Housing Bond and Credit Modernization and Fairness Act of 2001 - Amends the Internal Revenue Code to: (1) repeal the required use of certain principal repayments on mortgage subsidy bond financings to redeem bonds; (2) modify the purchase price limitation under mortgage subsidy bond rules based on median family income; and (3) define the term "area median gross income" for low-income housing credit projects.

Child Support Fairness and Tax Refund Interception Act of 2001 - Amends title IV part D (Child Support and Establishment of Paternity) of the Social Security Act to provide for the use of the tax refund intercept program to collect past-due child support on behalf of children who are not minors.

American Land Sovereignty Protection Act - Amends the National Historic Preservation Act Amendments of 1980 to prohibit the Secretary of the Interior from nominating any Federal lands for inclusion on the World Heritage List unless: (1) commercially viable uses of nominated lands and lands within ten miles will not be adversely affected; (2) the Secretary has reported to Congress on the lands' natural resources and the impact of inclusion on existing and future uses of such lands; and (3) such nomination is specifically authorized by law. Requires the Secretary to object to the inclusion of any property in the United States on the list of World Heritage in Danger unless the Secretary: (1) has reported to Congress on the necessity for such inclusion, the associated natural resources, and the impact of inclusion on existing and future uses of such property; and (2) is specifically authorized to assent to the inclusion by a joint resolution of Congress. Prohibits any Federal official from nominating any lands in the United States for designation as a Biosphere Reserve. Nullifies any such designation before enactment of this Act unless the Biosphere Reserve: (1) is specifically authorized by a law enacted after enactment of this Act and before December 31, 2003; (2) consists solely of federally owned lands; and (3) is subject to a management plan that ensures that the use of intermixed or adjacent non-Federal property is not limited or restricted as a result of that designation. Prohibits any Federal official from nominating, classifying, or designating any Federal land for a special or restricted use under any international conservation agreement unless specifically authorized by law. Provides that any such nomination, classification, or designation of private or State or local lands shall have no force or effect without the owner's consent or specific authorization by State or local law, respectively.

State Criminal Alien Assistance Program II and Local Medical Emergency Reimbursement Act - Amends the Immigration Reform and Control Act of 1986 to provide for the reimbursement of States for indirect costs of incarcerating illegal aliens. Defines such costs as: (1) court costs, county attorney costs, and non-trial criminal proceedings; (2) indigent defense; and (3) unsupervised probation costs. Provides for the reimbursement of States for costs of incarcerating juvenile aliens. Provides that reimbursement of States for incarcerating illegal aliens and certain Cuban nationals shall be allocated to give special consideration for any State that: (1) shares a border with Mexico or Canada; or (2) has a large number of undocumented aliens. Authorizes appropriations for allotments to States to be paid to local governments, hospitals, and other providers for emergency health services provided to undocumented aliens. Provides special consideration for providers: (1) in a border county with Mexico or Canada; or (2) in an area with a large number of undocumented aliens.

Revises a demonstration project under which the Secretary of Defense provides health care for Medicare-eligible beneficiaries of current and former military personnel under the Federal Employees Health Benefits (FEHB) program to: (1) remove the requirement that such a beneficiary must reside within one of the areas covered by the project; (2) extend such project from three to five years; and (3) require a military medical facility providing health care to a covered beneficiary to be reimbursed by the applicable FEHB health plan.

Independent Energy Production Act of 2001 - Marginal Well Preservation Act of 2001 - Amends the Internal Revenue Code to set forth provisions relating to domestic oil and gas production which: (1) establish a credit for producing oil and gas from marginal wells; and (2) permit a taxpayer to expense geological and geophysical expenditures and to delay rental payments in connection with oil and gas development. Permits a five-year net operating loss carryback for losses attributable to operating mineral interests of independent oil and gas producers.

Expresses the sense of Congress that: (1) the United States-Canada Softwood Lumber Agreement of 1996 should terminate on a specified date, with no extension or further quota agreement; and (2) the President should consult with appropriate stakeholders, including consumers, and continue discussions with the Government of Canada to promote open trade of softwood lumber between Canada and the United States.

