Recalcitrant Cancer Research Act of 2012

Pancreatic Cancer Research and Education Act - Amends the Public Health Service Act to require the Secretary of Health and Human Services (HHS) to establish and implement a Pancreatic Cancer Initiative to assist in coordinating activities to address the high mortality rate associated with pancreatic cancer. Requires the Secretary to establish the Interdisciplinary Pancreatic Cancer Coordinating Committee to: (1) provide advice on overall research objectives and benchmarks for pancreatic cancer research; (2) develop and update not less than every five years a strategic plan for pancreatic cancer research awareness; and (3) conduct evaluations and make recommendations as needed to the Secretary, the Director of the National Institutes of Health (NIH), and the Director of the National Cancer Institute (NCI) regarding the prioritization and award of NIH research grants relating to pancreatic cancer. Requires the Secretary to develop a primary care provider education program on pancreatic cancer. Requires the Director of NCI and the Director of the Centers for Disease Control and Prevention (CDC) to develop a communication tool kit for patients and their families that focuses on specific pancreatic cancer issues relating to patient choices and patient care. Allows the Secretary to award grants to research institutions for use in developing innovative compounds or technologies for the prevention, early detection, or treatment of those cancers with five-year survival rates of less than 50%. Requires the Secretary to focus on pancreatic cancer during the initial five fiscal years of awarding such grants. Allows the Secretary to designate two additional Specialized Programs of Research Excellence focusing solely on pancreatic cancer research.

Prohibits the Administrator of the Environmental Protection Agency (EPA) from authorizing or allowing the introduction into commerce of gasoline that contains greater than 10-volume-percent ethanol for use in light-duty motor vehicles, including by granting a waiver for new fuels and fuel additives from the Clean Air Act's fuel standards. Includes within the definition of "light-duty motor vehicles" light-duty vehicles, light-duty trucks, and medium-duty passenger vehicles. Repeals any waiver granted under such Act prior to this Act's enactment that allows for the introduction into commerce of gasoline that contains greater than 10-volume-percent ethanol for use in such vehicles, including: (1) the "Partial Grant and Partial Denial of Clean Air Act Waiver Application Submitted by Growth Energy To Increase the Allowable Ethanol Content of Gasoline to 15 Percent; Decision of the Administrator" published on November 4, 2010, and (2) the "Partial Grant of Clean Air Act Waiver Application Submitted by Growth Energy To Increase the Allowable Ethanol Content of Gasoline to 15 Percent; Decision of the Administrator" published on January 26, 2011.

Government Neutrality in Contracting Act - Directs the head of any federal agency that awards or obligates funds for any construction contract, or that awards grants, provides financial assistance, or enters into cooperative agreements for construction projects, to ensure that bid specifications, project agreements, or other controlling documents do not: (1) require or prohibit a bidder, offeror, contractor, or subcontractor from entering into, or adhering to, agreements with a labor organization, with respect to that construction project or another related construction project; or (2) otherwise discriminate against or give preference to such a party because it did or did not become a signatory or otherwise adhere to such an agreement. Allows exemptions to avert an imminent threat to public health or safety or to serve national security. Allows additional exemptions for certain projects. Directs the Federal Acquisition Regulatory Council to amend the Federal Acquisition Regulation to implement this Act with respect to the applicable federal contracts.

SHIELD Act

Secure High-voltage Infrastructure for Electricity from Lethal Damage Act or SHIELD Act - Amends the Federal Power Act to authorize the Federal Energy Regulatory Commission (FERC), with or without notice, hearing, or report, to order emergency measures to protect the reliability of either the bulk-power system or the defense critical electric infrastructure whenever the President issues a written directive or determination identifying an imminent grid security threat. Directs FERC to consult with governmental authorities in Canada and Mexico regarding implementation of emergency measures. Prescribes: (1) implementation procedures; and (2) related cost recovery measures affecting owners, operators, or users of either the bulk-power system or the defense critical electric infrastructure. Directs FERC to require any owner, user, or operator of the domestic bulk-power system to implement measures to protect the system against specified vulnerabilities. Directs FERC also to order the Electric Reliability Organization (ERO) to submit reliability standards to: (1) protect the bulk-power system from a reasonably foreseeable geomagnetic storm event or electromagnetic pulse event (EMP); and (2) require entities that own or operate large transformers to ensure their adequate availability to restore promptly the reliable operation of the bulk-power system in the event of destruction or disability as a result of attack or a geomagnetic storm or EMP. Directs the Secretary of Energy to establish a program to: (1) develop technical expertise in the protection of electric energy systems against either geomagnetic storms or malicious acts using electronic communications or electromagnetic weapons; and (2) share it with owners, operators, or users of systems for the generation, transmission, or distribution of electric energy located in the United States and with state commissions. Exempts, for a specified period, the Tennessee Valley Authority and the Bonneville Power Administration from any requirement pertaining to either emergency response measures or measures to address grid security vulnerabilities.

