State, Local, Tribal, and Territorial Fiscal Recovery, Infrastructure, and Disaster Relief Flexibility Act This bill allows states, tribes, territories, and localities to use certain COVID-19 relief funds for new categories of spending, including for natural disasters and infrastructure projects. It also makes changes to expenditure deadlines and other aspects of this funding. Specifically, recipients may use funds for emergency relief from natural disasters and associated negative economic impacts of natural disasters. In addition, recipients may use a portion of their COVID-19 relief funds for designated infrastructure projects, such as nationally significant freight and highway projects. Furthermore, the bill allows recipients to expend COVID-19 relief funds on these types of infrastructure projects until September 30, 2026. Under current law, recipients must expend the funds by December 31, 2024. Other changes in the bill include (1) modifying eligibility and allocation requirements for funding set aside for counties and Indian tribes that are near public lands, (2) allowing Indian tribes an additional year to expend their COVID-19 relief funds, and (3) establishing a process for government entities to decline COVID-19 relief funds and requiring any declined funds to be used to reduce the federal deficit.

DHS Roles and Responsibilities in Cyber Space Act This bill requires the Department of Homeland Security (DHS) to report on its roles and responsibilities, as well as those of its components, for responding to cyber incidents. DHS must coordinate with the Cybersecurity and Infrastructure Security Agency on the report.

Foreign Merger Subsidy Disclosure Act of 2021 This bill requires entities to disclose in their premerger notification filings to federal antitrust regulators a detailed accounting of any economic support they received from a foreign state.

Save Our Servicemembers Act of 2021 This bill requires the Office of the Under Secretary of Defense for Personnel and Readiness within the Department of Defense (DOD) to evaluate and standardize DOD's suicide prevention efforts. Specifically, the bill directs the Defense Suicide Prevention Office to collaborate with each military department to (1) develop and implement a process to ensure that individual nonclinical suicide prevention efforts are assessed for effectiveness, and (2) develop consistent suicide-related definitions for use throughout DOD. The bill also requires the use of such suicide-related definitions in any updated policies of DOD or each military department.

Justice for ALS Veterans Act of 2021 This bill extends increased dependency and indemnity compensation to the surviving spouse of a veteran who dies from amyotrophic lateral sclerosis (ALS or Lou Gehrig's disease) regardless of how long the veteran had such disease prior to death. Under current law, such compensation is paid for a service-connected disability that was rated totally disabling for a continuous period of at least eight years immediately preceding death. For purposes of this bill, a surviving spouse is a person who was married to the veteran for a continuous period of eight years or longer prior to the veteran's death.

Stabilizing Medicare Access to Rehabilitation and Therapy Act or the SMART Act This bill modifies the application of a certain Medicare payment methodology for outpatient physical therapy services and outpatient occupational therapy services that are furnished by a therapy assistant. Under current law, effective January 1, 2022, payment for such services is 85% of the otherwise applicable rate. The bill delays this effective date by one year and excludes services that are furnished in rural or medically underserved areas from this payment methodology. The bill also specifies that supervision requirements for outpatient physical therapy services that are furnished through private practice may not be more stringent for purposes of Medicare coverage than under state law.

Prevent All Soring Tactics Act of 2021 or the PAST Act of 2021 This bill addresses the practice of soring horses. The soring of horses includes various actions taken on horses' limbs to produce higher gaits that may cause pain, distress, inflammation, or lameness. Specifically, the bill expands soring regulation and enforcement at horse shows, exhibitions, sales, and auctions, including by establishing a new system for inspecting horses for soring. In addition, the bill increases penalties for violations.

This bill requires the Department of Defense to provide each of its medical providers with mandatory training regarding the potential health effects of perfluoroalkyl or polyfluoroalkyl substances, commonly referred to as PFAS. These substances are man-made and may have adverse human health effects. A variety of products contain the compounds, such as nonstick cookware or weatherproof clothing.

Reclaiming the Solar Supply Chain Act of 2021 This bill requires the Department of Energy to establish a program to award grants and loans to support a solar component manufacturing supply chain. Under the program, grants and loans must be used for (1) the construction of new facilities that manufacture solar components; and (2) retooling, retrofitting, or expanding existing facilities that manufacture solar components.

VA Governors Challenge Expansion Act of 2021 This bill provides statutory authority for the Governors Challenge Program and otherwise revises the program. The program assists states and local communities with developing and implementing veteran suicide prevention activities. In particular, the bill expands the program by directing the Department of Veterans Affairs (VA) to make grants to states and American Indian and Alaska Native tribes for developing and implementing plans to prevent veteran suicides. Further, the bill requires the VA to provide technical assistance to tribes.

