Safe Step Act This bill requires a group health plan to establish an exception to medication step-therapy protocol in specified cases. A medication step-therapy protocol establishes a specific sequence in which prescription drugs are covered by a group health plan or a health insurance issuer. A request for such an exception to the protocol must be granted if (1) an otherwise required treatment has been ineffective, (2) such treatment is expected to be ineffective and delaying effective treatment would lead to irreversible consequences, (3) such treatment will cause or is likely to cause an adverse reaction to the individual, (4) such treatment is expected to prevent the individual from performing daily activities or occupational responsibilities, (5) the individual is stable based on the prescription drugs already selected, or (6) there are other circumstances as determined by the Employee Benefits Security Administration. The bill requires a group health plan to implement and make readily available a clear process for an individual to request an exception to the protocol, including required information and criteria for granting an exception. The bill further specifies timelines under which plans must respond to such requests.

Federal Firearms Licensee Protection Act of 2023 This bill modifies criminal penalties for an offense involving the theft of a firearm from a licensed importer, manufacturer, or dealer, or from their business premises. Specifically, the bill does the following: increases from 10 to 20 years the maximum prison term, and creates a 3- or 5-year mandatory minimum prison term for an offense that occurs during the commission of a burglary or robbery. An attempt to commit an offense is subject to the same penalties as a substantive offense.

Preserving Rules Ordered for The Entities Covered Through 340B Act of 2023 or the PROTECT 340B Act of 2023 This bill prohibits pharmacy benefit managers (PBMs) and health insurance plans from discriminating against health providers participating in the 340B drug pricing program, including pharmacies contracted with such providers to dispense 340B drugs. The 340B program allows certain providers to receive covered outpatient drugs at reduced prices from manufacturers. Specifically, PBMs and insurance plans may not reimburse 340B participants at a lower rate than other entities not participating in the program; impose differing terms (such as fees, charge-backs, or audits) on 340B participants; interfere with an individual's choice to receive drugs from a 340B participant; require 340B participants to identify which drugs fall within the program; or refuse to contract with a 340B participant on the basis that they utilize the program. Further, insurance plans may not deny coverage of drug because it is a 340B drug. Violations of this bill are subject to a civil penalty of not more than $5,000 per violation per day. These prohibitions also apply to prescription drug (Part D) sponsors under Medicare. The bill also provides for a process to prevent duplicate 340B drug discounts to states under Medicaid.

Veteran's Choice Accountability Act This bill requires the Department of Veterans Affairs (VA) to evaluate VA programs that furnish hospital care, medical services, and nursing home care to ensure that the most intensively used specialized care programs are maintained as centers of excellence. The bill also requires the VA to submit an evaluation of the VA's implementation of the VA Budget and Choice Improvement Act.

BAH Restoration Act This bill increases the monthly amount of the basic housing allowance for members of the uniformed services inside the United States. Specifically, the monthly amount of allowance for a member must be the amount of the monthly cost of adequate housing in the area, as determined by the Department of Defense, for members of the uniformed services serving in the same pay grade and same dependency status as the member.

Nancy Gardner Sewell Medicare Multi-Cancer Early Detection Screening Coverage Act This bill allows for Medicare coverage and payment for multi-cancer early detection screening tests that are approved by the Food and Drug Administration and that are used to screen for cancer across many cancer types, if the Centers for Medicare & Medicaid Services determines such coverage is appropriate.

This joint resolution nullifies the final rule issued by the National Marine Fisheries Service titled Endangered and Threatened Wildlife and Plants; Regulations for Listing Endangered and Threatened Species and Designating Critical Habitat and published on June 24, 2022. The 2022 rule rescinds an earlier rule which limited the ability of the service to designate an area a critical habitat . Areas designated as critical habitat are subject to certain statutory restrictions.

This joint resolution nullifies the final rule issued by the U.S. Fish and Wildlife Service titled Endangered and Threatened Wildlife and Plants; Endangered Species Status for Northern Long-Eared Bat and published on November 30, 2022. This rule reclassifies the northern long-eared bat ( Myotis septentrionalis ) from a threatened species to an endangered species under the Endangered Species Act. The rule also removes the northern long-eared bat's species-specific rule, which applied only when the bat was listed as a threatened species.

