Consumers REBATE Act

Consumers Rebate to ban Emissions and Boost AlTernative Energy Act or the Consumers REBATE Act This bill imposes an excise tax on the carbon dioxide content of coal, oil, and natural gas. The tax must be paid by the producer, miner, or importer of the taxable carbon substance and does not apply to exports of the substances. Beginning in 2020, the tax rate is $25 per ton of carbon dioxide content of the life-cycle emissions from the taxable carbon substance. After 2020, the tax increases by $10 each year and does not apply if specified emissions reduction benchmarks have been attained. The bill also includes provisions that require certain fees or refunds for taxable carbon substances that are exported or imported. Funds equivalent to the revenues received from the tax must be transferred to a Carbon Trust Fund established by this bill. The funds must be used, as provided by appropriations Acts, to offset reductions in individual income tax rates, pay quarterly dividends to certain individuals with valid Social Security numbers; and for specified worker transition assistance, energy, research, and infrastructure priorities.

UAS Critical Infrastructure Protection Act This bill amends the FAA Extension, Safety, and Security Act of 2016 to include railroad facilities among the critical infrastructure to be considered fixed site facilities for purposes of prohibiting or restricting the operation of an unmanned aircraft (i.e., a drone) in close proximity to such facilities. Other fixed site facilities may include military installations, oil refineries and chemical facilities, or amusement parks. The Federal Aviation Administration must publish a notice of proposed rulemaking by March 31, 2019, for carrying out the the process for prohibiting or restricting the operation of drones near fixed site facilities, and then issue a final rule within 12 months after publishing the notice of proposed rulemaking.

Drone Safety Enhancement Act

Drone Safety Enhancement Act This bill authorizes funding for FY2019-FY2024 to the Federal Aviation Administration (FAA) for the Know Before You Fly educational campaign or similar public informational efforts to broaden unmanned aircraft systems (drone) safety awareness. The FAA shall initiate a review of the process for interagency coordination of C-UAS activity and the standards for operation of a C-UAS system. A "C-UAS system" is the counter-unmanned aircraft system for detecting, tracking, and defending against drones. The bill amends the FAA Extension, Safety, and Security Act of 2016 to include railroad facilities as fixed site facilities for purposes of prohibiting or restricting the operation of a drone near such facilities.

Grants for Reliable, Efficient, and Accountable Transit Act This bill amends the Passenger Rail Investment and Improvement Act of 2008 to reauthorize capital and preventive maintenance projects for the Washington Metropolitan Area Transit Authority (WMATA). The bill revises provisions relating to standards for WMATA arbitrators and enforcement of awards in labor disputes. The state of Maryland, the Commonwealth of Virginia, and the District of Columbia (Signatories) shall amend the WMATA Compact to limit the annual growth in the rate of spending by each signatory by not more than 3% to subsidize operational needs of WMATA. The bill sets forth whistle-blower protections for WMATA employees and criteria for pension benefits for current and prospective WMATA employees.

