Directing Independent Research To Yield Carbon Assessment Regarding Electric Vehicles Act of 2023 or the DIRTY CAR EV Act of 2023 The bill directs the Government Accountability Office to study the total carbon footprint and environmental impact of an electric vehicle ecosystem, including all aspects of the production, use, and disposal of electric vehicles.

Railroad Employee Equity and Fairness Act or the REEF Act This bill permanently exempts payments made from the Railroad Unemployment Insurance Account from sequestration. Sequestration is a process of automatic, usually across-the-board spending reductions under which budgetary resources are permanently cancelled to enforce specific budget policy goals. Currently, this exemption ends 30 days after the termination of the COVID-19 national emergency period.

This joint resolution nullifies a Department of Labor final rule entitled Adverse Effect Wage Rate Methodology for the Temporary Employment of H-2A Nonimmigrants in Non-Range Occupations in the United States and published on February 28, 2023. This rule makes changes to the methodology used to set adverse effect wage rates for H-2A workers (temporary agricultural workers), including by using Bureau of Labor Statistics wage surveys in certain instances. (Generally, the minimum wage for an H-2A worker is the highest of the adverse effect wage rate, the applicable minimum wage, the prevailing wage for that occupation in that area, or any agreed-upon collective bargaining wage.)

Defend Our Networks Act This bill requires certain unobligated funds that were provided to address COVID-19 to be transferred to the Federal Communications Commission (FCC) for carrying out the Secure and Trusted Communications Networks Reimbursement Program. (Under the program, the FCC reimburses certain providers of advanced communications services for reasonable expenses incurred in the removal, replacement, and disposal of communications equipment and services produced or provided by Huawei Technologies Company or ZTE Corporation.)

Combating Violent and Dangerous Crime Act This bill makes changes to federal criminal laws related to various offenses, including bank robbery, carjacking, and certain federal drug offenses. Among the changes, the bill makes conspiracy to commit bank robbery an offense under the federal bank robbery statute, which means violations carry a maximum prison term of up to 20 years; broadens the scope of prohibited conduct under the federal carjacking statute and increases statutory maximum penalties for offenses; and establishes enhanced criminal penalties for certain federal drug offenses involving the manufacture or distribution of candy-flavored controlled substances or similar products for minors.

Protecting Access for Hunters and Anglers Act of 2023 This bill bars the Department of the Interior and the Department of Agriculture from prohibiting or regulating the use of lead ammunition or tackle on federal land or water that is under the jurisdiction of such departments and made available for hunting or fishing. The bill makes exceptions for specified existing regulations and where the applicable department determines that a decline in wildlife population at the specific unit of federal land or water is primarily caused by the use of lead in ammunition or tackle, based on the field data from such unit, and the state approves the regulations.

This joint resolution nullifies the final rule issued by the National Marine Fisheries Service titled Endangered and Threatened Wildlife and Plants; Regulations for Listing Endangered and Threatened Species and Designating Critical Habitat and published on June 24, 2022. The 2022 rule rescinds an earlier rule which limited the ability of the service to designate an area a critical habitat . Areas designated as critical habitat are subject to certain statutory restrictions.

Stop Dangerous Sanctuary Cities Act This bill addresses issues related to state and local government cooperation with federal immigration enforcement efforts, including by prohibiting uncooperative jurisdictions from receiving certain grants. Specifically, the bill prohibits a sanctuary jurisdiction from receiving grants under certain Economic Development Assistance Programs and the Community Development Block Grant Program. Under the bill, a sanctuary jurisdiction is a state or local government that has in effect a statute, policy, or practice that prohibits or restricts (1) information sharing with another government entity about an individual's immigration status, or (2) compliance with a lawfully issued Department of Homeland Security (DHS) detainer request or notification of release request. When complying with a DHS-issued detainer, a state or local government shall be deemed to be acting as an agent of DHS with all authority available to DHS officers and employees. The bill also limits the legal liability of a state or local government for complying with a detainer.

Hammers' Law This bill authorizes a party in a civil suit to recover nonpecuniary damages (i.e., damages for loss of care, comfort, and companionship) when an individual dies as a result of a cruise ship accident that occurred on the high seas beyond 12 nautical miles from the U.S. shore. The nonpecuniary damages may be in addition to other damages, but punitive damages are not recoverable. Current law already permits these damages to be recovered if a death was caused by a commercial aviation accident on the high seas.

