Receiving Electronic Statements To Improve Retiree Earnings Act This bill amends the Employee Retirement Income Security Act of 1974 (ERISA) and the Internal Revenue Code to authorize the electronic delivery of pension plan documents required to be furnished to a plan participant, beneficiary, or other individual. The system for furnishing such a document must: (1) be designed to result in effective access to the document, (2) permit the recipient to select the electronic means through which the document is received or request paper documents, and (3) protect the confidentiality of personal information. An annual paper notice must be provided describing: the selection of electronic means for furnishing documents, the right to modify the selection or to elect to receive paper versions of the documents at no additional direct cost and how to make the election, and any election that has been made to receive paper documents. An electronically furnished document must be prepared and furnished in a manner that is consistent with the style, format, and content requirements for the document. It must also include a notice that apprises the individual of the significance of the document when it is not otherwise reasonably evident as transmitted.

Fallen Warrior Battlefield Cross Memorial Act This bill states that the Department of Veterans Affairs may not prohibit the display of a Battlefield Cross in any national cemetery. "Battlefield Cross" means a memorial monument in honor of fallen members of the Armed Forces that may include a replica of an inverted rifle, boots, helmets, and identification tag.

Protecting Home Oxygen & Medical Equipment Access Act of 2017 or the Protecting HOME Access Act of 2017 This bill: (1) requires the Centers for Medicare & Medicaid Services (CMS) to delay by one year the full implementation of new Medicare payment rates for durable medical equipment, and (2) revises a Medicare budget-neutrality requirement related to oxygen. Under current law, the CMS may establish separate payment classes under Medicare for items of oxygen and related equipment only if doing so does not result in increased program expenditures. The bill provides an exception to this budget-neutrality requirement with respect to such items that are included in a competitive acquisition program.

Tax Cuts and Jobs Act This bill amends the Internal Revenue Code to reduce tax rates and modify policies, credits, and deductions for individuals and businesses. With respect to individuals, the bill: replaces the seven existing tax brackets (10%, 15%, 25%, 28%, 33%, 35%, and 39.6%) with four brackets (12%, 25%, 35%, and 39.6%), increases the standard deduction, repeals the deduction for personal exemptions, establishes a 25% maximum rate on the business income of individuals, increases the child tax credit and establishes a new family tax credit, repeals the overall limitation on certain itemized deductions, limits the mortgage interest deduction for debt incurred after November 2, 2017, to mortgages of up to $500,000 (currently $1 million), repeals the deduction for state and local income or sales taxes not paid or accrued in a trade or business, repeals the deduction for medical expenses, consolidates and repeals several education-related deductions and credits, repeals the alternative minimum tax, and repeals the estate and generation-skipping transfer taxes in six years. For businesses, the bill: reduces the corporate tax rate from a maximum of 35% to a flat 20% rate (25% for personal services corporations), allows increased expensing of the costs of certain property, limits the deductibility of net interest expenses to 30% of the business's adjusted taxable income, repeals the work opportunity tax credit, terminates the exclusion for interest on private activity bonds, modifies or repeals various energy-related deductions and credits, modifies the taxation of foreign income, and imposes an excise tax on certain payments from domestic corporations to related foreign corporations. The bill also repeals or modifies several additional credits and deductions for individuals and businesses.

Financial Stability Oversight Council Improvement Act of 2017 This bill amends the Financial Stability Act of 2010 to require the Financial Stability Oversight Council, in determining whether a nonbank financial company shall be designated as systemically important and consequently be supervised by the Federal Reserve Board and subject to prudential standards, to consider the appropriateness of imposing such standards as opposed to other forms of regulation to mitigate identified risks to U.S. financial stability. Every five years, the council must, upon request by a nonbank financial company, reevaluate such a determination and hold a vote on whether to rescind it. The bill revises procedural requirements related to council determinations.

Removing Onerous Obstacles in the Tax code for Mainstreet Businesses Act or the ROOT for Mainstreet Businesses Act This bill amends the Internal Revenue Code to modify the tax treatment of personal holding companies. The bill excludes from the definition of "personal holding company" a corporation with greater than 50% stock ownership held by nonresident alien individuals with no effectively connected income under tax provisions regarding expatriation to avoid tax or the taxation of nonresident alien individuals. The bill also excludes from personal holding company income certain rents and royalties that are derived in the active conduct of a trade or business and are not received from a related person.

