Working Families Flexibility Act of 2019 This bill revises requirements for the receipt of compensatory time off for private sector employees. Specifically, the bill authorizes private employers to provide compensatory time off to their employees at a rate of one and one-half hours for each hour of employment for which overtime compensation is required, prohibits an employee from accruing more that 160 hours of compensatory time, requires an employer to give their employees a 30-day notice before discontinuing compensatory time, prohibits an employer from interfering with an employee's right to or not request compensatory time off in lieu of payment of overtime compensation or from requiring an employee to use such compensatory time, and imposes penalties on employers who violate the compensatory time requirements set forth by this bill.

Revitalizing Underdeveloped Rural Areas and Lands (RURAL) Act This bill modifies the definition of income used to determine the tax-exempt status of a mutual or cooperative telephone or electric company to exclude certain government grants, contributions, and assistance. Specifically, the bill excludes from income (1) grants, contributions, and assistance provided under the Robert T. Stafford Disaster Relief and Emergency Assistance Act or by local, state, or regional governmental entities for disasters or emergencies; and (2) certain grants or contributions provided by a government entity for electric, communications, broadband, internet, or other utility facilities or services.

Sustainable Chemistry Research and Development Act of 2019 This bill directs the Office of Science and Technology Policy to convene an interagency entity under the National Science and Technology Council with the responsibility of coordinating federal programs and activities in support of sustainable chemistry. Agencies participating in the entity must carry out specified activities in support of sustainable chemistry, including incorporating sustainable chemistry into existing research, development, demonstration, technology transfer, commercialization, education, and training programs. Sustainable chemistry, also known as green chemistry, is focused on conserving resources and minimizing the generation and use of hazardous substances in chemical processes.

Supporting and Treating Officers In Crisis Act of 2019 This bill reauthorizes for FY2020-FY2024 and revises Department of Justice grants to provide family support services to law enforcement personnel. Among other changes, the bill allows grants to support additional services such as suicide prevention and mental health programs.

Protecting Jessica Grubb's Legacy Act This bill more closely aligns the federal privacy standards for substance use disorder (SUD) patient records with the standards under the Health Insurance Portability and Accountability Act (HIPAA). Specifically, the bill authorizes the disclosure of SUD patient records without a patient's written consent to: (1) a covered entity for the purposes of treatment, payment, and health care operations, as long as the disclosure is made in accordance with HIPAA; and (2) a public health authority, as long as the content of the disclosure meets HIPAA standards regarding de-identified information. Current law authorizes disclosure of SUD patient records without a patient's written consent only to medical personnel in a medical emergency, to specified personnel for research or program evaluations, or pursuant to a court order. The bill also repeals and replaces criminal penalties for certain violations involving SUD patient records with the HIPAA civil penalty structure. It also applies HIPAA criminal penalties to wrongful disclosures of SUD patient records. In addition, the bill expands the current prohibition against using SUD patient records in criminal proceedings to include any use in specified federal, state, and local criminal and civil actions. The bill prohibits certain discrimination based on the release of SUD information under this bill.

Veterans' Education, Transition, and Opportunity Prioritization Plan Act of 2019 or the VET OPP Act of 2019 This bill establishes the Veterans Economic Opportunity and Transition Administration to administer economic opportunity assistance programs for veterans and their dependents and survivors. Specifically, the Veterans Economic Opportunity and Transition Administration must administer the following Department of Veterans Affairs programs: vocational rehabilitation and employment programs, educational assistance programs, veterans' housing loan and related programs, the Transition Assistance Program, and the database of small business concerns owned and controlled by veterans.

This resolution recognizes the 75th anniversary of the amphibious landing of the allied forces on D-Day, June 6, 1944, at Normandy, France, during World War II. The resolution expresses appreciation to the members of the U.S. Armed Forces who participated in the operations, thanks the young people of Normandy and the United States for their involvement in events celebrating the anniversary of the Normandy landings, recognizes the efforts of France and the people of Normandy to preserve the world heritage represented by the Normandy beaches and the sunken material remains of the landings by inscribing these on the UNESCO World Heritage List, and requests the President to issue a proclamation calling on the people of the United States to observe the 75th anniversary.

Improving Transparency and Accuracy in Medicare Part D Spending Act This bill prohibits Medicare prescription drug plan sponsors from retroactively reducing payment on clean claims submitted by pharmacies. (A clean claim is a Medicare claim that is free of defects such as incomplete documentation.)

