Innovation Protection Act

Innovation Protection Act - Establishes in the Treasury the United States Patent and Trademark Office Public Enterprise Fund (Public Enterprise Fund) to be used as a revolving fund by the Director of the U.S. Patent and Trademark Office (USPTO) without fiscal year limitation. Requires to be credited to or deposited in the Public Enterprise Fund: (1) appropriations for defraying the costs of USPTO activities; (2) fees collected under federal patent and trademark laws; and (3) any unobligated balances remaining in the Patent and Trademark Office Appropriation Account and in the Patent and Trademark Fee Reserve Fund. (Thus, replaces the Patent and Trademark Office Appropriation Account, eliminates the Patent and Trademark Fee Reserve Fund, and provides a source of permanent funding for the USPTO.) Requires fees collected by the Director to remain available to the Director until expended. Makes the Public Enterprise Fund available to cover: (1) ordinary and reasonable administrative, operating, and other expenses incurred by the Director for the continued operation of USPTO services, programs, activities, and duties relating to patents and trademarks; and (2) expenses incurred pursuant to obligations, representations, or other commitments of the USPTO. Requires the Director, on an annual basis, to: (1) report to Congress with operation and spending plans, including financial details and staff levels broken down by each major activity; (2) provide for an independent audit of USPTO financial statements; and (3) submit a budget to the President.

Taxpayer Transparency Act of 2013 - Requires each communication funded by a federal agency for advertising or educational purposes to clearly state: (1) in the case of a printed communication, including mass mailings, signs, and billboards, that the communication is printed and published at taxpayer expense; and (2) in the case of a communication transmitted through radio, television, or the Internet, that the communication is produced and disseminated at taxpayer expense. Requires any such printed communication, including e-mails, to be of sufficient size to be clearly readable, to be set apart from the other contents of the communication, and to be printed with a reasonable degree of color contrast between the background and the printed statement. Exempts from such requirements: (1) information in a solicitation for offers for a federal contract; and (2) advertisements for employment opportunities, not including advertising materials developed for use in recruiting and retaining personnel for the Armed Forces.

Requires the rate of operations to be calculated to reflect the full amount of any reduction required in FY2013 pursuant to: (1) the Consolidated and Further Continuing Appropriations Act, 2013 (P.L. 113-6), and (2) the presidential sequestration order dated March 1, 2013, except as attributable to budget authority made available by the Disaster Relief Appropriations Act, 2013 (P.L. 113-2). Makes appropriations and funds made available and authority granted under this joint resolution available until whichever of the following first occurs: (1) enactment into law of an appropriation for any project or activity provided for in this joint resolution, (2) enactment into law of the applicable appropriations Act for FY2014 without any provision for such project or activity, or (3) September 30, 2014. Requires implementation of this joint resolution so that only the most limited funding action be taken in order to provide for continuation of projects and activities. Authorizes amounts made available for civilian personnel compensation and benefits to be apportioned up to the rate for operations necessary to avoid furloughs, consistent with the applicable appropriations Act for FY2013, except that such authority shall not be used until after the agency has taken all necessary actions to reduce or defer non-personnel-related administrative expenses.

Modernizing Our Drug & Diagnostics Evaluation and Regulatory Network Cures Act of 2013 or MODDERN Cures Act of 2013 - Requires the Secretary of Health and Human Services (HHS) to: (1) establish the Advanced Diagnostics Education Council to recommend standard terms and definitions related to innovative diagnostics for use by patients, physicians, health care providers, payers, and policy makers; and (2) publish a guide regarding such terms and definitions. Sets forth additional factors for the Secretary to consider in determining the payment amount for new clinical diagnostic laboratory tests under gap filling procedures which are used when no comparable existing test is available. Extends the exclusivity period for a medicine if the diagnostic test related to such drug has been determined by the Secretary to have been developed by, or with the participation of, the manufacturer or sponsor of the medicine, and use of the diagnostic tests provides for or improves: (1) the identification of a patient population for the medicine; or (2) the determination of the most appropriate treatment option for a patient population with the medicine. Establishes a dormant therapy designation for medicine that addresses unmet medical needs. Gives such medicine 15 years of data exclusivity under which no drug can be approved by relying on the approval or licensure of the dormant therapy. Directs the Secretary to arrange with the Institute of Medicine (or, if it declines, another appropriate entity) to study intellectual property laws and their impact on therapy and diagnostic development in order to formulate recommendations on how to facilitate the clinical evaluation and development of therapies currently available on the market for new potential indications.

