Verification Alignment and Service-disabled Business Adjustment Act or the VA-SBA Act This bill transfers responsibility for verifying that a small business concern is owned and controlled by a veteran or service-disabled veteran, for the purposes of eligibility for certain procurement programs, from the Department of Veterans Affairs (VA) to the Small Business Administration (SBA). Specifically, the bill transfers maintenance of the database of veteran-owned and service-disabled veteran-owned businesses to the SBA. For the purposes of procurement programs for small businesses owned and controlled by service-disabled veterans, the SBA must certify the status of such businesses, require their periodic recertification, and penalize any small business that misrepresents its status. Accordingly, the bill also abolishes the Center for Verification and Evaluation of the VA and transfers all of its functions to the SBA.

Secure and Fair Enforcement Banking Act of 2019 or the SAFE Banking Act of 2019 This bill generally prohibits a federal banking regulator from penalizing a depository institution for providing banking services to a legitimate marijuana-related business. Specifically, the bill prohibits a federal banking regulator from (1) terminating or limiting the deposit insurance or share insurance of a depository institution solely because the institution provides financial services to a legitimate marijuana-related business; (2) prohibiting or otherwise discouraging a depository institution from offering financial services to such a business; (3) recommending, incentivizing, or encouraging a depository institution not to offer financial services to an account holder solely because the account holder is affiliated with such a business; (4) taking any adverse or corrective supervisory action on a loan made to a person solely because the person either owns such a business or owns real estate or equipment leased or sold to such a business; or (5) penalizing a depository institution for processing or collecting payments for such a business. As specified by the bill, a depository institution shall not, under federal law, be liable or subject to forfeiture for providing a loan or other financial services to a legitimate marijuana-related business.

Education Savings Accounts for Military Families Act of 2019 This bill directs the Department of Education (ED) to establish a program to provide children with parents on active duty in the uniformed services with funds to pay educational expenses. Specifically, ED shall establish a tax-exempt Military Education Savings Account for dependent children of parents in the uniformed services for the payment of the children's educational expenses. Funds in the savings account may be used for, among other things, the cost of attendance at a private elementary or secondary school or institution of higher education, private tutoring, or costs associated with an apprenticeship or other vocational training program.

This bill modifies the requirements for determining the unrelated business taxable income of tax-exempt organizations. The bill repeals a provision that requires unrelated business taxable income to be increased by the amount of expenses paid or incurred by a tax-exempt organization for certain fringe benefits for which a tax deduction is not allowed, including benefits relating to transportation, parking, or an on-premises athletic facility.

Fallen Warrior Battlefield Cross Memorial Act This bill provides that the Department of Veterans Affairs authorizes the display of a Fallen Soldier Display in any national cemetery. A Fallen Soldier Display is a memorial monument in honor of deceased members of the Armed Forces.

Education Freedom Scholarships and Opportunity Act This bill allows individual and corporate taxpayers a tax credit for cash contributions to tax-exempt scholarship-granting organizations for elementary and secondary education expenses. It imposes a cap of $5 billion on the amount of contributions that qualify for a tax credit. The bill directs the Department of Education, in coordination with the Department of the Treasury, to establish, host, and maintain a web portal that (1) lists all eligible scholarship-granting organizations; (2) enables contributions to such organizations; (3) provides information about the benefits of this bill; and (4) enables a state to submit and update information about its programs and scholarship-granting organizations, including information on student eligibility and allowable educational expenses.

This resolution calls upon the governments of Bangladesh and Pakistan to stop Jamaat-e-Islami (an Islamist political party) from threatening regional stability and urges U.S. agencies to end partnerships with groups affiliated with Jamaat-e-Islami . Additionally, this resolution presses law enforcement to investigate the reported collaboration between the Hand for Relief and Development (a charitable organization) and a Pakistani terrorist organization.