This bill amends the Export-Import Bank Act of 1945 to revise the quorum requirement for the Board of Directors of the Export-Import Bank of the United States to require the lesser of three members or the number of members holding office on the board (currently, at least three members) for there to be a quorum.

This bill amends title XVIII (Medicare) of the Social Security Act to prohibit the application of Medicare competitive acquisition rates to complex, rehabilitative, manual wheelchairs and accessories. (A competitive bidding program has replaced the use of established fee schedule amounts to determine payments under Medicare for certain durable medical equipment such as wheelchairs.)

Free File Permanence Act of 2017 This bill requires the Department of the Treasury to continue to operate the Internal Revenue Service (IRS) Free File Program. The program must work with state government agencies to enhance and expand the use of the program, while continuing to: provide free commercial-type online individual income tax preparation and electronic filing services to the lowest 70% of taxpayers by income; provide all taxpayers (regardless of income) with a basic, online electronic fillable forms utility; and work with the private sector to provide the free tax preparation and electronic filing services. Treasury must work with the private sector through the program to identify and implement innovative new program features to improve and simplify the taxpayer's experience with completing and filing individual income tax returns. The IRS and members of the tax software and electronic industry involved in the program must support and promote improvements within the program by mutually testing, piloting, and offering innovative solutions to: simplify the tax system, reduce compliance and reporting burdens, increase tax return accuracy through financial data authentication, strengthen the tax system against fraud through cybersecurity collaboration, avoid duplication, and maximize the use of electronic technology. The Electronic Tax Administration Advisory Committee must report annually to Congress regarding the program, including website statistics, cybersecurity standards, demographic information, marketing and education efforts, simplifications and innovations, and state and local participation.

Rightsizing Pension Premiums Act of 2017 This bill amends the Employee Retirement Income Security Act of 1974 (ERISA) to: (1) modify the formula that the Pension Benefit Guaranty Corporation (PBGC) uses to calculate the funded percentage of single-employer pension plans, and (2) reduce single-employer PBGC premiums for pension plans that are sponsored by certain small employers or have specified PBGC funded percentages. The bill also prohibits the budget effects of provisions that change PBGC premiums from being counted for the purposes of determining budget points of order for legislation in the House or the Senate. (The PBGC is a federal agency that insures the benefits of private sector, defined benefit pension plans. The PBGC is financed by insurance premiums paid by sponsors of the plans, investment income, assets from pension plans taken over by the PBGC, and recoveries from the companies formerly responsible for the plans.)

Save Local Business Act This bill amends the National Labor Relations Act and the Fair Labor Standards Act of 1938 to provide that a person may be considered a joint employer in relation to an employee only if such person directly, actually, and immediately, and not in a limited and routine manner, exercises significant control over the essential terms and conditions of employment (including hiring employees, discharging employees, determining individual employee rates of pay and benefits, day-to-day supervision of employees, assigning individual work schedules, positions, and tasks, and administering employee discipline).

HVAC Expensing and Technology Act of 2017 or the HEAT Act of 2017 This bill amends the Internal Revenue Code to allow expensing and accelerated cost recovery for certain energy efficient heating and air-conditioning property. The bill applies to certain real property: (1) with respect to which depreciation (or amortization in lieu of depreciation) is allowable; (2) which is installed as part of the heating, cooling, ventilation, and hot water systems; and (3) which is within the scope of specified standards of the American Society of Heating, Refrigerating, and Air Conditioning Engineers and the Illuminating Engineering Society of North America.

ELD Extension Act of 2017 This bill delays for an additional two years the effective date of regulations implementing the requirement that a commercial motor vehicle involved in interstate commerce and operated by a driver subject to federal hours of service (HOS) and record of duty status regulations be equipped with an electronic logging device to improve vehicle operator compliance with HOS regulations.

President John F. Kennedy Commemorative Coin Act This bill directs the Department of the Treasury to mint and issue not more than 500,000 $1 silver coins in commemoration of President John F. Kennedy. The bill requires all sales of such coins to include a surcharge of $10 per coin, which shall be paid by Treasury to the John F. Kennedy Library Foundation to support the John F. Kennedy Presidential Library and Museum.

