Promotion and Expansion of Private Employee Ownership Act of 201 9 This bill expands tax incentives and federal assistance for employee stock ownership plans (ESOPs) that are sponsored by S corporations. The bill extends to all domestic corporations, including S corporations, provisions allowing deferral of tax on gain from the sale of employer securities to an ESOP. The Department of the Treasury must establish the S Corporation Employee Ownership Assistance Office to foster increased employee ownership of S corporations. The bill defines an "ESOP business concern" and allows such a concern to continue to qualify as a small business for the purposes of programs under the Small Business Act. An "ESOP business concern" is a business concern that was a small business concern eligible for a loan, preference, or other program under the Small Business Act before more than 49% of the business concern was acquired by an ESOP.

This resolution expresses the sense of the Senate that Congress should expeditiously consider codifying into law the Protecting Life in Global Health Assistance policy, which prohibits U.S. foreign assistance funds from going to organizations that perform abortions or actively promote them for family planning.

Supporting Veterans in STEM Careers Act This bill addresses the participation of veterans in STEM (science, technology, engineering, and mathematics) fields, including by making veterans eligible for certain National Science Foundation (NSF) programs. The bill directs the NSF to (1) encourage veterans to study and pursue careers in STEM and computer science in coordination with other federal agencies that serve veterans, and (2) submit a plan to Congress for enhancing veterans outreach. The National Science Board shall provide in its annual report on the state of science and engineering in the United States relevant data on veterans in science and engineering careers or education programs. The bill provides for veterans' participation and outreach in (1) the Robert Noyce Teacher Scholarship program to recruit and train mathematics and science teachers, (2) NSF fellowships and masters fellowships for mathematics and science teachers, (3) computer and network security capacity building grants, and (4) traineeship grants leading to a doctorate degree in computer and network security research. The Office of Science and Technology Policy shall establish an interagency working group to coordinate federal programs and policies for transitioning and training veterans and military spouses for STEM careers.

Telephone Robocall Abuse Criminal Enforcement and Deterrence Act or the TRACED Act This bill implements a forfeiture penalty for violations (with or without intent) of the prohibition on certain robocalls. The bill also removes an annual reporting requirement for enforcement relating to unsolicited facsimile advertisements. The bill requires voice service providers to develop call authentication technologies. The Federal Communications Commission (FCC) shall promulgate rules establishing when a provider may block a voice call based on information provided by the call authentication framework, but also must establish a process to permit a calling party adversely affected by the framework to verify the authenticity of their calls. The FCC shall also initiate a rulemaking to help protect a subscriber from receiving unwanted calls or texts from a caller using an unauthenticated number. This bill requires the Department of Justice and the FCC to assemble an interagency working group to study and report to Congress on the enforcement of the prohibition of certain robocalls. Specifically, the working group will look into how to better enforce against robocalls by examining issues like the types of laws, policies, or constraints that could be inhibiting enforcement. The bill requires the FCC to initiate a proceeding to determine whether its policies regarding access to number resources could be modified to help reduce access to numbers by potential robocall violators.

Pain-Capable Unborn Child Protection Act This bill establishes a new criminal offense for performing or attempting to perform an abortion if the probable post-fertilization age of the fetus is 20 weeks or more. A violator is subject to criminal penalties—a fine, a prison term of up to five years, or both. The bill provides exceptions for an abortion (1) that is necessary to save the life of the pregnant woman, or (2) when the pregnancy is the result of rape or incest. A physician who performs or attempts to perform an abortion under an exception must comply with specified requirements. A woman who undergoes a prohibited abortion may not be prosecuted for violating or conspiring to violate the provisions of this bill.

Health Insurance Tax Relief Act of 2019 This bill delays reimposition of the annual fee on health insurers until 2022. Under current law, the annual fee for a health insurer is calculated based on the insurer's share of total premiums from the preceding year. The fee is suspended for 2019 (i.e., there is no fee based on premiums from 2018); reimposition is scheduled for 2020.

