Medicare Adult Day Services Act of 2019 This bill provides for Medicare coverage and payment of certified adult day services that meet specified requirements. Among other things, services must be furnished by an authorized home- and community-based services provider at a certified adult day services center and in accordance with a physician-approved plan. Covered services include nursing services, physical therapy, nutritional meals, physical activities, and medication-management programs.

Focused Reduction of Effluence and Stormwater runoff through Hydrofracking Environmental Regulation Act of 2019 or the FRESHER Act of 2019 This bill addresses stormwater runoff from mining, oil, or gas operations. Specifically, it eliminates a prohibition on the Environmental Protection Agency from requiring a permit under the National Pollutant Discharge Elimination System for discharges of certain collected, uncontaminated stormwater runoff from mining operations or oil and gas operations. In addition, the Department of the Interior must study stormwater runoff associated with oil or gas operations, including an analysis of (1) measurable contamination, (2) groundwater resources, and (3) the susceptibility of aquifers to contamination from stormwater runoff associated with the operations.

CLEANER Act of 2019 or the Closing Loopholes and Ending Arbitrary and Needless Evasion of Regulations Act of 2019 This bill eliminates the exemption of waste associated with the exploration, development, or production of crude oil, natural gas, or geothermal energy from regulations governing the disposal of hazardous waste. Within a year of enactment, the Environmental Protection Agency must determine whether waste associated with oil, gas, or geothermal energy activities meet the criteria promulgated for the identification or listing of hazardous waste.

Social Determinants Accelerator Act of 2019 This bill establishes the Social Determinants Accelerator Interagency Council and provides funds for the council to (1) assist the Centers for Medicare & Medicaid Services (CMS) in awarding specified grants, (2) increase coordination among health and social service programs, and (3) provide program evaluation guidance and technical assistance to increase the impact of social service programs. Specifically, the bill provides funds for the CMS to award up to 25 grants to state, local, or tribal health or human services agencies for the development of social determinants accelerator plans that address at least one health and one social outcome for a specified target population.

Clean School Bus Act of 2019 This bill directs the Department of Energy (DOE) to establish the Clean School Bus Grant Program in the Office of Energy Efficiency and Renewable Energy. Under the program, DOE must award grants for the replacement of existing school buses with electric buses.

Food for Thought Act of 2019 This bill directs the Food and Nutrition Service (FNS) to implement a pilot program to award grants to community colleges so they may provide free meals, including snacks, to eligible students. The FNS must provide grants to community colleges that reflect varying (1) student body size; (2) full-time student enrollment; (3) geographic location, including urban, rural, or suburban campuses; (4) minority serving institutions; and (5) residential character, including race, ethnicity, and socioeconomic status. The FNS may give priority to community colleges (1) with prepared food infrastructure, or those that can identify outside sources of support to help develop such infrastructure; (2) that serve more than 300 students who are eligible for Federal Pell Grants; or (3) that are located within proximity of a school in a high poverty area that receives special assistance payments under the National School Lunch Program or the School Breakfast Program.

Department of Homeland Security Appropriations Act, 2020 This bill provides FY2020 appropriations for the Department of Homeland Security. The bill provides appropriations for Departmental Management, Operations, Intelligence, and Oversight, including the Office of the Secretary and Executive Management; the Management Directorate; Intelligence, Analysis, and Operations Coordination; and the Office of Inspector General. The bill provides appropriations for Security, Enforcement, and Investigations, including U.S. Customs and Border Protection, U.S. Immigration and Customs Enforcement, the Transportation Security Administration, the U.S. Coast Guard, and the U.S. Secret Service. The bill provides appropriations for Protection, Preparedness, Response, and Recovery, including the Cybersecurity and Infrastructure Security Agency, and the Federal Emergency Management Agency (FEMA). The bill provides appropriations for Research, Development, Training, and Services, including U.S. Citizenship and Immigration Services, the Federal Law Enforcement Training Centers, the Science and Technology Directorate, and the Countering Weapons of Mass Destruction Office. The bill also sets forth requirements and restrictions for using funds provided by this and other appropriations Acts.

