Defending American Security from Kremlin Aggression Act of 2018 This bill imposes limits on any U.S. withdrawal from the North Atlantic Treaty Organization (NATO), amends provisions related to cybercrimes, and imposes sanctions on Russian individuals involved in various activities. No funds may be used to withdraw the United States from NATO unless the Senate passes a resolution consenting to the withdrawal. The bill also authorizes expedited transfers of excess defense articles to NATO member countries. This bill establishes in the Department of State the Office of Cyberspace and the Digital Economy, to serve as the lead policy body on issues including international cybersecurity and Internet freedom. Offenses relating to the manufacture, distribution, and possession of communication-intercepting devices shall be unlawful under federal anti-money laundering laws. It shall also be a crime to intentionally traffic in the means to access protected computers, including computers that are part of a voting system. Property related to such crimes, including proceeds gained from the crime, shall be subject to criminal and civil forfeiture. The President shall impose sanctions (1) on Russian individuals and entities that facilitate or benefit from Russian President Vladimir Putin's corruption, and (2) on those that knowingly engage in significant financial transactions with individuals that support or facilitate Russian malicious cyber activities. The bill also imposes sanctions for supporting various other Russia-related activities, including Russian interference in democratic processes. The bill establishes requirements for reporting on a wide variety of matters concerning Russian economic, military, and political activities.

This joint resolution states that Congress opposes any effort to withdraw the United States from the North Atlantic Treaty. The President may withdraw from the North Atlantic Treaty, in accordance with its terms and pursuant to the advice and consent of the Senate, only if two-thirds of the Senators present concur, or pursuant to an Act of Congress. The Senate Legal Counsel may represent the Senate in initiating or intervening in federal judicial proceedings to oppose U.S. withdrawal from the North Atlantic Treaty and to ensure that any such withdrawal is pursuant to the advice and consent of the Senate or an Act of Congress.

CyberTipline Modernization Act of 2018 (Sec. 2) This bill revises reporting requirements for electronic communication service providers and remote computing service providers (providers) who report information to the National Center for Missing and Exploited Children (NCMEC) on crimes involving the sexual exploitation of children. Currently, providers must report the facts and circumstances of incidents of apparent child pornography, of which they become aware, to NCMEC via the CyberTipline. This bill retains the existing reporting requirement and provides new authority for providers to also report the facts and circumstances that indicate a child pornography violation is imminent. Additionally, it makes various procedural changes to the reporting requirements, including to do the following: grant discretion to providers to determine what information to include in a report; permit (currently, require) the Department of Justice (DOJ) to designate foreign law enforcement agencies to receive CyberTipline reports from NCMEC; allow NCMEC to forward a report to a foreign law enforcement agency in certain circumstances, even if the foreign law enforcement agency has not been designated by DOJ; and provide explicit permission for a provider to disclose the contents of a report, including visual depictions, to law enforcement agencies, to NCMEC, or as necessary to respond to legal process. Finally, the bill revises and updates various statutory references, including to replace references to “images” with “visual depictions” to make reporting requirements applicable to videos, in addition to images.

Water Supply Infrastructure and Drought Resilience Act of 2018 This bill establishes a pilot project to adjust flood control rule curves at Bureau of Reclamation facilities. The bill amends the Omnibus Public Land Management Act of 2009 to increase access to Reclamation's WaterSMART program by including within the definition of "eligible applicant" any state, regional, or local authority the members of which include one or more organizations with water or power delivery authority. The bill provides Reclamation with increased flexibility to recharge aquifers. The conveyance of water through a project facility that crosses Bureau of Land Management land for the purpose of aquifer recharge shall not require a new or additional permit or authorization if: (1) the existing project facility has a valid agreement that allows conveyance of water for a purpose other than aquifer recharge, (2) that conveyance does not result in a substantial change to the operation of the project facility, and (3) the entity operating the facility consents to such conveyance. In developing any rule, policy, directive, management plan, or similar federal action relating to the issuance, renewal, amendment, or extension of any permit, right-of-way, or other land use or occupancy agreement, Reclamation shall: (1) recognize the longstanding authority of the states relating to evaluating, protecting, allocating, regulating, permitting, and adjudicating water use; and (2) coordinate with the states to ensure that any such action is consistent with, and imposes no greater restriction or regulatory requirement, than applicable state water law.

