Church Plan Clarification Act of 2009 - Amends Internal Revenue Code pension plan provisions to: (1) apply a special rule for determining the status of an employer participating in a church plan as a member of a controlled group of entities; and (2) allow certain tax-free transfers to and mergers of church plans that are maintained by the same church or association of churches. Amends the Tax Equity and Fiscal Responsibility Act of 1982 (TEFRA) to apply limitations on benefits and contributions under qualified employee plans to certain church defined benefit plans. Includes within the definition of plan under the Employee Retirement Income Security Act of 1974 (ERISA) an employee benefit plan which is a church plan for purposes of ERISA automatic enrollment provisions. Allows church plans and their supporting organizations to invest plan assets in a group trust (as defined by Internal Revenue Service Revenue Rulings).

Radio Spectrum Inventory Act - Amends the Communications Act of 1934 to require the National Telecommunications and Information Administration (NTIA) and the Federal Communications Commission (FCC) to: (1) biennially inventory each radio spectrum band from 300 megahertz to 3.5 gigahertz managed by each such agency, including information on the licenses or government user assigned in the band, the total spectrum allocation of each licensee or government user, the number of deployed intentional and end-user intentional radiators, and (if available) other specified information; and (2) make the information available to the public through the Internet. Allows a licensee or government user to petition the NTIA or the FCC for a partial or total exemption from website inclusion. Allows an exemption to be granted only to the extent that each such agency determines that disclosure of the information would be harmful to U.S. national security.

Belated Thank You to the Merchant Mariners of World War II Act of 2009 - Establishes in the Treasury the Merchant Mariner Equity Compensation Fund for payments by the Secretary of Veterans Affairs of a monthly benefit of $1,000 to each individual who, between December 7, 1941, and December 31, 1946, was a documented member of the U.S. merchant marine (including the Army Transport Service and the Naval Transport Service) serving as a crewmember of a vessel that was operated in U.S. waters by the War Shipping Administration or the Office of Defense Transportation and under contract to, or the property of, the United States. Requires such individuals to: (1) apply for such benefit before October 1, 2009; and (2) not have received benefits under the Servicemen's Readjustment Act of 1944.

Financial and Economic Literacy Improvement Act of 2009 - Amends the Elementary and Secondary Education Act of 1965 to direct the Secretary of Education to award formula matching grants to states or partnerships between states, experienced nonprofit providers of financial and economic literacy education, and experienced nonprofit providers of teacher training in such fields. Requires grantees to use 25% of the grant funds to: (1) develop financial and economic literacy standards and assessments for at least three grade levels; (2) create teacher training programs to embed financial and economic literacy education into core academic subjects; and (3) evaluate the impact such education has on students' financial and economic literacy. Requires the remaining grant funds to be used for subgrants to local educational agencies (LEAs) or partnerships between LEAs and community organizations, local businesses, or other educational entities to implement such financial literacy activities, including student assessments and teacher training. Directs the Secretary to maintain a Financial and Economic Literacy and Economic Education Clearinghouse of best practices, tools, and instructional materials that are aligned with voluntary nationally recognized curriculum standards in such areas. Amends the Higher Education Act of 1965 to direct the Secretary to award competitive grants to institutions of higher education (IHEs) or partnerships between IHEs, experienced nonprofit providers of financial and economic literacy education, and experienced nonprofit providers of teacher training in such fields for activities that increase student knowledge in consumer, economic, and personal financial concepts.

Weather Mitigation Research and Development Policy Authorization Act of 2009 - Establishes in the National Science Foundation (NSF) the Weather Mitigation Research Office to establish and coordinate the national research and development program on weather mitigation described in this Act. Requires the Office be headed by a Director, who shall be appointed by the NSF Director. Creates an associated Advisory Board. Requires the Director of the Office, in consultation with the Advisory Board, to submit a plan for the establishment and coordination of the Program. Requires the Office to promote and fund research and development (R&D), studies, and investigations with respect to: (1) improved forecast and decisionmaking technologies for weather mitigation operations, including tailored computer workstations and software and new observation systems with remote sensors; and (2) assessments and evaluations of the efficacy of weather mitigation. Authorizes the Office to establish a grant program for the awarding of grants to eligible entities (state agencies, institutions of higher education, and nonprofits that have expertise in the field of weather mitigation and experience working with state agencies) for R&D projects that pertain to weather mitigation. Requires the submission of annual reports to the President and specified congressional committees on the activities conducted pursuant to this Act.