Even Playing Field Act This bill addresses pay equity for amateur athletes and other personnel. It permits a national governing body of an amateur sports organization eligible to be recognized, or to continue to be recognized, only if it provides equal investment, working conditions, and wages and other compensation to all amateur athletes, without discrimination based on sex. National governing bodies must report periodically to Congress regarding pay equity. Each report shall include (1) the median compensation for amateur athletes, coaches, trainers, managers, administrators, and officials, disaggregated by race, gender, and employment category; and (2) the minimum and maximum compensation paid to such personnel, disaggregated by race, gender, and employment category.

Give Our Athletes Level Salaries Act or the GOALS Act This bill prohibits the use of funds for the 2026 World Cup until the U.S. Soccer Federation agrees to provide equitable pay to the members of the U.S. Women's National Team and the U.S. Men's National Team.

Greater Leadership Overseas for the Benefit of Equality Act of 2019 or the GLOBE Act of 2019 This bill contains provisions related to (1) the protection of lesbian, gay, bisexual, transgender, and intersex (LGBTI) individuals globally; and (2) immigration protections for vulnerable individuals. The bill establishes (1) an interagency group to respond to urgent threats to LGBTI people in foreign countries, and (2) a permanent Special Envoy for the Human Rights of LGBTI Peoples in the Department of State. The President shall impose visa-blocking sanctions on foreign persons responsible for violating the human rights of individuals due to actual or perceived sexual orientation, gender identity, or sex characteristics. The State Department shall establish the Global Equality Fund to provide assistance to nongovernmental organizations working to advance and protect human rights. The U.S. Agency for International Development shall establish the LGBTI Global Development Partnership to work with the private sector and nongovernmental organizations to support LGBTI rights. The bill removes prohibitions against providing foreign assistance to nongovernmental organizations that offer certain medical services using non-U.S. government funds. The bill contains several immigration-related provisions, such as those (1) establishing that persecution based on sexual orientation or gender identity may form the basis of an asylum request, (2) removing the general requirement that an asylum claim must be filed within one year of the applicant's arrival in the United States, (3) establishing that a permanent partnership between two partners is a marriage for immigration law purposes, and (4) establishing that indigent aliens have a right to free counsel in certain immigration proceedings.

Violence Against Women Veterans Act This bill requires the Department of Veterans Affairs (VA) to take actions to improve assistance to veterans who experience domestic violence or sexual assault. Specifically, the bill requires the VA to implement a program to assist veterans who have experienced or are experiencing domestic violence or sexual assault in accessing VA benefits. The VA shall carry out the program in partnership with domestic violence shelters and programs, rape crisis centers, state domestic violence and sexual assault coalitions, and other appropriate service providers. The bill authorizes the VA to establish local coordinators to provide outreach under the program to effectively assist veterans who have experienced domestic violence or sexual assault. The VA must consult with the Department of Justice (DOJ) and the Department of Health and Human Services to establish a national task force to develop a comprehensive national program to address domestic violence and sexual assault among veterans by integrating VA facilities, services, and benefits into existing networks of community-based domestic violence and sexual assault services. The VA must consult with DOJ to conduct a national baseline study to examine the scope of the problem of domestic violence and sexual assault among veterans and spouses of veterans. Finally, the bill requires the Advisory Committee on Women Veterans to include in its biennial report an assessment of the effects of intimate partner violence on women veterans.

Wireless Infrastructure Resiliency during Emergencies and Disasters Act or the WIRED Act This bill authorizes states to require wireless companies to deploy infrastructure that can withstand natural disasters.

Energizing American Shipbuilding Act of 2019 This bill directs (1) the Federal Energy Regulatory Commission (FERC) to require specified percentages of liquefied natural gas exports to be transported on vessels built or retrofitted in the United States and documented under its laws, and (2) the President to require specified percentages of crude oil exports to be transported on vessels built or retrofitted in the United States and documented under its laws. FERC and the President may waive these requirements under specified circumstances. The Energy Information Administration must collect and publish information on exports of natural gas and crude oil by vessels, including forecasts and data on those exports.

