K2 Veterans Toxic Exposure Accountability Act of 2020

K2 Veterans Toxic Exposure Accountability Act of 2020 This bill addresses toxic exposure of members of the Armed Forces deployed to Karshi-Khanabad (K-2) Air Base in Uzbekistan between October 1, 2001, and December 31, 2005. Specifically, the bill requires the Department of Defense (DOD) to conduct a study and report on such exposure. Based on the results of the study, the Department of Veterans Affairs (VA) must determine (1) whether a positive association exists between such exposure and the occurrence of a diagnosed illness in humans, and (2) whether a presumption of service-connection is warranted. Under a presumption of service-connection, specific conditions diagnosed in certain veterans are presumed to have been caused by the circumstances of their military service. Health care benefits and disability compensation may then be awarded. If the VA determines a presumption of service-connection is not warranted, notice must be published and include an explanation of the basis for the determination. The bill also requires the VA to remove previous presumptions if evidence indicates such presumption is not warranted. The bill requires the VA to establish and maintain a registry for individuals who were deployed to K-2 during the specified time frame. Finally, DOD must provide access to information upon request by the National Academies of Sciences, Engineering, and Medicine for purposes of a study regarding the effects of exposure to toxic substances at K-2.

Transparency in Prescription Drug Advertising Act This bill requires that the list prices of drugs be included, as appropriate, in advertising for such drugs and directs the Department of Health and Human Services to issue department-wide guidance to that effect that is consistent with regulations issued by the Centers for Medicare & Medicaid Services (CMS) regarding drug price transparency. On May 10, 2019, the CMS issued a final rule titled Medicare and Medicaid Programs; Regulation to Require Drug Pricing Transparency . The rule requires direct-to-consumer television advertisements for drugs and biologics covered under Medicare and Medicaid to include the list price of a 30-day supply or for a typical course of treatment, if the list price is at least $35 per month. The rule was scheduled to take effect on July 9, 2019; however, a federal court blocked the rule's implementation, citing a lack of statutory authority.

State and Local Cybersecurity Improvement Act This bill establishes a grant program and places requirements on the Cybersecurity and Infrastructure Security Agency (CISA) with respect to certain cybersecurity risks and threats. Specifically, CISA shall distribute grants to states for addressing cybersecurity risks and threats to the information systems of state, local, tribal, or territorial governments. A state applying for such a grant must (1) submit a cybersecurity plan for approval, and (2) establish a cybersecurity planning committee to assist with developing and implementing the state's cybersecurity plan and determining the effective funding priorities for the grant. CISA must establish a State and Local Cybersecurity Resiliency Committee whereby state, local, tribal, and territorial governments can advise CISA on their cybersecurity needs. In addition, CISA must develop and make publicly available a Homeland Security Strategy to Improve the Cybersecurity of State, Local, Tribal, and Territorial Governments that provides recommendations regarding how the federal government should support and promote the ability of such governments to protect against, respond to, and recover from cybersecurity risks, threats, and incidents. CISA must also conduct a study to assess the feasibility of implementing a short-term rotational program for the detail of approved state, local, tribal, and territorial government employees in cyber workforce positions to the agency.

Federal Law Enforcement Training Research and Reporting Act of 2020 This bill requires the Director of the Federal Law Enforcement Training Centers, in coordination with the Under Secretary for Science and Technology of the Department of Homeland Security (DHS), to conduct research and development of a technology to enhance participation rates in training offered to state, local, and tribal communities, with particular attention to rural or remote communities, to enhance domestic preparedness for and collective response to terrorism and other homeland security threats. The Under Secretary for Management shall report to Congress on the accreditation status for each basic training program within DHS. If a basic training program loses accreditation, the relevant component shall notify the Under Secretary within 30 days after such loss.

Boundary Waters Wilderness Protection and Pollution Prevention Act This bill withdraws approximately 234,328 acres of federal land and waters in a specified area in the Rainy River Watershed of Superior National Forest in Minnesota from entry, appropriation, and disposal under the public land laws; location, entry, and patent under the mining laws; and operation of the mineral leasing, mineral materials, and geothermal leasing laws. The area is adjacent to the Boundary Waters Canoe Area Wilderness and the Boundary Waters Canoe Area Wilderness Mining Protection Area. Land or interest in land within such area that is acquired by the United States shall be immediately withdrawn in accordance with this bill. The Forest Service is authorized to permit the removal of sand, granite, iron ore, and taconite from national forest system lands within such area if the removal is not detrimental to the water quality, air quality, and health of forest habitat within the Rainy River Watershed.

