Affordable Housing Credit Improvement Act of 2023 This bill revises provisions of the low-income housing tax credit and renames it as the affordable housing tax credit . The bill increases the per capita dollar amount of the credit and its minimum ceiling amount beginning in 2023 and extends the inflation adjustment for such amounts. The bill modifies tenant income eligibility requirements and the average income formula for determining such income. It also revises rules for student occupancy of rental units and tenant voucher payments, and prohibits any refusal to rent to victims of domestic abuse. The bill further modifies the credit to increase state allocations of the credit; repeal the qualified census tract population cap; prohibit consideration of local approval and local government contribution requirements for housing projects; increase the credit for certain projects designated to serve extremely low-income households; increase the credit for certain bond-financed projects designated by state agencies; eliminate the basis reduction for properties that receive certain energy-related tax benefits; and increase the population cap for difficult development areas (i.e., areas with high construction, land, and utility costs relative to area median gross income). The bill also includes Indian and rural areas as difficult development areas and modifies other requirements relating to casualty losses, tax-exempt bond financing, and foreclosures.

Fight and Combat Rampant Iranian Missile Exports Act or the Fight CRIME Act This bill imposes sanctions pertaining to Iran's missile program. The President must impose visa- and property-blocking sanctions on foreign persons (i.e., foreign individuals, entities, and states) that are knowingly involved with Iran or Iran-aligned entities in certain missile-related activities, such as (1) acquiring, possessing, developing, transporting, transferring, or deploying missiles or related items and technology that are covered by the Missile Technology Control Regime (MTCR), or (2) developing missile or drone technologies. (The MTCR is an informal political understanding among states that seek to limit missile proliferation.) The President must also impose sanctions on (1) certain adult family members of those who are subject to the sanctions discussed above, and (2) foreign persons who knowingly provide significant support to or engage in a significant transaction with those subject to the sanctions discussed above. The bill also requires the Department of State to report to Congress on various topics, including (1) a diplomatic strategy to renew international restrictions on certain missile-related activities set forth in Annex B of U.N. Security Council Resolution 2231, which concerns restrictions on arms transfers to and from Iran; (2) the identities of foreign persons engaging in restricted activity under Annex B; and (3) an analysis of the foreign and domestic supply chains that facilitate Iran's missile or drone programs.

Food Date Labeling Act of 2023 This bill establishes requirements for the format of quality date and discard date labels on food packaging. Specifically, the bill requires the quality date on a food label (i.e., the date after which the quality of the item may deteriorate) to include the phrase BEST If Used By or the abbreviation BB . Similarly, the discard date on a food label (i.e., the date after which the item should not be consumed) must include the phrase USE By or the abbreviation UB . Abbreviations may only be used if the full phrase does not fit on the label. The Department of Health and Human Services and Department of Agriculture may specify alternative phrases through regulations.

This resolution expresses support for recognizing National Police Week. The resolution further recognizes law enforcement officers across the United States in the pursuit of preserving safe and secure communities; the need to ensure that such officers have the equipment, training, and resources necessary to protect their health and safety while they are protecting the public; and the law enforcement community for acts of sacrifice and heroism. The resolution expresses condolences and appreciation to the loved ones of each law enforcement officer who has made the ultimate sacrifice in the line of duty.

Postal Police Reform Act of 2023 This bill removes certain restrictions on U.S. Postal Service (USPS) police officers to investigate criminal matters related to the USPS and postal mail.

International Nuclear Energy Act of 2023 This bill addresses U.S. cooperation with other nations on nuclear energy-related issues. For example, the bill requires the President, in coordination with international partners, to hold a biennial conference on civil nuclear safety, security, safeguards, and sustainability; the Department of State to meet with ally or partner nations for the purpose of collaborating on research, development, licensing, and deployment of advanced nuclear reactor technologies for civil nuclear energy; the State Department to provide financial assistance to embarking civil nuclear nations for developing civil nuclear energy programs; and the establishment of a working group to develop a 10-year civil nuclear trade strategy with biennial targets for the export of civil nuclear technologies. Furthermore, the President must launch an international initiative to modernize outreach to embarking civil nuclear nations to improve the importation and exportation of civil nuclear technology and materials. This initiative may include establishing cooperative financing relationships for the export of such technology and materials. The bill also authorizes the Department of Energy to support regulatory development, design, and deployment activities related to certain small modular reactor projects.

