Directs the Secretary, with certain exceptions, to submit to Congress every 180 days written certification that DHS has deported or otherwise removed an apprehended individual from the United States through an entry or exit point on the southern border only during daylight hours. Directs the Secretary to promulgate regulations establishing short-term custody standards providing for basic minimums of care at all CBP facilities holding individuals in CBP custody.

Elder Protection and Abuse Prevention Act

Elder Protection and Abuse Prevention Act - Amends the Older Americans Act of 1965 to direct the Assistant Secretary of Health and Human Services for Aging to: (1) ensure that all programs funded under such Act include appropriate training in elder abuse prevention and the provision of services that address elder justice and exploitation, and (2) update periodically the need for and benefit of such training related to prevention of abuse, neglect, and exploitation (including financial exploitation) of older adults. Makes it a duty and function of the Administration on Aging to: (1) establish priority information and assistance services for older individuals; (2) ensure full collaboration between all governmental information and assistance systems that serve older individuals; and (3) develop a National Eldercare Locator Service, with a nationwide toll free number. Directs the Assistant Secretary, by grant or contract with a national nonprofit entity, to establish a National Adult Protective Services Resources Center to improve the capacity of state and local adult protective services programs to: (1) respond effectively to abuse, neglect, and exploitation of vulnerable adults, including home care consumers and residents of long-term care facilities; and (2) coordinate with the Long-Term Care Ombudsman Program. Requires each area plan to provide that the area agency on aging: (1) increases public awareness of elder abuse and financial exploitation, and removes barriers to elder abuse education, prevention, investigation, and treatment; (2) coordinates elder justice activities of the area agency on aging, community health centers, other public agencies, and nonprofit private organizations; (3) develops standardized, coordinated, and reporting protocols with respect to elder abuse; and (4) reports instances of elder abuse. Directs the Assistant Secretary to make grants to states under approved state plans for elder abuse and neglect screening. Requires a state operating a nutrition project to encourage individuals who distribute nutrition services to distribute information on diabetes, elder abuse, neglect, financial exploitation, and the annual Medicare wellness exam. Requires a state, an area agency on aging, a nonprofit organization, or a tribal organization that receives a grant for an older individuals' protection from violence project to use it to research and replicate successful models of elder abuse, neglect, and exploitation prevention and training. Directs the Assistant Secretary to award grants and enter into contracts with eligible organizations to carry out projects to engage volunteers over 50 years of age in providing support and information to older adults (and their families or caretakers) who have experienced or are at risk of elder abuse. Allows a state to use funds under the National Family Caregiver Support Program to support the Office of the State Long-Term Care Ombudsman.

Smuggled Tobacco Prevention Act of 2013 or the STOP Act - Amends the Internal Revenue Code to restrict the sale, lease, export or import, or delivery of tobacco production machines to persons lawfully engaged in: (1) the sale, lease, export or import, or delivery of such machines; (2) the manufacture or packaging of tobacco products or processed tobacco; or (3) the application of unique identification markings onto tobacco products or processed tobacco packages. Requires every person having possession or control of such machines to register then immediately with the Secretary upon installation. Defines "tobacco production machine" as a machine used to manufacture or package tobacco products or processed tobacco or to apply unique identification markings or other tax-payment indicia to packages of tobacco products or processed tobacco. Extends record keeping requirements to wholesalers and retailers of tobacco products and processed tobacco. Requires manufacturers and importers of tobacco products to affix a unique identification marking to each package of tobacco products or processed tobacco prior to sale or distribution in the United States or prior to export. Directs the Secretary of the Treasury to design a system of unique identification markings that does not interfere with state, local, or tribal tax stamps and markings and that provides a unique serial number or tracking code for each tobacco product. Requires wholesalers of tobacco products to obtain permits for selling or exporting tobacco products. Establishes new criminal offenses relating to the licensing and distribution of tobacco products or processed tobacco. Increases the civil penalty for tobacco-related infractions from $1,000 to $10,000. Requires the Secretary of the Treasury to coordinate with other federal agencies and officials to prevent and reduce tobacco tax evasion and contraband trafficking in tobacco products and processed tobacco. Amends the Tariff Act of 1930 to impose a civil penalty for the importation of tobacco products and cigarette papers and tubes by fraudulent means. Provides for the enforcement of this Act in Indian tribal areas.

