Clean Ports Act of 2010 - Declares that federal preemption of state and local law relating to a price, route, or service of any motor carrier of property shall not apply to the authority of a state, local government, or the political authority of two or more states to adopt requirements for motor carriers providing services at port facilities that are reasonably related to the reduction of environmental pollution, traffic congestion, the improvement of highway safety, or the efficient utilization of such port facilities, provided such requirements are in accordance with federal law. Declares that nothing in this Act shall limit the authority reserved to any state or political subdivision of such state under the Clean Air Act.

Pregnant and Parenting Students Access to Education Act of 2010 - Authorizes the Secretary of Education to make formula grants to states and, through them, competitive subgrants to local educational agencies (LEAs) to establish or enhance educational programs and related services that enable pregnant and parenting students to enroll in, attend, and succeed in school. Requires state grantees to: (1) designate a Coordinator for Education of Pregnant and Parenting Students who is to develop and implement a state plan for educating pregnant and parenting students; and (2) develop and implement high-quality professional development programs for LEAs and school personnel. Requires subgrantees to: (1) provide academic support services to pregnant and parenting students; (2) assist such students in accessing quality, affordable child care and early childhood education services; (3) provide transportation services or assistance to such students and their children; (4) educate students, parents and community members regarding the educational rights of such students; (5) train school personnel regarding the challenges facing pregnant and parenting students and their educational rights; and (6) revise school policies and practices that hinder or discourage such students from continuing their education. Gives subgrant priority to LEAs in geographic areas with teen pregnancy rates that: (1) exceed the state average; or (2) are below the state average, but higher than the state average for one or more racial or ethnic groups. Directs the Secretary to conduct national activities that include: (1) providing technical assistance to states and reviewing their plans for educating pregnant and parenting students; (2) evaluating subgrantees' programs and education program service delivery models for such students; and (3) gathering and disseminating information regarding the education of such students and best practices in facilitating it.

Direct Care Workforce Empowerment Act - Amends the Fair Labor Standards Act of 1938 to exempt from minimum wage and maximum hour requirements any employee employed on a casual basis in domestic service employment to provide companionship services for individuals who because of disability (or because of age or infirmity, as under current law) are unable to care for themselves. Directs the Secretary of Health and Human Services (HHS) to establish: (1) a direct care workforce monitoring program; and (2) a National Advisory Council on the Direct Care Workforce. Directs the Secretary to award three-year grants to states and other eligible entities to improve the recruitment, retention, and education of the direct care workforce.

Maximizing Optimal Maternity Services for the 21st Century or the MOMS for the 21st Century Act - Amends the Public Health Service Act to require the Secretary of Health and Human Services (HHS), acting through the Office on Women's Health, to: (1) establish the Interagency Coordinating Committee on the Promotion of Optimal Maternity Outcomes; and (2) develop and implement a consumer education campaign to promote understanding and acceptance of evidence-based maternity practices and models of care for optimal maternity outcomes among women of childbearing ages and families of such women. Requires the Secretary, acting through the Agency for Healthcare Research and Quality, to make publicly available and update an online bibliographic database identifying systematic reviews for care of childbearing women and newborns. Requires the Secretary, acting through the Administrator of the Health Resources and Services Administration, to: (1) designate maternity care health professional shortage areas under the National Health Service Corps program; (2) establish a loan repayment program to alleviate critical shortages of maternal care professionals; and (3) award planning and implementation grants to address workforce disparities for such professionals. Directs the Secretary to support the establishment of two additional Centers for Excellence on Optimal Maternity Outcomes to conduct research to improve maternity outcomes. Requires the Secretary to convene a Maternity Curriculum Commission to discuss and make recommendations for: (1) a shared core maternity care curriculum; (2) strategies to integrate and coordinate education across maternity care disciplines; and (3) pilot demonstrations of interdisciplinary educational models. Amends title XVIII (Medicare) of the Social Security Act to cover services provided by a supervised student midwife or an intern or resident-in-training under a teaching program under certain circumstances.

