Homeland Security Act of 2002

Homeland Security Act of 2002 - Establishes a Department of Homeland Security (DHS), as an executive department of the United States, headed by a Secretary of Homeland Security who shall be appointed by the President, by and with the advice and consent of the Senate. States that the primary mission of DHS is to: (1) prevent terrorist attacks within the United States; (2) reduce the vulnerability of the United States to terrorism; and (3) minimize the damage, and assist in the recovery, from terrorist attacks that occur within the United States. Includes as DHS's primary responsibilities: (1) information analysis and infrastructure protection; (2) chemical, biological, radiological, nuclear, and related countermeasures; (3) border and transportation security; (4) emergency preparedness and response; and (5) coordination (including the provision of training and equipment) with other executive agencies, with State and local government personnel, agencies, and authorities, with the private sector, and with other entities. Creates: (1) a Deputy Secretary of Homeland Security, who shall be the Secretary's first assistant for purposes of details; (2) an Under Secretary for Information Analysis and Infrastructure Protection; (3) an Under Secretary for Chemical, Biological, Radiological, and Nuclear Countermeasures; (4) an Under Secretary for Border and Transportation Security; (5) an Under Secretary for Emergency Preparedness and Response; (6) an Under Secretary for Management; and (7) not more than six Assistant Secretaries. Establishes an Inspector General (to be appointed under the Inspector General Act of 1978), and requires the Commandant of the Coast Guard and the Director of the Secret Service as well, to assist the Secretary in the performance of his functions. Transfers to the Secretary the functions, personnel, assets, and liabilities of specified entities, including: (1) the National Communications System of the Department of Defense; (2) the select agent registration enforcement programs and activities of the Department of Health and Human Services (HHS); (3) the Plum Island Animal Disease Center of the Department of Agriculture (DOA); (4) certain programs and activities of the Department of Energy, such as those specified for Lawrence Livermore National Laboratory; (5) the United States Customs Service of the Department of the Treasury (DOT); (6) the Immigration and Naturalization Service of the Department of Justice (DOJ); (7) DOA's Animal and Plant Health Inspection Service; (8) the Coast Guard; (9) DOT's Transportation Security Administration; (10) the Federal Protective Service of the General Services Administration; (11) the Federal Emergency Management Agency; (12) the National Domestic Preparedness Office of the Federal Bureau of Investigation; (13) HHS' Office of the Assistant Secretary for Public Health Emergency Preparedness; (14) HHS' Strategic National Stockpile; and (15) the United States Secret Service. Authorizes the Secretary to establish a human resources management system for DHS. Establishes in the Department of Defense a National Bio-Weapons Defense Analysis Center.

Amends the Medicare, Medicaid, and SCHIP Benefits Improvement and Protection Act of 2000 to provide for permanent extension of provider-based status for any facility or organization that is treated as provider-based in relation to a hospital or critical access hospital under Medicare as of October 1, 2000.

Requires such incentives to include one or more projects to provide payments for the purchase of life insurance policies or annuities, payable to a donor's designee. Limits evaluation costs to five percent of authorized funds.

Affordable Drugs Access Act - Amends the Federal Food, Drug, and Cosmetic Act to require a waiver of prohibitions which would then permit an individual to import a prescription drug from Canada. Stipulates that the drug be: (1) imported in final form in limited quantities for personal use from a registered Canadian pharmacy; (2) approved by the Secretary of Health and Human Services; and (3) accompanied by a valid prescription. Requires the Secretary to study the authenticity and quality of drugs imported into the United States from other countries for personal use. Authorizes the Secretary, based on whether study results indicate the presence or absence of a significant threat to public health, to: (1) condition the entry of drugs; (2) terminate the waiver; and/or (3) extend the waiver to other countries. Amends the Controlled Substances Import and Export Act to reduce the aggregate number of dosage units of a controlled substance a U.S. resident may import into the United States without a prescription. Regulates the Internet sale of prescription drugs. Requires Internet sites used for purposes of sales of a prescription drug to include a page (and links thereto) providing the identities of the seller and the persons serving as pharmacists or medical consultants and the States in which the seller and such persons are authorized to dispense drugs or provide consultations. Permits State enforcement of Internet prescription drug sale requirements, but retains the right of the Secretary to intervene.

Amends SSA title XVIII to: (1) authorize the Secretary of Health and Human Services to implement a program under which eligible individuals may receive disease management services; and (2) provide for coverage of such services as a part B (Supplementary Medical Insurance) benefit.

