Guam World War II Loyalty Recognition Act - Recognizes the suffering and the loyalty of the people of Guam during the Japanese occupation of Guam in World War II. Directs the Secretary of the Treasury to make specified payments to: (1) living Guam residents who were raped, injured, interned, or subjected to forced labor or marches resulting from, or incident to, such occupation and subsequent liberation; and (2) survivors of compensable residents who died in war or survivors of compensable injured residents (such payments to be made after payments have been made to surviving Guam residents). Defines "compensable Guam decedent" and "compensable Guam victim." Directs the Foreign Claims Settlement Commission to specify injuries that would constitute a severe personal injury or a personal injury. Authorizes the Commission to adjudicate claims and determine payment eligibility. Requires: (1) claims to be filed within one year after the Commission publishes public notice of the filing period in the Federal Register; and (2) the Commission to make filing period information available to the public through the media in Guam. Directs the Secretary of the Interior to establish a grant program for research, educational, and media activities that memorialize the events surrounding the occupation of Guam during World War II or honor the loyalty of the people of Guam during such occupation, or both.

Climate Change Rebate Act of 2008 - Requires that 35% of the total value of greenhouse gas emission allowances created by federal legislation limiting such emissions be auctioned each year to finance the purposes of this Act. Amends the Internal Revenue Code to allow certain low-income taxpayers a refundable tax credit for energy cost increases attributable to carbon regulation (climate change tax credit). Requires the Administrator of the Environmental Protection Agency (EPA) to: (1) formulate and administer a Climate Change Rebate Program to provide monthly rebates based on energy cost increases to low-income families and families receiving federal assistance; (2) establish a schedule and standards to implement such Program. Requires receipts from the auction of greenhouse gas emission allowances to be used equally for the Low-Income Home Energy Assistance Program and the Weatherization Assistance Program under the Energy Conservation and Production Act.

Commemorates the 10th anniversary of the establishment of the Minority AIDS Initiative. Commends the efforts of community organizations and health care providers in minority communities to deliver HIV/AIDS care and services. Encourages minorities to educate themselves about the HIV/AIDS prevention and treatment and to reduce HIV related stigma. Expresses support for the continued funding of the Initiative and other federal programs to stop the spread of HIV/AIDS and provide treatment to those affected.

Short-term Analog Flash and Emergency Readiness Act - Requires the Federal Communications Commission (FCC), notwithstanding specified provisions of the Communications Act of 1934 and the Digital Television Transition and Public Safety Act of 2005, to develop and implement a program to provide for the continued broadcasting in the analog television service of specified public safety information and digital television transition information from February 18, 2009, through March 3, 2009.

Rail Collision Prevention Act - Requires each rail carrier that is a Class I railroad, that has inadequate safety performance, or that provides intercity passenger or commuter rail passenger transportation to develop and submit for Secretary of Transportation approval by December 31, 2014, a plan to implement a positive train control system that prevents rail collisions. Requires implementation of such systems by December 31, 2012, in areas that have the highest safety risk due to shared track between commuter and freight rail. Increases penalties for violations of rail safety regulations or orders issued by the Secretary, including violations related to rail accident reporting and hours-of-service.

Juvenile Justice Reform Act of 2008 - Amends the Juvenile Justice and Delinquency Prevention Act of 1974 to: (1) revise the definition of "contact" in such Act to include any sight or sound interaction between a juvenile in custody and an adult inmate; (2) expand eligibility for participation in grant programs under such Act to certain individuals and organizations with an interest in the juvenile justice system ("juvenile justice stakeholders"); (3) require state plans under such Act to provide for increased protections for juveniles in custody, provide for culturally and linguistically appropriate services to juveniles at risk, and establish policies and strategies to identify and reduce racial and ethnic disparities among youths in the juvenile justice system; (4) require the inclusion on state juvenile delinquency prevention advisory boards of individuals with experience and competence in addressing the needs of girls or in implementing gender responsive services; and (5) require the Administrator of the Office of Juvenile Justice and Delinquency Prevention to assess and report on the effectiveness of treating juveniles as adults for purposes of criminal prosecutions. Amends the Incentive Grants for Local Delinquency Prevention Programs Act of 2002 to require the inclusion of gender specific services in the incentive grant program for juvenile delinquency prevention.