This bill requires the Department of Defense (DOD) to conduct outreach to build awareness among former members of the Armed Forces of the process established for the review of discharge characterizations related to sexual orientation (i.e., on the basis of Don't Ask, Don't Tell or a similar policy). DOD must also provide for specified relief for former members of the Armed Forces who were impacted by the discharge characterizations and ensure that DOD oral historians review related facts and receive testimony from affected individuals.

Prevent Exposure to Narcotics and Toxics Act of 2021 or the PREVENT ACT of 2021 This bill requires the U.S. Customs and Border Protection to make containment devices available to its officers, agents, and other personnel and to provide mandatory annual training on the use of containment devices to prevent secondary exposure to fentanyl and other lethal substances.

Animal Freedom from Testing, Experiments, and Research Act of 2021 or the AFTER Act of 2021 This bill requires federal research facilities to facilitate the adoption or nonlaboratory placement of certain warm-blooded animals (e.g., dogs, cats, monkeys, guinea pigs, hamsters, and rabbits) with animal rescue organizations, animal sanctuaries, animal shelters, or individuals. In order to be adopted or placed, the animals must (1) no longer be needed for research; (2) be suitable for release; (3) not be birds, rats, or mice.

Directed Energy Threat Emergency Response Act This bill requires actions to address anomalous health incidents. The President must designate an appropriate senior official as the Anomalous Health Incidents Interagency Coordinator. The interagency coordinator must (1) coordinate the U.S. government's response to anomalous health incidents, (2) ensure that affected personnel and dependents get access to care, and (3) ensure adequate training and education for relevant U.S. government personnel. The President must also appoint an appropriate senior official as the Deputy Anomalous Health Incidents Interagency Coordinator. The bill also requires certain agencies, including the Department of Defense and the Office of the Director of National Intelligence, to designate an appropriate senior official to serve as the Anomalous Health Incident Agency Coordination Lead. These officials must work with the interagency coordinator to (1) achieve objectives related to anomalous health incidents, and (2) jointly provide quarterly briefings to Congress on its activities. Such agencies must also develop updated workplace guidance to address anomalous health incidents. The bill authorizes the Department of State to take certain actions, such as increasing staffing for the Health Incident Response Task Force and collecting data related to anomalous health incidents.

Flood History Information Act of 2021 This bill provides for the sharing of National Flood Insurance Program policy and claim information. Specifically, the Federal Emergency Management Agency (FEMA) may share this data through an agreement with certain private insurance providers for the purposes of policy underwriting, establishing premium rates, and adjusting claims. Additionally, FEMA must provide specified flood insurance information to a purchaser, lessee, or current owner of a property upon request.

9/11 Memorial and Museum Act This bill directs the Department of Homeland Security (DHS) to award to the official organization that operates the National September 11 Memorial & Museum a one-time grant to be used solely for the purposes of the operation, security, and maintenance of the memorial and museum. As a condition on receipt of the grant, the organization must provide for free admission to all facilities and museums associated with the memorial and museum for active and retired members of the Armed Forces, individuals who were registered first responders to the terrorist attacks of September 11, 2001, and family members of victims of such attacks; provide for dedicated free admission hours for the general public at least once a week; and allow for annual federal audits of its financial statements.

This bill requires the Office of the Under Secretary of Defense for Personnel and Readiness within the Department of Defense (DOD) to designate an executive agent for commercially available advanced foreign language training to meet operational readiness requirements of DOD. The executive agent must establish a procedure for the respective military departments to reimburse any organization of DOD that provides foreign language instruction to service members.

Working Dog Commemorative Coin Act This bill directs the Department of the Treasury to mint and issue 50,000 $5 gold coins, 500,000 $1 silver coins, and 750,000 half-dollar clad coins in commemoration of the service that working dogs provide to society. The designs of the coins minted under this bill shall be emblematic of the contributions of working dogs to society, including in detection, military service, therapy and assistance. Treasury may issue coins only during the one-year period beginning on January 1, 2023. All sales of coins shall include a surcharge, which shall be paid to America's VetDogs for general expenses associated with the fulfillment of its mission.

Welcoming Evacuees Coming from Overseas to Mitigate Effects of Displacement Act of 2021 or the WELCOMED Act of 2021 This bill makes certain individuals from Afghanistan eligible for any benefit that is available to a refugee, such as resettlement assistance. Specifically, this bill shall apply to a national of Afghanistan (or an individual with no nationality who last habitually resided in Afghanistan) who is temporarily paroled into the United States for urgent humanitarian reasons or significant public benefit during the four-year period beginning on July 1, 2021.

