National Guard Empowerment and State-National Defense Integration Act of 2008 - Adds the Chief of the National Guard Bureau (Chief) to the Joint Chiefs of Staff. Requires the Chief to: (1) identify gaps between federal and state military capabilities to prepare for and respond to emergencies; and (2) make recommendations to the Secretary of Defense for military assistance to civil authorities to address such gaps. Requires annual defense budget documents to specify separate amounts for training and equipment for the National Guard for military assistance to civil authorities and other domestic operations. Redesignates the: (1) Director and Deputy Director of the Army National Guard as the Vice Chief and Deputy Vice Chief of the Army National Guard; and (2) Director and Deputy Director of the Air National Guard as the Vice Chief and Deputy Vice Chief of the Air National Guard. Treats Vice Chief service as an adjutant general as joint duty experience for assignment or promotion purposes. States that the United States Northern Command and the United States Pacific Command shall be the combatant commands principally responsible for the military support of civil authorities in the United States. Requires the Commander of each Command and the Chief to enter into a memorandum of understanding setting forth the operational relationships, and individual roles and responsibilities, during responses to domestic emergencies among such Commands and the National Guard Bureau. Directs the Secretary to assure that tactical control of the Armed Forces on duty within a state or possession is vested in the governor thereof when such forces are engaged in emergency response activities. Requires the officer serving as: (1) Commander of Army North Command to be an officer in the Army National Guard; and (2) Commander of Air Force North Command to be an officer in the Air National Guard. Expresses the sense of Congress that, in assigning officers to such positions, the President should afford a preference to officers who have served as a state adjutant general. Requires at least one of each of three specified commander and deputy commander joint task force positions to be an officer in the Army or Air National Guard.

Medicare Part D Home and Community Services Copayment Equity Act of 2008 - Amends part D (Voluntary Prescription Drug Benefit Program) of title XVIII (Medicare) of the Social Security Act to eliminate part D cost-sharing for certain non-institutionalized full-benefit dual eligible individuals with income below 135% of the poverty line who: (1) reside in an assisted living facility, a resident care program facility, a board and care facility, or any other appropriate licensed facility, including a community mental health center, a psychiatric health facility, a mental health rehabilitation center, and a mental retardation developmental disability facility; or (2) receive home and community-based services in a home setting under a home and community-based waiver.

Group Health Plan Prosthetics Parity Act of 2007 - Amends the Employee Retirement Income Security Act of 1974 (ERISA) to require a group health plan that provides both medical and surgical benefits and benefits for prosthetic devices and components to provide prosthetics coverage under terms and conditions that are no less favorable than those applicable to substantially all medical and surgical benefits provided under the plan. Prohibits the prosthetics benefit from being subject to separate or more restrictive financial requirements or more restrictive treatment limitations. Applies the requirements of this Act separately with respect to in-network and out-of-network benefits. Requires a group health plan to apply the same prior authorization requirements to the prosthetics benefit as apply for all similar benefits under the plan. Limits the required prosthetics benefit to the most appropriate model that adequately meets the medical requirements of the patient. Includes repair or replacement of prosthetic devices and components within such coverage. Prohibits a group health plan from imposing any annual or lifetime dollar limitation on the prosthetics benefit that is not applied in the aggregate to all medical and surgical benefits provided under the plan. Requires the Secretary of Labor to: (1) assist participants and beneficiaries with any questions or problems regarding compliance with the requirements of this Act; and (2) conduct random audits of group health plans to ensure compliance. Requires the Comptroller General to evaluate the effects of this Act, including on the cost of and access to heath insurance coverage.

