Equitable Student Aid Access Act This bill revises certain income requirements for calculating federal student financial aid amounts, and it requires the Department of Education (ED) to publish certain requirements for financial aid offers. Specifically, the bill eliminates the simplified needs test in financial aid applications for families with income below a specified threshold, and it increases the income threshold that automatically qualifies a student for certain financial aid. When determining the total income of an applicant or an applicant's household, ED shall provide for the use of data from the second preceding tax year to simplify applications used for the estimation and determination of financial aid eligibility. ED must also conduct consumer testing to serve as the basis for determining requirements for financial aid offers. A financial aid offer must contain information such as cost of attendance and sources of available financial aid, as well as a standardized quick reference box to enable comparison of information on college costs and financial aid.

Simplifying Student Loans Act This bill phases out existing repayment plans for federal student loans and replaces them with one fixed repayment plan and one income-based repayment plan. Under current law, a borrower may choose among eight plans for student loan repayment, such as standard repayment, extended repayment, and income-contingent repayment. The Department of Education must offer all borrowers a choice between the two new plans and allow borrowers of loans made prior to a date certain the option of continuing repayment under their original plan or electing to repay under one of the new plans.

Stopping Harmful Interference in Elections for a Lasting Democracy Act or the SHIELD Act This bill establishes a duty to report election interference from foreign entities, applies existing campaign advertising requirements to online advertisements, and generally limits political spending and election interference by foreign entities. Specifically, a political committee must report certain foreign contacts involving an offer of unlawful election assistance to the Federal Bureau of Investigation and the Federal Election Commission. The bill establishes criminal penalties for violations of these requirements. Existing requirements for political advertisements and electioneering communications apply to internet and digital advertisements, including requirements related to disclosures and contributions. Additionally, large online platforms must maintain a public database of certain political advertisements. The bill places limitations on political spending by foreign entities. Specifically, foreign entities may not (1) contribute to campaigns related to ballot initiatives and referenda, or (2) make disbursements for certain internet activity referring to a candidate or a political issue. A candidate is prohibited from offering to share nonpublic campaign information with certain foreign entities. The bill also prohibits (1) the dissemination of false statements regarding federal elections or public endorsement, or (2) the intentional hindering of voting or registering to vote. The bill establishes criminal penalties and a private right of action with respect to these prohibitions.

Stop College Closures Act of 2019 This bill revises provisions related to the recognition of an accrediting agency or association as a reliable authority on the quality of education or training offered by an institution of higher education (IHE). Specifically, an accreditor must (1) monitor the growth of programs at IHEs that are experiencing significant enrollment decline; (2) require, review, and approve the mandatory teach-out plan submitted by an IHE upon the occurrence of certain events indicating a potential school closure; and (3) respond to student complaints and monitor, assess, and submit such complaints to the Department of Education and the relevant state agencies.

The Southern Border Communities Relief Act of 2019 This bill authorizes assistance to jurisdictions and organizations providing services for aliens released from Department of Homeland Security (DHS) custody. It also directs DHS to develop a standard protocol related to releasing aliens from custody and issuing notices to such aliens to appear in immigration proceedings. The assistance authorized under this bill shall (1) be for FY2021, FY2022, and FY2023; (2) only be used to provide assistance for aliens released from DHS custody; (3) be distributed by the Emergency Food and Shelter Program National Board; and (4) only be given to jurisdictions that have experienced a significant influx of released aliens or organizations in such jurisdictions. The protocols related to releasing aliens and issuing notices to appear shall include requirements related to (1) coordinating with local governments and organizations on a release date and time, (2) releasing aliens in locations where organizations can provide assistance, and (3) ensuring that notices to appear contain complete and accurate information.

Financial Aid Fairness for Students Act or the FAFSA Act This bill repeals a provision that makes students convicted of drug-related offenses ineligible for federal student aid, and it prohibits the Department of Education from asking about drug-related convictions on the Free Application for Federal Student Aid.

Minority Diabetes Initiative Act This bill allows the Department of Health and Human Services (HHS) to make grants to public and nonprofit private health care providers to provide treatment for diabetes in minority communities. HHS must ensure that these grants cover a variety of diabetes-related health care services, including routine care for diabetic patients, public education on diabetes prevention and control, eye care, foot care, and treatment for kidney disease and other complications of diabetes.

