Title I: Export Trading Companies - Export Trading Company Act of 1981 - Directs the Secretary of Commerce to promote export trading companies by providing information and by facilitating contacts between producers of exportable goods and export trading companies. Authorizes any banking organization to invest specified amounts in export trading companies upon notifying, but without obtaining the prior approval of, the appropriate Federal banking agency, if such investment does not cause an export trading company to become a subsidiary of such organization. Allows greater investment by Edge Act Corporations not engaged in banking. Permits any banking organization to invest beyond such limitations with prior approval of the appropriate Federal banking agency. Requires prior notification of such agencies in specified circumstances. Sets forth further limitations on export trading companies and investments by banking organizations. Specifies factors to be taken into consideration by the banking agencies. Permits such agencies to impose conditions in approving applications to invest in export trading companies. Requires such agencies to report to the appropriate Congressional committees with their recommendations concerning implementation of this Act, related changes in U.S. law, and effects of ownership of U.S. banks by foreign banking organizations. Provides for judicial review of denial orders in the appropriate U.S. Court of Appeals. Sets forth the grounds for disapproval. Provides for remand for further consideration by the banking agency. Directs the Economic Development Administration and the Small Business Administration to give special weight to export-related benefits when considering applications for loans and guarantees by export trading companies. Authorizes up to $20,000,000 to be appropriated for initial investments and operating expenses for each of fiscal years 1981-1985. Directs the Export-Import Bank of the United States to provide loan guarantees for expansion to export trading companies or exporters to be secured by accounts receivable or inventories when adequate financing is not otherwise available. Directs the Board of Directors to try to insure that a major share of such guarantees promotes exports from small, medium-size, and minority businesses or agricultural concerns. Title II: Export Trade Associations - Export Trade Association Act of 1981- Amends the Webb-Pomerene Act to exempt the export trade, export trade activities, and methods of operation of certified export trade associations and export trading companies from the antitrust laws. Delays the effectiveness of any certificate upon the notification of the Secretary of Commerce by the Attorney General or the Federal Trade Commission (FTC) of disagreement with the decision to issue a certificate. Sets forth the procedure to be followed by any association, company, or export trading company seeking certification under this Act and by the Secretary in issuing such certificates. Permits automatic certification for existing associations. Provides for appeal of the Secretary's denial of certification. Authorizes the Attorney General or the FTC to bring an action to invalidate a certification. Requires the Secretary, in consultation with the Attorney General and the FTC, to publish certification guidelines. Requires certified associations and export trading companies to submit annual reports to the Secretary. Directs the Secretary to establish within the Department of Commerce an Office of Export Trade. Requires such Office to report annually to the appropriate Congressional committees on all East-West trade transactions requiring validated licenses and on the role of U.S. export trading companies in such trade. Grants a temporary exemption from the Sherman Act antitrust provisions for existing associations. Requires, with specified exceptions, that all applications for certification be kept confidential. Authorizes the Secretary to require an association or trading company to modify its operation to be consistent with international obligations of the United States. Directs the President to appoint, with the Senate's advice and consent, a task force, seven years after enactment, to examine the effect of this Act and to make recommendations.

Amends the Federal Property and Administrative Services Act of 1949 to authorize the Administrator of General Services to assign to the Secretary of the Army for disposal certain surplus real or personal property for use in the development, improvement, or operation of a public harbor, including property needed to develop sources of revenue from nonmaritime businesses. Requires that the deed of conveyance of disposed property provide that the property shall be used for the purpose for which it was conveyed or revert, at the Secretary's option, to the United States.

Authorizes appropriations for fiscal years 1982-84 for such programs.

