Protecting Student Athletes From Concussions Act

Protecting Student Athletes From Concussions Act This bill conditions each state's receipt of federal funds, beginning in FY2025, on the state's enforcement of specified minimum requirements for the prevention and treatment of concussions in school-sponsored athletics and activities. Each local educational agency must develop and implement a standard plan for concussion safety and management that includes (1) the education of students, parents, and school personnel about concussions; (2) specified supports for each student recovering from a concussion; and (3) best practices designed to ensure the uniformity of safety standards, treatment, and management. Each public school must post on school grounds and publish on the school website specified information about concussions. If any public school personnel suspects that a student has sustained a concussion during a school-sponsored activity, the student must be immediately removed from participation in that activity and prohibited from participating in school-sponsored athletic activities until the student submits a written release from a health care professional. Furthermore, the school personnel must report all available information regarding the injury to a concussion management team that will confirm and report details of the injury to the student's parents. The school's concussion management team shall consult with and make recommendations to relevant school personnel and the student to ensure that the student is receiving the appropriate academic supports.

Pay Our Border Patrol and Customs Agents Act This bill provides FY2024 appropriations for the salaries and expenses of certain U.S. Customs and Border Protection (CBP) employees who are required to work during a lapse in appropriations (i.e., government shutdown) in FY2024. Specifically, the bill provides appropriations to CBP for the salaries and expenses of agents of the U.S. Border Patrol and officers of the Office of Field Operations who are excepted from furlough (i.e., required to work) during a lapse in discretionary appropriations in FY2024. 

Pay Our Troops Act

Pay Our Troops Act This bill provides continuing appropriations for military pay for any period during which interim or full-year appropriations for FY2024 are not in effect (i.e., a government shutdown). Specifically, the bill provides FY2024 continuing appropriations for the pay and allowances of (1) members of the Armed Forces, including reserve components, who perform active service during the period; and (2) civilian employees and contractors of the Department of Defense (and the Department of Homeland Security in the case of the Coast Guard when the Coast Guard is not operating as a service in the Department of the Navy) who are providing support to such members of the Armed Forces. If a government shutdown occurs, the bill provides the continuing appropriations until the earlier of (1) the enactment into law of specified appropriations legislation, or (2) January 1, 2025.

Agent Raul Gonzalez Officer Safety Act This bill establishes new federal criminal offenses for operating a motor vehicle within 100 miles of the U.S. border while fleeing from a U.S. Border Patrol officer or a federal, state, or local law enforcement officer who is actively assisting or under the command of the U.S. Border Patrol. The bill establishes criminal penalties for an offense, including a mandatory minimum prison term for an offense resulting in death or serious bodily injury. Additionally, the bill establishes immigration-related penalties—a permanent bar on applying for legal status in the United States—for an offense by an individual who is unlawfully present in the United States.

Insurance Data Protection Act

Insurance Data Protection Act This bill limits the ability of federal entities to compel insurance companies to share information. Specifically, the bill eliminates the subpoena power of the Federal Insurance Office. Under current law, the office has the power to subpoena information from insurers to, among other purposes, identify issues that could contribute to a systemic crisis in the insurance industry or the U.S. financial system. The bill also eliminates the ability of the Office of Financial Research to subpoena insurance companies. When seeking to collect insurance company data under specified consumer protection laws, a financial regulator must obtain the data from other regulators or from publicly available sources if possible. Otherwise, the financial regulator may only collect this data directly from the insurance company if it complies with the Paperwork Reduction Act.