Defines "designated savings products" as a qualified retirement plan, a qualified tuition plan, a Coverdell education savings account, a U.S. savings bond, a certificate of deposit with a duration of at least 8 months, a savings account, or other savings product considered appropriate by the Secretary of the Treasury. Directs the Internal Revenue Service (IRS) to notify individual taxpayers who may qualify for a savings product tax credit that they have the option of an electronic direct deposit of any portion of their tax refund into a designated savings product.

Captive Primate Safety Act - Amends the Lacey Act Amendments of 1981 to add nonhuman primates to the definition of "prohibited wildlife species" for purposes of the prohibition against the sale or purchase of such species in interstate or foreign commerce. Makes it unlawful for a person to import, export, transport, sell, receive, acquire, or purchase a live animal of any prohibited wildlife species in interstate or foreign commerce (i.e., for pet trade purposes). Modifies exceptions to such prohibition, including by making it inapplicable to a person who is: (1) a licensed and inspected person who does not allow direct contact between the public and prohibited wildlife species, and (2) transporting a single primate of the genus Cebus that was obtained from and trained by a charitable organization to assist a permanently disabled individual with a severe mobility impairment. Sets forth civil and criminal penalties for violations of the requirements of this Act.

Nursing Home Patient Protection and Standards Act of 2013 - Amends title XVIII (Medicare) and XIX (Medicaid) of the Social Security Act to require testing programs in skilled nursing facility (SNF) survey and certification techniques to be sufficiently rigorous to ensure that surveyors are adequately prepared to survey and certify SNFs in a consistent and accurate manner. Directs the Secretary of Health and Human Services (HHS) to establish requirements: (1) for the qualification and compensation of members of a survey team, and (2) that a state employs an adequate number of individuals as members of survey teams to ensure adequate oversight of SNFs. Requires the Secretary, in addition to the training and testing program, to require that state and federal surveyors regularly complete an adequate number of continuing education courses meeting certain requirements for content and rigor of material. Requires covered individuals to report to the Secretary instances where surveys fail to report or under report an issue in a facility that could impact the safety or quality of care of its residents. Adds whistleblower protections for such individuals. Adds penalties for inappropriately influencing a surveyor. Requires the Secretary to establish an advisory committee on surveys. Requires survey team supervisors to review each conducted survey to ensure that any identified issues affecting quality of care are consistently and appropriately described and rated.

Restore Honor to Service Members Act

Restore Honor to Service Members Act - Requires appropriate military record correction boards or discharge review boards to review the discharge characterization of any former members of the Armed Forces requesting a review who were discharged because of their sexual orientation. Permits such boards to change a characterization to honorable if such characterization is any characterization except honorable. Directs the Secretary of Defense (DOD) to ensure that any such changes are carried out consistently and uniformly across the military departments using specified criteria, including that: (1) the original discharge was based on the policy of Don't Ask Don't Tell (as in effect before it was repealed pursuant to the Don't Ask, Don't Tell Repeal Act of 2010) or a similar earlier policy; and (2) the discharge characterization will be changed if, with respect to the original discharge, there were no aggravating circumstances, such as misconduct, that would have independently led to any discharge characterization except honorable. Prohibits "aggravating circumstances" from including: (1) an offense of sodomy committed by the member against a consenting person of the same sex; or (2) statements, consensual sexual conduct, or consensual acts relating to sexual orientation or identity, or the disclosure of such statements, conduct, or acts, that were prohibited at the time of discharge but that became permitted after such discharge. Directs the Secretary of each military department to ensure that oral historians of the department: (1) review discharges between World War II and September 2011 based on sexual orientation, and (2) receive oral testimony of individuals who personally experienced discrimination and discharge because of actual or perceived sexual orientation so that such testimony may serve as an official record of such discriminatory policies and their impact on American lives. Requires the reissuance of specified military personnel records and discharge forms in a manner that shall not reflect the sexual orientation of the member. Amends the Uniform Code of Military Justice to remove from the offense of sodomy specified activity referred to as unnatural carnal copulation with another person of the same or opposite sex.