Born-Alive Abortion Survivors Protection Act This bill establishes requirements for the degree of care a health care practitioner must exercise in the event a child is born alive following an abortion or attempted abortion. A health care practitioner who is present must (1) exercise the same degree of care as reasonably provided to another child born alive at the same gestational age, and (2) immediately admit the child to a hospital. The bill also requires a health care practitioner or other employee to immediately report any failure to comply with this requirement to law enforcement. A person who violates the requirements is subject to criminal penalties—a fine, up to five years in prison, or both. Additionally, an individual who intentionally kills or attempts to kill a child born alive is subject to prosecution for murder. The bill bars the criminal prosecution of a mother of a child born alive for conspiracy to violate these provisions, for being an accessory after the fact, or for concealment of felony. A woman who undergoes an abortion or attempted abortion may file a civil action for damages against an individual who violates this bill.

Merchant Mariners of World War II Congressional Gold Medal Act of 2019 This bill provides for a Congressional Gold Medal to be awarded to the U.S. Merchant Mariners of World War II, in recognition of their service during World War II. Following the award of the medal, it shall be given to the American Merchant Marine Museum, where it shall be available for display and research.

Child Interstate Abortion Notification Act This bill creates new federal crimes related to transporting a minor across state lines for an abortion. It makes it a crime to knowingly transport a minor to another state to obtain an abortion without satisfying a parental involvement law in the minor's resident state. A parental involvement law requires parental consent or notification, or judicial authorization, for a minor to obtain an abortion. The bill prohibits an individual who has committed incest with a minor from knowingly transporting the minor across a state line to receive an abortion. Finally, it makes it a crime for a physician to knowingly perform or induce an abortion on an out-of-state minor without first complying with parental notification requirements.

Regulations from the Executive in Need of Scrutiny Act of 2019 This bill revises provisions relating to congressional review of agency rulemaking. Specifically, the bill establishes a congressional approval process for a major rule. A major rule may only take effect if Congress approves of the rule. A major rule is a rule that results in (1) an annual effect on the economy of $100 million or more; (2) a major increase in costs or prices for consumers, individual industries, government agencies, or geographic regions; or (3) significant adverse effects on competition, employment, investment, productivity, innovation, or the ability of U.S.-based enterprises to compete with foreign-based enterprises. In addition, the bill establishes a congressional disapproval process for a nonmajor rule. A nonmajor rule may only take effect if Congress does not disapprove of the rule.

No Taxpayer Funding for Abortion and Abortion Insurance Full Disclosure Act of 2019 This bill modifies provisions relating to federal funding for, and health insurance coverage of, abortions. Specifically, the bill prohibits the use of federal funds for abortions or for health coverage that includes abortions. Such restrictions extend to the use of funds in the budget of the District of Columbia. Additionally, abortions may not be provided in a federal health care facility or by a federal employee. Historically, language has been included in annual appropriations bills for the Department of Health and Human Services (HHS) that prohibits the use of federal funds for abortions—such language is commonly referred to as the Hyde Amendment. Similar language is also frequently included in appropriations bills for other federal agencies and the District of Columbia. The bill makes these restrictions permanent and extends the restrictions to all federal funds (rather than specific agencies). The bill's restrictions regarding the use of federal funds do not apply in cases of rape, incest, or where a physical disorder, injury, or illness endangers a woman's life unless an abortion is performed. The Hyde Amendment provides the same exceptions. The bill also prohibits qualified health plans from including coverage for abortions. Currently, qualified health plans may cover abortion, but the portion of the premium attributable to abortion coverage is not eligible for subsidies.

Medical Expense Savings Act This bill makes permanent the reduction in the adjusted gross income threshold that must be exceeded before a taxpayer is allowed to claim an itemized tax deduction for medical expenses. (In 2017, the threshold was temporarily reduced from 10% to 7.5% for 2017 and 2018. This bill makes the 7.5% threshold permanent.)

Community Health Investment, Modernization, and Excellence Act of 2019 This bill reauthorizes for FY2020-FY2024 and makes appropriations for the Community Health Center Fund, which provides enhanced funding for the community health center program and the National Health Service Corps.

