Equality Act This bill prohibits discrimination based on sex, sexual orientation, or gender identity with respect to businesses, employment, housing, federally funded programs, and other settings. Specifically, the bill expands Title II and Title VI of the Civil Rights Act of 1964 to prohibit public accommodations and federally funded programs, respectively, from discriminating based on sex, sexual orientation, or gender identity. It also includes stores, transit services, recreational facilities, and establishments that provide health care, accounting, or legal services as public accommodations under Title II. The bill also expands Title IV (desegregation of public schools) and Title VII (employment discrimination) to specifically include sexual orientation and gender identity. (The Supreme Court held in Bostock v. Clayton County that Title VII's prohibition of employment discrimination based on sex also prohibits employment discrimination based on sexual orientation or gender identity.) The bill similarly expands the Fair Housing Act (discrimination in public and private housing) to include sexual orientation and gender identity. It also prohibits discrimination based on sexual orientation or gender identity by creditors and with respect to jury selection. The bill defines sex for purposes of the aforementioned provisions to include sex stereotypes, pregnancy, childbirth, sexual orientation, gender identity, and sex characteristics.

Financial Regulators Transparency Act of 2023 This bill makes certain disclosure and ethics requirements applicable to the Federal Reserve banks and financial regulators and changes the authority and appointment procedure of the inspector general of the Board of Governors of the Federal Reserve System and the Consumer Financial Protection Bureau. The bill applies to Federal Reserve banks Freedom of Information Act (FOIA) requirements, congressional FOIA request requirements, and federal records retention requirements. The bill also expands ethics-related congressional FOIA requests to apply to the Board of Governors of the Federal Reserve System, Federal Reserve banks, the Consumer Financial Protection Bureau, the Federal Deposit Insurance Corporation, the Securities and Exchange Commission, the National Credit Union Administration, the Office of the Comptroller of the Currency, and the Federal Housing Finance Agency. Finally, the bill requires the inspector general of the Board of Governors of the Federal Reserve System and the Consumer Financial Protection Bureau to be appointed by the President and confirmed by the Senate. The inspector general shall also have authority over the Federal Reserve banks. Under current law, this appointment is made by the chair of the Board of Governors of the Federal Reserve System.

Family Stability and Opportunity Vouchers Act of 2023 This bill establishes a voucher program through which public housing agencies (PHAs) shall offer support services to help families who have children and are unstably housed, live in an area of concentrated poverty, or are at risk of being displaced from an opportunity area for children move to areas with access to high-performing schools or high-quality childcare and early education. VA Home Loan Awareness Act of 2023 This bill requires Fannie Mae and Freddie Mac to include on the Uniform Residential Loan Application (i.e., Fannie Mae Form 1003/ Freddie Mac Form 65) a disclosure that (1) notifies applicants with military service that they may qualify for a Department of Veterans Affairs (VA) Home Loan, and (2) directs applicants to consult their lender regarding eligibility. Not later than 18 months after the enactment of the bill, the Government Accountability Office must study and report on whether at least 80% of lenders using the loan application form have met this requirement.

Affordable Housing Bond Enhancement Act This bill modifies the Mortgage Revenue Bond (MRB) and the Mortgage Credit Certificate (MCC) programs of state housing finance agencies to expand the supply of affordable homes and homeownership for low- and moderate-income homebuyers. The bill requires the Internal Revenue Service to annually report to the congressional banking and tax committees on the use by states of their private activity bond authority for housing investment. It also increases the MRB home improvement loan limit from $15,000 to $50,000. The bill permits states to redesignate their carryforward authority and use it for housing investment and permits MRBs to be used to refinance home loans for borrowers who have incomes below 115% of median family income. The bill modifies the recapture requirement for homeowners who receive a MRB-financed mortgage or an MCC and sell their residences within the first nine years of ownership and reduces the time in which a recapture tax may be assessed from nine to five years. The bill revises the MCC benefit calculation to a simple percentage of the original loan balance. It also extends the MCC revocation period from two to four years. The bill reduces the public notice requirement for MCC issuers from 90 days to 30 days and eliminates certain MCC lendor reporting requirements.

