Legislative Branch Appropriations Act, 2019 Provides FY2019 appropriations for the legislative branch, including the Senate and Joint Items such as: the Joint Economic Committee, the Joint Committee on Taxation, the Office of the Attending Physician, and the Office of Congressional Accessibility Services. Provides FY2019 appropriations for: the Capitol Police; the Office of Compliance; the Congressional Budget Office; the Architect of the Capitol; the Library of Congress, including the Congressional Research Service and the Copyright Office; the Government Publishing Office; the Government Accountability Office; the Open World Leadership Center Trust Fund; and the John C. Stennis Center for Public Service Training and Development. (Pursuant to the longstanding practice of each chamber of Congress determining its own requirements, funds for the House are not included in the Senate bill.) Sets forth permissible and prohibited uses for funds provided by this bill.

Synthetics Trafficking and Overdose Prevention Act of 2018 or STOP Act of 2018 This bill establishes requirements related to U.S. Postal Service (USPS) international mail shipments. Among other requirements, the bill requires USPS to gather advanced data on its shipments and share such information with U.S. Customs and Border Protection and assesses a fee on on overseas inbound express mail.

Modernizing Agricultural Transportation Act This bill directs the Department of Transportation to establish a working group to: (1) identify obstacles to safe, humane, and market-efficient transport of livestock, insects, and agricultural commodities; and (2) develop guidelines and recommended regulatory or legislative actions to improve the safe, humane, and efficient transport of livestock, insects, and agricultural commodities.

Modernizing Congressional Reporting Act of 2018 This bill requires federal agencies to submit reports, written communications, and other information to Congress in an electronic format, unless Congress requests a physical document.

B-47 Ridge Designation Act This bill designates the mountain ridge that runs south and west of Emigrant Peak in the Absaroka Range in Montana, which is where an Air Force B-47 strategic bomber crashed while on a training mission in 1962, as the "B-47 Ridge." The bill permits the installing of a plaque on the ridge in memory of such crash.

Reprioritizing Unserved Rural Areas and Locations for Broadband Act of 2018 or the RURAL Broadband Act of 2018 This bill amends the Rural Electrification Act of 1936 to allow financial assistance provided by the Rural Utilities Service for the deployment of broadband-capable infrastructure by a service provider to be used to provide retail fixed broadband service in an area where there is no qualifying broadband-capable infrastructure owned or operated by another service provider. The term "qualifying broadband-capable infrastructure" means fixed broadband-capable infrastructure: (1) used by a service provider to provide fixed broadband service for which the provider receives universal service support funds, and (2) was financed with funds from the Department of Agriculture.

Prevent All Soring Tactics Act of 2018 or the PAST Act This bill amends the Horse Protection Act to establish a new system for inspecting horses for soring, revise penalties for violations of the Act, and modify enforcement procedures. The soring of horses is any of various actions taken on a horse's limb to produce a higher gait that may cause pain, distress, inflammation, or lameness. The Department of Agriculture (USDA) must establish requirements to license, train, assign, and oversee persons hired by the management of horse shows, exhibitions, sales, or auctions to detect and diagnose sore horses. A license may not be issued to a person with conflicts of interest, and USDA must give preference to veterinarians. USDA may revoke a license for unsatisfactory performance. USDA must assign licensed inspectors after receiving notice that management intends to hire the inspectors. An inspector must issue a citation for violations and notify USDA of violations. USDA must publish information on violations of this bill and disqualify a horse that is sore. The bill prohibits a person in any horse show, exhibition, sale, or auction from causing or directing a horse to become sore for the purpose of showing, exhibiting, selling, or auctioning the horse. The bill prohibits the use of specified devices on a Tennessee Walking, a Racking, or a Spotted Saddle horse at a show, exhibition, sale, or auction. The bill increases the maximum criminal and civil liability penalties for certain violations. USDA may disqualify violators from specified activities related to horse shows, exhibitions, sales, and auctions.