DOE and NASA Interagency Research Coordination Act This bill provides statutory authority for a research and development partnership between the Department of Energy (DOE) and the National Aeronautics and Space Administration (NASA). Specifically, the bill authorizes DOE and NASA to enter into a memorandum of understanding to support cross-cutting and collaborative research and development that furthers the missions of both agencies. Through the partnership, DOE and NASA may conduct research in a variety of focus areas (e.g., dark matter), develop ways to support large voluntary data sets on space and aeronautical information, promote multi-agency data sharing, and support NASA's access to DOE research infrastructure. DOE and NASA must jointly report on their collaboration.

New York-New Jersey Watershed Protection Act This bill establishes programs to restore and protect the New York-New Jersey Watershed. The watershed is composed of all land area the surface water of which drains into the New York-New Jersey Harbor, the waters contained within that land area, and associated estuaries. Specifically, the bill requires the U.S. Fish and Wildlife Service to establish the New York-New Jersey Watershed Restoration Program, a nonregulatory program, to coordinate restoration and protection activities among government entities and conservation partners throughout the watershed. The bill also establishes the New York-New Jersey Watershed Restoration Grant Program, a voluntary grant and technical assistance program, to provide competitive matching grants to certain entities to implement restoration and protection activities for the watershed. The federal government may not maintain ownership of any land acquired under the bill except for the purpose of promptly transferring ownership to grant recipients. The bill ceases to have force or effect on October 1, 2030.

Living Donor Protection Act of 2023 This bill prohibits certain insurance carriers from discriminating against, and provides other protections for, living organ donors. Specifically, carriers may not deny, cancel, or otherwise impose conditions on policies for life insurance, disability insurance, or long-term care insurance based on an individual's status as a living organ donor. The bill also expressly specifies that recovery from organ-donation surgery constitutes a serious health condition that entitles eligible employees to job-protected medical leave. In addition, the Department of Health and Human Services must update educational materials on living organ donation to include information about the benefits of living organ donation and about access to insurance for living organ donors.

Justice Against Sponsors of Illicit Fentanyl Act of 2023 This bill allows foreign states to be sued in a U.S. court for physical injury to a person or property or death occurring in the United States as a result of fentanyl trafficking. (Typically, a foreign state is immune from lawsuits filed against it in a U.S. court.) Specifically, a foreign state is not immune from a lawsuit seeking damages for (1) an act of fentanyl trafficking in or into the United States, or (2) a tortious act or acts regardless where the tortious act or acts occurred. If the United States is in discussions with a foreign state that is seeking to resolve claims related to fentanyl trafficking or tortious acts, the Department of Justice may intervene and seek a stay in a case filed under this bill involving the foreign state.

Countering CCP Drones Act This bill requires the inclusion of telecommunications and video surveillance equipment or services produced or provided by Shenzhen Da-Jiang Innovations Sciences and Technologies Company Limited (a Chinese drone maker commonly known as DJI Technologies) on a list of communications equipment or services determined by the Federal Communications Commission (FCC) to pose an unacceptable risk to U.S. national security. Current law prohibits the use of federal funding available through specified FCC programs for purchasing or maintaining listed equipment or services.

Save Local Business Act This bill provides that a person may be considered a joint employer in relation to an employee under federal labor law only if such person directly, actually, and immediately (and not in a limited and routine manner) exercises significant control over the essential terms and conditions of employment. Such control may by demonstrated by hiring and discharging employees, determining individual employee rates of pay and benefits, day-to-day supervision of employees, assigning individual work schedules, positions, and tasks, and administering employee discipline.

Providing Child Care for Police Officers Act of 2023 This bill directs the Department of Health and Human Services to establish a grant pilot program for child care services for the children of law enforcement officers. Grants are provided to eligible states to provide assistance to a law enforcement agency or a group of entities to establish and operate child care programs for the minor children of law enforcement officers during shift work and abnormal work hours.

American Innovation and R&D Competitiveness Act of 2023 This bill eliminates the five-year amortization requirement for research and experimental expenditures, thus allowing continued expensing of such expenditures in the taxable years in which they are incurred.