Maximizing Outcomes through Better Investments in Lifesaving Equipment for (MOBILE) Health Care Act This bill expands and otherwise modifies the allowable uses of New Access Point grant funds. These grants help health centers establish new delivery sites to provide comprehensive primary care to medically underserved populations. Specifically, health centers may use funds to construct or renovate buildings or to set up mobile medical clinics. In addition, a mobile clinic may qualify for grant funding as a new delivery site regardless of whether it is associated with a permanent, full-time site.

Next Generation Fuels Act of 2021 This bill supports the use of biofuels (e.g., gasoline blended with ethanol) in vehicles, including by establishing a minimum octane standard for gasoline as well as making related biofuel requirements for vehicles, their fuels, and fuel infrastructure.

Protecting Election Administration from Interference Act of 2021 This bill revises preservation and retention requirements for federal election records. It also revises criminal penalties related to election records and the voting process. Under current law, election officials must, for a period of 22 months from the federal election, retain and preserve all election-related records and papers. This bill extends the requirement to electronic records and electronic equipment. Next, the bill directs the Cybersecurity and Infrastructure Security Agency to issue minimum standards and best practices for retaining and preserving records (including electronic records), papers, and electronic equipment, including protocols for observing their preservation, security, and transfer by the Department of Justice (DOJ) and a representative of each political party. In addition, the bill revises the federal criminal offense related to election records or papers to include reckless disregard of election record requirements resulting in the theft, destruction, concealment, mutilation, or alteration of a record, paper, or electronic equipment. Further, the bill allows DOJ to demand electronic records and electronic equipment for inspection and generally prohibits DOJ from disclosing this information. The bill allows DOJ and candidates for federal office to bring an action in a district court to compel compliance with election record requirements. Finally, the bill extends criminal penalties related to voting interference to include intimidating, threatening, or coercing (or attempting to do so) an individual for processing or scanning ballots, tabulating, canvassing, or certifying voting results.

John R. Lewis Voting Rights Advancement Act of 2021 This bill establishes new criteria for determining which states and political subdivisions must obtain preclearance before changes to voting practices may take effect. Preclearance is the process of receiving preapproval from the Department of Justice (DOJ) or the U.S. District Court for the District of Columbia before making legal changes that would affect voting rights. A state and all of its political subdivisions shall be subject to preclearance of voting practice changes for a 10-year period if 15 or more voting rights violations occurred in the state during the previous 25 years; 10 or more violations occurred during the previous 25 years, at least 1 of which was committed by the state itself; or 3 or more violations occurred during the previous 25 years and the state administers the elections. A political subdivision as a separate unit shall also be subject to preclearance for a 10-year period if three or more voting rights violations occurred there during the previous 25 years. States and political subdivisions that meet certain thresholds regarding minority groups must preclear covered practices before implementation, such as changes to methods of election and redistricting. Further, states and political subdivisions must notify the public of changes to voting practices. Next, the bill authorizes DOJ to require states or political subdivisions to provide certain documents or answers to questions for enforcing voting rights. The bill also outlines factors courts must consider when hearing challenges to voting practices, such as the history of official voting discrimination in the state or political subdivision.

Ensuring PFAS Cleanup Meets or Exceeds Stringent Standards Act This bill requires the Department of Defense's (DOD's) response actions to address perfluoroalkyl or polyfluoroalkyl (PFAS) substance contamination from DOD or National Guard activities to meet certain standards. PFAS are man-made and may have adverse human health effects. DOD must conduct such response actions to achieve a level of PFAS in the environmental media that meets or exceeds the most stringent of the following standards for each applicable PFAS: the state standard of the state in which the response action is being conducted under the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (CERCLA), a federal standard under CERCLA, or a health advisory under the Safe Drinking Water Act.

These substances are man-made and may have adverse human health effects. A variety of products contain the compounds, such as nonstick cookware or weatherproof clothing. DOD may not authorize the sale of any specified item containing PFAS on DOD property, such as commissaries or online exchange shops.

Hold Accountable and Lend Transparency on Campus Sexual Violence Act of 2021 or the HALT Campus Sexual Violence Act of 2021 This bill addresses dating violence, domestic violence, sexual assault, or stalking incidents on college campuses, including by expanding requirements governing the disclosure of such incidents and efforts to prevent them. Specifically, the bill requires the Department of Education (ED) to make available an online survey tool regarding student experiences with domestic violence, dating violence, sexual assault, harassment, and stalking. ED must publish a biennial report that includes campus-level data for each institution of higher education (IHE). The bill permits ED to impose civil penalties on IHEs that have violated a law under the jurisdiction of its Office for Civil Rights. In addition, the bill directs ED, the Department of Health and Human Services, and the Department of Justice to create a task force on sex-based harassment and violence in education.

