Uniting and Strengthening America by Reforming and Improving the Government's High-Tech Surveillance Act or the USA RIGHTS Act This bill amends the Foreign Intelligence Surveillance Act of 1978 to: require a warrant to collect communications of or about a U.S. person or a person inside the United States; require a warrant when a significant purpose of targeting foreigners is to collect communications of persons in the United States; prohibit the use of communications to or from, or information about, U.S. persons or persons in the United States in any criminal, civil, or administrative proceeding or investigation, with the exception of national security-related crimes; allow individuals who have a reasonable basis to believe their communications will be acquired and who have taken reasonable steps to avoid surveillance to challenge the constitutionality of surveillance in court; and require that all forms of technical assistance demanded by the government of electronic communications service providers be approved by a FISA court. The bill expands the mandate of the Privacy and Civil Liberties Oversight Board to include review of all foreign intelligence activities and whistle-blower complaints. The bill extends the FISA Amendments Act of 2008 to September 30, 2021.

No Abortion Bonds Act This bill amends the Internal Revenue Code to impose taxes on state, local, and tax credit bonds that are used to provide a facility owned or used (for any purpose) by an abortion provider for more than 30 days during a year in which interest is paid on the bond. An entity is not considered an abortion provider solely as a result of performing abortions if: (1) the pregnancy is the result of an act of rape or incest; or (2) a woman suffers from a physical disorder, physical injury, or physical illness that would, as certified by a physician, place the woman in danger of death unless an abortion is performed, including a life-endangering physical condition caused by or arising from the pregnancy itself. The Department of the Treasury may exempt certain hospitals from being considered an abortion provider by making the name of the hospital available on Treasury's public website.

75th Anniversary of the End of World War II Commemorative Coin Act This bill directs the Department of the Treasury to mint and issue up to 50,000 $5 coins, 500,000 $1 coins, and 750,000 half-dollar coins in commemoration of the 75th anniversary of the end of World War II. The coins shall be emblematic of the sacrifices made by millions of people of the United States 75 years ago in bringing an end to World War II. The design on each coin shall represent the World War II Victory Medal, which was awarded to all 16 million U.S. military personnel who served from December 7, 1941, to December 31, 1946. The bill requires all sales of such coins include specified surcharges, which shall be paid by Treasury to the congressionally designated National WWII Museum to fund its educational mission of telling the story of the U.S. experience in World War II.

Puerto Rico Humanitarian Relief Act This bill revises coastwise laws, commonly known as the Jones Act, that govern domestic transportation of merchandise or passengers by vessels. The Jones Act requires vessels transporting merchandise or passengers between Puerto Rico and other U.S. ports be built in the United States, at least 75% owned by U.S. citizens, and mostly crewed by U.S. citizens. The bill exempts for five years vessels transporting merchandise between Puerto Rico and other U.S. ports from Jones Act requirements. The Government Accountability Office must report the economic impact of this bill on Puerto Rico.

Preserving Liu Xiaobo Legacy of Freedom & Gold Medal Act This bill directs the Speaker of the House of Representatives and the President pro tempore of the Senate to award a Congressional Gold Medal to Liu Xiaobo and collectively to all those who have peacefully advocated for democracy and human rights in China in recognition of their achievements and contributions to freedom, human rights, and peace in China and globally. The bill expresses the sense of Congress that the Smithsonian Institution should make the medal available for display, particularly at locations: (1) associated with the research of the Tiananmen Protests of 1989 and their violent suppression, and (2) dedicated to preserving the history of the Chinese pro-democracy movement.

No Social Security for Illegal Immigrants Act of 2017 This bill prohibits an individual from collecting Social Security benefits based on wages and income earned for services illegally performed in the United States while the individual was an alien.