Medicare Part B Improvement Act of 2017 This bill amends title XVIII (Medicare) of the Social Security Act to: establish a transitional Medicare payment system with respect to certain home infusion services; extend the Medicare Intravenous Immune Globulin demonstration project and provide for participants to be automatically reenrolled in the project; specify that, for purposes of determining the reasonableness and medical necessity of orthotics and prosthetics, documentation created by an orthotist or prosthetist shall be considered part of a beneficiary's medical record; allow renal dialysis facilities to be accredited for Medicare participation by an approved accreditation body; allow Medicare beneficiaries with end-stage renal disease (ESRD) to receive certain ESRD-related visits via telehealth; codify certain rules regarding signature requirements and holdover arrangements as they relate to prohibitions against physician self-referrals; and beginning in FY2021, reduce funding available to the Medicare Improvement Fund by an amount equal to the amount of projected expenditures attributable to specified provisions of the bill.

This bill allows a Medicare Advantage (MA) plan, until 2024, to restrict plan enrollment to certain special-needs individuals, provided that the plan meets specified applicable requirements. Current law allows an MA plan to do so until 2019. The Federal Coordinated Health Care Office within the Centers for Medicare & Medicaid Services (CMS) shall serve as a dedicated point of contact for states with regard to special-needs MA plans for individuals who are dually eligible for Medicaid and Medicare. The CMS shall establish a unified process for grievances and appeals for individuals enrolled in such plans. The CMS must, with respect to special-needs MA plans for individuals with chronic conditions, convene a panel of clinical advisors to establish and update the list of chronic conditions that make an individual eligible for participation in such a plan. The Government Accountability Office (GAO) must study and report to Congress on health outcomes of individuals enrolled in specialized MA plans. The CMS shall, with respect to special-needs MA plans, consider applying certain quality measures at the plan level rather than at the contract level. The GAO must report to Congress on state-level integration between the Medicaid program and special-needs MA plans for individuals who are dually eligible for Medicaid and Medicare. Beginning in plan year 2020, an MA plan may provide certain supplemental benefits to chronically ill enrollees. The GAO must report to Congress on the provision of such supplemental benefits to MA enrollees.

Medicare Part B Home Infusion Services Temporary Transitional Payment Act This bill amends title XVIII (Medicare) of the Social Security Act to temporarily provide for transitional Medicare payment with respect to certain home infusion services furnished on or after January 1, 2019. Under current law, the Center for Medicare & Medicaid Services is required to establish a permanent payment system with respect to such services furnished on or after January 1, 2021.

Empowering Employees through Stock Ownership Act This bill amends the Internal Revenue Code to allow an employee to elect to defer, for income tax purposes, income attributable to certain stock transferred to the employee by an employer. The employee may defer the inclusion of income from the stock until the year that includes the earliest of the dates on which: the stock becomes transferable; the employee becomes an excluded employee; stock of the corporation becomes readily tradable on an established securities market; seven years have passed after the rights of the employee in the stock are transferable or are not subject to a substantial risk of forfeiture, whichever occurs earlier; or the employee revokes the election with respect to the stock. The stock must meet specified requirements and be transferred to the employee from an eligible corporation in connection with the performance of services as an employee. A corporation is eligible if: (1) no stock of the corporation or a predecessor is readily tradable on an established securities market during any preceding year; and (2) it has a written plan under which at least 80% of certain employees are granted stock options, or restricted stock units, with the same rights and privileges to receive qualified stock. Employees are excluded if they: (1) are a 1% owner, the chief executive officer, or the chief financial officer of the corporation or have been at any time during the 10 preceding calendar years; (2) are a family member of the specified individuals; or (3) have been one of the four highest compensated officers of the corporation during any of the 10 preceding taxable years.

Philanthropic Enterprise Act of 2017 This bill amends the Internal Revenue Code to exempt the holdings of a private foundation in any business enterprise that meets specified requirements relating to exclusive ownership, minimum distribution of net operating income for the charitable purpose (all profits to charity distribution requirement), and independent operation (not controlled by a substantial contributor or family members) from the excise taxes on excess business holdings.