Amends the Patient Protection and Affordable Care Act to require the Secretary of Health and Human Services (HHS) to offer through Exchanges a health benefits plan (public health insurance option) that ensures choice, competition, and stability of affordable, high-quality coverage throughout the United States. Declares that the Secretary's primary responsibility is to create a low-cost plan without compromising quality or access to care. Sets forth provisions related to the establishment and governance of the public health insurance option, including that such plan: (1) may be made available only through Exchanges; (2) must comply with requirements applicable to other health benefits plans offered through such Exchanges, including requirements related to benefits, benefit levels, provider networks, notices, consumer protections, and cost sharing; and (3) must offer bronze, silver, and gold plan levels. Requires the Secretary to: (1) establish an office of the ombudsman for the public health insurance option; (2) collect such data as may be required to establish premiums and payment rates; (3) establish geographically adjusted premiums at a level sufficient to fully finance the costs of the health benefits provided and administrative costs related to the operation of the plan; and (4) establish payment rates and provide for greater payment rates for the first three years. Requires repayment of start-up costs for the public health insurance option. Authorizes the Secretary to utilize innovative payment mechanisms and policies to determine payments for items and services under the public health insurance option.

United States Postal Service's CSRS Obligation Modification Act of 2010 - Prescribes the "average pay" and the appropriate percentage thereof to be used in determining annuities for civilian employment with the United States Postal Service (USPS) for purposes of provisions relating to future benefits attributable to such employment in order to calculate the amount of any Postal surplus or supplemental liability under the Civil Service Retirement System. Requires the Office of Personnel Management (OPM): (1) within six months after enactment of this Act, to determine (or, if applicable, redetermine) the amount of such surplus or liability as of the close of the most recently ending fiscal year using the methodology required under this Act; and (2) if the result is a surplus, to transfer the surplus amount to the Postal Service Retiree Health Benefits Fund.

PACE Assessment Protection Act of 2010 - Directs the Federal National Mortgage Association (Fannie Mae) and the Federal Home Loan Mortgage Corporation (Freddie Mac) to adopt underwriting standards that are consistent with the Guidelines for Pilot PACE Financing Programs issued on May 7, 2010, by the Department of Energy (DOE). Provides that liens or other property obligations that secure property taxes or assessments under a PACE program and that are consistent with such standards shall be considered to comply with the Uniform Instruments of Fannie Mae and Freddie Mac and shall not constitute a default on an existing mortgage or trigger the exercise of lender's remedies for a property with such a lien. Defines a "PACE program" as a property assessed clean energy program under which a state or political subdivision levies taxes or assessments on real property to finance the installation of renewable energy and energy efficiency improvements. Prohibits Fannie Mae and Freddie Mac from requiring repayment of a PACE program tax or assessment in order for a property owner to finance, refinance, or transfer property that meets their underwriting criteria without consideration of the PACE program lien. Requires the underwriting standards to provide that, in the event that a tax or assessment under a PACE program is delinquent, only the unpaid delinquent amount along with applicable penalties, interest, and costs will be subject to foreclosure and not the entire amount. Prohibits the Federal Housing Finance Agency, Fannie Mae, Freddie Mac, and all federal agencies and entities chartered under federal law from discriminating against communities implementing or participating in a PACE program.

Fire Sale Loophole Closing Act - Amends the federal criminal code to make it unlawful for: (1) anyone whose federal license to import, manufacture, or deal in firearms has been revoked, or whose license renewal application has been denied, to transfer business inventory firearms into a personal collection or to an employee of such person or to receive a firearm that was a business inventory firearm as of the date of a revocation or renewal denial notice; and (2) anyone who has received a license revocation or renewal denial notice to transfer to any other person a firearm that was a business inventory firearm. Imposes a fine and/or prison term of not more than one year (five years for willful violations) for violations of this Act.