Title X Abortion Provider Prohibition Act This bill prohibits the Department of Health and Human Services (HHS) from awarding federal family planning grants to entities that provide, or that financially support the provision of, abortions. Specifically, in order to receive such grants, entities must certify that, during the period of the grant, they will not perform abortions or provide funds to entities that perform abortions. Exceptions are made for abortions where (1) the pregnancy is the result of rape or incest; or (2) a physician certifies that the woman suffered from a physical disorder, injury, or illness that would place the woman in danger of death unless an abortion is performed, including a condition caused by or arising from the pregnancy. Hospitals are exempted unless they provide funds to non-hospital entities that perform abortions. HHS must include in an annual report (1) information on grantees who performed abortions under the exceptions, and (2) a list of entities to which grant funds are made available.

End Government Shutdowns Act This bill provides continuing appropriations to prevent a government shutdown if any appropriations measure for a fiscal year has not been enacted before the fiscal year begins or a joint resolution making continuing appropriations is not in effect. For an initial 120-day period, the bill provides appropriations to continue programs, projects, and activities for which funds were provided in the preceding fiscal year. The bill reduces the continuing appropriations by 1% after the first 120-day period and by an additional 1% for each subsequent 90-day period until the applicable appropriations legislation is enacted.

Constitutional Concealed Carry Reciprocity Act of 2019 This bill allows a qualified individual to carry a concealed handgun into or possess a concealed handgun in another state that allows its residents to carry concealed firearms. A qualified individual must (1) be eligible to possess, transport, or receive a firearm under federal law; (2) carry a valid photo identification document; and (3) carry a valid state-issued concealed carry permit, or be eligible to carry a concealed firearm in his or her state of residence.

Constitutional Amendment This joint resolution proposes a constitutional amendment prohibiting total outlays for a fiscal year from exceeding total receipts for that fiscal year unless Congress authorizes the excess by a two-thirds vote of each chamber. The prohibition excludes outlays for repayment of debt principal and receipts derived from borrowing. The amendment prohibits total outlays for any fiscal year from exceeding 18% of the gross domestic product of the United States, unless two-thirds of each house of Congress provides for a specific increase above this amount. The amendment requires a two-thirds vote of each chamber of Congress to impose a new tax, increase the statutory rate of any tax, or increase the aggregate amount of revenue. It requires a three-fifths vote of each chamber to increase the limit on the debt of the United States. The President must submit an annual budget in which total outlays do not exceed total receipts and 18% of the gross domestic product of the United States. The amendment prohibits a court from ordering a revenue increase to enforce the requirements. Congress may waive specified requirements when a declaration of war is in effect or the United States is engaged in a military conflict which causes an imminent and serious military threat to national security.

Ensuring Lawful Collection of Hidden Assets to Provide Order Act or the EL CHAPO Act This bill requires the forfeited profits of Joaquin Archivaldo Guzman Loera (El Chapo) from his illicit drug trafficking enterprise to be reserved for border security measures between the United States and Mexico, including the completion of a wall. Additionally, it requires the forfeited funds from the felony conviction of a member of a drug cartel to be reserved for border security measures between the United States and Mexico, including the completion of a wall.

This resolution urges the President to work with allies to lead a multinational freedom of navigation operation in the Black Sea to push back against excessive Russian claims of sovereignty. It also calls for the North Atlantic Treaty Organization to enhance allied maritime presence and capabilities in the Black Sea and for European governments to cancel the Nord Stream 2 pipeline due to its threat to European energy security. The resolution also urges the President to provide additional security assistance to Ukraine and states that the President is required by statute to impose mandatory sanctions on Russia.

Iranian Revolutionary Guard Corps Economic Exclusion Act This bill expands sanctions against Iran's Islamic Revolutionary Guard Corps (IRGC). The President shall report to Congress regarding: foreign and domestic supply chains that significantly aid the IRGC; Iranian state-owned entities that provide support to terrorist entities, including Mahan Air; and foreign persons owned or controlled by the IRGC, including companies listed on the Tehran Stock Exchange or companies with a value in excess of $100 million. The bill states that it is U.S. policy to prevent Iran's membership in the World Trade Organization and similar international bodies as long as Iran remains a state sponsor of terrorism.