Practical Reforms and Other Goals To Reinforce the Effectiveness of Self-Governance and Self-Determination for Indian Tribes Act of 2018 or the PROGRESS for Indian Tribes Act This bill amends the Indian Self-Determination and Education Assistance Act to replace the Tribal Self-Governance Demonstration Project with the Tribal Self-Governance Program. Under the program, Indian tribes or organizations may receive grants to plan for participation in self-governance and to negotiate the terms of participation. In addition, the bill revises the Department of the Interior's process for approving self-governance compacts and funding agreements with Indian tribes. Interior must negotiate contracts and funding agreements to maximize implementation of the self-governance policy. The bill sets forth requirements for tribes participating in self-governance with respect to conflicts of interest, audits, redesign and consolidation of programs, retrocession of programs, nonduplication of funding, and records. Funding agreements must include provisions for Interior to monitor the performance of trust functions by the tribe and to reassume a program and funding under specified circumstances. Indian tribes participating in self-governance may elect to assume some federal responsibilities under the National Environmental Policy Act of 1969 with respect to certain construction projects. The bill prohibits a tribe from being obligated to continue performance of a compact or funding agreement that provides insufficient funding.

Surface Warfare Enhancement Act of 2018 This bill directs the Department of the Navy to: conduct a comprehensive review of its operational and administrative chains-of-command and functions; implement a training and readiness matrix for Navy surface ships; conduct a comprehensive assessment of the Navy standard workweek; require that watchstanders on Navy surface ships shall maintain a career record of watchstanding hours and specific operational evolutions; establish minimum at-sea and simulator time and evolution requirements for qualified Navy officers in certain positions; provide for the use of not fewer than six Navy Yard Patrol craft in total at the Surface Warfare Officer School Basic Division Officer Course in San Diego, California, and Norfolk, Virginia; and maintain manning fit and manning fill for ships assigned to the Forward Deployed Naval Forces at levels not less than the levels established for each ship class or type of unit deploying from the United States. Vessels listed in the Naval Vessel Register may not be homeported in a location other than in the United States or Guam for a period of more than 10 consecutive years. The bill imposes certain limitations on transition of enlisted training to Ready Relevant Learning block learning, modernized delivery, or similar approaches, and grants authority to treat military units as unavailable for deployment due to a significant readiness deficiency.

Uniting and Securing America Act of 2018 or the USA Act of 2018 This bill provides conditional permanent resident status for an alien meeting specified requirements, including having entered the United States when younger than 18 years old and residing in the United States since December 31, 2013. An individual may apply to have such conditional basis removed after meeting specified eligibility requirements. The Department of Homeland Security (DHS) shall cancel the removal of, and adjust to the status of an alien lawfully admitted for permanent residence on a conditional basis, an individual who was granted Deferred Action for Childhood Arrivals (DACA) status, unless such individual has engaged in disqualifying conduct. The bill repeals provisions that deny an unlawful alien eligibility for higher education benefits on the basis of residence within a state unless a U.S. citizen or national is eligible for such benefits without regard to whether such citizen or national is such a resident. DHS shall: (1) deploy the most practical and effective technology available in order to achieve situational awareness and operational control along the U.S. border; (2) submit to Congress a comprehensive southern border strategy to achieve border control; and (3) begin eradicating the carrizo cane plant and salt cedar along the Rio Grande River and the Lower Colorado River. DHS may construct new ports of entry along the northern and southern borders. The bill establishes Operation Stonegarden in DHS to provide border security grants to law enforcement agencies in border or maritime border states that are involved in U.S. Customs and Border Protection operations DHS shall establish a two-year grant program to improve emergency communications in the southern border region for individuals who are at risk of violence and lack cellular and LTE network service. The number of immigration judges is increased. The President shall designate a senior official (Coordinator) to coordinate federal and international efforts to strengthen citizen security, the rule of law, and economic prosperity in Central America.