Legal Workforce Act This bill amends the Immigration and Nationality Act to direct the Department of Homeland Security (DHS) to establish an employment eligibility verification system (EEVS), patterned after the E-Verify system. An employer shall attest, during the verification period and under penalty of perjury, that the employer has verified that an individual is not an unauthorized alien. An individual shall attest that he or she is a U.S. citizen or national, a lawful permanent resident, or an alien authorized to work in the United States. The bill establishes a phased-in EEVS participation deadline for different categories of employers, including agricultural employers. The bill requires reverification of certain groups of workers who have not been verified under E-verify. An employer may voluntarily reverify employees. Employment recruitment and referral are included within the scope of EEVS. The bill sets forth provisions regarding: (1) an employer utilizing a good faith defense, (2) preemption of state or local law, (3) employer penalties, and (4) worker remedies for EEVS errors. DHS shall establish programs to: (1) block the use of misused social security numbers, (2) suspend or limit the use of social security account numbers of identity fraud victims, and (3) permit parents or legal guardians to suspend or limit the use of a minor's social security account number or other identifying information. DHS shall establish at least two Identity Authentication Employment Eligibility Verification pilot programs using distinct technologies to provide employers with identity authentication and employment verification of enrolled new employees.

Expresses the sense of Congress that: child safety is the first priority of custody and parenting adjudications, and courts should resolve safety risks and claims of family violence before assessing other best interest factors; quasi-scientific evidence should be admitted by courts only when it meets admissibility standards for scientific evidence; evidence from court-affiliated or appointed fee-paid professionals regarding adult or child abuse allegations in custody cases should be considered only when the professional possesses documented expertise and experience in the relevant types of abuse, trauma, and the behaviors of victims and perpetrators; states should define required standards of expertise and experience for appointed fee-paid professionals who provide evidence to the court on behaviors of abuse victims and perpetrators, specify requirements for the contents of such professional reports, and require courts to find that any appointed professionals meet those standards; states should consider models under which court-appointed professionals are paid directly by the courts, with potential reimbursement by the parties after due consideration of the parties' financial circumstances; and Congress should schedule hearings on family courts' practices with regard to children's safety and civil rights.

President John F. Kennedy Commemorative Coin Act This bill directs the Department of the Treasury to mint and issue not more than 500,000 $1 silver coins in commemoration of President John F. Kennedy. The bill requires all sales of such coins to include a surcharge of $10 per coin, which shall be paid by Treasury to the John F. Kennedy Library Foundation to support the John F. Kennedy Presidential Library and Museum.

This bill prohibits the Department of State from obligating or expending a specified amount of the funds made available for assistance for Honduras for FY2017 until the President certifies to Congress that the government of Honduras has settled all commercial disputes with U.S. citizens that were filed before enactment of this bill, including disputes related to the confiscation of real property.

This bill amends the Immigration and Nationality Act to reauthorize the State Criminal Alien Assistance Program (SCAAP) through FY2021. SCAAP provides payments to state, local, and tribal governments to offset the costs of incarcerating certain undocumented criminal aliens. It expands the definition of “undocumented criminal alien” to include an alien who has been charged with a felony or two or more misdemeanors. Additionally, the bill directs the Department of Justice to reimburse a state, local, or tribal government for incarceration costs and medical expenses of a criminal alien whose immigration status cannot be verified by the Department of Homeland Security. (Currently, a criminal alien with lawful immigration status does not meet the criteria for SCAAP reimbursement.)

Nuclear Waste Policy Amendments Act of 2017 This bill amends the Nuclear Waste Policy Act of 1982 to direct the Department of Energy (DOE) to initiate a program to consolidate and temporarily store commercial spent nuclear fuel during the development, construction, and operation of a permanent nuclear waste repository. The bill addresses federal land withdrawal and related management issues, including the permanent withdrawal of specific federal land for repository use by DOE, updating the Nuclear Regulatory Commission licensing process and conditions for the repository, and limiting activities relating to developing a separate defense waste repository used for storing high-level radioactive waste and spent nuclear fuel derived from the atomic energy defense activities of DOE. DOE may enter into agreements to provide benefits to state, local, and Tribal governments that might host or be affected by facilities related to storing nuclear waste. The bill revises the method by which DOE funds its nuclear waste management activities though the collection and usage of the Nuclear Waste Fund.

