Summary
<b>Bezug:</b> Gesetzentwurf fast identischer Materie wurde bereits in der 8.WP eingebracht (BR Drs. 509/79, BT Drs. 8/3828, s.a. GESTA/8.WP/S.777) <br><br><b>Inhalt:</b> Übernahme der ungeteilten Zuständigkeit im Bereich der Seeunfalluntersuchung durch den Bund, Konzentrierung auf 4 Seeämter (Hamburg, Bremerhaven, Kiel, Emden), einheitliche Weisungskompetenz des BMV, hauptamtliche Besetzung der Untersuchungsausschüsse, Vereinfachung des Verfahrens und Verkürzung des Rechtszuges, Anwendung des Verwaltungsverfahrensgesetzes und der Verwaltungsgerichtsordnung, Übernahme der ersten Verwaltungsinstanz durch den Bund; Änderung des § 1 des Gesetzes über die Aufgaben des Bundes auf dem Gebiet der Seeschiffahrt, Aufhebung des fünften Abschnittes des Gesetzes über die Statistik der Seeschiffahrt, Einschränkungen des Grundrechts des Artikels 13 GG über die Unverletzlichkeit der Wohnung, Außerkrafttreten aller früheren Gesetze und Verordnungen zum gleichen Gegenstand. Umverteilung der Kosten: die bisherigen Jahreskosten für die Länder von rd. 0,732 Mio DM entfallen, dem Bund entstehen statt 0,11 Mio DM nunmehr rd. 0,849 Mio DM. <br><br><b>Änderungen aufgrund der Ausschußempfehlung:</b> Die Änderungsvorschläge der Länder werden übernommen. Der Bundesminister für Verkehr regelt die örtliche Zuständigkeit der Seeämter durch Rechtsverordnung. <br><br><b>Nebenschlagwörter:</b> Zuständigkeit/Übernahme der ungeteilten Zuständigkeit im Bereich der Seeunfalluntersuchung durch den Bund * Seeamt/Konzentrierung auf vier Seeämter (Hamburg, Bremerhaven, Kiel, Emden) * Bundesminister für Verkehr/Einheitliche Weisungskompetenz des BMV im Seeunfalluntersuchungsverfahren * Verwaltungsgerichtsordnung/ Anwendung der Verwaltungsgerichtsordnung im Seeunfalluntersuchungsverfahren * Verwaltungsverfahrensgesetz/ Anwendung des Verwaltungsverfahrensgesetzes im Seeunfalluntersuchungsverfahren * Grundgesetz: Art.13/Einschränkung des Grundrechts des Artikels 13 GG über die Unverletzlichkeit der Wohnung im Bereich der Seeunfalluntersuchung * Seeschiffahrt/ Änderung des § 1 des Gesetzes über die Aufgaben des Bundes auf dem Gebiet der Seeschiffahrt, Aufhebung des fünften Abschnittes des Gesetzes über die Statistik der Seeschiffahrt
