Prove It Act of 2024 This bill expands the requirements for federal agency rulemaking with respect to small businesses, organizations, and governmental jurisdictions. Specifically, when conducting an initial regulatory flexibility analysis, agencies must include, where feasible, any reasonably foreseeable potential indirect costs the proposed rule may impose on such small entities. Further, if an agency certifies that an initial regulatory flexibility analysis is not required because the rule will not have a significant economic impact on a substantial number of small entities, the agency must provide such certification within 10 days to the Office of Advocacy of the Small Business Administration. A small entity or group of small entities may petition the Office of Advocacy to review such certification. The petition must include specified information, such as the issues the petitioner believes should be addressed and a proposed solution to the issues raised. If the Office of Advocacy ultimately determines, upon a full review of the petition, that the proposed rule would have a significant economic impact on a substantial number of small entities, the agency promulgating the rule must perform an initial and final regulatory flexibility analysis for the rule. Additionally, if the agency does not participate or assist in the full review process, the finalized rule shall not apply to small entities. The bill also requires agencies to publish, and allow for comments on, all guidance documents with respect to any rule an agency determines is likely to have a significant economic impact on a substantial number of small entities.

Specifically, if an agency receives below a letter grade of A on its annual scorecard for small business contracting or does not meet two or more of the government-wide goals for contracting with small businesses, the director must testify before such committees about the reasons why the agency did not meet these benchmarks.

This bill allows a state or local authority (e.g., a transit authority) to use public transportation grants to make a partial advance payment for bus rolling stock (e.g., transit buses).  Specifically, a public transportation grant recipient may use grant funds to make an advance payment of not more than 20% of the total purchase order value of a bus rolling stock vehicle without requiring the vehicle manufacturer to provide a performance bond (or similar financial arrangement). In order to make an advance payment, the recipient must meet certain requirements. For example, the recipient must have a signed purchase order and an executed contract with a vehicle manufacturer that includes advance payment provisions.

Supporting Pregnant and Parenting Women and Families Act

Supporting Pregnant and Parenting Women and Families Act This bill prohibits the Administration for Children and Families (ACF) from finalizing, implementing, or enforcing (with respect to certain pregnancy centers) a provision of a proposed rule modifying the standard for a state's reasonable use of funds under the Temporary Assistance for Needy Families (TANF) program. The proposed rule provides that if ACF identifies a TANF expenditure that does not appear to reasonably accomplish a purpose of TANF then the state must show that it used the funds in a manner that a reasonable person would consider to be within one of the purposes. The bill prohibits ACF from applying this standard to state expenditures for pregnancy centers that (1) support protecting the life of the mother and the unborn child; and (2) offer resources and services to mothers, fathers, and families, including but relationship counseling, prenatal and pregnancy education, pregnancy testing, diapers, baby clothes, or material supports. Under current law, TANF funds may be used for any of four purposes, including to prevent and reduce out-of-wedlock pregnancies. In the supplemental information to the proposed rule, ACF states that TANF expenditures for programs that exclusively or primarily provide pregnancy counseling to women only after they become pregnant have a tenuous or nonexistent connection to this purpose and, therefore, likely do not meet the proposed reasonableness standard.

Expanding Public Lands Outdoor Recreation Experiences Act or EXPLORE Act This bill sets forth policies for the Department of the Interior and the Department of Agriculture related to recreation on certain public lands. Issues addressed include itemized budget information for outdoor recreation across departments;  long-distance bike trails;  recreational climbing activities;  target shooting ranges;  overnight campsites in Arkansas;  filming and still photography;  motorized and nonmotorized access;  invasive species;  gateway communities;  real-time information for the public on visitor levels;  broadband and cellular service; public-private partnerships;  access for persons with disabilities to trails and recreation opportunities;  recreational and job opportunities for military members and veterans;  youth access to recreational lands;  issuance of special recreation permits; a digital version of the National Parks and Federal Recreational Lands Pass; extension of seasonal recreation opportunities; and  volunteers on public recreational lands.

Alaska Native Village Municipal Lands Restoration Act of 2023

Alaska Native Village Municipal Lands Restoration Act of 2023 This bill removes the requirement that Alaska Native village corporations must convey lands to Alaska to be held in trust for future municipal governments.  The Alaska Native Claims Settlement Act (ANCSA) requires all Alaska Native village corporations that receive land under the ANCSA to convey certain lands to the existing municipality in the village or, if no municipality exists, to Alaska in trust for any municipality that may be established in the future. This bill removes the requirement for conveyance. Additionally, the bill allows village corporations to regain title to the lands held in trust by dissolving the trust through formal resolution by the village corporation and the residents of the Native village.

This joint resolution nullifies the final rule issued by the National Labor Relations Board titled Standard for Determining Joint Employer Status and published on October 27, 2023. The rule establishes a new joint employer standard for determining whether two employers simultaneously employ a particular employee or employees. Under the rule, an entity may be considered a joint employer of another employer's employees if the two share or codetermine the employees' essential terms and conditions of employment. The rule is currently scheduled to take effect on February 26, 2024.

