Expresses opposition to the Environmental Protection Agency (EPA) proposal entitled "Prevention of Significant Deterioration New Source Review: Refinement of Increment Modeling Procedures" and urges that the rule be withdrawn. Finds that EPA has proposed multiple changes to the PSD program that would conflict with Congress's statutory scheme to preserve, protect, and enhance air quality in national parks, wilderness areas, monuments, and seashores, and in other areas of special natural, recreational, scenic, or historic value.

Giving Incentives to Volunteers Everywhere Act of 2008 or the GIVE Act of 2008 - Amends the Internal Revenue Code to: (1) increase the standard mileage rate for use of a passenger automobile for charitable purposes to a rate not less than the rate used for the tax deduction for medical transportation expenses; and (2) exclude from the gross income of charitable volunteers reimbursements paid to them for the use of a passenger automobile for the benefit of a charitable organization.

Designates September 2008 as National Prostate Cancer Awareness Month. Declares that the federal government has a responsibility to: (1) raise awareness about prostate cancer screening and treatment; (2) increase funding for prostate cancer research; and (3) improve access to, and the quality of, health care services for detecting and treating prostate cancer.

Presidential Historical Records Preservation Act of 2008 - Authorizes appropriations for the National Historical Publications and Records Commission for FY2010. Requires the Archivist of the United States, with the recommendation of the Commission, to make grants to eligible entities on a competitive basis to promote the historical preservation of, and public access to, historical records and documents relating to any President who does not have a presidential archival depository currently managed and maintained by the federal government pursuant to the Presidential Libraries Act of 1955. Defines eligible entities as specified tax-exempt organizations or state or local governments. Prohibits the use of grants for the maintenance, operating costs, or construction of any facility to house the historical records or documents. Prohibits the Commission from approving a grant application unless an entity establishes that it meets certain requirements, including that it: (1) ensures the preservation of, and access to, such historical works and collections of historical sources at no charge to the public; (2) has educational programs that make the use of such documents part of the entity's mission; and (3) has raised funds from nonfederal sources in support of the entity's efforts to promote such preservation and access.

Recognizes September 11, 2008, as a day of solemn commemoration of the events of September 11, 2001. Offers condolences to the families, friends, and loved ones of the innocent victims of the September 11, 2001, terrorist attacks. Honors the heroic service, actions, and sacrifices of first responders, law enforcement personnel, state and local officials, volunteers, and others who aided the victims and, in doing so, risked and often gave their own lives. Recognizes the service, actions, and sacrifices of U.S. personnel who have given so much to support our freedom and defend our security. Reaffirms that the people of the United States will never forget the challenges our country endured on and since September 11, 2001, and will work to defeat those who attacked us.

ADA Amendments Act of 2008 - Amends the Americans with Disabilities Act of 1990 (ADA) to redefine the term "disability," including by defining "major life activities" and "being regarded as having such an impairment." Sets forth rules of construction regarding the definition of "disability," including that: (1) such term shall be construed in favor of broad coverage of individuals under the Act; (2) an impairment that substantially limits one major life activity need not limit other major life activities in order to be a disability; (3) an impairment that is episodic or in remission is a disability if it would substantially limit a major life activity when active; and (4) the determination of whether an impairment substantially limits a major life activity shall be made without regard to the ameliorative effects of specified mitigating measures. Prohibits employment discrimination against a qualified individual on the basis of disability. (Current law prohibits employment discrimination against a qualified individual with a disability because of the disability.) Prohibits the use of qualification standards, employment tests, or other selection criteria based on an individual's uncorrected vision unless the standard, test, or other selection criteria, as used by the covered entity, is shown to be related to the position and is consistent with business necessity. Declares that nothing in the Act: (1) alters the standards for determining eligibility for benefits under state worker's compensation laws or under state and federal disability benefit programs; (2) alters the requirement to make reasonable modifications in policies or procedures, unless such modifications would fundamentally alter the nature of the goods, services, facilities, or accommodations involved; or (3) provides the basis for a claim by an individual without a disability that the individual was subject to discrimination because of the individual's lack of disability. Declares that the authority of the Equal Employment Opportunity Commission (EEOC), the Attorney General, and the Secretary of Transportation to issue regulations includes the authority to issue regulations implementing the definitions of this Act. Makes conforming amendments to the Rehabilitation Act of 1973.