Domestic Terrorism Prevention Act of 2020 This bill establishes new requirements to expand the availability of information on domestic terrorism, as well as the relationship between domestic terrorism and hate crimes. It authorizes domestic terrorism components within the Department of Homeland Security (DHS), the Department of Justice (DOJ), and the Federal Bureau of Investigation (FBI) to monitor, analyze, investigate, and prosecute domestic terrorism. The domestic terrorism components of DHS, DOJ, and the FBI must jointly report on domestic terrorism, including white-supremacist-related incidents or attempted incidents. DHS, DOJ, and the FBI must review the anti-terrorism training and resource programs of their agencies that are provided to federal, state, local, and tribal law enforcement agencies. It creates an interagency task force to analyze and combat white supremacist and neo-Nazi infiltration of the uniformed services and federal law enforcement agencies. Finally, it directs the FBI to assign a special agent or hate crimes liaison to each field office to investigate hate crimes incidents with a nexus to domestic terrorism.

Clean Water Standards for PFAS Act of 2020 This bill directs the Environmental Protection Agency (EPA) to review certain point sources that discharge perfluoroalkyl and polyfluoroalkyl substances, commonly referred to as PFAS. Based on this review, the EPA must establish effluent limitations and pretreatment standards, as well as publish water quality criteria, for certain PFAS. PFAS are man-made and may have adverse human health effects. A variety of products contain the compounds, such as nonstick cookware or weatherproof clothing. The bill also directs the EPA to award grants to owners and operators of publicly owned treatment works to implement PFAS pretreatment standards.

Federal Funding Accountability for Sexual Harassers Act This bill requires institutions of higher education (IHEs) that receive federal funding to report certain instances of discrimination on the basis of sex. Such IHEs must report, to all federal agencies that awarded competitive research and development grants over the previous 10 years and to the Federal Audit Clearinghouse, substantiated findings of discrimination (including harassment) on the basis of sex by a principal investigator or program director. A principal investigator or program director is an individual designated to direct or lead a project, program, or activity supported by a federal grant and who is responsible and accountable for the proper conduct of the project, program, or activity. In addition, each federal department or agency that is authorized to award competitive research and development grants must take into consideration any such reports when making the final decision of whether to award a grant to an IHE. The department or agency may condition the grant award on the prohibition of an individual for whom a report has been filed from using the grant award or carrying out activities under the grant. The National Academies of Sciences, Engineering, and Medicine must study and report on the implementation and effectiveness of strategies employed to address and prevent sexual harassment.

Support for Veterans in Effective Apprenticeships Act of 2019 This bill requires the Department of Labor to revise its registered apprenticeship programs to include additional program requirements for increasing the access of veterans and their survivors or dependents to such programs. Labor must acquire written assurance that sponsors of apprenticeship programs (1) are aware of the availability of educational assistance for veterans and eligible individuals for use in such programs, (2) will make a good faith effort to obtain approval for such educational assistance for at least each program location that employs or recruits such recipients, and (3) will not deny a qualified applicant to avoid making a good faith effort to obtain approval for educational assistance. In addition, Labor must (1) require program sponsors to provide standards that contain provisions to grant advanced standing or credit, (2) provide increased wages commensurate to such standing or credit for veterans or individuals eligible for educational assistance, and (3) provide a copy of the approved apprenticeship program's certificate of registration to the state approving agency.

Securing America's Ports Act This bill requires the Department of Homeland Security (DHS) to report to Congress a plan to scan all commercial and passenger vehicles entering the United States at a land port of entry using large-scale non-intrusive inspection systems, such as X-ray and gamma-ray imaging systems. The plan shall include elements such as (1) an inventory of such systems currently in use, (2) the estimated costs of achieving a 100% scanning rate, and (3) the anticipated impact that increasing the scanning rate will have on wait times at land ports of entry. DHS shall periodically report to Congress on the progress in implementing the plan. DHS shall also carry out a pilot program to research and develop technology enhancements to inspection areas at land ports of entry.

Stopping Harm and Implementing Enhanced Lead-time for Debts for Veterans Act or the SHIELD for Veterans Act This bill updates debt collection and overpayment processes related to Department of Veterans Affairs (VA) benefits or programs. Specifically, the bill prohibits the VA from collecting all or any part of an amount owed under a VA program if the amount is owed for any payment or overpayment that was caused by the amount of time taken by the VA to process information provided by or on behalf of an individual. If the VA has made an overpayment to an individual, the VA must provide notice to the individual of the overpayment and any action the VA plans to take to collect repayment or reduce any benefit of the individual at least 90 days before taking such action. The notice must include an explanation of the right of the individual to dispute the overpayment or request a waiver of indebtedness. The VA must report on its plan for the improvement of the notification and communication processes for individuals who receive overpayments from the VA. The bill prohibits interest and administrative cost charges on delinquent payments of debt resulting from a person's participation in a VA disability compensation program, pension program, or an educational assistance program.