Assuring and Improving Cancer Treatment Education and Cancer Symptom Management Act of 2008 - Amends title XVIII (Medicare) of the Social Security Act, as amended by the Medicare, Medicaid, and SCHIP Extension Act of 2007, to provide for Medicare coverage of comprehensive cancer patient treatment education services. Amends the Public Health Service Act to direct the Director of the National Institutes of Health (NIH) to expand, intensify, and coordinate programs for the conduct and support of research with respect to: (1) improving the treatment and management of symptoms and side effects associated with cancer and cancer treatment; and (2) evaluating the role of nursing interventions in the amelioration of such symptoms and side effects. Requires the NIH Director to make nursing intervention research grants for studying cancer symptom management care and services delivered by registered nurses. Directs the Secretary of Health and Human Services to enter into an arrangement under which the Institute of Medicine of the National Academy of Sciences shall evaluate and report to the Secretary and Congress on the current state of symptom management, patient treatment education, and supportive care given to people with cancer.

Recognizes that: (1) the overall progress being made on the ground in Iraq is undeniable; (2) much of this progress is due to the skill and valor of the American service member; and (3) the decision by the President and our military leadership to provide a surge of troops to implement a new counterinsurgency strategy was the correct course of action.

Entitles federal employees who satisfy age and service requirements for immediate or early retirement under the Federal Employees' Retirement System or the Foreign Service Pension System and who are separated from service or transferred to a position not subject to either of those retirement systems to a lump-sum payment for 15% of the amount of their accumulated sick leave exceeding 500 hours. Prohibits such a payment from exceeding $10,000. Excludes hours of sick leave that are creditable in the computation of any other compensation or benefit.

Generations Invigorating Volunteerism and Education Act, or the GIVE Act - Amends the National and Community Service Act of 1990 (NSCA) and the Domestic Volunteer Service Act of 1973 (DVSA) to revise the programs under such Acts and reauthorize appropriations for such programs through FY2012. Revises under NSCA: (1) the School-Based and Community-Based Service-Learning programs and Higher Education Innovative Programs for Community Service (Learn and Serve programs); (2) National Service Trust programs (AmeriCorps); (3) the National Civilian Community Corps (NCCC); and (4) the Investment for Quality and Innovation program. Eliminates the current Community-Based Learn and Serve programs. Establishes a new Learn and Serve program, Innovative Service-Learning Programs and Research, providing matching grants to: (1) provide community service-learning opportunities to elementary and secondary, college, and graduate students, including summer of service programs; and (2) research and evaluate service-learning. Includes among eligible AmeriCorps programs: (1) an E-corp program increasing community access to technology; (2) a program engaging citizens in public safety, health, and emergency preparedness services; (3) a youth mentoring program; (4) a program to reduce recidivism by re-engaging court-involved youth; and (5) the Education Awards Only program. Establishes an AmeriCorp pilot grant program for state-approved, member-selected, national service positions. Increases National Service educational awards for AmeriCorps, NCCC, and Volunteers in Service to America (VISTA) participants. Includes among needs to be met under the NCCC program, disaster relief, infrastructure improvement, environmental and energy conservation, and urban and rural development. Requires states to develop comprehensive plans for volunteer and paid service by Baby Boomers and older adults. Establishes an Office of Outreach and Recruitment in the Corporation for National and Community Service (Corporation). Requires the Corporation to plan pilot service programs to better utilize and serve veterans and displaced workers. Authorizes the Corporation to provide grants to innovative and model service programs that include service programs for disadvantaged youth. Eliminates federal funding for the Points of Light Foundation. Establishes a new Energy Conservation Corps program awarding: (1) matching grants to states for projects providing youth and young adults with career training in support of energy conservation, infrastructure and transportation improvement, and emergency operations; (2) competitive grants for school-based green Learn and Serve programs; and (3) competitive grants to National Senior Service Corps (Senior Corps) programs involving seniors in energy efficient housing, infrastructure rehabilitation, and environmental and energy conservation education projects. Revises under DVSA: (1) the VISTA program; and (2) the Senior Corps, including the Retired and Senior Volunteer program (RSVP), the Foster Grandparent program, and the Senior Companion program. Gives priority in VISTA participant selection to disadvantaged youth and retired adults of any profession. Authorizes new VISTA grant programs of national significance that provide poor and rural communities with: (1) services reintegrating formerly incarcerated individuals into society; (2) financial literacy and planning; (3) before-school and after-school services; (4) community economic development initiatives; (5) assistance to veterans and their families; and (6) health and wellness services. Eliminates the VISTA Literacy Corps, University Year for VISTA, and Literacy Challenge Grant programs. Raises the minimum and maximum stipend provided to VISTA participants. Prioritizes RSVP projects in specified areas. Makes anyone 55 years of age or older eligible as Senior Corps volunteers. Provides, under the Senior Corps demonstration program, incentive matching grants to Senior Corps programs that exceed specified performance measures, enroll most of their volunteers in outcome-based service programs, and increase their enrollment of Baby Boomer volunteers. Expresses the sense of the Congress that the number of AmeriCorps, VISTA, and NCCC participants should reach 100,000 by 2012. Congressional Commission on Civic Service Act - Establishes a Congressional Commission on Civic Service to provide recommendations to Congress on improving opportunities for individuals to volunteer or perform national service. Expresses the sense of Congress that the Corporation should try to: (1) coordinate its service programs so that senior citizens and their grandchildren can share volunteer opportunities and/or be assigned to the same geographic area; and (2) work with the National Endowment for the Humanities to provide opportunities for young service participants to collect oral histories from senior citizens.

