Congressional Harassment Reform Act This bill amends the Congressional Accountability Act of 1995 (CAA) to: (1) require certain discrimination and harassment awareness and prevention training for Members of Congress, officers, employees, interns, fellows, and detailees; (2) extend CAA nondiscrimination requirements and remedies to legislative interns, fellows, and detailees; (3) revise CAA procedures for certain harassment and discrimination complaints; (4) require a Member of Congress to reimburse the Treasury if an employee receives an award or settlement for the Member's alleged act of discrimination or harassment, unless the Member's request for a nonreimbursement determination is approved; and (5) rename the Office of Compliance the Office of Congressional Workplace Rights.

Fix NICS Act of 2017 This bill amends the Brady Handgun Violence Prevention Act to require each federal agency and department, including a federal court, to: certify whether it has provided to the National Instant Criminal Background Check System (NICS) disqualifying records of persons prohibited from receiving or possessing a firearm, and establish and substantially comply with an implementation plan to maximize record submissions and verify their accuracy. The bill amends the NICS Improvement Amendments Act of 2007 to: direct the Department of Justice (DOJ) to establish a state implementation plan, including benchmarks, to maximize the automation and submission of mental health and criminal history records to the NICS; waive the grant match requirement under the National Criminal History Improvement Program (NCHIP) for a state that complies with its implementation plan; reauthorize through FY2022 the NICS Act Record Improvement Program (NARIP); establish, as a priority area for NARIP grant funding, a domestic abuse and violence prevention initiative; and create a funding preference under the NARIP program for states that establish an implementation plan and use grant funds to upload felony conviction and domestic violence records. It amends the Crime Identification Technology Act of 1998 to reauthorize through FY2022 the NCHIP program. If a state complies with its implementation plan, then the federal share of an NCHIP grant may exceed 90% of program costs.

USS Indianapolis Congressional Gold Medal Act This bill requires the House of Representatives and the Senate to make appropriate arrangements for the award, on behalf of Congress, of a single gold medal of appropriate design to the crew of the USS Indianapolis , in recognition of their perseverance, bravery, and service to the United States. Following the award of the gold medal, it shall be given to the Indiana War Memorial Museum in Indianapolis, Indiana, where it will be displayed and made available for research. It is the sense of Congress that the Indiana War Memorial Museum should make the gold medal available for display elsewhere, particularly at other locations and events associated with the USS Indianapolis.

Sugar Policy Modernization Act of 2017 This bill amends the Federal Agriculture Improvement and Reform Act of 1996 and other agricultural laws to modify the Department of Agriculture (USDA) sugar program. The bill modifies the sugar program to: reduce the rates for price support loans to processors of domestically grown sugarcane and sugar beets; require USDA to recover the net cost of the program from domestic sugar processors; extend through 2019 and then terminate the Feedstock Flexibility Program under which USDA purchases surplus sugar from domestic processors for resale to ethanol producers; extend through 2020 and then repeal the flexible marketing allotments which limit the amount of sugar that domestic processing companies may sell for domestic human use; require USDA to administer the program to provide adequate supplies of sugar at reasonable prices; require USDA to adjust sugar tariff-rate quota imports to achieve specified ratios of sugar stocks to total sugar use; and allow the transfer of quotas between countries.

Foundations for Evidence-Based Policymaking Act of 2017 This bill requires departments and agencies identified in the Chief Financial Officers Act to submit annually to the Office of Management and Budget (OMB) and Congress a plan for identifying and addressing policy questions relevant to the programs, policies, and regulations of such departments and agencies.The plan must include: (1) a list of policy-relevant questions for developing evidence to support policymaking, and (2) a list of data for facilitating the use of evidence in policymaking. The OMB shall consolidate such plans into a unified evidence building plan. The bill provides statutory authority for the Interagency Council on Evaluation Policy. The council assists the OMB in supporting government-wide evaluation activities and policies. The bill defines "evaluation" to mean an assessment using systematic data collection and analysis of one or more programs, policies, and organizations intended to assess their effectiveness and efficiency. Each department or agency shall designate a Chief Evaluation Officer to coordinate evidence-building activities and an official with statistical expertise to advise on statistical policy, techniques, and procedures. The OMB shall establish an Advisory Committee on Data for Evidence Building to advise on expanding access to and use of federal data for evidence building. Open, Public, Electronic, and Necessary Government Data Act or the OPEN Government Data Act This bill requires open government data assets to be published as machine-readable data. Each agency shall: (1) develop and maintain a comprehensive data inventory for all data assets created by or collected by the agency, and (2) designate a Chief Data Officer who shall be responsible for lifecycle data management and other specified functions. The bill establishes in the OMB a Chief Data Officer Council for establishing government-wide best practices for the use, protection, dissemination, and generation of data and for promoting data sharing agreements among agencies. Confidential Information Protection and Statistical Efficiency Act of 2017 This bill codifies provisions relating to confidential information protection and statistical efficiency.

