Traumatic Brain Injury Act of 2008

Reauthorization of the Traumatic Brain Injury Act - Amends the Public Health Service Act to revise the national program for traumatic brain injury registries to include grants for state traumatic brain injury surveillance systems. Requires the Secretary of Health and Human Services, acting through the Director of the Centers for Disease Control and Prevention (CDC) , to conduct a study to: (1) determine the incidence of traumatic brain injury and prevalence of traumatic brain injury related disability; (2) report national trends in traumatic brain injury; (3) identify common therapeutic interventions which are used for the rehabilitation of individuals with such injuries; (4) identify interventions and therapies that can prevent or remediate the development of secondary neurologic conditions related to traumatic brain injury; and (5) develop practice guidelines for such rehabilitation. Authorizes appropriations for FY2008-FY2011 for the National Institutes of Health's (NIH) trauma research program. Allows the Secretary, acting through the Administrator of the Health Resources Services Administration (HRSA), to make grants to states and American Indian consortia (currently, only states) to improve access to rehabilitation (currently, health) and other services regarding traumatic brain injury. Requires the Administrator and the Commissioner of the Administration on Developmental Disabilities to coordinate the collection of data regarding protection and advocacy services. Directs the Administrator to make a grant for training and technical assistance to protection and advocacy systems, if funds permit.

District of Columbia Personal Protection Act - Amends specified law prohibiting the killing of wild birds and wild animals in the District of Columbia to declare that nothing in it or any other provision of law shall authorize or be construed to permit the Council, the Mayor, or any governmental or regulatory authority of the District to prohibit, constructively prohibit, or unduly burden the ability of persons otherwise not prohibited from possessing firearms under federal law from acquiring, possessing in their homes or businesses, or using for sporting, self-protection or other lawful purposes, any firearm neither prohibited by federal law nor subject to the National Firearms Act. Denies the District any authority to enact laws or regulations that discourage or eliminate the private ownership or use of firearms. Amends the Firearms Control Regulations Act of 1975 to repeal the definition of a machine gun as any firearm which shoots, is designed to shoot, or can be readily converted or restored to shoot semiautomatically, more than 12 shots without manual reloading. (Thus repeals the ban on semiautomatic weapons.) Redefines "machine gun" to include the frame or receiver of any such weapon, any part designed and intended solely and exclusively, or combination of parts designed and intended, for use in converting a weapon into a machine gun, and any combination of parts from which a machine gun can be assembled if such parts are in the possession or under the control of a person. Repeals the District's: (1) registration requirement for possession of firearms; (2) prohibition on possession of handgun restricted pistol bullets; and (3) requirement that, under certain conditions, firearms in the possession of certain individuals must be kept unloaded, disassembled, or with the trigger locked. Repeals the definition of restricted pistol bullet as any bullet designed for use in a pistol which, when fired from a pistol with a barrel of five inches or less in length, is capable of penetrating commercially available body armor with a penetration resistance equal to or greater than that of 18 layers of kevlar. Maintains the current ban on the possession and control of a sawed-off shotgun, machine gun, or short-barreled rifle. Eliminates criminal penalties for possessing an unregistered firearm. Amends federal law to eliminate criminal penalties for carrying a pistol whether loaded or unloaded in one's dwelling house, place of business, or on land possessed by such person. Amends the District of Columbia Code to extend to firearms generally (currently, only to pistols) the prohibition against carrying such a weapon either openly or concealed within the District without a license issued pursuant to D.C. law. Specifies exceptions to the prohibition against carrying concealed weapons in the District.

Provides that such exclusion shall not: (1) impose liability under the Emergency Planning and Community Right-To-Know Act of 1986 with respect to manure; (2) affect any provision of the Air Quality Agreement entered into between the Administrator and operators of animal feeding operations; or (3) affect the applicability of any other environmental law as it relates to the definition of manure or the responsibilities or liabilities of any person regarding the treatment, storage, or disposal of manure. Amends the Superfund Amendments and Reauthorization Act of 1986 to exempt releases associated with manure (as defined under CERCLA) from the emergency notification requirements under that Act.