Seniors Health and Independence Preservation Act of 2002 - Amends part C (Medicare+Choice) of title XVIII (Medicare) of the Social Security Act to consolidate and restate the Federal laws relating to the social health maintenance organization (SHMO) demonstration projects and to make the projects permanent. Directs the Secretary of Health and Human Services to promulgate a regulation that permits each SHMO demonstration project to expand its service area to include areas within the State served by the organization that are not contiguous to any other service area of the organization. Permits the participation in the SHMO demonstration project program of: (1) the five organizations authorized under the Omnibus Budget Reconciliation Act of 1990 to demonstrate the concept of SHMOs that were approved by the Secretary in 1995; and (2) each entity that received a planning grant in 1998 under the 1997 Grants Program for Reforming Service Delivery for Dual Eligible Beneficiaries to develop a Second Generation Social HMO Demonstration Program. Requires the Secretary to notify the appropriate congressional committees prior to making any change to the benefits available under a SHMO demonstration project. Directs the Medicare Payment Advisory Commission to study and report to Congress on the cost-effectiveness of SHMO demonstration projects and their potential expansion. Requires the Secretary to conduct, and report to Congress on, a comparative qualitative survey of the satisfaction of Medicare beneficiaries enrolled in: (1) the original Medicare fee-for-service program under Medicare parts A (Hospital Insurance) and B (Supplementary Medical Insurance); (2) a Medicare+Choice plan under Medicare part C (Medicare+Choice); and (3) an SHMO.

Oral Health Promotion Act of 2002 - Amends title XXI (State Children's Health Insurance) (SCHIP) of the Social Security Act (SSA) to add dental services to coverage provided. Allows States the option of using Federal SCHIP funds to cover dental expenses for a child who is eligible for Medicaid under targeted low-income child Medicaid guidelines when the child has medical coverage that does not include dental services. Allows States the option of covering dental services of adults receiving assistance under SCHIP. Alters the Medicaid matching rate for adult full coverage dental benefits. Establishes in the Treasury the Community Oral Health Expansion Fund to expand the availability of oral health services through community-based centers. Authorizes the use of funds for demonstration projects and demonstration partnerships with Head Start programs for identifying children at risk of dental disease and providing prevention measures. Requires States to contribute, directly or indirectly, up to ten percent of demonstration project costs. Requires the Secretary of Health and Human Services to give grant: (1) priority to States covering a Medicaid level of dental benefits under SCHIP; and (2) preference to States with market-based payment rates for dental services under both Medicaid and SCHIP.

Conditions grants on the presence of a fee schedule consistent with prevailing rates and a fee discount schedule which provides fee adjustments based on ability to pay. Evaluates services according to a peer-reviewed model according to best practices. Limits the grants to five years.

Agriculture Security Preparedness Act - Expresses the sense of Congress that the United Nations Security Council should include agroterrorism in the definition of a terrorist act involving a weapon of mass destruction. Amends Federal criminal law to include under the rubric of terrorism the use of a weapon of mass destruction against private property, including property used for agricultural or livestock operations. Directs the Attorney General to report on the feasibility of establishing a national agroterrorism and ecoterrorism incident clearinghouse. Directs the Secretary of Agriculture to: (1) report on international agricultural disease surveillance; (2) develop farm and ranch biosecurity guidelines and related education outreach; (3) develop a pilot program of biosecurity grants and loans to assist agricultural producers comply with such guidelines; (4) provide grants to universities for plant and animal disease research and vaccine development; (5) provide grants to States for geographic information systems for disease emergency epidemiological assessments; (6) develop a national public awareness campaign; (7) conduct a feasibility study respecting establishment of a national plant disease laboratory; (8) conduct a study of expanding laboratory sample screening capacities; (9) improve terrorist-related agricultural inspection abilities; and (10) establish a grant program to facilitate establishment of regional agricultural emergency response networks which shall serve as the basis for Federal, State, and local response plans. Requires the Director of the Federal Emergency Management Agency to: (1) establish a senior level position for agricultural disease emergency management liaison; (2) revise the Emergency Support Functions of the Federal Response Plan to include the economic, environmental, and medical impacts of naturally-occurring agricultural disease outbreaks and agroterrorist acts; (3) provide grants to small communities to facilitate participation of State and local animal health care officials in emergency planning; and (4) establish a task force to identify and distribute best practices for State regional agricultural disaster exercise programs. Directs: (1) the Secretary of Transportation to establish guidelines for transportation restrictions in response to an agricultural emergency; and (2) the Secretary of Health and Human Services to establish within the Department of Health and Human Services a senior level position for animal health liaison.