CLEANER Act of 2013

CLEANER Act of 2013 or the Closing Loopholes and Ending Arbitrary and Needless Evasion of Regulations Act of 2013 - Amends the Solid Waste Disposal Act, with respect to the regulation of wastes associated with the exploration, development, or production of crude oil, natural gas, or geothermal energy, to require the Administrator of the Environmental Protection Agency (EPA), within one year, to: determine whether drilling fluids, produced waters, and other wastes associated with such activities meet the criteria promulgated for the identification or listing of hazardous waste; identify or list as hazardous waste any of such energy-associated wastes that the Administrator determines meet the identification or listing criteria; and promulgate regulations regarding standards applicable to generators, transporters, and owners and operators of facilities for the treatment, storage, or disposal of wastes described under this Act (except that the Administrator may modify the requirements for such regulations to consider such wastes' special characteristics so long as the requirements protect human health and the environment). Directs the Administrator to promulgate revisions of the criteria regarding sanitary landfills and practices of open dumping for facilities that receive the energy-associated wastes described under this Act not identified as hazardous waste. Requires such revisions to: be those necessary to protect human health and the environment, allowing consideration of the practicable capability of such facilities; and include, at minimum, groundwater monitoring as necessary to detect contamination, criteria for the acceptable location of new or existing facilities, and provision for corrective action and financial assurance.

Rape Survivor Child Custody Act

Rape Survivor Child Custody Act - Directs the Attorney General to make grants to states that have in place a law that allows the mother of any child that was conceived through rape to seek court-ordered termination of the parental rights of her rapist with regard to that child, which the court shall grant upon clear and convincing evidence of rape. Limits such a grant to: (1) an amount that is not greater than 10% of the average of the total funding of the 3 most recent awards a state received under the STOP Violence Against Women Formula Grant Program and the Sexual Assault Services Program; and (2) a 1-year term, subject to renewal for not more than 3 additional years. Requires a state that receives such a grant to use: (1) 25% of grant funds for permissible uses under the STOP Violence Against Women Formula Grant Program, and (2) 75% of funds for permissible uses under the Sexual Assault Services Program.

Saving America's Pollinators Act of 2013

Saving America's Pollinators Act of 2013 - Requires the Administrator of the Environmental Protection Agency (EPA) to suspend the registration of imidacloprid, clothianidin, thiamethoxam, dinotafuran, and any other members of the nitro group of neonicotinoid insecticides to the extent such insecticide is registered under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) for use in seed treatment, soil application, or foliar treatment on bee attractive plants, trees, and cereals until the Administrator has made a determination that such insecticide will not cause unreasonable adverse effects on pollinators. Requires such a determination to be based on: (1) an evaluation of the published and peer-reviewed scientific evidence on whether the use or uses of such neonicotinoids cause unreasonable adverse effects on pollinators, including native bees, honeybees, birds, bats, and other species of beneficial insects; and (2) a completed field study that meets the criteria required by the Administrator and evaluates residues, including residue build-up after repeated annual application, chronic low-dose exposure, and cumulative effects of multiple chemical exposures. Prohibits the Administrator from issuing any new registrations of the pesticides listed in this Act for any seed treatment, soil application, and foliar treatment on bee attractive plants, trees, and cereals under FIFRA until the Administrator has made such determination with respect to such insecticide. Requires the Secretary of the Interior, in coordination with the Administrator, to: (1) regularly monitor the health and population status of native bees, (2) identify the scope and likely causes of unusual native bee mortality, and (3) submit to Congress and make public an annual report on such health and population status.