Limitations on Interrogation Techniques Act of 2008 - Prohibits any individual in the custody or control of personnel of an element of the intelligence community or contractor or subcontractor thereof, regardless of nationality or physical location, from being subject to the following interrogation techniques: (1) forcing the individual to be naked, perform sexual acts, or pose in a sexual manner; (2) placing hoods or sacks over the head of the individual or using duct tape over the eyes; (3) applying beatings, electrical shock, burns, or similar forms of physical pain; (4) using the technique known as waterboarding; (5) using military working dogs; (6) inducing hypothermia or heat injury; (7) conducting mock executions; or (8) depriving the individual of adequate food, water, or medical care.

Libyan Claims Resolution Act - States that Congress supports the President's efforts to provide fair compensation to all U.S. nationals who have terrorism-related claims against Libya as part of the process of restoring normal U.S.-Libya relations. Defines "claims agreement" as a binding international agreement between the United States and Libya that provides for the settlement of terrorism-related claims of U.S. nationals against Libya through fair compensation Authorizes the Secretary of State, after consultation with the appropriate congressional committees, to designate one or more entities to assist in providing compensation to U.S. nationals pursuant to a claims agreement. States that: (1) upon such designation property that relates to the claims agreement and that is held by or transferred to or from a designated entity shall be immune from attachment or any other judicial process; (2) such entity and any person acting through or on its behalf shall not be liable in any federal or state court for any action taken to implement a claims agreement; and (3) such entity shall not be subject to the Government Corporation Control Act. Exempts Libya (and related instrumentalities and individuals) from specified property liens and attachments, limitations on foreign jurisdictional immunity, and private rights of action if the Secretary certifies to the appropriate congressional committees that the U.S. government has received sufficient funds pursuant to the claims agreement to ensure: (1) payment of specified settlements to the Pan Am 103 victims’ families, the LaBelle Disco bombing victims, and other relevant terrorism cases; and (2) fair compensation of specified claims by U.S. nationals against Libya for wrongful death or physical injury in cases pending on the date of enactment of this Act. (Applies such provisions only to conduct or events occurring before June 30, 2006.) States that the designation and certification authorities under this Act: (1) are within the Secretary's sole discretion and may not be delegated; and (2) are not subject to judicial review.

National Infantry Museum and Soldier Center Commemorative Coin Act of 2008 - Directs the Secretary of the Treasury to mint and issue $1 coins emblematic of the courage, pride, sacrifice, sense of duty, and history of the U.S. Infantry, in commemoration of the legacy of the U.S. Army Infantry and the establishment of the National Infantry Museum and Soldier Center. Expresses the sense of Congress that the coins should be struck at the U.S. Mint at West Point, New York, to the greatest extent possible. Restricts coin issuance to calendar year 2012. Requires a $10 surcharge per coin, and payment of all surcharges received to the National Infantry Foundation to establish an endowment to support the maintenance of the National Infantry Museum and Soldier Center.

Expresses: (1) the condolences of the Senate to the wives, children, and other family members of Private First Class Chestnut and Detective Gibson on the 10-year anniversary of their passing; (2) gratitude and appreciation for the professional manner in which the U.S. Capitol Police carry out their diverse missions; and (3) appreciation for the dedication U.S. Capitol Police officers have for protecting the Capitol Complex. Immediate Steps to Conserve Gasoline Act - Requires federal departments, agencies, and Congress, for FY2009, to develop and carry out initiatives to reduce their annual consumption of gasoline by at least 3%. Requires the Administrator of the Energy Information Administration to study and report to Congress on the potential transportation fuel savings of imposing a national speed limit on highways on the Interstate System of 60 miles per hour. Requires the Comptroller General of the United States to study and report to specified congressional committees on whether additional gasoline reduction measures by federal departments, agencies, and Congress are technically feasible.