National Multimodal and Sustainable Freight Infrastructure Act This bill directs the Department of Transportation (DOT) to: (1) establish a Multimodal Freight Funding Formula Program to distribute funds to states, and a National Freight Infrastructure Competitive Grant Program to make grants to entities for projects, to improve the efficiency and reliability of freight movement in the United States. The bill: (1) requires national and state freight plans to include strategies and goals to decrease greenhouse gas emissions, local air pollution, water runoff, and wildlife habitat loss; and (2) expands the membership and duties of state freight advisory committees. The bill amends the Internal Revenue Code to: (1) impose a 1% excise tax upon taxable ground transportation of property (i.e., transportation by freight rail or truck trailer and semitrailer chassis and bodies, suitable for use with a trailer or semitrailer with a gross vehicle weight of 26,000 pounds or more), and (2) deposit such tax revenues into a Freight Trust Fund to finance the Multimodal Freight Funding Formula Program and the National Freight Infrastructure Competitive Grant Program.

This bill terminates the designation of the Islamic Republic of Pakistan as a major non-NATO ally. The President may not issue a separate designation of Pakistan as a major non-NATO ally until the President certifies that Pakistan: is continuing to conduct military operations that are contributing to significantly disrupting the safe haven and freedom of movement of the Haqqani Network, has taken steps to demonstrate its commitment in preventing the Haqqani Network from using any Pakistani territory as a safe haven, is actively coordinating with Afghanistan to restrict the movement of militants along the Afghanistan-Pakistan border, and has shown progress in the arrest and prosecution of Haqqani Network senior leaders and mid-level operatives.

Compassionate Access, Research Expansion, and Respect States Act of 2017 or the CARERS Act of 2017 This bill amends the Controlled Substances Act to provide that the Act's regulatory controls and administrative, civil, and criminal penalties do not apply to a person who produces, possesses, distributes, dispenses, administers, tests, recommends, or delivers medical marijuana in compliance with state law. The bill also: excludes "cannabidiol" (CBD) from the definition of "marijuana"; limits the concentration of delta-9-tetrahydrocannabinol (THC) in CBD to 0.3 percent on a dry weight basis; and deems marijuana grown or processed to make CBD, in accordance with state law, to comply with the THC concentration limit unless the Drug Enforcement Administration (DEA) determines state law to be unreasonable. The bill directs the Department of Health and Human Services (HHS) to terminate the Public Health Service's interdisciplinary review process that is used to evaluate applications for medical marijuana research. The DEA must license manufacturers and distributors of marijuana for medical research; HHS must register practitioners to conduct research; and the Department of Veterans Affairs (VA) must authorize VA health care providers to provide recommendations and opinions to veterans regarding participation in their states' marijuana programs.

No Regulation Without Representation Act of 201 7 This bill prohibits a state from taxing or regulating a person's activity in interstate commerce unless the person is physically present in the state during the period in which the tax or regulation is imposed. A person is physically present if the person's business activities in the state include: maintaining a commercial or legal domicile in the state; owning, holding, leasing, or maintaining certain property in the state; having one or more employees, agents, or independent contractors in the state who provide on-site design, installation, or repair services on behalf of the remote seller; having one or more employees, exclusive agents or exclusive independent contractors present in the state who engage in activities that substantially assist the person to establish or maintain a market in the state; or regularly employing three or more employees in the state. The bill specifies certain activities and agreements that indicate a de minimis physical presence that is excluded from the definition of "physical presence." The bill also specifies that U.S. district courts have original jurisdiction over civil actions to enforce this bill.

American Space Commerce Free Enterprise Act of 2017 This bill grants the Office of Space Commerce of the Department of Commerce the authority to issue certifications to U.S. nationals and nongovernmental entities for the operation of: (1) specified human-made objects manufactured or assembled in outer space, including on the Moon and other celestial bodies, with or without human occupants, that were launched from Earth; and (2) all items carried on such objects that are intended for use in outer space. To be eligible for certification, each entity's application must include a space debris mitigation plan for the space objects. The office shall establish a Private Space Activity Advisory Committee to: (1) analyze the status and recent developments of nongovernmental space activities, and (2) advise on matters relating to U.S. private sector activities in outer space. The bill authorizes the office to issue permits to persons for the operation of space-based remote sensing systems. The office shall establish an Advisory Committee on Commercial Remote Sensing to advise on matters relating to the U.S. commercial space-based remote sensing industry. The bill abolishes the Commercial Remote Sensing Regulatory Affairs Office of the National Oceanic and Atmospheric Administration.