Preserving Lawful Utilization of Services for Veterans Act of 2023 or the PLUS for Veterans Act of 2023 This bill modifies provisions related to agents and attorneys who represent veterans in Department of Affairs (VA) benefit claims. The VA must determine whether to recognize an individual as an agent or attorney for purposes of VA benefit claims within 90 days of receiving an application from such an individual. If the VA cannot verify whether the agent or attorney meets its qualifications and standards before the end of the 90 days, the VA must recognize the agent or attorney. If the VA determines after the 90-day period that such an agent or attorney does not meet the VA's qualifications and standards, the VA may suspend the individual without regard to notice and hearing procedures. The VA may not refuse to recognize an agent or attorney solely because the agent or attorney charges a fee for services rendered in the preparation, presentation, or prosecution of a claim. Additionally, the bill addresses and establishes the circumstances under which fees may be charged for the preparation, presentation, or prosecution of a claim for VA benefits. Finally, the bill imposes criminal penalties on individuals for directly or indirectly soliciting, contracting for, charging, or receiving any unauthorized fee or compensation with respect to the preparation, presentation, or prosecution of any claim for VA benefits. The commission or attempted commission of such offenses is punishable by a fine, imprisonment for up to one year, or both.

Purple Heart Freedom to Work Act This bill increases the monthly income limit that is used to determine whether certain Purple Heart recipients are eligible for Social Security Disability Insurance (SSDI) benefits. Specifically, when making such determinations with respect to Purple Heart recipients who are entitled to SSDI benefits based on combat-related injuries, the Social Security Administration must use the limit that applies to individuals who are blind rather than the lower limit that applies to other SSDI recipients. In addition, the bill phases out SSDI benefits for these Purple Heart recipients, with benefits reduced by $1 for every $4 of earnings in excess of the limit.

Reforming Broadband Connectivity Act of 2023 This bill requires the Federal Communications Commission (FCC) to make changes to the financing of the Universal Service Fund. This fund, which is financed by fees contributed by telecommunications carriers, supports programs to expand the availability of and access to telecommunications services. Specifically, the bill directs the FCC to (1) study the need for expanding the fund's contribution base to ensure fairness and equity in applicable contribution requirements, and (2) reform the fund's contribution system through rulemaking. In carrying out the rulemaking, the FCC must consider the findings and recommendations of its study and the impact of changes on consumers, businesses, and seniors.

Equal Campus Access Act of 2023 This bill prohibits funding made available under the Higher Education Act of 1965 from being provided to any public institution of higher education (IHE) that denies to religious student organizations any right, benefit, or privilege that is otherwise afforded to other student organizations at the IHE because of the religious beliefs, practices, speech, leadership standards, or standards of conduct of the religious student organization.

Small Lenders Exempt from New Data and Excessive Reporting Act or the Small LENDER Act This bill exempts certain financial institutions and transactions from the Consumer Financial Protection Bureau (CFPB) reporting requirements with respect to data about small business credit applications. Under the bill, the requirements apply only to financial institutions that originate at least 500 credit transactions to small businesses in each of the preceding two years. The bill further defines small businesses as those with annual revenue of $1 million or less. Currently, the CFPB has proposed a rule that the requirements apply only to financial institutions that originate at least 25 annual credit transactions to small businesses in each of the preceding two years. The rule further defines small businesses as those with annual revenue of $5 million or less.

Bank Loan Privacy Act This bill requires the Consumer Financial Protection Bureau to issue a rule prior to deleting or modifying publicly available small business loan data due to privacy concerns. Specifically, the bureau must describe the intended modifications and deletions and explain how such modifications and deletions will advance a privacy interest.

Get Rewarding Outdoor Work for our Veterans Act or the GROW Act This bill addresses certain federal activities related to veterans who are transitioning from service to civilian life. First, the bill requires the Department of Veterans Affairs to annually report to Congress on the Warrior Training Advancement Course (WARTAC) of the Veterans Benefits Administration. The report must include specified elements, including information regarding how many members of the Armed Forces who are participating in the Transition Assistance Program have participated in WARTAC. The bill also requires the Veterans' Employment and Training Services within the Department of Labor to establish guidelines containing best practices for departments and agencies that implement programs to employ veterans who are transitioning from service. Additionally, the Department of the Interior must implement a two-year pilot program under which veterans are employed by the federal government in positions that relate to the conservation and resource management activities of Interior.