Iran Counter-Proliferation Act of 2007

Iran Counter-Proliferation Act of 2007 - States that nothing in this Act shall be construed as authorizing the use of force or the use of the U.S. Armed Forces against Iran. Subjects, with respect to prohibited transactions with Iran, a parent company to penalties for violations committed by certain subsidiaries outside the United States that would be subject to prohibitions if committed inside the United States or by a U.S. person. Establishes specified additional import and export sanctions against Iran. Amends the Iran Sanctions Act of 1996 to require the imposition of procurement sanctions as part of the sanctions against a person contributing to Iran's petroleum resources. Directs the President to report every six months to the appropriate congressional committees (committees) respecting investment activity that could contribute to Iran's development of petroleum resources, and U.S. steps in response to such activity. Expands the definitions of "petroleum resources" and "person." Eliminates the national security waivers for imposition of sanctions. Directs the President to determine and report to the committees whether the the Islamic Revolutionary Guards Corps should be: (1) designated as a foreign terrorist organization; (2) placed on the list of designated global terrorists; and (3) placed on the list of weapons of mass destruction proliferators and their supporters. Authorizes appropriations for the Department of the Treasury's Office of Terrorism and Financial Intelligence. Authorizes the President to carry out exchange programs with the people of Iran. Directs the President to reduce annual U.S. contributions to the International Bank for Reconstruction and Development (World Bank) based upon Bank amounts provided to entities and projects in Iran. Restricts nuclear cooperation with countries assisting Iran's nuclear program or transferring advanced conventional weapons or missiles to Iran. Amends the Internal Revenue Code to eliminate specified geological and geophysical expense amortization benefits if petroleum-related sanctions are imposed under the Iran Sanctions Act of 1996 on any member of an expanded affiliated group whose common parent is a foreign corporation. Revises the definition of "affiliated group." States that specified restrictions respecting Iran shall not have effect if the President determines and certifies to the committees that Iran: (1) has ended efforts to develop or acquire nuclear, chemical, or biological weapons, or ballistic missiles; (2) has been removed from the list of countries supporting international terrorism; and (3) poses no significant threat to U.S. national security, interests, or allies.

Higher Education Affordability and Equity Act of 2007 - Amends the Internal Revenue Code to: (1) repeal the dollar limitation on the tax deduction for interest on education loans and expand eligibility for such deduction by revising the modified adjusted gross income phaseout for such deduction; (2) make the tax deduction for qualified tuition and related expenses permanent; (3) increase from $2,000 to $5,000 the maximum allowable contribution to a Coverdell savings account; (4) exclude from gross income amounts received for qualified higher education expenses (e.g., books, supplies, room, board, and special needs services); and (5) allow certain additional expenses (e.g., fees, books, supplies, and equipment) for purposes of the Hope Scholarship Tax Credit and provide that such tax credit shall not be reduced by Federal Pell Grants and Supplemental Educational Opportunity (SEOG) Grants. Repeals the sunset provisions of the Economic Growth and Tax Relief Reconciliation Act of 2001 (EGTRRA) applicable to title IV, subtitles A, B, and D (Affordable Education Provisions) of such Act.

Endangered Species Recovery Act of 2007- Amends the Internal Revenue Code to allow certain landowners whose property contains the habitat of an endangered or threatened species and who enter into a habitat protection agreement a tax credit for costs relating to habitat protection easements and restoration. Places limits on the amount of such credit for calendar years 2008, 2009, 2010, 2011, and 2012. Directs the Comptroller General of the United States to study and report to Congress on the effectiveness of such credit. Allows a tax deduction for expenditures related to recovery plans approved by the Endangered Species Act of 1973. Excludes from gross income certain payments under: (1) the Partners for Fish and Wildlife Program authorized by the Partners for Fish and Wildlife Act; and (2) the Landowner Incentive Program, the State Wildlife Grants Program, and the Private Stewardship Grants Program authorized by the Fish and Wildlife Act of 1956.

Freedom of Information Act Amendments of 2007 - Amends the Freedom of Information Act (FOIA) to prohibit a federal agency from denying a requester status as a news media representative for purposes of determining FOIA request processing fees solely on the absence of institutional association. Requires an agency to consider the requester's prior publication history or stated intent to distribute information to a reasonably broad audience. Provides that, for purposes of recovery of attorney fees and other litigation costs under FOIA, a complainant has substantially prevailed if the complainant has obtained relief through either: (1) a judicial order, an administrative action, or an enforceable written agreement or consent decree; or (2) a voluntary or unilateral change in position by the opposing party in a case in which the complainant's claim or defense was not frivolous. Directs the Attorney General to notify the Special Counsel of and report to Congress on civil actions taken for arbitrary and capricious rejections of requests for agency records. Prohibits the tolling of the time limit within which agencies determine whether to comply with a request for records without the consent of the party filing the request. Requires agencies to establish systems to track requests. Adds requirements for reports by agencies to the Attorney General on such requests. Establishes the Office of Government Information Services in the National Archives to: (1) provide, as a non-exclusive alternative to litigation, guidance to FOIA requesters; (2) review policies and procedures by administrative agencies under FOIA; and (3) recommend to Congress and the President policy changes to improve FOIA's administration. Requires the: (1) Comptroller General to annually report on implementation of provisions for the protection of voluntarily shared critical infrastructure information; and (2) Office of Personnel Management to report on personnel policies related to FOIA. Declares that the government's policy is to release information in response to a request if such release is: (1) required by law; or (2) allowed by law and the agency does not reasonably foresee that disclosure would be harmful to an interest protected by an applicable exemption.

