Summary

Bezug: BVerfG Entscheidungen vom 4.2.81 (2 BvR 570/76, 590/76) und 11.3.81 (2 BvR 441/77), BGBl I, S. 414, 415 Inhalt: Ausbringung einer Amtszulage für Richter in herausgehobener Funktion, Erste Landesanwälte in Baden-Württemberg und Erste Staatsanwälte in Bayern, Korrektur der zuletzt unterbliebenen Anpassung der Amtszulagen-Beträge, Bezeichnung dieser Ämter als künftig wegfallend aufgrund der Entscheidung des Bundesverfassungsgerichts vom 4. Februar 1981; Änderung von Artikel IX §§ 4 und 8 2. BesVNG, der Anlage IX des Bundesbesoldungsgesetzes und der Landesbesoldungsordnung R des Landesbesoldungsgesetzes Baden- Württemberg, Ermächtigung des Bundesministers des Innern zur Änderung der genannten Amtszulagen durch Rechtsverordnung. Der Bundeshaushalt wird mit unwesentlichen Mehrkosten belastet. Die Mehrkosten für die Länder sind nicht genau quantifizierbar. Änderungen aufgrund der Ausschußempfehlung: Ausnahmen von der Absenkung der Eingangsbesoldung bzw. Abrechnung von Absenkungszeiten für Beamte, die vor der Entstehung des Besoldungsanspruchs bereits in einem hauptberuflichen Angestelltenverhältnis im öffentlichen Dienst gestanden haben. Entsprechende Bestimmungen für Kirchenbeamte, Geistliche und hauptberufliche Angestellte öffentlich-rechtlicher Religionsgesellschaften oder ihrer Verbände sowie von Lehrern an Ersatzschulen. Ausnahmeregelungen zur Gewinnung hervorragender Nachwuchswissenschaftler für Hochschulen und das Deutsche Patentamt. Möglichkeit der Gewährung von Zuschüssen an Hochschullehrer zur Verhinderung ihrer Abwanderung ins Ausland oder in die Wirtschaft.