Women Veterans Health Care Improvement Act of 2009 - Directs the Secretary of Veterans Affairs to: (1) report on barriers to the receipt of comprehensive health care through the Department of Veterans Affairs (VA) encountered by women veterans, especially those of Operations Iraqi Freedom and Enduring Freedom; (2) provide for an independent study on health consequences for women veterans serving on active duty in deployments in such Operations; and (3) report on the employment of full-time managers for women veterans programs at VA medical centers. Requires the Secretary to: (1) develop a plan to improve the provision of VA health care services to women veterans; (2) carry out a program of education, training, certification, and continuing medical education for mental health professionals providing care for veterans suffering from sexual trauma; (3) carry out a pilot program of providing reintegration and readjustment services in group retreat settings to women veterans recently separated from service after a prolonged deployment; and (4) carry out a pilot program on subsidies for child care for certain women veterans receiving health care from VA facilities. Requires women veterans recently separated from service to be included on the Advisory Committee on Women Veterans and the Advisory Committee on Minority Veterans. Authorizes the Secretary to furnish care to a newborn child of a woman veteran receiving VA maternity care for up to seven days after the birth of the child.

No Cost Stimulus Act of 2009 - Deems the Draft Proposed Outer Continental Shelf Oil and Gas Leasing Program 2010-2015 issued by the Secretary of the Interior approved as a final oil and gas leasing program under the Outer Continental Shelf Lands Act (OCSLA). Deems the Secretary to have issued a final environmental impact statement for the program under the National Environmental Policy Act of 1969 (NEPA). Directs the Secretary to conduct a lease sale in each outer Continental Shelf (OCS) planning area for which there is a commercial interest in purchasing federal oil and gas production leases. Authorizes the Secretary to conduct commercial lease sales of federally-owned resources to: (1) produce renewable energy; or (2) cultivate marine organisms in their natural habitat. Amends OCSLA to direct the Secretary to develop: (1) a plan to address streamlining the process of making payments to states; and (2) a procedure to provide expedited funding to projects. Amends the Submerged Lands Act to extend from three geographical miles to 12 nautical miles a coastal state's allowable seaward boundary. Authorizes the leasing of land within the 1002 Coastal Plain Area of Alaska to any person qualified to obtain a lease for deposits of oil and gas under the Mineral Leasing Act. Prescribes procedures for lease sales and grants of leases. Directs the Secretary to administer the leasing program, with respect to Coastal Plain environmental protection, according to the No Significant Adverse Effect Standard. Establishes the Coastal Plain Local Government Impact Aid Assistance Fund to finance local government impact aid and community service assistance. Establishes an Arctic National Wildlife Refuge (ANWR) Alternative Energy Trust Fund. Amends the Oil Shale, Tar Sands, and Other Strategic Unconventional Fuels Act of 2005 to require the Secretary to conduct related lease sales in any state during any period for which there is sufficient support and interest in the state in the development of tar sands and oil shale resources. Amends the Atomic Energy Act of 1954 to repeal the requirement of 30 days' public notice before a hearing on each application for a construction permit for a new new nuclear power plant. Grants the U.S. District Court for the District of Columbia exclusive jurisdiction to hear all causes and claims arising from any covered project of federal land leasing for exploitation of oil, natural gas, or any other source or form of energy. Amends NEPA to require completion and review of environmental impact statements within 270 days after their commencement or the action concerned shall be considered a final agency action with no significant environmental impact. Amends the Clean Air Act to declare that carbon dioxide, methane from agriculture or livestock, or water vapor are not air pollutants. Amends the Endangered Species Act of 1973 (ESA) to require the Secretary concerned, upon the declaration of an emergency by a state governor, for the duration of the emergency, to exempt from the prohibition against taking, and against adverse modification of critical habitat, any action reasonably necessary to avoid or ameliorate the impact of the emergency, including the operation of any water supply or flood control project by a federal agency. Prohibits consideration of the impact of greenhouse gas on any species of fish or wildlife or plant for any purpose in the implementation of the ESA.

