrued annual or vacation leave into their Thrift Savings Fund accounts. Subtitle F: Committee on Ways and Means - Amends the Internal Revenue Code to: (1) repeal the limitation on the recapture of advance payment amounts of the tax credit for health insurance premium assistance that exceed the allowable amount of such credit for certain low-income taxpayers, and (2) require taxpayers who are claiming the refundable portion of the child tax credit to include their social security numbers on their tax returns. Repeals the program of block grants to states for social services under title XX (Block Grants to States for Social Services) of the Social Security Act. Subtitle G: Sequester Replacement - Sequester Replacement Act of 2012 - Amends the Balanced Budget and Emergency Deficit Control Act of 1985 (Gramm-Rudman-Hollings Act) to remove veterans' medical care from the accounts subject to a sequester. Abolishes the distinction between security and nonsecurity categories of discretionary spending for new budget authority in FY2013. Combines the dollar amounts of the current categories ($686 billion for the security category and $361 billion for the nonsecurity category) into a single amount of $1.047 trillion in new budget authority. Revises sequestration requirements for FY2013 to require a $19.104 billion across-the-board decrease in the discretionary spending category as of January 2, 2013. Directs the Office of Management and Budget (OMB) to issue a supplemental sequestration report for FY2013 to eliminate any discretionary spending breach of the $1.047 trillion spending limit, as adjusted by the $19.104 billion across-the-board reduction requirement of this Act. Directs the President to order a sequestration, if any, as required by such report. Amends the Congressional Budget Act of 1974 to authorize the chair of the Committee on the Budget of the House of Representatives or the Senate to make adjustments to any legislative measure to conform to the discretionary spending limits of this Act. Nullifies any sequestration order the President may issue under the Gramm-Rudman-Hollings Act to carry out reductions to direct spending for the FY2013 defense function (050).

Equitable Access to Care and Health Act or the EACH Act - Amends the Internal Revenue Code, with respect to minimum essential health care coverage requirements added by the Patient Protection and Affordable Care Act, to allow an additional religious exemption from such requirements for individuals whose sincerely held religious beliefs would cause them to object to medical health care provided under such coverage. Defines "medical health care" to mean voluntary health treatment by or supervised by a medical doctor that would be covered under minimum essential coverage that: (1) includes voluntary acute care treatment at hospital emergency rooms, walk-in clinics, or similar facilities; and (2) excludes treatment not administered or supervised by a medical doctor, physical examinations or treatment required by law or third parties, and vaccinations.

Air Travelers' Bill of Rights Act of 2012

Air Travelers' Bill of Rights Act of 2012 - Directs the Assistant Secretary of Homeland Security (Transportation Security Administration [TSA]) to: (1) establish an air travelers' bill of rights for air passengers screened at primary airports, and (2) post it on the TSA website and display signs and distribute brochures listing such rights to passengers before they are screened. Requires the air travelers' bill of rights to include, at a minimum, that a passenger has the right to: (1) presumed innocence before, during, and after screening; (2) be screened expeditiously if verified by the TSA as a low-risk or frequent traveler; (3) decline to be screened by a device that uses backscatter x-rays; (4) freedom from searches and screening procedures not implemented for cause or suspicion; (5) be screened by a method other than a pat-down; (6) accompany minor children through the screening process; (7) privacy of any image of the passenger generated during the screening process; and (8) peacefully express his or her concerns of mistreatment during the screening process to the supervisor of the individual conducting the screening. Transfers from the Under Secretary of Transportation for Security (DOT) to the Assistant Secretary the authority to approve any application of an airport operator to have the screening of passengers and property at an airport be carried out by the screening personnel of a qualified private screening company (security screening opt-out program). Requires the Assistant Secretary to approve all such applications. Directs the Assistant Secretary to take necessary actions to expand TSA's expedited screening initiative (PreCheck program). Directs the Assistant Secretary to increase the number of canines from the TSA's National Explosives Detection Canine Team Program, placed at commercial service airports with more than 2.5 million passenger boardings each year, to a number sufficient to ensure at least one canine team can be tasked exclusively for screening passengers. Prohibits the use of random computer-generated screening of air passengers at commercial service airports. Directs the Assistant Secretary to prescribe regulations to: (1) limit the screening of passengers through use of pat-downs; and (2) ensure that the screening of passengers wearing a prosthetic limb, a breast pump, adult diapers, a wheelchair, an insulin pump, or any other medical device is done in a private area out of view of other passengers if requested. Requires termination of any TSA or private security screener who commits a gross violation of the privacy of a passenger in a manner not supported by TSA policy. Amends the Support Anti-terrorism by Fostering Effective Technologies Act of 2002 to exclude from its liability protections against claims arising out of, or resulting from, an act of terrorism the manufacturers of advanced imaging technology or any technology developed or acquired after enactment of this Act for the screening of passengers. Directs the Secretary of Homeland Security (DHS) to take all appropriate actions to implement any elements of the air travelers' bill of rights that are not currently included in TSA policies and practices. Directs the Assistant Secretary to provide a Passenger Privacy Protection Award to an eligible airport and individual for improving the privacy of passengers at airports each year. Prescribes requirements for the distribution of unclaimed money recovered at airport security checkpoints.