Lease Lot Conveyance Act of 2001 - Directs the Secretary of the Interior to convey to the Elephant Butte/Caballo Leaseholders Association, Inc., real property comprising 403 cabin sites under the administrative jurisdiction of the Bureau of Reclamation that are located along the western portion of the reservoirs in Elephant Butte State Park and Caballo State Park, New Mexico. Requires the Association to grant leaseholders of such properties the option of purchasing or continuing to lease their properties. Requires the Secretary to establish specified use restrictions with respect to each property. Requires conveyance proceeds to be deposited in the reclamation fund on behalf of the Rio Grande Project.

Unsolicited Commercial Electronic Mail Act of 2001 - Amends the Federal criminal code to provide criminal penalties for intentionally initiating the transmission of any unsolicited commercial electronic mail message (message) to a protected computer in the United States with the knowledge that any domain name or other initiator identifying information contained in or accompanying such message is false or inaccurate. Prohibits any person from sending such a message unless the message contains a valid e-mail address, conspicuously displayed, to which a recipient may send notice of a desire not to receive further messages. Prohibits a person from sending other unsolicited commercial e-mail messages after a reasonable period of time following such notice. Requires any such message to include information that: (1) identifies the message as unsolicited commercial e-mail; and (2) contains notice of the opportunity for the recipient to request to not receive further messages. Makes it unlawful for a person to initiate the transmission of such a message in violation of a policy regarding unsolicited commercial e-mail messages that complies with specified requirements. Directs the Federal Trade Commission (FTC) to notify violators under this Act, to prohibit further initiation of such messages, and to require the initiator to delete the names and e-mail addresses of the recipients and providers from all mailing lists. Requires the names and e-mail addresses of any children of the recipient to be included in such notification.

Amends title II (Old Age, Survivors and Disability Insurance) (OASDI) of the Social Security Act to modify the formula for determining the amount of reduced monthly OASDI benefits payable to a spouse, surviving spouse, or parent receiving monthly payments from a Federal or State pension plan. Declares that such benefit reductions shall be equal to the lesser of: (1) the amount by which the total amount of the combined monthly benefit (before reduction) and monthly pension exceeds $1,200, adjusted for inflation; or (2) an amount equal to two-thirds of the amount of any such monthly pension plan payment.

Family Opportunity Act of 2001 or Dylan Lee James Act - Amends title XVIII (Medicare) of the Social Security Act (SSA) to: (1) give States the option of allowing families of disabled children to purchase Medicaid coverage for such children; and (2) provide for treatment of inpatient psychiatric hospital services for individuals under age 21 under waivers allowing for payment of part or all of the cost of home or community-based services. Authorizes a State to apply to the Secretary of Health and Human Services for approval of a demonstration project to provide Medicaid coverage of up to a specified maximum number of children with a potentially severe disability. Amends SSA title V (Maternal and Child Health Services) to make appropriations to the Secretary for special projects of regional and national significance for development and support of family-to-family health information centers. Amends SSA title XIX to provide for the restoration of Medicaid eligibility to certain SSI (Supplemental Security Income) (SSA title XVI) beneficiaries under age 21.

Military Survivor Benefits Improvement Act of 2001 - Adjusts the basic Survivor Benefit Plan (SBP) annuity amount for surviving spouses, age 62 or over, of former military personnel to: (1) 35 percent of the retired pay of the decedent (current law), for months beginning on or before the enactment of this Act; (2) 40 percent of such pay, for months beginning after enactment of this Act until October 2004; (3) 45 percent of such pay for months beginning after September 2004 and before October 2011; and (4) 55 percent of such pay for months after September 2011. Adjusts similarly the percentage amounts of SBP supplemental annuity authorized to be provided for such surviving spouses. Directs the Secretary of Defense to ensure appropriate adjustments in the computation of retired pay reductions for such supplemental annuities.

