Special Counsel Independence and Integrity Act This bill sets forth requirements and limitations with respect to the removal from office of a special counsel appointed by the Attorney General, or of another official appointed by the Attorney General who exercises a similar degree of independence from the Department of Justice (DOJ) chain of command. Specifically, a special counsel or other appointed official: may only be removed by the Attorney General or the most senior Senate-confirmed DOJ official, in certain circumstances; may only be removed for misconduct, dereliction of duty, incapacity, conflict of interest, or other good cause; must be provided written notice that specifies the reason for removal; and may file an action to challenge the removal not later than 10 days after notice was provided.

Ending the Fentanyl Crisis Act of 2018 This bill amends the Controlled Substances Act and the Controlled Substances Import and Export Act to modify the drug quantity thresholds that trigger a mandatory minimum prison term for a defendant who manufactures, distributes, imports, exports, or possesses with intent to distribute fentanyl. Specifically, the bill reduces from 400 to 20 grams the fentanyl quantity and from 100 to 5 grams the fentanyl analogue quantity that trigger a 10-year or 20-year mandatory minimum prison term for high-level first-time or repeat offenders. It also reduces from 40 to 2 grams the fentanyl quantity and from 10 to 0.5 grams the fentanyl analogue quantity that trigger a 5-year or 10-year mandatory minimum prison term for low-level first-time or repeat offenders. Additionally, the bill directs the U.S. Postal Service to increase the availability of chemical screening devices and dedicate the appropriate number of personnel to interdict fentanyl and other substances that are unlawfully imported into the United States.

Secure Elections Act This bill gives the Department of Homeland Security primary responsibility within the federal government for sharing information about election cybersecurity incidents, threats, and vulnerabilities with federal entities and election agencies. The Election Assistance Commission (EAC) shall establish an advisory panel of independent experts to develop guidelines on election cybersecurity, including standards for procuring, maintaining, testing, auditing, operating, and updating election systems. The EAC shall award election system cybersecurity and modernization grants to states and election agencies to implement the advisory panel's guidelines. Grants shall be awarded to: (1) remediate vulnerabilities identified by a cybersecurity evaluation, (2) replace electronic voting systems that are not optical scanners that read paper ballots, and (3) reimburse states for statistical audits of ballots in close federal elections.

Recognizes the 85th anniversary of the Ukrainian Famine (Holodomor) of 1932-1933 and extends sympathies to the victims, survivors, and families of that tragedy. Encourages dissemination of information regarding the famine. Condemns the systematic violations of human rights of the Ukrainian people by the Soviet government. Recognizes the 1988 findings of the Commission on the Ukraine Famine that Joseph Stalin committed genocide against the Ukrainians in 1932-1933. Supports the continuing efforts of the people of Ukraine to work toward ensuring democratic principles, a free-market economy, and full respect for human rights.

Federal Extreme Risk Protection Order Act of 2018 This bill amends the federal criminal code to authorize and establish procedures for a family or household member, or law enforcement officer, to request an extreme risk protection order with respect to an individual who poses an imminent risk to themselves or others. An extreme risk protection order is a federal court order that prohibits a person from owning, possessing, receiving, or having control or custody of a firearm. The bill also expands the categories of prohibited persons (i.e., persons barred from receiving or possessing a firearm or ammunition) to add a new category for persons who are subject to a court order that prohibits them from purchasing, possessing, or receiving a firearm.

School Safety and Mental Health Services Improvement Act of 2018 This bill amends the Elementary and Secondary Education Act of 1965 to allow state and local educational agencies to use certain federal funds for activities related to school safety, including: (1) infrastructure improvements to prevent, mitigate, or respond to incidents of school violence; and (2) professional development for school personnel in mental-health awareness, crisis response, and other programs designed to reduce and prevent school violence. The bill also amends the Public Health Service Act to expand the programs for which the Department of Health and Human Services may provide financial support to assist local communities in helping children deal with violence. Such programs may include those designed to provide mental-health and substance-use disorder assessments, crisis-intervention training, counseling, treatment, and referral. The President must convene an interagency task force to address school safety.