Promoting Women in Aviation Act This bill establishes a Women in Aviation Advisory Committee within the Department of Transportation (DOT). The committee must advise DOT and the Federal Aviation Administration (FAA) on matters related to women in the aviation industry and coordinate with the FAA's Federal Women's Program. Membership in the committee must include representatives from major airlines and aerospace companies, nonprofit organizations within the aviation industry, airport operators and employees, aviation and engineering business associations, the Civil Air Patrol, the FAA, educational institutions, and labor organizations. The committee must submit a report annually to Congress, DOT, and the FAA on the committee's findings and conclusions, as well as any recommendations for legislation and administrative actions.

Don't Weaponize the IRS Act This bill codifies regulations promulgated by the Trump Administration exempting certain tax-exempt organizations from specified reporting requirements. Specifically the bill increases from $5,000 to $50,000 the gross receipts threshold used to determine the eligibility of tax-exempt organizations for the exemption from certain disclosure and reporting requirements; expands the definition of organization to include tax-exempt charitable organizations and organizations with no significant activities relating to lobbying, political activity, and the operation of a trade or business; exempts from disclosure the names and addresses of contributors to an organization in its annual informational return; and extends exemptions from reporting requirements to political action committees (i.e., 527 organizations).

Truck Parking Safety Improvement Act This bill directs the Department of Transportation (DOT) to provide competitive grants for projects that provide public parking for commercial motor vehicles and improve the safety of commercial motor vehicle drivers. States, metropolitan planning organizations, tribal governments, and local governments are eligible for these grants. The grants must be used for projects on federal-aid highways or a facility with reasonable access to such a highway or a freight facility. In providing grants, DOT must determine that there is a shortage of commercial motor vehicle parking capacity in the corridor in which the project is located; the eligible entity has consulted with motor carriers, commercial motor vehicle drivers, public safety officials, and private providers of commercial motor vehicle parking regarding the project; the project will likely increase the availability or utilization of commercial motor vehicle parking, facilitate the efficient movement of freight or improve highway safety, traffic congestion, and air quality; and the eligible entity has demonstrated the ability to provide for the maintenance and operation of the facility. To the maximum extent practicable, DOT must select grant projects that maximize the geographic dispersion of new commercial motor vehicle parking capacity across the United States.

Equal Campus Access Act of 2023 This bill prohibits funding made available under the Higher Education Act of 1965 from being provided to any public institution of higher education (IHE) that denies to religious student organizations any right, benefit, or privilege that is otherwise afforded to other student organizations at the IHE because of the religious beliefs, practices, speech, leadership standards, or standards of conduct of the religious student organization.

Honoring Our Fallen Heroes Act of 2023 This bill extends death and disability benefits under the Public Safety Officers' Benefits Program (PSOB) to certain public safety officers who suffer from exposure-related cancer while on duty and their survivors. The PSOB program provides death, disability, and education benefits to public safety officers who are killed or injured in the line of duty and their survivors. The bill specifies that exposure-related cancer shall be presumed to constitute a personal injury in the line of duty if the public safety officer was exposed to or in contact with heat, radiation, or a carcinogen that is linked to an exposure-related cancer; the officer began serving as an officer not later than 5 years before the date of the diagnosis of an exposure-related cancer and the diagnosis occurred not later than 15 years after the last date of active service; and the exposure-related cancer directly and proximately resulted in the death or permanent and total disability of the officer. The Department of Justice's Bureau of Justice Assistance (BJA) must periodically review the definition of exposure-related cance r. It directs the BJA to add additional cancers to the definition under certain circumstances (e.g., a petition process).

Let Experienced Pilots Fly Act This bill raises the mandatory retirement age for pilots engaged in commercial aviation operations from 65 to 67 years of age, unless the operation takes place in (1) the territorial airspace of a foreign county where such operations are prohibited by the foreign country, or (2) international airspace where such operations are not in compliance with the Annexes to the Convention on International Civil Aviation.

American Innovation and Jobs Act This bill revises and expands the deductibility of research and experimental expenditures to allow immediate expensing of such expenditures. It also allows the amortization over a period of at least 60 months of certain other types of research and experimental expenditures not treated as expenses. The bill increases the maximum amount eligible for the tax credit for new and small businesses and increases to 20% the rate of the credit for business startups.

This bill establishes a commission to develop a comprehensive grand strategy and whole-of-government approach with respect to the U.S.-China relationship. The purposes of the commission include (1) defining steps to build a stable international order that includes China, (2) providing recommendations to protect U.S. national security interests, and (3) ensuring a holistic approach towards China across all federal departments and agencies. Membership on the commission includes 6 specified executive branch officials and 12 members nominated by designated congressional leaders. The commission is required to issue a final report on its findings and recommendations no later than September 1, 2025.