Fair Deal for Volunteers Act of 2008 - Amends the Internal Revenue Code to provide that the standard mileage rate for the tax deduction for use of a passenger automobile for charitable purposes (currently prescribed as 14 cents per mile) shall be determined by the Secretary of the Treasury.

10 Million-Solar Roofs Act of 2008 - Requires the Secretary of Energy to establish a program to provide rebates (for each watt of installed capacity) to eligible individuals or entities for the purchase and installation of photovoltaic systems, over a 10-year period, of at least an additional 10 million solar systems in the United States with a cumulative capacity of at least 30,000 megawatts. Provides eligibility requirements for homeowners, businesses, nonprofit entities, and state and local governments. Sets minimum Energy Star or equivalent ratings that must be achieved by the buildings for which the photovoltaic system is installed. Limits the total amount of a rebate to 50 percent of the purchase and installation cost of the system.

Gas Price Reduction Act of 2008 - Amends the Outer Continental Shelf Lands Act (OCSLA) to prescribe procedures for petition, by the governor of a state with a new producing area within the offshore administrative boundaries beyond the state's submerged land, to make the new producing area available for oil and gas leasing. Directs the Secretary of the Treasury to deposit specified percentages of outer Continental Shelf revenues into: (1) the general fund of the Treasury; and (2) into a special account in the Treasury for disbursal to both new producing states and to the Land and Water Conservation Fund. Amends the Department of the Interior, Environment, and Related Agencies Appropriations Act, 2008, to repeal the prohibition against funding: (1) regulations regarding a commercial leasing program for oil shale resources on public lands; or (2) an oil shale lease sale. Instructs the Secretary of Energy to: (1) expand and accelerate research and development efforts for advanced batteries; and (2) implement a direct loan program for up to 30% of the costs of advanced battery production. Expresses the sense of the Senate that the federal government should implement policies to increase federal purchases of plug-in electric drive vehicles. Directs the Secretary of the Treasury, the Chairman of the Board of Governors of the Federal Reserve System, the Chairman of the Securities and Exchange Commission (SEC), and the Chairman of the Commodity Futures Trading Commission (CFTC) to study jointly and report to Congress on the international regime for regulating trading in energy commodity futures and derivatives. Amends the Commodity Exchange Act to prohibit the CFTC from permitting a foreign board of trade to provide to participants subject to CFTC jurisdiction direct access to electronic trading and order matching unless specified requirements are met. Directs the CFTC to: (1) promulgate rules for routine reporting requirements for index traders and swap dealers in energy and agricultural transactions; and (2) disaggregate and make public monthly information on the positions and value of index funds and other passive, long-only positions in the energy and agricultural futures markets. Instructs the CFTC to report to certain congressional committees on: (1) the scope of commodity index trading in the futures markets; (2) whether classification of index traders and swap dealers in the futures markets can be improved for regulatory and reporting purposes; and (3) whether index trading activity is adversely impacting the price discovery process in the futures markets and whether different practices and controls should be required. Instructs the CFTC to hire additional employees.

Amends the Outer Continental Shelf Lands Act to authorize the governor of Virginia to petition the Secretary of the Interior for authorization to conduct natural gas exploration and extraction activities in any area that is at least 50 miles beyond the state's coastal zone. Requires the Secretary of the Treasury to deposit into a Clean Energy Fund of 50% of all rentals, royalties, bonus bids, and other sums due and payable to the United States from leases entered into under this Act for natural gas exploration and extraction activities. Requires deposit of the other 50% into a special account in the Treasury from which the Secretary shall disburse: (1) 75% to the state; (2) 12.5% to provide financial assistance to states in accordance with the Land and Water Conservation Fund Act of 1965; and (3) 12.5% to a reserve fund to be used to mitigate for any environmental damage that occur as a result of extraction activities authorized under this Act.

