Women Veterans Health Care Improvement Act - Requires the Secretary of Veterans Affairs to: (1) study barriers encountered by women veterans to the provision by the Department of Veterans Affairs (VA) of comprehensive health care; (2) assess all health care services and programs provided by the VA for women veterans; (3) provide graduate education, training and certification for mental health professionals who provide counseling, care, and services to women veterans suffering from sexual trauma and post-traumatic stress disorder (PTSD); and (4) carry out a pilot program of child care for certain women veterans receiving health care from VA facilities. Authorizes the Secretary to furnish hospital care and medical services to a newborn child of a woman veteran receiving VA maternity care for up to 14 days after the birth of the child. Requires: (1) women veterans recently separated from service to be included on the Advisory Committee on Women Veterans; and (2) recently separated minority veterans to be included on the Advisory Committee on Minority Veterans.

Achieving a Better Life Experience Act of 2009 or the ABLE Act of 2009 - Amends the Internal Revenue Code to establish tax-exempt ABLE accounts for individuals with a disability to pay certain expenses of such individuals, including expenses for education, housing, transportation, employment support, medical care, and certain life necessities. Defines "individual with a disability" as an individual who is eligible to receive certain supplemental security income benefits under the Social Security Act. Allows individual taxpayers a tax deduction, up to $2,000 per year, for contributions to an ABLE account. Requires the Secretary of the Treasury to study and report to Congress on the use of ABLE accounts and the effect of the tax deduction for contributions to such accounts. Requires ABLE accounts to be disregarded in determining eligibility for Medicaid benefits and for purposes of determining eligibility for other means-tested federal programs.

Bone Marrow Failure Disease Research and Treatment Act of 2009 - Amends the Public Health Service Act to require the Secretary of Health and Human Services, acting through the Director of the Centers for Disease Control and Prevention (CDC), to: (1) develop a system to collect data on acquired bone marrow failure diseases; (2) establish the National Acquired Bone Marrow Failure Disease Registry; and (3) establish the Advisory Committee on Acquired Bone Marrow Failure Diseases to provide recommendations to the Secretary on the Registry. Allows the Secretary, acting through the Director, to award grants to, and enter to contracts and cooperative agreements with, public or private nonprofit entities for the management of the Registry. Requires the Secretary, acting through the Administrator of the Agency for Toxic Substances and Disease Registry, to conduct pilot studies to determine which environmental factors may cause acquired bone marrow failure diseases. Requires the Secretary, acting through the Deputy Assistant Secretary for Minority Health, to: (1) establish outreach and information programs targeted to minority populations affected by such diseases; (2) undertake a coordinated outreach effort to connect Hispanic, Asian American, and Pacific Islander communities with comprehensive services focused on treatment of, and information about, such diseases; and (3) awards grants to, or enter into cooperative agreements with, entities to perform research on such diseases. Requires the Secretary, acting through the Director of the Agency for Healthcare Research and Quality (AHRQ), to award grants to entities to improve diagnostic practices and quality of care with respect to patients with such diseases.

Arthritis Prevention, Control, and Cure Act of 2009 - Amends the Public Health Service Act to authorize the Secretary of Health and Human Services to develop and implement a National Arthritis Action Program that may include: (1) research, investigations, demonstrations, training, and studies relating to the control, prevention, and surveillance of arthritis and other rheumatic diseases; (2) additional grant support to encourage the expansion of research related to the prevention and management of arthritis at the Centers for Disease Control and Prevention (CDC); (3) national education and outreach activities for arthritis and other rheumatic diseases; (4) emphasis on prevention, early diagnosis, and appropriate management of arthritis and opportunities for effective patient self-management; and (5) grants to states or Indian tribes for comprehensive arthritis control and prevention programs and public health surveillance, prevention, and control activities related to arthritis and other rheumatic diseases. Authorizes the Secretary to expand and intensify programs of the National Institutes of Health (NIH) with respect to research and related activities concerning various forms of juvenile arthritis and related conditions. Authorizes the Secretary, acting through the Director of CDC, to: (1) provide for the collection, analysis, and reporting of data on juvenile arthritis; and (2) support the development of a national juvenile arthritis population-based database. Requires the Secretary to support activities that provide for: (1) an increase in institutional training grants to support pediatric rheumatology training; and (2) an expansion of public-private partnerships to promote education training and fellowship opportunities for pediatric rheumatologists. Directs the Secretary to establish and carry out a pediatric rheumatology loan repayment program, as needed.