Immediate Establishment of Syrian War Crimes Tribunal Resolution - Expresses the sense of Congress that: (1) the United States should urge the government of Syria and other groups involved in the civil war in Syria to implement an immediate cease fire and engage in negotiations to end the bloodshed; (2) the United States should declare that it is a requirement of basic justice that war crimes, crimes against humanity, and genocide, whether committed by officials of the government of Syria or members of other groups involved in the civil war in Syria, should be investigated and prosecuted; (3) the President should direct the U.S. representative to the United Nations (U.N.) to promote the establishment of a Syrian war crimes tribunal; (4) in working with other countries to establish a Syrian war crimes tribunal the United States should promote judicial procedures that enable the prosecution of the most culpable persons guilty of directing such crimes; (5) the United States should make an immediate priority the collection of information for use as evidence to support the indictment and trial of any person responsible for war crimes, crimes against humanity, or genocide in Syria; and (6) the United States should urge other interested states to apprehend and deliver into the custody of a Syrian war crimes tribunal persons indicted for war crimes, crimes against humanity, or genocide in Syria, and urge such states to provide relevant information to the tribunal.

Senator Paul Simon Water for the World Act of 2013 - Expresses the sense of Congress that: (1) the initial U.S. Agency for International Development (USAID) Water and Development Strategy is a significant accomplishment and improves USAID's capacity to provide sustainable and effective water, sanitation, and hygiene assistance; and (2) the Secretary of State, through the Special Advisor for Water Resources, should develop a Global Water Resources Strategy relating to U.S. foreign policy water objectives. Amends the Foreign Assistance Act of 1961 to direct: (1) the Administrator to designate a Global Water Coordinator to coordinate and oversee water, sanitation, and hygiene assistance; and (2) the Secretary of State to designate a Special Advisor for Water Resources to coordinate and oversee policy relating to water, hygiene, and sanitation assistance. Sets forth principles to ensure that water, sanitation, and hygiene projects carried out under the Foreign Assistance Act of 1961 and the Senator Paul Simon Water for the Poor Act of 2005 achieve maximum impact. Amends the Senator Paul Simon Water for the Poor Act of 2005 to direct: (1) the President, through the Secretary, to develop a strategy every five years to further the U.S. foreign policy objective to provide affordable and equitable access to safe water and sanitation in developing countries; and (2) the Administrator, through the Global Water Coordinator, to develop a complementary strategy to further the U.S. foreign assistance objective to provide affordable and equitable drinking water, sanitation, and hygiene in developing countries.

Marijuana Businesses Access to Banking Act of 2013 - Prohibits a federal banking regulator from: (1) terminating or limiting the deposit insurance of a depository institution solely because it either provides or has provided financial services to a marijuana-related legitimate business; or (2) prohibiting, penalizing, or otherwise discouraging a depository institution from providing financial services to a marijuana-related legitimate business. Prohibits a federal banking regulator, in addition, from recommending, motivating, providing incentives, or encouraging a depository institution not to offer financial services to an individual, or to downgrade or cancel financial services offered to an individual, solely because the individual: (1) is or later becomes a manufacturer, producer, owner or operator of a marijuana-related legitimate business; or (2) the depository institution was not aware that the individual is the owner or operator of a marijuana-related legitimate business. Prohibits a federal banking regulator from taking any action on a loan to an owner or operator of: (1) a marijuana-related legitimate business, or (2) real estate or equipment that is leased to a marijuana-related legitimate business. Grants immunity from federal criminal prosecution or investigation to a depository institution providing financial services to a marijuana-related legitimate business. Prohibits the Secretary of the Treasury from requiring a depository institution, and any director, officer, employee, or agent of a depository institution, to report a transaction as suspicious solely because a party to the transaction is a marijuana-related legitimate business.