Increasing Opportunity through Evidence-Based Home Visiting Act This bill amends title V (Maternal and Child Health Services) of the Social Security Act (SSAct) to reauthorize through FY2022, and otherwise revise, the Maternal, Infant, and Early Childhood Home Visiting Program. Under current law, grantees were required, after three years of program implementation, to demonstrate improvement in specified benchmark areas. The bill requires grantees to continue, in subsequent years, to track and demonstrate improvement in applicable benchmark areas. A grantee that fails to do so must develop and implement a corrective action plan, subject to approval by the Department of Health and Human Services (HHS). HHS shall terminate a program grant made to a grantee that implements such a plan but continues to fail to demonstrate improvement. As a condition for receiving grant funds under the program, a state must conduct a statewide needs assessment by October 1, 2019, and at least once every five years thereafter. A grantee may use program grant funds to support a "pay-for-outcomes initiative" (a performance-based grant, contract, or cooperative agreement, awarded by a public entity, in which a commitment is made to pay for improved outcomes that result in social benefit and public-sector cost savings). Grantees must provide matching funds under the program beginning in FY2020. HHS must designate data-exchange standards applicable to the program. The bill also amends title XVI (Supplemental Security Income) (SSI) under the SSAct to prohibit the payment of SSI benefits to an individual who is subject to an arrest warrant for: (1) committing, or attempting to commit, a felony; or (2) violating a condition of parole or probation.

Research and Experimentation Advances Competitiveness at Home Act or the REACH Act This bill amends the Internal Revenue Code, with respect to the tax credit for increasing research activities (known as the research and experimentation tax credit), to: increase the alternative simplified credit rate to match the rate of the regular credit; allow taxpayers to use reasonable estimation techniques in lieu of contemporaneous accounting to measure employee hours per business component; allow employees engaging in the direct supervision or direct support of research activities which constitute qualified research to be included in the research expense calculation without regard to the employee's position or management level; allow the credit to be used for research related to the adaptation of an existing business component to a particular customer's requirement or need, cost reduction, or obsolescence mitigation; and allow taxpayers to make an election for a reduced credit (in order to be allowed a full deduction for research expenses) on an amended tax return.

GSP Footwear Act of 2017 This bill amends the Trade Act of 1974 to authorize the President to designate certain footwear as eligible for duty-free treatment under the Generalized System of Preferences (GSP). The President shall include in the next six annual reports to Congress regarding the status of internationally recognized worker rights within a GSP eligible beneficiary developing country a study on the state of the U.S. footwear manufacturing industry for the preceding year. In conducting any study of the probable economic effect of providing duty-free treatment under the GSP to such footwear, the U.S. Trade Representative shall request the U.S. International Trade Commission to examine current domestic production of like or directly competitive footwear articles and to identify any such articles where domestic commercial production is likely to occur within the next year.

This bill amends the Internal Revenue Code to allow the premium assistance tax credit to be used for unsubsidized COBRA continuation health coverage. (Under the Consolidated Omnibus Budget Reconciliation Act of 1985 [COBRA], an individual may continue to receive coverage under an employer-sponsored health plan after an event that would otherwise end coverage, such as a termination of employment. This bill applies to COBRA continuation coverage if the premiums are solely the obligation of the taxpayer.) "COBRA continuation coverage" includes continuation coverage provided under: the Internal Revenue Code, the Employee Retirement Income Security Act of 1974 (ERISA), the Public Health Service Act, or the Federal Employees Health Benefits Program; a state law or program that provides comparable coverage; or a church plan that provides comparable coverage. It does not include coverage under a health flexible spending arrangement. For the coverage to qualify for the tax credit, the plan administrator of the group health plan must certify that the COBRA continuation coverage meets the requirements for qualified health plans. The bill is contingent on the enactment of the American Health Care Act of 2017 and applies (if at all) after December 31, 2019.

American Legion 100th Anniversary Commemorative Coin Act This bill requires the Department of the Treasury to mint and issue commemorative coins in recognition and celebration of the 100th anniversary of the American Legion. Surcharges received from the sale of these coins shall be paid to the American Legion for costs related to promoting the importance of: (1) caring for those who have served, and those who are still serving, in the Armed Forces; and (2) maintaining patriotic values, strong families, and assistance for at-risk children.