Health Care Protection Act of 1981 - Authorizes each State to establish a program for compensation and reduction of health care malpractice. Authorizes the Attorney General to promulgate regulations to carry out the purposes of this Act. Authorizes each State to establish malpractice screening panels with original and exclusive jurisdiction to hear all claims of health care malpractice by State certified or licensed health care personnel. Directs each State to publish a list of licensed health care professions. Sets forth the procedural rules governing the handling of such claims. Requires such a panel to determine the amount of damages owed under State law by a defendant found liable for a compensable injury resulting from health care malpractice and to enter an order to pay an award in that amount. Authorizes a State to provide judicial enforcement of an award that is not paid promptly. Prohibits review of a panel decision except for review of allegations of a conflict of interest by a panel member or of fraud. Specifies methods of payment of such damage awards. Requires that any party to a claim decided by a panel be entitled to trial de novo on such claim in State court. Requires that a panel or court report any findings of health care malpractice or notice of a settlement agreement to the State insurance commissioner and the State licensing or certification board with jurisdiction over the health care personnel concerned. Directs the State insurance commissioner to make such reports available to the public and to insurance carriers, who shall be authorized to adjust the rates of involved health care personnel. Sets limits on the amount of the contingent fee which may be awarded to a winning claimant's attorney. Subjects an attorney who accepts a fee in excess of such limits to civil liability. Encourages a State to develop a program requiring specified health care institutions within the State to employ a risk management program for the reporting and investigation of all known or suspected incidents of malpractice within such institutions and the identification of preventive measures to reduce the risk of such incidents. Directs the Governor of a State to certify the State's program and the Attorney General to approve such certification if such program is in compliance with this Act. Directs the Attorney General to make specified payments to a State with a certified program to support the establishment of the malpractice screening panels and the development of the State program under this Act. Directs the Governor to report to the Attorney General on the State's use of such payments. Reallocates funds paid to a State which does not have a program in compliance with this Act to those States which the Attorney General determines are most in need of additional funds. Authorizes appropriations beginning in fiscal year 1982 for the Department of Justice to carry out the provisions of this Act. Defines "malpractice" as malpractice, or professional negligence, by an individual or group that provides health care services or goods, and that is required by State law to be licensed or certified to provide such services or goods within the State.

Amends the Employee Retirement Income Security Act of 1974 to prohibit the decrease of any employee disability benefits because of any corresponding increase in the levels of social security or railroad retirement benefits. Amends the Internal Revenue Code to deny an employer any income tax deduction for amounts paid to or under a disability compensation plan if the benefits payable to an individual under such plan are reduced, or any scheduled increase in such benefits is omitted, on account of any increase in monthly insurance benefits to which such an individual is entitled under title II of the Social Security Act (Old Age, Survivors, and Disability Insurance).

Amends the Federal criminal code to establish penalties for whoever robs, by force and violence or intimidation, a licensed pharmacy which is regularly engaged in retail dispensing of prescription drugs or devices in interstate commerce, if such robbery is part of a pattern of robberies in the locality. Defines "property" as a controlled substance, as defined in the Controlled Substances Act, whose value exceeds $500.

Employment Tax Act of 1981 - Amends the Internal Revenue Code to specify standards for determining whether certain individuals qualify as independent contractors for purposes of the tax on employment income. Treats an individual as an independent contractor if such individual: (1) controls the total number of his work hours; (2) does not maintain a principal place of business, or, if he does, such place of business is not provided, or is not provided rent-free, by the person for whom such individual performs services; (3) has substantial investment in his business and earns income based upon sale or output rather than upon number of hours worked; and (4) performs services pursuant to a written contract and is provided written notice of his responsibility with respect to income and self-employment taxes. Amends title II (Old Age, Survivors and Disability Insurance) of the Social Security Act to exclude from social security coverage service performed by an individual who qualifies as an independent contractor under the standards established by this Act.

Constitutional Amendment - Provides that the people of the several States, and the District of Columbia shall elect the President and Vice President. Requires each elector to cast a single vote for two persons who shall have consented to the joining of their names as candidates for the offices of President and Vice President. Requires the electors of President and Vice President in each State to have the qualifications requisite for electors of the most numerous branch of the State legislature, except that for electors of President and Vice President, the legislature of any State may prescribe less restrictive residence qualifications and for electors of President and Vice President the Congress may establish uniform residence qualifications. Provides that: (1) the pair of persons having the greatest number of votes for President and Vice President shall be elected, if such number is at least 40 percent of the whole number of votes cast; and (2) if no pair of persons has such number, a runoff election shall be held in which the choice of President and Vice President shall be made from the two pairs of persons who received the highest numbers of votes. Requires the days for such elections to be determined by Congress and to be uniform throughout the United States. Requires Congress to prescribe by law the time, place, and manner in which the results for such elections shall be ascertained and declared. Allows Congress to provide for the case of the death, inability, or withdrawal of any candidate for President or Vice President before a President and Vice President have been elected, and for the case of the death of both the President-elect and Vice President-elect.