Weather Forecasting Improvement Act of 2013 - Requires the Under Secretary of Commerce for Oceans and Atmosphere (and also the Administrator of the National Oceanic and Atmosphere Administration [NOAA]) to make certain weather-related activities concerning public safety and the national economy the top priority in the planning and management of programs within all relevant NOAA line offices. Directs the Assistant Administrator of the Office of Oceanic and Atmospheric Research (OAR) to: (1) undertake a program to develop an improved understanding of forecast capabilities for atmospheric events; (2) establish a tornado warning extension program; and (3) issue a plan for restoring U.S. leadership in weather modeling, prediction, and forecasting. Requires the Under Secretary to: (1) develop a prioritized list of observation data requirements necessary to ensure weather forecasting capabilities to protect life and property; (2) undertake ongoing systematic evaluations of observing systems, data, and information needed to meet the requirements developed under such priority list; (3) identify current and potential future data gaps in observing capabilities related to such requirements; and (4) determine a range of options to address the gaps identified. Directs the OAR Assistant Administrator to undertake Observing System Simulation Experiments (OSSEs) to assess the relative value and benefits of observing capabilities and systems. Allows technical and scientific OSSE evaluations to include assessments of the impact of observing capabilities on: (1) global weather prediction, (2) hurricane track and intensity forecasting, (3) tornado warning times and accuracy, and (4) prediction of mid-latitude severe local storm outbreaks. Requires OSSEs to: (1) determine the potential impact of proposed space-based, sub-orbital, and in-situ observing systems on analyses and forecasts; (2) evaluate and compare observing system design options; and (3) assess the relative capabilities and costs of various and combinations of observing systems in providing data necessary for the protection of life and property. Requires OSSEs to be conducted: (1) before the acquisition of major government-owned or government-leased operational observing systems, (2) before the purchase of new commercially provided data critical to forecast accuracy, and (3) for any existing commercially provided observing system data contracts exceeding $15 million. Permits OSSEs to be conducted on existing observing systems where such data costs NOAA in excess of $20 million. Requires NOAA to issue a specified plan for high performance computing support of its advanced research and operational weather prediction models. Permits: (1) the purchase of weather data through contracts with commercial providers, and (2) the placement of weather satellite instruments on co-hosted government or private payloads. Requires a report to Congress assessing the range of commercial opportunities for obtaining space-based weather observations and providing a plan for procuring data from those nongovernmental sources.

Directs the Secretary to delay the start of round 1 recompete of such DMEPOS competitive bidding program from January 1, 2014, to a date no earlier than six months after the initial implementation of round 2. Requires the Secretary, acting through the Office of the Assistant Secretary for Planning and Evaluation, to contract three auction experts, a health economist, and an econometrician to work collectively as an auction expert team, led by the auction experts, to independently review and assess all aspects of round 1 re-bid and round 2 of the DMEPOS competitive bidding program, including its design, development, implementation, adequacy of support for Medicare beneficiaries with chronic illness or disabilities, market fairness, sustainability, and functioning.

Federal Land Transaction Facilitation Act Reauthorization of 2013

Federal Land Transaction Facilitation Act Reauthorization of 2013 - Amends the Federal Land Transaction Facilitation Act (FLTFA) to reauthorize, until July 25, 2020, the program for the completion of appraisals and satisfaction of other legal requirements for the sale or exchange of public land identified for disposal under approved land use plans under the Federal Land Policy and Management Act of 1976. Directs the Secretary of the Interior to: (1) establish and maintain a database containing a comprehensive list of all of the public land identified for disposal under such plans, and (2) make such database available to the public on the website of the Department of the Interior. Allows a state to use any funds made available from the Federal Land Disposal Account for same-state purchases that are not obligated or expended by the end of the fourth fiscal year after the sale or exchange of the land that generated such funds. Instructs the Secretary and the Secretary of Agriculture (USDA), in prioritizing the acquisition of inholdings and non-federal lands with exceptional resources, to consider the extent to which the acquisition of the land or interest therein will increase public availability of resources for, and facilitate public access to, hunting, fishing, and other recreational activities. Requires any remaining balance in the Federal Land Disposal Account to be deposited into the Treasury and used for deficit reduction, except that in the case of a fiscal year for which there is no federal budget deficit, such amounts shall be used to reduce the federal debt. Makes the FLTFA inapplicable to land eligible for sale under specified public land laws.