United States-Israel Future of Warfare Act of 2023 This bill requires the Department of Defense to establish the United States-Israel Future of Warfare Research and Development Fund to conduct collaborative defense projects between the United States and Israel in areas of emerging technologies (e.g., artificial intelligence). The purpose of the fund is to enable the Armed Forces of the United States and Israel to meet emerging defense challenges.

Equitable Community Access to Pharmacist Services Act This bill expands Medicare coverage to permanently include services provided by a pharmacist, including incidental services and supplies, related to testing, vaccines, and treatment for COVID-19, influenza, and certain other illnesses. Specifically, the bill provides for continued coverage of pharmacist services relating to evaluation and management of patients for testing and treatment for COVID-19, influenza, respiratory syncytial virus (RSV), or streptococcal pharyngitis (strep throat), as well as vaccines for pneumococcal disease, COVID-19, influenza, or hepatitis B. It also generally provides for coverage of pharmacist services during a public health emergency.

Quantum in Practice Act This bill includes quantum modeling and simulation within the definition of quantum information science for purposes of various federal research and development initiatives, programs, and activities. Quantum information science refers to the use of the laws of quantum physics to store, transmit, manipulate, compute, or measure information, and quantum modeling and simulation refers to the use of quantum computing hardware to determine the properties of quantum systems (e.g., the properties of materials such as high-temperature superconductors and modeling nuclear and particle physics).

This resolution supports the preservation of the stepped-up basis tax rule that allows recipients of inherited assets such as land, equipment, or buildings to adjust the cost basis of the assets to reflect their fair market value. The resolution opposes any efforts to impose new taxes on family farms or small businesses and recognizes the importance of generational transfers of farm and family-owned businesses.

Helping Ensure Life- and Limb-Saving Access to Podiatric Physicians Act or the HELLPP Act This bill adds podiatrists as covered physicians under the Medicaid program. Additionally, the bill revises certain documentation requirements related to Medicare coverage of therapeutic shoes for individuals with diabetes. Finally, the bill subjects payments made to a Medicaid provider or supplier to a continuing levy for federal taxes owed by the provider or supplier.

This joint resolution nullifies the rule issued by the Bureau of Alcohol, Tobacco, Firearms and Explosives titled Factoring Criteria for Firearms With Attached "Stabilizing Braces" and published on January 31, 2023. The rule establishes criteria for determining whether a firearm equipped with an attached stabilizing brace that facilitates shoulder fire is a rifle subject to regulation (e.g., registration) under the National Firearms Act.

Range Access Act This bill provides for the creation of new target shooting ranges on public land. Specifically, the bill directs the Department of Agriculture and the Department of the Interior to publish a list that identifies whether each National Forest and each Bureau of Land Management district has a target shooting range that meets specified requirements. The departments must identify at least one suitable location for a range in each forest or district where (1) there is not currently a range that meets requirements, and (2) establishing a range is not prevented by law or a land use plan. In at least one suitable location in each forest or district with a suitable location, the departments shall subject to the availability of appropriations, construct a range or modify an existing range; or enter into an agreement with an entity to establish or maintain a range. A range established under this bill may not require a user to pay a fee to use the range.

Protecting American Sovereignty Act This bill prohibits the federal government from implementing any obligations upon the United States that may be contained in a draft report by a World Health Organization (WHO) working group on strengthening the WHO's preparedness and response to health emergencies. This prohibition shall also apply to any related or successor reports and recommendations regarding pandemics.

Preserving Choice in Vehicle Purchases Act This bill modifies the waiver process under the Clean Air Act related to state emission control standards for new motor vehicles (or new motor vehicle engines). Under current law, states are preempted from adopting or enforcing emission control standards for new motor vehicles (or new motor vehicle engines) unless the Environmental Protection Agency (EPA) provides a waiver authorizing a state to adopt such standards if certain requirements are met. The bill provides that state standards that directly or indirectly limit the sale or use of new motor vehicles with internal combustion engines are not eligible for waivers. The bill also prohibits the EPA from determining that any state standards amended after the bill's enactment are within the scope of an existing waiver. Additionally, the bill requires the EPA to revoke waivers granted between January 1, 2022, and the date of enactment of this bill if the standards directly or indirectly limit the sale or use of new motor vehicles with internal combustion engines.