Limits the period for coin issuance to calendar year 2011. Imposes a surcharge of $35 per coin for the $5 coin and $10 per coin for the $1 coin, to be distributed to the Congressional Medal of Honor Foundation to help finance educational, scholarship, and outreach programs of the Foundation.

Community Pharmacy Fairness Act of 2009 - Entitles independent pharmacies negotiating contract terms with a health plan for the provision of health care items or services to the same treatment under the antitrust laws as the treatment to which bargaining units recognized under the National Labor Relations Act are entitled. Treats such a pharmacy as an employee engaged in concerted activities in connection with such negotiations. Exempts actions taken in good faith reliance on this Act from being subject to criminal sanctions or civil penalties beyond actual damages incurred. Provides that this Act does not exempt from application of antitrust laws any agreement or unlawful conspiracy that: (1) would have the effect of boycotting any independent pharmacy; (2) would exclude, limit the participation or reimbursement of, or otherwise limit the scope of services to be provided by any independent pharmacy or group of independent pharmacies with respect to the performance of services that are within their scope of practice as defined or permitted by relevant law or regulation; (3) allocates a market among competitors; (4) unlawfully ties the sale or purchase of one product or service to the sale or purchase of another product or service; or (5) monopolizes or attempts to monopolize a market. Requires the Comptroller General to study the impact of this Act after five years. Provides that this Act does not preclude the Federal Trade Commission (FTC) or the Department of Justice (DOJ) from overseeing the conduct of independent pharmacies covered under this Act.

Federal Response to Eliminate Eating Disorders Act of 2009 - Amends the Public Health Service Act (PHSA) to require the Director of the National Institutes of Health (NIH) to take certain actions regarding eating disorder research, including to: (1) implement a scientifically justified budget for research on eating disorders; (2) coordinate and evaluate NIH research activities and programs; (3) expand NIH research on eating disorders; (4) establish a task force on eating disorder research; and (5) provide for centers of excellence for research on eating disorders. Requires the Secretary of Health and Human Services, acting through the Director of the Centers for Disease Control and Prevention (CDC), to: (1) provide for the collection, analysis, and reporting of epidemiological data on eating disorders; (2) establish a Center of Eating Disorders Epidemiology to collect and analyze information on eating disorders; and (3) establish a CDC clearinghouse for the collection and storage of data generated under this Act. Sets forth provisions providing for education and training on eating disorders, including requirements for: (1) developing and implementing a training program for health professionals on eating disorders; (2) establishing the Task Force on Eating Disorders Prevention in Educational Institutions to develop and provide training on eating disorders identification and prevention for students, faculty, coaches, and staff in schools; and (3) conducting public service announcements. Amends the PHSA, the Employee Retirement Income Security Act of 1974 (ERISA), and the Internal Revenue Code to require a group health plan that provides medical and surgical benefits to also provide coverage for eating disorders. Applies such requirement to coverage offered in the individual market and coverage offered under the Federal Employees Health Benefit Program.

Directs the Secretary to give priority to individuals who agree to serve in community health centers in designated health professional shortage areas. Sets forth factors for the Secretary to consider in determining the amount to pay for each year of service. Directs the Secretary to provide additional reimbursements for the individual's tax liability resulting from such payments.

Colorectal Cancer Prevention, Early Detection, and Treatment Act of 2009 - Amends the Public Health Service Act to allow the Secretary of Health and Human Services, acting through the Director of the Centers for Disease Control and Prevention (CDC), to make grants to states and Indian tribes for colorectal cancer programs that include: (1) providing colorectal cancer screening to individuals who are over 50 years of age or at high risk for such cancer; (2) providing case management and referrals for medical treatment; (3) ensuring the full continuum of follow up and cancer care for individuals screened; (4) carrying out activities to improve the education, training, and skills of health professionals in the detection and control of colorectal cancer; and (5) developing and disseminating public information and education programs for the detection and control of colorectal cancer and promoting the benefits of receiving screenings through this program. Gives priority to low-income individuals who lack adequate coverage under health insurance and health plans with respect to screenings for colorectal cancer. Allows the Secretary to provide training and technical assistance with respect to the planning, development, and operation of programs funded by a grant under this Act. Amends title XIX (Medicaid) of the Social Security Act to allow states to provide medical assistance to individuals who have been screened for colorectal cancer under this Act and who need treatment for complications due to screening or colorectal cancer. Applies provisions related to breast and cervical cancer programs to programs under this Act.