Condemns: (1) the violence and displacement inflicted on Burma's (Myanmar's) Rohingya and other ethnic minorities, and (2) the attacks by the Arakan Rohingya Salvation Army militant group. Calls for an immediate halt to all hostilities by Burmese authorities. Calls on: the government of Burma to allow full access to Rakhine State and to ensure the full participation of the United Nations High Commissioner for Refugees (UNHCR) and that the voices of refugees are represented, the UNHCR and international nongovernmental organizations to play a role in monitoring repatriation efforts by the governments of Bangladesh and Burma, and the United Nations to consider the feasibility of Bangladesh's proposal for a safe zone or for a peacekeeping mission to protect vulnerable communities under international supervision. Commends: (1) the positive role of the government of Bangladesh in receiving Rohingya refugees and urges that government to continue allowing the full participation of the UNHCR and human rights organizations in accessing refugee camps, and (2) the Bangladesh's efforts to provide shelter and relief for such refugees. Calls for any return of Rohingya to include specified guarantees. Recognizes that any forced relocation of Rohingya refugees into areas not of their choosing is unacceptable. Calls on the government of Burma to: allow for a flexible and practical approach to dealing with evidence of Rohingya residence in Burma; address root causes consistent with the Rakhine Advisory Commission recommendations and fully implement such recommendations; address the issue of statelessness for the Rohingya, the deprivation of rights, and institutionalized and pervasive discrimination; and release journalists Wa Lone and Kyaw Soe Oo. Calls on the government of Bangladesh to ensure that all refugees have freedom of movement and are not subject to unsafe, involuntary, precipitous, or uninformed returns to Burma.

Earmark Elimination Act of 2018 This bill establishes a point of order in the Senate against considering legislation that includes an earmark. Under the bill, an "earmark" is a congressionally directed spending item, tax benefit, or tariff benefit targeted to a specific recipient or group of beneficiaries. The point of order may be waived by an affirmative vote of two-thirds of the Members of the Senate, duly chosen and sworn. If the point of order is successfully raised and sustained, the earmark shall be stricken from the legislation.

Pain-Capable Unborn Child Protection Act This bill amends the federal criminal code to make it a crime for any person to perform or attempt to perform an abortion if the probable post-fertilization age of the fetus is 20 weeks or more. A violator is subject to criminal penalties—a fine, up to five years in prison, or both. The bill provides exceptions for an abortion: (1) that is necessary to save the life of the pregnant woman, or (2) when the pregnancy is the result of rape or incest. A physician who performs or attempts to perform an abortion under an exception must comply with specified requirements. A woman who undergoes a prohibited abortion may not be prosecuted for violating or conspiring to violate the provisions of this bill.

Good Accounting Obligation in Government Act or the GAO-IG Act This bill requires each federal agency, in its annual budget justification, to include a report on: (1) each public recommendation of the Government Accountability Office (GAO) that is classified as "open" or "closed, unimplemented"; (2) each public recommendation for corrective action from the agency's office of the inspector general (OIG) for which no final action has been taken; and (3) the implementation status of each such recommendation. Each agency shall also provide a copy of this information to its OIG and to the GAO.

Mitigating the Methamphetamine Epidemic and Promoting Tribal Health Act or the Mitigating METH Act This bill amends the 21st Century Cures Act to make Indian tribes eligible for funding under the opioid grant program for states. In addition, the bill expands the grant program to allow states and tribes to use grants for the prevention and treatment of the use of other substances, such as methamphetamine, that have a substantial public health impact on states or tribes.

Knowledgeable Innovators and Worthy Investors Act or the KIWI Act This bill makes New Zealand nationals eligible to enter the United States as nonimmigrant traders and investors as provided for under the Immigration and Nationality Act if New Zealand provides reciprocal nonimmigrant treatment to U.S. nationals.