Help Separated Families Act of 2013 - Amends part E (Foster Care and Adoption Assistance) of title IV of the Social Security Act to: (1) require state child protection standards to ensure that the immigration status alone of a parent, legal guardian, or relative shall not disqualify the parent, legal guardian, or relative from being a placement for a child; and (2) require the state procedures for criminal records checks to require the state to accept foreign identification documents as sufficient identification for purposes of initiating a criminal records check or a fingerprint-based check. Requires the state plan for foster care and adoption assistance to notify relatives seeking placement of a child that their immigration status will not be questioned, except to the extent necessary in determining eligibility for relevant services or programs. Includes as a compelling reason for a state not to file for termination of parental rights in foster care cases the removal of an otherwise fit and willing parent from the United States or the parent's involvement in an immigration proceeding (including detention). Requires a state (or local agency), before filing to terminate parental rights, to make reasonable efforts to notify any parent of the child who has been removed from the United States, and any adult relative of the child, including through the diplomatic or consular offices of the country to which the parent was removed, and to reunify the child with any such parent or relative. Directs the Secretary of Health and Human Services (HHS) to develop and disseminate to state, county, and local child welfare agencies best practice guidance on specified activities that takes into account the best interest of the child, including a preference for family unity whenever appropriate. Requires a state plan for foster care and adoption assistance to require the state to: (1) ensure that the case manager for a separated child is capable of communicating in the native language of the child and the family, or that an interpreter is provided at no cost; (2) coordinate with the Department of Homeland Security (DHS) to make every effort to ensure that parents who wish for their child to accompany them to their country of origin are given adequate time and assistance to obtain a passport, visa, and all relevant documents and other information; and (3) preserve the privacy and confidentiality of certain information in specified ways.

Amends the federal rules of construction added by such Act concerning the definitions of "marriage" and "spouse" to provide that, for purposes of any federal law in which marital status is a factor, an individual shall be considered married if that individual's marriage is valid in the state where the marriage was entered into or, in the case of a marriage entered into outside any state, if the marriage is valid in the place where entered into and the marriage could have been entered into in a state. Removes the definition of "spouse" (currently, a person of the opposite sex who is a husband or a wife).

Educating Tomorrow's Engineers Act - Amends the Elementary and Secondary Education Act of 1965 to require states to incorporate engineering design skills and practices into their academic content standards and academic achievement standards and assessments in science by the 2016-2017 school year. Requires states to reserve 10% of the grant they receive under the Teacher and Principal Training and Recruiting Fund program to award competitive grants to nonprofit organizations and other entities with expertise in the science, technology, engineering, and mathematics (STEM) fields to develop and provide professional development and instructional materials for STEM education in their state. Changes current references to the mathematics and science partnerships program to references to the STEM partnerships program, which provides funding to states, institutions of higher education, and high-need local educational agencies (LEAs) to recruit and train STEM teachers and improve STEM curricula. Amends the 21st century community learning centers program to include STEM activities (currently, mathematics and science activities) within the before- and after-school activities funded under that program. Amends the rural and low-income school program to include professional development in engineering education among the uses of the funds provided to rural LEAs. Amends the Education Sciences Reform Act of 2002 to require the National Center for Education Research to sponsor and conduct research geared toward improving STEM, rather than just mathematics and science, teaching and learning. Directs the Secretary of Education to support research on engineering education and use that research to provide information to the public, and technical assistance to states, on best practices and promising innovations in kindergarten through grade 12 engineering education.

Authorizes the Secretary to cover under Medicare part D (Voluntary Prescription Drug Benefit Program) medication for treatment of obesity or for weight loss management for an overweight individual with one or more comorbidities.

