This joint resolution nullifies the final rule issued by the National Labor Relations Board titled Standard for Determining Joint Employer Status and published on October 27, 2023. The rule establishes a new joint employer standard for determining whether two employers simultaneously employ a particular employee or employees. Under the rule, an entity may be considered a joint employer of another employer's employees if the two share or codetermine the employees' essential terms and conditions of employment. The rule is currently scheduled to take effect on February 26, 2024.

End Iranian Terrorism Act of 2023 This bill requires the President to identify and impose sanctions on each foreign entity, including Chinese entities, determined to meet criteria for sanctions under certain current laws and executive orders. The Department of State must submit a strategy and provide a briefing to Congress on the role of China in evasion of sanctions with respect to Iranian-origin petroleum products.

This resolution recognizes that the economic relationship between the United States and Israel is strong and has benefitted both countries and the peoples of both countries. It also expresses support for the people of Israel and the economy of Israel in the face of Hamas' attacks against Israel. Additionally, the resolution affirms that (1) the United States-Israel Free Trade Agreement set the stage for robust growth in trade and investment between the United States and Israel, and (2) the agreement can serve as a tool for supporting the economy of Israel during the conflict with Hamas.

Southern Border Transparency Act of 2023 This bill requires various reports on immigration, particularly regarding individuals paroled into the United States. The U.S. Customs and Border Protection must monthly publish details on non-U.S. nationals ( aliens under federal law) paroled into the United States at ports of entry or individuals encountered between land ports of entry and subsequently granted parole. The report must include details regarding citizenship, nationality, and demographic information. U.S. Citizenship and Immigration Services must quarterly publish the number of humanitarian parole petitions received and the number of those granted, disaggregated by nationality. Quarterly, the Department of Homeland Security (DHS) must report on individuals encountered or apprehended at the southern U.S. border and within nearby patrol sectors. The report must contain information including citizenship, nationality, demographics, the number receiving fear of persecution screenings, and immigration outcomes. DHS must also annually report on individuals paroled into the United States on humanitarian grounds, including demographics, employment authorizations, and current immigration status.

Antisemitism Awareness Act of 2023 This bill provides statutory authority for the requirement that the Department of Education’s Office for Civil Rights take into consideration the International Holocaust Remembrance Alliance's (IHRA's) working definition of antisemitism when reviewing or investigating complaints of discrimination based on race, color, or national origin in programs or activities that receive federal financial assistance. According to the IHRA's working definition, antisemitism is a certain perception of Jews, which may be expressed as hatred toward Jews.

Federal Reserve Loss Transparency Act This bill prohibits transfers to the Consumer Financial Protection Bureau from the Board of Governors of the Federal Reserve System if Federal Reserve banks incur specified quarterly operating losses. The bureau is directly funded through transfers from the board.

This resolution states that the Senate stands with Israel as it defends itself, reaffirms Israel's right to self-defense, and calls on all countries to unequivocally condemn Hamas' war on Israel. The resolution also reaffirms the United States' commitment to Israel's security, supports emergency resupply and certain other types of assistance to Israel, and calls on the United States to lead an international effort to deprive Hamas of Iranian and other sources of funding and lethal assistance. Furthermore, the resolution states that it may not be construed as a declaration of war or an authorization for the use of military force.

Protect Our Bases Act of 2023 This bill revises the authority of the Committee on Foreign Investment in the United States (CFIUS) to review the national security implications of foreign real estate transactions. Specifically, the bill allows CFIUS to prescribe regulations for treating facilities and properties of the intelligence community and national laboratories as sensitive sites for national security purposes. Additionally, CFIUS must annually submit a classified report to Congress on the activities of CFIUS relating to federal facilities and property that are determined to be sensitive for national security purposes. The bill also requires each member of CFIUS (i.e., each federal agency that is a member of CFIUS, such as the Department of Defense and the Department of Energy) to annually review the list of military installations and other U.S. government sites that are sensitive for national security purposes. (This list in the Code of Federal Regulations identifies the military installations around which certain real estate transactions are covered under the jurisdiction of CFIUS.) CFIUS must then submit an annual report to Congress certifying the completion of such review and information related to the list's accuracy.