Requires at least semiannual inspections of, and appropriate repairs to, any such quarters, as well as alternate housing during periods of unremedied housing deficiencies. Outlines requirements to be implemented for recovering servicemembers and their families, including: (1) physical disability evaluation system changes; (2) supervising officer and caseworker support; (3) increased training for caseworkers and social workers on particular servicemember conditions, including post-traumatic stress disorder (PTSD); (4) increased support services, including an Ombudsman for Recovering Servicemembers; (5) a prohibition on discrimination in employment of family members caring for such servicemembers; and (6) meal benefits for recovering servicemembers and family members caring for such servicemembers. Establishes the Oversight Board for the Wounded.

Applies such prohibition only if the individual asserting the rights knew or had reason to know at the time of acquiring the rights asserted that the mark or name was the same or substantially similar to the mark or name used in connection with the business or assets that were confiscated.

Requires the Secretary to award grants to: (1) support arthritis-specific research projects at the Centers for Prevention Research by the CDC; (2) support state comprehensive arthritis control and prevention programs and public health surveillance, prevention, and control activities; and (3) assist in the implementation of a national strategy for arthritis control and prevention. Requires the Secretary to coordinate a national education and outreach program on arthritis and other rheumatic diseases. Requires the Secretary to establish an Arthritis and Rheumatic Diseases Interagency Coordinating Committee to: (1) improve coordination of federal research activities related to arthritis and rheumatic diseases; and (2) convene a summit to provide a detailed overview of such current federal research. Requires the Director of the National Institutes of Health (NIH) to expand and intensify juvenile arthritis research. Allows the Secretary, acting through the Director of the CDC, to award grants to support juvenile arthritis data collection. Requires the Secretary, acting through the Director of the CDC, to support the development of a National Juvenile Arthritis Patient Registry. Requires the Secretary to promote and support pediatric rheumatology training, including by allowing the Secretary to establish a loan repayment program. Requires the Comptroller General to conduct a study on the economic impact of arthritis in the workplace.

Requires the Archivist of the United States to make such information available to the public through the Internet as soon as is practicable after each quarterly filing. Prohibits knowing and willful submissions of false information or omissions of material information by contributors or the fundraising organization. Prescribes criminal penalties for violation of such prohibitions.

Confines existing payment limitations to diagnostic magnetic resonance imaging (MRI), computed tomography (CT), positron emission tomography (PET) (all specified under current law), plus nuclear cardiology procedures. Imposes a two-year moratorium, however, on the application of existing payment limitations for such services. Directs the Comptroller General to study and report to Congress and the Secretary of Health and Human Services on patient access and service issues relating to the availability and quality of advanced diagnostic imaging services in physician offices and freestanding clinics that would have resulted (but for the moratorium declared by this Act) from payment changes made under the Deficit Reduction Act of 2005.

Requires the Comptroller General to study and report to Congress on the wage equalization and recruitment and retention of direct support professionals who are providing services and supports to individuals with disabilities.

Presidential Records Act Amendments of 2007 - Amends the Presidential Records Act to require the Archivist of the United States, when making available any presidential record not previously made available publicly, to: (1) promptly provide written notice of such determination to the former President during whose term of office the record was created and to the incumbent President; and (2) make the notice available to the public. Requires such a record to be made available upon the expiration of a specified period, except any record with respect to which the Archivist receives notification from a former or incumbent President of a claim of constitutionally based privilege against disclosure. Authorizes a former or an incumbent President to extend such period for a specified time. Requires: (1) any claim to be asserted personally by a former or incumbent President; and (2) a former or incumbent President to notify the Archivist and specified Congressional committees of a privilege claim. Prohibits the Archivist from making publicly available a presidential record that is subject to a privilege claim asserted by the incumbent President unless: (1) the incumbent President withdraws the privilege claim; or (2) the Archivist is otherwise directed by a final court order that is not subject to appeal. Sets forth provisions that state when such a prohibition is inapplicable. Provides that Executive Order 13233, dated November 1, 2001 (establishing a process for review of presidential records and assertion of privilege claims), shall have no force or effect.