STEM Jobs Act of 2012 - Amends the Immigration and Nationality Act to make up to 55,000 visas available to qualified immigrants who: (1) have a doctorate degree in a field of science, technology, engineering, or mathematics (STEM degree) from a U.S. university; (2) agree to work for at least five years for the petitioning employer or in the United States in a STEM field upon being lawfully admitted for permanent residence; and (3) have taken all doctoral courses in a STEM field, including all correspondence courses, while physically present in the United States. Makes any such unused visas available to aliens who: (1) hold a master's degree in a STEM field from a U.S. university; (2) agree to work for a total of at least five years for the petitioning employer or in the United States in a STEM field upon being lawfully admitted for permanent residence; (3) have taken all master's degree courses in a STEM field, including all correspondence courses, while physically present in the United States; and (4) hold a baccalaureate degree in a STEM field or in the biological and biomedical sciences. Prohibits the Secretary of Homeland Security (DHS) (Secretary) from approving an employer petition on behalf of either of the above class of aliens unless the Secretary receives a determination by the Secretary of Labor that there are not sufficient American workers available for the job. Requires: (1) employers of foreign STEM graduates to submit a job order for the position with the appropriate state workforce agency, and (2) such agency to post the position on its website for at least 30 days. Requires DHS to make available on its website specified information regarding foreign STEM employers, the number of aliens granted STEM status, and their occupations. Eliminates the diversity immigrant program. States that: (1) the permanent priority date for any employment-based petition shall be the date on which the petition is filed, unless such filing was preceded by the filing of a labor certification with the Secretary of Labor, in which case that date shall constitute the priority date; and (2) an alien who is the beneficiary of an employment-based petition that was approvable when filed shall retain such petition's priority date in the consideration of any subsequently filed employment-based petition. Revises student visa provisions.

Fort Sumner Project Title Conveyance Act - Authorizes the Secretary of the Interior to convey to the Fort Sumner Irrigation District, located in De Baca County, New Mexico, all works, land, and facilities of the Fort Sumner reclamation project in accordance with the Memorandum of Agreement between the United States and the Fort Sumner Irrigation District Concerning Principles and Elements of Proposed Transfer of Title to Fort Sumner Irrigation District Facilities. Requires the Secretary, before carrying out such conveyance, to assure compliance with all applicable requirements under the National Environmental Policy Act of 1969, the Endangered Species Act of 1973, and any other law applicable to the property conveyed. Requires the Secretary to report to Congress if such conveyance isn't completed within two years after such requirements are met. Terminates, on the date of such conveyance: (1) U.S. interest in and responsibility for the project and liability relating to the conveyed property; (2) a specified repayment contract between the United States and the District dated November 5, 1948; and (3) a specified payment obligation of the United States under the contract between the United States and the District for the forbearance of exercising priority water rights, dated August 21, 2009. Provides that all other terms of such forbearance agreement shall remain in effect for not less than 10 years after this Act's enactment. Provides that after conveyance of title under this Act: (1) the conveyed property shall not be considered to be a part of a federal reclamation project; and (2) the entity to which the property is conveyed shall not be eligible to receive any benefits, including federal project power, with respect to the conveyed property, except for benefits that would be available to a similarly situated entity with respect to property that is not part of a federal reclamation project.

Allows a state governor or the Secretary of Agriculture (USDA), with respect the National Forest System, or of the Interior, with respect to public lands, to designate high-risk areas of the national forests and public lands in the state for purposes of addressing: (1) deteriorating forest health conditions due to the bark beetle epidemic or drought, with the resulting imminent risk of devastating wildfires; and (2) the future risk of insect infestations or disease outbreaks through preventative treatments to improve forest health conditions. Excludes wilderness areas and national monuments from designation as high-risk areas. Establishes a 20-year period for such high-risk area designation. Allows a governor or the Secretary, upon designation of a high-risk area, to provide for the development of proposed emergency hazardous fuels reduction projects for the area. Prohibits clear cutting as a part of any such project. Applies the administrative and judicial review processes of the Healthy Forests Restoration Act of 2003, with modifications, to such projects. Authorizes the Secretary concerned to enter into cooperative agreements and contracts with state foresters to provide forest, rangeland, and watershed restoration and protection services that include: (1) activities to treat insect infected trees; (2) activities to reduce hazardous fuels; and (3) any other activities to restore or improve forest, rangeland, and watershed health, including fish and wildlife habitat. Permits state foresters to enter into subcontracts to provide such restoration and protection services. Amends the Department of the Interior and Related Agencies Appropriations Act, 1999 to extend the authority to enter, and the duration of, contracts to perform services to achieve land management goals for national forests that meet local and rural community needs.

