Strengthening Medicare for Patients and Providers Act

United States · United States Congress · 3 April 2023

Strengthening Medicare for Patients and Providers Act This bill modifies certain adjustments to payment amounts under the Medicare physician fee schedule. Payment amounts under the Medicare physician fee schedule are based on a service's relative value, a conversion factor, and a geographic adjustment factor. Current law provides for separate conversion factors for physicians that are qualifying participants in advanced alternative payment models (also known as qualifying APM participants) and for other physicians beginning in 2026, with an annual update of 0.75% and 0.25%, respectively. The bill replaces the separate conversion factors for qualifying APM participants and other physicians with a single conversion factor and provides for an update that is equal to the annual percentage increase in the Medicare Economic Index, beginning in 2024. Specifically, the bill allows an individual seeking a WIC certification, recertification, or a nutritional risk evaluation to do so by phone or through video teleconference, in addition to the in-person option. The bill also allows states to provide benefits on WIC electronic benefit transfer cards through mail or remote issuance instead of requiring participants to pick up or reload benefits in person at a WIC office. The bill also reauthorizes Food and Nutrition Service (FNS) WIC funding for infrastructure, management information systems, and special nutrition education through FY2029. Specified funds must be used to establish, develop, improve, replace, or administer technology platforms that allow for secure communication between health care providers and program clinics under the program. Further, the Department of Agriculture must report to Congress about the use of remote technologies and other digital tools in the WIC program. Under current law, individuals are generally required to be physically present to certify their WIC eligibility and receive benefits, with exceptions. The FNS has temporarily waived these requirements and allowed remote certification and benefits using authorities that were originally provided by laws that were enacted to address the COVID-19 pandemic.

Women’s Health Protection Act of 2023

United States · United States Congress · 30 March 2023

Before fetal viability, governments may not restrict providers from using particular abortion procedures or drugs, offering abortion services via telemedicine, or immediately providing abortion services if delaying risks the patient's health. Furthermore, governments may not require providers to perform unnecessary medical procedures, provide medically inaccurate information, or comply with credentialing or other conditions that do not apply to providers who offer medically comparable services to abortions. Additionally, governments may not require patients to make medically unnecessary in-person visits before receiving abortion services or disclose their reasons for obtaining services. After fetal viability, governments may not restrict providers from performing abortions when necessary to protect a patient's life and health. The same provisions that apply to abortions before viability also apply to necessary abortions after viability. Additionally, states may authorize post-viability abortions in circumstances beyond those that the bill considers necessary. Further, the bill recognizes an individual's right to interstate travel, including for abortion services. The bill also prohibits governments from implementing measures that are similar to those restricted by the bill or that otherwise single out and impede access to abortion services, unless the measure significantly advances the safety of abortion services or health of patients and cannot be achieved through less restrictive means. The Department of Justice, individuals, or providers may sue states or government officials to enforce this bill, regardless of certain immunity that would otherwise apply.

Improving Access to Mental Health Act of 2023

United States · United States Congress · 17 March 2023

Improving Access to Mental Health Act of 2023 This bill increases the Medicare reimbursement rate for clinical social worker services. The bill excludes clinical social worker services from the prospective payment system in which predetermined amounts form the basis for payment under Medicare. Additionally, the bill alters the definition of clinical social worker services as it relates to Medicare. Under current law, such services (1) include services performed for the diagnosis and treatment of mental illnesses, and (2) exclude services furnished to an inpatient of a skilled nursing facility as a condition of the facility's participation in the Medicare program. The bill repeals these provisions and instead specifies that such services include certain types of health behavior assessment and intervention.

Pro Codes Act

United States · United States Congress · 17 March 2023

Protecting and Enhancing Public Access to Codes Act or the Pro Codes Act This bill addresses copyright protections for privately-developed technical standards that are incorporated into a law or regulation (e.g., a state law that requires buildings to comply with the electrical standards developed by a private standards development organization). Currently, there is not a consensus as to whether a technical standard that has been incorporated by reference into a law retains copyright protection. (A technical standard created by a private organization is typically eligible for copyright protection, but some courts have ruled that standards incorporated into law lose their copyright protections for various reasons. For example, some courts have held that incorporated standards effectively became law and therefore entered the public domain.) Under this bill, a technical standard shall retain its copyright protection even if it has been incorporated by reference into a law or regulation, if the applicable standards development organization makes the standard available on a free publicly accessible online source. If a party asserts that an incorporated technical standard has lost its copyright protection because it has not been made available for free online, the party making that assertion shall bear the burden of proof.
