Specifically, a member may be expelled for cause pursuant to a policy adopted by a majority vote of a quorum of the directors of a credit union. Currently, a member may be expelled by a two-thirds vote of the credit union membership present at a special meeting. The expelled member may request reinstatement by the credit union board. Member conduct that may be cause for expulsion includes a loss to the credit union, a violation of the credit union membership agreement, a disruption to the operations of a credit union, fraud or attempted fraud, and other illegal or inappropriate behavior.

Helping Open Properties Endeavor Act of 2020 or the HOPE Act of 2020 This bill establishes an equity facility in the Department of the Treasury to assist commercial mortgage borrowers. Specifically, Treasury must guarantee the purchase by financial institutions of certain equity instruments backed by a commercial mortgage. The bill defines commercial mortgage as a mortgage loan secured by an interest in real property owned for rental income. Borrowers with reduced revenues from their commercial property may qualify for an amount not to exceed 10% of the outstanding amount owed on their commercial mortgage. The bill sets forth eligibility requirements for borrowers, as well as requirements for the equity instruments, including rates, fees, repayment, and the rights of purchasers.

REPLANT Act

Repairing Existing Public Lands by Adding Necessary Trees Act or the REPLANT Act This bill directs the Department of Agriculture (USDA) annually for each of the 10 years after enactment of this bill to transmit to Congress an estimate of the sums necessary to be appropriated, in addition to the funds available from other sources, to replant and otherwise treat an acreage equal to the acreage to be cut over that year, plus a sufficient portion of the backlog of lands found to be in need of treatment to eliminate the backlog within the 10-year period. After such 10-year period, USDA shall transmit annually to Congress an estimate of the sums necessary to replant and otherwise treat all lands being cut over and maintain planned timber production on all other forested lands in the National Forest System to prevent the development of a backlog of needed work larger than the needed work at the beginning of the fiscal year. Each reforestation activity included in a renewable resource assessment shall be carried out in accordance with applicable Forest Service management practices and definitions, including those contained in a specified amendment and regulations related to silvicultural practices. The Forest Service shall, based on recommendations from regional foresters, create a priority list of reforestation projects that primarily take place on priority land, promote effective reforestation following unplanned events, and may include activities to ensure adequate and appropriate seed availability. USDA shall give priority to projects on the priority list.

SOS Act

Save our Stages Act or the SOS Act This bill authorizes the Small Business Administration (SBA) to make grants to eligible live venue operators, producers, promoters, or talent representatives to address the economic effects of the COVID-19 (i.e., coronavirus disease 2019) pandemic on certain live venues. Specifically, the SBA may make (1) an initial grant of up to $12 million dollars to an eligible operator, promoter, producer, or talent representative; and (2) a supplemental grant that is equal to 50% of the initial grant. An initial grant must be used for costs incurred between March 1, 2020, and December 31, 2020, but a supplemental grant may be used for expenses incurred through June 30, 2021. Such grants shall be used for specified expenses such as payroll costs, rent, utilities, and personal protective equipment.

Protecting Firefighters from PFAS Act

Protecting Firefighters from PFAS Act This bill addresses firefighter and veteran exposure to perfluoroalkyl and polyfluoroalkyl substances, commonly referred to as PFAS. These substances are man-made and may have adverse human health effects. A variety of products contain the compounds (e.g., weatherproof clothing). The bill authorizes the use of pre-disaster hazard mitigation funding for the remediation of PFAS at fire training facilities. The National Institute of Standards and Technology in the Department of Commerce must commence a study and report on the contents and composition of new and unused personal protective equipment worn by firefighters in relation to PFAS. For certain conditions associated with exposure to PFAS, the bill provides eligibility for Department of Veterans Affairs (VA) hospital care and medical services to veterans who served on active duty at military installations at which individuals were exposed to PFAS. Service by veterans as reservists or civilian firefighters shall be considered active duty service for eligibility purposes if such service occurred during a period specified by the VA on the applicable military installations. The bill also provides eligibility for VA hospital care and medical services for exposure-related conditions to the family members of such veterans and civilian firefighters. The bill establishes a presumption of service-connection for specified illnesses or diseases related to PFAS exposure that manifest in veterans (including reservists or veterans serving as civilian firefighters) who served on active duty at a military installation where they were exposed to PFAS. Under a presumption of service-connection, specific conditions diagnosed in certain veterans are presumed to have been caused by the circumstances of their military service. Health care benefits and disability compensation may then be awarded.