Campus Accountability and Safety Act This bill addresses sexual harassment, sexual assault, and other violence and harassment on the campuses of colleges and universities. The bill expands reporting requirements included in the annual campus security report provided to current and prospective students and employees. Specifically, the report must include information about (1) the institution's coordination with local law enforcement about domestic violence, dating violence, sexual assault, and stalking occurring against its students or against other individuals on its campus; (2) statistics about certain criminal offenses reported to campus security authorities or local police, including rape, fondling, incest, and statutory rape; and (3) information about how the institution is addressing domestic violence, dating violence, sexual assault, and stalking. The Department of Education (ED) must administer and publish the campus-level results of a biannual survey of students regarding their experiences with domestic violence, dating violence, sexual assault, and stalking. Each institution must establish a campus security policy that meets certain requirements with respect to (1) assisting survivors; (2) training individuals who are involved in implementing the student grievance procedures or who are responsible for interviewing survivors; and (3) establishing a uniform process for student disciplinary proceedings relating to any claims of domestic violence, dating violence, sexual assault, or stalking, or relating to a sexual misconduct policy violation against a student. ED and the Department of Justice may impose civil penalties for failure to meet certain requirements under this bill. The bill also authorizes grants to address these issues.

Smithsonian American Women's History Museum Act This bill establishes in the Smithsonian Institution a comprehensive women's history museum. Such museum shall be named by the Board of Regents of the Smithsonian Institution. The bill establishes a council that, among other things, shall make recommendations to the board on the planning, design, and construction of the museum. The board shall designate a site for the museum, with priority given to a site that is on or near the National Mall.

Providing Officers With Electronic Resources Act or the POWER Act This bill authorizes the Office of Community Oriented Policing Services within the Department of Justice to make grants to law enforcement agencies to purchase a chemical screening device and to train personnel to use, and interpret data collected by, such device.

Conrad State 30 and Physician Access Reauthorization Act This bill modifies the Conrad 30 Waiver program, which incentivizes qualified foreign physicians to serve in underserved communities. It also extends statutory authority for the program through FY2021. Aliens coming to the United States under a J-1 nonimmigrant visa to receive medical training typically must leave the country and reside for two years abroad before being eligible to apply for an immigrant visa or permanent residence. The Conrad program waives this requirement for individuals who meet certain qualifications, including serving for a number of years at a health care facility in an underserved area. The bill increases the number of waivers that a state may obtain each fiscal year from 30 to 35 if a certain number of waivers were used the previous year, and provides for further adjustments depending on demand. An alien physician may be employed at an academic medical center to meet the Conrad program's employment requirements if the alien's work is in the public interest, even if the medical center is not in an underserved area. Employment contracts for alien physicians under the Conrad program shall contain certain information, such as the maximum number of on-call hours per week the physician shall have to work. Certain alien physicians (along with the physician's spouse and children) shall be exempt from the direct annual numerical limits on immigration, including those physicians that have met certain requirements related to visas for physicians to serve in underserved areas.

The resolution also applauds the association for its past, present, and future efforts to advocate for the National Park System. Finally, it wishes the association continued success during the next 100 years as it strives to engage and inspire the public to advance the mission of the National Park System.

Driftnet Modernization and Bycatch Reduction Act This bill addresses certain driftnet fishing. (Driftnet fishing is a method of fishing in which a gillnet composed of a panel or panels of webbing, or a series of such gillnets, is placed in the water and allowed to drift with the currents and winds for the purpose of entangling fish in the webbing.) Currently, the use of large-scale drift gillnets with a total length of 2.5 kilometers or more is prohibited in the United States. The bill expands the definition of large-scale driftnet fishing to prohibit the use of gillnets with a mesh size of 14 inches or greater. This expanded prohibition does not apply within the U.S. exclusive economic zone for five years. The Department of Commerce must conduct a transition program to facilitate the phase out of large-scale driftnet fishing and to promote the adoption of alternative fishing practices that minimize the incidental catch of living marine resources. Commerce must award grants to program participants.