Collision Avoidance Systems Act of 2023

Collision Avoidance Systems Act of 2023 This bill allows for the use of a pulsating light system for vehicle braking. Specifically, Federal Motor Vehicle Safety Standard Number 108 (Standard 108) must be deemed to allow for the use of a pulsating light system on covered vehicles (i.e., passenger cars, multipurpose passenger vehicles, trucks, buses, trailers, and motorcycles). The Department of Transportation must issue regulations to update Standard 108 to (1) include performance-based standards for pulsating light systems, and (2) allow for the use of the systems on motor vehicles. As background, Standard 108 regulates all automotive lighting, signaling, and reflective devices. Under the bill, a pulsating light system includes a system for a high-mounted stop lamp in which the lamp pulses rapidly no more than four times and for no more than 1.2 seconds when the brake of the vehicle is applied and then converts to a continuous light (as a normal stop lamp) until the brake is released.

Protecting Infrastructure Investments for Rural America Act

Protecting Infrastructure Investments for Rural America Act This bill modifies the definition of rural area that is used for the Rural Surface Transportation Grant Program and adds provisions for small communities. As background, the grant program supports projects that improve and expand the surface transportation infrastructure in rural areas. Eligible applicants for the grant program include states, regional transportation planning organizations, local governments, and tribal governments. For purposes of the program, the bill defines rural area as an area outside an urbanized area that has a population of 20,000 or less. Current law requires a rural area to be outside of an urbanized area with a population of over 200,000. The bill includes provisions for small communities (i.e., an area outside an urbanized area and that has a population of 5,000 or less). The bill sets the maximum federal cost-share at 90% for project grants carried out in a small community. The Department of Transportation (DOT) must use at least 5% of the program's annual funds to provide grants for projects in small communities. The bill also removes the prohibition against DOT using more than 10% of program funds for grants that are under $25 million. Further, program grants may be used for highway, road, bridge, or tunnel projects that would benefit the economic development or quality of life for citizens of the local community. The bill also specifies that the program's goals include the generation of economic growth and development in rural areas.

The SBA also must report on its collaboration with the Department of Agriculture pursuant to the memorandum of understanding the agencies entered into on April 4, 2018, including the extent to which the SBA remains involved with the working groups convened under the memorandum.

Senior Citizens' Freedom to Work Act of 2023 This bill eliminates provisions that reduce Social Security retirement benefits for certain beneficiaries who are younger than full retirement age and who have outside income above a certain threshold, also known as the Retirement Earnings Test (RET). Under the RET, benefits are reduced for beneficiaries who are younger than full retirement age if they earn more than the annual limit ($21,240 for 2023). Withheld benefits are subsequently added to monthly benefits once the beneficiary reaches full retirement age.

Healthy Poultry Assistance and Indemnification Act

Healthy Poultry Assistance and Indemnification Act This bill expands the Animal and Plant Health Inspection Service (APHIS) producer indemnity and compensation program to include compensation for all poultry growers and layers located in an APHIS-determined control area.  Currently, APHIS provides indemnity and compensation to producers to remove animals classified as affected, suspect, or exposed to diseases of concern, including highly pathogenic avian influenza (HPAI). An APHIS-determined  control area consists of both an infected zone and a buffer zone.  Under the bill, APHIS must compensate all owners of poultry growing or laying facilities for flocks of birds that the facility owner was prohibited from growing or laying due to the location of the facility within a control area. This may include facilities that are located in the buffer zones and have non-infected poultry. Further, the bill establishes a new compensation payment formula that requires payments to be based on the owner’s average income from the five most recent flocks. Under the bill, APHIS's compensation determination is final and not subject to judicial or administrative review (other than by the Secretary of Agriculture or a designee).

To require ports of entry along the northern border to remain open as many hours per day as they were open prior to the COVID-19 pandemic.

