Community Services Block Grant Reauthorization Act of 2019 This bill reauthorizes the Community Services Block Grant program through FY2028 and makes other changes to the program, including with respect to administration and leadership; performance measurement; and minimum and maximum allotments to states and territories.

Building Blocks of STEM Act This bill modifies National Science Foundation (NSF) grant programs that support STEM (science, technology, engineering, and mathematics, including computer science) education. The bill instructs the NSF, when awarding grants under the Discovery Research PreK-12 program, to improve the focus of research and development on early childhood education. The bill specifies that NSF grants to increase the participation of underrepresented populations in STEM fields may be used for research into various subjects regarding female students in prekindergarten through elementary school, including the role of teachers and caregivers in encouraging or discouraging participation by such students in STEM activities, and the types of STEM activities that encourage greater participation by such students. The bill specifies that NSF grants to research computer science education and computational thinking may be used to support development and implementation of various tools and models for teaching and learning, including developing and offering gender-inclusive computer science enrichment programs, and acquainting female students in prekindergarten through elementary school with careers in computer science.

Let Everyone Get Involved in Opportunities for National Service Act This bill authorizes The American Legion to expand membership eligibility to include veterans and service members who served during times that were not designated periods of war. Currently, only veterans and service members who served during periods of time specified by Congress are eligible to join The American Legion.

Building Success for Youth ChalleNGe Act This bill authorizes the federal government and state, tribal, county, and local governments to transfer excess equipment and facilities to the National Guard for purposes of the Youth Challenge Program, which seeks to improve life skills and employment potential of at-risk youth.

Verification Alignment and Service-disabled Business Adjustment Act or the VA-SBA Act This bill transfers responsibility for verifying that a small business concern is owned and controlled by a veteran or service-disabled veteran, for the purposes of eligibility for certain procurement programs, from the Department of Veterans Affairs (VA) to the Small Business Administration (SBA). Specifically, the bill transfers maintenance of the database of veteran-owned and service-disabled veteran-owned businesses to the SBA. For the purposes of procurement programs for small businesses owned and controlled by service-disabled veterans, the SBA must certify the status of such businesses, require their periodic recertification, and penalize any small business that misrepresents its status. Accordingly, the bill also abolishes the Center for Verification and Evaluation of the VA and transfers all of its functions to the SBA.

Secure and Fair Enforcement Banking Act of 2019 or the SAFE Banking Act of 2019 This bill generally prohibits a federal banking regulator from penalizing a depository institution for providing banking services to a legitimate marijuana-related business. Specifically, the bill prohibits a federal banking regulator from (1) terminating or limiting the deposit insurance or share insurance of a depository institution solely because the institution provides financial services to a legitimate marijuana-related business; (2) prohibiting or otherwise discouraging a depository institution from offering financial services to such a business; (3) recommending, incentivizing, or encouraging a depository institution not to offer financial services to an account holder solely because the account holder is affiliated with such a business; (4) taking any adverse or corrective supervisory action on a loan made to a person solely because the person either owns such a business or owns real estate or equipment leased or sold to such a business; or (5) penalizing a depository institution for processing or collecting payments for such a business. As specified by the bill, a depository institution shall not, under federal law, be liable or subject to forfeiture for providing a loan or other financial services to a legitimate marijuana-related business.

National Nurse Act of 2019 This bill requires the Department of Health and Human Services to designate the Chief Nurse Officer of the Public Health Service as the National Nurse for Public Health. The position includes the authority to (1) provide leadership and coordination of Public Health Service nursing professional affairs for the Office of the Surgeon General and other agencies of the Public Health Service, (2) conduct outreach and education, and (3) provide guidance and leadership for activities that will increase public safety and emergency preparedness. The National Nurse for Public Health must (1) participate in identification of national health priorities, (2) encourage volunteerism of nurses and strengthen the relationship between government agencies and health-related national organizations, and (3) promote the dissemination of evidence-based practice in educating the public on health promotion and disease prevention activities.

Removing Barriers to Colorectal Cancer Screening Act of 2019 This bill waives Medicare coinsurance requirements with respect to colorectal cancer screening tests, regardless of the code billed for a resulting diagnosis or procedure.

