Safeguard American Voter Eligibility Act or the SAVE Act This bill requires individuals to provide documentary proof of U.S. citizenship in order to register to vote in federal elections. Specifically, the bill prohibits states from accepting and processing an application to register to vote in a federal election unless the applicant presents documentary proof of U.S. citizenship. Further, the bill (1) prohibits states from registering an individual to vote in a federal election unless, at the time the individual applies to register to vote, the individual provides documentary proof of U.S. citizenship; and (2) requires states to establish an alternative process under which an applicant may submit other evidence to demonstrate U.S. citizenship. Each state must take affirmative steps on an ongoing basis to ensure that only U.S. citizens are registered to vote, which shall include establishing a program to identify individuals who are not U.S. citizens using information supplied by specified sources. Additionally, the bill requires states to remove noncitizens from their official lists of eligible voters. The bill allows for a private right of action against an election official who registers an applicant to vote in a federal election who fails to present documentary proof of U.S. citizenship. The bill also establishes criminal penalties for registering an applicant to vote in a federal election who fails to present documentary proof of U.S. citizenship. The Election Assistance Commission must, within 10 days, adopt and transmit guidance for implementing the bill's requirements to chief state election officials.

Ammunition Supply Chain Act This bill requires the Department of the Army to report to Congress on the U.S. supply chain for smokeless gunpowder, including nitrocellulose, nitroglycerin, and acid production, essential to ammunition manufacturing.

Sultana Steamboat Disaster Commemorative Coin Act of 2024 This bill directs the Department of the Treasury to mint and issue not more than 100,000 $5 gold coins, 500,000 $1 silver coins, and 750,000 half-dollar clad coins emblematic of the Sultana steamboat explosion that occurred on April 27, 1865, on the Mississippi River. All surcharges received by Treasury from the sale of such coins must be paid to the Sultana Historical Preservation Society Inc. for the purpose of establishing, operating, and maintaining a museum.

Disabled Veterans Housing Support Act This bill excludes compensation received for a military service-connected disability from a veteran's income when determining eligibility for assistance under the Community Development Block Grant (CDBG) program. The CDBG program provides grants to urban communities for development activities focused on revitalizing neighborhoods, economic development, and providing improved community facilities and services. Additionally, the Government Accountability Office must report on how service-connected disability compensation is treated when determining eligibility for all programs administered by the Department of Housing and Urban Development.

Financial Services Innovation Act of 2024 This bill addresses the regulation of financial products and services. Specifically, the bill allows persons intending to offer a financial innovation to petition specified financial regulatory agencies regarding existing areas of regulation. A petitioner may request a modification or waiver of an agency regulation. The bill sets forth requirements regarding the petition process, a safe harbor for petitioners from enforcement, and enforceable compliance agreements. Agencies must biannually publish a list of financial regulatory areas the agency would consider modifying or waiving through the petition process. The bill also establishes Financial Services Innovation Offices at these agencies to assist petitioners. These offices must also generally support the development of financial innovations and coordinate with other offices to share data.

HUD Transparency Act of 2024 This bill requires the Office of Inspector General of the Department of Housing and Urban Development (HUD) to annually testify before Congress. Specifically, the office must testify regarding efforts to detect and prevent fraud, waste, and abuse; ability to conduct and supervise audits, investigations, and reviews; actions to identify opportunities for HUD programs to progress and succeed; and ongoing activities regarding any such additional work.

Homebuyers Privacy Protection Act This bill prohibits a credit reporting agency from providing a consumer's credit report to a third party in connection with a residential mortgage transaction unless (1) the third party provides documentation certifying that it has the consumer's consent; or (2) the third party has originated the mortgage, is the current loan servicer, or has a current specified banking relationship with the consumer.

Israel Security Supplemental Appropriations Act, 2024 This bill provides FY2024 supplemental appropriations to the Department of Defense (DOD) and the Department of State for activities to respond to the attacks in Israel. The bill designates the funding as emergency spending, which is exempt from discretionary spending limits. Specifically, the bill provides appropriations to DOD for Military Personnel; Operation and Maintenance; Procurement; Research, Development, Test and Evaluation; Defense Working Capital Funds; and the Defense Health Program. The funding is provided for purposes such as supporting current U.S. military operations in the region; replacing defense articles that were provided to Israel; reimbursing DOD for defense services and training provided to Israel; and procuring Israel's Iron Dome, David's Sling, and Iron Beam defense systems to counter short-range rocket threats. The bill also provides appropriations to the State Department for Diplomatic Programs, Emergencies in the Diplomatic and Consular Service, and the Foreign Military Financing Program. The funding is provided to the State Department for purposes such as (1) increasing security at U.S. embassies impacted by the attacks on Israel, and (2) conducting emergency evacuations of U.S. government personnel and citizens in the region. Finally, the bill includes provisions that expand the authorities of the President to transfer defense articles and services from DOD to Israel.