Motorcoach Enhanced Safety Act of 2009 - Directs the Secretary of Transportation to prescribe regulations requiring motorcoaches to be installed with: (1) safety seat belts at each seating position; (2) advanced glazing in each portal to prevent passenger ejection; (3) improved firefighting equipment; and (4) enhanced compartmentalization safety countermeasures and certain other motor vehicle safety features. Requires the Secretary to study and report to Congress on improving bus crashworthiness, bus crash avoidance, and bus fire protection and passenger evacuation. Directs the Secretary to prescribe regulations: (1) requiring providers of motorcoach services registered with the the Federal Motor Carrier Safety Administration (FMCSA) to undergo periodic safety reviews; (2) establishing a training curriculum and providing certification for each driver of a motorcoach seeking a commercial driver's license (CDL) passenger endorsement; (3) improving CDL testing; (4) requiring a driver of a commercial motor vehicle that transports for compensation between nine and 15 passengers to have a CDL; (5) preventing the submission and use of invalid or fraudulent medical certificates by applicants for a CDL; (6) requiring the annual review of state licensing authorities to assess the accuracy of physical examination reports and medical certificates of CDL applicants that are submitted by medical examiners to such authorities; and (7) requiring that all commercial motor vehicles be equipped with electronic on-board recorders (that record driver hours of service) and event data recorders, as well as direct tire pressure monitoring warning systems. Sets forth a deadline for the Secretary to establish the national registry of medical examiners. Requires the Secretary to establish a performance standard for retreaded commercial motor vehicle tires that ensures such tires achieve a safety level of performance equivalent to that of new commercial motor vehicle tires. Requires a state to conduct an annual commercial motor vehicle inspection program in order to receive a grant for the development or implementation of programs for improving motor carrier safety.

Veteran and Servicemember Caregiver Support Act of 2009 - Directs the Secretary of Veterans Affairs to carry out a two-year pilot program of training, certification, and support for eligible family caregivers of eligible veterans and members of the Armed Forces. Defines as: (1) eligible family caregivers those family members who agree to provide such services, are accepted by the veteran or member as the provider, and are determined qualified to provide such services; and (2) eligible veterans and members those veterans and members who have a service-connected disability incurred or aggravated on or after September 11, 2001, and require caregiver services because of such disability. Requires: (1) the pilot program to be conducted at at least six medical facilities; (2) at least one facility to be a private facility with expertise in providing rehabilitative care; (3) at least one facility to be a Department of Veterans Affairs (VA) medical center in a rural area; and (4) the Secretary, in selecting locations, to give special emphasis to VA polytrauma centers designated as Tier I polytrauma centers. Directs the Secretary to provide training to each eligible family caregiver under the program, and to certify the caregiver as qualified upon training completion. Requires caregivers to be paid for providing such services. Requires: (1) a review of VA and Department of Defense (DOD) respite care programs, as well as a study on enhancing the availability of such programs; (2) the provision of psychological and social support services to caregivers; and (3) a national survey of family caregivers of seriously disabled veterans and members.

Repeals certain provisions which require the offset of amounts paid in dependency and indemnity compensation from Survivor Benefit Plan (SBP) annuities for the surviving spouses of former military personnel who are entitled to military retired pay or would be entitled to such pay except for being under 60 years of age. Prohibits recoupment by the Secretary of Defense of certain amounts previously paid to SBP recipients in the form of a retired pay refund. Repeals the optional authority of (and instead requires) the Secretary of the military department concerned to pay an annuity to a member's dependent children when there is no eligible surviving spouse. Directs the Secretary concerned to restore annuity eligibility to a surviving spouse who earlier agreed to transfer such eligibility to a surviving child or children of a member.

The Depositor Protection Act of 2009 - Amends the Federal Deposit Insurance Act to increase from $30 billion to $100 billion the maximum sum that the Federal Deposit Insurance Corporation (FDIC) is authorized to borrow from the Secretary of the Treasury. Authorizes a temporary increase, through calendar 2010, in such borrowing authority, up to a maximum of $500 billion, if the Secretary of the Treasury, in consultation with the President, determines that additional amounts above $100 billion are necessary, pursuant to the written recommendation of the FDIC Board of Directors and the Board of Governors of the Federal Reserve System (Federal Reserve Board). Requires a two-thirds vote of the members of both the FDIC Board of Directors and the Federal Reserve Board to make such a recommendation. Requires the FDIC, if its borrowing authority is increased above $100 billion, to report promptly to certain congressional committees the reasons and need for the additional borrowing authority and its intended uses.

Directs the Director of the Office of Personnel Management (OPM) and the Secretary of Defense to ensure that the option of paying FEHBP and TRICARE supplemental premiums on a pretax basis is available to federal civilian and military retirees for the first open enrollment period beginning not less than 90 days after the enactment of this Act.