Declares that: (1) the United States should not tolerate the Democratic People's Republic of Korea's (DPRK's) possession of nuclear weapons or continued development of nuclear weapon and ballistic missile capabilities; (2) the United States and the international community should develop and implement the strictest sanctions regime and exhaust every reasonable diplomatic option to achieve the dismantlement of the DPRK's nuclear weapons and ballistic missile programs; and (3) the U.S. government should plan for every military contingency necessary to defend the American people and ensure regional and global security. Acknowledges that the Republic of Korea and Japan would likely face immediate retaliation by the DPRK in response to any potential U.S. military action and, therefore, any such action should be coordinated with those governments. Asserts that Congress should be consulted prior to any use of military force, recognizes that Congress possesses the authority under Article I of the Constitution to declare war, and affirms that congressional authorization is needed prior to any pre-emptive or preventative ground war on the Korean Peninsula initiated by U.S. forces.

Repeal Insurance Plans of the Multi-State Program Act of 2017 or the RIP MSP Act This bill repeals a provision of the Patient Protection and Affordable Care Act that allows the Office of Personnel Management (OPM) to enter into contracts with health insurance issuers to offer multi-state plan options. OPM must report about specified efforts in its process to wind down the multi-state program. The bill rescinds specified unobligated funds that were provided to OPM for staffing and administering the multi-state program.

Veterans Community Care and Access Act of 2017 This bill revises requirements governing health care benefits provided to veterans under programs of the Department of Veterans Affairs (VA), including to: (1) replace the existing VA programs that provide hospital care, medical services, and extended care services to veterans in their communities at non-VA facilities or through non-VA providers with a new Veterans Community Care Program; and (2) provide funds for veterans health care.

Amy, Vicky, and Andy Child Pornography Victim Assistance Act of 2017 This bill amends the federal criminal code to modify procedures for determining the amount of mandatory restitution in child pornography cases. Additionally, the bill amends the Victims of Crime Act of 1984: to direct courts to impose additional assessments on persons convicted of child pornography offenses; and to establish a Child Pornography Victims Reserve, within the Crime Victims Fund, where the additional assessments must be deposited.

Fix NICS Act of 2017 This bill amends the Brady Handgun Violence Prevention Act to require each federal agency and department, including a federal court, to: certify whether it has provided to the National Instant Criminal Background Check System (NICS) disqualifying records of persons prohibited from receiving or possessing a firearm, and establish and substantially comply with an implementation plan to maximize record submissions and verify their accuracy. The bill amends the NICS Improvement Amendments Act of 2007 to: direct the Department of Justice (DOJ) to establish a state implementation plan, including benchmarks, to maximize the automation and submission of mental health and criminal history records to the NICS; waive the grant match requirement under the National Criminal History Improvement Program (NCHIP) for a state that complies with its implementation plan; reauthorize through FY2022 the NICS Act Record Improvement Program (NARIP); establish, as a priority area for NARIP grant funding, a domestic abuse and violence prevention initiative; and create a funding preference under the NARIP program for states that establish an implementation plan and use grant funds to upload felony conviction and domestic violence records. It amends the Crime Identification Technology Act of 1998 to reauthorize through FY2022 the NCHIP program. If a state complies with its implementation plan, then the federal share of an NCHIP grant may exceed 90% of program costs.

Sugar Policy Modernization Act of 2017 This bill amends the Federal Agriculture Improvement and Reform Act of 1996 and other agricultural laws to modify the Department of Agriculture (USDA) sugar program. The bill modifies the sugar program to: reduce the rates for price support loans to processors of domestically grown sugarcane and sugar beets; require USDA to recover the net cost of the program from domestic sugar processors; extend through 2019 and then terminate the Feedstock Flexibility Program under which USDA purchases surplus sugar from domestic processors for resale to ethanol producers; extend through 2020 and then repeal the flexible marketing allotments which limit the amount of sugar that domestic processing companies may sell for domestic human use; require USDA to administer the program to provide adequate supplies of sugar at reasonable prices; require USDA to adjust sugar tariff-rate quota imports to achieve specified ratios of sugar stocks to total sugar use; and allow the transfer of quotas between countries.

Burma Human Rights and Freedom Act of 2017 This bill authorizes assistance to victims of the military's ethnic cleansing campaign targeting the Rohingya people in Rakhine State, Burma (Myanmar), as well as technical assistance to investigate and prosecute crimes related to ethnic cleansing in Rakhine State. The bill imposes restrictions on international financial institution assistance, security cooperation, and trade. It calls on the President to determine whether specified individuals should be included in the list of specially designated nationals and blocked persons maintained by the Department of the Treasury's Office of Foreign Assets Control. The Departments of State and the Treasury and the U.S. Agency for International Development shall submit to Congress an assistance strategy to promote broad-based economic development in Burma.