Put School Counselors Where They're Needed Act - Amends the Elementary and Secondary Education Act of 1965 to direct the Secretary of Education to implement a demonstration project providing competitive, four-year grants to at least 10 secondary schools that have a four-year adjusted cohort graduation rate of 60% or lower, for the provision of additional school counselors and counselor resources. Expresses the sense of Congress that grantees should provide one additional counselor for every 250 students at risk. Requires the additional school counselors to serve primarily students identified as being at risk of not graduating in four years. Makes grantees that demonstrate progress in improving their graduation rates eligible for subsequent grants.

Simplifying the Ambiguous Law, Keeping Everyone Reliably Safe Act of 2010 or the STALKERS Act of 2010 - Amends the federal criminal code to revise the definition of the crime of stalking and extend criminal penalties for such crime to anyone who, with intent to kill, physically injure, harass, or intimidate a person, engages in any conduct in or affecting interstate or foreign commerce or in the special maritime and territorial jurisdiction of the United States that: (1) causes or attempts to cause bodily injury or serious emotional distress; or (2) occurs in circumstances where the conduct would be reasonably expected to cause emotional distress. Increases penalties for such crime if: (1) the offense involves conduct in violation of a protection order; or (2) the victim of the offense is under the age of 18. Requires the annual report of the Attorney General to include an evaluation of efforts to enforce laws relating to stalking and to identify and describe elements of such efforts that constitute the best practices for the enforcement of such laws.

Redistricting Reform Act of 2010 - Prohibits a state that has been redistricted after an apportionment from being redistricted again until after the next apportionment of Representatives, unless the state is ordered by a court to conduct such a subsequent redistricting in order to: (1) comply with the U.S. Constitution; or (2) enforce the Voting Rights Act of 1965. Requires such redistricting to be conducted according to: (1) a plan developed by the independent redistricting commission established in the state; or (2) if such plan is not enacted into law, the redistricting plan selected by the state's highest court or developed by a U.S. district court. Provides for: (1) establishment by each state of an independent redistricting commission; (2) development by such commission of a redistricting plan; (3) submission of the plan to, and consideration and enactment of a plan by, the state legislature; (4) selection of a plan by the state's highest court or development of a plan by the U.S. district court, under specified conditions; (5) special rules for redistricting conducted under a federal court order; (6) Election Assistance Commission payments to states for carrying out redistricting; (7) civil enforcement to carry out this Act; and (8) the right of action for a person who is aggrieved by a violation of this Act.

Nonprofit Sector and Community Solutions Act of 2010 - Establishes the United States Council on Nonprofit Organizations and Community Solutions, which shall study how the federal government can work more effectively with nonprofit organizations to achieve better outcomes in addressing national and community challenges. Directs the Council to provide advice to the President and Congress on: (1) the establishment and enhancement of grant programs to build the capacity of nonprofit organizations, to support research and the reporting of data on nonprofit organizations, and to assist the government to effectively address national and community challenges by supporting nonprofit organizations, encouraging social innovation, and enabling nonprofit organizations to replicate and expand the use of effective strategies for addressing such challenges; and (2) how innovation can enhance the impact of nonprofit organizations. Directs the Council to organize and carry out a national summit on nonprofit organizations to inform the public and Congress of the results of its activities. Directs the President to establish an Interagency Working Group on Nonprofit Organizations and the Federal Government, which shall: (1) develop recommendations on federal policies relating to contracting with and making grants to nonprofit organizations and the availability to nonprofit organizations of federal funding provided to state and local governments; (2) develop recommendations on enhancing the effectiveness of federal support for organizational development assistance for building the capacity of nonprofit organizations; (3) identify strategies for managing relationships with nonprofit organizations; (4) provide to the Council information on government operations; and (5) assist the implementation of Council recommendations.. Directs the Secretary of Commerce: (1) to collect all data in the possession of a federal agency relating to nonprofit organizations and make such data available annually to the public, Congress, the Council, and the Working Group; and (2) through the Bureau of Economic Analysis, to submit to Congress, the Council, and the Working Group a report that includes recommendations for the establishment of measures to assess and track the economic impact of nonprofit organizations in the United States. Requires: (1) the Director of the Office of Management and Budget (OMB) to ensure accurate and timely data on funding provided to nonprofit organizations by the federal government; (2) the Secretary of Labor to ensure that employment data provided by the Bureau of Labor Statistics (BLS) includes nonprofit organizations as a distinct category of employer; (3) the Director of the Census to annually submit a comprehensive report on nonprofit organizations; and (4) the Director of the National Science Foundation (NSF) to establish a program to improve information and knowledge regarding nonprofit organizations.