Hello Girls Congressional Gold Medal Act of 2023 This bill provides for the award of a single Congressional Gold Medal in honor of the female telephone operators of the Army Signal Corps, commonly known as the Hello Girls , in recognition of their military service, devotion to duty, and 60-year struggle for veterans' benefits and recognition as soldiers.

Modification to Department of Defense Travel Authorities for Abortion-Related Expenses Act of 2023 This bill prohibits the Department of Defense (DOD) from providing certain funding related to abortion services. First, the bill terminates the DOD memorandum titled Ensuring Access to Reproductive Health Care (October 20, 2022). Such memo sets forth DOD policies and procedures in response to the Supreme Court's ruling in Dobbs v. Jackson Women's Health Organization . Under the bill, DOD may not obligate or expend funds to carry out the objectives of the memo or any successor memo. Next, the bill prohibits DOD from providing any actual or necessary expenses of travel or transportation related to official travel for a member of the Armed Forces or a dependent of such a member who is seeking an abortion or any abortion-related service (except in the case of rape or incest, or when the mother's life is in danger). The bill provides that limited access of a member of the Armed Forces or a dependent to an abortion or abortion-related services due to the member's duty location does not constitute an unusual, extraordinary, hardship, or emergency circumstance for which travel and transportation allowances may be provided (except in the case of rape or incest, or when the mother's life is in danger). The bill also prohibits a member of the Armed Forces from taking convalescent leave or using an administrative absence for travel related to receiving an abortion or abortion-related service (except in the case of rape or incest, or when the mother's life is in danger).

Consumer and Fuel Retailer Choice Act of 2023 This bill amends the Clean Air Act to address the limitations on Reid Vapor Pressure (a measure of gasoline's volatility) that are placed on gasoline during the summer ozone season. Specifically, the bill applies the waiver for Reid Vapor Pressure requirements that are applicable to gasoline blended with 10% ethanol (E10) to gasoline blended with more than 10% ethanol. This change allows gasoline that is blended with more than 10% ethanol to be sold year round.

Airline Operational Resiliency Act of 2023 This bill requires the Government Accountability Office (GAO) to study and report on air carriers' operational preparedness for changing weather and other events related to changing conditions and natural hazards (e.g., flooding, extreme heat, storms, and fire conditions). GAO must also make recommendations for any related legislative and administrative action. As part of the study, GAO must assess the extent to which air carriers are preparing for weather events and natural disasters, as well as changing conditions, that may have an impact on air carriers' operational investments, staffing levels and safety policies, and mitigation strategies; how the Federal Aviation Administration oversees air carriers' operational resilience to these types of events; and steps the federal government and air carriers can take to improve their operational resilience.

National Advisory Council on Indian Education Improvement Act or the NACIE Improvement Act This bill revises the membership and duties of the National Advisory Council on Indian Education. Specifically, the bill requires the President to ensure that the council includes at least one member who is the president of a tribal college or university. Additionally, the bill requires the council to submit its annual report to the Department of Education (ED) and the Department of the Interior. ED and Interior must consider the council's report when preparing their budget materials.

Governing Unaccredited Representatives Defrauding VA Benefits Act of 2023 or the GUARD VA Benefits Act of 2023 This bill imposes criminal penalties on individuals for directly or indirectly soliciting, contracting for, charging, or receiving any unauthorized fee or compensation with respect to the preparation, presentation, or prosecution of any claim for Department of Veterans Affairs benefits. The commission or attempted commission of such offenses is punishable by a fine, imprisonment for up to one year, or both.

Precision Agriculture Loan Act of 202 3 This bill establishes a loan program within the Farm Service Agency to assist agricultural producers in purchasing precision agriculture technology, such as geospatial mapping, data management and analytics software, and network connectivity products and solutions. Precision agriculture refers to managing, tracking, or reducing crop or livestock production inputs, including seed, feed, fertilizer, chemicals, water, and time, at a heightened level of spatial and temporal granularity to improve efficiencies, reduce waste, and maintain environmental quality.

Producing Responsible Energy and Conservation Incentives and Solutions for the Environment Act of 2023 or the PRECISE Act of 2023 This bill incorporates support for precision agriculture into various programs of the Department of Agriculture (USDA). Precision agriculture refers to managing, tracking, or reducing crop or livestock production inputs, including seed, feed, fertilizer, chemicals, water, and time, at a heightened level of spatial and temporal granularity to improve efficiencies, reduce waste, and maintain environmental quality. Precision agriculture technology includes any technology and equipment that directly contributes to a reduction in, or improved efficiency of, inputs used in crop or livestock production. Specifically, the bill makes changes to eligibility criteria, administrative procedures, and other aspects of the Conservation Loan Program, the Environmental Quality Incentives Program, and the Conservation Stewardship Program. These changes include allowing the programs to support the adoption of precision agriculture practices and acquisition of precision agriculture technologies. In addition, the bill expands a program through which USDA makes and insures loans to for-profit and nonprofit organizations that invest in rural areas by allowing the loans to be used for precision agriculture practices. Also, USDA must emphasize the use of third-party providers when providing technical assistance on matters related to soil health for participants in certain USDA conservation programs.