Project Exile Safe Streets and Neighborhoods Act of 2001 - Amends the Violent Crime Control and Law Enforcement Act of 1994 to direct the Attorney General to provide firearms sentencing incentive grants to eligible States that: (1) demonstrate that they have implemented laws requiring that any person who uses or carries a firearm in any violent crime or serious drug trafficking crime be sentenced to not less than five years in prison (without the possibility of parole) in addition to the punishment provided for such crime, or requiring that any person who possesses a firearm, having at least one prior conviction for a violent crime, be sentenced to five years' imprisonment (without the possibility of parole); or (2) can demonstrate that they have in effect an equivalent Federal prosecution agreement; and (3) demonstrate that they have or will implement a public awareness and community support program that seeks to build support for, and warns potential violators of, such firearms sentencing laws; and (4) provide assurances that they will coordinate with Federal prosecutors and Federal law enforcement agencies and will allocate resources to reduce crime in high-crime areas. Sets forth allowable uses for such grants, including to: (1) support law enforcement agencies, prosecutors, courts, probation officers, correctional officers, the juvenile justice system, the improvement of criminal history records, or case management programs involving the sharing of information about serious offenders; (2) carry out such a public awareness and community support program; and (3) build or expand correctional facilities.

Vietnam Veterans Memorial Education Act - Authorizes the Vietnam Veterans Memorial Fund, Inc., to construct a temporary education center for educating people about the Memorial. Requires the center to remain for ten years, after which Congress may reevaluate the continuing need for the center. Sets forth conditions for the use of excess coin funds under the United States Veterans Commemorative Coin Act of 1993 in the construction of such center, including that the Fund provide detailed information with respect to the use of such funds.

Designates cyberterrorism as an emerging threat to the national security of the United States and the nation's electronic infrastructure. Calls for: (1) a partnership between the Federal Government and private industry in combating the cyber menace; (2) a revised legal framework for the prosecution of hackers and cyberterrorists; and (3) a new interagency study to be conducted by the Departments of Commerce and Defense, the National Security Agency, the Central Intelligence Agency, and the Federal Bureau of Investigation to assess the threat posed by cyberterrorists.

Postmasters Fairness and Rights Act of 2001 - Amends Federal law to prescribe guidelines within which the Postal Service shall propose changes in pay policies, schedules, and fringe benefit programs affecting postmasters which are to be in effect during the period covered by a collective bargaining agreement between the Postal Service and certain recognized bargaining representatives. Grants certain qualified postmasters' organizations the right to participate in program planning and development pertaining to pay policies, schedules, and fringe benefits.

Notification and Federal Employee Antidiscrimination and Retaliation Act of 2001 - Requires the amount of any claim, final judgment, award, or compromise settlement paid to any current or former Federal employee or applicant in connection with specified anti-discrimination and whistle blower protection proceedings to be reimbursed to the fund established for such payments out of the operating expenses of the agency to which the discriminatory conduct is attributable.

College Student Credit Card Protection Act - Amends the Truth in Lending Act to limit by a specified formula the total credit extended under a credit card account to a full time, traditional-aged college student (unless the student's parent or guardian assumes joint liability). Prohibits increasing the credit limit on an account for which a parent or guardian has assumed joint liability without the parent's or guardian's approval of such increase. Prohibits a creditor from opening a credit card account for any such college student who: (1) has no annual gross income; and (2) already has a credit card account under an open end consumer credit plan.

Arctic Coastal Plain Domestic Energy Security Act of 2001- Declares that it is the policy of the United States to permit exploration, development, production, and transportation of oil and gas resources in a designated area of the Coastal Plain Study Area of the Arctic National Wildlife Refuge. Instructs the Secretary of the Interior to establish and implement a competitive oil and gas leasing program. Amends the Alaska National Interest Lands Conservation Act of 1980 to repeal the prohibition against production of oil and gas from the Arctic National Wildlife Refuge, and any leasing or development leading to such production. States that Congress determines that the Coastal Plain oil and gas leasing program and activities authorized by this Act are compatible with the purposes for which the Arctic National Wildlife Refuge was established, and that no further findings or decisions are required to implement this determination. States that this Act is the sole authority for Coastal Plain leasing. Authorizes the Secretary to: (1) designate a maximum total of Coastal Plain acreage as "Special Areas" and close them to leasing if the Secretary determines that they require special management and regulatory protection; and (2) permit leasing in those Special Areas by setting lease terms that restrict surface use and occupancy but permit the use of horizontal drilling technology from lease sites located outside the Special Areas. Declares that this Act constitutes the Secretary's sole authority to close Coastal Plain lands to oil and gas leasing and to exploration, development, and production. Directs the Secretary to grant rights-of-way and easements across the Coastal Plain for oil and gas transportation.