Equitable Nutrition Assistance for the Territories Act of 2019 This bill allows Puerto Rico, American Samoa, and the Northern Mariana Islands to participate in the Supplemental Nutrition Assistance Program (SNAP, formerly known as the food stamp program) after submitting a plan of operation that is approved by the Department of Agriculture. (Under current law, the three territories receive block grants instead of participating in SNAP.)

Long-Term Care Veterans Choice Act This bill authorizes the Department of Veterans Affairs (VA) to enter into contracts to place certain disabled veterans in medical foster homes at the request of such veterans. Specifically, the bill concerns veterans with service-connected disabilities to whom the VA is required to provide nursing home care. Medical foster homes are homes designed to provide non-institutional, long-term, supportive care for veterans who are unable to live independently and prefer a family setting. In any year, not more than a daily average of 900 veterans placed in a medical foster home may have their care covered.

Combating Illicit Fentanyl Act of 2019 This bill directs the Department of State and the Department of the Treasury to annually report to Congress identifying each person in China, including government officials, involved in fentanyl production and its trafficking into the United States.

Ending the Monopoly of Power Over Workplace harassment through Education and Reporting Act or the EMPOWER Act This bill addresses policies and procedures related to claims of workplace harassment. Specifically, the bill makes it an unlawful practice (with exceptions regarding certain settlement or separation agreements) for an employer to (1) enter into a contract with an employee or applicant, as a condition of employment, promotion, compensation, benefits, or change in employment status or contractual relationship, if that contract contains a nondisparagement or nondisclosure clause that covers workplace harassment; and (2) enforce, or attempt to enforce, a nondisparagement clause or nondisclosure clause that covers workplace harassment. Under the bill, an employee or applicant retains any right they would otherwise have had to report a concern about workplace harassment to the Equal Employment Opportunity Commission (EEOC) and other specified agencies, regardless of whether they have signed a nondisparagement or nondisclosure clause. Employees or applicants also retain the right to pursue legal action regardless of signing such clauses. The bill sets forth (1) enforcement powers of the EEOC and other entities, and the jurisdiction of U.S. courts, regarding workplace harassment; and (2) the applicable procedures and remedies for employees' claims. The EEOC must (1) establish a confidential tip-line that supplements its process for submitting a charge of discrimination, and (2) provide for the development and dissemination of workplace training programs and information regarding workplace harassment. The bill modifies the tax treatment of expenses and payments related to workplace harassment and employment discrimination.

Economic Development Act for Distressed Zones of 2019 This bill provides various tax credits related to economically distressed zones and establishes a procedure for state and local governments to apply for such zone designation. Specifically, the bill provides credits to taxpayers in an economically distressed zone based on the amount of (1) wages paid by an employer to employees, (2) depreciation and amortization allowances for business property, and (3) trade or business payments made for purchases of services or property. The bill also allows state and local governments to apply for a population census tract under their ambit to be designated as an economically distressed zone

Puerto Rico Insurance Excise Tax Exemption Act of 201 9 This bill exempts from the foreign insurer excise tax certain insurance policies, indemnity bonds, annuity contracts, or reinsurance policies issued by partnerships or corporations created or organized under the laws of a U.S. territory or possession. The exemption applies unless any of the covered hazards, risks, losses, or liabilities are also covered by a reinsurance policy issued by a foreign insurer or reinsurer other than the partnership or corporation.

Multinational Species Conservation Funds Semipostal Stamp Reauthorization Act of 2019 This bill directs the U.S. Postal Service (USPS) to sell each copy of the Multinational Species Conservation Fund Semipostal Stamp and notify Congress when all copies have been sold. If the USPS destroys one or more such stamps before this bill's enactment, it shall print and sell the same number of such stamps.

Minority Business Development Act of 2019 This bill permanently authorizes the Minority Business Development Administration to assist socially and economically disadvantaged business concerns. Specifically, the bill redesignates the Minority Business Development Agency as the Minority Business Development Administration (MBDA). The MBDA shall (1) assist disadvantaged business concerns entering domestic and foreign markets by providing education and training, management and technological assistance, a skilled labor pool, and financial and marketing services; and (2) encourage such businesses to establish joint ventures and projects among themselves or in cooperation with public or private sector organizations. In addition, the Securities and Exchange Commission must consult and cooperate with the MBDA to promote access by disadvantaged businesses to securities markets.