Midwives for Maximizing Optimal Maternity Services Act of 2019 or the Midwives for MOMS Act of 2019 This bill establishes programs for the Health Resources and Services Administration (HRSA) to award grants supporting midwifery programs at higher education institutions and nursing schools. Funds may be used to establish or expand programs and increase the number of training staff. The HRSA may prioritize funding institutions that focus on increasing the number of midwife professionals from underrepresented groups and that promote practicing in areas with limited access to professional health care.

Hispanic Educational Resources and Empowerment Act of 2019 This bill directs the Department of Education to (1) award grants to Hispanic-serving institutions of higher education (IHEs) to improve and expand innovative collaboration agreements between local educational agencies and IHEs to better serve Hispanic students, (2) provide technical assistance to such IHEs, and (3) contract with a third party to conduct an independent evaluation of grant activities. Such grants must be used for specific activities, such as providing academic support to prepare students for postsecondary education and addressing nonacademic needs of students that are barriers to college enrollment.

Reuniting Families Act This bill makes various immigration law changes, such as increasing the annual caps for certain immigrant visas and establishing that permanent partners are generally treated as spouses. The bill also expands which familial relationships are considered as immediate family and therefore not subject to annual limits, repeals specified bars from admission for unlawfully present aliens, and limits what constitutes a misrepresentation of citizenship status—a deportable offense—by requiring a willful misrepresentation.

Athletics Fair Pay Act of 2019 This bill addresses pay equity for amateur athletes. It requires amateur sports national governing bodies to provide equitable wages and other compensation for women where separate programs for male and female athletes are conducted on a national basis. The bill also requires a national governing body to report to Congress on the compensation of amateur athletes in the sport governed by such body for each of the two consecutive calendar years ending immediately before, and each calendar year beginning after, this bill's enactment. Each report shall include (1) the median compensation for amateur athletes, disaggregated by race and gender; and (2) the minimum and maximum compensation paid to amateur athletes, disaggregated by race and gender.

Correcting Hurtful and Alienating Names in Government Expression (CHANGE) Act This bill prohibits any executive agency from using the term alien to refer to an individual who is not a U.S. citizen or national, or il legal alien to refer to such an individual who is unlawfully present in the United States or lacks lawful immigration status. This prohibition does not apply when quoting certain texts. The bill (1) establishes a uniform definition for the term foreign national when used in acts of Congress and agencies; (2) replaces alien with foreign national in federal government documents, including statutes and regulations; and (3) replaces illegal alien with undocumented foreign national in such documents. Under the bill, a foreign national is any individual other than an individual (1) who is a citizen of the United States; or (2) though not a citizen of the United States, who owes permanent allegiance to the United States.

Cady Housh and Gemesha Thomas Student Suicide Prevention Act of 2019 This bill reauthorizes through FY2025, and otherwise revises, grants administered by the Substance Abuse and Mental Health Services Administration (SAMHSA) to support youth suicide early-intervention and prevention strategies. Specifically, the bill requires SAMHSA to award a portion of such grants for statewide training programs on emotional well-being, mental health, and suicide awareness and prevention for elementary and secondary school students and staff.

Domestic Workers Bill of Rights Act This bill provides rights and protections for domestic workers, including pay and leave rights, and health and safety protections. The bill, among other things repeals the exemption under the Fair Labor Standards Act of 1938 for domestic live-in employees from certain minimum wage and maximum hour requirements; requires written notices of termination and allow other communications for live-in domestic employees; requires written agreements for domestic workers covering wages, sick leave, benefits, and other matters; allows domestic workers to request and receive changes to work schedules due to personal events; sets forth certain privacy rights for domestic workers; expands coverage to domestic workers under Title VII of the Civil Rights Act of 1964 against discrimination in employment; and increases the federal medical assistance percentage (FMAP) for certain Medicaid-funded medical services provided by domestic workers. The Department of Labor shall (1) award grants for a domestic worker national hotline for reporting emergencies, training on hazards facing domestic workers, and workforce investment activities for domestic workers; and (2) establish a Domestic Worker Wage and Standards Board to investigate standards in the domestic workers industry. Labor must provide domestic workers with a document that describes the rights and protections under the domestic workers bill of rights. The Department of Health and Human Services must collect state Medicaid program data on the personal or home care aide workforce.