Department of Veterans Affairs Expiring Authorities Act of 2018

Department of Veterans Affairs Expiring Authorities Act of 2018 This bill extends and otherwise revises specified Department of Veterans Affairs (VA) programs and services, including those related to health care, benefits, and homeless veteran reintegration. TITLE I--EXTENSIONS OF AUTHORITY Subtitle A--Health Care Matters (Sec. 101) The bill extends through FY2020 copayment guidelines for hospital care and nursing home care. (Sec. 102) The bill extends through FY2020 VA authority to provide nursing home care to certain veterans with service-connected disabilities. (Sec. 103) The bill removes appropriations limitations on family caregiver assistance for veterans. (Sec. 104) The bill makes permanent the authority of the VA to recover from a third party the costs of care for a non-service-connected disability. (Sec. 105) VA authority to transfer real property is extended through FY2020. (Sec. 106) The bill extends through FY2020 a pilot program for providing child care for veterans receiving health care. (Sec. 107) The bill extends through FY2020 the VA's grant authority for programs related to rural veteran transportation in connection with the provision of medical care. (Sec. 108) The bill extends through FY2020 a pilot program related to reintegration and counseling in retreat settings for women veterans. (Sec. 109) The bill extends through FY2019 an initiative to assess the feasibility of paying actual travel expenses in connection with veterans receiving care from VA centers. Subtitle B--Benefits Matters (Sec. 121) The bill makes permanent the authority of the VA to assist certain veterans with difficulty ambulating in acquiring and adapting housing with special features. (Sec. 122) The bill extends through FY2020 grants to encourage the development of new assistive technologies for specially adapted housing. (Sec. 123) The bill makes permanent the authority of the VA to guarantee certain mortgage-backed securities. (Sec. 124) The bill makes permanent provisions related to calculating the value of foreclosed property. (Sec. 125) The bill extends through FY2019 the VA's authority regarding property management. (Sec. 126) The bill makes permanent the authority of the VA to provide rehabilitation and vocational benefits for members and former members of the armed services with severe injuries or illnesses. (Sec. 127) The bill extends through FY2020 the agreement with the National Academy of Sciences to research associations between diseases and certain chemical compounds in herbicides. Subtitle C--Homeless Veterans Matters (Sec. 141) The bill extends through FY2020 a program for homeless veteran reintegration. (Sec. 142) The bill extends through FY2020 a reintegration program for homeless women veterans and homeless veterans with children. (Sec. 143) This bill extends through FY2020 referral and counseling services for veterans at risk for homelessness transitioning from institutional living. (Sec. 144) This bill extends through FY2020 programs providing outreach services and other assistance to homeless veterans and veterans with severe mental illness. (Sec. 145) The bill increases the amounts authorized to be appropriated in FY2018 and FY2019 for financial assistance for entities that support very low-income veteran families in permanent housing. (Sec. 146) The bill extends through FY2020 grant programs for homeless veterans with special needs. (Sec. 147) The bill extends through FY2022 the Advisory Committee on Homeless Veterans. Subtitle D--Other Matters (Sec. 161) The bill extends through FY2020 the authority to transport individuals to and from VA facilities. (Sec. 162) The bill extends through FY2019 the authority for operation of the VA's regional office in Manila, Philippines. (Sec. 163) The bill extends through FY2020 authorization of appropriations for the VA to provide monthly assistance allowances to specified veterans participating in Olympic programs. (Sec. 164) The bill extends through 2020 the VA's reporting requirement regarding equitable relief. (Sec. 165) The bill extends through FY2020 the authorization of appropriations for the Adaptive Sports Program for disabled veterans and members of the Armed Forces. (Sec. 166) The bill: (1) extends through FY2022 the Advisory Committee on Minority Veterans, and (2) requires the committee to report on relevant VA activities every other year rather than every year. TITLE II--IMPROVEMENT OF HEALTH CARE FROM DEPARTMENT OF VETERANS AFFAIRS (Sec. 201) The bill provides that modifications to contracts under the Veterans Community Care Program are not subject to specified bid requirements. (Sec. 203) Veterans Care Agreement coverage is expanded to any individual eligible for services through the VA. (The Veterans Care Agreement is a program that provides third-party health care if health care is not feasibly available from a VA facility.) (Sec. 204) The VA is allowed (currently, required) to deduct overpayments from payments owed to a health care entity. The VA may also use other means to collect overpayments. (Sec. 205) The bill expands eligibility for specified mental health services to veterans eligible for, but not enrolled in, VA health care. (Sec. 206) The bill expands the network of prescription drug monitoring programs accessible to VA health care providers to include state and regional programs not a part of the national network. (Sec. 207) The bill eliminates reporting requirements related to activities contracted out by the VA. (Sec. 208) The VA must complete additional reporting regarding the availability of opioid receptor antagonists (e.g., naloxone). (Sec. 209) The bill expands certain health care assessment reports to include the U.S. Virgin Islands and Puerto Rico. (Sec. 210) The bill authorizes a specified medical facility project in West Los Angeles, California. (Sec. 211) The bill extends a veterans medical school scholarship program to the entering class of 2020. TITLE III--OTHER MATTERS (Sec. 301) An educational institution providing educational benefits to veterans must charge in-state tuition rates for certain veterans entitled to rehabilitation as a condition of the institution's participation in certain VA education benefit programs. (Sec. 302) The bill revises conflict of interest restrictions for VA employees related to educational institutions. Specifically, the bill removes advance notice and hearing requirements regarding conflict waivers, limits the restrictions to those VA employees working on education benefit programs, and reduces the punishment for such activity. (Sec. 303) The bill revises VA authority to enter into certain leases at the West Los Angeles, California, campus. Specifically, in the case of previous mismanagement, the VA may not enter into a new lease or land-sharing agreement until the VA certifies compliance with certain audit reports or evaluations.

Federal Lands FIRES Act of 2018

Federal Lands Fire-Related Incidents Recovery and Economic Stimulus Act of 2018 or the Federal Lands FIRES Act of 2018 This bill authorizes the President to declare a federal lands wildfire disaster. Specifically, the President may make such a declaration for any wildfire: for which a request for a declaration has been made by the governor of an affected state or the chief executive of an affected Indian tribal government; that has burned 40% or more of an area that consists of federal lands; and that, in the President's determination, causes damage of sufficient severity and magnitude to warrant assistance to supplement the efforts and available resources of states, local governments, Indian tribes, and disaster relief  organizations in alleviating the damage, loss, hardship, or suffering caused by the wildfire. Assistance may be provided for secondary and tertiary damages, which may not include any area more than 100 miles from the area subject to the wildfire. The Department of Housing and Urban Development may provide assistance to states, local governments, and Indian tribes for necessary expenses for disaster relief, long-term recovery, restoration of infrastructure and housing, and economic revitalization in the most impacted and distressed areas resulting from a federal lands wildfire disaster. The bill amends the Small Business Act to allow small businesses to receive economic injury disaster loans from the Small Business Administration for a federal lands wildfire disaster.