Medicaid Third Party Liability Act This bill alters provisions related to third-party liability for medical assistance paid under the Medicaid program. Specifically, with respect to such liability, the bill: expands the definition of "responsible third party" to include, among other health insurers, the TRICARE program; eliminates special rules with respect to certain services provided to children; requires the inclusion, in a contract between a state Medicaid program and a health insurer, of certain information regarding whether the state is delegating or transferring to the insurer a right of third-party recovery;  provides for the treatment as overpayment of reimbursements made by a responsible third party to a health insurer; disallows a responsible third party from denying a state's claim solely on the basis of a failure to obtain a prior authorization;  imposes a timeline for a responsible third party to respond to a state's inquiry regarding a claim for payment; provides for reductions to a state Medicaid program's federal matching rate if the state fails to comply with third-party insurance requirements; and modifies other provisions related to third-party liability under the Medicaid program. Third-party liability requirements applicable under Medicaid shall also apply under the Children's Health Insurance Program (CHIP). The Centers for Medicare & Medicaid Services must: publish on its website, and annually update, best practices for assessing third-party liability; monitor and analyze efforts to assess that liability; in consultation with states, develop and make available a model uniform reporting field for identifying information related to responsible third parties; and provide other specified information and guidance to states.

Seniors Tax Hike Prevention Act of 2017 This bill amends the Internal Revenue Code (IRC) to extend, through 2019, the rule that permits individuals who are 65 and older to deduct certain medical expenses that exceed 7.5% of adjusted gross income. (A provision that reduced the 10% threshold for the medical expense deduction to 7.5% if a taxpayer or a taxpayer's spouse is 65 or older expired at the end of 2016.) The bill also expresses the sense of the Senate that the reduction in revenues resulting from this bill should be offset by an appropriate amendment to the IRC.

Pain-Capable Unborn Child Protection Act This bill amends the federal criminal code to make it a crime for any person to perform or attempt to perform an abortion if the probable post-fertilization age of the fetus is 20 weeks or more. A violator is subject to criminal penalties—a fine, up to five years in prison, or both. The bill provides exceptions for an abortion: (1) that is necessary to save the life of the pregnant woman, or (2) when the pregnancy is the result of rape or incest. A physician who performs or attempts to perform an abortion under an exception must comply with specified requirements. A woman who undergoes a prohibited abortion may not be prosecuted for violating or conspiring to violate the provisions of this bill.

Commonsense Reporting Act of 2017 This bill amends the Patient Protection and Affordable Care Act and the Internal Revenue Code to modify the requirements for employers to report health insurance coverage information to the Internal Revenue Service (IRS) by the end of the tax year. The bill changes the information that is required and permits employers to voluntarily report the information prior to the beginning of open enrollment. The Department of the Treasury must develop a prospective reporting system to permit: employers to voluntarily report specified health insurance coverage information before the annual open enrollment period; the exchanges, the Federal Marketplace Data Services Hub, and the IRS to access the information to carry out their missions and provide the Department of Health and Human Services with information related to eligibility for advance payment of premium tax credits and cost-sharing subsidies; the exchanges to communicate with employers and employees regarding eligibility for the tax credits or cost-sharing subsidies; and employers to provide updates to the hub regarding changes in coverage for employees. At the time of enrollment, exchanges must provide employers the names of employees and dependents that enroll in a qualified health plan for a year. If a health insurance issuer or employer is unable to obtain the taxpayer identification number of a dependent, Treasury may permit the individual's full name and date of birth to be used instead. Employers participating in the reporting system established by this bill are exempt from the requirement to report health insurance coverage information to the IRS by the end of the tax year.