Expresses the sense of the Senate that: (1) the Board of Governors of the Federal Reserve System should reduce and institute alternative policies to restrain interest rates; (2) Congress should abolish the Federal Open Market Committee and stipulate that the Board make all final decisions concerning the money supply and interest rates; and (3) the Senate Committee on Banking, Housing, and Urban Affairs should study and report on the advisability of seeking other necessary reforms of the Federal Reserve System including implementation of a dual prime rate to improve management of the monetary structure.

Advanced Battery Research, Development, and Demonstration Act of 1980 - Directs the Secretary of Energy to: (1) assure the expansion of the current battery research program; (2) assure the expansion of the current battery exploratory investigations program; (3) accelerate battery development and engineering activities; (4) conduct field tests and demonstrations of each advanced battery; (5) ensure the coordination of the activities of this Act with those of the Electric and Hybrid Vehicle Research, Development and Demonstration Act; (6) establish technology applications programs to foster manufacturing process development, cost reduction programs, and pilot line operations; (7) develop a technology applications program for each advanced battery which is proven to be suitable for use in conjunction with dispersed applications of renewable energy sources, such as wind energy and photovoltaic systems; and (8) prepare a comprehensive program management plan for the conduct of the research, development, and demonstration activities under this Act. Establishes a technical panel on advanced batteries of the Energy Research Advisory Board to advise the Secretary on the conduct of the advanced battery energy storage program. Directs the Secretary to report annually to Congress concerning activities pursuant to this Act.

Establishes the United States Holocaust Memorial Council which shall: (1) provide and encourage appropriate ways for the Nation to observe the Days of Remembrance to commemorate the holocaust; (2) plan, erect, and oversee the operation of a memorial museum to the victims of the holocaust; and (3) plan for carrying out the recommendations of the report submitted to the President on September 27, 1979, by the President's Commission on the Holocaust. Authorizes the Council to receive public land in the District of Columbia on which it may erect the memorial. Terminates the Council's authority to construct a memorial if the erection of the memorial has not commenced within five years of enactment of this Act and sufficient funds to ensure completion of the memorial have not been certified to be available. Authorizes appropriations to carry out this Act.

National Hostel System Act of 1980 - Directs the National Hostel System Study Commission, established by this Act, to transmit to specified congressional committees, within two fiscal years following the effective date of this Act, a National Hostel System Plan which shall: (1) guide the development and implementation of a national hostel system; (2) encourage the development of hostels by State and local governmental agencies and private, nonprofit organizations; and (3) encourage the operation of hostels by private, nonprofit organizations. Requires the Commission to provide for full public participation during the development of such Plan. Requires the Commission, every six months after the effective date of this Act, and until the Plan is submitted to the specified congressional committees, to submit to such committees a brief and comprehensive written status report on the progress being made toward the completion of the Plan. Terminates the Commission one year after submission of the Plan. Directs the Commission to transmit the proposed Plan to the Secretary of the Interior for review and comment. Requires the Secretary, within 30 days after receipt of the Plan, to submit written comments and recommendations to the Commission. Provides for public review and comment on the Plan. Requires the Commission, within 30 days after the completion of such review procedures, to incorporate into the Plan such comments and recommendations as it deems appropriate and submit the Plan, along with the Secretary's and the public's comments and recommendations, to specified congressional committees. Establishes the National Hostel System Study Commission, whose purpose it shall be to prepare, and to submit to Congress, a National Hostel System Plan, and to perform such other functions as are set forth in this Act. Authorizes the Secretary to make grants to States, units of local government, and private, nonprofit organizations to defray the costs of improvements in, or renovations of, structures and facilities for hostel purposes. Specifies that such grants may be made only for projects approved by the Commission, and limits such grants to amounts not to exceed $200,000. Sets forth the procedures for applying for such grants. Declares that, upon the request of the Secretary, any structure declared excess by any Federal agency shall be transferred to the Secretary to carry out the purposes of this Act. Requires the Secretary to ensure that the State Comprehensive Outdoor Recreation Plan for each State developed pursuant to the Land and Water Conservation Fund Act address the potential and plans for the location and development of hostels. Allows the head of any Federal agency, upon the application of any agency or instrumentality of a State or local government or any private nonprofit organization, to lease any structures and land to such applicant, without charge, for hostel purposes if the Secretary has certified that the applicant meets the standards of the National Hostel System Plan.