Access to Emergency Medical Services Act of 2009 - Establishes the United States Bipartisan Commission on Access to Emergency Medical Services to: (1) identify and examine factors in the health care delivery, financing, and legal systems that affect the effective delivery of screening and stabilization services furnished in hospitals that have emergency departments pursuant to the Emergency Medical Treatment and Labor Act (EMTALA); and (2) make specific recommendations to Congress with respect to federal programs, policies, and financing needed to assure the availability of such screening and stabilization services and the coordination of state, local, and federal programs for responding to disasters and emergencies. Amends title XVIII (Medicare) of the Social Security Act to provide for additional payments for certain physicians' emergency services furnished pursuant to EMTALA. Directs the Secretary of Health and Human Services, acting through the Administrator of the Centers for Medicare & Medicaid Services, to convene a working group that includes experts in emergency care, inpatient critical care, hospital operations management, nursing, and other relevant disciplines to develop boarding and diversion standards for hospitals and guidelines, measures, and incentives for implementation, monitoring, and enforcement of such standards. Requires the CMS working group to: (1) identify barriers contributing to delays in timely processing of patients requiring admission as inpatients who initially sought care through the hospital's emergency department; (2) identify best practices to improve patient flow within hospitals; and (3) report to Congress and the Secretary a detailed description of the standards, guidelines, measures, and incentives developed, as well as identified barriers and best practices. Directs the Secretary to establish a mechanism to make public information regarding any hospital that fails to report information requested by the CMS working group.

Summer of Service Act of 2009 - Amends the National and Community Service Act of 1990 to create Summer of Service programs providing at least 100 hours of summer community service learning opportunities to youth who will subsequently enroll in grades six through nine. Requires the Chief Executive Officer of the Corporation for National and Community Service to provide competitive three-year grants to: (1) states under a State Grant program; and (2) public or private organizations under a National Direct Grant program, when a state does not apply for funding or the community service program includes multiple states. Requires states and organizations, in making project subgrants, to favor entities with established track records that: (1) have leadership positions in the communities from which participating youth will be drawn; (2) focus on youth service during the transition year before high school; (3) encourage or enable youth to continue providing community service throughout the school year; (4) involve youth in the design and operation of the community service project; and (5) include youth of diverse backgrounds, at least 50% of which are from low-income families. Permits such entities to charge the parents of participants an income-based fee to contribute to the nonfederal share of project costs. Makes each youth serving at least 100 hours in a service-learning project eligible for an educational award of up to $500.

Youth PROMISE Act

Youth Prison Reduction through Opportunities, Mentoring, Intervention, Support, and Education Act or the Youth PROMISE Act - Amends the Juvenile Justice and Delinquency Prevention Act of 1974 to establish a PROMISE Advisory Panel to assist the Office of Juvenile Justice and Delinquency Prevention in: (1) assessing and developing standards and evidence-based practices to prevent juvenile delinquency and criminal street gang activity; and (2) collecting data in designated geographic areas to assess the needs and existing resources for juvenile delinquency and criminal street gang activity prevention and intervention. Authorizes the Administrator of the Office of Juvenile Justice and Delinquency Prevention to award grants to local governments and Indian tribes to: (1) plan and assess evidence-based and promising practices for juvenile delinquency and criminal street gang activity prevention and intervention, especially for at-risk youth; and (2) implement PROMISE plans, developed by local PROMISE Coordinating Councils (PCCs), for coordinating and supporting the delivery of juvenile delinquency and gang prevention and intervention programs in local communities. Establishes a National Research Center for Proven Juvenile Justice Practices to provide PCCs and the public with current research and other information about evidence-based practices related to juvenile delinquency and criminal street gang prevention and intervention. Directs the Administrator to award grants to: (1) allow institutions of higher education to serve as regional research partners with PCCs; and (2) hire and train law enforcement officers as youth-oriented police to work with PCCs, other community-based organizations, and high-risk youth. Establishes a Center for Youth-Oriented Policing. Mynisha's Law - Authorizes any local government or Indian Tribe with a PCC to submit an application to the Administrator of the Office of Juvenile Justice and Delinquency Prevention for designation as a Comprehensive Gang Prevention and Relief Area. Authorizes the Attorney General to award grants to partnerships comprising state mental health authorities and local or private entities to prevent or alleviate the effects of youth violence in urban communities with a high or increasing incidence of such violence. Prevention Resources for Eliminating Criminal Activity Using Tailored Interventions in Our Neighborhoods Act of 2009 or the PRECAUTION Act - Establishes the National Commission on Public Safety Through Crime and Delinquency Prevention to: (1) carry out a comprehensive study of the effectiveness of certain crime and delinquency prevention and intervention strategies: and (2) make initial and final reports on such strategies to specified federal and state officials. Authorizes the Director of the National Institute of Justice to make three-year grants to public and private entities for the implementation and evaluation of innovative crime or delinquency prevention or intervention strategies. Amends the Violent Crime Control and Law Enforcement Act of 1994 to authorize grants for the creation and expansion of state, local, and tribal juvenile witness and victim protection grants.