It also expresses a commitment to keep America open to those who lawfully seek refuge from violence and oppression and those willing to work hard to achieve the American Dream, regardless of race, ethnicity, faith, or country of origin. The resolution strongly condemns as racist the President’s comments about immigrants and those who look to the President like immigrants and states that these have legitimized hatred of new Americans and people of color, including his reference to immigrants and asylum seekers as “invaders.”

Legal Services for Homeless Veterans Act This bill requires the Department of Veterans Affairs (VA) to enter cooperative agreements or make grants to eligible entities that provide legal services to homeless veterans and veterans at risk for homelessness. To be eligible, an entity must (1) be a public or nonprofit private entity with the capacity to effectively administer a grant or cooperative agreement, (2) demonstrate that adequate financial support will be available to provide legal services to homeless veterans and veterans at risk for homelessness, and (3) agree to meet the VA's established requirements and demonstrate a capacity to meet such requirements.

HUD Inspection Oversight Act of 2019 This bill modifies inspection and oversight protocols under the Housing Choice Voucher Program, including by directing the Department of Housing and Urban Development (HUD) to take certain enforcement actions when a property's inspection score falls below a specified threshold. In recent years, language directing HUD to take specific actions in such circumstances has been included in annual appropriations bills.

Child Trafficking Victims Protection and Welfare Act This bill provides for protections for children detained by the Department of Homeland Security (DHS). DHS shall develop guidelines for the treatment of children (under age 18 with no permanent immigration status) in U.S. Customs and Border Protection (CBP) custody. DHS must provide resources to address the needs of such children, including child welfare professionals, at each port of entry and Border Patrol station. The bill imposes various duties on such child welfare professionals, including the duty to report allegations of abuse. DHS may not remove a child from a parent or legal guardian solely for the purpose of deterring individuals from migrating to the United States or for promoting compliance with the immigration laws. DHS must (1) assign a family unit tracking number to each family member apprehended at the border, (2) allow humanitarian organizations and state and local child welfare agencies to monitor children in detention and conduct unannounced inspections, (3) promulgate regulations establishing basic standards of care for children in short-term CBP custody, (4) ensure that children apprehended by CBP receive an interview and screening with a child welfare professional and are provided information about their rights, and (5) provide each apprehended parent or legal guardian and each child with access to legal counsel. The U.S. Agency for International Development shall establish programs to support the safe and sustainable repatriation of an unaccompanied alien child to the child's country of nationality or last habitual residence.

Equal Deferment Opportunity Act This bill prohibits the Department of Defense from deploying, within a period of 12 months, a service member who gives birth, unless (1) the service member elects to deploy, and (2) such election is approved by a health care provider employed at a military medical treatment facility.

Nutrition Counseling Aiding Recovery for Eating Disorders Act of 2019 or the Nutrition CARE Act of 2019 This bill provides for Medicare coverage of medical nutrition therapy services for individuals with eating disorders. Such services must be furnished by a registered dietitian or nutrition professional pursuant to a referral from a physician, psychologist, or other authorized mental health professional.

Wage Theft Prevention and Wage Recovery Act This bill amends the Fair Labor Standards Act of 1938 (FLSA) to require employers to make initial and modified disclosures to employees of the terms of their employment, provide such employees with regular paystubs, and make a final payment to an employee for uncompensated work hours within 14 days of the employee's termination. Employers must also allow employees access to wage records. An employer must compensate an employee at the rate specified in an employment contract, including a collective bargaining agreement, that specifies a rate of pay higher than the minimum wage rate. The bill establishes new and increased civil and criminal penalties for FLSA overtime or minimum wage violations, including referral to the Department of Justice for criminal prosecution of employers who engage in wage theft, falsification of wage records, or retaliation against employees. The Wage and Hour Division of the Department of Labor must provide grants to specified organizations, including nonprofits and educational institutions, to enhance the enforcement of wage and hour laws. The Government Accountability Office must study and report on successful grant programs.