Private Foundation Excise Tax Simplification Act of 2017 This bill amends the Internal Revenue Code to: (1) reduce from 2% to 1% the excise tax rate on the net investment income of tax-exempt private foundations, and (2) repeal the 1% reduction in such tax rate for private foundations that meet certain distribution requirements. The bill also excludes the budgetary effects of this bill from PAYGO scorecards maintained pursuant to the Statutory Pay-As-You-Go Act of 2010.

Consumer Financial Choice and Capital Markets Protection Act of 2017 This bill amends the Investment Company Act of 1940 to allow a money market fund, under specified conditions, to elect to operate using a different method of valuation than is otherwise required. A money market fund that elects to do so shall not be subject to specified requirements related to the imposition of liquidity fees. Certain federal assistance may not be provided directly to any money market fund. This limitation on federal assistance must be disclosed in a money market's advertising and sales literature.

This bill amends the Public Health Service Act, if the American Health Care Act (H.R. 1628) is enacted, to make plans made available by the federal government to Members of Congress and congressional staff subject to state waivers of the Patient Protection and Affordable Care Act (PPACA) requirement for health insurance to cover the essential health benefits and PPACA restrictions on premium variation by age and health status.

Insurance Company Tax Modernization and Parity Act of 2017 This bill amends the Internal Revenue Code to allow affiliated life and non-life insurance companies to file consolidated tax returns. The bill also allows: (1) a phase-in of the full application of losses of affiliated non-life insurance companies against the taxable income of an affiliated life insurance company for taxable years beginning after December 31, 2017, and before January 1, 2024, and (2) an automatic waiver of the five-year waiting period applicable to affiliated non-life insurance companies for offset of their losses against life insurance company income.

Flags of Convenience Don't Fly Here Act This bill bars the Department of Transportation (DOT) from issuing a foreign air carrier permit or an exemption from certain air carrier certificate requirements to a person to provide foreign air transportation under the United States-European Union Air Transport Agreement of April, 2007, in a proceeding in which the applicability of Article 17 bis of such Agreement has been raised by an interested person, unless DOT: finds that issuing the permit or exemption would be consistent with the intent set forth in Article 17 bis of the agreement, that opportunities created by the agreement do not undermine labor standards or the labor-related rights and principles contained in the laws of the respective parties to the agreement; and imposes conditions on the permit or exemption necessary to ensure that the person complies with the intent of Article 17 bis . In carrying out such air carrier certificate requirements, DOT shall consider preventing entry of flag of convenience carriers into U.S. markets as being in the public interest and consistent with public convenience and necessity for safety in air transportation and air commerce. In formulating U.S. international air transportation policy, the Department of State and DOT shall develop a negotiating policy emphasizing the greatest degree of competition for a well-functioning air transportation system that eliminates specified discriminatory and unfair competitive practices faced by U.S. airlines in foreign air transportation, to include erosion of labor standards associated with flag of convenience carriers. A "flag of convenience carrier" is defined as a foreign air carrier that is established in a country other than the home country of its majority owner or owners in order to avoid the home country's regulations.

Promotion and Expansion of Private Employee Ownership Act of 201 7 This bill expands tax incentives and federal assistance for employee stock ownership plans (ESOPs) that are sponsored by S corporations. The bill provides additional tax incentives for ESOPs by (1) extending to all domestic corporations, including S corporations, provisions allowing deferral of tax on gain from the sale of employer securities to an ESOP; and (2) allowing a tax deduction for 50% of the interest received by a bank on loans to S corporation-sponsored ESOPs for the purchase of employer securities. The Department of the Treasury must establish the S Corporation Employee Ownership Assistance Office to foster increased employee ownership of S corporations. The bill defines an "ESOP business concern" and allows such a concern to continue to qualify as a small business for the purposes of programs under the Small Business Act. An "ESOP business concern" is a business concern that was a small business concern eligible for a loan, preference, or other program under the Small Business Act before more than 49% of the business concern was acquired by an ESOP.