Military Spouses Residency Relief Act - Amends the Servicemembers Civil Relief Act to prohibit, for purposes of voting for a federal, state, or local office, deeming a person to have lost a residence or domicile in a state, acquired a residence or domicile in any other state, or become a resident in or of any other state solely because the person is absent from a state because the person is accompanying the person's spouse who is absent from the state in compliance with military or naval orders. Prohibits a servicemember's spouse from either losing or acquiring a residence or domicile for purposes of taxation because of being absent or present in any U.S. tax jurisdiction solely to be with the servicemember in compliance with the servicemember's military orders if the residence or domicile is the same for the servicemember and the spouse. Prohibits a spouse's income from being considered income earned in a tax jurisdiction if the spouse is not a resident or domiciliary of such jurisdiction when the spouse is in that jurisdiction solely to be with a servicemember serving under military orders. Suspends land rights residency requirements for spouses accompanying servicemembers serving under military orders.

Heart Disease Education, Analysis Research, and Treatment for Women Act or the HEART for Women Act - Amends the Federal Food, Drug, and Cosmetic Act to allow the Secretary of Health and Human Services to deny a new drug application if the application fails to include required information on clinical investigations. Directs the Secretary to: (1) require that a new drug application include any clinical data possessed by the applicant that relates to the safety and effectiveness of the drug involved by gender, age, and racial subgroup; and (2) develop guidance for the staff of the Food and Drug Administration (FDA) to ensure that new drug applications are adequately reviewed to determine whether they include the required clinical data. Authorizes the Secretary to place a clinical hold on an investigation under an investigational new drug application if the sponsor of the investigation fails to meet the requirements of an annual report on the status of each study in progress. Applies provisions relating to clinical data submission for new drug applications to applications for an investigational new drug, a biologics license for a biological product, premarket approval for a class III device, and investigational use of a device. Amends the Public Health Service Act to require the Secretary to provide that all nonidentifiable patient safety work product reported to and among the network of patient safety databases be identified by sex. Directs that analyses of statistics of information reported to the network of patient safety databases take into account data that specifically relates to women and any disparities between treatment and the quality of care between males and females. Requires the Director of the Agency for Healthcare Research and Quality to support research and demonstrations to identify and evaluate clinical and organizational strategies to improve the quality of and access to care for women with heart disease, stroke, and other cardiovascular diseases. Requires the Secretary to: (1) distribute to females age 65 or older and appropriate health care professionals educational materials relating to the prevention diagnosis and treatment of heart disease, stroke, and cardiovascular diseases in women; and (2) conduct an education and awareness campaign for health care professionals relating to such diagnosis and treatment. Expands the grant program authorizing the Secretary to award grants for preventive health services to all states.

DTV Delay Act - Amends the Digital Television Transition and Public Safety Act of 2005 to delay the transition of television broadcasting from analog to digital to June 13, 2009. Extends to July 31, 2009, provided additional budget authority is enacted, the deadline for requesting digital-to-analog converter box coupons. Authorizes the issuance, on request, of one replacement coupon for each coupon that expired without being redeemed. Declares that this Act does not prevent: (1) a station from ending analog broadcasting (and continuing to broadcast exclusively digitally) before June 13, 2009; or (2) a public safety service from beginning operations on spectrum recovered as a result of such voluntary cessation of analog or digital broadcasting. Amends the Communications Act of 1934 to extend through September 30, 2012 (under current law, September 30, 2011), the authority of the Federal Communications Commission (FCC) to grant a license or permit under provisions relating to competitive bidding.

Requires the FCC to adopt a final rule establishing criteria for certification for the manufacture, sale, importation, and interstate shipment of such devices.