Stop Mental Health Stigma in Our Communities Act This bill requires the Substance Abuse and Mental Health Services Administration to develop and implement an outreach and education strategy regarding behavioral health issues among the Hispanic and Latino populations. The strategy must be designed to promote behavioral and mental health and reduce stigma associated with mental health conditions and substance abuse among such populations.

FAFSA Translation Act This bill requires the Department of Education to (1) translate the forms developed under the Free Application for Federal Student Aid into no fewer than 11 foreign languages, and (2) make the translated forms available to applicants in paper and electronic formats.

Public Servants Protection and Fairness Act This bill establishes an alternative formula to calculate Old-Age, Survivors, and Disability Insurance benefits for those who receive pensions for certain non-covered employment. (The existing formula is known as the windfall elimination provision.) The alternative formula adjusts an individual's total lifetime earnings based on the proportion of covered earnings (i.e., earnings subject to Social Security payroll taxes). It applies to individuals who (1) first become eligible for benefits after 2021, (2) have earnings from non-covered service performed after 1977 and (3) have less than 30 years of coverage (i.e., years in which a beneficiary is considered to have contributed a substantial amount into the Social Security trust funds). Beneficiaries receive the higher benefit amount as calculated under the alternative method or the existing formula. In addition, the bill provides rebates for certain beneficiaries currently impacted by the existing formula. The Social Security Administration must include non-covered earnings in Social Security account statements, and the Government Accountability Office must study the availability of certain information related to retirement plans maintained by state and local governments.

This joint resolution nullifies a rule issued by the Department of Education (ED) on September 23, 2019. The rule revised the process for a student loan borrower to obtain a discharge from a student loan if an institution of higher education misrepresented a material fact. Among other requirements, the 2019 rule requires each borrower to apply to ED for a defense to repayment. However, under the previous 2016 rule, an application could be submitted on behalf of an entire group (e.g., veterans).

Expanding Health Care Options for Early Retirees Act This bill establishes a Medicare buy-in option for certain qualifying first responders. Specifically, the bill allows first responders aged 50 to 64 to enroll in Medicare if they are retired or otherwise separated from service due to a disability. The Centers for Medicare & Medicaid Services (CMS) must determine enrollment periods and set premiums for the buy-in option established under the bill, in accordance with specified requirements. The CMS must also award grants to states and nonprofit organizations for outreach and enrollment activities relating to the buy-in option.

This resolution expresses support for the designation of National Suicide Prevention Month; recognizes suicide as a preventable public health problem and declares that suicide prevention should be a priority; and promotes awareness that there is no single cause for suicide and that particular attention should be paid to communities at heightened risk, including lesbian, gay, bisexual, transgender, and queer (LGBTQ) youth and LGBTQ youth of color.

(REACH is a national program administered by the Centers for Disease Control and Prevention that aims to reduce health disparities among racial and ethnic populations with the highest burden of chronic disease.) The resolution further expresses the commitment of the House of Representatives to protecting and expanding investments to address racial and ethnic health disparities and encourages federal agencies to build on the work of REACH grantees.

Eric Garner Excessive Use of Force Prevention Act of 2019 This bill modifies the criminal civil rights statute that prohibits the deprivation of rights under color of law. Currently, the second prong of the prohibition bars the application of different punishments, pains, or penalties based on an individual's alien status, color, or race. This bill specifies that the application of any pressure to a person's throat or windpipe which may prevent or hinder breathing or reduce intake of air (e.g., a chokehold) constitutes a punishment, pain, or penalty.

Lead-Free Future Act of 2019 This bill addresses lead-based hazards, and their abatement, in residential properties. Specifically, the bill requires the Department of Housing and Urban Development (HUD) to award grants to state and local governments and certain nonprofit organizations for the purpose of evaluating and reducing lead-based hazards in residential properties constructed before 1978. Additionally, the Department of Health and Human Services (HHS) may award grants to state and local governments to monitor blood lead levels in infants, children, and pregnant women and to educate the public on the risks of lead poisoning. To be eligible to receive funding from these grant programs and others addressing lead poisoning, a state or local government must have a blood lead reference level (i.e., the minimum concentration of lead at which it is recommended that public health actions be taken) at or below the level used by the Centers for Disease Control and Prevention. Applicants must also conduct an environmental investigation to identify environmental sources of lead exposure in residential properties and childcare facilities occupied by a child with an elevated blood lead level. In addition, HUD, the Department of Agriculture, the Federal Housing Finance Agency, and the Department of Veterans Affairs must require alignment with specified federal laws, including those related to lead-risk assessment and lead-hazard remediation, as a condition of eligibility for federal mortgage programs and certain federally supported housing. These agencies must also test and remedy lead hazards in such housing.