Coronavirus Economic Relief for Transportation Services Act This bill requires the Department of the Treasury to provide grants and other forms of emergency assistance to certain providers of transportation services that have experienced a significant revenue loss as a direct or indirect result of COVID-19 (i.e., coronavirus disease 2019). Treasury must ensure equal access to the assistance for small, minority-owned, and women-owned businesses. As a condition of receipt of assistance, Treasury must require that a provider of transportation services agree to (1) use the funds, on a priority basis, to maintain through December 31, 2020, pay, paid administrative leave, and benefits to all employees after making any adjustments required for retirement or voluntary employee separation; and (2) recall or rehire any employee laid off, furloughed, or terminated because of reduced service as a result of COVID-19, to the extent warranted by increased service levels.

Strengthening America's Strategic National Stockpile Act of 2020 This bill makes changes to the administration and management of the Strategic National Stockpile. Among these changes, the bill authorizes through September 30, 2023, the Department of Health and Human Services (HHS) to transfer supplies from the stockpile to any federal departments or agencies under certain conditions. HHS must also ensure the contents of the stockpile remain in working order and may enter into maintenance service contracts to carry out this requirement. Furthermore, as part of its management of the stockpile, HHS must establish and maintain domestic reserves of certain supplies, including through purchases, leases, or joint ventures to access facilities and equipment to produce these supplies. The authority for such purchases, leases, or joint ventures terminates on September 30, 2023. Additionally, the bill temporarily authorizes HHS to award grants to states for maintaining stockpiles of certain equipment and supplies for use during public health emergencies. HHS must also develop transparent processes for the use and distribution of supplies from the stockpile that address, for example, the prioritization of requests. Additionally, during the COVID-19 (i.e., coronavirus disease 2019) emergency, the Office of the Assistant Secretary for Preparedness and Response must report monthly on requests for supplies from states, tribes, and other jurisdictions. These reports must include the rationale for any partially fulfilled or denied requests. Lastly, the Government Accountability Office must study the feasibility of establishing user fees to offset costs for procuring single-source materials for, and distributing such materials from, the stockpile.

VA Clinical Training in Evidence-based treatments And Military Culture Act of 2020 or the VA Clinical TEAM Culture Act of 2020 This bill requires the Department of Veterans Affairs (VA) to establish standards and requirements for the provision of mental health care by non-VA providers in the Veterans Community Care Program (VCCP). The established standards must be the same as the standards applicable to VA employees who provide mental health care. The VA must require non-VA mental health care providers to complete training courses on military culture, core competencies for health care professionals, suicide evaluation and management, post-traumatic stress disorder, traumatic brain injury, and military sexual trauma after the provider becomes approved under the VCCP. The VA must also (1) identify additional training areas for which to develop courses, and (2) require the non-VA providers to complete such courses.

Reviving the Economy Sustainably Towards A Recovery in Twenty-twenty Act or the RESTART Act This bill establishes a loan program whereby the Small Business Administration (SBA) shall guarantee loan amounts to certain businesses affected by COVID-19 (i.e., coronavirus disease 2019). Specifically, the bill requires the SBA to guarantee 100% of program loan amounts made to certain small businesses that have not more than than 5,000 full-time employees. The terms for such loans shall include (1) a maximum duration of not more than seven years; (2) an amount that is not greater than 45% of 2019 gross receipts, up to $12 million; and (3) no payment on principal for the first two years of the loan. A lender that is otherwise approved to make paycheck protection loans may make and approve loans established by the bill, and a recipient may use loan funds for specified allowable expenses including payroll costs, rent, utilities, and personal protective equipment. Such loans may be forgiven up to the amount of total losses incurred by the recipient in the taxable year 2020.