Stop Anti-Semitism on College Campuses Act This bill prohibits an institution of higher education (IHE) that participates in federal student aid programs from authorizing, facilitating, providing funding for, or otherwise supporting any event that promotes anti-Semitism on the IHE's campus.

Preventing Underhanded and Nefarious Iranian Supported Homicides Act of 2023 or the PUNISH Act of 2023 This bill extends sanctions and national emergencies related to Iran established by specified executive orders and limits the authority of the President to waive sanctions related to Iran. The bill requires the Department of State to periodically report whether Iran or any foreign person has supported specified activities, including murder or politically motivated detention in Iran of a U.S. citizen.

Define the Mission Act This bill requires the President to submit to Congress a comprehensive strategy for U.S. involvement in Ukraine. The report must define U.S. national interests at stake in the Russia-Ukraine conflict and identify specific objectives the President believes must be achieved to protect such national interests. The strategy must be designed to achieve a cease-fire between Russia and Ukraine and must not be contingent on U.S. funding of Ukrainian reconstruction.

Science and Technology Agreement Enhanced Congressional Notification Act of 2023 This bill requires the Department of State to notify Congress regarding science and technology agreements with China. Any existing agreement is revoked unless the State Department notifies Congress regarding the agreement no later than 60 days after enactment of this bill. The State Department must notify Congress 30 days prior to entering, renewing, or extending any science and technology agreement with China. A notification shall contain (1) the full text of the agreement, (2) a written justification for the agreement, (3) an assessment of the risks and potential effects of the agreement, (4) and a detailed justification for how the State Department intends to address human rights concerns arising from the agreement's scientific and technology collaboration.

Secure the Border Act of 2023 This bill addresses issues regarding immigration and border security, including by imposing limits to asylum eligibility. For example, the bill requires the Department of Homeland Security (DHS) to resume activities to construct a wall along the U.S.-Mexico border; provides statutory authorization for Operation Stonegarden, which provides grants to law enforcement agencies for certain border security operations; prohibits DHS from processing the entry of non-U.S. nationals ( aliens under federal law) arriving between ports of entry; limits asylum eligibility to non-U.S. nationals who arrive in the United States at a port of entry; authorizes the removal of a non-U.S. national to a country other than that individual's country of nationality or last lawful habitual residence, whereas currently this type of removal may only be to a country that has an agreement with the United States for such removal; expands the types of crimes that may make an individual ineligible for asylum, such as a conviction for driving while intoxicated causing another person's serious bodily injury or death; authorizes DHS to suspend the introduction of certain non-U.S. nationals at an international border if DHS determines that the suspension is necessary to achieve operational control of that border; prohibits states from imposing licensing requirements on immigration detention facilities used to detain minors; authorizes immigration officers to permit an unaccompanied alien child to withdraw their application for admission into the United States even if the child is unable to make an independent decision to withdraw the application; imposes additional penalties for overstaying a visa; and requires DHS to create an electronic employment eligibility confirmation system modeled after the E-Verify system and requires all employers to use the system.

Allowing for Recreational Resources for Outdoor Wellness Act or the ARROW Act This bill authorizes the use of federal elementary and secondary education funds to purchase or use dangerous weapons for sports clubs, teams, training, or related activities provided for students. Current law prohibits the use of these funds to provide any person with a dangerous weapon or training in the use of a dangerous weapon. The bill specifies that this prohibition shall not apply to the use of these funds for sports clubs, teams, training, or related activities provided for students.

This resolution designates August 2023 as National Catfish Month. It also recognizes (1) the contributions of all workers, past and present, that produce, process, and provide catfish for the people of the United States; and (2) that purchasing U.S. farm-raised catfish supports farmers, jobs, and the U.S. economy.