The concurrent resolution also supports policies that will help meet these goals, such as policies that achieve maximum feasible reductions in oil use.

Office of Technology Assessment Improvement and Enhancement Act This bill renames and revises the functions and duties of the Office of Technology Assessment which, composed of a Technology Assessment Board and a director, provides Congress with assessments of probable technology application impacts. Specifically, the bill renames the office the Congressional Office of Technology, and it requires the office to undertake additional duties, such as providing to Members of Congress (1) certain information without the need for board review, (2) certain technical assistance on legislation related to science and technology without the need for board review, and (3) objective policy options on how Members may achieve goals with respect to science and technology policy. The bill authorizes Members of Congress to submit to the board a request that the office undertake an assessment activity. Additionally, the bill requires the Congressional Research Service and the Government Accountability Office to coordinate technology assessment activities with the office to avoid duplication or overlapping of research activities. The office may temporarily appoint specified technical and professional personnel to work for the office, and the office must also make the findings of completed analyses publicly available. The bill also (1) revises the appointment of board members, (2) requires the board to hold an annual meeting at which Members of Congress may appear and present information regarding technology assessment activities, and (3) requires the board to report annually on the activities of the office.

Protect America’s Wildlife and Fish In Need of Conservation Act of 2019 or the PAW and FIN Conservation Act of 2019 This bill nullifies the 2019 rules relating to the listing of endangered or threatened species and the designation of critical habitats. Among other things, the restored rules automatically give threatened species the same protections as endangered species; revise requirements governing when an agency must consult with the U.S. Fish and Wildlife Service or the National Marine Fisheries Service about endangered species, threatened species, or their habitats; prohibit economic assessments from being considered in listing decisions; and revise the criteria used for designating critical habitats for the species.

Police Exercising Absolute Care With Everyone Act of 2019 This bill establishes a framework to reduce the unnecessary use of force by law enforcement at the federal, state, and local levels. At the federal level, the bill limits the use of force by federal law enforcement officers. It prohibits the use of deadly force, except as a last resort to prevent imminent and serious bodily injury or death. It also prohibits the use of less lethal force, unless it is necessary and proportionate to effectuate an arrest. Finally, it limits the use of a justification defense for a federal law enforcement officer who is charged with murder or manslaughter. At the state and local level, the bill conditions eligibility for funds under the Edward Byrne Memorial Justice Assistance Grant Program on the enactment of consistent limitations.

School Shooting Safety and Preparedness Act This bill requires the Department of Education to publish an annual report on indicators of school crime and safety. Such report shall collect specified information, including (1) the number of school shootings that have taken place nationwide; (2) the age, gender, race, ethnicity, and nationality of each victim; (3) the motivation of the shooter; (4) how the shooting was stopped; and (5) the number and type of firearms and ammunition used in each shooting.

Puppies Assisting Wounded Servicemembers for Veterans Therapy Act or the PAWS for Veterans Therapy Act This bill requires the Department of Veterans Affairs to implement a pilot program to assess the effectiveness of addressing post-deployment mental health and post-traumatic stress disorder through a method where veterans train service dogs for veterans with disabilities.

Immigrant Witness and Victim Protection Act of 2019 This bill provides protections for certain aliens who are victims of crimes and violence. The bill removes the annual cap on the number of visas issued to aliens who are victims of certain serious crimes and are likely to be helpful to law enforcement in prosecuting such crimes (U visas). Work authorization shall be granted to an alien with a pending application for (1) a U visa, (2) a T visa (for victims of severe human trafficking), or (3) cancellation of removal on the basis of the alien being subjected to extreme cruelty by a spouse, parent, or fiancé. Removal shall be stayed and detention shall be prohibited for an alien with a pending application for (1) a T or U visa; (2) employment authorization for a battered spouse of certain types of nonimmigrants; (3) cancellation of removal or adjustment of status on the basis of the alien being subjected to extreme cruelty by a spouse, parent, or fiancé; (4) temporary protected status; or (5) relief under the Violence Against Women Act.