Allows the Secretary, acting through the Director, to award grants to, and enter to contracts and cooperative agreements with, public or private nonprofit entities for the management of the Registry. Requires the Secretary, acting through the Administrator of the Agency for Toxic Substances and Disease Registry, to conduct pilot studies to determine which environmental factors may cause acquired bone marrow failure diseases. Requires the Secretary, acting through the Deputy Assistant Secretary for Minority Health, to: (1) establish outreach and information programs targeted to minority populations affected by such diseases; (2) undertake a coordinated outreach effort to connect Hispanic, Asian American, and Pacific Islander communities with comprehensive services focused on treatment of, and information about, such diseases; and (3) awards grants to, or enter into cooperative agreements with, entities to perform research on such diseases. Requires the Secretary, acting through the Director of the Agency for Healthcare Research and Quality (AHRQ), to award grants to entities to improve diagnostic practices and quality of care with respect to patients with such diseases.

Currency Reform for Fair Trade Act

Currency Reform for Fair Trade Act - Amends the Tariff Act of 1930 to include as a "countervailable subsidy" requiring action under a countervailing duty or antidumping duty proceeding the benefit conferred on merchandise imported into the United States from foreign countries with fundamentally undervalued currency. Defines "benefit conferred," in cases where the currency of a foreign country is exchanged for foreign currency (i.e., U.S. dollars) obtained from export transactions, as the difference between: (1) the amount of currency provided by a foreign country in which the subject merchandise is produced; and (2) the amount of currency such country would have provided if the real effective exchange rate of its currency were not fundamentally undervalued. Declares that the fact that such a subsidy is also provided in circumstances not involving export shall not, for that reason alone, mean it cannot be considered export contingent and actionable under a countervailing duty and antidumping duty proceeding. Requires the administering authority to determine that the currency of a foreign country is fundamentally undervalued if for an 18-month period: (1) the government of the country engages in protracted, large-scale intervention in one or more foreign exchange markets; (2) the country's real effective exchange rate is undervalued by at least 5%; (3) the country has experienced significant and persistent global current account surpluses; and (4) the country's government has foreign asset reserves exceeding the amount necessary to repay all its debt obligations falling due within the coming 12 months, 20% percent of the country's money supply, and the value of the country's imports during the previous 4 months. Requires the use, for calculating a country's "real effective exchange rate undervaluation," of certain guidelines of the Consultative Group on Exchange Rate Issues of the International Monetary Fund (IMF) or, if those guidelines are not available, generally accepted economic and econometric techniques and methodologies. Requires the use, also, of inflation-adjusted, trade-weighted exchange rates. Applies the amendments made by this Act to goods from Canada and Mexico.

Subjects such payments to specified conditions, including approved treatment. Requires the VA Secretary to notify each veteran with a service-connected injury or disability of the opportunity to receive such treatment. Requires the Secretaries to jointly: (1) develop and maintain a database containing data from each patient case involving the use of such treatments; and (2) report annually to Congress on the implementation of this Act.

Help Efficient, Accessible, Low Cost, Timely Healthcare (HEALTH) Act of 2011 - Sets conditions for lawsuits arising from health care liability claims regarding health care goods or services or any medical product affecting interstate commerce. Sets a statute of limitations of three years after the date of manifestation of injury or one year after the claimant discovers the injury, with certain exceptions. Limits noneconomic damages to $250,000. Makes each party liable only for the amount of damages directly proportional to such party's percentage of responsibility. Allows the court to restrict the payment of attorney contingency fees. Limits the fees to a decreasing percentage based on the increasing value of the amount awarded. Allows the introduction of collateral source benefits and the amount paid to secure such benefits as evidence. Prohibits a provider of such benefits from recovering any amount from an award in a health care lawsuit involving injury or wrongful death. Authorizes the award of punitive damages only where: (1) it is proven by clear and convincing evidence that a person acted with malicious intent to injure the claimant or deliberately failed to avoid unnecessary injury the claimant was substantially certain to suffer; and (2) compensatory damages are awarded. Limits punitive damages to the greater of two times the amount of economic damages or $250,000. Denies punitive damages in the case of products approved, cleared, or licensed by the Food and Drug Administration (FDA), or otherwise considered in compliance with FDA standards. Provides for periodic payments of future damages.

Protect Life Act - Amends the Patient Protection and Affordable Care Act (PPACA) to prohibit federal funds from being to used to cover any part of the costs of any health plan that includes coverage of abortion services. (Currently, federal funds cannot be used for abortion services and plans receiving federal funds must keep federal funds segregated from any funds for abortion services.) Requires any qualified health benefit plan offered through an Exchange that includes coverage for abortions to also offer a qualified health benefit plan through the Exchange that is identical in every respect except that it does not cover abortions. Prohibits a federal agency or program and any state or local government that receives federal financial assistance under PPACA from requiring any health plan created or regulated under PPACA to discriminate against any institutional or individual health care entity based on the entity's refusal to undergo training in the performance of induced abortions, require or provide such training, or refer for such training. Creates a cause of action for any violations of the abortion provisions of PPACA. Gives federal courts jurisdiction to prevent and redress actual or threatened violations of such provisions by issuing any form of legal or equitable relief, including injunctions and orders preventing the disbursement of all or a portion of federal financial assistance until the prohibited conduct has ceased. Gives standing to institute an action to affected health care entities and the Attorney General. Requires the Secretary of Health and Human Services to designate the Director of the Office for Civil Rights of the Department of Health and Human Services (HHS) to receive and investigate complaints alleging a violation of PPACA abortion provisions. Requires the Director of the Office of Personnel Management (OPM) to ensure that no multistate qualified health plan offered in an Exchange provides coverage of abortion services.