Directs: (1) the Secretary of Transportation and the Administrator of the Environmental Protection Agency (EPA) to designate as hazardous byproducts of methamphetamine production; (2) the Administrator of the Drug Enforcement Administration to list byproducts likely to cause long-term environmental harm; (3) the Secretary of Labor to provide grants to local law enforcement; (4) the EPA Administrator to study methamphetamine laboratory operation impacts on the environment; and (5) the Secretary of Health and Human Services to study contamination issues. Amends: (1) the Elementary and Secondary Education Act of 1965 and the Public Health Service Act to authorize grants for educational programs and treatment, respectively; (2) the Omnibus Crime Control and Safe Streets Act of 1968 to permit hiring police personnel and purchasing equipment; (3) the Controlled Substances Act to eliminate the regulatory exemption for over-the-counter pseudoephedrine product sales; and (4) the Comprehensive Methamphetamine Control Act of 1996 regarding court consideration of good faith efforts to prevent sales violations. Urges the President to seek commitments from the Canadian Government regarding pseudoephedrine availability in Canada and its importation into the United States. Directs the Attorney General to study ephedrine product theft.

Stafford Disaster Relief and Emergency Assistance Act (the Act) to include a terrorist attack, dispersion of radioactive or other contaminants, dispersion of hazardous substances, or other catastrophic event as a "major disaster" eligible for relief under the Act. Includes as a "private nonprofit facility" for purposes of damages coverage in a major disaster private for-profit telecommunications, phone services, and utilities when losses occur during a homeland security event and are not covered by insurance. Authorizes the President, at the request of a State governor, to declare that a major disaster constitutes a homeland security event and is of such severity and magnitude that effective response is beyond the capacity of the affected State and local government. Provides specified Federal assistance under the Act upon such a declaration, including reimbursement and grant assistance for lost compensation, sustained losses, and required repairs. Includes as critical services under the Act education systems, providers of counseling, and providers of assistance to the homeless. Removes the $5 million limit on community disaster loans provided under the Act. Requires or provides for: (1) standards for reporting information concerning disasters involving homeland security events; (2) a special commission to review air quality following a homeland security event; (3) guidelines concerning health risks associated with the release of materials following a homeland security event and associated monitoring and analysis; and (4) grants for data collection during public health emergencies, research on assisting victims, and advance preparation for public health emergencies.

Trade Adjustment Assistance Improvement Act of 2002 - Amends the Trade Act of 1974 to revise requirements with respect to: (1) agreements between the United States and cooperating States or State agencies for the petition and provision of certain services and benefits for workers adversely affected by import competition; (2) eligibility certification of a group of adversely affected workers for trade adjustment assistance; (3) payment of, and limitations on, trade adjustment allowances to such workers; (4) job training programs for them; and (5) the maximum amount of job search and relocation allowances payable to an adversely affected worker. Provides for the eligibility certification of adversely affected secondary workers, employed at a downstream producer or a supplier, for trade adjustment assistance. Reauthorizes and revises the trade adjustment assistance program for firms adversely affected by import competition. Reestablishes trade adjustment assistance programs for communities adversely affected by import competition. Community Workforce Development and Modernization Partnership Act - Directs the Secretary of Labor to make competitive matching grants to eligible partnerships to: (1) help workers improve job skills necessary for employment by businesses in the pertinent industry; (2) help dislocated workers find employment; and (3) upgrade the operating and competitive capacities of businesses belonging to the partnership. Sets forth partnership program requirements and authorized activities for workforce development and business modernization. Authorizes a group of agricultural commodity producers to petition the Secretary of Agriculture for a certification of eligibility to apply for trade adjustment assistance. Authorizes a group of producers (persons who are engaged in commercial fishing or who are U.S. fish processors) to petition the Secretary of Commerce for a certification of eligibility to apply for trade adjustment assistance. Amends the Internal Revenue Code to allow an individual eligible for trade adjustment assistance a tax credit for 75 percent of the cost of health care insurance coverage. Establishes a program for making payments to providers of health insurance on behalf of workers eligible to receive trade adjustment assistance. Amends part A of title XI of the Social Security Act to authorize grants to States to provide workers eligible to receive trade adjustment assistance: (1) temporary health insurance coverage; and (2) transportation, child care, dependent care, and income assistance. Amends the Consolidated Omnibus Budget Reconciliation Act of 1985 to extend the authority of the Secretary of the Treasury to charge and collect customs user fees.