Protect Local Taxpayers Act of 2023 This bill specifies that, in order to receive certain Federal Medical Assistance Percentage (FMAP) increases under Medicaid, states with a local share requirement must agree to distribute funds to each locality in an amount that is proportional to the locality's Medicaid contributions.

Safety From Violence for Healthcare Employees Act or the SAVE Act This bill establishes a new criminal offense for knowingly assaulting or intimidating hospital personnel during the performance of their official duties in a manner that interferes with their performance of the duties or limits their ability to perform the duties. Additionally, the bill authorizes grants to reduce the incidence of violence at hospitals, including violence or intimidation against hospital personnel in the performance of their duties.

Infrastructure Expansion Act of 2023 This bill precludes absolute liability in any action against a property owner or contractor for certain federal infrastructure and transportation development projects for any injury associated with an elevation- or gravity-related risk occurring on those projects. This applies to federally owned or operated projects and to projects receiving federal financial assistance for infrastructure and transportation development. In any such claim, a state must apply a liability standard that considers the comparative negligence of the injured person when such negligence is a proximate cause of an injury, and state law would otherwise apply absolute liability as the basis for such claim. The bill applies to claims arising from projects in which a state or local government accepts federal financial assistance beginning on or after January 1, 2025.

Strengthening Medicare for Patients and Providers Act This bill modifies certain adjustments to payment amounts under the Medicare physician fee schedule. Payment amounts under the Medicare physician fee schedule are based on a service's relative value, a conversion factor, and a geographic adjustment factor. Current law provides for separate conversion factors for physicians that are qualifying participants in advanced alternative payment models (also known as qualifying APM participants) and for other physicians beginning in 2026, with an annual update of 0.75% and 0.25%, respectively. The bill replaces the separate conversion factors for qualifying APM participants and other physicians with a single conversion factor and provides for an update that is equal to the annual percentage increase in the Medicare Economic Index, beginning in 2024. (The Medicare Economic Index is a specialized index that is generally used to determine allowed charges for physician services based on annual price changes.)

Protect American Energy From China Act This bill prohibits federal funds from being used for implementing or administering the memorandum of understanding reached in 2011 between the Department of Energy and the Chinese Academy of Sciences on facilitating cooperation in nuclear energy science and technology.

Nancy Gardner Sewell Medicare Multi-Cancer Early Detection Screening Coverage Act This bill allows for Medicare coverage and payment for multi-cancer early detection screening tests that are approved by the Food and Drug Administration and that are used to screen for cancer across many cancer types, if the Centers for Medicare & Medicaid Services determines such coverage is appropriate.

Resident Physician Shortage Reduction Act of 2023 This bill increases the number of residency positions eligible for graduate medical education payments under Medicare for qualifying hospitals, including hospitals in rural areas and health professional shortage areas. Current law provides for an increase of up to 200 positions per fiscal year beginning in FY2023, with a total increase of 1,000 positions; each hospital may receive up to 25 additional positions. Current law also provides for an additional increase of up to 200 positions for FY2026, with at least 100 of these positions for psychiatry or related specialties; each hospital may receive up to 10 additional positions. The bill provides for an additional increase of 2,000 positions per fiscal year from FY2025-FY2031; during this period, each hospital may receive up to 75 additional positions in total under the bill and current law. Additionally, one-third of the positions that are made available under the bill must be allocated to hospitals that are already operating above applicable resident limits. The bill also requires the Government Accountability Office to report on strategies to increase the diversity of the health professional workforce, including with respect to representation from rural, low-income, and minority communities.

Goldie's Act This bill expands enforcement provisions under the Animal Welfare Act (AWA). Specifically, the bill directs the Department of Agriculture (USDA) to document and record detailed descriptions of violations of the act observed during inspections and investigations. USDA must provide a copy of all records documenting violations to state, local, and municipal animal control or law enforcement officials within 24 hours of such inspections or investigations. Inspections must be held at least once a year of each research facility, the premises of each animal dealer, and each exhibitor of animals. If violations are found during inspections, then USDA must conduct any necessary follow-up inspections until all the violations are corrected. Inspectors must confiscate or destroy in a humane manner animals found to be suffering physical or psychological harm as a result of failure to comply with the AWA. Violators are subject to civil penalties as outlined in the bill.