Leverage to Enhance Effective Diplomacy Act of 2017 or the LEED Act This bill directs the President to: (1) impose property-blocking sanctions against the North Korean government, business entities that trade with North Korea, including specified Chinese entities, and affiliated persons or entities; (2) prohibit the opening, and strictly control the maintaining in the United States, of correspondent or payable-through accounts by a foreign financial institution that assisted in the importation, sale, or transfer of North Korean goods or services; and (3) impose specified sanctions against a person that imports, purchases, or transfers goods or services from the North Korean government or from such entities or affiliates. The North Korean Human Rights Act of 2004 is amended to extend assistance for human rights and democracy programs. The bill prescribes reporting requirements with respect to North Korea's ballistic missile and missile fuel program. The Department of State shall: (1) brief Congress on the status of U.S. diplomatic engagement with North Korea and of detained U.S. citizens, and (2) develop a diplomatic strategy to end the transfer of rocket fuels and chemical precursors to North Korea. The State Department may reduce its diplomatic presence in, and terminate or reduce foreign assistance to, countries that are not cooperating with diplomatic and economic efforts to isolate North Korea.

Lead-Safe Housing for Kids Act of 2017 This bill amends the Lead-Based Paint Poisoning Prevention Act to direct the Department of Housing and Urban Development (HUD) to promulgate regulations that: require owners of certain housing to initiate a lead-based paint hazard risk assessment before a family with a child under age six occupies such housing, unless lead-based paint has already been removed; state that a visual assessment alone is not sufficient for these purposes; and require owners to control lead-based paint hazards identified in the assessment within 30 days and provide certain notices to residents of the housing. These regulations shall apply to housing receiving federal assistance that was constructed before 1978, but exclude: single-family housing covered by an application for mortgage insurance under the National Housing Act, or multi-family housing that is covered by such an application but does not receive any other federal housing assistance. HUD regulations shall also require emergency relocation of such families, without placement on a waitlist, penalty (including rent payments to be made for that dwelling unit), or lapse in assistance, to a unit that was constructed in 1978 or later or to another unit of covered housing that has no lead-based paint hazards.

The President shall designate a current U.S. Agency for International Development (USAID) employee serving in the Senior Executive Service or at the level of a Deputy Assistant Administrator or higher to serve concurrently as the Maternal and Child Survival Coordinator, who shall be responsible for: overseeing such strategy, and all U.S. government funds appropriated or used for international maternal and child health and nutrition programs. Strategy grants, contracts, and cooperative agreements shall include targets for increased implementation of high-impact, evidence-based interventions and strengthening health systems. The President shall report to Congress annually for six years regarding progress made toward achieving the strategy and ending preventable child and maternal deaths.

The EPA must establish certification criteria for the WaterSense label, enhance public awareness regarding the label, preserve the label's integrity, and review, and if appropriate, revise the WaterSense label requirements. To the maximum extent practicable and no less than annually, the EPA must estimate and publish the aggregate production, aggregate market penetration, and savings of water, energy, and capital costs of water, wastewater, and stormwater attributable to the use of WaterSense-labeled products, buildings and building landscapes, facilities, processes, and services.

North Korean Enablers Accountability Act of 2017

North Korean Enablers Accountability Act of 2017 This bill directs the President to: (1) impose property-blocking sanctions against the North Korean government, business entities that trade with North Korea, including specified Chinese entities, and affiliated persons or entities; (2) prohibit the opening, and strictly control the maintaining in the United States, of correspondent or payable-through accounts by a foreign financial institution that assisted in the importation, sale, or transfer of North Korean goods or services; and (3) impose specified sanctions against a person that imports, purchases, or transfers goods or services from the North Korean government or from such entities or affiliates. The President may waive the application of these sanctions for humanitarian or national security purposes. The bill prohibits the U.S. entry of goods mined, produced, or manufactured by North Korean labor, and directs the President to apply property-blocking sanctions against a person or entity that mines, produces, or manufactures such prohibited goods. Such prohibition shall not apply if U.S. Customs and Border Protection finds that the goods were not produced with trafficked, convict, forced, or indentured labor. The Securities and Exchange Commission shall require issuers of stock and other securities to disclose annually any investments in North Korea and activities potentially sanctionable under this bill.