Affordable Housing Credit Improvement Act of 2023 This bill revises provisions of the low-income housing tax credit and renames it as the affordable housing tax credit . The bill increases the per capita dollar amount of the credit and its minimum ceiling amount beginning in 2023 and extends the inflation adjustment for such amounts. The bill modifies tenant income eligibility requirements and the average income formula for determining such income. It also revises rules for student occupancy of rental units and tenant voucher payments, and prohibits any refusal to rent to victims of domestic abuse. The bill further modifies the credit to increase state allocations of the credit; repeal the qualified census tract population cap; prohibit consideration of local approval and local government contribution requirements for housing projects; increase the credit for certain projects designated to serve extremely low-income households; increase the credit for certain bond-financed projects designated by state agencies; eliminate the basis reduction for properties that receive certain energy-related tax benefits; and increase the population cap for difficult development areas (i.e., areas with high construction, land, and utility costs relative to area median gross income). The bill also includes Indian and rural areas as difficult development areas and modifies other requirements relating to casualty losses, tax-exempt bond financing, and foreclosures.

Homes for Every Local Protector, Educator, and Responder Act of 2023 or the HELPER Act of 2023 This bill establishes a program administered by the Department of Housing and Urban Development to provide mortgage assistance to law enforcement officers, elementary and secondary school teachers, firefighters, or other first responders. Specifically, these individuals may be eligible for a first-time mortgage on a primary family residence with no down payment. Instead, the mortgage is subject to a one-time, up-front mortgage insurance premium.

Excess Urban Heat Mitigation Act of 2023 This bill requires the Department of Housing and Urban Development (HUD) to establish a grant program for state, tribal, territorial, and local governments; metropolitan planning organizations; and certain nonprofits (or consortia of nonprofits) to carry out activities to mitigate or manage heat in urban areas. Eligible activities under the program include the implementation, construction, or maintenance of tree planting, green roofs, shade structures, cooling centers, and community gardens, as well as outreach to the community and education efforts. HUD's Office of Community Planning and Development must coordinate on the program with the Environmental Protection Agency, the National Oceanic and Atmospheric Administration's Climate Program Office, and the Forest Service.

Neighborhood Homes Investment Act This bill allows a business-related tax credit for certain development costs for the acquisition, rehabilitation, or remediation of qualified real property (i.e., real property affixed on a permanent foundation and comprised of four or fewer residential units, a condominium unit, or a house or apartment owned by a cooperative housing corporation). The bill also provides for the exclusion from gross income, for income tax purposes, of the value of any subsidy provided to a taxpayer by any state energy office for purposes of improvements made to a qualified residence.

Choice in Affordable Housing Act of 2023 This bill establishes programs and grants to incentivize landlord participation in the Housing Choice Voucher program (i.e., Section 8 tenant-based housing assistance). The bill authorizes the Department of Housing and Urban Development (HUD) to provide one-time incentive payments to landlords, security deposit payments, bonuses to public housing agencies that employ landlord liaisons, and amounts for other recruitment purposes. The bill also reauthorizes through FY2028 the Tribal Housing and Urban Development-Veterans Affairs Supportive Housing program. Additionally, the bill allows dwelling units to meet Housing Choice Voucher program inspection requirements by satisfactory inspection through participation in other housing programs. Landlords not yet participating in a low-income housing assistance program may request inspection by a public housing agency to determine whether the dwelling meets requirements prior to selection by a tenant. Finally, HUD must expand the use of an alternative method of calculating fair market rent for purposes of the Housing Choice Voucher program.

Healthy Moms and Babies Act This bill establishes programs and requirements to support maternal health services under Medicaid and the Children's Health Insurance Program (CHIP). For example, the bill allows state Medicaid programs to cover services that are provided by maternity health homes (designated providers or health teams that provide pregnancy and postpartum coordinated care services). It also establishes a demonstration program to expand telehealth services for pregnant and postpartum women under Medicaid. The bill also establishes an advisory group on birthing practices for health care professionals, requires a study on Medicaid coverage of doula services, and establishes other requirements relating to the maternal health care workforce. It also requires the Centers for Medicare & Medicaid Services to develop guidance on ways to address social determinants of health for pregnant and postpartum women and to reduce maternal mortality for Medicaid and CHIP beneficiaries.