Feeding Children Not Fraudsters Act of 2023

Feeding Children Not Fraudsters Act of 2023 This bill directs the Department of Agriculture (USDA) to audit state agencies for known fraud (i.e., child nutrition program fraud for which any person is investigated, charged, or convicted by the Department of Justice, USDA, or a state official). Under the bill, a state agency is one that serves a local agency, institution, or service institution administering or operating a child nutrition program under which known fraud was committed. Specifically, USDA must annually audit a state agency for the period of January 1, 2020, through December 31, 2022, for known fraud, including fraud carried out under the Child and Adult Care Food Program (CACFP), the Summer Food Service Program, and child nutrition COVID–19 waivers. The audit must examine specific areas, including (1) oversight measures by a state agency; (2) hearings conducted by a state agency after being made aware of such fraud; and (3) overpayments, improper payments, or fraudulent uses of funds by a local agency, institution, or service institution served by a state agency. USDA must submit a report to Congress on the audits.  A state agency that is being audited must fully cooperate with an audit, including by providing any requested information, in order to participate in or operate any child nutrition program. Further, USDA and state agencies must retain certain records related to fraud.

Unrecognized Southeast Alaska Native Communities Recognition and Compensation Act

Unrecognized Southeast Alaska Native Communities Recognition and Compensation Act This bill allows five Alaska Native communities in Southeast Alaska to form urban corporations and receive land entitlements. Specifically, the bill allows the Alaska Native residents of each of the Alaska Native villages of Haines, Ketchikan, Petersburg, Tenakee, and Wrangell, Alaska, to organize as Alaska Native urban corporations and to receive certain settlement land. The bill directs the Department of the Interior to convey specified land to each urban corporation. Further, Interior must convey the subsurface estate for that land to the regional corporation for Southeast Alaska. The land conveyed to each urban corporation must include any U.S. interest in all roads, trails, log transfer facilities, leases, and appurtenances on or related to the land conveyed to the urban corporation. The bill also allows each urban corporation to establish a settlement trust to (1) promote the health, education, and welfare of the trust beneficiaries; and (2) preserve the Alaska Native heritage and culture of their communities.

Investing in Rural America Act

Investing in Rural America Act This bill allows Farm Credit System (FCS) institutions to provide financing and technical assistance for essential community facility projects as part of the Department of Agriculture's Community Facilities Direct Loan & Grant Program. (This program provides funding to develop essential community facilities in rural areas.) The FCS financing and technical assistance may be provided in order to make capital available to develop, build, maintain, improve, or provide other support for essential community facilities in rural communities (e.g., certain facilities that provide healthcare, community support, public safety, educational, or utility services).  Under the bill, the financing provided by an FCS institution may not exceed 15% of the institution’s total assets unless the FCS institution offers at least one non-FCS lending institution an interest in the financing under reasonable terms and conditions acceptable to the borrower. The FCS institution must also report the offer to the Farm Credit Administration (FCA). The FCA must submit an annual report to Congress on the activities undertaken by FCS institutions under this bill, including through the partnerships between FCS institutions and other lending institutions. The FCA must post the report on the agency's website. 

To terminate the COVID-19 vaccination requirement for aliens, and for other purposes.

Community News and Small Business Support Act This bill allows certain small businesses and employers of journalists tax credits for advertising in local media and for the wages of not more than 1,500 local news journalists in any calendar quarter. Specifically, the tax credit for advertising in local media allows small businesses with less than 50 full-time employees a limited credit for the expense of advertising in a local newspaper, or in any licensed broadcast radio or television station that serves a local community. The credit for the wages of a local news journalist is a payroll tax credit that takes into account wages not exceeding $12,500 in any calendar quarter.

American Confidence in Elections Act or the ACE Act This bill addresses election administration and security, campaign finance, and other related provisions. Specifically, the bill directs the Election Assistance Commission's (EAC's) Standards Board and Local Leadership Council to issue voluntary considerations for states about various aspects of election administration. Additionally, the bill  reduces certain election assistance payments for states and local jurisdictions that allow noncitizens to vote; requires states to provide designated congressional election observers with full access to observe the administration procedures of federal elections; prohibits federal agencies from using funds made available for salaries and expenses to solicit or enter into agreements with nongovernmental organizations to conduct voter registration or voter mobilization activities on the agency's property or website;   prohibits federal funds for election administration for states that allow ballot harvesting, with exceptions; establishes various requirements for elections in the District of Columbia; makes various changes to the EAC; and prohibits foreign nationals from making contributions or donations in connection with state or local ballot initiatives or referenda. The bill also establishes the Twentieth Amendment Section Four Panel, which must recommend to Congress model legislation to resolve any vacancy created by the death of a candidate in a contingent presidential or vice-presidential election. The bill makes changes to campaign finance, including by (1) repealing limits on coordinated party expenditures, and (2) prohibiting federal funds from being used to make payments in support of a congressional election campaign. It also makes changes to the Federal Election Commission.

