Education Regulatory Reform Act - Establishes in the Department of Health, Education, and Welfare the position of Under Secretary for Education to replace the offices of Assistant Secretary for Education and Commissioner of Education. Conditions the authority of the Secretary of Health, Education, and Welfare to issue regulations regarding elementary and secondary schools by: (1) requiring the Secretary to prepare an educational impact statement; (2) limiting the validity of regulations to five years; and (3) exempting local educational agencies receiving less than ten percent of their annual budget from Federal funds from being considered as receiving Federal funds for purposes of compliance with most Federal enforcement provisions.

Amends the National School Lunch Act to direct the Secretary of Agriculture to conduct not less than 30 pilot project school lunch programs in representative urban and rural school districts during the 1979 and 1980 school years for the purpose of determining the feasibility, desirability, and economic impact of a program under which no child is charged for his or her lunch. Requires the Secretary to reimburse participating school districts for all costs in excess of normal school lunch program costs. Requires the Secretary to conduct, and report to Congress on, a continuing evaluation of such projects, including the amount of money which local school districts would save through a permanent free school lunch program. Authorizes such appropriations as may be necessary for fiscal year 1979, and $10,000,000 for each of fiscal years 1980 and 1981.

Child Nutrition Assistance Act - Title I: Declaration of Purpose - Declares that it is the policy of Congress to expand and strengthen child nutrition programs through grants-in-aid and other assistance to the States. Title II: Definitions - Defines terms used in this Act. Title III: Nutrition Requirements for Meals - Directs the Secretary of Agriculture to research nutrition needs of children and food consumption in order to prescribe minimum nutritional requirements for meals served under this Act. Title IV: State Plan of Operations - Directs each State agency, as a prerequisite to receipt of any Federal funds, to submit for approval each year to the Secretary a State plan of operations for the various programs under this Act, including the school food service program, the child care, and the summer food service programs. States that such plan should address accountability, free and reduced-price meal policy, nutrition requirements for meals, and compliance with anti-discrimination laws. Requires the States to secure and consider public opinion in the development of such plans. Title V: School Food Service Program - Combines the existing school lunch and breakfast programs into a single school food service program. Establishes a formula for payments to States in the amount of the number of meals served multiplied by an applicable payment factor. Sets the payment factor for the school year ending June 30, 1978 at: (1) 40.25 cents for free breakfasts, 33.25 cents for reduced-price breakfasts, 11.5 cents for paid breakfasts; and (2) 79.5 cents for free lunches, 20 cents for reduced-price lunches, 14.5 cents for paid lunches. Requires breakfast service, beginning with the school year ending June 30, 1980, in any participant school with an enrollment of over 100 students if over 50 percent of such students are eligible for free or reduced-price meals. Requires the Secretary to establish standards of eligibility for meals at 125 percent, and for reduced-price meals at 195 percent, of the nonfarm income poverty guidelines prescribed by the Office of Management and Budget, adjusted annually. Establishes a new formula for determining a State's fund-matching, based on the appropriate payment factor. Requires the Secretary to administer program funds to private schools in any State where the State education agency is not permitted by law to do so. Title VI: Child Care Food Program - Extends the existing child care food program indefinitely, and establishes the same payment-to-States formula as for the school food service program. Sets the payment factor for the year ending June 30, 1978 at: (1) 40.25 cents for breakfasts; and (2) 79.5 cents for lunches. Limits eligibility for the program to children of families whose annual income does not exceed 195 percent of the nonfarm income poverty guidelines prescribed by the Office of Management and Budget, adjusted annually. Directs the Secretary to provide advance payments to participating institutions. Title VII: Summer Food Service Program for Children - Makes permanent the summer food service program to assist States to initiate, maintain, and expand nonprofit food service programs for children in camps or in areas, especially rural areas, in which poor economic conditions exist. Requires no charge to children served meals in service institutions other than camps. Increases the maximum meal payments: (1) from 85.75 cents to 92.75 cents for each lunch and supper served; (2) from 47.75 cents to 51.5 cents for each breakfast served; and (3) from 22.5 cents to 24.25 cents for each meal supplement served, adjusted annually for cost-of-living increases. Title VIII: Food Service Equipment Assistance - Authorizes the appropriation of $40,000,000 to assist States through grants-in-aid and other means to