Federal Employees Paid Parental Leave Act of 2008 - Allows federal employees to substitute any available paid leave for any leave without pay available for either the: (1) birth of a child; or (2) placement of a child with the employee for either adoption or foster care. Makes available for any of the 12 weeks of leave an employee is entitled to for such purposes: (1) four administrative weeks of paid parental leave in connection with the birth or placement involved; and (2) any accumulated annual or sick leave. Authorizes the Director of the Office of Personnel Management (OPM) to increase the amount of paid parental leave available to up to eight administrative workweeks, based on the consideration of: (1) the benefits provided to the federal government of offering increased paid parental leave, including enhanced recruitment and retention of employees; (2) the cost to the federal government of increasing the amount of paid parental leave that is available to employees; (3) trends in the private sector and in state and local governments with respect to offering paid parental leave; and (4) the federal government's role as a model employer. Amends the Congressional Accountability Act of 1995 to allow the same substitution for covered congressional employees. Amends the Family and Medical Leave Act of 1993 to allow the same substitution for Government Accountability Office (GAO) and Library of Congress employees.

Equity in Prescription Insurance and Contraceptive Coverage Act of 2007 [ sic ] - Amends the Employee Retirement Income Security Act of 1974 (ERISA) and the Public Health Service Act to prohibit a group health plan, and a health insurance issuer providing group coverage, from: (1) excluding or restricting benefits for prescription contraceptive drugs, devices, and outpatient services if the plan provides benefits for other outpatient prescription drugs, devices, or outpatient services; (2) denying eligibility based on use or potential use of such items or services; (3) providing monetary payments or rebates to a covered individual to encourage acceptance of less than the minimum protections available; (4) penalizing, reducing, or limiting a professional's reimbursement because the professional prescribed such drugs or devices or provided such services; or (5) providing incentives to a professional to induce the professional to withhold such drugs, devices, or services. Applies such prohibitions to coverage offered in the individual market.

Boy Scouts of America Centennial Commemorative Coin Act - Directs the Secretary of the Treasury to mint and issue up to 350,000 $1 coins in commemoration of the centennial of the founding of the Boy Scouts of America. Requires the coin design to be emblematic of the 100 years of the organization. Restricts issuance of such coins to February 8 through December 31, 2010. Subjects coin sales to a surcharge of $10 per coin. Requires payment of such surcharges to the National Boy Scouts of America Foundation, to be made available to local councils in the form of grants for the extension of Scouting in hard-to-serve areas.

Northern Neck National Heritage Area Study Act - Requires the Secretary of the Interior to study and report to specified congressional committees on the suitability and feasibility of establishing the Northern Neck National Heritage Area to be comprised of: (1) the part of eastern coastal Virginia between the Potomac and Rappahannock Rivers; (2) Westmoreland, Northumberland, Richmond, King George, and Lancaster Counties, Virginia; and (3) other areas adjacent to or in the vicinity of those areas that have similar heritage aspects.