Hidden Figures Congressional Gold Medal Act This bill requires the Speaker of the House of Representatives and President pro tempore of the Senate to arrange for the presentation of one Congressional Gold Medal to Katherine Johnson, in recognition of her service to the United States as a mathematician; one Congressional Gold Medal to Dr. Christine Darden, for her service to the United States as an aeronautical engineer; two Congressional Gold Medals in commemoration of the lives of Dorothy Vaughan and Mary Jackson, in recognition of their service to the United States during the Space Race; and one Congressional Gold Medal in recognition of all the women who served as computers, mathematicians, and engineers at the National Advisory Committee for Aeronautics and the National Aeronautics and Space Administration (NASA) between the 1930s and the 1970s.

Puerto Rico Data Collection Equality Act This bill makes changes to the collection and publication of statistics relating to U.S. territories and regarding reports on their economies. The Interagency Council on Statistical Policy shall collect and publish statistics regarding Puerto Rico in the same manner as statistics are collected and reported by federal agencies for the states. The Bureau of the Census shall collect and report statistics regarding Puerto Rico as part of specified statistical programs and surveys. Bureau calculations of U.S. total population must include U.S. territories. The Bureau of Economic Analysis shall include U.S. territories in its quarterly calculation of real gross domestic product by state. The National Center for Education Statistics shall collect and publish data for Puerto Rico in the same manner as for the states. The National Agricultural Statistics Service shall include Puerto Rico in its surveys. The Substance Abuse and Mental Health Services Administration must report on efforts to include U.S. territories in the National Survey on Drug Use and Health. The National Center for Health Statistics must make available information regarding U.S. territories in the same manner as for the states. The Bureau of Justice Statistics must gather information from Puerto Rico. The Bureau of Labor Statistics shall calculate Puerto Rico's unemployment rate and inflation rate. The Federal Reserve Bank of New York shall annually update the Report on the Competitiveness of Puerto Rico's Economy. The Energy Information Administration shall annually (1) update the data and information included on its website regarding Puerto Rico, and (2) report on the cost and reliability of electric power in Puerto Rico and how that affects Puerto Rican economic growth.

Ensuring Lasting Smiles Act This bill requires private health insurance plans to cover diagnosis and treatment services for congenital anomalies and birth defects, such as reconstructive services and prosthetics. Coverage must include services that functionally improve, repair, or restore any body part that is medically necessary for normal bodily functions or appearance, as determined by the treating physician.

VA Health Center Management Stability and Improvement Act This bill directs the Department of Veterans Affairs (VA) to develop and implement a plan to hire a director for each VA medical center without a permanent director. Hiring priority shall be given to medical centers that have not had a permanent director for the longest periods.

Never Forget the Heroes: Permanent Authorization of the September 11th Victim Compensation Fund Act This bill funds through FY2090 the September 11th Victim Compensation Fund of 2001. Additionally, the bill modifies the Victim Compensation Fund (VCF): to allow claims to be filed until October 2089, to require VCF policies and procedures to be reassessed at least once every five years (currently, at least once annually), to require claimants to be paid for the amount by which a claim was reduced on the basis of insufficient funding, to remove the cap on noneconomic damages in certain circumstances, and to adjust the annual limit on economic loss compensation for inflation.

Territories Health Equity Act of 2019 This bill alters provisions under Medicaid, Medicare, and Medicare Advantage relating to U.S. territories, and generally modifies and establishes programs to expand health insurance coverage for residents. Among other things, the bill eliminates Medicaid funding limitations for U.S. territories beginning in FY2020; repeals provisions that exclude residents of Puerto Rico from a certain automatic enrollment process for Medicare medical services; establishes minimum criteria for certain elements used in Medicare Advantage payment calculations for areas within U.S. territories; and allows residents of U.S. territories who are unable to obtain health insurance through their employer or a health insurance exchange to instead obtain coverage through the District of Columbia exchange, including coverage that is available to Members of Congress and their staff.