UAS Critical Infrastructure Protection Act This bill amends the FAA Extension, Safety, and Security Act of 2016 to include railroad facilities among the critical infrastructure to be considered fixed site facilities for purposes of prohibiting or restricting the operation of an unmanned aircraft (i.e., a drone) in close proximity to such facilities. Other fixed site facilities may include military installations, oil refineries and chemical facilities, or amusement parks. The Federal Aviation Administration must publish a notice of proposed rulemaking by March 31, 2019, for carrying out the the process for prohibiting or restricting the operation of drones near fixed site facilities, and then issue a final rule within 12 months after publishing the notice of proposed rulemaking.

Increased Aviation Safety through Contract Towers Act This bill authorizes the Department of Transportation to provide grants to an airport sponsor for the construction or improvement of a nonapproach control tower and for the acquisition and installation of air traffic control, communications, and related equipment to be used in that tower.

Paid Family Leave Pilot Extension Act of 2018 This bill amends the Internal Revenue Code to extend through 2022 the tax credit for employers who provide employees with paid family and medical leave. The bill also requires the Government Accountability Office to: (1) examine the effectiveness of the tax credit for paid family and medical leave, (2) recommend ways to modify or enhance the tax credit to further promote access to paid family and medical leave for qualifying employees, and (3) suggest alternative policies that federal and state governments could implement to increase access to paid family and medical leave.

Hidden Figures Congressional Gold Medal Act This bill requires the Speaker of the House of Representatives and President pro tempore of the Senate to arrange for the presentation of: one Congressional Gold Medal to Katherine Johnson, in recognition of her service to the United States as a mathematician; one Congressional Gold Medal to Dr. Christine Darden, for her service to the United States as an aeronautical engineer; and two Congressional Gold Medals in commemoration of the lives of Dorothy Vaughan and Mary Jackson, in recognition of their service to the United States during the Space Race.

Securing and Revitalizing Aviation Act of 2018 or the SARA Act of 2018 This bill directs the Federal Aviation Administration (FAA) to establish a program to provide grants to support the education of future aircraft pilots and the development of the aircraft pilot workforce. The FAA shall (1) assign to the Aviation Rulemaking Advisory Committee the task of reviewing all regulations and policies related to designated pilot examiners, (2) review the process of reserving aircraft registration numbers and enact appropriate changes to ensure the fair participation by the general public, and (3) provide air traffic services and aviation safety support for aviation events without charge. The bill amends the FAA Extension, Safety, and Security Act of 2016 to modify FAA tower marking requirements. The bill amends the Volunteer Protection Act of 1997 with respect to liability protection for volunteer pilots who fly for the public benefit.

Sanction Terrorist Operations Using Human Shields Act of 2018 or the STOP Using Human Shields Act This bill provides for the imposition of sanctions on members of foreign terrorist organizations, including Hamas and Hizballah, and other foreign persons, agencies, or instrumentalities of foreign states with regard to use of civilians, other specially protected persons, or specially protected property to shield lawful targets from attack or to deliberately cause casualties to such persons or the destruction to such property during an armed conflict.

Gold Star Spouses Leasing Relief Act This bill amends the Servicemembers Civil Relief Act to permit a widow or widower of a service member who died while in military service to terminate a lease of premises occupied, or intended to be occupied, by the service member or the service member's dependents for a residential, professional, business, agricultural, or similar purpose without penalty within one year of the service member's death.

Primary Regulators of Insurance Vote Act of 2018 This bill amends the Financial Stability Act of 2010 to establish a state insurance commissioner as a voting member of the Financial Stability Oversight Council. The member is appointed by the President with the advice and consent of the Senate. Under current law, this member is nonvoting and selected by state insurance commissioners.