Alaska’s Right to Produce Act of 2023

Alaska’s Right to Produce Act of 2023 This bill provides for oil and gas leases in the Arctic National Wildlife Refuge (ANWR).  Specifically, the bill nullifies any order or action by the President or the Department of the Interior that places a moratorium on, suspends, or otherwise pauses leasing in ANWR's 1002 Area. It also ratifies and approves all authorizations and permits issued for the establishment and administration of the Coastal Plain Oil and Gas Leasing Program. The Environmental Protection Agency and other applicable federal departments and agencies must process, reinstate, or continue to maintain such authorizations and permits.  Within 30 days of the bill's enactment, Interior must accept bids for certain ANWR leases that were canceled and reissue the leases. The bill states that the reissued leases must be considered to meet the requirements of specified existing laws, such as the Endangered Species Act of 1973. By December 22, 2024, Interior must also conduct a second lease sale. Further, the bill limits the authority of the President and Interior to cancel future leases issued under the program. The bill also directs the Bureau of Land Management to withdraw its (1) Notice of Availability of the Draft Coastal Plain Oil and Gas Leasing Program Supplemental Environmental Impact Statement , and (2) proposed rule titled  Management and Protection of the National Petroleum Reserve in Alaska . It also nullifies Section 4 of Executive Order 13990 and Secretarial Order 3401. Finally, the bill limits judicial review of approvals of leases under the program.

Farm to Fly Act of 2023

Farm to Fly Act of 2023 This bill directs the Department of Agriculture (USDA) to integrate the advancement of sustainable aviation fuels into its programs. Specifically, this bill includes sustainable aviation fuel as an advanced biofuel for the purposes of several USDA bioenergy programs that primarily provide support and incentives for renewable energy projects. For purposes of these programs, the bill defines sustainable aviation fuel as liquid fuel, the portion of which is not kerosene, which (1) meets specific international standards, (2) is not derived from coprocessing specific materials (e.g., triglycerides) with a non-biomass feedstock, (3) is not derived from palm fatty acid distillates or petroleum, and (4) is certified as having a lifecycle greenhouse gas emissions reduction percentage of at least 50% compared with petroleum-based jet fuel (based on specific standards and agreements). In addition, the bill specifically includes fostering and advancing sustainable aviation fuels as part of the Biorefinery, Renewable Chemical, and Biobased Product Manufacturing Assistance Program. Further, USDA must carry out a comprehensive and integrated pursuit of all USDA mission areas for the advancement of sustainable aviation fuels, including through the identification of opportunities to maximize the development and commercialization of the fuels, supporting rural economic development through improved sustainability for aviation, and advancing public-private partnerships.

Antisemitism Awareness Act of 2023 This bill provides statutory authority for the requirement that the Department of Education’s Office for Civil Rights take into consideration the International Holocaust Remembrance Alliance's (IHRA's) working definition of antisemitism when reviewing or investigating complaints of discrimination based on race, color, or national origin in programs or activities that receive federal financial assistance. According to the IHRA's working definition, antisemitism is a certain perception of Jews, which may be expressed as hatred toward Jews.

Federal Retirement Fairness Act

Federal Retirement Fairness Act This bill modifies the federal civilian service that is creditable service under the Federal Employees Retirement System (FERS). Specifically, it expands the nondeduction service that may be creditable under FERS. Nondeduction service is federal service where an employee's pay is not subject to retirement deductions (e.g., service under a temporary appointment). Currently, nondeduction service performed before January 1, 1989, is creditable under FERS so long as a deposit is made into the retirement fund to cover the period of nondeduction service. This bill allows nondeduction service performed on or after January 1, 1989, to be creditable under FERS so long as a deposit is made into the retirement fund.

This bill terminates the presidential waiver of certain sanctions on Iran and the licenses issued by the Department of the Treasury that allowed for the transfer of previously blocked Iranian funds (namely, the approximately $6 billion of Iranian funds that the Biden Administration permitted to be transferred from restricted accounts in South Korea to restricted accounts in Qatar to facilitate the release of five U.S. citizens detained in Iran). Furthermore, the President may not exercise waiver authority related to certain accounts belonging to Iran.

Drone Research and Innovation for Law Enforcement Act of 2023

Drone Research and Innovation for Law Enforcement Act of 2023 This bill directs the Federal Aviation Administration (FAA) to study, and create an approval process for, nonlethal de-escalation unmanned aircraft (i.e., drones). Under the bill,  nonlethal de-escalation unmanned aircraft  means an unmanned aircraft that is equipped with one or more nonlethal weapons or devices and is used by law enforcement personnel in scenarios (1) that present significant risk to human life, and (2) in which the suspected criminal is in a position to potentially escalate the situation and expose human life to a high level of risk. Specifically, the FAA must initiate a pilot research program to study the potential use of nonlethal de-escalation unmanned aircraft by law enforcement agencies. As part of the study, the FAA must enter into interagency agreements with various federal, state, and local agencies. The FAA must submit a report on the results of the research program to Congress. The report must include a plan outlining a proposed FAA application process for law enforcement to seek permission to operate nonlethal de-escalation unmanned aircraft. Within 90 days of submitting the report, the FAA must initiate rulemaking to create a process through which the FAA may provide approval to operate these unmanned aircraft.

Transportation Security Screening Modernization Act This bill directs the Transportation Security Administration (TSA) to streamline the process for individuals applying for or renewing enrollment in multiple security threat assessment (STA) programs, in particular the Transportation Worker Identification Credential (TWIC) and the Hazardous Materials Endorsement (HME) programs. Among other things, the TSA must permit an individual to enroll at a TSA-authorized enrollment center once and use the application, as well as information generated by TSA’s vetting, to enroll in any other programs; permit an individual to enroll in more than one STA program at the same time for a single fee that is less than the combined fee for applying to the same programs separately; provide for a streamlined and expeditious renewal process; and provide states the expiration dates for each individual’s STA to ensure commercial driver's licenses include an individual's current HME status. Additionally, the TSA must publish on its website information relating to the streamlining of the enrollment system. If the TSA determines it is necessary to implement these changes through rulemaking, the bill provides for an expedited rulemaking process.