Vietnam Human Rights Act of 2013 - Prohibits U.S. nonhumanitarian assistance to the government of Vietnam in excess of FY2012 amounts unless the President certifies to Congress that the government of Vietnam has made substantial progress respecting political, media, and religious freedoms, minority rights, access to U.S. refugee programs, and actions to end trafficking in persons and the release of political prisoners. Authorizes the President to waive such requirements if increased U.S. nonhumanitarian assistance would promote the purposes of this Act or is otherwise in the U.S. national interest. Allows the President to waive such authority with respect to: (1) all U.S. nonhumanitarian assistance to Vietnam; or (2) one or more programs, projects, or activities of such assistance. Expresses the sense of Congress that: (1) the United States should take measures to overcome the jamming of Radio Free Asia by Vietnam and that the Broadcasting Board of Governors should not cut staffing, funding, or broadcast hours for the Vietnamese language services of the Voice of America and Radio Free Asia; (2) U.S.-Vietnam educational and cultural exchange programs should promote freedom and democracy in Vietnam; (3) the Secretary of State should oppose Vietnam's candidacy for membership on the United Nations Human Rights Council (UNHRC); (4) Vietnam should be designated as a country of particular concern for religious freedom; and (5) Vietnam does not fully comply with the minimum standards for the elimination of trafficking and is not making significant efforts to bring itself into compliance.

Jamiel Shaw, Jr. Memorial Act of 2013 - Prohibits the payment of funds to a state or its political subdivisions under any program or activity administered by the Department of Homeland Security (DHS) unless such state: (1) compiles statistics on each person arrested, charged, convicted of a crime, or incarcerated by such state, including the immigration status and country of origin of such persons and the crimes for which such persons were arrested, charged, convicted, or incarcerated; (2) reports such statistics monthly to the Federal Bureau of Investigation (FBI); and (3) certifies, on a monthly basis, compliance with the requirements of this Act.  Requires each federal agency to compile similar statistics and report on such statistics monthly to the FBI. Requires the FBI to annually publish all statistics reported under this Act as a separate data collection of its Uniform Crime Reports. Defines "crime" for purposes of this Act.

Email Privacy Act

Email Privacy Act - Amends the Electronic Communications Privacy Act of 1986 to prohibit a provider of remote computing service or electronic communication service to the public from knowingly divulging to any governmental entity the contents of any communication that is in electronic storage or otherwise maintained by the provider. Revises provisions under which the government may require, pursuant to a warrant, the disclosure by such a provider of the contents of such communications. Eliminates the different requirements applicable under current law depending on whether such communications were stored for fewer than, or more than, 180 days. Requires a law enforcement agency, within 10 days after receiving the contents of a customer's communication, or a governmental entity, within 3 days, to provide the customer a copy of the warrant and a notice that such information was requested by, and supplied to, the government entity. Provides that nothing in this Act shall be construed to limit the authority of a governmental entity to use an administrative or civil discovery subpoena to: (1) require an originator or recipient of an electronic communication to disclose the contents of such communication to the governmental entity; or (2) require an entity that provides electronic communication services to employees or agents of the entity to disclose the contents of an electronic communication to or from such employee or agent to a governmental entity if the communication is held, stored, or maintained on an electronic communications system owned or operated by the entity. Authorizes a governmental entity that is: (1) seeking a warrant for the contents of communications to include in the application a request for an order delaying the notification required for up to 180 days, in the case of a law enforcement agency, or up to 90 days, in the case of any other governmental entity; and (2) obtaining the contents of a communication, or information or records, to apply to a court for an order directing a provider of electronic communication service or remote computing service to which a warrant, order, subpoena, or other directive is directed not to notify any other person of the existence of the directive for up to 180 days, in the case of of a law enforcement agency, or up to 90 days, in the case of any other governmental entity. Provides for extensions. Requires service providers, after such extension, to provide the government three business days' notice of their intent to inform a customer or subscriber that the provider has disclosed the individual's electronic communications information to the government. Directs the Comptroller General to report to Congress by September 30, 2015, regarding the disclosure by electronic communication service providers of customer communications and records, including an analysis and evaluation of such disclosure under provisions: (1) as in effect before the enactment of this Act, and (2) as amended by this Act.