NICS Denial Notification Act of 2018 This bill amends the federal criminal code to require the Department of Justice (DOJ) to report certain information to state and local law enforcement authorities following a determination, by the National Instant Criminal Background Check System, that a prospective firearm purchaser is a prohibited person (i.e., a person who is barred from receiving or possessing a firearm). DOJ must report annually on: (1) certain details regarding denied firearm purchases in each category of prohibited persons, and (2) the number of background check notices reported to states.

Terrorist Firearms Prevention Act This bill authorizes the Department of Justice (DOJ) to deny the transfer of a firearm or explosive, or the issuance of an explosives license or permit, to known or suspected terrorists. Specifically, DOJ may deny a transfer to, or deny a license or permit for, an individual who is included on the No Fly list or the Selectee list. The No Fly and Selectee lists are subsets of the Terrorist Screening Database—the U.S. government's consolidated database of individuals known or reasonably suspected to be involved in terrorist activities. DOJ and federal, state, and local law enforcement must be notified immediately of requests to transfer a firearm or explosive to a person who is, or in the last five years was, identified on the database. The bill establishes a judicial review process for appealing a denial by DOJ.

Ukraine Cybersecurity Cooperation Act of 2018 This bill states that it is U.S. policy to: (1) reaffirm the United States-Ukraine Charter on Strategic Partnership, which highlights the bilateral relationship's importance and outlines enhanced cooperation in defense, security, economics and trade, energy security, democracy, and cultural exchanges; (2) support continued cooperation between the North Atlantic Treaty Organization (NATO) and Ukraine; (3) support Ukraine's political and economic reforms; (4) reaffirm the commitment of the United States to the Budapest Memorandum on Security Assurances; (5) assist Ukraine's efforts to enhance its cybersecurity capabilities; and (6) improve Ukraine's ability to respond to Russian-supported disinformation and propaganda efforts in cyberspace, including through social media. It is the sense of Congress that the Department of State should take the following actions, commensurate with U.S. interests, to help Ukraine improve its cybersecurity: (1) provide Ukraine necessary support to secure government computer networks from cyber intrusions, particularly networks that defend critical infrastructure; (2) provide Ukraine support to reduce reliance on Russian information and communications technology; and (3) help Ukraine build capacity, expand cybersecurity information sharing, and cooperate on international cyberspace efforts. The State Department shall report to Congress on the status of U.S.-Ukraine cybersecurity cooperation.

American Innovation and Manufacturing Act of 2018 This bill directs the Environmental Protection Agency to reduce the use of hydrofluorocarbons through rulemaking. This must include an allowance allocation and trading program and the advancement of new technology to replace hydrofluorocarbons.

Cambodia Accountability and Return on Investment Act of 2018 This bill prohibits assistance for the government of Cambodia unless the Department of State certifies to Congress that Cambodia is taking steps to: (1) strengthen regional security and the enforcement of international sanctions against North Korea, and (2) respect Cambodia's Constitution. The State Department shall continue to restrict the U.S. entry of individuals involved in undermining democracy in Cambodia. The President may prohibit transactions of such individual's U.S.-sited or -controlled property and property interests. The United States shall oppose international financial institution loans and assistance to Cambodia, other than to meet basic human needs, until restrictions on Cambodian officials undermining democracy in Cambodia terminates. Funds are authorized for Khmer-language broadcasting.

Compensating Legacy Artists for their Songs, Service, and Important Contributions to Society Act or the CLASSICS Act This bill provides federal copyright protection for sound recordings fixed before February 15, 1972, specifically the right to make digital transmissions. Currently, pre-1972 recordings are only covered by state law. Pre-1972 recordings will fall within the existing compulsory license system for digital transmissions, which currently only cover post-1972 recordings. The bill preempts claims under state and common law for digital transmission of pre-1972 recordings.