This resolution expresses support for the goals and ideals of Polycystic Ovary Syndrome (PCOS) Awareness Month. PCOS is caused by a hormone imbalance. Symptoms can include infertility, weight gain, excess hair growth, and acne. It recognizes the need for further research, improved treatment and care options, and a cure for PCOS. It also acknowledges the struggles affecting all women and girls afflicted with PCOS.

LWCF Parity for Territories and DC Act This bill requires that the same apportionment formula be applied to specified U.S. territories (i.e., Puerto Rico, Guam, American Samoa, the U.S. Virgin Islands, and the Northern Mariana Islands) and the District of Columbia as is applied to states with respect to amounts made available for state purposes from the Land and Water Conservation Fund.

Federal Disaster Assistance Coordination Act This bill extends the deadline by which the Federal Emergency Management Agency (FEMA) must (1) conduct a study and develop a plan under which the collection of information from disaster assistance applicants and grantees will be made less burdensome, duplicative, and time consuming for applicants and grantees; and (2) develop a plan for the regular collection and reporting of information on federal disaster assistance awarded. Not later than two years after enactment of this bill, FEMA shall convene a working group on a regular basis to (among other things) identify (1) potential areas of duplication or fragmentation in preliminary damage assessments after disaster declarations; and (2) potential emerging technologies, such as Unmanned Aircraft Systems (i.e., drones), to expedite the administration of preliminary damage assessments. FEMA must submit a comprehensive report on the plans for streamlining and consolidating information collection and preliminary damage assessments and the findings and recommendations of the working group to Congress with a briefing. The report must be made available to the public and posted on FEMA's website.

Post-Disaster Assistance Online Accountability Act This bill establishes a centralized location to publish information on disaster assistance provided by federal agencies. The Small Business Administration, the Department of Housing and Urban Development, and any agencies providing disaster assistance must make available to the public on a quarterly basis information regarding (1) the total amount of assistance provided by the agency, (2) the amount provided that was expended or obligated, and (3) all projects or activities for which assistance was expended, obligated, or used.

Coastal and Ocean Acidification Stressors and Threats Research Act of 2019 or the COAST Research Act of 2019 This bill addresses the effects of ocean and coastal acidification on marine organisms and ecosystems. Specifically, the bill reauthorizes through FY2023 and revises the Ocean Acidification Program of the National Oceanic and Atmospheric Administration and the ocean acidification grant program of the National Science Foundation. The bill expands those programs, as well as the ocean acidification activities of the National Aeronautics and Space Administration (NASA), to include efforts to research and monitor the effects of coastal acidification.

United States Coast Guard Commemorative Coin Act of 2019 This bill directs the Department of the Treasury to mint and issue in commemoration of the U.S. Coast Guard (1) $5 gold coins, (2) $1 silver coins, and (3) half-dollar clad coins. The design of such coins shall be emblematic of the traditions, history, and heritage of the Coast Guard and its role in securing the United States since 1790. The issuance of such coins is restricted to the one-year period beginning on January 1, 2020. The bill prescribes the sale price of the coins and coin surcharges. Surcharges shall be paid by Treasury to the National Coast Guard Museum Association to help finance the design, construction, operations, and maintenance of the museum.

Protecting Older Workers Against Discrimination Act This bill amends the Age Discrimination in Employment Act of 1967 to establish an unlawful employment practice when the complaining party demonstrates that age or participation in investigations, proceedings, or litigation under such Act was a motivating factor for any unlawful employment practice, even though other factors also motivated the practice (thereby allowing what are commonly known as "mixed motive" claims). The bill (1) permits a complaining party to rely on any type or form of admissible evidence, which need only be sufficient for a reasonable trier of fact to find that an unlawful practice occurred; and (2) declares that a complaining party shall not be required to demonstrate that age or retaliation was the sole cause of the employment practice (thereby rejecting the Supreme Court's decision in Gross v. FBL Financial Services, Inc. , which requires a complainant to prove that age was the "but-for" cause for the employer's decision). The bill authorizes a court in a claim in which age discrimination is shown to grant declaratory and injunctive relief, but prohibits a court from awarding damages or issuing an order requiring any admission, reinstatement, hiring, promotion, or payment. The bill applies the same standard of proof to other employment discrimination and retaliation claims, including claims under the Civil Rights Act of 1964, the Americans With Disabilities Act of 1990, and the Rehabilitation Act of 1973.