This bulletin provides accounting and disclosure guidance for entities related to their obligations to safeguard cryptoassets held for users of its platform. A letter of opinion from the Government Accountability Office dated October 31, 2023, titled Securities and Exchange Commission—Applicability of the Congressional Review Act to Staff Accounting Bulletin No. 121 concluded that this bulletin is a rule for purposes of the Congressional Review Act.

Financial Stability Oversight Council Reform Act This bill subjects the budgets of the Financial Stability Oversight Council (FSOC) and the Office of Financial Research (OFR) to the annual appropriations process and establishes requirements for reports and a public notice and comment period. The budgets of the FSOC and the OFR are funded by assessments on financial institutions which are deposited into the Financial Research Fund and, under current law, are immediately available to be spent. This bill requires the funding from the Financial Research Fund to be made available by appropriations acts. The OFR must submit quarterly reports to Congress regarding its finances; workforce; and actions taken to achieve the goals, objectives, and performance measures of the office. The OFR must provide a public notice and comment period of at least 90 days before issuing any proposed report, rule, or regulation. The bill expands the duties of the OFR to include publishing an annual work plan; consulting with other federal departments and agencies with relevant expertise prior to preparing any public report with respect to a specified entity, class of entities, or financial product or service; and developing and implementing a cybersecurity plan. The Government Accountability Office must annually audit the cybersecurity plan and its implementation.

Rectifying Undefined Descriptions of Abusive Acts and Practices Act or the Rectifying UDAAP Act This bill restricts the Consumer Financial Protection Bureau’s (CFPB’s) authority to deem a financial practice abusive for purposes of enforcement activities. Currently, under the Dodd-Frank Wall Street Reform and Consumer Protection Act, the CFPB may take enforcement action against a financial product or service provider in connection with any transaction with a consumer for a consumer financial product or service that is unfair, deceptive, or abusive. Specifically, the bill prohibits the CFPB from including discrimination as an abusive practice. Further, the bill revises what an abusive practice is, including by additionally requiring the act or practice to intentionally interfere with the ability of a consumer to understand a term or condition. The bill also establishes additional criteria for abusive actions. For example, conduct is considered abusive if (1) it causes or is likely to cause substantial injury to consumers which is not reasonably avoidable by consumers, (2) the substantial injury is not outweighed by countervailing benefits to consumers or to competition, or (3) the conduct is otherwise prohibited under federal consumer financial law. The bill also eliminates the CFPB’s ability to seek monetary relief for unfair, deceptive, or abusive acts or practices if the provider establishes a good faith effort to comply with requirements. The bill establishes rulemaking requirements, including requiring a cost-benefit analysis for a rule relating to unfair, deceptive, or abusive acts or practices. Finally, the bill establishes the right for providers to cure violations if they self-report and limits the CFPB’s use of alternative claims in court.

Eliminate Congressional Slush Funds Act This bill rescinds specified unobligated funds that were provided for the Department of Commerce Nonrecurring Expenses Fund by the Fiscal Responsibility Act of 2023. The bill also prohibits the budgetary effects of this bill from being counted for the purposes of certain budget enforcement procedures and spending allocations for congressional committees.

Main Street Growth Act This bill allows for the registration of national venture securities exchanges for the purpose of trading the securities of certain small companies, such as startups and emerging growth companies. Individuals and existing national securities exchanges may apply to the Securities and Exchange Commission for approval to register such an exchange, or to register a listing tier within an existing exchange. The bill sets forth requirements for these venture exchanges, including required disclosures, trading limits, and trading privileges.

Uniform Treatment of Custodial Assets Act This bill addresses the accounting treatment of certain assets, including digital assets, at financial institutions. For example, under the bill, federal regulatory entities are prohibited from requiring specified financial institutions to include as a liability on financial statements assets that are held in custody or safekeeping by the institution. This applies to assets associated with a cryptographic key held in custody or safekeeping by the financial institution. However, if cash held by an institution for a third party is commingled with the general assets of the institution, that cash may be treated as a liability.