Identity Theft Protection Act of 2001 - Amends title II (Old Age, Survivors and Disability Insurance) (OASDI) of the Social Security Act and the Internal Revenue Code to establish new rules restricting the use of Social Security account numbers (SSNs) to applicable Social Security Administration and tax related purposes. Amends the Privacy Act of 1974 to prohibit any Federal, State, or local government agency from requiring or requesting an individual to disclose his SSN. Prohibits any two Federal agencies or instrumentalities from implementing the same identifying number with respect to any individual, except as authorized under this Act. Prohibits a Federal agency from: (1) establishing or mandating a uniform standard for individual identification that is required to be used by any other Federal or State agency or by a private person except for conducting the authorized activities of the Federal agency establishing or mandating the standard; or (2) conditioning receipt of any Federal grant or contract on the adoption, by a State or State agency or by a political subdivision of a State, of a uniform standard for individual identification. Prohibits a Federal agency from establishing or mandating a uniform standard for individual identification that is required to be used within the agency, or by any other Federal or State agency or by a private person for regulating a transaction to which the Federal Government is not a party, or for administrative simplification.

Community Protection Act of 2001- Amends the Federal criminal code to authorize qualified law enforcement officers (including qualified retired officers) carrying the photographic identification issued by the governmental agency for which the individual is, or was, employed as a law enforcement officer, notwithstanding State or local laws, to carry a concealed firearm that has been shipped or transported in interstate or foreign commerce. Specifies that this Act shall not be construed to supersede or limit the laws of any State that: (1) permit private persons or entities to prohibit or restrict the possession of concealed firearms on their property; or (2) prohibit or restrict the possession of firearms on any State or local government property, installation, building, base, or park.

Declares that failure to comply with this requirement shall give rise to a point of order in either House of Congress.

Citizens' Self-Defense Act of 2001 - Declares that a person not prohibited under the Brady Handgun Violence Prevention Act from receiving a firearm shall have the right to obtain firearms for security and to use firearms in defense of: (1) self or family against a reasonably perceived threat of imminent and unlawful infliction of serious bodily injury; (2) self or family in the course of the commission by another person of a violent felony against the person or a member of the person's family; and (3) the person's home in the course of the commission of a felony by another person. Authorizes persons whose rights under this Act have been violated to bring an action in U.S. district court against the United States, any State, or any person for damages, injunctive relief, and such other relief as the court deems appropriate. Sets forth provisions regarding: (1) the award of attorney's fees; and (2) the statute of limitations.

Armed Services Vote Rescue Act - Prohibits a State from refusing to count a ballot submitted in a Federal election by an absent uniformed services voter on the grounds that the ballot was improperly or fraudulently cast, unless the State finds clear and convincing evidence of fraud in the preparation or casting of the ballot by the voter.