supply specified schools and institutions with food service equipment. Title IX: Donated Commodities and Utilization of Foods - Requires that foods available for donation under this title be made available to schools not participating in the school food service program for use in carrying out nonprofit school food service programs. Permits distribution of donated foods to participants in the special supplemental food program under title XIII of this Act. Requires each State agency receiving assistance to establish an advisory council, composed of school representatives, to advise such agency with respect to the needs of such schools. Sets the national average value of food assistance at: (1) 12.75 cents for each lunch served in the school food service program; and (2) 12.75 cents for each lunch and supper served in the child care food program. Permits a State to elect to receive cash payments in lieu of donated foods where it phased out its distribution facilities prior to June 30, 1974. Title X: Special Milk Program for Children - Includes in the special milk program schools that do not participate in the school food service program. Limits eligibility for such program to children from families whose annual income does not exceed 125 percent of the nonfarm poverty income guidelines of the Office of Management and Budget. Increases the reimbursement rate for a half-pint of milk from five cents to 6.25 cents. Title XI: Nutrition Education and Training Program - Continues the existing program. Authorizes the Secretary to withhold up to ten percent of grant funds allocated to any State for innovative research, evaluation, development, and demonstration projects to be conducted by State educational agencies and institutions of higher education. Title XII: State Administrative Expenses - Establishes formulae for the determination and allocation of funds for State expenses incurred in the administration of the programs in this Act. Title XIII: Special Supplemental Food Program - Extends through fiscal year 1982 the existing special supplemental food program for women, infants, and children (WIC). Limits eligibility for such program to pregnant, postpartums, and breast-feeding women, and infants and children from low-income families who are determined by a competent professional authority to be at nutritional risk. Directs the Secretary to establish income eligibility standards in accordance with the nonfarm poverty income guidelines of the Office of Management and Budget. Defines terms used in this title. Requires each State agency to assure the provision of nutrition education to all participants in such program. Authorizes the appropriation of $535,000,000 for fiscal year 1979. Title XIV: Miscellaneous Provisions - Directs the Secretary to prescribe such regulations as he may deem necessary to carry out this Act. Prohibits the Secretary or any State from imposing any requirements with respect to teaching personnel, curriculum, instruction, methods of instruction, and materials of instruction as a condition to participation. Requires the Secretary to consult with the Secretary of Health, Education, and Welfare on areas of mutual interest. Title XV: Appropriation Authorization - Authorizes such appropriations each fiscal year as may be necessary. Authorizes an additional annual appropriation of $1,000,000 to carry out experimental or demonstration projects to teach children the nutritional value of foods and the relationship of nutrition to health. Title XVI: Laws Repealed - Repeals the National School Lunch Act and the Child Nutrition Act of 1966. Title XVII: Effective Date and Implementation - Sets the effective date of this Act.

Alcohol and Drug Abuse Education Amendments - Amends the Alcohol and Drug Abuse Education Act to emphasize prevention of alcohol and drug abuse in stating congressional purpose and to expand the focus of the Act to include "approaches" to the prevention of alcohol and drug abuse rather than limiting the scope to curricula. Authorizes grants to State and local educational agencies and other nonprofit agencies to establish demonstration projects for determining the most effective methods of alcohol and drug abuse prevention. Requires that at least 25 percent of such grant money for demonstration projects be used for programs in rural areas. Establishes the Office of Alcohol and Drug Abuse Education within the Office of Education. Extends the Act for three years and authorizes appropriations to carry out programs under the Act. Requires that at least 25 percent of the sums appropriated for any fiscal year be used for programs in rural areas.

Amends the Internal Revenue Code to allow taxpayers to credit against the income tax specified higher education expenses, including tuition, fees, books, and supplies, incurred by the taxpayer for himself or any other individual. Limits the credit to 100 percent of the first $300 for any individual, 50 percent of the next $300, and 10 percent of the next $400. Limits the credit to expenses incurred by full time students at institutions of vocational and higher education, minus scholarships and veterans' benefits. Limits the total credit allowed the taxpayer to his income tax liability minus the sum of all other credits applied thereto. Disallows any deduction of educational expenses used to determine the amount of the credit allowed by this Act.