Border Security and Immigration Enforcement Act of 2017 This bill amends the Immigration and Nationality Act to replace the diversity visa program with a paying immigrant program under which an immigrant visa can be obtained by paying a $1 million fee (and a $500,000 fee for an accompanying child under the age of 18). The bill establishes a fiscal year limit of 55,000 visas for such immigrants. A Border Security and Immigration Enforcement Account is established in the Treasury for such fees (except for certain of such fees allocated to individuals who facilitate the application process for such immigrants) which shall be used for U.S. Immigration and Customs Enforcement and U.S. Customs and Border Protection. Such an immigrant who otherwise meets the naturalization requirements shall be naturalized within two years (rather than five years) of being lawfully admitted for permanent residence.

Processing Revival and Intrastate Meat Exemption Act or the PRIME Act This bill amends the Federal Meat Inspection Act to expand the exemption of custom slaughtering of animals from federal inspection requirements. Under current law, the exemption applies if the meat is slaughtered for personal, household, guest, and employee uses. The bill expands the exemption to include meat that is: slaughtered and prepared at a custom slaughter facility in accordance with the laws of the state where the facility is located; and prepared exclusively for distribution to household consumers in the state or restaurants, hotels, boarding houses, grocery stores, or other establishments in the state that either prepare meals served directly to consumers or offer meat and food products for sale directly to consumers in the state. The bill does not preempt any state law concerning: (1) the slaughter of animals or the preparation of carcasses, parts thereof, meat and meat food products at a custom slaughter facility; or (2) the sale of meat or meat food products.

Mortgage Fairness Act of 2017 This bill amends the Truth in Lending Act to revise the definition of "points and fees," for purposes of determining whether a mortgage is a "high-cost mortgage," to: (1) exclude compensation taken into account in setting the interest rate and for which the consumer was not separately charged, and (2) include compensation paid by a consumer or creditor to an individual employed by or contracting with a mortgage originator. (A high-cost mortgage designation restricts the terms of a loan and requires a lender to make certain disclosures to the borrower.)

American Legion 100th Anniversary Commemorative Coin Act This bill requires the Department of the Treasury to mint and issue commemorative coins in recognition and celebration of the 100th anniversary of the American Legion. Surcharges received from the sale of these coins shall be paid to the American Legion for costs related to promoting the importance of: (1) caring for those who have served, and those who are still serving, in the Armed Forces; and (2) maintaining patriotic values, strong families, and assistance for at-risk children.

Everglades Flow Increases Rely on Storage and Treatment Act or the Everglades FIRST Act This bill directs the Department of the Army to expedite completion of the reports for the following projects in Florida and to expedite completion of construction of the projects it determines are feasible: Everglades Agricultural Area Storage Reservoirs, Loxahatchee River Watershed Restoration Project, Lake Okeechobee Watershed Restoration Project, and Western Everglades Restoration Project.

Calls on the government of Iran to: (1) release Siamak Namazi, Baquer Namazi, Karan Vafadari, Afarin Niasari, Nizar Zakka, and any other U.S. citizen, legal permanent resident alien, or foreign national being held in Iran; and (2) fulfill its promises to assist in locating and returning Robert Levinson. Encourages the President to: (1) take meaningful action to secure the release of such individuals if Iran does not do so, and (2) make the release of U.S. citizens and legal permanent resident aliens held hostage by the Iranian government the highest of priorities. Requests the United States and its allies whose nationals have been detained to consider establishing a multinational task force to secure the release of the detainees.

Chinese American World War II Veterans Congressional Gold Medal Act This bill directs the President pro tempore of the Senate and the Speaker of the House of Representatives to make appropriate arrangements for the award of a single Congressional Gold Medal to the Chinese American Veterans of World War II in recognition of their dedicated service during World War II. The medal shall be displayed at the Smithsonian Institution, which is urged to make the medal available for display at other locations associated with such veterans or with World War II.