Declares the importance of access to swimming lessons for all U.S. communities. Condemns the persistent high rates of drowning fatalities among children. Celebrates the passage of the Virginia Graeme Baker Pool and Spa Safety Act and the work of initiatives to educate parents and caregivers on water safety and drowning prevention messages. Encourages funding to support initiatives that provide all children access to swimming education.

Bruce Vento Ban Asbestos and Prevent Mesothelioma Act of 2008 - Amends the Toxic Substances Control Act to require the Administrator of the Environmental Protection Agency (EPA) to establish a plan and initiate a program to: (1) increase awareness of the dangers posed by asbestos-containing products in homes and workplaces and by asbestos-related diseases; (2) provide information to, and encourage participation in research and treatment endeavors by, asbestos-related disease patients and their families and front-line health care providers; and (3) encourage health care providers and researchers to provide to patients and their families information relating to research, diagnostic, and clinical treatments relating to asbestos. Prohibits any person from importing, manufacturing, processing, or distributing asbestos-containing products, subject to limited exemption upon petition and specified exemptions sought by the Department of Defense (DOD) and the National Aeronautics and Space Administration (NASA). Sets forth exceptions for specified levels of asbestos with respect to: (1) chlor-alkali electrolysis installations or caustic soda produced at such installations; (2) aggregate products (extracted from stone, sand, or gravel operations) that are imported, manufactured, processed, or distributed in commerce for use as an integral part of specified cemented materials; (3) calcium carbonate, olivine, talc, vermiculite, and wollastonite; and (4) taconite pellets or iron ore that will be used to produce such pellets (but the prohibition does apply to tailings, waste material, or other byproducts of iron ore extraction). Provides that such prohibitions shall apply to any asbestos-containing calcium carbonate, olivine, talc, vermiculite, and wollastonite imported, manufactured, processed, or distributed in commerce for use in or for processing: (1) food that is intended for human consumption; (2) products used by individuals for personal health or cosmetic reasons; (3) drugs for human use; (4) consumer garden products; (5) cosmetics; (6) products designed or intended primarily for use by children 12 years old or younger; or (7) other products with such asbestos-containing materials that endanger human health or the environment. Requires the disposal of asbestos-containing products within three years after enactment of this Act. Provides for: (1) criminal penalties for violations; and (2) citizen petitions to the Administrator to initiate a proceeding for the issuance, amendment, or repeal of a rule or order under such Act. Declares that nothing in this Act: (1) preempts state or federal law; (2) creates a cause of action or increases or diminishes the liability of persons under other laws; or (3) prohibits the importation, manufacture, processing, or distribution in commerce of drinking water in a manner that complies with the Safe Drinking Water Act. Revises the definition of "asbestos" to include winchite and richterite asbestos and asbestiform amphibole mineral.

Home Health Care Planning Improvement Act of 2008 - Amends title XVIII (Medicare) of the Social Security Act to revise conditions of and limitations on payment for home health care services. Allows payment for home health services to Medicare beneficiaries by: (1) a nurse practitioner; (2) a clinical nurse specialist working in collaboration with a physician in accordance with state law; (3) a certified nurse-midwife; or (4) a physician assistant under a physician's supervision.