Education Fiscal Assistance Act - Amends the Internal Revenue Code to allow each individual taxpayer a refundable $100 income tax credit for each dependent child who is enrolled in a school, from the elementary level through graduate studies, whether or not any expenses are incurred for the child's education. Forbids any construction of this Act as granting the government additional authority to examine the books or activities of church schools except to the extent necessary to determine whether they are educational institutions within the meaning of this Act. Provides for the immediate certification of any judicial action brought in a United States district court concerning the constitutionality of this Act to the appropriate circuit court of appeals. Authorizes direct appeal to the Supreme Court of any decision by a circuit court. Directs the expedited consideration of such a case at both judicial levels. Provides that if any provision of this tax credit, or its application, is held invalid to any provision of this tax credit, or its application, or is held invalid to any person or circumstances, the ruling shall not affect the remainder of the provisions of the credit, nor the application of such provisions to other persons or circumstances. Provides that the refund of this tax credit shall not be used in computing any person's eligibility for federally-funded educational assistance benefits.

Domestic Volunteer Service Act Amendments - Amends the Domestic Volunteer Service Act of 1973 to authorize the Director of ACTION to make advance payments of a volunteer's end-of-service stipend during the volunteer's period of service. Repeals the limitation on appropriated funds that may be used to support volunteers or to encourage students in secondary and post-secondary schools to participate in service-learning programs. Authorizes the Director to provide stipends and other support payments to any ACTION volunteer who has volunteered for at least ten weeks of service or at least 20 hours of service per week. Declares that Retired Senior Volunteer Program (RSVP) volunteers shall not be deemed to be Federal employees for any purpose. Repeals the right of specified State or community action agencies to supervise or carry out Foster Grandparent or Older American Community Service programs and substitutes the right of such agencies to review appropriate project applications and to make recommendations on such applications. Declares full- and part-time antipoverty volunteers who have served less than one year, as well as other already so declared under present law, to be Federal employees for purposes of the Hatch Act, Internal Revenue Code, Social Security Act, Federal Tort Claims Act, and provisions dealing with injuries incurred during service as a Federal employee. Makes the Federal Tort Claims Act the exclusive remedy for persons who are damaged as a result of the malpractice of a full-time ACTION volunteer providing medical care or treatment within the scope of such volunteer's duties. Prohibits the denial of governmental assistance to a full-time volunteer if such volunteer would otherwise be entitled to such assistance if the reason for such denial is such volunteer's refusal to register for, seek, or accept employment. Makes the nondiscrimination provisions of the Act and the Civil Rights Act of 1964 applicable to entities receiving ACTION volunteer help. Prohibits discrimination by any ACTION agency against any volunteer enrolled for at least 20 hours per week of service on the basis of race, color, religion, sex, or national origin.

Bilingual Education Act Amendments - Revises the Bilingual Education Act to extend the general authorization for appropriations under such Act to 1981. Stipulates that grants for assistance to bilingual education programs will be available for fiscal years 1979, 1980, and 1981. Revises application requirements for such grants, including provisions regarding an evaluation plan and bilingual personnel recruitment. Provides special provisions for Puerto Rico regarding use and distribution of funds under such Act. Directs the Commissioner of Education to conduct a study on the need for compensatory English proficiency programs in Puerto Rico. Revises specified bilingual education training provisions under such Act. Extends indefinitely the Commissioner of Education's authority to award fellowships for bilingual teachers training. Directs the Commissioner to undertake an ongoing study of the impact of such fellowships on the field of bilingual education. Revises the definition of "eligible applicant" for purposes of such training grants. Requires an individual receiving such assistance to work in a bilingual education related activity for a period equivalent to the period such assistance was received. Establishes within the Office of Education in place of the existing Office of Bilingual Education a Bureau of Bilingual Education to be headed by a Deputy Commissioner of Bilingual Education. Revises the composition of the National Advisory Council on Bilingual Education, including a requirement that at least two parents of children whose language proficiency is other than English be included in such Council. Extends authorizations for research and demonstration projects under such Act to fiscal year 1981. Provides for a program of grants for fiscal years 1982 and 1983 to States for bilingual education. Provides guidelines for State applications for such bilingual education grants, including a two year comprehensive program plan and a matching funds requirement. Amends the Emergency School Aid Act to revise certain appropriations allocations and application requirements regarding (1) educational television; (2) special projects; and (3) evaluations of specific projects assisted under such Act.