Domestic Offshore Energy Security Act of 2008, or the DOES Act - Permits United States persons to: (1) engage in exploration and extraction of hydrocarbon resources from any portion of any foreign exclusive economic zone contiguous to the exclusive economic zone of the United States; and (2) export without license authority all pertinent equipment for such activity. Amends the Trade Sanctions Reform and Export Enhancement Act of 2000 to direct the Secretary of the Treasury to authorize travel-related transactions for travel to, from, or within Cuba in connection with exploration and extraction of hydrocarbon resources in any part of a foreign maritime Exclusive Economic Zone contiguous to the U.S. Exclusive Economic Zone. Identifies as persons authorized to travel to Cuba any full-time employees, executives, and agents and consultants of oil and gas producers, distributors, and shippers. Amends the Gulf of Mexico Energy Security Act of 2006 to: (1) repeal the moratorium on oil and gas leasing east of the Military Mission Line in the Gulf of Mexico; and (2) decrease to 45 miles within the coastline of Florida the moratorium on oil and gas leasing. Instructs the Secretary of the Interior to promulgate regulations that establish environmental safeguards for oil and natural gas exploration and production on the outer Continental Shelf. Authorizes such Secretary to inventory the oil and natural gas resources beneath the waters of the outer Continental Shelf off the coasts of Virginia, North Carolina, South Carolina, or Georgia, only if the respective state governor requests it. Amends the Energy Policy Act of 2005 to instruct the Secretary of Energy, in evaluating applications for enhanced oil and natural gas production through carbon dioxide injection, to grant priority consideration to applications carried out in geologically challenging fields. Requires the Secretaries of the Interior and of Energy (Secretaries) to suspend acquisition of petroleum for the Strategic Petroleum Reserve (SPR) during calendar 2008. Authorizes the Secretaries to resume such acquisition after the President notifies Congress that the weighted average price of petroleum in the United States for the most recent 90-day period is $75 or less per barrel.

Amends the Internal Revenue Code to suspend excise taxes on gasoline and diesel fuels between May 26, 2008, and September 1, 2008. Provides for reimbursement from the Treasury to the Highway Trust Fund for any reduction in Trust Fund receipts resulting from such suspension. Expresses the policy of Congress that: (1) consumers immediately receive the benefit of the reduction in taxes resulting from this Act; and (2) transportation motor fuels producers and other dealers take necessary actions to reduce fuel prices to reflect such reduction in taxes.

Family Educational Rights and Privacy Act Amendments of 2008 - Amends the Family Educational Rights and Privacy Act of 1974 to declare that nothing in the Act prohibits a physician, psychiatrist, psychologist, or other healthcare professional or paraprofessional from consulting with or disclosing treatment records on a student who is 18 years old or older or who is attending a postsecondary educational institution to a healthcare professional or paraprofessional outside the educational institution in connection with the provision of treatment to the student. Prohibits deeming the release by an educational institution of education records or related personally identifiable information, in the good faith belief that such release is necessary to protect against a threat to the health or safety of the student or other persons, to be a failure to comply with the Act regardless of whether it is subsequently determined that the specified conditions for such release did not exist. Allows the release of education records to appropriate persons in an emergency if the knowledge of that information is necessary, according to the good faith belief of the educational institution or persons to whom the disclosure is made, to protect the health or safety of the student or other persons.

Beach Protection Act of 2008 - Amends the Federal Water Pollution Control Act (commonly known as the Clean Water Act) to include among eligible grant activities the development and implementation of programs for source tracking, sanitary surveys, and prevention efforts to address the identified sources of beach water pollution. Authorizes appropriations for such grants for FY2008-FY2013. Requires grant recipients to identify: (1) the use of a rapid testing method; (2) measures for communication within 24 hours of the results of a water sample concerning pollutants to specified officials and all state agencies with authority to require the prevention or treatment of the sources of beach water pollution; (3) measures to develop and implement a beach water pollution source identification and tracking program for the coastal recreation waters that are not meeting applicable water quality standards for pathogens; (4) a publicly accessible and searchable global information system database with information updated within 24 hours of its availability, organized by beach and with defined standards, sampling plan, monitoring protocols, sampling results, and number and cause of beach closing and advisory days; and (5) measures to ensure that closures or advisories are made or issued within 24 hours after a state government determines that its coastal recreation waters are not meeting applicable water quality standards for pathogens. Requires the Environmental Protection Agency (EPA) Administrator to: (1) publish a revised list of rapid testing methods; and (2) validate such methods no later than two years after this Act's enactment and periodically thereafter. Sets forth provisions requiring: (1) a review by the Administrator of state and local compliance with statutory and regulatory requirements and grant conditions; (2) corrective actions by such governments not in compliance; and (3) a review by the Comptroller General of such compliance review and corrective action. Amends the Beaches Environmental Assessment and Coastal Health Act of 2000 to authorize appropriations to carry out such Act through FY2013.