Makes such requirement inapplicable to a VA facility that is closed, or that the Secretary intends to close, as part of the Capital Asset Realignment for Enhanced Services (CARES) process. Makes this Act applicable to any VA facility unable to provide covered services on or after August 29, 2005, by reason of a major disaster.

Allows the Secretary, acting through the Director of the CDC, to provide for the collection, analysis, and reporting of data on pulmonary fibrosis and other interstitial lung diseases that can be confused with, misdiagnosed as, and progress to pulmonary fibrosis. Requires the Secretary, in developing the Registry, to: (1) expand and coordinate existing data and surveillance systems, surveys, registries, and other federal public health and environmental infrastructure; and (2) provide for research access to pulmonary fibrosis data. Directs the Secretary to ensure that epidemiological and other types of information are made available to the National Institutes of Health (NIH) and the Department of Veterans Affairs (VA). Requires the Director of the National Heart, Lung, and Blood Institute to expand, intensify, and coordinate Institute pulmonary fibrosis research activities. Requires the Director of CDC to prepare the National Pulmonary Fibrosis Action Plan. Requires the Secretary to: (1) convene a summit of individuals with expertise in research and care of pulmonary fibrosis to provide a detailed overview of NIH research activities and discuss potential collaborations between NIH and other federal health agencies; and (2) make information about NIH activities relating to pulmonary fibrosis publicly available.

Authorizes the Secretary of Commerce to establish an international cooperation and assistance program, including grants, to provide assistance for international fishing capacity building efforts.

Heart Disease Education, Analysis Research, and Treatment for Women Act or the HEART for Women Act - Amends the Federal Food, Drug, and Cosmetic Act to allow the Secretary of Health and Human Services to deny a new drug application if the application fails to include required information on clinical investigations. Directs the Secretary to: (1) require that a new drug application include any clinical data possessed by the applicant that relates to the safety and effectiveness of the drug involved by gender, age, and racial subgroup; and (2) develop guidance for the staff of the Food and Drug Administration (FDA) to ensure that new drug applications are adequately reviewed to determine whether they include the required clinical data. Authorizes the Secretary to place a clinical hold on an investigation under an investigational new drug application if the sponsor of the investigation fails to meet the requirements of an annual report on the status of each study in progress. Applies provisions relating to clinical data submission for new drug applications to applications for an investigational new drug, a biologics license for a biological product, premarket approval for a class III device, and investigational use of a device. Amends the Public Health Service Act to require the Secretary to provide that all nonidentifiable patient safety work product reported to and among the network of patient safety databases be identified by sex. Directs that analyses of statistics of information reported to the network of patient safety databases take into account data that specifically relates to women and any disparities between treatment and the quality of care between males and females. Requires the Director of the Agency for Healthcare Research and Quality to support research and demonstrations to identify and evaluate clinical and organizational strategies to improve the quality of and access to care for women with heart disease, stroke, and other cardiovascular diseases. Requires the Secretary to: (1) distribute to females age 65 or older and appropriate health care professionals educational materials relating to the prevention, diagnosis, and treatment of heart disease, stroke, and cardiovascular diseases in women; and (2) conduct an education and awareness campaign for health care professionals relating to such diagnosis and treatment. Expands the grant program authorizing the Secretary to award grants for preventive health services to all states.