Title V: Foreign Assistance and Related Programs - Appropriates funds for the following: (1) Foreign Agricultural Service; (2) Public Law 480 program account, title I ocean freight differential grants, and titles II and III grants; and (3) Commodity Credit Corporation export loans program account. Title VI: Related Agencies and Food and Drug Administratio n- Appropriates funds for the following: (1) Food and Drug Administration; (2) Commodity Futures Trading Commission; and (3) Farm Credit Administration. Title VII: General Provisions - Specifies certain uses and limits on or prohibitions against the use of funds appropriated by this Act. (Sec. 727) Prohibits Food and Drug Administration (FDA) fund use to close or relocate the FDA Division of Drug Analysis, St. Louis, Missouri, except that funds may be used to plan a relocation within St. Louis city limits. (Sec. 728) Prohibits FDA fund use to reduce the FDA District Office in Detroit, Michigan, below specified staffing levels. (Sec. 734) Prohibits fund use to declare excess any Federal (Department of Agriculture) lands or facilities at Fort Reno, Oklahoma, or to transfer such lands or facilities prior to a specified date without congressional authorization. (Sec. 736) Revises specified housing, community development, and business assistance provisions respecting isolated, high-cost rural Alaskan areas. (Sec. 737) Makes the Town of Lloyd, New York, and the Town of Thompson, New York, eligible for loans and grants through the rural community advancement program. (Sec. 742) Amends the Agricultural Market Transition Act to extend milk price support provisions. (Sec. 743) Directs the Secretary of Agriculture to obligate specified dollar-equivalent amounts of agricultural commodities for foreign countries to assist in mitigating the effects of HIV and AIDS. (Sec. 745) Medicine Equity and Drug Safety Act of 2000 - Amends the Federal Food, Drug, and Cosmetic Act to require regulations permitting the importation into the United States of covered products (prescription drugs). (Sec. 746) Prescription Drug Import Fairness Act of 2000 - Amends the Federal Food, Drug, and Cosmetic Act to prohibit FDA from sending a warning notice to an individual who imports a prescription drug into the United States for personal use unless specified notice requirements are met. (Sec. 749) States that the Friends of the National Arboretum organization shall not be considered a prohibited fund source for the United States National Arboretum as long as such organization maintains its tax-exempt status and operates exclusively for the Arboretum. (Sec. 752) Subjects U.S. establishments that slaughter or process birds of the order Ratitae (ostriches, squab, emus, and rheas) for human consumption to inspection and sanitation requirements under the Poultry Products Inspection Act. (Sec. 754) Amends the Omnibus Consolidated and Emergency Supplemental Appropriations Act, 1999, with respect to the indemnity fund for cotton stored in bankrupt Georgia warehouses, to: (1) extend the use of remaining funds for producers; and (2) authorize fund use for cotton ginners and other cotton-related businesses, and for producers from other States with Georgia-stored cotton. (Sec. 756) Amends the Consolidated Farm and Rural Development Act to increase available funds for the National Sheep Industry Improvement Center. (Sec. 759) Maintains the eligibility, until the availability of 2000 Census population data, of: (1) the Sea Island Health Clinic, John's Island, South Carolina, for community facilities assistance; and (2) a specified area in Dade County, Florida, for business and industry guaranteed loans. (Sec. 761) Considers: (1) the cities of Kewanee and Jacksonville, Illinois, and Vicksburg, Mississippi, as having met certain rural housing area requirements; and; and (2) Jefferson County, Kentucky, as a rural area for purposes of certain business and industry loans. (Sec. 762) Provides settlement funds for claims associated with the Chuquatonchee Watershed Project, Mississippi. (Sec. 763) Makes the Konocti Water District, California, eligible for certain rural utilities grants and loans. (Sec. 765) Authorizes the conveyance of specified land in Prince George's County, Maryland, to resolve certain land claims at the Beltsville Agricultural Research Center, Maryland. (Sec. 766) Obligates specified funds under the Agricultural Risk Protection Act of 2000 for California. (Sec. 769) Makes Coachella, California, eligible for rural development mission area assistance. (Sec. 773) Amends the Consolidated Farmers Home Administration Act of 1961 to make Indian tribes (currently federally recognized Indian tribes) eligible for water and waste facility loans and grants. (Sec. 776) Expresses the sense of Congress that: (1) Alexander Hamilton made an immense contribution to the United States as a principal drafter of the Constitution; and (2) the National Park Service should restore and relocate his home, "the Grange", to St. Nicholas Park, New York City. (Sec. 777) Amends the Fallen Timbers Battlefield and Fort Miamis National Historic Site Act of 1999 to authorize land acquisition assistance and related appropriations. Title VIII: Natural Disaster Assistance and Other Emergency Appropriations - Authorizes additional Department of Agriculture appropriations for: (1) Office of the Chief Information Officer (common computing environment); (2) departmental administration; (3) Farm Service Agency; (4) Federal Crop Insurance Corporation Fund; (5) Natural Resources Conservation Service; and (6) Rural Community Advancement Program. Sets forth specified programs for which the Secretary shall make additional compensation and assistance available. Title IX: Trade Sanctions Reform and Export Enhancement - Trade Sanctions Reform and Export Enhancement Act of 2000 - Sets forth provisions respecting: (1) presidential and congressional authorities and procedures for the imposition of new, and termination of existing, unilateral agricultural or medical sanctions; and (2) trade and travel restrictions with Cuba and other specified countries. Title X: Continued Dumping and Subsidy Offset Act of 2000 - Continued Dumping or Subsidy Offset Act of 2000 - Amends the Tariff Act of 1930 to declare that, whenever continued dumping or subsidization is found to exist by the administering authority or by operation of law, any duties assessed shall be distributed as continued dumping or subsidy offsets to the affected domestic producers for qualifying expenditures on an annual basis. Limits qualifying expenditures to expenditures incurred since the issuance of the antidumping duty finding or order or countervailing duty order in any or all of the categories of plant, equipment, research and development, personnel training, acquisition of technology, employer-paid employee health care and pension benefits, environmental equipment, training or technology, acquisition of raw materials and other inputs, and borrowed working capital or other funds needed to maintain production. Directs the Commissioner of the U.S. Customs Service to prescribe offset disbursement procedures. Requires the Commissioner to establish a special account in the Treasury to receive all antidumping or countervailing duties. Title XI: Conservation of Farmable Wetland - Conservation of Farmable Wetland Act of 2000 - Amends the Food Security Act of 1985 to direct the Secretary of Agriculture to carry out a pilot program for conservation reserve enrollment of wetland and buffer acreage in Iowa, Minnesota, Montana, Nebraska, North Dakota, and South Dakota. Title XII: Hass Avocado Promotion, Research, and Information - Hass Avocado Promotion, Research, and Information Act of 2000 - Directs the Secretary of Agriculture to issue a marketing order, subject to producer and importer referendum approval, providing for research and promotion of Hass avocados. Sets forth marketing order terms and related provisions, including establishment of a Hass Avocado Board. Authorizes appropriations. Title XIII: Debt Reduction - Deposits a specified sum for FY 2001 in the Department of the Treasury for public debt reduction.