Furthering carbon capture, Utilization, Technology, Underground storage, and Reduced Emissions Act or the FUTURE Act This bill amends the Internal Revenue Code to extend and modify the tax credit for carbon dioxide sequestration. The bill modifies the credit to apply it to carbon oxide sequestration. (Carbon oxide refers to any of the three oxides of carbon: carbon dioxide, carbon monoxide, and carbon suboxide.) The bill also: allows certain new industrial or direct air capture facilities to qualify for the credit if construction begins before January 1, 2024; allows qualified projects to claim the credit for 12 years, beginning on the date the equipment was originally placed in service; increases the separate credit amounts, with respect to projects placed in service upon or after the enactment of this bill, that apply to captured carbon oxide that is: (1) disposed of in secure geological storage, and (2) used as a tertiary injectant in an enhanced oil or natural gas recovery project and disposed of in secure geological storage; expands the purposes for which captured carbon oxide may be used; establishes separate carbon oxide capture thresholds for electricity generating facilities, direct air capture facilities, and facilities used for other purposes; specifies that the 75 million metric ton cap on the carbon dioxide that may qualify for the credit applies to carbon oxide and only to projects placed in service before the enactment of this bill; and allows the credit to be transferred from the entity that owns and uses the capture equipment to the entity that disposes of or uses the carbon oxide.

Affirms that the rights to freedom of assembly, association, and expression and freedom from extrajudicial detention and violence are universal human rights.

Independent Agency Regulatory Analysis Act of 2017 This bill authorizes the President to require an independent regulatory agency to: (1) comply with regulatory analysis requirements applicable to other federal agencies, (2) provide the Office of Information and Regulatory Affairs with an assessment of the costs and benefits of a proposed or final economically significant rule and an assessment of costs and benefits of potentially effective and reasonably feasible alternatives to the rule, (3) publish the assessments with the rules, and (4) submit to the office for review any proposed or final economically significant rule. An economically significant rule means a rule that is likely to: (1) have an annual effect on the economy of $100,000,000 or more; or (2) adversely affect in a material way the economy, a sector of the economy, productivity, competition, jobs, the environment, public health or safety, or state, local, or tribal governments or communities. In addition, it prohibits judicial review of an independent regulatory agency's compliance with the requirements of this bill.

National Museum of the American Latino Act

National Museum of the American Latino Act This bill establishes the National Museum of the American Latino in the Smithsonian Institution. The purposes of the museum are to: (1) illuminate Latino contributions to the story of the United States; (2) provide for the collection, study, research, publication, and establishment of exhibitions and programs related to Latino life, art, history, and culture; and (3) provide for collaboration with Smithsonian Institution museums and research centers and other museums and educational institutions in the United States and abroad to promote the study and appreciation of Latino life, art, history, culture, and its impact on society in the United States. The bill establishes a Board of Trustees for the museum to advise and assist the Board of Regents of the Smithsonian on all matters related to the administration and preservation of the museum. The Director of the museum shall manage the museum and may carry out educational and liaison programs in support of its goals. The Board of Regents shall designate a site for the museum and is authorized to design and construct it.

Charities Helping Americans Regularly Throughout the Year Act of 2017 This bill amends the Internal Revenue Code to modify several tax provisions affecting charitable contributions and tax-exempt organizations. The Internal Revenue Service may determine the standard mileage rate for deducting the cost of using a passenger automobile for charitable purposes (currently set by statute at 14 cents per mile), and the rate may not be less than the rate for medical purposes (17 cents per mile for 2017). The bill modifies the substantiation requirements for charitable contributions to eliminate an exemption for contributions that are reported on a return filed by a tax-exempt organization. Tax-exempt organizations must file their returns in electronic form. The bill excludes from the gross income of an individual who is at least 70-1/2 years of age up to $100,000 in distributions from an individual retirement plan to a donor-advised fund (DAF). The bill also modifies disclosure requirements for DAFs. (A DAF is a fund or account that is separately identified by reference to contributions of a donor or donors. The account is owned and controlled by a sponsoring charitable organization, while the donor retains advisory privileges with respect to the distribution and investment of funds in the account.) The bill reduces from 2% to 1% the excise tax on the investment income of private foundations and eliminates a provision that reduces the rate to 1% if a foundation meets certain distribution requirements. The bill exempts certain philanthropic business holdings from the tax on excess business holdings of private foundations if a foundation meets requirements for exclusive ownership, donating all profits to charity, and independent operation.

Relationship Lending Preservation Act of 2017

Relationship Lending Preservation Act of 2017 This bill directs the Consumer Financial Protection Bureau to issue regulations that include as a "qualified mortgage" any mortgage loan that: (1) is extended by a Federal Home Loan Bank member that, together with its affiliates, has less than $10 billion in total consolidated assets; (2) meets specified qualifying criteria under the Truth in Lending Act; and (3) is eligible to be purchased by a Federal Home Loan Bank pursuant to regulations of the Federal Housing Finance Agency and requirements established by the bank. Current law provides certain protections for lenders against lawsuits by distressed borrowers with respect to qualified mortgages.