Carryover Equity Act of 2018 This bill amends the National Agricultural Research, Extension, and Teaching Policy Act of 1977 to allow 1890 land-grant colleges and universities (historically black colleges and universities that were established under the Second Morrill Act of 1890 and receive funding from the Department of Agriculture) to carry over all extension funding into the succeeding fiscal year. (Under current law, the institutions are prohibited from carrying over more than 20% of the funds received in any fiscal year.)

Clarifying Lawful Overseas Use of Data Act or the CLOUD Act This bill amends the federal criminal code to specify that an electronic communication service (ECS) or remote computing service (RCS) provider must comply with existing requirements to preserve, backup, or disclose the contents of an electronic communication or noncontent records or information pertaining to a customer or subscriber, regardless of whether the communication or record is located within or outside the United States. An ECS or RCS provider may challenge a domestic warrant that compels disclosure of the contents of an electronic communication if: the customer or subscriber is not a U.S. citizen or national, lawful permanent resident, corporation, or other unincorporated entity; the customer or subscriber does not reside in the United States; and the required disclosure creates a material risk that the provider violates the laws of a foreign government with which the United States has in effect an executive agreement on data access. In response to an order from a foreign government with which the United States has an executive agreement on data access, an ECS or RCS provider may: intercept or disclose the contents of an electronic communication, and disclose the contents of a stored electronic communication or noncontent records or information pertaining to a subscriber or customer. It establishes a framework to allow the United States to enter into executive agreements with foreign governments to govern data access. To be valid, an executive agreement must meet certain requirements, including that the foreign government affords robust procedural privacy protections and adopts minimization procedures. This bill does not preclude a foreign authority from obtaining assistance in a criminal investigation or prosecution.

Music Modernization Act of 2018 This bill amends the copyright law to create a statutory blanket license for making and distributing nondramatic musical sound recordings, including through digital delivery. The blanket license allows digital music services to distribute sound recordings covered by the license without negotiating for the rights for each individual recording, as long as the music service complies with the license's requirements, such as paying the required royalties.

Defending Elections from Threats by Establishing Redlines Act of 2018 This bill requires the Office of the Director of National Intelligence (DNI), no more than 30 days after a U.S. election, to determine whether a foreign government interfered with the election and report on that determination. If the DNI reports that there was not interference and subsequently determines that there was interference, the DNI shall report on the subsequent determination. If the DNI determines that Russia interfered with an election, the President shall impose specified sanctions. The President shall brief Congress on any foreign government the President determines interfered with, or is likely to interfere with, an election.

Pain-Capable Unborn Child Protection Act This bill amends the federal criminal code to make it a crime for any person to perform or attempt to perform an abortion if the probable post-fertilization age of the fetus is 20 weeks or more. A violator is subject to criminal penalties—a fine, up to five years in prison, or both. The bill provides exceptions for an abortion: (1) that is necessary to save the life of the pregnant woman, or (2) when the pregnancy is the result of rape or incest. A physician who performs or attempts to perform an abortion under an exception must comply with specified requirements. A woman who undergoes a prohibited abortion may not be prosecuted for violating or conspiring to violate the provisions of this bill.

BuyAmerican.gov Act of 2018 This bill requires the General Services Administration to establish a publicly available website that contains details regarding waivers of and exceptions to Buy American laws. The website must contain information on all waivers and exceptions that have been requested, are under consideration, or have been granted by federal agencies. The bill also: (1) specifies requirements for granting public interest waivers of Buy American laws; and (2) requires the Department of Commerce to report to Congress and the President on the implementation of, and compliance with, Buy American laws.

Increasing and Mobilizing Partnerships to Achieve Commercialization of Technologies for Energy Act or the IMPACT for Energy Act This bill requires the Department of Energy to establish a nonprofit corporation named the IMPACT for Energy Foundation that provides a mechanism to channel private sector investment into commercial innovative technologies in energy.