Restricting the Emergence of Security Threats that Risk Information and Communications Technology Act or the RESTRICT Act This bill requires federal actions to identify and mitigate foreign threats to information and communications technology (ICT) products and services (e.g., social media applications). It also establishes civil and criminal penalties for violations under the bill. Specifically, the Department of Commerce must identify, deter, disrupt, prevent, prohibit, investigate, and mitigate transactions involving ICT products and services (1) in which any foreign adversary (such as China) has any interest, and (2) that pose an undue or unacceptable risk to U.S. national security or the safety of U.S. persons. Additionally, Commerce must identify and refer to the President any covered holding (e.g., stock or security) that poses an undue or unacceptable risk to U.S. national security or the security and safety of U.S. persons. If the President determines that the holding poses such a risk, the President may compel divestment of or otherwise mitigate the risk associated with the holding. Commerce may (1) designate any foreign government or regime as a foreign adversary upon a determination that the foreign government or regime is engaged in a long-term pattern or serious instances of conduct significantly adverse to U.S. national security or the security and safety of U.S. persons, and (2) remove such a designation. Commerce must notify Congress before making or removing a designation; these actions are subject to congressional disapproval. The bill outlines (1) enforcement mechanisms, including actions by the Department of Justice; and (2) civil and criminal penalties for violations.

Veteran Improvement Commercial Driver License Act of 2023 This bill authorizes approval of certain commercial driver education programs for purposes of Department of Veterans Affairs (VA) educational assistance if the programs meet specified requirements. Under current law, the VA may not approve enrollment of a veteran in courses for programs that do not lead to a standard degree that are offered at a new branch (i.e., a branch that has been operating for less than 2 years) of an educational institution. Under the bill, a commercial driver education program offered at a new branch of an educational institution may be approved if it is appropriately licensed and uses the same curriculum as a commercial driver education program offered by the educational institution at another location that is already approved for purposes of VA educational assistance. The educational institution must submit a report demonstrating the curriculum at the new branch is the same as the curriculum at the primary location in order to be exempt from the current prohibition against course approval at new branches.

Safe Step Act This bill requires a group health plan to establish an exception to medication step-therapy protocol in specified cases. A medication step-therapy protocol establishes a specific sequence in which prescription drugs are covered by a group health plan or a health insurance issuer. A request for such an exception to the protocol must be granted if (1) an otherwise required treatment has been ineffective, (2) such treatment is expected to be ineffective and delaying effective treatment would lead to irreversible consequences, (3) such treatment will cause or is likely to cause an adverse reaction to the individual, (4) such treatment is expected to prevent the individual from performing daily activities or occupational responsibilities, (5) the individual is stable based on the prescription drugs already selected, or (6) there are other circumstances as determined by the Employee Benefits Security Administration. The bill requires a group health plan to implement and make readily available a clear process for an individual to request an exception to the protocol, including required information and criteria for granting an exception. The bill further specifies timelines under which plans must respond to such requests.

Title X Abortion Provider Prohibition Act This bill prohibits the Department of Health and Human Services (HHS) from awarding family planning grants to entities that perform abortions or provide funding to other entities that perform abortions. To receive a grant, an entity must certify it will refrain from those activities during the grant period. The bill provides exceptions for abortions (1) in cases of rape or incest; or (2) when the life of the woman is in danger due to a physical disorder, injury, or illness. It also exempts hospitals unless they provide funds to non-hospital entities that provide abortions. HHS must report annually on this prohibition.

Social Security Fairness Act This bill repeals provisions that reduce Social Security benefits for individuals who receive other benefits, such as a pension from a state or local government. The bill eliminates the government pension offset , which in various instances reduces Social Security benefits for spouses, widows, and widowers who also receive government pensions of their own. The bill also eliminates the windfall elimination provision , which in some instances reduces Social Security benefits for individuals who also receive a pension or disability benefit from an employer that did not withhold Social Security taxes. These changes are effective for benefits payable after December 2023.

Credit Union Board Modernization Act This bill revises the required frequency of meetings held by a credit union's board of directors. Specifically, new credit unions and credit unions with a low soundness rating must meet monthly. All other credit unions must hold at least six meetings annually, with at least one meeting held during each fiscal quarter. Currently, all credit union boards must meet at least once a month.