Credit Card Fair Fee Act of 2008 - Authorizes providers of a single covered electronic payment system (e.g. Visa or Mastercharge credit cards) and any merchants to jointly negotiate and agree upon rates and terms for access to such a system. Defines covered electronic payment system as any system that has been used for at least 20% of the combined dollar value of U.S. credit, signature-based debit, and PIN-based debit card payments processed in the applicable base year. Grants limited antitrust immunity to such providers and merchants, as well as to those providers who jointly determine among themselves the proportionate division of paid access fees. Sets forth procedures to determine rates and terms for access to a covered electronic payment system. Prohibits any other rates and terms from being imposed upon a merchant for accessing a covered electronic payment system except as specified in a voluntarily negotiated access agreement. Creates a panel of three full-time Electronic Payment System Judges, appointed by the Antitrust Division of the Department of Justice and the Federal Trade Commission Bureau of Competition, to determine the schedule of rates and terms for three-year periods. Subjects any determination of such Judges to judicial review. Authorizes providers and merchants to engage in voluntarily negotiated access agreements. Declares that such voluntarily negotiated access agreements shall be given effect with respect to the signatories in lieu of any determination by the Judges.

Volunteer Firefighter Tax Relief Act of 2008- Amends the Internal Revenue Code to allow volunteer firefighters a tax deduction from gross income for personal safety clothing (including helmets and boots) used in performing fire fighting services.

Bear Protection Act of 2008 - Amends the Lacey Act Amendments of 1981 to make it unlawful for any person to import, export, transport, sell, receive, acquire, or purchase in interstate or foreign commerce bear viscera. Defines "bear viscera" as the body fluids or internal organs of a bear, including its gallbladder and excluding its blood or brains. Provides that this Act does not affect the regulation by any state of its bear populations or affect the hunting of bears that is lawful under state laws.

Federal Land Asset Inventory Reform Act of 2008 - Directs the Secretary of the Interior to develop a multipurpose cadastre of federal real property (an inventory of real property of the federal government) to assist with federal land management, resource conservation, environmental protection, and use of real property. Authorizes the Secretary to enter into cost-sharing agreements with states to include any non-federal lands in a state in such cadastre. Limits the federal share of any such agreement to 50% of the total cost to a state for the development of the cadastre of the non-federal lands in the state. Requires the Secretary to submit a report on: (1) existing real property inventories or any components of any cadastre; (2) consolidation of inventories and components; (3) the use of existing inventories and components of any cadastre; (4) the cost savings that will be achieved; and (4) recommendations for legislation.

Officer Daniel Faulkner Children of Fallen Heroes Scholarship Act of 2008 - Amends the Higher Educaton Act of 1965 to eliminate the expected family contribution used in determining Pell Grant eligibility in the case of a student applicant whose parent or guardian died as a result of performing service as a police officer, firefighter, or other first responder.