Lease Lot Conveyance Act of 2000 - Directs the Secretary of the Interior to convey to the Elephant Butte/Caballo Leaseholders Association, Inc., real property comprising 403 cabin sites under the administrative jurisdiction of the Bureau of Reclamation that are located along the western portion of the reservoirs in Elephant Butte State Park and Caballo State Park, New Mexico. Requires the Association to grant leaseholders of such properties the option of purchasing or continuing to lease their properties. Requires the Secretary to establish specified use restrictions with respect to each property. Requires conveyance proceeds to be deposited in the reclamation fund on behalf of the Rio Grande Project.

Calls on the Russian Federation to immediately release Edmond Pope and to ensure that proper and qualified medical attention is provided to him. Expresses the sense of Congress that if Pope is not released immediately, the President should continue efforts to secure his release, including consideration of: (1) terminating all assistance to the Government of the Russian Federation under the Foreign Assistance Act of 1961 and the annual Foreign Operations, Export Financing, and Related Programs Appropriations Act for purposes of preparing the Russian Federation's entrance or accession to the World Trade Organization; and (2) opposing any further debt relief of obligations owed to the U.S. Government from the Government of the Russian Federation. Urges the President to increase efforts to secure appropriate medical attention for Pope.

Acknowledges the contributions of children with disabilities, their parents, teachers, related services personnel, and administrators. Reaffirms support for the Individuals with Disabilities Education Act so that all children with disabilities have access to a free public education.

