An amendment to prohibit other federal agencies from using information collected by the NBS on private land unless the landowner has been provided access to the information, a detailed description of the manner in which it was collected, and the opportunity to dispute its accuracy. In cases where the landowner disputes the information, the amendment would provide that the information may be used only if the Secretary of the Interior reviews it and determines that it is accurate.

An amendment to prohibit any action authorized under the bill if it constitutes a "taking" of private property under the Fifth Amendment to the Constitution (which provides that private property shall not be taken for public use without just compensation). The amendment would require the Interior Department to provide compensation to the owner of any private property or property interest that loses more than 50% of its value as the result of certain federal actions that may occur based on data, information, or research developed by the NBS. Under the amendment, compensation would be available only in the case of federal wetlands regulatory actions under the Clean Water Act or federal actions under the Endangered Species Act, and would be subject to the availability of appropriations.

Such procedures shall include an administrative process to provide compensation to the owner of private property if the use or value of all or any portion of the private property is substantially diminished as a result of the designation of the American Heritage Area or the management plan for the American Heritage Area.

Amendment prohibits video programmers affiliated with cable operators from engaging in unfair or deceptive practices that hinder or exclude competing cable systems, or alternative broadcast distribution systems from obtaining programming. The amendment prohibits discrimination in the price, terms, and conditions for carrying programs offered to competing multichannel broadcast delivery systems. The amendment would allow affiliated programmers to establish different prices, terms, and conditions of service for competing systems as a result of actual differences in the cost of production, sales, distribution, and program transmission, and reasonable discounts based on market size. Exclusive contracts between cable programmers and operators would be permitted if the FCC determines that such contracts serve the public interest.