Protecting our Communities from Failure to Secure the Border Act of 2023 This bill prohibits the federal government from using certain federally administered lands to provide housing to any non-U.S. nationals ( aliens under federal law) who have not been admitted into the United States. Specifically, this prohibition shall apply to any land under the administrative jurisdiction of the National Park Service, the Bureau of Land Management, the United States Fish and Wildlife Service, or the Forest Service.

Connect Our Parks Act This bill requires the National Park Service (NPS) to assess locations within the National Park System with the greatest need for broadband internet or cellular service, and to develop a plan for the placement of broadband and cellular infrastructure in parks. In assessing where broadband service is most needed, the NPS must consider the current availability of broadband in housing, lodging, administrative facilities, developed campgrounds, and other areas within each park. In assessing where cellular service is most needed, the NPS must consider locations where the availability of cellular service in a developed area of a park would increase public access to emergency services and traveler information or the communications capabilities of NPS employees. The NPS must complete the assessment within one year of the bill’s enactment. Further, within three years of the bill's enactment, the NPS must develop a plan based on the results of the assessment to install broadband and cellular service infrastructure at locations within the National Park System. In developing the plan, the NPS must consult with affected tribes and local stakeholders. The plan must (1) be technology neutral; (2) provide for infrastructure to be located in previously developed areas or areas zoned for uses that would support infrastructure; and (3) avoid or minimize impacts to cultural and natural resources, the visitor experience, and park viewsheds. The plan must also provide for the use of public-private partnerships for the installation of equipment and provision of broadband or cellular service.

Weatherization Assistance Program Improvements Act of 2023 This bill expands the Weatherization Assistance Program of the Department of Energy (DOE). The existing program reduces energy costs for low-income households by increasing the energy efficiency of their homes. The bill establishes a Weatherization Readiness Fund from which DOE may distribute funds to states for repairing structural defects or hazards of such homes so that weatherization measures may be installed. In addition, the bill increases the cap on the amount of funding that may be spent on (1) each home for labor, weatherization materials, and related matter; and (2) renewable energy systems in homes. The bill also eliminates a prohibition on providing funding for partially weatherized homes that have received assistance within the past 15 years. Instead, the bill applies this prohibition on fully weatherized homes.

Gateway Community and Recreation Enhancement Act This bill directs the Department of the Interior and the Forest Service to carry out activities to enhance recreational opportunities for gateway communities and provides for the establishment of a digital National Parks and Federal Recreational Lands Pass. Gateway community means a community that serves as an entry point or is adjacent to a recreation destination at which there is consistently high seasonal or year-round visitation. Specifically, Interior and the Forest Service must collaborate with state and local governments, Indian tribes, and other relevant stakeholders to identify needs and economic impacts in gateway communities, including housing shortages, demands on existing municipal infrastructure, accommodation and management of sustainable visitation, and the expansion and diversification of visitor experiences by bolstering the visitation at certain nearby underutilized locations or lesser-known recreation sites. The Rural Business-Cooperative Service shall provide to businesses in gateway communities assistance to establish, operate, or expand infrastructure to accommodate and manage sustainable visitation. Interior and the Forest Service must (1) establish a single visitation data reporting system to report accurate annual visitation data, and (2) carry out a Real-time Data Pilot Program. The bill provides for the establishment, by January 1, 2024, of a digital version of the National Parks and Federal Recreational Lands Pass that is able to be stored on a mobile device.

Investing in State Energy Act of 2023 This bill revises requirements concerning the distribution of funds under the Weatherization Assistance Program (WAP) and the State Energy Program (SEP) to state agencies and local partners that implement energy initiatives. Under WAP, the Department of Energy (DOE) reduces energy costs for low-income households by increasing the energy efficiency of their homes. Under SEP, DOE supports state energy conservation plans and energy security. This bill requires DOE, upon receiving state or area plans under WAP or SEP, to distribute funds to the recipients of the funding as quickly as practicable. Within 60 days of Congress making the funds available for WAP and SEP, DOE must (1) provide application guidance for financial assistance, and (2) publish the allocation of financial assistance to be provided to states under the programs.