Children's Act for Responsible Employment of 2013 or CARE Act of 2013 - Amends the Fair Labor Standards Act of 1938 to define "oppressive child labor," for purposes of the Act's child labor prohibitions, as the employment of any employee who is: (1) 16 or 17 in any occupation found by the Secretary of Labor to be particularly hazardous for their employment or detrimental to their health or well-being; (2) 14 or 15, unless the employment is confined to periods which do not interfere with the employee's schooling, health, or well-being; or (3) under 14. Revises the Act's exemptions to make the restrictions on oppressive child labor inapplicable to the following: (1) employment in agriculture of an employee under age 18 by his or her parent, or by a person standing in the place of the parent, on a farm owned by the parent or person (current law uses an age- and consent-based scheme); and (2) employment of an employee under age 16 by a parent, or a person standing in place of a parent, other than in agriculture, manufacturing, mining, or any other employment the Secretary finds to be particularly hazardous for the employment of children age 16 or 17 or detrimental to their health or well-being. (Current law applies the child labor restrictions to particularly hazardous agricultural employment, except where the child is employed by a parent or a person standing in place of the parent on a farm owned or operated by such person). Eliminates any waiver of such prohibitions for hand-harvesting of certain crops. Increases civil and establishes criminal penalties for child labor violations. Directs the Secretary to revise federal child labor regulations to prohibit the employment of children under age 18 in duties involving the handling of pesticides.

Requires the Agency for Healthcare Research and Quality to make publicly available and update an online bibliographic database identifying systematic reviews, including an explanation of the level and quality of evidence, for the care of childbearing women and newborns. Requires the Administrator of the Health Resources and Services Administration to: (1) designate maternity care health professional shortage areas under the National Health Service Corps program, and (2) award planning and implementation grants to address workforce disparities for such professionals. Directs the Secretary of Health and Human Services (HHS) to support the establishment of two additional Centers for Excellence on Optimal Maternity Outcomes to conduct research to improve maternity outcomes. Requires the Secretary to convene an Interprofessional Maternity Provider Education Commission to discuss and make recommendations for: (1) a consensus standard physiologic maternity care curriculum that takes into account the core competencies for basic midwifery practice and the educational objectives for physicians practicing in obstetrics and gynecology, (2) suggestions for multidisciplinary use of the consensus physiologic curriculum, (3) strategies to integrate and coordinate education across maternity care disciplines, and (4) pilot demonstrations of interprofessional educational models. Amends title XVIII (Medicare) of the Social Security Act to cover services provided by a supervised student midwife or an intern or resident-in-training under a teaching program under certain circumstances.

Requires each state grantee to develop and implement a state child and youth strategy that assesses children's needs and the assets within the state that can be mobilized, coordinated, and integrated to achieve quantifiable progress toward goals that include ensuring that: (1) children are ready for school; (2) students are engaged and achieving in school; (3) students are physically, mentally, socially, and emotionally healthy; (4) schools and neighborhoods are safe and provide a positive climate for learning; (5) families and communities are supportive and engaged in their children's education as equal partners; (6) students are ready for postsecondary education and 21st Century careers; (7) students are contributing to their communities; and (8) students are not chronically absent. Directs the consortia to develop and implement a local child and youth strategy that integrates multiple private and public services into a comprehensive, coordinated continuum of services directed toward achieving quantifiable progress toward such goals. Requires the Secretary to award competitive grants directly to local consortia if appropriated funds fall below a specified amount.

Prohibits federal facilities from purchasing or otherwise acquiring dogs or cats for exhibition purposes (currently, for research, experimentation, or exhibition purposes) except from: (1) the operator of an auction that comports with legal requirements, or (2) a person holding a valid dealer or exhibitor license. Prohibits dealers from selling or otherwise providing any research facility (currently, any individual or entity) with random source dogs or cats unless specified certification requirements are met.