Expresses concern about the safety and well-being of innocent civilians in Chad and the refugees from Darfur and the Central African Republic. Condemns Sudanese President Omar al-Bashir and the National Congress Party for their support of the armed rebellion in Chad. Calls on all parties to seek a negotiated settlement. Calls on the President to: (1) continue U.S. humanitarian assistance to the refugees and internally displaced persons in Chad and the Central African Republic; (2) provide support to strengthen democratic institutions and respect for human rights; and (3) seek punitive measures against the government of Sudan by the U.N. Security Council for its aggression and destructive activities in Chad and the region.

Global Autism Assistance Act of 2008 - Directs the Administrator for the United States Agency for International Development (USAID) to establish and administer a health and education grant program (Global Autism Assistance Program) to: (1) support activities by nongovernmental organizations and other service providers, including advocacy groups, focused on autism in developing countries; and (2) establish a "teach the teachers" program to train health and education professionals working with autistic children in developing countries.

Improper Payments Elimination and Recovery Act of 2008 - Amends the Improper Payments Information Act of 2002 to require the head of each federal agency to: (1) annually review all agency programs and identify those programs and activities that may be susceptible to significant improper payments; and (2) report on agency actions to reduce and recover improper payments. Defines "improper payment" as any payment that should not have been made, that was made in an incorrect or duplicate amount, or that was made to an ineligible recipient. Requires the Director of the Office of Management and Budget (OMB) to: (1) provide guidance to agencies for reducing improper payments, addressing risks, and establishing appropriate prepayment and postpayment internal controls; and (2) prepare an annual report with an identification of the compliance status of each agency in identifying improper payments and the delinquent programs responsible for the agency's status. Requires federal agencies with outlays of $1 million or more to conduct a recovery audit of all programs and activities to assist in recouping improper payments. Requires: (1) each agency's Inspector General to report each fiscal year on agency compliance with the Improper Payments Information Act of 2002 and this Act; (2) the head of an agency determined not to be in compliance for two consecutive fiscal years to reprogram available funds to achieve compliance; and (3) an agency determined not to be in compliance for three consecutive fiscal years, with a delinquent program reported for two of those years consecutively, to transfer 5% of the appropriations for each of delinquent program to the Treasury. Suspends appropriations to agencies that have a program that reports an improper payment rate greater than 15% for three consecutive fiscal years until the agency's Inspector General certifies that sufficient changes have been implemented to warrant resumed authorization of appropriations.

Strategic Petroleum Reserve Fill Suspension and Consumer Protection Act of 2008 - Directs the Secretary of Energy to suspend, during calendar year 2008, petroleum acquisition for the Strategic Petroleum Reserve (SPR) through the royalty-in-kind program or any other acquisition method. Authorizes resumption of such acquisition during calendar 2008 not earlier than 30 days after the Secretary notifies Congress that the weighted average price of petroleum in the United States for the most recent 90-day period is $50 or less per barrel.