Notification and Federal Employee Antidiscrimination and Retaliation Act of 2008 or the No FEAR Act of 2008 - Amends the Notification and Federal Employee Antidiscrimination and Retaliation Act of 2002, or No FEAR Act of 2002, to require a federal agency, after receiving a final finding of discrimination, to arrange with the Department of the Treasury for a two-year payment schedule for reimbursing the Judgment Fund for its payment to a federal employee, former federal employee, or applicant for federal employment who has prevailed in an anti-discrimination or whistle blower protection complaint. Requires a federal agency to: (1) give written notification of the rights and protections available to federal employees to any employee of a contractor receiving more than half of its annual gross revenues from federal contracts; and (2) notify its employees annually by email or voice mail of the agency's Internet site. Directs the Government Accountability Office (GAO) to report annually to specified congressional and executive entities on the total costs incurred during the fiscal year associated with processing and litigating cases involving prohibited personnel practices. Requires each federal agency to establish performance goals reflective of its efforts to implement such Act. Specifies the No FEAR Institute as a source of training and counseling for federal employees regarding their rights and remedies under antidiscrimination, retaliation, and harassment, as well as whistleblower protection laws. Prescribes disciplinary action an agency must take against a culpable official in: (1) a case in which the official's discriminatory or retaliatory acts have contributed to a loss of life or limb or any other substantial diminishment of an employee's mental or physical health; or (2) other cases of discrimination. Prescribes monetary penalties for each week an agency failed to take action against employees who falsify evidence in a proceeding under Title VII of the Civil Rights Act of 1964. Requires the Equal Employment Opportunity Commission (EEOC) and any agency that becomes aware of a criminal violation to refer the matter to the Department of Justice for prosecution when agency officials are found liable for intimidating or harassing employees that testify before Congress. Directs the Comptroller General to ensure that a No FEAR Oversight Office is created within GAO. Sets the liability limits for federal workplace discrimination cases under Title VII at $300,000 per each claim or alleged violation.

Recognizes: (1) the important contributions of African-American doctors on the event of the apology of American Medical Association (AMA) to the National Medical Association (NMA) for over a century of racial prejudices and wrongdoings; (2) the efforts of Dr. W. Montague Cobb, former president of the NMA, to break down the racial prejudices at the AMA that led to its full integration; and (3) Shaw University's Leonard Medical School and other historically black colleges and universities for their role in training African-American doctors. Encourages more African-Americans to work in medicine and become doctors, nurses, and researchers.

Declares that Congress commits to pass, and urges the President sign, within 18 months, legislation that guarantees health care for all and that: (1) recognizes the role of women as health care consumers, caregivers, and providers; (2) guarantees inclusion of benefits essential to achieving and maintaining good health; (3) promotes primary and preventive care; (4) provides a choice of public and private plans and direct access to a choice of doctors and health care providers to ensure continuity of coverage and a delivery system that meets the need of women; (5) eliminates disparities on the basis of gender, culture, race, ethnicity, socioeconomic status, health status, or sexual orientation; (6) shares financing responsibility among employers, individuals, and the government while taking into account small business needs; (7) ensures affordable access to health care; (8) enhances quality and patient safety; (9) ensures a sufficient supply of qualified providers through expanded medical and public health education and adequate reimbursement; and (10) promotes administration efficiency and is easy to utilize.

Recognizes that it is imperative that this nation strengthen its public health system to provide all persons with the resources they need to make healthier choices and live healthier lives and to protect people from health threats beyond their control. Commits to creating public health strategies to eliminate health disparities and improve the health of all people in the United States. Expresses support for prioritizing public policies focusing on the prevention of disease and injury and calls for community-based programs to support healthy lifestyles. Urges the expansion of the prevention strategies of daily aspirin therapy, smoking cessation, colorectal cancer screening, annual flu immunizations, and breast cancer screening. Declares that the congressional budget process should reflect the savings associated with investments in the prevention of disease and injury. Encourages the Congressional Budget Office (CBO) to consider the savings associated with a reduced chronic disease burden due to preventive services and programs when formulating its health care cost estimates. Pledges support for increasing the investment in federal public health programs to at least 1% of total federal spending within five years.