Directs the Secretary to award competitive, matching Promise School grants to LEAs that partner with nonprofit organizations, and Indian or charter schools that partner with nonprofit organizations or institutions of higher education, to implement school-centered strategies and integrated student supports that leverage community partnerships to improve student achievement and development in schools with high concentrations of low-income children. Authorizes the Secretary to renew Promise Neighborhood Partnership grants and Promise School grants if the grantees demonstrate significant success in: (1) ensuring children's school readiness; (2) improving their academic outcomes; (3) increasing their college and career readiness; and (4) improving their health, mental health, and social and emotional well-being. Requires this Act's grantees to evaluate their programs continuously and improve them based on data and outcomes. Directs the Secretary to evaluate this Act's grant programs and disseminate research on best practices for improving the academic achievement of children living in our most distressed communities. Authorizes the Secretary to award matching planning grants to entities eligible for this Act's other grants.

FIT Kids Act

Fitness Integrated with Teaching Kids Act or FIT Kids Act - Requires the Secretary of Education to award grants to states to implement comprehensive programs to promote physical activity, education, and fitness and nutrition that are based on scientifically valid research, and an analysis of need that considers, at a minimum, physical education indicators. Limits a grant award to a maximum of five years. Prescribes certain activities under a grant, including that states must: (1) develop and implement a physical education indicators measurement system; (2) collect and publish information on physical activity, education, and fitness and nutrition at the school level; (3) use indicators to identify and address student needs; (4) encourage local education agencies to integrate physical activity, education, and fitness into a range of subjects throughout the school day and locations within schools; and (5) award sub-grants based on identified needs. Requires the Secretary, acting through the Director of the Institute of Education Sciences, to establish program performance metrics to measure the effectiveness of the grant program's activities. Amends the Elementary and Secondary Education Act of 1965 to require the compact with parents under the school-level parental involvement policy to include a description of the school's responsibility to support their children in leading a healthy and active life, such as by providing health meals and snacks, encouraging participation in physical education, and sharing in physical activity outside the school day to support successful academic achievement. Amends the Rehabilitation Act of 1973 to require the Secretary to promote equal opportunities for students with disabilities to be included and participate in physical education and extracurricular athletics implemented in, or in conjunction with, elementary schools, secondary schools, and institutions of higher education, by ensuring the provision of appropriate technical assistance and guidance for schools and institutions and their personnel.

Access to Substance Abuse Treatment Act of 2013 - Amends the Public Health Service Act to authorize the Secretary of Health and Human Services (HHS) to make grants to: (1) increase the availability of treatment for abuse of heroin, cocaine, methamphetamine, 3,4-methylenedioxymethamphetamine (ecstasy), and phencyclidine (PCP); (2) provide vouchers to individuals in underserved populations for authorized services related to such treatment; and (3) establish programs to provide for and coordinate the provision of wrap-around services, such as medical services, job training services, and housing assistance, to individuals re-entering the community after successfully receiving treatment for abuse of such substances. Revises the grant program to provide residential substance abuse treatment to pregnant and postpartum women to: (1) make caregiver parents eligible for such program, (2) make Indian tribes and tribal organizations eligible for grants, and (3) set forth the priority for allocation of grants. Requires the Director of the National Institute on Drug Abuse to conduct research on the effectiveness of the use of agonist and antagonist drugs to reduce the problems associated with stimulant abuse, including cocaine and methamphetamine abuse. Requires the Secretary to seek to enter into a contract with the Institute of Medicine to complete a literature review on the effectiveness of agonist and antagonist drugs for the treatment of stimulant abuse, including cocaine and methamphetamine abuse. Requires the Comptroller General to study: (1) the impact of the programs authorized by this Act on the effectiveness and availability of treatment for abuse of heroin, cocaine, methamphetamine, 3,4-methylenedioxymethamphetamine, and phencyclidine; (2) how the level of federal funding available for such treatment compares to the amount necessary to provide adequate treatment; and (3) the impact of effective treatment on cost savings due to the reduced need for criminal justice and other services. Declares that this Act shall not be construed to increase the amount of appropriations that are authorized to be approved for any fiscal year.