Pell Grant Restoration Act This bill restores a student's Pell Grant eligibility for any period of time during which the student qualified for, or would have qualified for, federal student loan forgiveness due to school closure, assertion of a defense against repayment, or institutional fraud or misconduct. Specifically, this bill provides that Pell Grants received by a student during that period of time do not count toward the student's lifetime Pell Grant eligibility period (currently 12 full-time semesters).

Supplemental Security Income Restoration Act of 2019 This bill modifies the Supplemental Security Income (SSI) benefits program by (1) excluding certain income and raising the resource limit for purposes of determining SSI eligibility, (2) providing for annual inflation adjustments for benefits, and (3) repealing certain SSI penalties related to disposing of resources for less than fair market value.

TPS for Victims of Hurricane Dorian Act of 2019 This bill designates the Bahamas as a temporary protected status (TPS) country for 18 months from the enactment of this bill. (Qualified nationals of a TPS-designated country shall have work authorization and may not be removed from the United States while the designation is in effect.) A Bahamian national shall qualify for temporary protected status if the individual (1) has been continuously physically present in the United States since the bill's enactment, (2) meets certain admissibility and eligibility requirements generally required for such status, and (3) registers with the Department of Homeland Security.

Rare disease Advancement, surveillance Research, and Education Act of 2019 or the RARE Act of 2019 The bill reauthorizes through FY2024 the National Institutes of Health Rare Disease Regional Centers of Excellence and expands activities to facilitate research and increase awareness of rare diseases and conditions. (Rare diseases and conditions are those with a prevalence of fewer than 200,000 individuals in the United States.) The Centers for Disease Control and Prevention (CDC) may expand infrastructure and activities to track the epidemiology of up to four rare diseases and conditions and incorporate this information into a National Rare Disease or Condition Surveillance System. The Agency for Healthcare Research and Quality must expand its activities to increase health care providers' awareness of rare diseases and conditions. The National Academies of Sciences, Engineering, and Medicine, or another appropriate entity, must update the 2010 report Rare Diseases and Orphan Products: Accelerating Research and Development.

Animal Welfare Enforcement Improvement Act This bill revises the licensing process of the Department of Agriculture (USDA) for animal dealers and exhibitors to expand USDA's oversight and enforcement of animal welfare requirements. The bill also authorizes citizen suits to enforce the Animal Welfare Act. Dealers and exhibitors must apply to USDA for licenses or renewal licenses each year. Before issuing or renewing licenses, USDA must conduct unannounced facility inspections. USDA must deny an application for a new license if the applicant fails to meet animal welfare standards during a second inspection, a renewal license if the applicant violates such standards in more than one inspection in the previous two years, or a new or renewal license if the dealer or exhibitor has violated laws relating to animals or if the issuance of the license would facilitate the circumvention of state or local laws that prohibit the private ownership of certain animals. Further, USDA must suspend the licenses of dealers or exhibitors whose violations present a risk to animal welfare. USDA must revoke the licenses if the violations persist or if the licensees commit multiple violations. Dealers and exhibitors with suspended or revoked licenses may not be (1) granted another license, (2) granted another license through another person or entity, or (3) employed by another licensee to work with animals during the period of the suspension or revocation.

Student and Taxpayer Protection Act This bill requires the Department of Education to establish performance metrics and a disclosure template to enable programs of training that prepare students for gainful employment in a recognized occupation to be eligible to receive federal student aid funds.

No Federal Funding for Confederate Symbols Act This bill prohibits federal funds from being used for the creation, maintenance, or display of any Confederate symbol on federal public land or other federal property. An exception to such prohibition is provided (1) if the use of such funds is necessary to allow for the removal of the Confederate symbol to address public safety; or (2) in the case of a Confederate symbol created, maintained, or displayed in a museum or educational exhibit. The Department of Defense shall redesignate the following military installations with such designation as it determines appropriate: Fort Rucker, Alabama, Fort Benning, Georgia, Fort Gordon, Georgia, Camp Beauregard, Louisiana, Fort Polk, Louisiana, Fort Bragg, North Carolina, Fort Hood, Texas, Fort A.P. Hill, Virginia, Fort Lee, Virginia, and Fort Pickett, Virginia.