Birth Defects Prevention, Risk Reduction, and Awareness Act of 2010 - Requires the Secretary of Health and Human Services (HHS), acting through the Director of the Centers for Disease Control and Prevention (CDC), to establish and implement a birth defects prevention and public awareness program, which includes: (1) a nationwide media campaign to increase awareness among health care providers and at-risk populations about pregnancy and breastfeeding information services; (2) grants for the provision of, or campaigns to increase awareness about, pregnancy and breastfeeding information services; and (3) grants for the conduct or support of surveillance of or research on maternal exposures and maternal health conditions that may influence the risk of adverse pregnancy outcomes and maternal exposures that may influence health risks to a breastfed infant, or of networking to facilitate such surveillance or research.

Puppy Uniform Protection and Safety Act - Amends the Animal Welfare Act to define a "high volume retail breeder" as a person who, in commerce, for compensation or profit: (1) has an ownership interest in or custody of one or more breeding female dogs; and (2) sells, via any means of conveyance, more than 50 of the offspring of such dogs for use as pets in any one-year period. Considers such a breeder of dogs to be a dealer. Requires dealers to include on licensing applications and annual renewals the total number of dogs exempted from exercise on the premises of the dealer in the preceding year by a licensed veterinarian. Requires the Secretary of Agriculture to promulgate requirements for the exercise of dogs at facilities owned or operated by a dealer, including requiring daily access to exercise that: (1) allows the dogs to move sufficiently in a way that is not forced, repetitive, or restrictive; and (2) is in an area that is spacious, cleaned at least once a day, free of infestation by pests or vermin, and designed to prevent the dogs from escaping. Allows an exemption if: (1) a licensed veterinarian determines that a dog should not exercise because of the health, condition, or well-being of the dog; and (2) such determination is reviewed and updated at least once every 30 days by the veterinarian, unless the basis for the determination is a permanent condition. Subjects such a determination to review and approval by the Secretary.

Investor Deposit Yardstick Act - Extends retroactively the increase in the standard maximum deposit insurance amount pursuant to the Emergency Economic Stabilization Act of 2008 (EESA) to include depositors in any institution for which the Federal Deposit Insurance Corporation (FDIC) was appointed as receiver or conservator on or after January 1, 2008, and before October 3, 2008. Directs the FDIC to take necessary actions to carry out deposit insurance requirements under the Federal Deposit Insurance Act (FDIA) with respect to such depositors, without regard to any time limitations under such Act. Deems any payment on a deposit claim made by FDIC as receiver or conservator to a depositor above the standard maximum deposit insurance amount in effect at the time of the FDIC's appointment as receiver or conservator to be part of the net amount due to the depositor under the FDIA.

COBRA Health Benefits Extension Act of 2010 - Extends COBRA coverage (health insurance continuation benefits) until the earlier of: (1) the first date in which an individual is eligible for coverage under an employment-based health plan; or (2) the date on which such individual becomes eligible for health insurance coverage through an American Health Benefit Exchange under the Patient Protection and Affordable Care Act (PPACA). Directs the Secretary of Labor to provide rules setting forth the form and manner in which prompt notice to individuals of such continued coverage shall be made. Allows a state to enforce the provisions of this Act with respect to COBRA continuation coverage provided under a state program. Provides that this Act shall: (1) have no effect on termination of continuation coverage for any reason other than expiration of a period of a specified number of months; and (2) supersede any provision of the law of a state or political subdivision that limits or precludes access by a qualified beneficiary, whose COBRA continuation coverage has been extended under this Act, to a state high risk pool established under PPACA solely by reason of such extension.