Restore Our Parks and Public Lands Act This bill establishes the National Park Service and Public Lands Legacy Restoration Fund into which, through FY2024, there shall be deposited an amount equal to 50% of all energy development revenues due to the federal government from oil, gas, coal, or alternative or renewable energy development on federal lands and waters. Deposited amounts must not exceed $1.3 billion for any fiscal year. From such amounts 80% shall be allocated to the National Park Service for high-priority deferred maintenance projects, ensuring parity between transportation and nontransportation projects; 10% shall be for the national wildlife refuge system maintenance backlog; 5% shall be for the public access and recreation backlog on public lands; and 5% shall be for school construction and deferred maintenance backlogs. The Department of the Interior must submit to Congress, with the President's annual budget submission, a list of projects receiving allocations from the fund and a description of each such project. Interior, and other specified agencies, may accept cash or in-kind donations that advance efforts to reduce maintenance backlogs and encourage public-private partnerships.

This bill establishes that a U.S. national who otherwise qualifies may become a citizen upon establishing residence and physical presence in a U.S. outlying possession (i.e. America Samoa and Swains Island). Currently, U.S. nationals must become a resident of a state to qualify for naturalization. Individuals born in an outlying possession are U.S. nationals but do not automatically acquire citizenship through birth in an outlying possession. The bill also waives certain naturalization requirements, including those related to English language proficiency and participation in a public ceremony, for individuals who have continuously resided in an outlying possession or state from birth to the approval of a naturalization application. The Department of Interior may issue a grant to America Samoa for holding a referendum on whether those born or residing in America Samoa should be declared U.S. citizens.

Jobs for Veterans Act of 2019 This bill allows an increased work opportunity tax credit for employers who hire veterans who have been certified as discharged or released from active duty in the Armed Forces after September 11, 2001, and who begin working for the employer after December 31, 2019, and before January 1, 2024. This increased credit is in addition to any work opportunity tax credit allowed to a veteran with a service-connected disability.

Law Enforcement Officers Equity Act This bill expands the definition of law enforcement officer under provisions of the Federal Employees Retirement System (FERS) and the Civil Service Retirement System (CSRS) to include (1) federal employees whose duties encompass the investigation or apprehension of suspected or convicted criminals and who are authorized to carry a firearm; (2) Internal Revenue Service employees whose duties are primarily the collection of delinquent taxes and the securing of delinquent returns; (3) U.S. Postal Inspection Service employees; (4) Department of Veterans Affairs police officers; and (5) certain U.S. Customs and Border Protection employees who are seized-property specialists with duties relating to custody, management, and disposition of seized and forfeited property. The bill deems service performed by an incumbent law enforcement officer on or after the enactment date of this bill to be service performed as a law enforcement officer for retirement purposes. The past service of such incumbents shall be treated as service performed by a law enforcement officer for retirement purposes only if a written election is submitted to the Office of Personnel Management within five years after the enactment of this bill or before separation from government service, whichever is earlier. An incumbent who makes an election before the enactment of this bill may pay a deposit into the Civil Service Retirement and Disability Fund to cover prior service. A law enforcement officer shall not be subject to mandatory separation during the three-year period beginning on the enactment of this bill.

Craft Beverage Modernization and Tax Reform Act of 2019 This bill modifies the tax treatment of certain alcoholic beverages to exclude the aging period from the production period for beer, wine, or distilled spirits for purposes of determining whether a taxpayer can expense, rather than capitalize, interest costs paid or incurred during the production period; reduce excise tax rates on beer and distilled spirits; permit the transfer of beer between bonded facilities without payment of tax; increase the amount of the small wine producer tax credit and expand the categories of producers covered by such credit; allow an adjustment to the producer credit for hard cider; and modify the alcohol content limitations that apply to certain wines for tax purposes. The Department of the Treasury must amend applicable regulations with respect to the use of wholesome products suitable for human consumption in the production of fermented beverages. The bill also increases funding for the Alcohol and Tobacco Tax and Trade Bureau.