Congressional Harassment Reform Act This bill amends the Congressional Accountability Act of 1995 (CAA) to: (1) require certain discrimination and harassment awareness and prevention training for Members of Congress, officers, employees, interns, fellows, and detailees; (2) extend CAA nondiscrimination requirements and remedies to legislative interns, fellows, and detailees; (3) revise CAA procedures for certain harassment and discrimination complaints; (4) require a Member of Congress to reimburse the Treasury if an employee receives an award or settlement for the Member's alleged act of discrimination or harassment, unless the Member's request for a nonreimbursement determination is approved; and (5) rename the Office of Compliance the Office of Congressional Workplace Rights.

Ending Forced Arbitration of Sexual Harassment Act of 2017 This bill prohibits a predispute arbitration agreement from being valid or enforceable if it requires arbitration of a sex discrimination dispute. The prohibition does not apply to an arbitration provision in a contract between an employer and a labor organization or between labor organizations, subject to limitations.

Fix NICS Act of 2017 This bill amends the Brady Handgun Violence Prevention Act to require each federal agency and department, including a federal court, to: certify whether it has provided to the National Instant Criminal Background Check System (NICS) disqualifying records of persons prohibited from receiving or possessing a firearm, and establish and substantially comply with an implementation plan to maximize record submissions and verify their accuracy. The bill amends the NICS Improvement Amendments Act of 2007 to: direct the Department of Justice (DOJ) to establish a state implementation plan, including benchmarks, to maximize the automation and submission of mental health and criminal history records to the NICS; waive the grant match requirement under the National Criminal History Improvement Program (NCHIP) for a state that complies with its implementation plan; reauthorize through FY2022 the NICS Act Record Improvement Program (NARIP); establish, as a priority area for NARIP grant funding, a domestic abuse and violence prevention initiative; and create a funding preference under the NARIP program for states that establish an implementation plan and use grant funds to upload felony conviction and domestic violence records. It amends the Crime Identification Technology Act of 1998 to reauthorize through FY2022 the NCHIP program. If a state complies with its implementation plan, then the federal share of an NCHIP grant may exceed 90% of program costs.

USS Indianapolis Congressional Gold Medal Act This bill requires the House of Representatives and the Senate to make appropriate arrangements for the award, on behalf of Congress, of a single gold medal of appropriate design to the crew of the USS Indianapolis , in recognition of their perseverance, bravery, and service to the United States. Following the award of the gold medal, it shall be given to the Indiana War Memorial Museum in Indianapolis, Indiana, where it will be displayed and made available for research. It is the sense of Congress that the Indiana War Memorial Museum should make the gold medal available for display elsewhere, particularly at other locations and events associated with the USS Indianapolis.

Sentencing Reform and Corrections Act of 2017 This bill amends various provisions of law and sets forth new provisions: to reduce mandatory minimum prison terms for certain nonviolent repeat drug offenses; to establish a mandatory sentencing enhancement for a drug offense involving heroin or fentanyl; to broaden the existing safety valve to permit a sentence below the mandatory minimum for certain nonviolent, cooperative drug offenders with a limited criminal history; to create a new safety valve for certain nonviolent, cooperative defendants convicted of a high-level first-time or low-level repeat drug offense; to create new mandatory minimum prison terms, including for interstate domestic violence that results in a victim's death and for providing goods or services to terrorists; to make the Fair Sentencing Act of 2010 retroactive to permit resentencing of a convicted crack cocaine offender sentenced before August 3, 2010; to require the Bureau of Prisons to expand recidivism reduction programs and productive activities to all eligible prisoners; to lengthen prerelease custody for prisoners who successfully complete such programs; to develop the Post-Sentencing Risk and Needs Assessment System; to create reentry demonstration projects in judicial districts; to require presentence investigation reports to include certain information such as substance abuse history, military service, and veteran status; to permit a court to reduce a life prison term imposed on a defendant convicted as an adult for an offense committed as a juvenile; to establish a process to seal and expunge certain records of juvenile nonviolent offenses; to prohibit juvenile solitary confinement, except in limited circumstances; to make permanent and modify eligibility for an elderly offender early release pilot program; and to establish the National Criminal Justice Commission.