ALS Disability Insurance Access Act of 2019 This bill eliminates the five-month waiting period for disability benefits under the Old Age, Survivors, and Disability Insurance program for individuals with amyotrophic lateral sclerosis (a progressive neurodegenerative disease, also known as Lou Gehrig's disease, that affects nerve cells in the brain and spinal cord). Under current law, individuals must wait five months after becoming disabled before their disability insurance benefit payments may begin.

Ensuring Lasting Smiles Act This bill requires private health insurance plans to cover diagnosis and treatment services for congenital anomalies and birth defects, such as reconstructive services and prosthetics. Coverage must include services that functionally improve, repair, or restore any body part that is medically necessary for normal bodily functions or appearance, as determined by the treating physician.

History and Tradition Protection Act of 2019 This bill limits the remedies available for certain civil actions involving the deprivation of rights under color of law. Specifically, remedies will be limited to injunctive and declaratory relief for claims where the deprivation of rights consists of violation of a prohibition in the Constitution against the establishment of religion. Additionally, no attorney's fees shall be awarded in proceedings in vindication of civil rights with respect to such a claim concerning the actions of states and localities. With regard to a claim brought against the United States or a federal official acting in his or her official capacity, the bill prohibits the award of reasonable fees and expenses of attorneys to the prevailing party.

Nursing Home Workforce Quality Act This bill repeals certain restrictions under Medicare and Medicaid that prohibit the approval of nurse-aide training and competency evaluation programs in skilled nursing facilities that have been subject to specified regulatory actions (e.g., civil penalties) for substandard quality of care. The Centers for Medicare & Medicaid Services (CMS) may still disapprove such programs; however, the CMS must rescind the disapproval upon completion of corrective action.

Due Process Restoration Act of 2019 This bill specifies that a person against whom the Securities and Exchange Commission (SEC) brings an administrative proceeding may compel the SEC to terminate the proceeding. The SEC may then bring a civil action against that person.

VA Website Accessibility Act of 2019 This bill directs the Department of Veterans Affairs (VA) to report to Congress regarding the accessibility of VA websites (including attached files and web-based applications) to individuals with disabilities. The report shall identify websites, files, and applications that are not accessible to such individuals and include the VA's plan to make each of them accessible.

Graduate Student Savings Act of 201 9 This bill allows funds paid to an individual to aid in the pursuit of graduate or postdoctoral study or research to be saved in an Individual Retirement Account (IRA). The bill permits the funds to be considered compensation for purposes of current law provisions that limit annual deductible IRA contributions to the lesser of (1) the deductible amount permitted under current law, or (2) the compensation includible in the individual's gross income for the year.

Craft Beverage Modernization and Tax Reform Act of 2019 This bill modifies the tax treatment of certain alcoholic beverages to exclude the aging period from the production period for beer, wine, or distilled spirits for purposes of determining whether a taxpayer can expense, rather than capitalize, interest costs paid or incurred during the production period; reduce excise tax rates on beer and distilled spirits; permit the transfer of beer between bonded facilities without payment of tax; increase the amount of the small wine producer tax credit and expand the categories of producers covered by such credit; allow an adjustment to the producer credit for hard cider; and modify the alcohol content limitations that apply to certain wines for tax purposes. The Department of the Treasury must amend applicable regulations with respect to the use of wholesome products suitable for human consumption in the production of fermented beverages. The bill also increases funding for the Alcohol and Tobacco Tax and Trade Bureau.

Student Loan Disclosure Modernization Act This bill requires loan disclosure forms for federal student loans to be written in plain language, thus enabling borrowers to understand loan terms, total costs of loans, and estimated monthly repayments. Borrowers must acknowledge in writing that they have read the form before the loans are issued.