No Taxpayer Funding for Abortion Act - Prohibits the expenditure of funds authorized or appropriated by federal law or funds in any trust fund to which funds are authorized or appropriated by federal law (federal funds) for any abortion. (Currently, federal funds cannot be used for abortion services, except in cases involving rape, incest, or life endangerment.) Prohibits federal funds from being used for any health benefits coverage that includes coverage of abortion. (Thus making permanent existing federal policies.) Disallows any tax benefits for amounts paid or incurred for an abortion or for a health benefits plan that includes coverage of abortion, including any medical deduction for such amounts or any credit for such an employer-sponsored plan. Prohibits the inclusion of abortion in any health care service furnished by a federal or District of Columbia health care facility or by any physician or other individual employed by the federal government or the District. Provides that such prohibitions shall not apply to an abortion if: (1) the pregnancy is the result of forcible rape or, if the pregnant woman is a minor, incest; or (2) the woman suffers from a physical disorder, injury, or illness, including a life-endangering physical condition caused by or arising from the pregnancy itself, that would place her in danger of death unless an abortion is performed, as certified by a physician. Makes such prohibitions applicable to District funds. Codifies the prohibition against a federal agency or program or any state or local government that receives federal financial assistance from subjecting any individual or health care entity to discrimination on the basis that the health care entity does not provide, pay for, provide coverage of, or refer for abortions. Creates a cause of action for any violations of such provisions. Gives federal courts jurisdiction to prevent and redress actual or threatened violations of such provisions by issuing any form of legal or equitable relief, including an injunction or order preventing the disbursement of all or a portion of federal financial assistance until the prohibited conduct has ceased. Gives standing to institute an action to affected health care entities and the Attorney General. Law Enforcement Officers Equity Act - Amends the definition of the term "law enforcement officer" under provisions of the Federal Employees Retirement System (FERS) and the Civil Service Retirement System (CSRS) to include: (1) federal employees not otherwise covered by such term whose duties include the investigation or apprehension of suspected or convicted individuals and who are authorized to carry a firearm; and (2) such employees of the Internal Revenue Service (IRS) whose duties are primarily the collection of delinquent taxes and the securing of delinquent returns. Requires such service that is performed by an incumbent law enforcement officer: (1) on or after enactment of this Act to be treated for all purposes other than retirement as service performed as a law enforcement officer; and (2) before, on, or after enactment of this Act to be treated for federal retirement purposes as service performed as such an officer only if an appropriate written election is submitted to the Office of Personnel Management (OPM) within five years after enactment of this Act or before separation from government service, whichever is earlier. Provides that nothing under current law respecting mandatory separation from government service under CSRS or FERS shall cause the involuntary separation of an officer before the end of the three-year period following enactment.

Health Care Choice Act of 2011 - Amends the Public Health Service Act to provide that the laws of the state designated by a health insurance issuer (primary state) shall apply to individual health insurance coverage offered by that issuer in the primary state and in any other state (secondary state), but only if the coverage and issuer comply with the conditions of this Act. Exempts issuers from any secondary state's laws that would prohibit or regulate the operation of the issuer in such state, subject to certain restrictions imposed by such state. Specifies the notice that an issuer must provide in any insurance coverage offered in a secondary state and at renewal of the policy. Requires each issuer issuing individual health insurance coverage in both primary and secondary states to submit to the insurance commissioners of such states: (1) a copy of the plan of operation or feasibility study; (2) written notice of any change in its designation of its primary state and of its compliance with all the laws of the primary state; and (3) a quarterly financial statement. Prohibits an issuer from offering, selling, or issuing individual health insurance coverage in a secondary state if the state insurance commissioner does not use a risk-based capital formula for the determination of capital and surplus requirements for all issuers. Gives sole jurisdiction to the primary state to enforce the primary state's covered laws in the primary state and any secondary state. Requires the Comptroller General to study the effect of this Act on specified health insurance issues.

Excludes an abortion where: (1) the pregnancy is the result of an act of rape or an act of incest against a minor; or (2) a physician certifies that the woman suffered from a physical disorder, injury, or illness that would place the woman in danger of death unless an abortion is performed, including a condition caused by or arising from the pregnancy. Excludes hospitals from such requirement so long as the hospital does not provide funds to any non-hospital entity that performs an abortion. Requires the Secretary to annually provide Congress: (1) information on grantees who performed abortions under the exceptions; and (2) a list of entities to which grant funds are made available.