The Environmental Protection Agency (EPA) must monitor, evaluate, and report on the progress of the United States in achieving the national goal. In addition, the EPA must establish the Clean Economy Federal Advisory Committee to make recommendations to the EPA on one or more interim greenhouse gas emissions reduction goals for the United States to achieve before achieving the national goal. After obtaining the committee's recommendations, the EPA must recommend to Congress one or more interim goals.

Farm Workforce Modernization Act of 2019

Farm Workforce Modernization Act of 2019 This bill contains provisions related to alien farmworkers, including provisions establishing a certified agricultural worker (CAW) status and changing the H-2A temporary worker program. The Department of Homeland Security (DHS) may grant CAW status to an applying alien who (1) performed at least 1,035 hours of agricultural labor during the two-year period prior to November 12, 2019, (2) was inadmissible or deportable on that date, and (3) has been continuously present in the United States from that date until receiving CAW status. The bill imposes additional crime-related inadmissibility grounds on CAW applicants and makes some other grounds inapplicable. CAW status shall be valid for 5.5 years and may be extended. DHS may grant dependent status to the spouse or children of a principal alien. An alien with a pending application may not be detained or removed by DHS and shall be authorized for employment until DHS makes a final decision on the application. A CAW alien (and dependents) may apply for lawful permanent resident status after meeting various requirements, including performing a certain amount of agricultural labor for a number of years. DHS shall create an electronic platform for (1) filing H-2A petitions, (2) facilitating the processing of H-2A cases, and (3) providing agencies a single tool for obtaining H-2A-related case information. The bill makes various changes to the H-2A program, such as (1) modifying the method for calculating and making adjustments to the H-2A worker minimum wage, (2) specifying how an employer may satisfy requirements that it attempted to recruit U.S. workers, (3) requiring H-2A employers to guarantee certain minimum work hours, and (4) making the program available for year-round agricultural work and reserving a visa allocation for the dairy industry. Recruiting in Underserved Rural Areas and Localities for Veterans Act or the RURAL Veterans Act This bill addresses the recruitment of Department of Veterans Affairs (VA) health care professionals in rural areas. Specifically, the bill requires the VA to establish the Office of Rural Recruitment to improve the recruitment of health care professionals for rural and highly rural community-based outpatient clinics and medical centers of the VA. The bill also requires the director of each Veterans Integrated Service Network that contains at least one rural or highly rural community-based outpatient clinic to annually develop and maintain a strategy to recruit health care professionals. The Office of Rural Recruitment shall conduct a study on the feasibility of a scholarship program for health care professionals to attend the Uniformed Services University of the Health Sciences in exchange for service as full-time employees at a rural or highly rural community-based outpatient clinic or medical center of the VA for a specified period of time. The VA shall establish the Rural Health Quality and Access Fellowship program to provide fellowships to health care professionals at the graduate or post-graduate level who serve on a short-term basis as full-time employees at a rural or highly rural community-based outpatient clinic or medical center of the VA and conduct research on (1) improving the quality of rural health care, (2) access to health care in rural areas, and (3) recruitment and retention of health care professionals in rural areas.

Election Technology Research Act of 2020

Election Technology Research Act of 2019 This bill directs the National Institute of Standards and Technology (NIST), the National Science Foundation (NSF), and other agencies to support research on voting systems. NIST, in collaboration with the NSF, must carry out research related to the security and integrity of voting systems. NIST shall make an award to an institution of higher education or a nonprofit organization to establish a Center of Excellence in Election Systems. The NSF, in collaboration with other agencies, shall award basic research grants to increase the understanding of cyber and other threats to voting systems and to inform the development of technologies, processes, and policies that contribute to more secure, fair, and accessible elections. The NSF shall award grants to institutions of higher education or nonprofit organizations to establish at least one multidisciplinary center for elections systems research and education. NIST shall establish and make available common data format specifications for auditing, voter registration, and other elements of voting systems. The General Accountability Office must report on, among other things, the extent to which NIST's efforts to assist in the development of voluntary voting systems guidelines have resulted in market-ready standardized voting equipment and software.