People's Republic of China and U.S. Election Investigation Act of 2000 - Directs the Attorney General to appoint an independent counsel to undertake a comprehensive investigation of the actions taken by: (1) officials from the People's Republic of China in connection with the 1996 presidential election to determine if such actions were illegal; and (2) high ranking officers of the Federal government in connection with financial contributions made by officials from the People's Republic of China in connection with such election to determine if such actions violated any Federal law.

Railroad Retirement and Survivors' Improvement Act of 2000 - Title I: Amendments to the Railroad Retirement Act of 1974 - Amends the Railroad Retirement Act of 1974 to increase benefits to railroad employees and their beneficiaries and to revise financing of the pension part (tier II) of the railroad retirement system. (Sec. 101) Increases benefits for widows and widowers by guaranteeing to them all of the tier II annuity the employee was entitled to at the time of the death. (Sec. 102) Makes employees with 30 years of service eligible to retire at age 60 with unreduced tier I and tier II annuities. Makes spouses of such employees eligible for unreduced annuities at age 60. (Sec. 103) Reduces the vesting requirement for tier II retirement annuities from ten years to five years of service after December 1995. Makes employees with at least five years of such service, but less than ten years of total service, eligible for a tier I disability annuity if their combined railroad retirement and social security earnings credits would satisfy social security eligibility requirements. Makes spouses, divorced spouses, and survivors of employees with at least five years of such service, but less than ten years of total service, eligible for a tier I annuity if they would have been entitled to a social security benefit based on combined service. (Sec. 104) Repeals a limit on the total amount of monthly railroad retirement benefits payable to an employee and spouse at the time the employee's annuity begins. (Sec. 105) Establishes a Railroad Retirement Trust Fund (the Fund) and a Railroad Retirement Investment Trust (RRIT) to manage and invest the assets of the Fund. Declares that RRIT is not an agency, department, or instrumentality of the U.S. Government. Requires RRIT to be administered by a Board of Trustees (the Trustees) with seven members (three representing labor, three representing employers, and one representing the general public) with experience and expertise in the management of financial investments and pension plans. Requires the Trustees to be appointed by a unanimous vote of the Railroad Retirement Board (RRB). Prohibits RRB members from being Trustees. Applies specified reporting requirements and fiduciary standards to the RRIT. Requires the Trustees to diversify investments so as to minimize the risk of large losses. Authorizes the Trustees to invest Fund assets in non-Governmental assets. (Sec. 106) Abolishes the Railroad Retirement Supplemental Annuity Account and provides for transfer of its funds to the Fund. (Sec. 107) Requires the RRB, upon the establishment of the Fund, to determine the portion of the Railroad Retirement Account not needed to pay current administrative expenses and direct the Secretary of the Treasury to transfer that amount into the Fund. Requires the Fund to transfer the necessary amount of funds to pay benefits and related administrative expenses to the disbursing agent. Transfers to the Fund Social Security Equivalent Benefit account funds not needed to pay current benefits, but requires that such funds only be used to pay benefits or to invest in U.S. Government or Government-guaranteed securities. Transfers to the disbursing agent from the Dual Benefit Account the amount necessary to make dual benefit payments. Requires the Trustees to consult with the Secretary of the Treasury to develop an appropriate method for transferring or converting existing account obligations. (Sec. 108) Requires the RRB to calculate the ratio of assets to benefits to determine annual tier II tax rates for employers, employee representatives, and employees. Establishes schedules for: (1) decreasing tax rates if the average account benefits ratio, based on the ratios for the ten most recent fiscal years, is above six; and (2) increasing employer and employee representatives' tax rates if the ratio is below four. Title II: Amendments to the Internal Revenue Code of 1986 - Amends the Internal Revenue Code to exempt the Railroad Retirement Trust Fund (the Fund) from taxation. (Sec. 203) Repeals a supplemental annuity tax that railroad employers pay to finance a benefit for long-time rail employees. (Sec. 204) Provides for adjustments to railroad employers, employee representatives, and employee tier II tax rates. Decreases such rates in 2001 and in 2002 for employers and employee representatives. Provides in the years after 2002 for tax rate schedules, based on the ten-year average account benefit ratio, for employers, employee representatives, and employees.