Amends the Internal Revenue Code to provide an annual long-term care credit of $3000 per applicable person for whom a taxpayer is an eligible caregiver. Requires the Secretary, acting through the Administrator of the Health Resources and Services Administration, to carry out research, demonstration, and education programs toward improving the delivery of appropriate health and support services for patients with fatal chronic illnesses. Requires the Director for the Centers for Disease Control and Prevention and the Director of the National Institutes of Health to expand activities with respect to fatal chronic illness. Requires the Secretary to develop pilot programs for the treatment for fatal chronic illness. Directs the Secretary of Veterans Affairs to improve the delivery of appropriate treatment services to patients with fatal chronic illness under health care programs of the Department of Veterans Services.

Directs the Secretary of Health and Human Services (HHS) to establish: (1) within the Department of HHS the Medicare Competitive Agency, headed by an Administrator charged with carrying out Medicare parts D and C (Medicare+Choice); and (2) within the Agency an Office of Beneficiary Assistance to carry out functions relating to Medicare beneficiaries. Creates a Medicare Ombudsman in such Office. Establishes within the Medicare Competitive Agency the Medicare Competitive Policy Advisory Board. Directs the Administrator of the Medicare Competitive Agency to study and report to Congress on the need for rules relating to permitting individuals who are enrolled under Medicare part B (Supplementary Medical Insurance) but are not entitled to benefits under Medicare part A (Hospital Insurance) to buy into the Medicare voluntary prescription drug delivery program. Amends SSA title XVIII with respect to the Federal Supplementary Medical Insurance Trust Fund to require the Board of Trustees of the Trust Fund to submit to Congress a combined report on the operation and status of the Trust Fund and the Federal Supplementary Medical Insurance Trust Fund, including the Prescription Drug Account within such Trust Fund. Expands the membership and duties of the Medicare Payment Advisory Commission (MEDPAC). Directs the Secretary to establish procedures under which each eligible beneficiary shall be entitled to elect to receive enhanced Medicare benefits under a new Medicare part E (Enhanced Medicare Benefits) instead of the benefits under Medicare parts A and B. Sets forth rules relating to Medicare supplemental insurance (Medigap) policies that provide prescription drug coverage, such as prohibiting the sale, issuance, and renewal of policies that provide prescription drug coverage to part D enrollees. Amends SSA title XVIII part C to provide for competition under the Medicare+Choice program and part D and E benefits under competitive Medicare+Choice plans.

Requires the Secretary to identify populations at high risk for early childhood caries and provide for the development of prevention programs. Revises the eligibility requirements for the school-based dental sealant program to include Indian tribes.

Allows any restricted lands on the reservation of, and held in trust for, the Confederated Tribes of the Umatilla Reservation to be leased by the Indian owners, with the Secretary of the Interior's approval, for terms of not to exceed 99 years for public, religious, educational, recreational, residential, business, or certain other purposes. Amends the Cow Creek Band of Umpqua Tribe of Indians Recognition Act concerning the treatment of land for trust purposes. Amends the Navaho-Hopi Relocation Settlement Act of 1974 to require an impact study. Amends the Ponca Restoration Act to designate Douglas and Sarpy Counties, Nebraska, and Pottawattamie County, Iowa, as the Ponca Health and Wellness Clinic Service Unit. Changes the report which identifies which lands are declared to be held by the United States in trust for the benefit of the Mississippi Band of Choctaw Indians. Modifies the Pueblo de Cochiti settlement concerning the Cochiti Wetlands Solution. Amends the Chippewa Cree Tribe of The Rocky Boy's Reservation Indian Reserved Water Rights Settlement and Water Supply Enhancement Act of 1999 to extend from three to five years the period during which court approval must be final before the Compact by the United States is declared null and void. Amends the Strom Thurmond National Defense Authorization Act for Fiscal Year 1999 concerning the disposal of Oil Shale Reserve Numbered 2. Prohibits the transfer of specified lands in Riverside County, California, held in fee by the Pechanga Band of Luiseno Mission Indians, until the Secretary of the Interior renders a final decision on a specified fee-to-trust application. Authorizes the Secretary to carry out a water feasibility study for the Quinault Indian Nation, Olympic Peninsula, Washington. Waives repayment of expert assistance loans to the Pueblo of Santo Domingo. Declares that the Trinity River Mainstream Fishery Restoration record of decision, concurred to by the Hoopa Valley Tribe, is legally compliant. Revises the powers of the Indian Arts and Crafts Board concerning trademarks for Indian arts and crafts. Amends the Carl D. Perkins Vocational and Technical Education Act of 1998 to specify an exemption for tribally controlled postsecondary vocational and technical institutions. Extends the Medicare Board eligibility period for residents and fellows in child and adolescent psychiatry.