Securing All Livestock Equitably Act of 2018 or the SALE Act of 201 8 This bill amends the Packers and Stockyards Act, 1921 to require all livestock purchased by a dealer in cash sales and all inventories of, or receivables or proceeds from, such livestock to be held by the dealer in a trust until all unpaid cash sellers of the livestock have been paid. The bill exempts from the requirement any dealer whose average annual purchases of livestock do not exceed $250,000. A dealer and cash seller may voluntarily waive the requirement using a written agreement that meets specified requirements. The bill also specifies requirements regarding enforcement, preserving a trust, notifying lien holders, and purchasing or transferring livestock that is subject to a trust.

Keep Families Together and Enforce the Law Act This bill amends the Immigration and Nationality Act to authorize the Department of Homeland Security (DHS) to extend protective custody over alien children under age 18 who are accompanied by a parent and apprehended at the border or are seeking admission to the United States at a port of entry. DHS must temporarily house an alien child under age 18 in a family residential center during the pendency of civil or criminal proceedings. DHS must increase the number of available beds in family residential centers. The Department of Justice must increase the number of immigration judge teams to conduct prioritized proceedings for accompanied alien children and families apprehended at the southwest border or who are seeking admission to the United States at a port of entry.

Health Insurance Tax Relief Act of 2018 This bill amends the Patient Protection and Affordable Care Act to delay until 2021 the reimposition of the annual fee on certain health insurance providers based on market share. Under current law, the fee is suspended for 2019 and is scheduled to be reimposed in 2020.

Victims of Child Abuse Act Reauthorization Act of 2018 (Sec. 2) This bill reauthorizes for FY2019-FY2023 grants for local and regional children's advocacy centers (CACs), as well as for technical assistance and training. CACs coordinate a multidisciplinary response to child abuse. The bill adds a new finding specifying the need for state chapters of CAC networks (1) to help local communities coordinate their multidisciplinary services, and (2) to provide oversight of, and training and technical assistance in, the effective delivery of evidence-informed programming. It modifies grants for regional CACs, including to add, as a new program objective, collaboration with state chapters; and to require regional CACs to assist local CACs, multidisciplinary teams, and state chapters, in addition to communities. It also modifies grants for local CACs, including to add, as a new grant purpose, promoting the effective delivery of the evidence-informed Children's Advocacy Model and the multidisciplinary response to child abuse; to allow grants to support direct services for victims of human trafficking, in addition to victims of child pornography; and to require a portion of grants to be distributed to state chapters. The Department of Justice must report annually on efforts to monitor and evaluate the program activities of regional CACs and the extent to which both urban and rural populations are served by the regional CAC program. (Sec. 3) The bill provides immunity from civil and criminal liability under federal, state, and local law for people who make good-faith reports of child abuse or neglect or who provide related information or assistance.

Congressional Accountability Act of 1995 Reform Act This bill amends the Congressional Accountability Act of 1995 (CAA) to revise administrative and judicial dispute resolution procedures for initiating and resolving claims by employees alleging that employing offices have violated their CAA rights and protections, including protections against sexual harassment. The bill revises CAA provisions, including to: eliminate CAA counseling requirements and make mediation an employee's option before filing a claim with the Office of Compliance (OOC) alleging the violation; require current and former Members of Congress to reimburse the Treasury for compensatory damages included in an award or settlement resulting from the Member's alleged act of discrimination or retaliation; require referral to congressional ethics committees of final disposition of claims alleging CAA violations by Members of Congress and senior staff of employing offices; require non-congressional legislative offices that violate CAA requirements to reimburse the Treasury for resulting award or settlement payments; extend CAA nondiscrimination requirements and remedies to uncompensated legislative branch interns, detailees, and fellows; and provide OOC and CAA resources and services to employees outside of the Washington, DC area. The bill applies CAA rights and protections to the China Review Commission, the Congressional-Executive China Commission, the Helsinki Commission, the John C. Stennis Center for Public Service Training and Development, and their employees. Non-congressional CAA employing offices must develop programs to train and educate employees about their CAA rights and protections and available procedures to consider alleged CAA violations. The bill renames the OOC the Office of Congressional Workplace Rights.