Improving Benefits for Underserved Veterans Act This bill requires the Department of Veterans Affairs (VA) to publish a report regarding veterans who receive VA benefits, including those who receive benefits under the Transition Assistance Program. Information in the report must be disaggregated by sex and minority group member status.

Health Care Access for Urban Native Veterans Act This bill authorizes the Department of Veterans Affairs (VA) and the Department of Defense (DOD) to enter arrangements for the sharing of medical facilities and services with urban Indian organizations. The VA and DOD shall reimburse an urban Indian organization where services are provided to beneficiaries eligible for services from either department.

Funding Attorneys for Indigent Removal (FAIR) Proceedings Act This bill expands access to counsel for aliens in immigration proceedings and provides for protections related to such proceedings. An alien shall have the privilege of being represented by counsel in any immigration proceeding, whereas currently this privilege is statutorily provided for only in removal proceedings. Similarly, the Department of Justice (DOJ) may provide counsel at government expense to aliens in any immigration proceeding, whereas currently DOJ is statutorily authorized to provide counsel to aliens only in removal proceedings and at no expense to the government. Under this bill, DOJ shall provide counsel to children and vulnerable individuals in such proceedings, at government expense if necessary. If DOJ fails to do so, certain limits on filing a motion to reopen removal proceedings (such as the time limit for filing) shall not apply, and the alien's removal shall be stayed upon the motion's filing. The bill establishes the Immigration Counsel Account and a surcharge on various immigration fees. The surcharge shall be deposited into the account to be used to provide counsel under this bill. The Department of Homeland Security (DHS) shall provide each alien, generally at the beginning of proceedings, a complete copy of the alien's case file in DHS possession, unless the alien waives this right in writing. Failure to provide such documents shall delay the alien's removal proceeding. DHS shall facilitate for all detained aliens access to counsel and programs that inform such aliens of their immigration-related rights and obligations.

Negro Leagues Baseball Centennial Commemorative Coin Act This bill directs the Department of the Treasury to mint and issue up to 50,000 $5 gold coins, 400,000 $1 silver coins, and 750,000 half-dollar clad coins in commemoration of the 100th anniversary of the establishment of the Negro National League, a professional baseball league that was formed in response to African-American players being banned from baseball's major leagues. The design of the coins shall be emblematic of the Negro Leagues Baseball Museum and its mission to promote tolerance, diversity, and inclusion. All surcharges from sales of these coins shall be paid to the Negro Leagues Baseball Museum to fund educational and outreach programs and exhibits.

Build Local, Hire Local Act This bill imposes various requirements on certain federally assisted infrastructure projects. The bill also creates infrastructure-related grant programs and establishes the Buy America Bureau. Such federally assisted infrastructure projects must (1) employ a certain percentage of local workers to the maximum extent practicable; and (2) prioritize hiring certain individuals, such as veterans and those facing barriers to employment. A certain percentage of funds for such projects shall be used for contracts with small businesses and certain targeted businesses, such as those owned by socially or economically disadvantaged individuals, women, or individuals with disabilities. When applying for a contract, grant, or loan related to such a project, the applying entity must disclose whether there are any rulings, such as a civil judgment, finding that the entity has violated certain federal labor and occupational safety laws in the last three years. In addition, the Department of Transportation must award grants to entities in disadvantaged and underserved communities for infrastructure projects that create connected, economically prosperous, and environmentally healthy communities. Further, the Department of Labor must provide grants to workforce development boards and industry partnerships for job training programs to train certain groups, such as individuals with barriers to employment, for jobs in targeted infrastructure industries. The bill also establishes the Buy America Bureau within the Department of Commerce to oversee project compliance with existing laws that require the use of U.S.-made materials in certain federally funded projects.

EARLY Act Reauthorization of 2019 This bill reauthorizes through FY2024 programs that raise public awareness about breast health, educate health care providers to encourage early detection of breast cancer, and provide support for young women diagnosed with breast cancer.

Expanding Broadcast Ownership Opportunities Act of 2019 This bill requires the Federal Communications Commission (FCC) to increase diversity of ownership in the broadcasting industry. Specifically, the bill allows companies engaged in the qualifying sale of a broadcast station to receive favorable tax treatment by electing nonrecognition of the gain or loss resulting from the sale. To qualify for this treatment, the sale must result in or preserve ownership of a broadcast station by socially disadvantaged individuals. The bill also requires the FCC to foster investment in broadcast stations owned by socially disadvantaged individuals.