This joint resolution nullifies the policy update issued by the Food and Nutrition Service (FNS) on May 5, 2022, related to discrimination on the basis of gender identity and sexual orientation. The Government Accountability Office (GAO) deemed the policy update a rule on June 5, 2023, and therefore subject to the Congressional Review Act (CRA) requirement that a rule must be submitted to Congress and the GAO before it can take effect. The CRA also permits Congress to review and disapprove rules using specified procedures. In June 2020, the U.S. Supreme Court held in Bostock v. Clayton County that, under Title VII of the Civil Rights Act of 1964, the prohibition on sex discrimination in employment includes discrimination on the basis of sexual orientation and gender identity. The FNS determined that the Bostock analysis also applies to certain FNS-enforced requirements under the Food and Nutrition Act of 2008 and Title IX of the Education Amendments of 1972 because the requirements are sufficiently similar to those in the Civil Rights Act of 1964. The FNS rule concludes that the prohibitions against sex discrimination in the FNS-enforced statutes prohibit discrimination on the basis of gender identity and sexual orientation. The rule also directs state agencies and program operators to handle complaints alleging discrimination on the basis of gender identity and sexual orientation as complaints of prohibited sex discrimination.

Protecting America's Property Rights Act This bill requires title insurance on conventional mortgages purchased by Fannie Mae and Freddie Mac. Specifically, these mortgages must be secured by real property and the priority of the mortgage lien must be insured by a title insurance company that is licensed and authorized to do business in the appropriate state, territory, or district. The bill also prohibits Fannie Mae and Freddie Mac from implementing any new program without the approval of the Federal Housing Finance Agency (FHFA), in addition to the approval of the Department of the Treasury as under current law. Approval from both is also required for any new activity, product, or type of risk. FHFA must appear before Congress on a semiannual basis regarding new programs, activities, products, or types of risk.

This joint resolution nullifies the final rule issued by U.S. Citizenship and Immigration Services and the Executive Office for Immigration Review titled Circumvention of Lawful Pathways and published on May 16, 2023. The final rule established a rebuttable presumption that a non-U.S. national ( alien under federal law) entering the United States from Mexico without valid entry documents is ineligible for asylum if that individual had traveled through another country to reach the United States but did not apply for asylum or similar protection in that other country.

Stillbirth Health Improvement and Education for Autumn Act of 2023 or the SHINE for Autumn Act of 2023 This bill authorizes grants and establishes other programs to improve data collection on stillbirths. Specifically, the Department of Health and Human Services (HHS) may award grants for surveillance and data collection on stillbirths, and HHS must issue guidelines for health departments and vital statistics units concerning the collection of stillbirth data. HHS must also develop educational awareness materials about stillbirths and make them publicly available. Furthermore, HHS must implement a fellowship program to provide training in perinatal autopsy pathology and otherwise support research on stillbirths and fetal autopsies. The bill also requires HHS to issue a report with educational guidelines on stillbirths and stillbirth risk factors.

Behavioral Health Information Technology Coordination Act This bill establishes a grant program to support behavioral health integration for individuals with mental health and substance use disorders. Specifically, the Office of the National Coordinator for Health Information Technology must award grants to behavioral health care providers, including physicians, psychologists, and social workers, to support integration and coordination of services for individuals with mental health and substance use disorders. Authorized activities include purchasing or upgrading technology to meet specified federal certification standards for health information technology and to support integrated services with respect to screenings, treatment, and recovery.

Portal for Appraisal Licensing Act of 2023 This bill establishes a central portal for real estate appraisers and real estate appraisal management companies to apply for and to renew certain licenses, certifications, and registrations. The portal must provide connectivity with state agencies and include the ability to pay fees. The Department of Justice must provide access to criminal history information to state officials for required background checks.

Mid-South Oilseed Double Cropping Study Act of 2023 This bill directs the federal crop insurance program to provide for research and development with respect to the inclusion of covered oilseed crops (i.e., rapeseed and canola crops) under double cropping policies. (Double cropping is producing two or more crops for harvest on the same acreage in the same crop year.) The research must evaluate (1) the economic and environmental benefits of incorporating the crops into the policies; and (2) the potential risks associated with incorporating the crops into the policies, specifically with respect to winter-planted covered oilseed crops, including risks to soil health, biodiversity, and the profitability of farming operations. (The term policy means an insurance policy, plan of insurance, provision of a policy or plan of insurance, and related materials.) In awarding contracts, the program may place emphasis on persons and institutions that have previous research experience with covered oilseed crops and have access to a facility with the capacity to do the research.