Nuclear Energy Leadership Act This bill addresses nuclear energy innovation. Among other things, the bill directs the Department of Energy (DOE) to (1) establish a long-term nuclear power purchase agreement pilot program; (2) advance the research and development of domestic advanced, affordable, and clean nuclear energy; (3) develop a 10-year strategic plan for its Office of Nuclear Energy; (4) provide for a versatile, reactor-based fast neutron source; (5) establish a program to make available high-assay, low-enriched uranium for use in commercial or noncommercial advanced nuclear reactors; and (6) provide competitive grants to develop the capability to transport high-assay, low enriched uranium. DOE, the National Nuclear Security Administration, and the Nuclear Regulatory Commission must jointly establish a University Nuclear Leadership Program to provide financial assistance for scholarships, fellowships, and research and development projects at institutions of higher education.

Younger Onset Alzheimer's Disease Act This bill makes individuals with younger-onset Alzheimer's disease (i.e., individuals who experienced onset of the disease before age 60) eligible for certain federal grants and programs that support older adults. Under current law, these grants and programs serve only individuals 60 and older.

Rosie the Riveter Congressional Gold Medal Act of 2019 This bill directs the President pro tempore of the Senate and the Speaker of the House of Representatives to make appropriate arrangements for the award of a single Congressional Gold Medal to Rosie the Riveter (i.e., any female individual who held employment or volunteered in support of the war efforts during World War II), in recognition of their contributions to the United States and the inspiration they have provided to ensuing generations. The medal shall be displayed at the National Museum of American History, which is urged to make the medal available for display at other locations associated with Rosie the Riveter.

Shark Fin Sales Elimination Act of 2019 This bill makes it illegal to possess, buy, sell, or transport shark fins or any product containing shark fins, except for certain dogfish fins. A person may possess a shark fin that was lawfully taken consistent with a license or permit under certain circumstances. Penalties are imposed for violations under the Magnuson-Stevens Fishery Conservation and Management Act. The maximum civil penalty for each violation shall be $100,000, or the fair market value of the shark fins involved, whichever is greater.

Improving HOPE for Alzheimer's This bill requires the Centers for Medicare & Medicaid Services (CMS) to conduct outreach to health care practitioners regarding comprehensive care planning services that are available under Medicare for individuals with Alzheimer's disease and related dementias. The CMS must report on its outreach efforts, as well as on the number of beneficiaries receiving such services and any barriers to access.

This resolution opposes the Global Boycott, Divestment, and Sanctions Movement (BDS) and other efforts targeting Israel, and states that BDS undermines the possibility for a negotiated solution to the Israeli-Palestinian conflict. The resolution urges both sides to return to direct negotiations and expresses support for a solution resulting in the state of Israel existing alongside a democratic Palestinian state.

U.S.S. Frank E. Evans Act This bill requires the Department of Defense to authorize inclusion on the Vietnam Veterans Memorial Wall in the District of Columbia of the names of the 74 crew members of the USS Frank E. Evans killed on June 3, 1969.

Transit Infrastructure Vehicle Security Act This bill prohibits the awarding of a contract to an entity for the procurement of rolling stock for use in public transportation if the manufacturer of the rolling stock is (1) incorporated or has manufacturing facilities in the United States; and (2) is owed or controlled by an entity based in a country that is identified as a nonmarket economy country, was identified by the Office of the U.S. Trade Representative (USTR) as a priority foreign country (e.g., a country that does not protect intellectual property rights), and is subject to monitoring by the USTR. This includes the People's Republic of China. Any recipient of financial assistance for public transportation that operates a rail fixed guideway service must certify that it will not award any contract for the procurement of rail rolling stock for use in public transportation to a manufacturer of rolling stock that is described by this bill. A recipient that operates a rail fixed guideway public transportation system must certify that it has a written plan for identifying and reducing cybersecurity risks.

Improving Broadband Mapping Act of 2019 This bill requires the Federal Communications Commission to establish a process that uses broadband coverage data reported by consumers and government entities to verify coverage data reported by wireless carriers. In addition, the FCC must consider (1) including a mechanism to incorporate such data; and (2) implementing other measures, such as an evidence-based challenge process, to verify reported coverage data.

Jumpstart Our Businesses by Supporting Students Act of 2019 or the JOBS Act of 2019 This bill expands student eligibility for Pell Grants by establishing the Job Training Federal Pell Grant program. Specifically, the bill requires the Department of Education to award a job training Pell Grant to a student who does not have a degree; attends an institution of higher education (IHE); is enrolled in a career and technical education program at an IHE that provides 150 to 600 clock hours of instructional time over a period of 8 to 15 weeks and provides training aligned with high-skill, high-wage, or in-demand industry sectors (i.e., job training programs); and meets all other eligibility requirements for a Pell Grant. It also specifies that any period during which a student receives a job training Pell Grant counts toward that student's Pell Grant eligibility period.