Aviation Funding Stability Act of 2019 This bill provides continuing appropriations to the Federal Aviation Administration (FAA) from the Airport and Airway Trust Fund if an appropriations bill for the FAA has not been enacted before a fiscal year begins or a joint resolution making continuing appropriations for the FAA is not in effect. The bill provides appropriations at the rate of operations that was provided for the prior fiscal year to continue programs, projects, and activities for which funds were provided in the preceding fiscal year.

Fairness for High-Skilled Immigrants Act of 2019 This bill increases the per-country cap on family-based immigrant visas from 7% of the total number of such visas available that year to 15%, and eliminates the 7% cap for employment-based immigrant visas. It also removes an offset that reduced the number of visas for individuals from China. The bill also establishes transition rules for employment-based visas from FY2020-FY2022, by reserving a percentage of EB-2 (workers with advanced degrees or exceptional ability), EB-3 (skilled and other workers), and EB-5 (investors) visas for individuals not from the two countries with the largest number of recipients of such visas. Of the unreserved visas, not more than 85% shall be allotted to immigrants from any single country.

Autism Collaboration, Accountability, Research, Education, and Support Act of 2019 or the Autism CARES Act of 2019 This bill reauthorizes through FY2024 and revises several programs and activities relating to autism spectrum disorder (ASD). Among other things, the bill reauthorizes provisions relating to (1) expanded ASD research at the National Institutes of Health; (2) ASD education, early detection, and intervention activities supported by the Health Resources and Services Administration; and (3) the Interagency Autism Coordinating Committee. The bill also generally revises the scope of such programs and activities to encompass ASD individuals of all ages, rather than only youth.

Employer Participation in Repayment Act of 2019 This bill expands the tax exclusion for employer-provided educational assistance to include payments of qualified education loans by an employer to either an employee or a lender.

Offshore Wind for Territories Act This bill addresses offshore wind development and coral reef conservation. The Department of the Interior may conduct wind and mineral development lease sales on the Outer Continental Shelf in the U.S. Exclusive Economic Zone adjacent to U.S. territories. The bill establishes the Coral Reef Conservation Fund for the Department of Commerce to carry out the Coral Reef Conservation Act of 2000, including to preserve, sustain, and restore the condition of coral reef ecosystems. The bill also specifies requirements for distributing revenues from the leases authorized by this bill to the Treasury, the Coral Reef Conservation Fund, and U.S. territories.

National Estuaries and Acidification Research Act of 2019 or the NEAR Act of 2019 This bill directs the Department of Commerce to arrange with the Ocean Studies Board of the National Academies for the board to conduct a study that: examines the existing science of ocean acidification in estuarine environments, examines the challenges to studying ocean acidification and acidification's interactions with other environment stressors in estuarine environments, provides recommendations for improving future research with respect to ocean acidification in estuarine environments, and identifies pathways for applying science in management and mitigation decisions related to ocean acidification in those environments.

Full Military Honors Act of 2019 This bill requires full military honors to be provided for the funerals of certain veterans. Specifically, a veteran shall receive full military honors if the veteran (1) is first interred or inurned in Arlington National Cemetery, (2) was awarded the medal of honor or the prisoner-of-war medal, and (3) is not entitled to full military honors because of such veteran's grade.

Born-Alive Abortion Survivors Protection Act This bill establishes requirements for the degree of care a health care practitioner must exercise in the event a child is born alive following an abortion or attempted abortion. A health care practitioner who is present must (1) exercise the same degree of care as reasonably provided to another child born alive at the same gestational age, and (2) immediately admit the child to a hospital. The bill also requires a health care practitioner or other employee to immediately report any failure to comply with this requirement to law enforcement. A person who violates the requirements is subject to criminal penalties—a fine, up to five years in prison, or both. Additionally, an individual who intentionally kills or attempts to kill a child born alive is subject to prosecution for murder. The bill bars the criminal prosecution of a mother of a child born alive for conspiracy to violate these provisions, for being an accessory after the fact, or for concealment of felony. A woman who undergoes an abortion or attempted abortion may file a civil action for damages against an individual who violates this bill.