Parity for Tribal Law Enforcement Act

Parity for Tribal Law Enforcement Act This bill treats certain tribal law enforcement officers as federal law enforcement officers under specified circumstances. Specifically, the bill authorizes the law enforcement officers of any Indian tribe that has contracted or compacted any or all federal law enforcement functions through the Indian Self-Determination and Education Assistance Act to enforce federal law within the tribe's jurisdiction if those officers meet certain qualifications. These qualifications include completing training and passing an adjudicated background investigation. Further, the bill deems a tribal law enforcement officer who is acting under an authorized contract or compact as a federal law enforcement officer for the purposes of certain federal laws, including for injury and death, retirement, and pension benefits. The Department of the Interior must (1) develop procedures for credentialing tribal officers to confirm these officers meet minimum certification standards and training requirements for Indian country peace officers, and (2) promulgate guidance to implement this bill. The bill also requires the Department of Justice to coordinate and provide oversight for its functions and programs to ensure a coordinated approach for public safety in Indian communities.

Fair and Open Skies Act This bill amends the policy considerations the Department of Transportation (DOT) must take into account when issuing a foreign air carrier permit. (This allows foreign air carriers to operate in U.S. air space.) DOT must consider preventing the undermining of labor standards when determining whether the foreign air transportation will be in the public interest. Further, the bill amends the requirements for the Department of State and DOT in formulating U.S. international air transportation policy. Under current law, the State Department and DOT must develop a negotiating policy emphasizing the greatest degree of competition compatible with a well-functioning international air transportation system and include specific considerations; this is amended to also include preventing the undermining of labor standards.

Jackie Walorski Enhancing Necessary Data on Illegal School Bus Passing Act This bill addresses various issues related to illegal passing of stopped school buses. For example, the bill requires the National Highway Traffic Safety Administration to  establish a grant program for demonstration projects to monitor and collect data on illegal passing of stopped school buses, produce and distribute a national public safety messaging campaign concerning the dangers of illegal passing of stopped school buses, and modify certain educational materials to include more information on the dangers of illegal passing of stopped school buses and the importance of enforcing laws against it. The bill also requires the Department of Transportation, in consultation with the National Conference of State Legislatures, to develop model legislation to address incidents of illegal passing of stopped school buses.  

Neighborhood Homes Investment Act

Neighborhood Homes Investment Act This bill allows a business-related tax credit for certain development costs for the acquisition, rehabilitation, or remediation of qualified real property (i.e., real property affixed on a permanent foundation and comprised of four or fewer residential units, a condominium unit, or a house or apartment owned by a cooperative housing corporation). The bill also provides for the exclusion from gross income, for income tax purposes, of the value of any subsidy provided to a taxpayer by any state energy office for purposes of improvements made to a qualified residence.