Insurance Data Protection Act This bill limits the ability of federal entities to compel insurance companies to share information. Specifically, the bill eliminates the subpoena power of the Federal Insurance Office. Under current law, the office has the power to subpoena information from insurers to, among other purposes, identify issues that could contribute to a systemic crisis in the insurance industry or the U.S. financial system. The bill also eliminates the ability of the Office of Financial Research to subpoena insurance companies. When seeking to collect insurance company data under specified consumer protection laws, a financial regulator must obtain the data from other regulators or from publicly available sources if possible. Otherwise, the financial regulator may only collect this data directly from the insurance company if it complies with the Paperwork Reduction Act.

CBDC Anti-Surveillance State Act This bill prohibits a Federal Reserve bank from offering products or services directly to an individual, maintaining an account on behalf of an individual, or issuing a central bank digital currency (i.e., a digital dollar) directly or indirectly to an individual. Further, The Board of Governors of the Federal Reserve System and the Federal Open Market Committee are prohibited from using a central bank digital currency to implement monetary policy.

Financial Innovation and Technology for the 21st Century Act This bill establishes a regulatory framework for digital assets. The Commodity Futures Trading Commission (CFTC) must regulate a digital asset as a commodity if the blockchain, or digital ledger, on which it runs is functional and decentralized. The bill classifies a blockchain as decentralized if, among other requirements, no person has unilateral authority to control the blockchain or its usage, and no issuer or affiliated person has control of 20% or more of the digital asset or the voting power of the digital asset. In addition, the bill provides the CFTC with exclusive regulatory authority over cash or spot markets for digital commodities. The Securities and Exchange Commission (SEC) must regulate a digital asset as a security if its associated blockchain is functional but not decentralized. However, the bill establishes certain exceptions to SEC regulation for digital assets that limit annual sales, restrict nonaccredited investor access, and satisfy disclosure and compliance requirements. The bill also sets forth requirements for primary and secondary market transactions. The CFTC and SEC must jointly issue rules to define terms and exempt dually registered exchanges from duplicative rules. The bill excludes permitted stablecoins from CFTC and SEC regulation, except regarding anti-fraud authority and specified transactions on registered entities.

Main Street Tax Certainty Act This bill makes permanent the tax deduction for qualified business income. (Under current law, the deduction expires after December 31, 2025.) Qualified business income is defined as the net amount of qualified items of income, gain, deduction and loss with respect to any trade or business, excluding capital gains or losses, dividends, interest income, or income earned outside the U.S.

Protecting Investors' Personally Identifiable Information Act This bill prohibits the Securities and Exchange Commission (SEC) from requiring a national securities exchange, association, or a member of either to provide a market participant's personally identifiable information to satisfy the reporting requirements of the Consolidated Audit Trail (i.e., data used to track market activity). However, this information must be provided to the SEC upon request if the information is related to a securities investigation. The SEC must destroy the information not later than one day after the conclusion of the matter for which this information was required.

SEC Stabilization Act of 2023 This bill expands the composition of the Securities and Exchange Commission from five commissioners to six, extends the term of the commissioners from five years to six, and creates an executive director position. If appointing two commissioners whose terms end on the same date, the President is prohibited from appointing individuals from the same political party.

Stop Harboring Iranian Petroleum Act or the SHIP Act This bill requires the President to impose visa- and property-blocking sanctions against foreign persons that knowingly transport, process, refine, or otherwise deal in petroleum and petroleum products originating in Iran. These sanctions also extend to certain foreign persons associated with the sanctioned individual, such as adult family members and any entities owned or controlled by the sanctioned individual.

Middle Class Borrower Protection Act of 2023 This bill rolls back changes made by the Federal Housing Finance Agency (FHFA) to the fees charged by Fannie Mae and Freddie Mac for a conventional single-family mortgage (i.e., loan-level pricing adjustments) and restricts future fee adjustments. These changes, effective May 1, 2023, revised the fee charts that provide percentage adjustments based on a mortgagor's credit score and down payment. The bill reinstates the fee structure that was in place prior to May 1, 2023. The Government Accountability Office (GAO) must report on the changes made by the FHFA. Further adjustments to the fee structure by FHFA are prohibited until 90 days after the publication of the GAO report. After this period, FHFA must follow Administrative Procedure Act requirements when proposing adjustments to the fee structure. The bill also requires that, to the greatest extent feasible, revisions to the fee schedule must be based on risk. Further, FHFA, Fannie Mae, and Freddie Mac are prohibited from imposing any loan-level pricing adjustment fee that is based on the ratio of the debt of the mortgagor to the income of the mortgagor.