Asuncion Valdivia Heat Illness and Fatality Prevention Act of 2019 This bill requires the Department of Labor to promulgate an occupational safety or health standard on prevention of exposure to excessive heat. Excessive heat includes outdoor or indoor exposure to heat at levels that exceed the capacities of the body to maintain normal body functions and may cause heat-related injury, illness, or fatality. In addition, the bill establishes requirements concerning (1) training and education to prevent and respond to heat illness, and (2) whistle-blower protections.

Federally Requiring Earned Education-debt Discharges for Vets Act or the FREED Vets Act This bill requires the Department of Education (ED) to automatically discharge loans under the Federal Family Education Loan program for certain borrowers who are veterans of the U.S. Armed Forces. Specifically, ED must automatically discharge a veteran borrower's loan when the Department of Veterans Affairs has assigned the borrower a rating of total disability for a service-connected disability or has determined the borrower to be unemployable due to a service-connected condition, determine whether a state might impose a tax liability for the discharge of such a loan, and provide the borrower with a notification related to potential tax liability and an opportunity to opt out of such loan discharge.

Coastal State Climate Preparedness Act of 2019 This bill directs the Department of Commerce to establish a coastal climate change adaptation preparedness and response program to (1) assist coastal states with voluntarily developing coastal climate change adaptation plans, and (2) provide financial and technical assistance and training for coastal states to implement the adaptation plans.

Northern Triangle and Border Stabilization Act This bill authorizes assistance to the Northern Triangle countries (El Salvador, Guatemala, and Honduras) to address the causes of migration to the United States and contains provisions related to the handling of such migrants. The Department of State shall create and implement a Northern Triangle strategy to (1) address crime and violence, (2) improve democratic governance, and (3) promote economic development and tackle extreme poverty. The State Department shall (1) help strengthen the capacity of Western Hemisphere countries to accept and care for refugees, and (2) establish Designated Processing Centers in various Latin American countries to process individuals seeking to migrate to the United States. At least 100,000 additional nationals from Northern Triangle countries shall be admitted as refugees each year from FY2020 through FY2024. The bill requires the hiring of additional Customs and Border Protection (CBP) officers, immigration judges, and related staff. The Department of Homeland Security shall establish standards of minimum care for individuals in CBP custody and additional guidelines and standards relating to children in CBP custody. The bill expands penalties related to smuggling and establishes criminal penalties for certain actions related to evading border controls. The bill contains various other immigration-related provisions, including (1) limits on when asylum applicants may be removed, (2) an expansion of alternatives to detention programs, and (3) a requirement that the Department of Justice provide counsel to children and particularly vulnerable individuals in immigration proceedings.

Redistricting Reform Act of 2019 This bill requires that congressional redistricting be conducted in accordance with a plan developed by (1) a state-established independent commission; or (2) if such a commission fails to enact a plan, a three-judge panel from a U.S. District Court.

Stop Shackling and Detaining Pregnant Women Act This bill prohibits the Department of Homeland Security (DHS) from detaining a woman during pregnancy or postpartum recovery and must immediately release any detainee found to be pregnant, unless such woman presents an immediate and serious threat of hurting herself or others. A DHS detention facility may not use a restraint on a detainee who is known to be pregnant, including during labor, transport to a medical facility or birthing center, and delivery, or during postpartum recovery, except for medical or safety purposes. The bill requires DHS to use the least restrictive restraint necessary and prohibits certain specified restraint types, including four-point restraints and binding a detainee's hands behind her back. The bill prohibits DHS detention officers from being present during a pelvic exam of a detainee, labor, delivery, or treatment relating to a pregnancy, unless specifically requested by medical personnel. If a detention officer is requested by medical personnel, such officer shall be female, if practicable, and remain at a reasonable distance from the detainee. The bill requires that a pregnant detainee shall have access to health care services, including comprehensive services relating to reproductive health care and pregnancy.