Leveling the Playing Field 2.0 Act

Leveling the Playing Field 2.0 Act This bill addresses unfair trade practices by making various changes to U.S. antidumping and countervailing duty law. Antidumping provides relief to U.S industries and workers that are materially injured or threatened with injury due to imports of like products sold in the U.S. market at less than fair value, while countervailing duty provides such relief from imports of products subsidized by a foreign government or public entity. Specifically, the bill establishes a process for successive antidumping and countervailing duty investigations. Successive investigations may be concurrent (an ongoing investigation of the same product) or recently completed (not more than two years before the date of the initiation of the successive investigation). Further, the bill establishes a time line for the Department of Commerce to issue determinations in successive investigations. Among other provisions, the bill authorizes Commerce to apply countervailing duty law to subsidies provided by a foreign government or public entity to a company operating in a third country, use another method for calculating the cost of production in specific circumstances, and require importers to provide a certification that the imported merchandise is not subject to an antidumping or countervailing duty order. Additionally, the bill statutorily establishes procedures for Commerce to conduct circumvention inquiries, including by specifying the deadlines for preliminary and final determinations. The bill also provides statutory authority for Commerce to investigate currency undervaluation as a countervailable subsidy.

Children’s Hospital GME Support Reauthorization Act of 2023

Children's Hospital GME Support Reauthorization Act of 2023 This bill reauthorizes through FY2028 the Children's Hospital Graduate Medical Education Payment program, which supports education and training for medical residents and fellows in children's hospitals. The bill also bars children's hospitals that provide gender-affirming care to minors from receiving payments through the program. Under the bill, gender-affirming care generally includes procedures (e.g., surgeries or hormone therapies) that change the body of an individual to correspond to a sex that is different than the individual's biological sex. It excludes, however, specified types of procedures, including those for treating (1) individuals who have both ovarian and testicular tissue or abnormal sex chromosome structure or hormones, or (2) infections or other harms that result from a previous gender-transition procedure.

Crop Insurance for Future Farmers Act

Crop Insurance for Future Farmers Act This bill amends the federal crop insurance program (FCIP) to increase the premium assistance rate for beginning and veteran farmers or ranchers. Specifically, the bill amends the amount of percentage points that are added to the premium assistance rate for beginning and veteran farmers or ranchers for an applicable insurance policy or plan (currently 10 percentage points) to provide 15 percentage points in each of the 1st and 2nd reinsurance years, 13 percentage points in the 3rd year, 11 percentage points in the 4th year, and 10 percentage points in each of the 5th through the 10th reinsurance years. The bill also amends the FCIP definition of beginning farmer or rancher to include a farmer or rancher who has not actively operated and managed a farm or ranch for more than 10 crop years (currently more than 5 crop years).

For example, the bill  extends the authorization for the Department of Defense (DOD) to transfer certain defense items to Israel;  extends the authorization to finance cooperative projects among the United States, Israel, and developing countries related to water resources, agriculture, and energy storage;  extends energy cooperation and authorizes the Department of Energy to make grants to Israel to support advanced nuclear technologies, as well as for carbon capture, utilization, and storage;  requires the U.S. Agency for International Development to ensure that applicants from Abraham Accord countries are eligible for Middle East Regional Cooperation grants; and  requires the Department of State to report to Congress on U.S. diplomatic efforts to oppose politically motivated investigations against the United States and Israel at the International Criminal Court.

Stop Harboring Iranian Petroleum Act or the SHIP Act This bill requires the President to impose visa- and property-blocking sanctions against foreign persons that knowingly transport, process, refine, or otherwise deal in petroleum and petroleum products originating in Iran. These sanctions also extend to certain foreign persons associated with the sanctioned individual, such as adult family members and any entities owned or controlled by the sanctioned individual.

Access Technology Affordability Act of 2023

Access Technology Affordability Act of 202 3 This bill allows a refundable tax credit equal to the amounts paid for qualified access technology for use by a blind individual who is the taxpayer, the taxpayer's spouse, or a dependent of the taxpayer. Qualified access technology is hardware, software, or other information technology with the primary function of converting or adapting information that is visually represented into forms or formats usable by blind individuals. The credit is limited to (1) costs that are not compensated by insurance or otherwise, and (2) an aggregate amount of $2,000 per blind individual in any period of three consecutive taxable years. The credit must be adjusted for inflation after 2024 and terminates after 2028.