Sets forth additional monetary penalties for related violations. Prohibits federal facilities from purchasing or otherwise acquiring dogs or cats for exhibition purposes except from: (1) the operator of an auction that comports with legal requirements; or (2) a person holding a valid dealer or exhibitor license. Prohibits dealers from selling or otherwise providing a research facility with random source dogs or cats unless specified certification requirements are met.

Requires the Secretary to terminate individual proficiency testing that was in effect before enactment of this Act.

Keep Our Promise to America's Military Retirees Act - Directs the Secretary of Defense to enter into an agreement with the Office of Personnel Management to provide Federal Employees Health Benefits (FEHB) coverage to the following eligible beneficiaries: (1) a member or former member of the Armed Forces entitled to military retired or retainer pay; (2) an unremarried former spouse who was married to a member for at least 20 years, during which such member performed at least 20 years of retirement-creditable military service; (3) a dependent of a deceased qualifying member or former member; (4) a dependent of a living member or former member; and (5) a family member. Directs the Secretary to reimburse such eligible persons for pharmacy benefits received from a pharmacy that is not a TRICARE (Department of Defense managed health care plan) network pharmacy in the same manner as the Secretary would reimburse such person for such benefits received from a TRICARE network pharmacy. Requires such persons, in order to receive such reimbursement, to submit a certification from their physician stating that the person does not have access to a TRICARE network pharmacy due to physical or medical constraints.

Kidney Care Quality and Education Act of 2007 - Directs the Secretary of Health and Human Services to establish demonstration projects to: (1) increase public awareness about the factors that lead to chronic kidney disease, how to prevent it, how to treat it, and how to avoid kidney failure, as well as enhance surveillance systems and expand research to better assess the prevalence and incidence of kidney disease; and (2) enable individuals with end-stage renal disease (ESRD) to develop self-management skills. Amends title XVIII (Medicare) of the Social Security Act (SSA) to provide for Medicare coverage of kidney disease patient education services. Directs the Secretary to: (1) establish blood flow monitoring demonstration projects; and (2) arrange with the Institute of Medicine of the National Academy of Sciences to evaluate the barriers to increasing the number of individuals with ESRD who elect to receive home dialysis services or other treatment modalities under Medicare. Sets forth required training for patient care dialysis technicians. Directs the Secretary to establish an independent, multidisciplinary, nonpartisan End-Stage Renal Disease Advisory Committee. Establishes the annual update framework for the Medicare ESRD composite rate. Directs the Secretary to establish a three-year continuous quality improvement initiative under which quality payments are provided to renal dialysis facilities, providers of services, and physicians that: (1) provide items and services to individuals with ESRD enrolled under Medicare part B (Supplementary Medical Insurance); and (2) meet quality benchmarks and demonstrate quality improvements. Requires the Secretary to make quality incentive payments to facilities and providers whose services to individuals with ESRD have substantially improved or exceeded a certain threshold. Extends Medicare as secondary payer with respect to individuals with ESRD.

Requires the Director of CDC to: (1) enter into a cooperative agreement with such consortium to develop, implement, and manage a system for lupus data collection and analysis; and (2) ensure that such consortium represents different geographic areas and includes individuals of racial and ethnic backgrounds disproportionately affected by lupus. Requires the Secretary to enter into a contract with the Institute of Medicine to study and make recommendations related to lupus, to include: (1) evaluating federal and state activities related to lupus and recommending ways to expand such activities; (2) identifying gaps in federal research; and (3) recommending ways to improve the quality of life for people with lupus. Requires the Secretary, acting through the Director of the Office on Women's Health, to conduct and support a national lupus public awareness and health professional education campaign, with an emphasis on reaching populations at highest risk for the disease.

Directs the Secretary to establish a demonstration project which allows the Secretary, acting through the Director of the Centers for Disease Control and Prevention (CDC), to waive, for two-year periods, requirements for awarding breast and cervical cancer grants that specify the percentage of grant funds to be spent on screening and referrals for medical treatments if certain requirements are met, including: (1) the state involved will use the waiver to leverage private funds to supplement screening and referral services or the application of such requirements would result in a barrier to the enrollment of women; and (2) the Secretary finds that granting such a waiver to a state will not adversely affect the quality of such services. Allows the Secretary to extend a waiver if the waiver requirements are and have been met. Requires the Secretary to include information on waivers as part of the evaluations of the activities carried out pursuant to breast and cervical cancer grants.