Clean Energy Tax Stimulus Act of 2008 - Amends the Internal Revenue Code to extend certain tax incentives for energy production and conservation. Extends through 2009 the tax credit for the production of electricity from renewable resources (e.g., biomass, geothermal energy, landfill gas, and trash combustion). Includes marine and hydrokinetic renewable energy as a renewable resource eligible for such credit. Allows sales of electricity produced from renewable resources to regulated public utilities. Extends the energy investment tax credits for solar energy (through 2016) and for fuel cell and microturbine property (through 2017). Repeals the dollar per kilowatt limitation for fuel cell property under the energy investment tax credit. Allows public electric utilities to qualify for such credit. Extends through 2009 the tax credit for residential energy efficient property expenditures. Repeals the $2,000 limitation on the tax credit for solar electric property. Allows an offset against the alternative minimum tax (AMT) of tax credit amounts. Extends through 2009 the tax credit for investment in clean renewable energy bonds. Increases the national limitation amount for such bonds. Extends through 2009 deferral provisions relating to the recognition of gain by certain electric utilities. Extends through 2009 the tax credit for nonbusiness energy property. Includes residential biomass fuel stoves (pellet stoves) as eligible energy property for purposes of such credit. Extends through 2010 the tax credit for energy efficient new homes. Extends through 2009 the tax deduction for energy efficient commercial buildings and increases the allowable amount of such deduction. Extends the tax credit for energy efficient appliances to include appliances produced in 2008, 2009, and 2010. Revises and updates energy efficiency standards for such appliances in accordance with the Energy Independence and Security Act of 2007.

Code Talkers Recognition Act of 2008 - Directs the Speaker of the House of Representatives and the President pro tempore of the Senate to arrange for the award of gold medals in recognition of the service of Native American code talkers of specified Indian tribes. Defines "code talker" as a Native American who served in the Armed Forces during a foreign conflict and who participated in miliatary communications using a native language. Requires the Secretary of the Treasury, in consultation with the Secretary of Defense and Indian tribes, to identify Native American code talkers eligible for a gold medal.

United States Army Commemorative Coin Act of 2008 - Instructs the Secretary of the Treasury to mint and issue $5 gold coins, $1 silver coins, and half dollar clad coins as numismatic items emblematic of the traditions, history, and heritage of the U.S. Army, and its role in American society from the Colonial period to today. Requires the design for such coins to contain motifs that honor specifically the American soldier of both today and yesterday, in wartime and in peace, consistent with the traditions and heritage of the U.S. Army, the mission and goals of the National Museum of the U.S. Army, and the missions and goals of the Army Historical Foundation. Restricts coin issuance to the one-year period beginning on January 1, 2011. Requires all surcharges from coin sales to be promptly paid by the Secretary to the Foundation to help finance the National Museum of the U.S. Army.

Blind Persons Earnings Fairness Act of 2008 - Amends title II (Old Age, Survivors and Disability Insurance) (OASDI) of the Social Security Act to increase, by specified increments over five years, the level of earnings demonstrating the ability of a blind person to engage in substantial gainful activity for purposes of determining disability insurance benefit payments.

Santa Fe 400th Anniversary Commemorative Coin Act of 2007 - Instructs the Secretary of the Treasury to issue $5 gold coins and $1 silver coins emblematic of the settlement of Santa Fe, New Mexico, the oldest capital city in the United States. Permits issuance of such coins only during calendar 2010. Requires the Secretary to pay 50% of surcharges received from such coin sales to: (1) the Santa Fe 400th Anniversary Committee, Inc.; and (2) the Secretary of the Interior to sustain the ongoing mission of preserving Santa Fe, including educational programs, infrastructure and archaeological research activities, and other programs to support commemoration of the 400th anniversary of Santa Fe.