Hospital Adoption Education Act of 2023 This bill requires the Department of Health and Human Services (HHS) to develop resources to promote the understanding of adoption in the health care industry. Specifically, HHS must develop and disseminate digital resources about adoption for the health care industry, including best practices for interacting with prospective birth mothers and adoptive families. In addition, the Administration for Children and Families (ACF) must maintain resources on its website for health care workers to improve their awareness and understanding of adoption. The ACF must also provide professional development (and related consultation services) about families pursuing adoption for care providers at hospitals and birthing centers. The ACF may carry out these activities directly or through grants or contracts with education organizations that are health care-based and focused on adoption. However, the ACF may not award grants to or enter contracts with (1) agencies that place newborn children for adoption or in foster care, or (2) organizations that provide abortion services.

Expanding America's National Cemetery Act of 2023 This bill requires the Department of Veterans Affairs, before Arlington National Cemetery reaches capacity, to expand or otherwise modify an existing national cemetery to ensure that full military honors are provided in a specified manner. Specifically, the VA must expand or modify such a cemetery to ensure that full military honors are provided (1) in a manner consistent with the full military honors provided for interment in Arlington National Cemetery as of March 31, 2023; and (2) using the eligibility criteria in effect on March 31, 2023, for providing full military honors for interment in Arlington National Cemetery.

Sultana Steamboat Disaster Commemorative Coin Act of 2023 This bill directs the Department of the Treasury to mint and issue not more than 100,000 $5 gold coins, 500,000 $1 silver coins, and 750,000 half-dollar clad coins emblematic of the Sultana steamboat explosion that occured on April 27, 1865, on the Mississippi River. All surcharges received by Treasury from the sale of such coins must be paid to the Sultana Historical Preservation Society for the purpose of establishing, operating, and maintaining a museum.

Major Richard Star Act This bill provides that combat-disabled uniformed services retirees with fewer than 20 years of creditable service may concurrently receive, without reduction, veterans' disability compensation and retired pay or combat-related special compensation.

Military Spouse Hiring Act This bill expands the Work Opportunity Tax Credit (WOTC) to include the hiring of a qualified military spouse. (The WOTC permits employers who hire individuals who are members of a targeted group such as qualified veterans, ex-felons, or long-term unemployment recipients to claim a tax credit equal to a portion of the wages paid to those individuals.) A qualified military spouse is any individual who is certified by the designated local agency as being (as of the hiring date) a spouse of a member of the Armed Forces.

Taiwan Democracy Defense Lend-Lease Act of 2023 This bill authorizes the President to lend or lease defense articles to Taiwan for protection against potential Chinese military aggression and requires the President to establish expedited procedures for delivering loaned or leased defense articles to Taiwan. The bill also authorizes the President to finance Taiwan's procurement of certain services in connection with the loan or lease of a defense article, provided Taiwan repays the United States within 12 years.

This bill prohibits the Department of Defense (DOD) from providing certain funding related to abortion services. Specifically, the bill prohibits DOD from paying or reimbursing any fees or expenses for a health care professional (who provides health care at a military medical treatment facility) to gain a license in a state if the purpose of gaining the license is to provide abortion services. The bill also repeals the DOD memorandum titled Ensuring Access to Reproductive Health Care (October 20, 2022). Such memo sets forth DOD policies and procedures in response to the Supreme Court's ruling in Dobbs v. Jackson Women's Health Organization . Under the bill, DOD may not obligate or expend funds to carry out the memo or any successor memo.

Parents Bill of Rights Act This bill establishes various rights of parents and guardians regarding the elementary or secondary school education of their children. Local educational agencies (LEAs) and schools must comply with the requirements of the bill in order to receive federal education funds. Specifically, the bill requires schools to notify parents and guardians of their rights regarding the education of their children. These rights include the right to review the curriculum of their child's school; know if the state alters its challenging academic standards; meet with each teacher of their child at least twice each school year; review the budget, including all revenues and expenditures, of their child's school; review a list of the books and other reading materials in the library of their child's school; address the school board of the LEA; receive information about violent activity in their child's school; and receive information about any plans to eliminate gifted and talented programs in the child's school. Additionally, the bill directs each LEA to post on a publicly accessible website (or otherwise widely disseminate to the public) the curriculum for each elementary and secondary school grade level. The LEA must also include in its annual report card the overall budget of the LEA and the budget for each elementary and secondary school. The bill also provides for additional family educational and privacy rights, including by prohibiting schools from selling student information for commercial or financial gain.