Rural STEM Education Act This bill directs the National Science Foundation (NSF) to support research regarding STEM (science, technology, engineering, and mathematics, including computer science) education in rural schools. The NSF must award grants to institutions of higher education or nonprofit organizations for (1) research and development to advance innovative approaches to support and sustain high-quality STEM teaching in rural schools, (2) research and development of programming to identify the barriers rural students face in accessing high-quality STEM education, (3) development of innovative solutions to improve the participation and advancement of rural students in grades Pre-K through 12 in STEM studies, and (4) research on online STEM education courses for rural communities. The NSF may establish a pilot program of regional cohorts in rural areas to provide peer support, mentoring, and hands-on research experiences for rural STEM educators of students in grades Pre-K through 12 in order to build an ecosystem of cooperation among educators, researchers, academia, and local industry. The NSF shall enter into an agreement with the National Academy of Sciences under which the National Academy agrees to evaluate aspects of STEM education and workforce development in rural areas. The National Institute of Standards and Technology must award prizes to stimulate research and development of creative technologies in order to deploy affordable and reliable broadband connectivity to underserved rural communities. The Office of Science and Technology Policy must establish a broadband research and development working group to address national research challenges and opportunities for improving broadband access and adoption across the United States.

Leveraging Effective Apprenticeships to Rebuild National Skills Act or the LEARNS Act This bill establishes, in the Employment and Training Administration of the Department of Labor, an Office of Apprenticeship to determine whether an apprenticeship program meets requirements for registration and maintains the standards necessary to remain registered, manage the national apprenticeship system (the collective group of registered apprenticeship programs and pre-apprenticeship programs in the nation), and make grants on a competitive basis to eligible entities to carry out projects that support development of pre-apprenticeship programs. The bill also establishes in Labor a National Advisory Committee on Apprenticeships. Labor and the Department of Education shall establish a voluntary Registered Apprenticeship-College Collaborative consisting of the sponsors carrying out registered apprenticeship programs, two- or four-year postsecondary educational institutions, and organizations that represent such programs or institutions, that agree to meet certain criteria in order to promote stronger connections between the registered apprenticeship programs involved and participating two- and four-year postsecondary educational institutions. Labor shall make assistance payments to eligible sponsors of new registered apprenticeship programs or of existing programs that add employers as new partners.

Farm Workforce Modernization Act of 2019

Farm Workforce Modernization Act of 2019 This bill contains provisions related to alien farmworkers, including provisions establishing a certified agricultural worker (CAW) status and changing the H-2A temporary worker program. The Department of Homeland Security (DHS) may grant CAW status to an applying alien who (1) performed at least 1,035 hours of agricultural labor during the two-year period prior to October 30, 2019, (2) was inadmissible or deportable on that date, and (3) has been continuously present in the United States from that date until receiving CAW status. The bill imposes additional crime-related inadmissibility grounds on CAW applicants and makes some other grounds inapplicable. CAW status shall be valid for 5.5 years and may be extended. DHS may grant dependent status to the spouse or children of a principal alien. An alien with a pending application may not be detained or removed by DHS and shall be authorized for employment until DHS makes a final decision on the application. A CAW alien (and dependents) may apply for lawful permanent resident status after meeting various requirements, including performing a certain amount of agricultural labor for a number of years. DHS shall create an electronic platform for (1) filing H-2A petitions, (2) facilitating the processing of H-2A cases, and (3) providing agencies a single tool for obtaining H-2A-related case information. The bill makes various changes to the H-2A program, such as (1) modifying the method for calculating and making adjustments to the H-2A worker minimum wage, (2) specifying how an employer may satisfy requirements that it attempted to recruit U.S. workers, (3) requiring H-2A employers to guarantee certain minimum work hours, and (4) making the program available for year-round agricultural work and reserving a visa allocation for the dairy industry. Insulin Price Reduction Act

Insulin Price Reduction Act This bill prohibits health insurance plan issuers and pharmacy benefits managers (PBMs) from receiving rebates or discounts for insulin from manufacturers who certify that its current insulin list price has been reduced to an amount no greater than what the list price was for the same insulin on July 1, 2006. This restriction does not apply to discounts provided to insurance plan holders at retail sale or to flat-rate fees for service paid to PBMs. Further, insurance plans are prohibited from applying a deductible to insulin that has received such price certification. A manufacturer may certify insulin prices by submitting to the Department of Health and Human Services data about the list price of any insulin the manufacturer has produced since January 1, 2000, and by setting the current list price for an insulin product at the 2006 rate. To remain certified, a manufacturer may not increase the list price of insulin by more than the annual increase in the medical care consumer price index. A manufacturer may certify the price of an insulin product for which it did not have a list price in 2006 by reducing the list price of such insulin to the weighted average list price in 2006 of specified insulin categories. This bill also applies to Medicare prescription drug benefits. The bill sets the rebate for insulin under Medicaid based on the average manufacturer price of insulin during the last fiscal quarter of 2019, increasing by the medical care consumer price index thereafter.