Fairness for High-Skilled Immigrants Act of 2019 This bill increases the per-country cap on family-based immigrant visas from 7% of the total number of such visas available that year to 15%, and eliminates the 7% cap for employment-based immigrant visas. It also removes an offset that reduced the number of visas for individuals from China. The bill also establishes transition rules for employment-based visas from FY2020-FY2022, by reserving a percentage of EB-2 (workers with advanced degrees or exceptional ability), EB-3 (skilled and other workers), and EB-5 (investors) visas for individuals not from the two countries with the largest number of recipients of such visas. Of the unreserved visas, not more than 85% shall be allotted to immigrants from any single country.

SFC Sean Cooley and SPC Christopher Horton Congressional Gold Star Family Fellowship Program Act This resolution establishes in the House of Representatives the Congressional Gold Star Family Fellowship Program under which certain family members of a member of the Armed Forces who is a hostile casualty or died from a training-related injury may serve a 12-month fellowship in the office of a Member of the House.

Full Military Honors Act of 2019 This bill requires full military honors to be provided for the funerals of certain veterans. Specifically, a veteran shall receive full military honors if the veteran (1) is first interred or inurned in Arlington National Cemetery, (2) was awarded the medal of honor or the prisoner-of-war medal, and (3) is not entitled to full military honors because of such veteran's grade.

Born-Alive Abortion Survivors Protection Act This bill establishes requirements for the degree of care a health care practitioner must exercise in the event a child is born alive following an abortion or attempted abortion. A health care practitioner who is present must (1) exercise the same degree of care as reasonably provided to another child born alive at the same gestational age, and (2) immediately admit the child to a hospital. The bill also requires a health care practitioner or other employee to immediately report any failure to comply with this requirement to law enforcement. A person who violates the requirements is subject to criminal penalties—a fine, up to five years in prison, or both. Additionally, an individual who intentionally kills or attempts to kill a child born alive is subject to prosecution for murder. The bill bars the criminal prosecution of a mother of a child born alive for conspiracy to violate these provisions, for being an accessory after the fact, or for concealment of felony. A woman who undergoes an abortion or attempted abortion may file a civil action for damages against an individual who violates this bill.

Saving Children Act This bill establishes a new criminal offense that prohibits a physician from knowingly performing a dismemberment abortion. It provides a definition of the term "dismemberment abortion." A physician who performs a dismemberment abortion is subject to a criminal fine, up to two years in prison, or both, unless the dismemberment abortion was necessary to save the mother's life. A woman or a parent of a minor who undergoes a dismemberment abortion may file a civil action for damages against an individual who violates this bill. The legislation bars the criminal prosecution of a woman who undergoes a dismemberment abortion for conspiracy to violate the provisions of this bill, for being a principal or an accessory after the fact, or for concealing a dismemberment abortion.

Free Speech Fairness Act This bill permits a tax-exempt organization to make certain statements related to a political campaign without losing its tax-exempt status. An organization may not lose its tax-exempt status under section 501(c)(3) of the Internal Revenue Code or be deemed to have participated in, or intervened in any political campaign on behalf of (or in opposition to) any candidate for public office, solely because of the content of any statement that (1) is made in the ordinary course of the organization's regular and customary activities in carrying out its exempt purpose, and (2) results in the organization incurring not more than de minimis incremental expenses.

Never Again Education Act This bill creates the Holocaust Education Assistance Program Fund for the Department of Education (ED) to (1) award grants to eligible entities to carry out Holocaust education programs, and (2) conduct periodic regional workshops to provide teachers with technical assistance on how to incorporate Holocaust education within state and local education standards. The fund may accept donations and in-kind contributions. ED shall (1) create and maintain a Holocaust education program website containing resources for middle grades and high schools; and (2) establish the Holocaust Education Advisory Board to advise on developing application criteria for the fund's grants, to advise on content for the Holocaust education program website, and to lead efforts to solicit donations for the fund.

Increasing Veteran Access to Colorectal Cancer Screening Act of 2019 This bill directs the Department of Veterans Affairs to ensure that the colorectal cancer screening guidelines used in medical facilities at which veterans receive hospital care or medical services include the strategies for screenings included in both the latest recommendations of the U.S. Preventive Services Task Force and the Healthcare Effectiveness Data and Information Set issued by the National Committee for Quality Assurance.