LA28 Olympic and Paralympic Games Commemorative Coin Act This bill directs the Department of the Treasury to mint coins in commemoration of the 2028 Olympic and Paralympic Games in Los Angeles, California. All surcharges received by Treasury from the sale of the coins shall be promptly paid by Treasury to the United States Olympic and Paralympic Properties for the objects and purposes related to the hosting of the 2028 Olympic and Paralympic Games and to aid in the execution of its legacy programs, including the promotion of youth sports in the United States. Treasury is encouraged to develop and execute a marketing and educational program to promote and sell the coins.

Stop Funding Our Adversaries Act of 2023 This bill prohibits federal agencies from conducting or supporting, either directly or indirectly, research that will be conducted by China's government, the Chinese Communist Party, or any agent, instrumentality, or entity belonging to or controlled by either entity.

Testing, Rapid Analysis, and Narcotic Quality Research Act or the TRANQ Research Act This bill requires the National Institute of Standards and Technology (NIST) to support research and other activities related to identifying xylazine (a compound used in veterinary medicine as a nonopioid tranquilizer), novel synthetic opioids, and other emerging substances of concern. In particular, NIST must support basic measurement science and research, including graduate and postgraduate research; near-real time spectrometry capabilities (i.e., a technique for rapidly identifying the chemical composition of a substance); strategies and voluntary best practices for handling, transporting, and analyzing such substances; and collaboration with other government agencies, institutions of higher education, and the private sector to enhance relevant narcotic and opioid detection and analysis capabilities.

Stopping Illicit Fentanyl Trafficking Act of 2023 or the SIFT Act of 2023 This bill permanently adds five fentanyl analogues and the entire category of fentanyl-related substances to schedule I of the Controlled Substances Act. A schedule I controlled substance is a drug, substance, or chemical that has a high potential for abuse; has no currently accepted medical value; and is subject to regulatory controls and administrative, civil, and criminal penalties under the Controlled Substances Act. Fentanyl-related substances are currently regulated under schedule I through a temporary order issued by the Drug Enforcement Administration. The temporary order expires on December 31, 2024. The bill also creates a process to remove from schedule I certain fentanyl-related substances that do not have a high potential for abuse.

Dairy Pricing Opportunity Act of 2023 This bill directs the Department of Agriculture (USDA) to hold national hearings to review Federal Milk Marketing Orders. (USDA uses these orders to establish a minimum price for various classes of milk.) The hearings must include the review of proposals from producers and the dairy industry on the price of Class I skim milk. The bill also requires manufacturers to report cost and yield information for all dairy products processed in the same facility or facilities to USDA's Dairy Product Mandatory Reporting Program. Further, every two years, USDA must publish a report containing the information obtained under these new requirements.

Let Experienced Pilots Fly Act of 2023 This bill raises the mandatory retirement age for pilots engaged in commercial aviation operations from 65 to 67 years of age, unless the operation takes place in (1) the territorial airspace of a foreign county where such operations are prohibited by the foreign country, or (2) international airspace where such operations are not in compliance with the Annexes to the Convention on International Civil Aviation. The Federal Aviation Administration must also submit a report to Congress on further increasing the age limitation for pilots engaged in commercial aviation operations.

Kids in Classes Act This bill prohibits a state educational agency from receiving specified federal education funds unless funds are provided directly to a parent or guardian of an eligible child for certain qualified educational expenses (e.g., educational materials, tutoring, or private school tuition). Eligible child refers to a child who attends a public elementary or secondary school and such school (1) receives specified federal education funds; and (2) does not provide, for more than three days during a school year and for reasons related to a public health emergency or collective bargaining action, in-person instruction for all students who wish to attend.

Quantum in Practice Act This bill includes quantum modeling and simulation within the definition of quantum information science for purposes of various federal research and development initiatives, programs, and activities. Quantum information science refers to the use of the laws of quantum physics to store, transmit, manipulate, compute, or measure information, and quantum modeling and simulation refers to the use of quantum computing hardware to determine the properties of quantum systems (e.g., the properties of materials such as high-temperature superconductors and modeling nuclear and particle physics).