Access Technology Affordability Act of 2019 This bill allows a refundable tax credit equal to the amounts paid for qualified access technology for use by a blind individual who is the taxpayer, the taxpayer's spouse, or a dependent of the taxpayer. "Qualified access technology" is hardware, software, or other information technology with the primary function of converting or adapting information that is visually represented into forms or formats useable by blind individuals. The credit is limited to (1) costs that are not compensated by insurance or otherwise, and (2) an aggregate amount of $2,000 per blind individual in any period of three consecutive taxable years. The credit must be adjusted for inflation after 2020 and terminates after five years.

Restoring Investment in Improvements Act This bill confirms that the applicable recovery period for qualified improvement property (nonresidential real estate) for depreciation purposes is 15 years under the modified accelerated cost recovery system (MACRS) and 20 years under the alternative depreciation system (ADS).

College Transparency Act This bill requires the National Center for Education Statistics to establish a secure and privacy-protected data system that contains information about postsecondary students. Specifically, the data system must evaluate student enrollment patterns, progression, completion, and postcollegiate outcomes, and higher education costs and financial aid; provide complete and customizable information for students and families making decisions about postsecondary education; reduce the requirements for reporting by institutions of higher education; and periodically match with other federal systems of data. The bill also establishes a postsecondary student data system advisory committee.

Healthy Food Access for All Americans Act This bill allows tax credits and grants for activities that provide access to healthy food in food deserts, which are communities that have limited or no access to grocery stores and meet income requirements. For entities that are certified by the Department of the Treasury as special access food providers using specified criteria, the bill allows tax credits for operating a new grocery store or renovating an existing grocery store in a food desert. The bill also authorizes grants for a portion of (1) the construction costs of building a permanent food bank in a food desert, and (2) the annual operating costs of temporary access merchants (mobile markets, farmers markets, and food banks). Treasury, in coordination with the Department of Agriculture (USDA), must annually allocate the tax credits and grants to special access food providers. Grants authorized by this bill are not considered gross income for tax purposes. The bill also requires USDA to update the Food Access Research Atlas at least annually to account for food retailers that are placed in service during that year.

Merrill's Marauders Congressional Gold Medal Act This bill directs Congress to award a Congressional Gold Medal to the 5307th Composite Unit (Provisional), commonly known as Merrill's Marauders, in recognition of their bravery and outstanding service in the jungles of Burma (Myanmar) during World War II. Following its award, the gold medal shall be given to the Smithsonian Institution where it shall be displayed and made available for research.

Support for Veterans in Effective Apprenticeships Act of 2019 This bill requires the Department of Labor to amend rules and procedures for its registered-apprenticeship programs to include additional program requirements for increasing the access of veterans and their survivors or dependents to such programs.

Diesel Emissions Reduction Act of 2019 This bill reauthorizes through FY2024 and revises the diesel emissions reduction program. The program authorizes the Environmental Protection Agency (EPA) to provide grants, rebates, or loans for replacing diesel engines or retrofitting the engines with pollution control technologies. The bill modifies requirements governing how the EPA must prioritize projects when providing grants, rebates, and loans. Specifically, the EPA must recognize differences in how vehicles, engines, equipment, and fleets are used across the country as it prioritizes projects that include certified engine configurations, verified technologies, or emerging technologies that have a long expected useful life. Under current law, the EPA must use a certain percentage of the funds made available for the program to support state administered programs for reducing diesel emissions. If a state does not quality for funds, then the funds for the unqualified state must be reallocated to qualified states. This bill requires the funds for the unqualified state to be reallocated to the national diesel emissions reduction program.

Improving Access to Medicare Coverage Act of 2019 This bill deems an individual receiving outpatient observation services in a hospital as an inpatient for purposes of satisfying the three-day inpatient hospital-stay requirement with respect to Medicare coverage of skilled nursing facility services.

New Markets Tax Credit Extension Act of 201 9 This bill makes the new markets tax credit permanent. It also modifies the credit to (1) provide for an inflation adjustment to the limitation amount for the credit after 2018, and (2) allow an offset against the alternative minimum tax for the credit (determined with respect to qualified equity investments initially made after 2018).