Clean Water Infrastructure Act

Clean Water Infrastructure Act This bill amends the Safe Drinking Water Act to reauthorize through FY2022 and revise the drinking water state revolving fund (SRF), including to require SRF-funded projects to use iron and steel produced in the United States. The bill revises requirements for state Intended Use Plans for SRF funds, including to require the plans to: (1) list systems that are not in compliance with national primary drinking water regulation, (2) reserve a specified amount of funding for assistance for disadvantaged communities, and (3) prioritize SRF funding by those communities. The bill repeals: (1) requirements for regulations on variance technologies, and (2) state authority to exempt small public water systems from national primary drinking water regulations if the system installs certain treatment techniques. The Environmental Protection Agency must: prescribe follow up inspections after violations by public water systems, establish requirements for electronic submission of compliance monitoring data by public water systems, study the presence of pharmaceuticals and personal care products in drinking water sources, collect data on best practices for administration of SRF programs, implement a voluntary certification program for effective water loss and leak control technology, and submit a strategic plan for assessing and managing the risks of drought to drinking water provided by public water systems. Finally, the bill reauthorizes through FY2023 a grant program for certain lead reduction projects.

School Bus Safety Act of 2018 This bill requires the Department of Transportation (DOT) to issue rules prescribing or amending motor vehicle safety standards to require school buses with a gross vehicle weight rating of greater than 10,000 pounds to be equipped with a three-point safety belt at each designated seating position. DOT shall also issue rules to require (1) school buses to be equipped with an automatic emergency braking system, an event data recorder, and an electronic stability control system; and (2) at least 30 hours of behind-the-wheel instruction for school bus operators. The Federal Motor Carrier Safety Administration and the Federal Railroad Administration shall publish a final rule entitled "Evaluation of Safety Sensitive Personnel for Moderate-to-Severe Obstructive Sleep Apnea." The National Highway Traffic Safety Administration (NHTSA) shall complete a study of the benefits of requiring school buses to be equipped with a motion-activated detection system that can detect pedestrians located near the exterior of the school bus and alert the bus operator of the pedestrians. The NHTSA must also study the benefits of requiring school buses to have a system that alerts the operator if a passenger is not wearing a three-point safety belt. The bill requires DOT to e stablish a grant program to assist local educational agencies to purchase school buses equipped with three-point safety belts at each designated seating position and assist them in modifying existing school buses to be equipped with such belts.

The VA shall report to Congress regarding: (1) the effects of medical marijuana on veterans in pain; and (2) the relationship between state-approved medical marijuana treatment programs, program access, and opioid abuse reduction.

Department of Transportation Reports Harmonization Act This bill makes certain Department of Transportation (DOT) reports available online and eliminates specified DOT advisory councils and committees. The bill terminates the Northeast Corridor Safety Committee once positive train control, an automated safety control, is fully implemented on the Northeast rail corridor. Additionally, the advisory board for the National Rail Cooperative Research Program is terminated effective January 1, 2019. The program is no longer receiving appropriations. The bill requires the National Railroad Passenger Corporation (Amtrak), as parts of its grant request, to report on the status of efforts to improve safety and security along the Northeast Corridor. The bill requires changes to charges and fees for the U.S. Merchant Marine Academy to be posted online. DOT must publish on its website the biennial report on how federal agencies are coordinating environmental review for transportation projects. DOT must publish on its website the highway safety performance of each state. This requirement replaces the biennial report DOT was required to submit to Congress. The Government Accountability Office must report on state highway safety programs.

I-5 Corridor Cooperation Act This bill prohibits tolls of any kind from being collected along Interstate 5 and Interstate 205 between State Route 500 in the state of Washington and U.S. Route 30 in the state of Oregon for any purpose unless: (1) the economic impact study required by this bill is completed; and (2) the governors of such states sign an agreement to allow the collection of a toll in those areas. Threat Assessment, Prevention, and Safety Act of 2018 This bill directs the Department of Homeland Security (DHS) to establish within itself a Joint Threat Assessment and Management Task Force, which shall provide recommendations to Congress and DHS on the development and implementation of a national strategy for preventing targeted violence through threat assessment and management. The task force shall make recommendations relating to the most effective use of existing government infrastructure, workforce, and experience, unit support, training, and school violence prevention. The bill defines "threat assessment and management" as the systematic and evidence-based process of: (1) identifying individuals whose behavior indicates a capacity for committing acts of violence; (2) investigating and gathering information to assess whether such individuals pose a real threat; and (3) the subsequent management of such a threat. DHS shall develop and implement the national strategy and provide information and training services related to it. The bill directs DHS to award grants to governmental and educational entities and nongovernmental organizations to establish community based units for implementing the national strategy.

The term "innovative material," with respect to an infrastructure project, includes high performance asphalt mixtures and concrete formulations, geosynthetic materials, advanced alloys and metals, reinforced polymer composites, including any coating or other corrosion prevention method used in conjunction with those materials, advanced polymers, and any other material or aggregate materials, as determined by the appropriate agency or department head. The Department of Transportation shall carry out a program to enhance the development of innovative materials in the United States. The Federal Highway Administration shall establish the Innovative Bridge Program to provide grants for coastal and rural infrastructure bridge projects. The Environmental Protection Agency shall establish the Water Infrastructure Innovation Program to provide grants for the design and installation of water infrastructure projects.