Honoring Our Fallen Heroes Act of 2023 This bill extends death and disability benefits under the Public Safety Officers' Benefits Program (PSOB) to certain public safety officers who suffer from exposure-related cancer while on duty and their survivors. The PSOB program provides death, disability, and education benefits to public safety officers who are killed or injured in the line of duty and their survivors. The bill specifies that exposure-related cancer shall be presumed to constitute a personal injury in the line of duty if the public safety officer was exposed to or in contact with heat, radiation, or a carcinogen that is linked to an exposure-related cancer; the officer began serving as an officer not later than 5 years before the date of the diagnosis of an exposure-related cancer and the diagnosis occurred not later than 15 years after the last date of active service; and the exposure-related cancer directly and proximately resulted in the death or permanent and total disability of the officer. The Department of Justice's Bureau of Justice Assistance (BJA) must periodically review the definition of exposure-related cance r. It directs the BJA to add additional cancers to the definition under certain circumstances (e.g., a petition process).

DOE and USDA Interagency Research Act This bill requires the Department of Energy and Department of Agriculture to carry out cross-cutting and collaborative research and development activities through the establishment of an interagency agreement. The agencies are authorized to (1) carry out reimbursable agreements in order to maximize research and development effectiveness, and (2) collaborate with other federal agencies. Further, the interagency agreement must require the use of a competitive, merit-reviewed process, which considers applications from federal agencies, national laboratories, institutions of higher education, and nonprofit institutions. Research and development activities may include collaborative research in a variety of focus areas such as integrated natural resources and the energy-water nexus, biofuels and biobased products, invasive species management, grid modernization and security, and rural technology development; developing methods to accommodate large voluntary standardized and integrated data sets on agricultural, environmental, supply chain, and economic information; supporting research infrastructure and workforce development; and conducting collaborative research and development on ways to improve agriculture operations and processing efficiencies, and reduce greenhouse gas emissions.

Advanced Weather Model Computing Development Act This bill requires the Department of Energy (DOE) and the National Oceanic and Atmospheric Administration (NOAA) to carry out research on advancing weather and climate modeling and prediction. DOE and NOAA must jointly carry out research on using artificial intelligence and high-performance computing for climate modeling and weather prediction. Research activities may include (1) developing new methods for modeling and simulation, machine learning, and predictive data analysis; and (2) facilitating data sharing between federal agencies, institutions of higher education, and other organizations. Additionally, NOAA must carry out an initiative to conduct proof-of-concept scenarios by comparing forecasts generated by advanced forecasting models with those generated by current models. As part of the initiative, NOAA may share innovations in the modeling system and applications through community-based activities and leverage climate and weather data and efforts of other federal agencies. NOAA must collaborate with DOE on the initiative. The research required by the bill must meet security and integrity requirements that apply to certain research activities of the National Science Foundation.

Puppy Protection Act of 2023 This bill requires the Department of Agriculture to expand standards that govern the humane handling, care, treatment, and transportation of animals to include new requirements for commercial dog dealers. Specifically, the standards must require dog dealers to provide to dogs adequate housing, exercise, and veterinary care; appropriate and nutritious food; continuous access to potable water; and meaningful socialization with humans and compatible dogs for at least 30 minutes each day. The standards must also include requirements for breeders to use safe breeding practices and make all reasonable efforts to find humane placement for retired breeding dogs.

Lower Energy Costs Act This bill provides for the exploration, development, importation, and exportation of energy resources (e.g., oil, gas, and minerals). For example, it sets forth provisions to (1) expedite energy projects, (2) eliminate or reduce certain fees related to the development of federal energy resources, and (3) eliminate certain funds that provide incentives to decrease emissions of greenhouse gases. The bill expedites the development, importation, and exportation of energy resources, including by waiving environmental review requirements and other specified requirements under certain environmental laws, eliminating certain restrictions on the import and export of oil and natural gas, prohibiting the President from declaring a moratorium on the use of hydraulic fracturing (a type of process used to extract underground energy resources), directing the Department of the Interior to conduct sales for the leasing of oil and gas resources on federal lands and waters as specified by the bill, and limiting the authority of the President and executive agencies to restrict or delay the development of energy on federal land.