Cancer Drug Parity Act of 2019 This bill requires health plans that cover anticancer medications administered by a health care provider to provide no less favorable cost sharing for patient-administered anticancer medications. This requirement applies to medications that are (1) approved by the Food and Drug Administration; (2) medically necessary for the cancer treatment; and (3) clinically appropriate in terms of type, frequency, extent site, and duration. To comply with this requirement, health plans may not, with respect to anticancer medications (1) change or replace benefits to increase out-of-pocket costs, (2) reclassify benefits to increase costs, or (3) apply more restrictive limitations to orally administered medications than to intravenously administered or injected medications.

Building Blocks of STEM Act This bill modifies National Science Foundation (NSF) grant programs that support STEM (science, technology, engineering, and mathematics, including computer science) education. The bill instructs the NSF, when awarding grants under the Discovery Research PreK-12 program, to improve the focus of research and development on early childhood education. The bill specifies that NSF grants to increase the participation of underrepresented populations in STEM fields may be used for research into various subjects regarding female students in prekindergarten through elementary school, including the role of teachers and caregivers in encouraging or discouraging participation by such students in STEM activities, and the types of STEM activities that encourage greater participation by such students. The bill specifies that NSF grants to research computer science education and computational thinking may be used to support development and implementation of various tools and models for teaching and learning, including developing and offering gender-inclusive computer science enrichment programs, and acquainting female students in prekindergarten through elementary school with careers in computer science.

National Nurse Act of 2019 This bill requires the Department of Health and Human Services to designate the Chief Nurse Officer of the Public Health Service as the National Nurse for Public Health. The position includes the authority to (1) provide leadership and coordination of Public Health Service nursing professional affairs for the Office of the Surgeon General and other agencies of the Public Health Service, (2) conduct outreach and education, and (3) provide guidance and leadership for activities that will increase public safety and emergency preparedness. The National Nurse for Public Health must (1) participate in identification of national health priorities, (2) encourage volunteerism of nurses and strengthen the relationship between government agencies and health-related national organizations, and (3) promote the dissemination of evidence-based practice in educating the public on health promotion and disease prevention activities.

Middle Class Health Benefits Tax Repeal Act of 201 9 This bill repeals the excise tax on employer-sponsored health care coverage for which there is an excess benefit (high-cost plans). The repeal applies to taxable years beginning after December 31, 2019.

Personal Health Investment Today Act of 2019 or the PHIT Act of 201 9 This bill allows a medical care tax deduction for up to $1,000 ($2,000 for a joint return or a head of household) of qualified sports and fitness expenses per year. The bill defines "qualified sports and fitness expenses" as amounts paid exclusively for the sole purpose of participating in a physical activity, including (1) fitness facility memberships, (2) physical exercise or activity programs, and (3) equipment for a physical exercise or activity program.

Honoring American Veterans in Extreme Need Act of 2019 or the HAVEN Act This bill modifies the treatment of certain veterans' benefits in bankruptcy. Specifically, the bill excludes from a debtor's current monthly income certain benefits, including disability benefits, paid by the Department of Veterans Affairs or the Department of Defense.

Workforce Development Through Post-Graduation Scholarships Act of 201 9 This bill modifies the requirements for calculating taxable income to exclude post-graduation scholarship grants from gross income in the same manner as scholarships are currently excluded. A "post-graduation scholarship grant" is a grant provided by a program that is established by certain tax-exempt organizations; requires the grantee to live and work in an applicable community that meets certain requirements regarding income, out-migration, and bachelor's degree attainment rates; and under which, in accordance with the conditions of a grant, the organization repays any portion of an education loan incurred by an individual to pay higher education expenses. In implementing this bill, the Department of the Treasury must prescribe specified regulations and meet reporting requirements. The Government Accountability Office must report on the post-graduation scholarship grants covered by this bill.

Miners Pension Protection Act This bill transfers certain funds to provide pension benefits for retired coal miners who have been affected by issues such as coal company bankruptcies. The Department of the Treasury must transfer additional funds to the 1974 United Mine Workers of America (UMWA) Pension Plan to pay pension benefits required under that plan if the annual limit on transfers under the Surface Mining Control and Reclamation Act of 1977 exceeds the amount required to be transferred for existing obligations of the Abandoned Mine Reclamation Fund. The bill also increases the annual limit on transfers from $490 million to $750 million. The bill also allows in-service distributions under a pension plan or governmental section 457(b) plan at age 59-1/2 (currently age 62).