Charlotte's Web Medical Access Act of 2017 This bill amends the Controlled Substances Act (CSA): to add definitions for the terms "cannabidiol" and "cannabidiol-rich plants," to exclude cannabidiol and cannabidiol-rich plants from the definition of marijuana, and to remove cannabidiol and cannabidiol-rich plants from coverage under the CSA. The bill also removes cannabidiol and cannabidiol-rich plants from coverage under the Federal Food, Drug, and Cosmetic Act. Finally, it specifies that no provision of this bill prohibits or restricts the use, production, or distribution of marijuana in a state in which such activities are legal under state law.

Secure and Fair Enforcement Banking Act of 2017 or the SAFE Act of 2017 This bill prohibits a federal banking regulator from: (1) terminating or limiting the deposit insurance or share insurance of a depository institution solely because the institution provides financial services to a legitimate marijuana-related business; (2) prohibiting or otherwise discouraging a depository institution from offering financial services to such a business; (3) recommending, incentivizing, or encouraging a depository institution not to offer financial services to an account holder solely because the account holder is affiliated with such a business; or (4) taking any adverse or corrective supervisory action on a loan made to a person solely because the person either owns such a business or owns real estate or equipment leased to such a business. As specified by the bill, a depository institution shall not, under federal law, be liable or subject to forfeiture for providing financial services to a legitimate marijuana-related business.

Flood and Agriculture Risk Management Cost Reduction Act of 2017 This bill amends the National Flood Insurance Act of 1968 to allow, under the National Flood Insurance Program, certain local variances with respect to agricultural structures located in special flood-hazard zones. The chargeable premium rate for coverage with respect to a structure that is provided such a variance shall be the same as would otherwise apply if the structure had been dry flood-proofed. If a community applies to the Federal Emergency Management Agency (FEMA) for the remapping of a levee-impacted area in which the pertinent levee system fails to meet specified minimum standards for accreditation on a flood-insurance rate map: (1) FEMA must establish, on an alternative map, a flood-risk zone for the area; and (2) flood insurance shall be made available, at specified risk-based rates, to properties located within the zone. FEMA shall carry out a pilot program that provides for the sale of contracts for flood-insurance coverage, under the National Flood Insurance Program, for multiple nonresidential agricultural structures under a single policy.

Election Integrity Act of 2017 This bill amends the Help America Vote Act of 2002 to prohibit a state or local election official from providing a ballot for a federal election to an individual who desires to vote in person unless the individual presents a valid photo identification. If an individual does not present a valid photo identification, the individual shall be permitted to cast a provisional ballot. An election official may not determine that such an individual is eligible under state law to vote in the election unless, not later than 10 days after casting the provisional ballot, the individual presents: (1) the identification required, or (2) an affidavit attesting that the individual does not possess the identification because the individual has a religious objection to being photographed. With an exception for overseas military voters, an election official may not accept a ballot for a federal election provided by an individual who votes other than in person unless the individual submits with the ballot a copy of a valid photo identification. If an individual presents an election official with an affidavit attesting that the individual is unable to afford to obtain a valid photo identification, the official shall provide the individual with a valid photo identification without charge.

This bill directs the Drug Enforcement Administration to transfer marijuana from schedule I to schedule III of the Controlled Substances Act. Reciprocal Access to Tibet Act of 2017 This bill requires the Department of State to submit an annual, publicly-available report to Congress that includes: (1) a list of individuals holding specified senior Chinese leadership positions at the national and subnational levels; and (2) an assessment of the level of access Chinese authorities granted U.S. diplomats, journalists, and tourists to Tibetan areas in China. Such assessment shall include: a comparison with the level of access granted to other areas of China, a comparison between the levels of access granted to Tibetan and non-Tibetan areas in relevant provinces, a comparison of the level of access in the reporting year and the previous year, and a description of the measures that impede the freedom to travel in Tibetan areas. Listed persons shall be ineligible for a visa to enter or to be present in the United States if specified restrictions on foreign travelers entering Tibetan areas remain in effect, subject to a national interests waiver. Expresses the sense of Congress that the State Department, when granting Chinese diplomats access to parts of the United States, should take into account the extent to which China grants U.S. diplomats access to parts of China, including the Tibetan areas.