North Korea Sanctions Enforcement Act of 2014

North Korea Sanctions Enforcement Act of 2013 - Directs the President to investigate credible information of sanctionable activities involving North Korea and to designate and apply sanctions with respect to any person (referred to as a "designated person" and includes business entities, nongovernmental organizations, and governmental entities operating as business enterprises) the President determines is knowingly: contributing, through the export to or import from North Korea of any goods or technology, to the use, development, production, stockpiling, or acquisition of nuclear, radiological, chemical, or biological weapons, or any device or system designed to deliver such weapons; exporting, or facilitating the export of, defense articles and services to North Korea, or from North Korea to any other country; exporting, or facilitating the export of, any luxury goods to North Korea; providing, selling, leasing, registering, or reflagging a vessel, aircraft, or other conveyance, or providing insurance or any other shipping or transportation service used to transport goods to or from North Korea, for purposes of facilitating a specified unlawful activity or evading a regulation established under this Act or the International Emergency Economic Powers Act (IEEPA); transferring, paying, exporting, withdrawing, or otherwise dealing with any property or interest in property of the government of North Korea for purposes of facilitating such unlawful activity or evading such regulations; engaging in or facilitating censorship by North Korea; or committing or facilitating a serious human rights abuse by North Korea. Directs the President to designate and exercise IEEPA authorities with respect to the government of North Korea as well as any person or foreign government the President determines has been: listed or sanctioned under any regulation, specified executive order, or the IEEPA for illicit activities or activities concerning North Korea's proliferation of weapons of mass destruction; sanctioned under U.N. Security Council resolutions concerning North Korea's proliferation of weapons of mass destruction; or convicted of a criminal offense for engaging in sanctionable activities. Authorizes the President to exercise IEEPA authorities with respect to any foreign government or financial institution the President determines to be: engaging in sanctionable activities involving North Korea; failing to freeze funds, assets, or economic resources of a person designated pursuant to the requirements above or that could be used to facilitate sanctionable activities relating to imports or exports; failing to monitor import and export transactions appropriately; permitting any North Korean financial institution to open any new branches, offices, or joint ventures within its jurisdiction, or to take an ownership interest in, or establish or maintain a correspondent relationship with any bank in its jurisdiction, if it could be used to facilitate sanctionable import or export activities; failing to prohibit transfers of bulk cash to and from North Korea in facilitation of sanctionable import or export activities; providing public financial support for trade with North Korea to facilitate such import or export activities; or facilitating the use of any proceeds of the bribery of North Korean government officials, or the misappropriation, theft, or embezzlement of public funds by, or for the benefit of, such officials. Sets forth civil and criminal penalties under the IEEPA. Establishes the North Korea Enforcement and Humanitarian Fund in which assets subject to criminal, civil, or administrative forfeiture or penalties are to be deposited for the enforcement of this Act and to carry out humanitarian activities under the North Korea Human Rights Act of 2004. Expresses the sense of Congress that the government of North Korea should be treated as a primary money laundering concern that may be required to undertake special measures with respect to the recordkeeping and reporting of certain financial transactions as well as the identification of customers or retention of information relating to certain beneficial ownership, payable-through, or correspondent accounts. Directs the Secretary of the Treasury to require domestic financial institutions to apply special measures to certain designated entities. Directs domestic financial institutions to terminate various accounts maintained for persons, foreign governments, or financial institutions required to be designated as engaging in sanctionable activity under this Act and for foreign financial institutions providing services to such designated entities. Prohibits a designated person that is a domestic financial institution from serving as a primary dealer in U.S. debt instruments or as a repository for U.S. funds. Sets forth authority for the President to prohibit certain foreign exchange and banking transactions, revoke transaction licenses, and direct the Secretary of State to deny visas to designated aliens. Permits the President to impose sanctions against persons providing specialized financial messaging services to designated North Korean financial institutions. Requires a validated license for exports to North Korea under the Export Administration Act of 1979. Prohibits munitions and defense articles from being provided to North Korea under the Arms Export Control Act regardless of whether it is designated as a state sponsor of terrorism. Bars U.S. government contracts from being provided to designated persons. Authorizes the seizure or forfeiture of vessels or aircraft used to facilitate sanctionable activities. Directs the President to withhold assistance to the governments of countries providing defense articles or services to North Korea or receiving such articles or services from North Korea. Sets forth exceptions to designations under this Act and authorizes the President to waive designations and sanctions, for a period of up to one year, upon the President's submission to Congress of a determination that the waiver: protects vital U.S. economic and national security interests, benefits entities cooperating with investigations, and addresses humanitarian aid considerations while meeting other specified standards. Permits the President to temporarily suspend sanctions with a certification to Congress under specified circumstances and to prescribe rules for removing sanctions. Directs issuers of financial securities regulated by the Securities and Exchange Commission (SEC) to disclose activities relating to North Korea in annual and quarterly reports. Authorizes state and local governments to divest assets and prohibit investments in companies that invest in North Korea. Exempts North Korea from the jurisdictional immunity of foreign states, thereby enabling plaintiffs to seek certain damages against North Korea regardless of whether it is designated as a state sponsor of terrorism.