Veterans' Prostate Cancer Treatment and Research Act This bill requires the Department of Veterans Affairs (VA) to establish in its National Surgery Office an interdisciplinary clinical pathway for all stages of prostate cancer. Clinical pathways are health care management tools designed around research and evidence-based practices that provide direction for the care and treatment of a specific condition. The clinical pathway must include specified elements, such as a diagnosis pathway and a treatment pathway. The VA must consult with and incorporate feedback from (1) veterans who have received prostate cancer care at its medical facilities, and (2) experts in multidisciplinary cancer care and clinical research. Additionally, the VA must publish the clinical pathway on a public VA website and annually update the pathway as needed based on medical literature and evidence-based guidelines. The bill also requires the VA to submit a plan to establish a prostate cancer program using the comprehensive prostate cancer clinical pathway.

Candidates Afforded Dignity, Equality and Training (CADET) Act of 2021 This bill requires the Departments of Defense, Homeland Security, and Transportation to prescribe regulations ensuring that the parental guardianship rights of cadets and midshipmen attending military service academies are protected consistent with individual and academic responsibilities. Cadets and midshipmen with dependents must establish a family care plan with appropriate academy leadership. Pregnant cadets and midshipmen must be provided with, at minimum, the options to (1) take leave from the military service academy for up to one year, (2) fully release from the military service academy and any related obligations, and (3) enlist in active-duty service. Males fathering a child while enrolled at a military service academy must not be required to give up parental rights and must not acquire any benefits or leave considerations as a result of fathering a child, with certain exceptions (e.g., leave to attend the birth).

Uyghur Policy Act of 2021 This bill addresses human rights issues concerning the Uyghurs and other minority groups in the Xinjiang Uyghur Autonomous Region in China. The bill authorizes the establishment of a Special Coordinator for Uyghur Issues position within the Department of State. The State Department's Bureau of Educational and Cultural Affairs may, subject to appropriations, make certain funds available to human rights advocates working on behalf of Uyghurs and members of other minority groups. The funds, if made available, shall be used to facilitate the presence of such human rights advocates at public diplomacy forums to speak on issues related to the human rights and religious freedoms of minority groups in Xinjiang. The State Department must ensure that Uyghur language training is available to Foreign Service officers. It must also ensure that a Uyghur-speaking member of the Foreign Service is assigned to U.S. diplomatic and consular missions in China.

Migratory Bird Protection Act of 2021 This bill prohibits the incidental taking (e.g., capturing or killing) of migratory birds by commercial activities unless the activity is authorized under a permit or is identified as posing de minimis risk to migratory birds. The U.S. Fish and Wildlife Service (USFWS) must regulate such incidental taking, including by (1) issuing general permits for certain industries, (2) creating a mitigation fee for any incidental taking of migratory birds, and (3) identifying categories of de minimis risk activities that are exempt from liability for the taking of migratory birds. In addition, the USFWS must establish and maintain a research program (1) to evaluate the impacts of commercial activities on birds, (2) to evaluate the effectiveness of best management practices and technologies to avoid or minimize such impacts, and (3) to develop new or improved best management practices and technologies.

Domestic Workers Bill of Rights Act This bill provides rights and protections for domestic workers (e.g., housekeepers, nannies, caretakers, personal assistants, and chauffeurs), including pay and leave rights, and health and safety protections. Specifically, the bill repeals the exemption of domestic live-in employees from certain minimum wage and maximum hour requirements. Employers must provide written notice of termination and provide at least 30 days of lodging and two weeks of severance pay to terminated live-in employees. Live-in employees also must be provided with reasonable access to telephone and internet service during their employment. The bill requires employers to provide domestic workers with a written agreement covering wages, sick leave, benefits, and other matters. Further, domestic workers may request and be granted changes to work schedules due to personal events. The bill also provides domestic workers with certain privacy rights, extends to domestic workers protections against discrimination in employment, and increases the federal medical assistance percentage (FMAP) for certain Medicaid-funded medical services provided by domestic workers. The Department of Labor must (1) award grants for a domestic worker national hotline for reporting emergencies, training on hazards facing domestic workers, and workforce investment activities for domestic workers; and (2) establish a Domestic Worker Wage and Standards Board to investigate standards in the domestic workers industry. Labor must publish online a document that describes the rights and protections for domestic workers under this bill.