Library Stabilization Fund Act of 2020 This bill establishes and provides funds for a Library Stabilization Fund to assist libraries with responding to and recovering from the coronavirus (i.e., the virus that causes COVID-19) pandemic. Specifically, the bill directs the Institute of Museum and Library Services (IMLS) to allocate funding to states, Indian tribes, and organizations that primarily serve and represent Native Hawaiians. From these allocated funds, the IMLS must also make emergency library relief grants to state library administrative agencies with approved five-year plans, Indian tribes, and organizations that primarily serve and represent Native Hawaiians. Additionally, the IMLS must allocate funding to carry out activities that strengthen the ability of libraries to provide services to communities affected by the coronavirus pandemic. The IMLS may enter into arrangements (e.g., grants and contracts) and other forms of assistance with libraries, library consortia and associations, and institutions of higher education to carry out these activities. Funds allocated by the bill may be used to provide support to libraries, such as by supporting general operations; paying staff; purchasing cleaning supplies; training library staff on the safe handling of library materials; providing access to computers and other technology; purchasing digital resources; expanding resources related to early education and literacy, distance learning, and workforce development training; and ensuring access to community services and activities.

Federal PFAS Research Evaluation Act This bill requires various studies and reports on the exposure, hazards, and management of perfluoroalkyl and polyfluoroalkyl substances, commonly referred to as PFAS. These substances are man-made and may have adverse human health effects. A variety of products contain the compounds, such as nonstick cookware or weatherproof clothing. Specifically, the bill requires the Environmental Protection Agency (EPA) to enter into an agreement with the National Academies of Sciences, Engineering, and Medicine (NASEM) to conduct a two-phase study and report on the research and development needed to advance human exposure estimation and toxicity hazard estimation of individual or total PFAS. The bill also requires the EPA to jointly enter into an agreement with NASEM to conduct a study and submit a report on the research and development needed to advance the understanding of the extent and implications of environmental contamination by PFAS, how to manage and treat such contamination, and the development of safe alternatives. Research Investment to Spark the Economy Act or the RISE Act This bill authorizes the Departments of Agriculture, Commerce, Defense, Education, Energy, the Interior, and Health and Human Services and the National Aeronautics and Space Administration (NASA), National Science Foundation, and Environmental Protection Agency to provide support for research regarding COVID-19 (i.e., coronavirus disease 2019) or research disrupted by the COVID-19 pandemic. Support under this bill shall be provided through federal science agencies with at least $50 million in basic and applied research obligations in FY2020. Support may be used to provide supplemental funding to extend the duration of a grant to a research institution or national laboratory that was awarded prior to the enactment of this bill, or to expand the purposes of such a grant as specified; provide supplemental funding through existing competitively awarded cooperative agreements and contracts to cover the increased costs of construction of scientific facilities and equipment that have been delayed because of COVID-19; and award grants and cooperative agreements to institutions of higher education to conduct research on the behavioral, social, or economic effects of COVID-19 and the responses to the disease or on the effectiveness of such responses. Agencies must provide the support as rapidly as possible. Provided funds shall remain available for expenditure for up to two years.

CHIPS for America Act

Creating Helpful Incentives to Produce Semiconductors for America Act or the CHIPS for America Act This bill establishes investments and incentives to support U.S. semiconductor manufacturing, research and development, and supply chain security. Specifically, the bill provides an income tax credit for semiconductor equipment or manufacturing facility investment through 2026. The bill also establishes a trust fund to be allocated upon reaching an agreement with foreign government partners to promote (1) consistency in policies related to microelectronics, (2) transparency in microelectronic supply chains, and (3) alignment in policies towards nonmarket economies. The Department of Commerce shall, through the National Institute of Standards and Technology (NIST), carry out a program of research and development investment to accelerate the design, development, and manufacturability of next generation microelectronics, including through the creation of a Manufacturing USA institute for semiconductor manufacturing. Commerce shall also establish a program to match state and local government incentives offered to private entities for the purposes of building fabrication facilities relating to semiconductor manufacturing. Further, Commerce shall assess the capabilities of the U.S. industrial base to support the national defense in light of the global nature of supply chains and interdependencies between the industrial bases of the U.S. and foreign countries with respect to the manufacture and design of semiconductors. The Department of Defense shall prioritize the use of specified available amounts for programs, projects, and activities in connection with semiconductor and related technologies. The President shall establish within NIST a subcommittee on matters relating to U.S. leadership in semiconductor technology and innovation, which shall develop a national strategy on semiconductor research.