Foreign Intelligence Surveillance Act of 1978 Amendments Act of 2008 or FISA Amendments Act of 2008 - Amends the Foreign Intelligence Surveillance Act of 1978 (FISA) to authorize the Attorney General (AG) and Director of National Intelligence (DNI) to jointly authorize, for periods up to one year, the targeting (electronic surveillance) of persons located outside the United States in order to acquire foreign intelligence information, under specified limitations and requirements. Authorizes the AG and DNI to direct an electronic communication service provider to: (1) immediately provide the government with all information, facilities, and assistance necessary to accomplish an acquisition of communications; and (2) maintain under security procedures any records concerning such acquisition. Requires the AG and DNI, at least every six months, to: (1) assess compliance with required targeting and minimization procedures; and (2) submit assessment results to the Foreign Intelligence Surveillance Court (Court) and the congressional intelligence committees. States that FISA and the procedures of chapters 119 (Wire and Electronic Communications Interception and Interception of Oral Communications), 121 (Stored Wire and Electronic Communications and Transactional Records Access), and 206 (Pen Registers and Trap and Trace Devices) of the federal criminal code shall be the exclusive means by which electronic surveillance and the interception of domestic wire, oral, or electronic communications may be conducted. Allows the AG to authorize the emergency employment of electronic surveillance if the AG, among other things: (1) determines that an emergency exists; (2) informs a Court judge of such determination; and (3) applies for a Court order authorizing such surveillance. Requires the AG, after authorizing the installation and use of a pen register or trap and trace device on an emergency basis, to apply to the Court for an authorization order within seven days (current law requires 48 hours) after the emergency installation and use. Authorizes the Court to sit en banc when: (1) necessary to secure or maintain uniformity of Court decisions; or (2) the proceeding involves a question of exceptional importance. Authorizes the acquisition of foreign intelligence information in order to prevent the international proliferation of weapons of mass destruction. Prohibits: (1) civil actions against a communication service provider, or individual other than such a provider, furnishing surveillance assistance requested from an element of the intelligence community; and (2) a state from conducting investigations, imposing sanctions, or commencing or maintaining a civil action or other proceeding against a provider furnishing requested assistance.

Paul D. Wellstone Muscular Dystrophy Community Assistance, Research, and Education Amendments of 2008 - Amends the Public Health Service Act to designate centers of excellence for research on various forms of muscular dystrophy as Paul D. Wellstone Muscular Dystrophy Cooperative Research Centers. Requires the Muscular Dystrophy Interagency Coordinating Committee to give special consideration to enhancing the clinical research infrastructure required to test emerging therapies for the various forms of muscular dystrophy. Requires the Secretary of Health and Human Services to ensure that any data on patients that is collected as part of the Muscular Dystrophy Surveillance, Tracking and Research Network (MD STARnet) is regularly updated to reflect changes in patient condition over time. Requires the Director of the Centers for Disease Control and Prevention (CDC) to: (1) report to the appropriate congressional committees on MD STARnet and data collection; and (2) provide prospective health outcome data on the health and survival of people with muscular dystrophy. Requires the Director of CDC, in carrying out a program to provide information and education on muscular dystrophy to health professionals and the general public, to: (1) partner with leaders in the muscular dystrophy patient community; and (2) widely disseminate the Duchenne-Becker muscular dystrophy care considerations. Requires the Director of the Agency for Healthcare Research and Quality to: (1) evaluate the available scientific evidence to develop and issue an initial set of care considerations for Duchenne-Becker muscular dystrophy and provide ongoing review and updates where appropriate; and (2) replicate the same methodology used to develop such care considerations as a model for other muscular dystrophies.

Ronald Reagan Centennial Commission Act - Establishes the Ronald Reagan Centennial Commission to: (1) plan and carry out activities to honor Ronald Reagan on the occasion of the 100th anniversary of his birth; (2) provide assistance to federal, state, and local governmental agencies and civic groups to carry out such activities; and (3) study other federal activities to honor Ronald Reagan, including the issuance of a postal stamp, the issuance of a $1 coin for one year, and the convening of a joint session of Congress.

Montgomery GI Bill Educational Assistance Transferability Act of 2008 - Amends the Montgomery GI Bill educational assistance program to authorize the Secretary of the military department concerned to permit any member of the Armed Forces (currently, only members with critical military skills) entitled to basic educational assistance to elect to transfer a portion of such assistance to one or more dependents. Removes the 18-month limitation on the number of months of entitlement authorized to be transferred. Provides similar eligibility for the transfer of educational assistance for members of the Selected Reserve who have completed at least six years of service and enter into an agreement to remain a member of such Reserve for at least four more years.

Semper Fi Act - Rescinds all amounts appropriated by the Consolidated Appropriations Act, 2008 for the city of Berkeley, California, or entities in such city. Transfers the rescinded amounts to the Operation and Maintenance, Marine Corps account of the Department of Defense (DOD) for FY2008, to be used for recruiting.