Bicameral Congressional Trade Authority Act of 2019 This bill requires congressional approval for a presidential import adjustment due to a national security threat from an import related to military equipment, energy resources, or critical infrastructure essential to national security. Specifically, the bill requires the President to submit a proposal to Congress, which Congress may approve by a joint resolution. Under current law, the President determines whether any adjustment of an import is necessary and must submit to Congress the reasons for any action taken or not taken. The Department of Defense (currently, the Department of Commerce) must investigate the effect of these imports on national security. The bill retroactively applies to any proposed action made four years before enactment of this bill. In general, any rate of duty modification occurring in the time period beginning four years before and ending the day before enactment of this bill must revert to the previous rate unless it receives congressional approval.

Merrill's Marauders Congressional Gold Medal Act This bill directs Congress to award a Congressional Gold Medal to the 5307th Composite Unit (Provisional), commonly known as Merrill's Marauders, in recognition of their bravery and outstanding service in the jungles of Burma (Myanmar) during World War II. Following its award, the gold medal shall be given to the Smithsonian Institution where it shall be displayed and made available for research.

Child Welfare Provider Inclusion Act of 2019 This bill prohibits discrimination or adverse action against a child welfare provider that declines to provide services due to the provider's sincerely held religious beliefs or moral convictions. The prohibition applies to the federal government and any state, tribal, or local government that receives federal funding for child and family services or foster care and adoption assistance. However, government entities may still take adverse action against a provider that denies adoption or foster care placement based on the prospective parent or child's race, color, or national origin. If a state, tribal, or local entity engages in such prohibited actions, the Department of Health and Human Services shall withhold 15% of the federal funds the entity would have received to provide child and family services or foster care and adoption. The bill also provides a private right of action for child welfare providers to sue the government entity for such discrimination, and a prevailing provider shall be entitled to recover reasonable attorney's fees and costs. A government entity that accepts federal funding for child and family services or foster care and adoption assistance shall have waived sovereign entity as a defense to such discrimination allegations.

Women's Public Health and Safety Act This bill allows a state to exclude from participation in the state's Medicaid program a provider that performs an abortion, unless (1) the pregnancy is the result of rape or incest, or (2) the woman suffers from a physical issue that would place her in danger of death unless an abortion is performed. (Under current law, a state plan for medical assistance must provide that any individual eligible for medical assistance may obtain required services from any provider qualified to perform them.)

Constitutional Amendment This joint resolution proposes a constitutional amendment stating that the liberty of parents to direct the upbringing, education, and care of their children is a fundamental right; the parental right to direct education includes the right to choose, as an alternative to public education, private, religious, or home schools, and the right to make reasonable choices within public schools for one's child; neither the United States nor any state shall infringe upon these rights without demonstrating that its governmental interest as applied to the person is of the highest order and not otherwise served; the parental rights guaranteed by this amendment shall not be denied or abridged on account of disability; and this amendment shall not be construed to apply to a parental action or decision that would end life.

Threat Assessment, Prevention, and Safety Act of 2019 This bill directs the Department of Homeland Security (DHS) to establish a Joint Behavioral Threat Assessment and Management Task Force, which shall provide recommendations to Congress and DHS on the development and implementation of a national strategy for preventing targeted violence through behavioral threat assessment and management. The bill defines behavioral threat assessment and management as the systematic and evidence-based process of (1) identifying individuals whose behavior indicates a capacity for committing acts of violence, (2) investigating and gathering information from multiple sources to assess whether such individuals pose a threat, and (3) the subsequent management of such a threat. DHS shall (1) develop and implement the national strategy and provide information and training services related to it, and (2) award grants to establish community based units for implementing the national strategy.