Improvements in Global Maternal and Newborn Health Outcomes while Maximizing Successes Act or Improvements in Global MOMS Act - Amends the Foreign Assistance Act of 1961 to authorize the President to furnish assistance to reduce mortality and improve maternal health and the health of newborns in developing countries, including HIV/AIDS prevention programs. Directs the President to implement a comprehensive strategy as part of the Global Health Initiative to reduce mortality and improve the health of mothers and newborns in developing countries.

Democracy is Strengthened by Casting Light on Spending in Elections Act or DISCLOSE Act - Amends the Federal Election Campaign Act of 1971 (FECA) to prohibit: (1) independent expenditures and payments for electioneering communications by government contractors if the value of the contract is at least $50,000; and (2) recipients of assistance under the Troubled Asset Relief Program (TARP) of the Emergency Economic Stabilization Act of 2008 (EESA) from making any contribution to any political party, committee, or candidate for public office, or to any person for any political purpose or use, or from making any independent expenditure or disbursing any funds for an electioneering communication. Applies the ban on contributions and expenditures by foreign nationals to foreign-controlled domestic corporations. Treats as contributions: (1) any payments by any person (except a candidate, a candidate's authorized committee, or a political committee of a political party) for coordinated communications; and (2) political party communications made on behalf of candidates if made under the control or direction of a candidate or a candidate's authorized committee. Revises the definition of independent expenditure to mean, in part, an expenditure that, when taken as a whole, expressly advocates the election or defeat of a clearly identified candidate, or is the functional equivalent of express advocacy. Requires any person making independent expenditures exceeding $10,000 to file a report within 24 hours. Increases the period before a general election during which a communication shall be considered an electioneering communication. Requires corporations, labor organizations, and other covered organizations to include specified additional information in reports on independent expenditures of at least $10,000. Sets forth special rules for the use of general treasury funds by covered organizations for campaign-related activity. Authorizes covered organizations to make optional use of a separate Campaign-Related Activity Account for making disbursements for campaign-related activity. Prescribes additional information to be included in certain radio or television communications by persons (including significant funders of campaign-related communications of a covered organization) other than a candidate, a candidate's authorized committee, or a political committee of a political party. Amends the Lobbying Disclosure Act of 1995 to require registered lobbyists to report information on independent expenditures or electioneering communications of at least $1,000 to the Secretary of the Senate and the Clerk of the House of Representatives. Requires certain covered organizations to disclose to shareholders, members, or donors information on disbursements for campaign-related activity. Authorizes judicial review of the provisions of this Act.

Smuggled Tobacco Prevention Act of 2010 or the STOP Act - Amends the Internal Revenue Code to restrict the sale, lease, importation, or delivery of tobacco production machines to persons lawfully engaged in: (1) the sale, lease, or delivery of such machines; (2) the manufacture or processing of tobacco products, including for personal use; or (3) the application of unique identification markings onto tobacco product packages. Defines "tobacco production machine" as a machine used to manufacture, process, or package tobacco products or to apply unique identification markings to packages of tobacco products. Requires any person leasing, importing, exporting, or delivering a tobacco production machine to keep records relating to any transfers or deliveries of such machines. Requires manufacturers and importers of tobacco products to affix a unique identification marking to each package of tobacco products prior to sale or distribution of such products. Directs the Secretary of the Treasury to design a system of unique identification markings that does not interfere with state and local tax stamps and markings. Requires wholesalers of tobacco products to obtain permits for selling or exporting tobacco products. Establishes new criminal offenses relating to the distribution of tobacco products. Increases the civil penalty for tobacco-related infractions from $1,000 to $10,000. Establishes in the Treasury the Anti-Contraband Tobacco Trafficking Fund to finance the enforcement provisions of this Act and other laws relating to contraband or illegal tobacco products using the increased civil and criminal fines provided by this Act. Amends the Tariff Act of 1930 to impose a civil penalty for the importation of tobacco products and cigarette papers and tubes by fraudulent means.

Promotes raising awareness of the risks and consequences of undiagnosed chronic hepatitis B and hepatitis C infections and the urgency for a robust governmental and public health response to protect the health of those who suffer from chronic viral hepatitis.