Honest Ads Act This bill expands source disclosure requirements for political advertisements by (1) establishing that paid internet and paid digital communications may qualify as “public communications” or “electioneering communications” that may be subject to such requirements, and (2) imposing additional requirements relating to the form of such source disclosures and the information contained within. The bill also requires certain online platform companies to maintain publicly available records about qualified political advertisements that have been purchased on their platforms.

Tribal Law and Order Reauthorization and Amendments Act of 2017 This bill amends the Indian Law Enforcement Reform Act, the Tribal Law and Order Act of 2010, and other laws to: (1) establish, or reauthorize through FY2022 and revise, various public safety programs and services for Indian communities (e.g., law enforcement, alcohol and substance abuse prevention, and control of illegal narcotics); and (2) modify provisions, and reauthorize through FY2022 various programs, related to Indian youth and juvenile justice.

Department of Veterans Affairs Financial Accountability Act of 2017 This bill expresses the sense of Congress that: (1) the normal Department of Veterans Affairs (VA) budget process should be grounded in sound actuarial analysis based on accurate demand forecasting, (2) the regular VA budget process should be the norm, and (3) supplemental requests for appropriations should be used sparingly and for unforeseen demand or natural occurrences. The VA shall contract with an independent third party to: (1) to review and audit the VA's financial processes, including reporting structures and actuarial and estimation models; (2) develop recommendations to improve such structures; and (3) complete such review and development within 180 days of entering into the contract. The VA shall submit an implementation plan to Congress within 60 days after completion of the review and development. The VA shall appoint one individual within the Office of the VA Secretary to monitor the implementation of third party recommendations. Whenever the VA submits to Congress a request for supplemental appropriations or other appropriation outside the standard budget process the VA shall submit a justification for the request within 45 days before the date that such budgetary issue would affect a program or service. Concurrent with the President's annual budget request to Congress the VA Chief Financial Officer shall submit to Congress: (1) an assurance that budgetary financial projections are sufficient to provide VA benefits and services, and (2) an attestation of collaboration with the financial officers of the concerned facilities and components.

Urges: Prime Minister Hun Sen and the Cambodian People's Party to end all harassment and intimidation of Cambodia's opposition and foster an environment where democracy can thrive and flourish; the Department of State to consider placing all senior Cambodian government officials implicated in such abuses on the Specially Designated Nationals list; the Cambodian government to free Mr. Kem Sokha and to respect freedom of the press and the rights of its citizens to freely assemble, protest, and speak out against the government; and the President to communicate to the Cambodian government that if it ignores the recommendations of the international community and maintains the current restrictive and intimidating political environment, the U.S. government will have to determine that the 2018 elections were not conducted freely or fairly. Supports electoral reform efforts in Cambodia and free and fair elections in 2018.

This bill revises the coastwise laws, commonly known as the Jones Act, that govern domestic transportation of merchandise or passengers by vessels. The Jones Act requires that vessels transporting merchandise or passengers between Puerto Rico and other U.S. ports be built in the United States, at least 75% owned by U.S. citizens, and mostly crewed by U.S. citizens. Jones Act requirements are currently waived with respect to vessels transporting passengers between Puerto Rico and U.S. ports. This bill permanently exempts vessels transporting merchandise between Puerto Rico and other U.S. ports from those requirements.

Securing Urgent Resources Vital to Indian Victim Empowerment Act or the SURVIVE Act This bill amends the Victims of Crime Act of 1984 to require the Department of Justice's Office for Victims of Crime to make grants to Indian tribes for programs and services for crime victims, such as domestic violence shelters, rape crisis centers, child abuse programs, child advocacy centers, elder abuse programs, medical care, legal services, relocation, and transitional housing. In addition, the bill makes 5% of the Crime Victims Fund available for these grants.

Healthcare Tax Relief Act This bill amends the Patient Protection and Affordable Care Act to delay the imposition of an annual fee on health insurance providers until after December 31, 2018.