Gifted and Talented Education Act - Amends the Elementary and Secondary Education Act of 1965 to authorize a grant program for the education of gifted and talented children at the preschool, elementary, and secondary levels. Authorizes appropriations for such program for fiscal years 1979-1983 and provides guidelines for the allocation and use of such funds. Directs the Commissioner of Education to designate an administrative unit within the Office of Education to coordinate all programs under such Office for gifted and talented children.

Bilingual Education Act Amendments - Revises the Bilingual Education Act to extend the general authorization for appropriations under such Act to 1981. Stipulates that grants for assistance to bilingual education programs will be available for fiscal years 1979, 1980, and 1981. Revises application requirements for such grants, including provisions regarding an evaluation plan and bilingual personnel recruitment. Provides special provisions for Puerto Rico regarding use and distribution of funds under such Act. Directs the Commissioner of Education to conduct a study of the need for compensatory English proficiency programs in Puerto Rico. Directs the Commissioner to make authorized payments directly to the applicants rather than to the Secretary of the Interior for specified programs of bilingual education for Indian children. Transfers specified evaluation responsibilities of the Secretary regarding such programs to the Commissioner of the Bureau of Indian Affairs. Revises specified bilingual education training provisions under such Act to place particular emphasis on degree programs in bilingual education. Extends indefinitely the Commissioner of Education's authority to award fellowships for bilingual teacher training. Directs the Commissioner to undertake an ongoing study of the impact of such fellowships on the field of bilingual education. Revises the definition of "eligible applicant" for purposes of such training grants. Requires an individual receiving such assistance to work in a bilingual education related activity for a period equivalent to the period such assistance was received. Establishes within the Office of Education in place of the existing Office of Bilingual Education a Bureau of Bilingual Education to be headed by a Deputy Commissioner of Bilingual Education. Revises the composition of the National Advisory Council on Bilingual Education, including a requirement that at least two parents of children whose language proficiency is other than English be included in such Council. Extends authorizations for research and demonstration projects under such Act to fiscal year 1981. Authorizes appropriations for fiscal years 1979-1983 for a grant program to local educational agencies and private nonprofit organizations eligible for Emergency School Aid assistance to meet the needs of minority children from an environment in which English is not the dominant language. Stipulates that such grants be designed to complement local programs carried out under the Emergency Aid Act. Provides for a program of grants for fiscal years 1982 and 1983 to States for bilingual education and for supplementary incentive grants to States providing State assistance to bilingual education programs. Provides guidelines for State applications for such bilingual education grants, including an annual State plan for distribution of such funds to local educational agencies giving priority to those programs that have been funded in previous years. Amends the Emergency School Aid Act to revise certain appropriation allocations and application requirements regarding: (1) educational television; (2) special projects; and (3) evaluations of specific projects assisted under such Act.

Hubert H. Humphrey Institute of Public Affairs Memorial Act - Authorizes the Commissioner of Education to provide financial assistance to assist in the development of the Hubert H. Humphrey Institute of Public Affairs at the University of Minnesota-Twin Cities. Authorizes up to $5,000,000 to be appropriated for such purpose.

Prohibits, during the fiscal years 1978 and 1979, the use of funds appropriated to the Department of Health, Education, and Welfare to carry out a program on smoking and health described by the Secretary of such Department on January 11, 1978. Stipulates that programs on smoking and health for the period beginning October 1, 1977 and ending January 10, 1978, shall not be affected. Limits the use of funds which were projected on or before January 11, 1978, to be expended to carry out the program on smoking and health, announced on such date, to expenditures for additional research during 1978 or 1979 on the harmful properties of tobacco and dangerous effects of smoking.