Requires projects carried out in at-risk forests to move the federal land from condition class II or III toward condition class I. Permits use in a project of: (1) domestic livestock grazing to reduce surface fuel loads and to recover burned areas; and (2) timber harvesting and thinning to reduce ladder and canopy fuel loads for the prevention of wildfire, including catastrophic wildfires. Directs the Secretaries to review public petitions for, and make determinations with respect to, the designation of federal lands as at-risk forests or as threatened and endangered species habitats. Requires notice in the Federal Register of proposed projects and final designated projects and permits public comment on projects as specified. Instructs the Secretaries to prepare an environmental assessment for projects that include timber harvesting or grazing. Instructs the Secretaries to research what impact any listing of a species under the Endangered Species Act of 1973 would have on both forage and timber forest fuel loads. Requires endangered species recovery plans and critical habitat determinations to include a wildfire risk assessment analysis.

Requires: (1) the Administrator to develop such criteria in conjunction with input from states, and (2) such criteria to reflect the technical expertise and resources available in state and local agencies and the availability of meteorological and other monitoring data in rural areas. Authorizes such criteria to vary with respect to different regions. Requires the Administrator, in developing such criteria, to consider using an expedited or streamlined approval process and conditions under which such demonstrations may be suitable for such process. Requires the Administrator: (1) to approve or disapprove an exceptional event demonstration within 90 days of such demonstration; or (2) if the Administrator requests additional information from a state regarding such demonstration, to approve or disapprove such demonstration within 90 days of submission of such information. Considers such demonstrations to be approved if the Administrator does not take action within such time frames. Requires: (1) such approval or disapproval to be based on a preponderance of the evidence, and (2) the Administrator to accord substantial deference to state findings on such demonstration. Authorizes the Administrator to develop and use analyses and consider evidence not provided by such demonstration. Considers such approval or disapproval to be final action subject to judicial review. Requires the Administrator to revise regulations concerning air quality monitoring data influenced by exceptional events to meet the requirements of this Act within 180 days of this Act's enactment.

Directs the Board to include in its semiannual report to Congress: (1) the results of the evaluation process, (2) whether the goal of long-term price stability is being met, (3) the main monetary policy instruments and strategy used by the Board and the FOMC to achieve long-term price stability, and (4) an analysis of how the policies of the Board and the FOMC are affecting the foreign exchange rate value of the U.S. dollar. Directs the Board to clearly articulate its lender-of-last-resort policy. Revamps FOMC membership to consist of one representative from each of the Federal Reserve banks (in addition to members of the Board). Directs the FOMC to release meeting transcripts to the public within three years after each meeting. Redesignates the Department of the Treasury stabilization fund as the Special Drawing Rights Fund. Instructs the Secretary of the Treasury to liquidate all property in the Fund (other than Special Drawing Rights) and to use all such amounts to reduce the public debt. Limits the availability of the Fund solely to stabilize exchange rates and arrangements. Repeals the authority of the Secretary to deal in U.S. instruments of credit and securities. Permits only Special Drawing Rights to be deposited into the Fund. Requires funds that would otherwise have been deposited into the Fund to be paid, instead, to the Secretary to reduce the public debt. Amends the FRA to authorize the FOMC, in unusual and exigent circumstances, by the affirmative vote of two-thirds of its members, to grant any Federal Reserve bank emergency authority to buy and sell U.S. debt obligations and revenue bonds in anticipation of the collection of taxes or the receipt of assured revenues by any state or local governmental entity, as well as obligations of, or guaranteed by, a foreign government or agency. Amends the Consumer Financial Protection Act of 2010 to repeal: (1) funding for the Consumer Financial Protection Bureau (CFPB), and (2) the Bureau of Consumer Financial Protection Fund.

Repeals: (1) criminal penalties under such Act, and (2) the authorization to suspend, modify, or cancel specified licenses or permits issued to any person who is convicted of a criminal violation of such Act.

United States-Israel Enhanced Security Cooperation Act of 2012 - States that it is U.S. policy to: (1) reaffirm the commitment to Israel's security as a Jewish state, (2) provide Israel with the military capabilities to defend itself and help preserve its qualitative military edge, (3) expand military and civilian cooperation, (4) assist in a negotiated settlement of the Israeli-Palestinian conflict that results in two states living side by side in peace and security, and (5) encourage Israel's neighbors to recognize Israel's right to exist as a Jewish state. Expresses the sense of Congress that the United States should take specified actions to assist in Israel's defense.