Onward to Opportunity Act This bill requires the Department of Defense to implement a pilot grant program at five military installations to provide enhanced support and funding to eligible entities to supplement the Transition Assistance Program (TAP) in providing job opportunities for industry-recognized certifications, job placement assistance, and related employment services to service members participating in TAP and their spouses.

Performing Artist Tax Parity Act of 2021 This bill modifies the tax deduction for the expenses of performing artists (including commissions paid to managers or agents) to provide for a phaseout of such deduction for taxpayers whose adjusted gross income exceeds $100,000 ($200,000 for joint return filers). The $100,000 phaseout threshold is adjusted for inflation annually for taxable years beginning after 2021.

Mature Technology Node Resiliency and Manufacturing Act of 2021 This bill provides $2 billion in FY2022 funds for the Department of Commerce to give financial assistance that incentivizes investment in semiconductor facilities and equipment at mature technology nodes. (A technology node is a specific semiconductor manufacturing process and its design rules.) This assistance shall be provided to certain entities with a demonstrated ability to substantially finance, construct, expand, or modernize a semiconductor facility. Such entities must also (1) provide equipment or materials or operate at mature technology nodes, and (2) commit to using federal financial assistance received pursuant to the bill to increase semiconductor production at such nodes. Commerce must prioritize entities that support the resiliency of the semiconductor supply chain for critical manufacturing industries in the United States.

Global Malnutrition Prevention and Treatment Act of 2021 This bill sets out programs and otherwise directs the U.S. Agency for International Development (USAID) to carry out activities to prevent and treat malnutrition globally. Specifically, the USAID must leverage resources to address malnutrition through the Global Nutrition Coordination Plan (an interagency effort to strengthen the impact of U.S. investments in nutrition) and its role on the board of directors of the International Development Finance Corporation. The USAID must also select countries based on specified malnutrition-related indicators for purposes of targeting malnutrition prevention and treatment programs and update the selection within five years. Additionally, the USAID may establish the Nutrition Leadership Council to coordinate activities to prevent and treat malnutrition across the agency; target resources and nutrition interventions to the populations most susceptible to severe malnutrition and otherwise support efforts to prevent and treat malnutrition globally; and coordinate activities among partner countries, United Nations agencies, civil society, private sector actors, and others to, for example, build capacity in partner countries to sustain nutrition interventions. The bill also requires the USAID to provide to Congress an implementation plan and annual reports concerning its programs for treating and preventing malnutrition. The bill's provisions terminate seven years after its enactment.

K-12 Cybersecurity Act of 2021 This bill requires the Cybersecurity and Infrastructure Security Agency (CISA) to study the cybersecurity risks facing elementary and secondary schools and develop recommendations that include cybersecurity guidelines designed to assist schools in facing those risks. The use of such recommendations shall be voluntary. The study must evaluate the challenges that schools face in securing (1) information systems owned, leased, or relied upon by those schools; and (2) sensitive student and employee records. Further, the bill requires CISA to (1) develop an online training toolkit designed for school officials; and (2) make available on the Department of Homeland Security website the study's findings, the cybersecurity guidelines, and the toolkit.

School Milk Nutrition Act of 20 21 This bill revises requirements for milk provided by the National School Lunch Program of the Department of Agriculture. The bill permits schools participating in the program to offer students low-fat flavored milk.

American Grown Act This bill prohibits the official display of a cut flower or green in any public area of a building of the Executive Office of the President, the Department of State, or the Department of Defense unless it is produced in the United States. The prohibition does not apply to any cut flower or green used by a federal officer or employee for personal display.

United States Call Center Worker and Consumer Protection Act of 2021 This bill establishes restrictions on businesses that relocate call centers or redirect customer service calls to locations outside the United States. Specifically, a business must notify the Department of Labor that it intends to move its customer service call center overseas and Labor must maintain a publicly available list of such businesses. Subject to narrow exceptions, a business appearing on such list is ineligible to receive federal grants or guaranteed loans for five years after the business is added to the list. Further, agencies must condition the awarding of government contracts on the requirement that any call center activity pursuant to the contract must be performed in the United States. Additionally, the bill requires call center employees to disclose their physical location at the beginning of each call initiated or received, unless all employees of the business participating in the communication are located in the United States, among other exceptions.

Veterans' Agricultural Apprenticeship Act of 2021 This bill requires the Department of Agriculture to establish a program to make direct loans to farmers and ranchers who will provide mentorship and apprenticeship opportunities for veterans who have not previously operated a farm or ranch. The Government Accountability Office must report on the effectiveness of the program in assisting veterans in becoming farmers and ranchers.