Federal Firefighter Pay Equity Act This bill modifies certain pay calculations that are used to determine retirement and annuity benefits for federal firefighters. Specifically, the bill adjusts the method of determining the average pay of a federal firefighter by adding one-half of a firefighter's basic hourly rate multiplied by the number of overtime hours included as part of such firefighter's regular tour of duty. It also requires the Office of Personnel Management to issue regulations that cap the number of hours in a regular workweek, which may not exceed 60 hours per week.

Combating Racist Training in the Military Act of 2023 This bill prohibits the Armed Forces and academic institutions of the Department of Defense from promoting specified anti-American and racist theories (e.g., that any race is inherently superior or inferior to any other race). Specifically, the bill prohibits including anti-American and racist theories or materials in curricula, reading lists, seminars, workshops, trainings, or other educational or professional settings in a manner that could appear as sponsorship, approval, or endorsement; contracting with, hiring, or otherwise engaging speakers, consultants, diversity trainers, and other persons for the purpose of advocating anti-American and racist theories; compelling members of the Armed Forces to affirm or profess belief in anti-American and racist theories; and segregating members of the Armed Forces by race in any setting, including educational and training sessions.

Fair and Open Competition Act or the FOCA Act This bill prohibits federal construction contracts or controlling documents for federally supported construction projects from requiring or prohibiting project labor agreements. Such documents also may not discriminate against or give preference to a bidder or contractor who signs or refuses to sign a project labor agreement. An agency may exempt a project from this prohibition to avert an imminent threat to public health or safety or to serve the national security.

Expediting Israeli Aerial Refueling Act of 2023 This bill requires the Department of Defense (DOD), particularly the Department of the Air Force, to provide certain training and support to the air force of Israel. Specifically, the bill requires the U.S. Air Force to train members of the air force of Israel on (1) the operation of the KC-46 aircraft, and (2) maintenance and sustainment requirements of the KC-46 aircraft. Before completing the training required by this bill, DOD must authorize members of the air force of Israel who are associated with the operation of KC-46 aircraft to participate in the U.S. Air Force Military Personnel Exchange Program. DOD must make the program available to such members of the air force of Israel and ensure that they may participate immediately after completing training. DOD must rotationally deploy one or more KC-46 aircraft to Israel until the earlier of five years after the enactment of this bill or the date on which a KC-46 aircraft procured by the military forces of Israel is commissioned into such military forces and achieves full combat capability.

National Right-to-Work Act This bill repeals those provisions of the National Labor Relations Act and the Railway Labor Act that permit employers to make an agreement with a labor union to require employees to join such union as a condition of employment. Currently, at least 27 states have enacted laws prohibiting employers from compelling employees to become members of a union as a condition of employment.

Healthy Dog Importation Act This bill imposes requirements on the importation of live dogs. Specifically, the bill prohibits the importation of a live dog into the United States unless the Department of Agriculture (USDA) determines the dog (1) is in good health; (2) has received all necessary vaccinations, internal and external parasite treatment, and demonstrated negative test results as evidenced by a certificate from a licensed veterinarian; and (3) is officially identified by a permanent method approved by USDA. Additionally, dogs entering the United States for transfer must be at least six months of age and accompanied by a USDA permit. Transfer is defined as a change of ownership or control of an imported dog to another person, including by sale, adoption, exchange, or donation. USDA must provide an exception to any requirements under the bill for dogs that are transferred for (1) research purposes; (2) veterinary treatment under certain conditions, including appropriate quarantining; or (3) lawful importation into the state of Hawaii if the dog is not transported out of Hawaii for transfer at less than six months of age. USDA also has enforcement authority under the bill.

Governing Unaccredited Representatives Defrauding VA Benefits Act or the GUARD VA Benefits Act This bill imposes fines on individuals for soliciting, contracting for, charging, or receiving any unauthorized fee or compensation with respect to the preparation, presentation, or prosecution of any claim for Department of Veterans Affairs benefits. The attempted commission of such offenses is also punishable by fine.

Debbie Smith Act of 2023 This bill reauthorizes through FY2029 the Debbie Smith DNA Backlog Grant Program. The program provides grants to state and local governments to improve and expand the collection and analysis of DNA evidence, including evidence in sexual assault kits.