Patients First Act of 2018 This bill amends the Public Health Service Act to require the Department of Health and Human Services (HHS) to conduct and support basic and applied research to develop techniques for the isolation, derivation, production, testing, and human clinical use of stem cells that may result in improved understanding of, or treatments for, diseases and other adverse health conditions, provided that the techniques will not involve: (1) the creation of a human embryo for research purposes; (2) the destruction or discarding of, or risk of injury to, a living human embryo; or (3) the use of any stem cell the derivation or provision of which would be inconsistent with this bill. HHS must issue guidelines to ensure that any research (including any clinical trial) supported under this bill: (1) is clearly consistent with the standards established in this bill, if conducted using human cells; and (2) is prioritized in terms of potential for near-term clinical benefit in human patients. HHS must report on peer reviewed stem cell research proposals that were not funded.

Encourages increased public awareness of brain tumors to honor individuals who are living with or who have lost their lives to brain tumors. Urges a collaborative approach to brain tumor research.

Tribal Employment and Jobs Protection Act This bill amends the Internal Revenue Code to exclude from the definition of "applicable large employer" for purposes of the employer health care mandate under the Patient Protection and Affordable Care Act (PPACA): (1) any Indian tribal government or subdivision, (2) any tribal organization, or (3) any corporation or partnership if more than 50% of the equity interest of such an entity is owned by an Indian tribal government or tribal organization. An applicable large employer is defined by PPACA as an employer who employs 50 or more full-time employees who provide services on average at least 30 hours per week.

Transporting Livestock Across America Safely Act This bill requires the Department of Transportation to amend regulations on hours of service for commercial drivers who transport livestock or insects within a 300 air-mile radius from where the on-duty time of the driver begins.The regulations must: (1) exclude from the driver's on-duty time certain activities, such as loading or unloading a commercial motor vehicle; (2) change the driving time requirement to a maximum of not less than 15, and not more than 18, hours within a 24-hour period; (3) permit the driver to take one or more rest periods during the trip, which shall not be included in the calculation of the driving time; (4) require the driver, after completion of the trip, to take a rest break for a period that is five hours less than the maximum driving time; (5) exclude from the calculation of the driving time any additional driving to the point of delivery if the driver is within 150 air-miles of the point of delivery; and (6) make inapplicable the requirement that the driver take a 10-hour rest period before driving.

National Law Enforcement Museum Commemorative Coin Act This bill directs the Department of the Treasury to mint and issue up to 50,000 $5 gold coins, 400,000 $1 silver coins, and 750,000 half-dollar clad coins that are emblematic of the National Law Enforcement Museum in Washington, DC, and the service and sacrifice of law enforcement officers throughout the history of the United States. All sales of such coins shall include specified surcharges, which shall be distributed to the National Law Enforcement Officers Memorial Fund, Inc., for educational and outreach programs and exhibits.

Putting First-Responders First Act This bill amends the Internal Revenue Code to allow first responders to exclude from gross income certain service-connected disability payments received as part of a pension or annuity after reaching the age of retirement. The bill applies to law enforcement officers, employees in fire protection activities, and individuals who provide out-of-hospital emergency medical care.

Gambling Addiction Prevention Act This bill directs the Department of Defense (DOD) to: (1) incorporate medical screening questions specific to gambling disorder into the Annual Periodic Health Assessment conducted by DOD for members of the Armed Forces; (2) incorporate into ongoing DOD research efforts questions on gambling disorder; and (3) develop and implement policies and programs on prevention, education, and treatment of gambling disorder and integrate gambling disorder into existing mental health and substance use disorder programs.

Music Modernization Act This bill makes various changes to copyright law related to sound recordings, including providing protection for sound recordings fixed before February 15, 1972, creating a system for paying royalties to producers and sound engineers, and establishing a statutory blanket license for digital music services. The blanket license allows music services to distribute sound recordings covered by the license without negotiating for the rights for each individual recording, as long as the music service complies with the license's requirements, such as paying the required royalties.