Military Construction, Veterans Affairs, and Related Agencies Appropriations Act, 2024 This bill provides FY2024 appropriations for military construction, the Department of Veterans Affairs (VA), and related agencies. National Defense Authorization Act for Fiscal Year 2024 This bill authorizes FY2024 appropriations and sets forth policies for Department of Defense (DOD) programs and activities, military construction, and the national security programs of the Department of Energy (DOE). The bill authorizes appropriations, but does not provide budget authority, which is provided by appropriations legislation. This title also extends or modifies the authorization of certain projects from previous fiscal years. TITLE XXVII--BASE REALIGNMENT AND CLOSURE ACTIVITIES This title authorizes appropriations for base realignment and closure activities as authorized by the Defense Base Closure and Realignment Act of 1990. TITLE XXVIII--MILITARY CONSTRUCTION GENERAL PROVISIONS This title sets policy in such areas as military construction and military housing. This title also authorizes specified land conveyances. DIVISION C--DEPARTMENT OF ENERGY NATIONAL SECURITY AUTHORIZATIONS AND OTHER AUTHORIZATIONS TITLE XXXI--DEPARTMENT OF ENERGY NATIONAL SECURITY PROGRAMS This title authorizes appropriations for the activities of the National Nuclear Security Administration (NNSA), defense environmental cleanup, nuclear energy, and other defense activities. This title also sets policy for certain nuclear-related matters and authorizes new plant projects for the NNSA at specified locations. TITLE XXXII--DEFENSE NUCLEAR FACILITIES SAFETY BOARD This title authorizes appropriations for the Defense Nuclear Facilities Safety Board. DIVISION D--FUNDING TABLES TITLE XLI--PROCUREMENT This title sets forth amounts requested and authorized for procurement. Stop Human Trafficking in School Zones Act This bill establishes an enhanced penalty—an additional prison term of up to five years—for certain human trafficking offenses and sex offenses involving minors that occur within 1,000 feet of the real property comprising a school, school-sponsored activity, playground, or public housing facility; or within 100 feet of certain other places where children gather (e.g., a youth center or swimming pool). The additional prison term must be served consecutively with the prison term imposed for the underlying offense.

Native American Direct Loan Improvement Act of 2023 This bill revises the Native American Direct Loan (NADL) program, which is administered by the Department of Veterans Affairs (VA). Under the NADL program, the VA makes loans directly to Native American veterans to purchase, construct, improve, or refinance their homes located on federal trust land. Specifically, the bill expands the NADL program by allowing Native American veterans to refinance other existing mortgage loans on the same property if certain conditions are met. Additionally, the bill requires the VA to conduct additional program outreach by partnering with local service providers (e.g., tribal organizations and nonprofit organizations) to conduct outreach, homebuyer education, housing counseling, and post-purchase education. The bill directs the VA to assign a sufficient number of personnel to carry out the NADL program, including construction and valuation specialists to assist with issues unique to new construction and renovations on trust land. The bill also authorizes the VA to make a loan with a 1% interest rate to a Native community development financial institution to allow the institution to relend loan amounts to qualified Native American veterans residing on federal trust land.

Black Maternal Health Momnibus Act This bill directs multi-agency efforts to improve maternal health with a particular focus on racial and ethnic minority groups, veterans, and other vulnerable populations. The Department of Health and Human Services (HHS) must address the social determinants of maternal health (i.e., child care, housing, and other nonmedical factors that affect health outcomes). HHS and other departments must also carry out other actions to increase access to maternal health care and otherwise improve maternal health, such as growing and diversifying the maternal health workforce; establishing various grants and other programs, including ones related to maternal health disparities and maternal behavioral health; testing alternative payment models for perinatal care in Medicaid and the Children's Health Insurance Program (CHIP); addressing maternal health during public health emergencies; and supporting training, technology, and telehealth initiatives. The bill further provides for extended postpartum and breastfeeding eligibility for the Special Supplemental Nutrition Program for Women, Infants, and Children; increased research and data collection on maternal health indicators; activities to mitigate adverse maternal health outcomes associated with climate change; and expanded public education to improve maternal vaccination rates. The bill also addresses maternal health for incarcerated populations. For example, it (1) requires the Bureau of Prisons and the Department of Justice to establish programs to improve maternity care; and (2) reduces grants for criminal justice activities unless the recipient state or territory has a law to limit the use of restraints during pregnancy for incarcerated populations.