Justice in Policing Act of 2020 This bill addresses a wide range of policies and issues regarding policing practices and law enforcement accountability. It includes measures to increase accountability for law enforcement misconduct, to enhance transparency and data collection, and to eliminate discriminatory policing practices. The bill facilitates federal enforcement of constitutional violations (e.g., excessive use of force) by state and local law enforcement. Among other things, it does the following: lowers the criminal intent standard—from willful to knowing or reckless—to convict a law enforcement officer for misconduct in a federal prosecution, limits qualified immunity as a defense to liability in a private civil action against a law enforcement officer or state correctional officer, and authorizes the Department of Justice to issue subpoenas in investigations of police departments for a pattern or practice of discrimination. The bill also creates a national registry—the National Police Misconduct Registry—to compile data on complaints and records of police misconduct. It establishes a framework to prohibit racial profiling at the federal, state, and local levels. The bill establishes new requirements for law enforcement officers and agencies, including to report data on use-of-force incidents, to obtain training on implicit bias and racial profiling, and to wear body cameras.

Great American Outdoors Act

Great American Outdoors Act This bill establishes the National Parks and Public Land Legacy Restoration Fund to support deferred maintenance projects on federal lands. For FY2021-FY2025, there shall be deposited into the fund an amount equal to 50% of all federal revenues from the development of oil, gas, coal, or alternative or renewable energy on federal lands and waters. Deposited amounts must not exceed $1.9 billion for any fiscal year. The fund must be used for priority deferred maintenance projects in specified systems that are administered by the National Park Service, the Forest Service, the U.S. Fish and Wildlife Service, the Bureau of Land Management, and the Bureau of Indian Education. The Government Accountability Office must report on the effect of the fund in reducing the backlog of priority deferred maintenance projects for the specified agencies. Additionally, the bill makes funding for the Land and Water Conservation Fund (LWCF) permanent. The President shall annually report to Congress specified details regarding the allocation of funds to the LWCF. Congress may provide for alternate allocations using specified procedures.

Accelerating Access to Critical Therapies for ALS Act This bill establishes a grant program, as well as a new center within the Food and Drug Administration (FDA), to facilitate access to investigational therapies for neurodegenerative diseases such as amyotrophic lateral sclerosis (i.e., ALS, also known as Lou Gehrig's disease, a progressive and fatal disease). Specifically, the Department of Health and Human Services (HHS) must award grants for the provision of investigational drugs for ALS and other rapidly progressing neurodegenerative diseases through an expanded access (i.e., compassionate use) program. HHS may award these grants to (1) a small business that is the sponsor of an investigational new drug application, or (2) a participating clinical trial site for such a sponsor. Additionally, HHS must establish within the FDA a Center of Excellence for Neurodegenerative Diseases. The center shall have duties and authorities similar to those of the FDA's Oncology Center of Excellence, which helps expedite the development of medical products and assists providers in requesting access to investigational drugs.

Terms for such loans shall include (1) a 15-year term, (2) no requirement to provide collateral or a guaranty, and (3) a maximum loan amount of $25 million. An applicant for such a loan must make a good faith certification that, among other things, (1) the loan request is necessary to support the recipient's ongoing operations; and (2) the recipient will use the loan for purposes directly connected to contracted services, including performances and sporting events.

Paycheck Protection Program Flexibility Act of 2020

Paycheck Protection Program Flexibility Act of 2020 This bill modifies provisions related to the forgiveness of loans made to small businesses under the Paycheck Protection Program implemented in response to COVID-19 (i.e., coronavirus disease 2019). Specifically, the bill establishes a minimum maturity of five years for a paycheck protection loan that has a remaining balance after the application of forgiveness. The bill also extends the covered period during which the recipient of a paycheck protection loan may use such funds for certain expenses while remaining eligible for forgiveness of the loan. Further, the bill prohibits the Small Business Administration from limiting the non-payroll portion of a forgivable covered loan amount. Currently, only 25% of a paycheck protection loan may be allocated to non-payroll expenses such as rent and utilities. The bill extends the period of time in which an employer may rehire or eliminate a reduction in employment, salary, or wages that would otherwise reduce the forgivable amount of a paycheck protection loan. However, the forgivable amount must be determined without regard to a reduction in the number of employees if the recipient is (1) unable to rehire an employee, (2) able to demonstrate an inability to hire a similarly qualified employee, or (3) able to demonstrate an inability to return to the same level of business activity. Lastly, the bill eliminates a provision that makes a paycheck protection loan recipient who has such indebtedness forgiven ineligible to defer payroll tax payments.