Federal Firearms Licensee Protection Act of 2017 This bill amends the federal criminal code to modify criminal penalties for an offense involving the theft of a firearm from a licensed importer, manufacturer, or dealer, or from their business premises. Specifically, the bill: increases from 10 to 20 years the maximum prison term, and creates a 3- or 5-year mandatory minimum prison term for an offense that occurs during the commission of a burglary or robbery. An attempt to commit an offense is subject to the same penalties as a substantive offense.

This bill establishes the National Commission on the Cybersecurity of United States Election Systems. The purposes of the commission are to: identify and document mitigation and response activities to or in the prevention of cybersecurity vulnerabilities in U.S. election systems in 2016; document and describe any harm or attempted harm to U.S. election systems in 2016; review foreign cyber interference in elections in other countries to determine additional cybersecurity threats, interference methods, and successful defense mechanisms; make a full and complete accounting of emerging threats and unmitigated vulnerabilities to U.S. election systems; and report recommendations for action at the federal, state, and local levels. The commission is given the authority to hold hearings and issue subpoenas to fulfill its purposes.

Provides appropriations for Related Agencies and Related Programs, including: the Broadcasting Board of Governors, the Asia Foundation, the U.S. Institute of Peace, the Center for Middle Eastern-Western Dialogue Trust Fund, the Eisenhower Exchange Fellowship Program, the Israeli Arab Scholarship Program, the East-West Center, and the National Endowment for Democracy. Provides appropriations for Other Commissions, including: the Commission for the Preservation of America's Heritage Abroad, the U.S. Commission on International Religious Freedom, the Commission on Security and Cooperation in Europe, the Congressional-Executive Commission on the People's Republic of China, and the U.S.-China Economic and Security Review Commission. Provides appropriations for the U.S. Agency for International Development (USAID). John Stringer Rainey Memorial Safeguard American Food Exports Act or the SAFE Act This bill amends the Federal Food, Drug, and Cosmetic Act to deem equine (horses and other members of the equidae family) parts to be an unsafe food additive or animal drug. The bill prohibits the knowing sale or transport of equines or equine parts for human consumption.

Water Efficiency Improvement Act of 2017 This bill amends the Energy Policy and Conservation Act to codify the WaterSense Program of the Environmental Protection Agency (EPA) that allows water-efficient products, buildings, landscapes, facilities, processes, and services to bear a "WaterSense" label. The EPA must establish certification criteria for the WaterSense label, enhance public awareness regarding the label, preserve the label's integrity, and review, and if appropriate, revise the WaterSense label requirements. To the maximum extent practicable and no less than annually, the EPA must estimate and publish the aggregate production, aggregate market penetration, and savings of water, energy, and capital costs of water, wastewater, and stormwater attributable to the use of WaterSense-labeled products, buildings and building landscapes, facilities, processes, and services.

Stop Enabling Sex Traffickers Act of 2017 This bill amends the Communications Act of 1934 to specify that communications decency provisions protecting providers from liability for the private blocking or screening of offensive material shall not be construed to impair the enforcement of, or limit availability of victim restitution or civil remedies under, state or federal criminal or civil laws relating to sex trafficking of children or sex trafficking by force, fraud, or coercion. The bill amends the federal criminal code to specify that the violation for benefiting from "participation in a venture" engaged in sex trafficking of children, or by force, fraud, or coercion, includes knowing conduct by any person or entity by any means that assists, supports, or facilitates the violation.