Revises or adds provisions concerning VA health care matters, including: (1) care furnished to children of Vietnam veterans; (2) medical records disclosures; (3) health care quality management; (4) pilot programs on training and certification for family caregivers, respite care to members of the Armed Forces and veterans with traumatic brain injury (TBI), the use of community-based organizations and local and state entities to ensure that veterans receive authorized care and benefits, and the provision of dental insurance plans to veterans and their survivors and dependents; (5) specialized residential care and rehabilitation; (6) the use of non-VA facilities for the rehabilitation of veterans with TBI; and (7) the inclusion of certain tribal organizations in programs for state veterans homes. Revises or adds provisions concerning women veterans health care, including: (1) reports on barriers to their receipt of health care, and full-time women veterans program managers at medical centers; (2) pilot programs or studies on the health consequences of women veterans of Operations Iraqi Freedom and Enduring Freedom, counseling for women veterans recently separated from service, and subsidies for child care for women veterans receiving health care; (3) training and certification for mental health care providers caring for veterans suffering from sexual trauma; and (4) care for newborn children of veterans receiving maternity care. Revises or adds provisions concerning veterans' mental health care, including: (1) services provided through the Readjustment Counseling Service; and (2) a study on veteran suicides. Revises or adds provisions concerning homeless veterans, including pilot programs on financial support for entities providing: (1) supportive services for formerly homeless veterans residing on certain military property or other permanent housing; (2) outreach about pension benefits; and (3) transportation, child care, and clothing assistance to homeless veterans entitled to a rehabilitation program. Revises or adds provisions concerning VA nonprofit research and education corporations. Expands the authority of VA police officers, and provides them a uniform allowance.

Amends the Controlled Substances Act to impose criminal penalties on individuals who commit violent crimes in relation to a drug trafficking crime. Expands restrictions on the release of persons charged with using firearms in a drug trafficking crime or a crime of violence. Establishes a 10-year limitation period for prosecutions of any noncapital felony crime of violence. Increases criminal penalties for possession of firearms by felons with prior convictions for a violent felony or serious drug offense. Redefines and increases penalties for the crimes of carjacking and transfers of firearms to commit a crime of violence or drug trafficking. Increases penalties for conspiracy to commit a criminal offense or to defraud the United States. Extends to 10 years the limitation period for prosecuting certain federal crimes of terrorism. Establishes crimes committed in Indian country or in any other area of exclusive federal jurisdiction as a predicate for invoking federal racketeering laws. Establishes as a predicate for a wiretap authorization violations of the Controlled Substances Act relating to violent crimes in furtherance of a drug trafficking crime and certain criminal street gang activity. Expands the prohibition against impeding commerce by threats or violence to include robbery or extortion attempts committed by a person unlawfully impersonating a law enforcement officer. Prohibits traveling in interstate or foreign commerce or using the mail to tamper with or retaliate against a witness, victim, or informant in a state criminal proceeding. Authorizes the Attorney General to designate and assist state high intensity gang activity areas in combating gang activity. Directs the Office of Justice Programs to establish a National Gang Research, Evaluation, and Policy Institute to design and evaluate anti-gang programs. Authorizes the Office of Justice Programs of the Department of Justice (DOJ) to make grants to develop community-based programs that provide crime prevention, research, and intervention services for gang members and at-risk youth. Authorizes the Attorney General to expand the Project Safe Neighborhoods Program and the Safe Streets Program. Directs the Attorney General to: (1) establish a National Gang Activity Database; and (2) provide funding to the Regional Information Sharing Systems to use RISSNET to connect existing gang information systems with the Database. Amends the Violent Crime Control and Law Enforcement Act of 1994 to provide grants to assist prosecutors and law enforcement agencies in identifying gang members and violent offenders. Amends the Juvenile Justice and Delinquency Prevention Act of 1974 to direct the Administrator of the Office of Juvenile Justice and Delinquency Prevention to expand the number of sites receiving juvenile delinquency reduction grants. Authorizes the Attorney General to make grants for carrying out projects involving innovative approaches to combat gang activity. Establishes in the U.S. Marshals Service a Short-Term State Witness Protection Section. Authorizes the Attorney General to make grants to states for projects to prevent family abductions. Directs the U.S. Sentencing Commission to report on the appropriateness of sentences for minors in the federal criminal justice system. Amends the Office of National Drug Control Policy Reauthorization Act of 1998 to require the Director of National Drug Control Policy to promote prevention of youth heroin use. Authorizes the National District Attorneys Association to use the National Advocacy Center in South Carolina for a training program to improve the professional skills of state and local prosecutors. Prevention Resources for Eliminating Criminal Activity Using Tailored Interventions in Our Neighborhoods Act of 2009 or the PRECAUTION Act - Establishes the National Commission on Public Safety Through Crime Prevention to study the effectiveness of crime and delinquency prevention and intervention strategies. Declares the sense of Congress that such facility should be the U.S. Mint at West Point, New York, to the greatest extent possible. Authorizes the Secretary to issue such coins only during calendar 2011. Applies a $10 per coin surcharge to all coin sales. Requires all surcharges received to be paid to the Girl Scouts of the United States of America for efforts involved in marking it centennial, which may include efforts to preserve the birthplace of founder Juliette Gordon Low.
