Summary

Federal Insecticide, Fungicide, and Rodenticide Act Amendments of 1981 - Amends the Federal Insecticide, Fungicide, and Rodenticide Act to revise pesticide registration provisions. Extends the time for securing additional registration data. Sets forth joint data development provisions. States that applicants who purchase a pesticide for an end-use product shall not be required to share in data production expenses. Requires the Administrator of the Environmental Protection Agency to give notice to affected registrants of the risks upon which a proposed public interim review will be based. Makes an interim decision not to restrict a pesticide's use or classification to judicial review. Requires the Administrator to: (1) notify registrants about reregistration; and (2) cancel a product's registration upon failure to reregister within a specified time. Sets forth specified data provisions for applications approved beginning 18 months after enactment of this Act. Revises cancellation and classification provisions. Requires an applicant to explain why specific registration data should be protected from disclosure as a trade secret or commercial or financial information. Requires the Administrator to provide an applicant with up to 60 days to show that data to be disclosed is protected manufacturing, testing, or ingredient percentage information. Requires the Administrator to make testing data available to the public through the Environmental Protection Agency reading rooms. Sets forth guidelines for public use of these facilities. Replaces the penalty provision for Federal employees disclosing protected information with a provision prohibiting the unauthorized disclosure of an applicant's data available in such reading rooms to a pesticide producer. Requires the Administrator to notify an applicant when and by whom such data has been borrowed. Sets forth guidelines for nondisclosure of certain information acquired from foreign governments or international organizations. Makes it unlawful to fire or adversely affect a person's work status for exercising his or her rights under such Act. Revises penalty provisions for improperly obtaining or using specified pesticide data. Permits aggrieved persons to sue for pesticide misuse. Provides, beginning with fiscal year 1982, that funds for State and Indian pesticide application certification shall be distributed on a formula basis. Sets forth procedures for State requests of health and safety data concerning State-regulated federally registered pesticides. Extends the scientific advisory panel through fiscal year 1983. Requires the Administrator to adopt pesticide safety guidelines within one year. Revises State enforcement provisions to provide that a State must: (1) begin investigating a complaint within 30 days, and begin enforcement action within 120 days; and (2) begin investigating an alleged injury to an agricultural worker within five days.