Recruit and Retain Act This bill expands the Community Oriented Policing Services (COPS) grant program to support recruitment efforts by law enforcement agencies. Specifically, the bill expands the COPS program by allowing funds to be used for reducing application-related fees (e.g., fees for background checks, psychological evaluations, and testing); and directing the Department of Justice (DOJ) to award competitive grants to partnerships between law enforcement agencies and educational institutions (e.g., elementary and secondary schools and institutions of higher education) for recruiting activities, such as for career and job fairs. The bill requires DOJ to establish guidance for understaffed law enforcement agencies applying for COPS grants. The Government Accountability Office must study and report on the effects of recruitment and attrition rates on federal, state, tribal, and local law enforcement agencies.

Energy Security Cooperation with Allied Partners in Europe Act of 2023 This bill establishes requirements related to U.S. international energy strategy. Applications to export natural gas to North Atlantic Treaty Organization (NATO) member countries, Japan, and certain other countries must be granted on an expedited basis without modification or delay. The President must impose sanctions on a person (individual or entity) that provides certain equipment, investment, or services to the Russian government or related entities for constructing or servicing Russian energy export pipelines. The Department of State must report to Congress on a strategy to enhance the energy security of NATO member countries and increase U.S. energy exports to such countries.

This resolution condemns Iran's state-sponsored persecution of the Baha'i religious minority and Iran's continued violation of international human rights treaties. The resolution calls on Iran to (1) immediately release Baha'is and others imprisoned or detained solely on account of religion, (2) end its state-sponsored campaign of hate propaganda against the Baha'is, and (3) reverse certain policies that discriminate against Baha'is and other religious minorities. The resolution also urges the President and the Department of State to impose sanctions on Iranian officials and others who are responsible for serious human rights abuses, including abuses against Iran's Baha'i community.

Iran Nuclear Treaty Act This bill requires Senate approval of certain actions with respect to Iran's nuclear program. Specifically, the bill deems any agreement reached between the President and Iran relating to Iran's nuclear program to be a treaty that is subject to the advice and consent of the Senate. Further, the bill prohibits the President from (1) limiting the application of certain sanctions, or (2) refraining to apply such sanctions pursuant to an agreement unless the agreement is subject to the advice and consent of the Senate as a treaty.

This resolution condemns China's violation of U.S. sovereignty and denounces the Chinese Communist Party's efforts to deceive through false claims about its intelligence collection campaigns in violation of U.S. sovereignty. Firearm Industry Non-Discrimination Act or the FIND Act This bill prohibits the federal government from entering into contracts with an entity that discriminates against firearm trade associations or businesses that deal in firearms, ammunition, or related products. Specifically, the bill requires a federal agency to include in each contract for the procurement of goods or services awarded by the agency a clause requiring the prime contractor to certify that it (1) has no policy, practice, guidance, or directive that discriminates against a firearm entity or firearm trade association; and (2) will not adopt a policy, practice, guidance, or directive that discriminates against a firearm entity or firearm trade association during the term of the contract. The bill establishes (1) a similar requirement with respect to subcontracts, and (2) penalties for violations. The bill makes such prohibition inapplicable to a contract for the procurement of goods or services that is a sole-source contract.

UNRWA Accountability and Transparency Act This bill makes changes to U.S. foreign policy in matters concerning the United Nations Relief and Works Agency for Palestine Refugees in the Near East (UNRWA). For purposes of this policy, the bill defines Palestinian refugee as a person who (1) resided from June 1946 to May 1948 in Mandatory Palestine (a region controlled by Britain until 1948), (2) was personally displaced as a result of the 1948 Arab-Israeli conflict, and (3) has not accepted citizenship or other permanent adjustment in status in another country. Furthermore, under U.S. policy, derivative refugee status may only extend to the spouse or minor child of such a Palestinian refugee. The bill withholds U.S. funding for the UNRWA unless the Department of State makes certifications concerning the UNRWA's staff, partners, and funding. Specifically, the State Department must certify that neither UNRWA staff and partners nor its funding and facilities are affiliated with terrorism or disseminating certain rhetoric, such as calling for the destruction of Israel or describing Israelis as occupiers or settlers . Additionally, the State Department must certify that the UNRWA is (1) subject to comprehensive independent financial audits, and (2) not affiliated with any financial institutions complicit in money laundering or terror financing. The State Department must also implement a plan to encourage other countries to align their UNRWA-related activities with U.S. policy objectives, including the phaseout of the UNRWA by resettling Palestinian refugees outside of Israel.