National Guard Promotion Accountability Act This bill permits the date of promotion of a commmissioned officer of the National Guard to be backdated, after federal recognition is granted, to the date such officer's promotion was published by the state. The bill requires the Departments of the Army and the Air Force to report to Congress on delay in publication of scrolls indicating promotions of commissioned National Guard officers. The Departments of the Army and of the Air Force shall each undertake a comprehensive review of their policies and procedures for the federal recognition promotions of Army or Air Force National Guard commissioned officers.

Hemp Farming Act of 2018 This bill legalizes industrial hemp that has a tetrahydrocannabinol (THC, the psychoactive component of marijuana) concentration of no more than 0.3% by removing it from schedule I of the Controlled Substances Act. States and Indian tribes may regulate the production of hemp by submitting a plan to the Department of Agriculture (USDA). The bill also makes hemp producers eligible for the federal crop insurance program and certain USDA research grants.

Safeguarding American Families from Exposure by Keeping Information and Data Secure Act or the SAFE KIDS Act This bill prohibits an operator of a school's website from using personally identifiable information or material it acquired because of use of the site in order to target advertising to students from early childhood education through secondary school, or their parents, based on information obtained or inferred from students' online behavior, use of online applications, or such personally identifiable information. The bill exempts online advertisements that are based on a current visit or are in response to a student's request for more information or feedback, provided that information about students' online behavior is not collected or retained over time for the purpose of targeting subsequent advertisements. The bill prohibits operators from: (1) selling students' personal information to third parties; or (2) collecting student information to create a personal profile or for purposes unrelated to educational instruction, school collaboration, or administrative activities. The bill requires operators to implement information security procedures. It directs operators to delete certain student information that is not included in a student's education records: (1) within a reasonable time after a request through an educational agency, institution, or program, or from the student's parent; or (2) once the data has outlived the legitimate purpose for which it was collected.

Equitable Access to Care and Health Act or the EACH Act This bill amends the Internal Revenue Code to expand the religious conscience exemption under the Patient Protection and Affordable Care Act to exempt individuals who rely solely on a religious method of healing and for whom the acceptance of medical health services would be inconsistent with their religious beliefs from the requirement to purchase and maintain minimum essential health care coverage.

National Park Restoration Act This bill establishes the National Park Restoration Fund in the Treasury to be made available to the Department of the Interior for priority deferred maintenance needs that support critical infrastructure and visitor services of the National Park Service. Funds deposited through FY2027 are calculated according to a formula that uses as a factor the total amount of energy development revenues due and payable to the federal government. Interior may not use amounts in the fund to acquire lands. Interior shall submit to Congress a list of the projects for which amounts from the fund are allocated, including a summary of each project.

United States-Israel Security Assistance Authorization Act of 2018 This bill extends security assistance to Israel. Specifically, it extends: foreign military financing assistance to Israel through FY2028, loan guarantees through FY2023, and authority for the war reserves stockpile through FY2023. The President may: enter into a cooperative agreement with Israel for research and joint production of anti-drone defense articles; conduct a joint assessment with Israel regarding which precision guided munitions Israel needs in a sustained armed confrontation with Hezbollah, Hamas, or other groups; and transfer precision guided munitions and defense articles to such stockpile. The bill directs the Department of Defense to provide for the rapid acquisition and deployment of precision guided munitions for U.S. counterterrorism missions or to assist an ally under missile threat from a terrorist organization or a country that supports international terrorism. The President shall report to Congress describing the steps taken to include Israel in the list of countries eligible for the strategic trade authorization exception. Such exception allows a controlled item to be exported without a transaction-specific license. The National Aeronautics and Space Administration shall continue to work with the Israel Space Agency to pursue peaceful space exploration and science initiatives. The bill also requires the periodic reports on Israel's qualitative military edge to include information about Israel's ability to defend itself from regional state and non-state actors and from drone, cyber, and asymmetric threats.