Therapeutic Fraud Prevention Act of 2019 This bill prohibits commercial conversion therapy, which is a practice or treatment designed to change a person's sexual orientation or gender identity or otherwise change behaviors, thoughts, or expressions related to gender or sexual attraction. This prohibition does not apply to treatment that assists an individual undergoing a gender transition or facilitates identity exploration and development.

Exposing Discrimination in Higher Education Act This bill requires the Department of Education's Office for Civil Rights to publish prominently on its website the names of the institutions of higher education (IHEs) that request, and the names of the IHEs that receive, religious exemptions from the prohibition on sex discrimination in federally funded education programs and activities. It also requires an IHE that requests, receives, exercises, or intends to exercise such a religious exemption to publish prominently on its website certain information with respect to such exemption.

Preventing Risky Operations from Threatening the Education and Career Trajectories of Students Act of 2019 or the PROTECT Students Act of 2019 This bill provides additional oversight of postsecondary education programs, including for-profit institutions of higher education (IHEs), and addresses protections for students and student loan borrowers from fraudulent or predatory practices. The bill sets forth a variety of provisions concerning oversight of for-profit IHEs. Specifically, the bill decreases the cap on the amount of revenue for-profit IHEs may receive from federal sources, including funds from the Department of Veterans Affairs and the Department of Defense. In addition, it establishes (1) a process for reviewing for-profit IHEs that convert to nonprofit or public status, and (2) a For-Profit Education Oversight Coordination Committee. The bill also sets forth provisions to address predatory practices in higher education. For instance, the bill requires career education programs to prepare students for gainful employment. In addition, it requires the Office of Federal Student Aid to have a unit that enforces compliance with laws governing student financial assistance programs. The office must also maintain a system that tracks reports of suspicious activity of IHEs or student loan servicers, including anonymous complaints. Lastly, the bill allows borrowers of student loans to seek loan forgiveness if IHEs mislead the students or engage in other misconduct. Finally, the bill prohibits IHEs that receive federal funding from limiting students' legal actions, providing incentive compensation, and using educational assistance funds for recruiting and marketing activities.

This resolution expresses support for (1) equal rights and protections for all people, regardless of actual or perceived sexual orientation or gender identity; and (2) the designation of LGBTQ Equality Day on June 26 to commemorate Supreme Court decisions handed down on that day in 2003, 2013, and 2015. The resolution also acknowledges the need for further legislation to ensure that people in the United States are free from all forms of discrimination on the basis of actual or perceived sexual orientation or gender identity.

Restore Honor to Service Members Act This bill requires the Department of Defense (DOD) to review the discharge characterization of a service member who was discharged on the basis of sexual orientation (i.e., on the basis of Don't Ask Don't Tell or a similar policy) if the service member requests such a review. If the service member's discharge is characterized as other than honorable, and if there were no aggravating circumstances that would have independently caused the discharge to be characterized as other than honorable, then DOD must change its characterization of the discharge to honorable.

Patsy T. Mink and Louise M. Slaughter Gender Equity in Education Act of 2019 This bill requires the Department of Education (ED) to establish an Office for Gender Equity to support state and local educational agencies, institutions of higher education, and elementary and secondary schools in fully implementing title IX of the Education Amendments of 1972, which prohibits discrimination on the basis of sex in federally funded education programs or activities. The office may provide grants and perform activities to reduce or prevent sex discrimination in all areas of education. The office must provide technical assistance and annual training to title IX coordinators and develop a handbook for conducting self-evaluations of title IX compliance. The training must address discrimination based on multiple characteristics, including race, ethnicity, national origin, disability status, religion, age, actual or perceived sex, sexual orientation, or gender or gender identity. The office may award grants to eligible entities and partnerships that apply to carry out programs and activities designed to implement title IX and prevent and reduce sex discrimination, including programs that increase campus resources. ED must coordinate with the Institute of Education Sciences and other federal entities to investigate, identify, and disseminate best practices to (1) reduce and prevent sex stereotyping, bias, and discrimination in educational materials; (2) address sex-based harassment and violence on campuses; (3) develop counseling and career guidance training; (4) mitigate implicit bias in teaching and discipline; and (5) address the needs of students who face discrimination based on multiple characteristics.