Cents and Sensibility Act This bill requires that the one-cent, five-cent, ten-cent, and quarter-dollar coins be: (1) produced primarily of steel, and (2) treated to impart a color so that their appearance is similar to coins produced previously. In minting these coins, Treasury shall use steel produced only in the United States unless: (1) doing so would be inconsistent with the public interest, or (2) an adequate supply of the appropriate grade of steel is not produced in the United States in sufficient and reasonably available quantities. In setting specifications for these coins, Treasury may not: (1) require more than one change to coin-accepting and coin-handling equipment to accommodate new coins produced; (2) facilitate or allow the use of a coin with a lesser value produced by another country, or the use of any token or other easily or regularly produced metal device of minimal value, in the place of a circulating coin produced by Treasury; or (3) require non-trivial changes to coin-accepting or coin-handling equipment to easily accommodate continued co-circulation of both old and new coins.

Social Security Disability Insurance and Unemployment Benefits Double Dip Elimination Act This bill amends title II (Old Age, Survivors and Disability Insurance) of the Social Security Act to disqualify an individual from receiving disability insurance benefits with respect to any month for which the individual receives unemployment insurance benefits.

Homeless Veterans Legal Services Act This bill directs the Department of Veterans Affairs to enter into partnerships with public or private entities to fund a portion of the legal services such entities provide to homeless veterans and veterans at risk of homelessness related to housing, family law, income support, and criminal defense.

This bill modifies the methodology used to calculate a manufacturer's average sales price for certain drugs covered under Medicare. Specifically, the bill excludes, from a manufacturer's average sales price calculation, customary prompt pay discounts extended to wholesalers.

Retirement Security Preservation Act of 2017 This bill amends the Internal Revenue Code to modify the nondiscrimination requirements for certain defined benefit retirement plans that limit participation or certain features to a closed class, such as individuals who were hired before a certain date. (Under current law, the plans may not discriminate in favor of highly compensated employees and must meet minimum participation requirements.) The bill applies only to a defined benefit plan that: (1) closed before April 5, 2017; or (2) was in effect for at least five years when it closed and did not substantially increase the coverage or value of the benefits, rights, or features for the closed class during the five-year period before it closed, except as the result of certain business acquisitions or mergers. Such a plan meets the nondiscrimination requirements if it: (1) satisfies certain testing rules for the year that the class closes and the two succeeding plan years, and (2) is not amended in a discriminatory manner after the class is closed. A defined contribution plan that offers additional contributions or benefits to a closed class whose benefits under a defined benefit plan have been reduced or eliminated meets the nondiscrimination requirements if: (1) the group receiving the contributions or benefits satisfies certain testing rules for the year in which the group is closed and for two subsequent plan years, and (2) the plan is not amended in a discriminatory manner. A defined benefit plan that is either closed or has ceased benefit accruals for all participants (frozen plan) satisfies the minimum participation requirements if the plan met the requirements when it was closed or frozen.

Larry Doby Congressional Gold Medal Act This bill directs the Speaker of the House of Representatives and the President pro tempore of the Senate to arrange for the presentation of a Congressional Gold Medal in honor of Larry Doby in recognition of his achievements and contributions to American major league athletics, civil rights, and the Armed Forces during World War II.

Allow States and Victims to Fight Online Sex Trafficking Act of 2017 This bill amends the Communications Act of 1934 to specify that communications decency provisions protecting providers or users of interactive computer services from liability for the private blocking or screening of offensive material shall not be construed to impair the enforcement of, or limit availability of victim restitution or civil remedies under, state or federal criminal or civil laws relating to sexual exploitation of children or sex trafficking. The bill amends the federal criminal code to specify that the violation for benefiting from "participation in a venture" engaged in sex trafficking of children, or by force, fraud, or coercion, includes knowing or reckless conduct by any person or entity and by any means that furthers or in any way aids or abets the violation. A provider of an interactive computer service that publishes information provided by an information content provider with reckless disregard that the information is in furtherance of a sex trafficking offense shall be subject to a criminal fine or imprisonment for not more than 20 years.

Calls upon the President to: (1) consult with the House of Representatives and the Senate to consider opportunities to promote further economic and commercial activity and cooperation between the United States and Japan; (2) invite Japan to begin discussions toward establishing the basis for closer trade ties with the United States; and (3) determine whether negotiation of a trade agreement with Japan would be likely to achieve the negotiating objectives established by the Bipartisan Congressional Trade Priorities and Accountability Act of 2015 and, if so, to commence such negotiations.