Condemns the City Council of Berkeley, California, for impugning the integrity and professionalism of the Marine Corps. Recommends that any special federal projects funding provided under the Consolidated Appropriations Act, 2008, for Berkeley be rescinded. Recognizes: (1) the service and sacrifices of members of the Armed Forces and their families; and (2) the efforts of the United States Marine Corps Recruiting Command. Commends the unique and significant role the Marine Corps has played in upholding U.S. freedom and security. Reaffirms a commitment to ensuring that policy disagreements do not compromise the honor and sacrifice of serving military personnel.

International Education Leadership Act of 2008 - Amends the Department of Education Organization Act to establish, in the Department of Education, an Office of International and Foreign Language Education, headed by an Assistant Secretary for International and Foreign Language Education with extensive experience in international and foreign language instruction. Makes the Assistant Secretary responsible for: (1) promoting the study of foreign languages and cultures at the elementary, secondary, and postsecondary levels; (2) administering the Department's programs on international and foreign language education and research, and its activities in international affairs; and (3) coordinating such programs with other related federal programs.

Condemns the ongoing Iranian-enabled rocket attacks on Israeli civilians and places responsibility for launching the attacks on Hamas and other terrorist organizations in Gaza. Supports the government of Israel's right to defend its territory. Recognizes the difficult balance Israel faces with the competing pressures of being the primary supplier of numerous necessities for Palestinian civilians, even while rockets are being fired at Israel from Palestinian areas. Supports Palestinian civilians who reject Hamas and all forms of terrorism. Reaffirms the friendship between the governments and the people of Israel and the United States.

Combat Veterans Debt Elimination Act of 2008 - Prohibits the Secretary of Veterans Affairs from collecting debts owed to the United States by certain members of the armed forces or veterans who die as a result of an injury incurred or aggravated on active duty in a war or a combat zone after September 11, 2001. Excepts any amounts owed the United States under federal housing and small business loan programs from such prohibition on debt collection.

Lance Corporal Jeremy Burris Act - Amends the federal criminal code to modify the prohibition against destruction of veterans' memorials to include destruction of the grave, headstone, or marker of any person in the Armed Forces and to extend such prohibition to memorials, graves, headstones, or markers on private as well as public property.

Condemns the People's Republic of China (PRC) for producing unsafe products, disregarding the environment, and exploiting workers. Encourages: (1) U.S. merchants to suspend the importation and sales of goods from the PRC until reforms are made; and (2) U.S. parents to consider the "Made in China" label when purchasing toys due to potential high levels of toxic materials that may cause serious injury or death.

Josh Miller Helping Everyone Access Responsive Treatment in Schools Act of 2007, or the Josh Miller HEARTS Act - Amends the Elementary and Secondary Education Act of 1965 to direct the Secretary of Education to award matching grants to local educational agencies (LEAs) to: (1) purchase automated external defibrillators (AEDs) for use in their schools; and/or (2) provide training to meet the requirement that at least five adult employees or volunteers at each school with an AED successfully complete training in its use and in cardiopulmonary resuscitation (CPR). Requires LEA grant applicants also to demonstrate that: (1) the AEDs are integrated into the schools' medical emergency response procedures; and (2) emergency services personnel are notified of their locations.

National Guardsmen and Reservists Parity for Patriots Act - Amends the National Defense Authorization Act for Fiscal Year 2008 to back-date to September 11, 2001, the period of active duty or performed active service, in support of a contingency operation or in other emergency situations, for which members of Ready Reserve components of the armed forces shall receive credit in determining eligibility for early receipt of non-regular service retired pay.

Amends the Federal Law Enforcement Pay Reform Act of 1990 to revise the special pay adjustments for (percentage differentials payable to) federal law enforcement officers in specified consolidated metropolitan statistical areas. Includes Capitol Police as law enforcement officers under such Act. Eliminates the limitation on the aggregate of basic pay and premium pay with respect to availability pay for federal criminal investigators.