Retirement Savings Lost and Found Act of 201 8 This bill requires the Department of the Treasury and the Social Security Administration (SSA) to create an online Retirement Savings Lost and Found (RSLF) to assist individuals in locating certain employer-sponsored retirement accounts. The RSLF must provide plan participants or beneficiaries only with the ability to view contact information for the administrator of a plan that is sufficient to locate the plan. The bill amends the Internal Revenue Code (IRC) to set forth additional reporting and notification requirements for retirement plans. Treasury and the SSA must take precautions to: (1) safeguard the privacy and security of participants' plan information, and (2) permit plan participants to opt out of inclusion in the RSLF. The bill amends the Employee Retirement Income Security Act of 1974 (ERISA) and the IRC to revise provisions that permit mandatory distributions of the balances of small retirement accounts using a rollover into an Individual Retirement Account (IRA). The bill modifies the investment options available for the distributions and increases the maximum account balance that may be subject to such a distribution. A plan must transfer unclaimed mandatory distributions that are $1,000 or less to the RSLF or to an IRA established by Treasury. The RSLF must invest funds received in Treasury securities and distribute the balance upon receiving an application from a plan participant or beneficiary.

This bill prohibits the Department of Homeland Security from searching or seizing an electronic device at the international border except in certain circumstances where a manual or a forensic search or a seizure is justified by a reasonable suspicion or probable cause that the person transporting the device is carrying contraband or illegally transporting goods or persons. The bill sets forth procedures for initiating searches and seizures of electronic devices at the border.

Charitable Conservation Easement Program Integrity Act of 2018 This bill amends the Internal Revenue Code to limit the aggregate amount of a partner's annual tax deductions for qualified conservation contributions of a partnership to 2.5 times the partner's adjusted basis in the partnership. (Under current law, a "qualified conservation contribution" is the contribution of a qualified real property interest to a qualified organization exclusively for conservation purposes.) The limitation applies for the first five years after the individual becomes a partner in the partnership. It does not apply to certain family partnerships.

Fair Agricultural Reporting Method Act or the FARM Act This bill amends the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 to exempt air emissions from animal waste at a farm from specified release notification requirements, recordkeeping requirements, and associated penalties.

Child Tax Credit for Pregnant Moms Act of 2018 This bill amends the Internal Revenue Code, with respect to the child tax credit, to allow the credit to be used for an unborn child if the child is born and issued a Social Security number before the due date for the tax return (without regard to extensions) for the taxable year. The bill defines an "unborn child" as a member of the species homo sapiens, at any stage of development, who is carried in the womb. If a child is not taken into account for the credit for the year immediately preceding the year of the child's birth, the bill doubles the amount of the credit allowed for the year of the birth.

Cyber Support for Anti-Terrorism by Fostering Effective Technologies Act of 2018 or the Cyber SAFETY Act of 2018 This bill amends the Homeland Security Act of 2002 to authorize the Department of Homeland Security to extend liability protections to cybersecurity technologies. Under current law, such protections are limited to anti-terrorism technologies.

Streamlining and Investing in Broadband Infrastructure Act This bill requires the National Telecommunications and Information Administration to issue best practices relating to broadband infrastructure and installation for state broadband coordination offices, with an emphasis on rural areas. The Department of Transportation (DOT) must require states to install broadband conduits, which support broadband or wireless facilities for broadband service, in certain highway construction projects. DOT must ensure that: (1) standards are established that apply to all areas, including rural and remote areas with low population density; and (2) any requesting broadband provider has access to such installed conduits on a competitively neutral and nondiscriminatory basis, for a charge not to exceed a cost-based rate. The bill amends the Middle Class Tax Relief and Job Creation Act of 2012 to require federal agencies and other entities to grant real property interests necessary for the installation, construction, or modification of a communications facility installation, as defined by this bill.