Equitable Access to Care and Health Act or the EACH Act - Amends the Internal Revenue Code, with respect to minimum essential health care coverage requirements added by the Patient Protection and Affordable Care Act, to allow an additional religious exemption from such requirements for individuals whose sincerely held religious beliefs would cause them to object to medical health care provided under such coverage. Defines "medical health care" to mean voluntary health treatment by or supervised by a medical doctor that would be covered under minimum essential coverage that: (1) includes voluntary acute care treatment at hospital emergency rooms, walk-in clinics, or similar facilities; and (2) excludes treatment not administered or supervised by a medical doctor, physical examinations or treatment required by law or third parties, and vaccinations.

Sudan Peace, Security, and Accountability Act of 2013 - Directs the President to develop and transmit to Congress a comprehensive strategy to end serious human rights violations in Sudan and to promote comprehensive peace and democratic reform. Requires the strategy to include an interagency plan along with a description of the resources and additional personnel required for the diplomatic, economic, intelligence, and military activities to be undertaken to address and end human rights violations, strengthen democratic institutions, and expand democratic participation and governance, including capacity building of Sudanese civil society, political parties, and nongovernmental organizations seeking peaceful democratic change. Requires a description of: (1) the options for expanding U.S. diplomatic engagement with countries with close political or economic relations with Sudan, including China, Russia, Qatar, Egypt, and other traditional allies and multilateral organizations; and (2) the manner in which sanctions against Sudan or Sudanese individuals will be more effectively enforced, including by providing adequate resources and personnel to the Office of Foreign Assets Control (OFAC) within the Department of the Treasury, prioritizing the enforcement of Sudan sanctions within OFAC, and mandating increased collection of intelligence information on Sudanese targets of sanctions. Directs the President to impose specified visa, development assistance, security assistance, property, credit, financial assistance, export, cultural, or scientific sanctions on any person or government that: (1) supported or assisted Sudan in the commission of serious human rights violations in Sudan, including by selling, leasing, or otherwise transferring military equipment to Sudan or providing property, goods, technology, services, or other support in the amount of $500,000 or more that directly and significantly contributes to Sudan committing or assisting in the commission of serious human rights violations; (2) is interfering or has interfered with the delivery of humanitarian aid to Sudan; (3) is impeding the peace process or threatening the stability of any part of Sudan or the region; or (4) failed to execute an International Criminal Court arrest warrant against any Sudanese official if such person or government had the jurisdictional authority to execute the warrant and failed to make the arrest without reasonable justification. Prohibits the imposition of sanctions or other prohibitions on any government or person that is: (1) acting on behalf of the government of South Sudan in connection with the shipment or payment for oil from South Sudan or the advancement of peace between Sudan and South Sudan, or (2) providing humanitarian aid to Sudan. Amends: (1) the Comprehensive Peace in Sudan Act of 2004 to make its asset and visa sanctions applicable to Sudan, and (2) the Darfur Peace and Accountability Act of 2006 to impose such sanctions on Janjaweed commanders and coordinators threatening peace and stability in Sudan. Terminates sanctions upon certification by the President that specified conditions have been met.