Protecting Life and Taxpayers Act of 2019 This bill requires federally funded entities to certify that they will not perform, and will not provide funds to any other entity that performs, an abortion, except in cases of rape or incest or where a physical condition endangers the woman's life unless an abortion is performed.

Middle Class Health Benefits Tax Repeal Act of 201 9 This bill repeals the excise tax on employer-sponsored health care coverage for which there is an excess benefit (high-cost plans). The repeal applies to taxable years beginning after December 31, 2019.

Pain-Capable Unborn Child Protection Act This bill establishes a new criminal offense for performing or attempting to perform an abortion if the probable post-fertilization age of the fetus is 20 weeks or more. A violator is subject to criminal penalties—a fine, a prison term of up to five years, or both. The bill provides exceptions for an abortion (1) that is necessary to save the life of the pregnant woman, or (2) when the pregnancy is the result of rape or incest. A physician who performs or attempts to perform an abortion under an exception must comply with specified requirements. A woman who undergoes a prohibited abortion may not be prosecuted for violating or conspiring to violate the provisions of this bill.

SOAR Reauthorization Act of 2019 This bill reauthorizes through FY2024 and amends the Scholarships for Opportunity and Results (SOAR) Program, which provides education funding for the District of Columbia, including for private school vouchers, public schools, and public charter schools. The bill requires participating private schools to be fully accredited by (1) an accrediting body with jurisdiction in the District that is recognized by the Student and Visitor Exchange English Language Program administered by U.S. Immigration and Customs Enforcement, or (2) any international accrediting body designated by the Department of Education (ED). The bill revises the manner in which tutoring services provided under the program are funded. The bill revises several requirements concerning SOAR evaluations, including concerning (1) frequency; (2) ED's and the Institute of Education Sciences' duties; and (3) the issues to be evaluated, including high school and college performance measurements.

Global Trade Accountability Act of 2019 This bill requires congressional approval of unilateral trade actions. Such actions may take effect without congressional approval for one 90-day period if the President determines that it is necessary because of a national emergency, because of an imminent threat to health or safety, for the enforcement of criminal laws, or for national security; and submits written notice of the determination to Congress.

Department of Veterans Affairs Oversight Enhancement Act of 2019 This bill requires the Department of Veterans Affairs (VA) to report biennially on corrective measures taken to address concerns identified on the high risk list published by the Government Accountability Office (GAO). The high risk list is a list of programs that are vulnerable to fraud, waste, abuse, and mismanagement or that need transformation. The VA is also required to report annually on the implementation of recommendations from the GAO.

Taxpayer Conscience Protection Act of 2019 This bill establishes reporting requirements for states regarding certain Medicaid payments to abortion providers. Specifically, the bill requires states that make Medicaid payments using federal funds for any items or services furnished by an abortion provider to annually (1) submit a report to the Centers for Medicare & Medicaid Services on all such payments, and (2) publish the report on the state's website. The report must include specified information, including the number of abortions performed by the providers and the gestational age with respect to each such abortion.

Protecting the Dignity of Unborn Children Act of 2019 This bill establishes a new criminal offense for recklessly disposing of or abandoning fetal remains in a landfill or in any navigable waters of the United States. The term "fetal remains" means any part (except a cremated part) of a deceased human fetus following an abortion. A violator is subject to a fine, up to three years in prison, or both.

Burn Pits Accountability Act This bill requires the Department of Defense (DOD) and the military departments to evaluate whether each member of the Armed Forces has been (1) based or stationed where an open air burn pit was used to dispose of waste, or (2) exposed to toxic airborne chemicals. Members located where an open burn pit was used or exposed to toxic airborne chemicals must be enrolled in the Airborne Hazards and Open Burn Pit Registry, unless the member elects not to enroll. The evaluations must be included in periodic health assessments, physical exams conducted immediately prior to separation from active duty, and deployment assessments. DOD must share the results of the evaluations with the Department of Veterans Affairs.