Child Welfare Provider Inclusion Act of 2017 This bill prohibits the federal government, and any state or local government that receives federal funding for any program that provides child welfare services under part B (Child and Family Services) or part E (Foster Care and Adoption Assistance) of title IV of the Social Security Act (SSAct), from discriminating or taking an adverse action against a child welfare service provider that declines to provide, facilitate, or refer for a child welfare service that conflicts with the provider's sincerely held religious beliefs or moral convictions. The bill bars such prohibition from applying to SSAct requirements that forbid state entities from denying or delaying adoption or foster care placements on the basis of an adoptive parent's or a child's race, color, or national origin. The Department of Health and Human Services must withhold 15% of the federal funds that a state or local government receives for such programs if the state or local government violates this bill. An aggrieved child welfare service provider may assert such an adverse action violation as a claim or defense in a judicial proceeding and to obtain all appropriate relief (including declaratory relief, injunctive relief, compensatory damages, and reasonable attorney's fees and costs).

Larry Doby Congressional Gold Medal Act This bill directs the Speaker of the House of Representatives and the President pro tempore of the Senate to arrange for the presentation of a Congressional Gold Medal in honor of Larry Doby in recognition of his achievements and contributions to American major league athletics, civil rights, and the Armed Forces during World War II.

Regulate Marijuana Like Alcohol Act This bill directs the Department of Justice to issue a final order that removes marijuana in any form from all schedules of controlled substances under the Controlled Substances Act (CSA). Marijuana is exempted from the CSA except as provided in this bill. The definition of "felony drug offense" does not include conduct related to marijuana. Marijuana is not included in the provisions setting forth penalties applicable to prohibited conduct under the CSA. It shall be unlawful to ship or transport marijuana from any place outside a jurisdiction of the United States into such a jurisdiction in which its possession, use, or sale is prohibited. The bill eliminates marijuana from regulation under various federal laws including the Controlled Substances Import and Export Act, the National Forest System Drug Control Act of 1986, the federal Wiretap Act, and the Office of National Drug Control Policy Reauthorization Act of 1998. Further, it subjects marijuana to the provisions that apply to: (1) intoxicating liquors under the Original Packages Act, the Webb-Kenyon Act, and the Victims of Trafficking and Violence Protection Act of 2000; and (2) distilled spirits under the Federal Alcohol Administration Act. The Food and Drug Administration shall have the same authorities with respect to marijuana as it has for alcohol. Functions of the Administrator of the Drug Enforcement Administration relating to marijuana enforcement shall be transferred to the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF). The ATF is renamed the Bureau of Alcohol, Tobacco, Marijuana, Firearms and Explosives and the Alcohol and Tobacco Tax and Trade Bureau is renamed the Alcohol, Tobacco, and Marijuana Tax and Trade Bureau.

Veterans Equal Access Act This bill directs the Department of Veterans Affairs (VA) to authorize VA health care providers to: (1) provide veterans with recommendations and opinions regarding participation in their state's marijuana programs, and (2) complete forms reflecting such recommendations and opinions.

Small Business Tax Equity Act of 201 7 This bill amends the Internal Revenue Code to exempt a trade or business that conducts marijuana sales in compliance with state law from the prohibition against allowing business-related tax credits or deductions for expenditures in connection with trafficking in controlled substances.

Smithsonian Women's History Museum Act This bill establishes a comprehensive women's history museum within the Smithsonian Institution in Washington, DC, to provide for: (1) the collection, study, and establishment of programs related to women's contributions that have influenced the direction of the United States; (2) collaboration with other Smithsonian museums and facilities, outside museums, and educational institutions; and (3) the creation of exhibitions and programs that recognize diverse perspectives on women's history and contributions. The bill establishes a council within the Smithsonian Institution to: (1) make recommendations to the Smithsonian's Board of Regents for the construction of the museum; (2) advise and assist the board on the administration and preservation of the museum; (3) recommend annual operating budgets for the museum; and (4) report annually to the board on the acquisition, disposition, and display of objects related to women's art, history, and culture. The council shall have sole authority to: (1) acquire artifacts for the museum's collections, (2) dispose of any part of the collections but only if funds generated are used for additions to the collections, (3) specify criteria for the use of the museum's collections and resources, and (4) preserve and maintain the collections. The museum's director may carry out educational and liaison programs in support of its goals.
