<b>Bezug:</b> Bericht der Bundesregierung über die Belastung der Gewässer durch die Nährstoffe Phosphor und Stickstoff (BT Drs. 11/4213); 10-Punkte- Katalog des BMU zum Schutz von Nord- und Ostsee; Entschließung des Deutschen Bundestages vom 7.12.1988 (BT Drs. 11/3299) <br><br><b>Europäische Impulse:</b> Beschlüsse der 2. Internationalen Nordseeschutz-Konferenz, der 9. Sitzung der Helsinki-Kommission sowie des Aktionsprogramms Rhein vom 1. Oktober 1987; Vorschlag einer Richtlinie des Rates über die Behandlung kommunaler Abwässer (als Anlage zur Beschlußempfehlung) <br><br><b>Inhalt:</b> Einbeziehung von Phosphor und Stickstoff in die Abgabenbewertung, Anhebung des Abgabensatzes in zwei Schritten auf 60 DM als Anreiz zur beschleunigten Umsetzung der nach § 7a Abs. 1 Wasserhaushaltsgesetz festgelegten Anforderungen, Festlegung eines Abgabesatzes von 25 v.H. bei Einhaltung dieser Anforderungen, Verrechnung von Investitionen für Gewässerschutzmaßnahmen mit der in einem bestimmten Zeitraum anfallenden Abgabe; Änderung versch. §§ sowie der Anlage zu § 3 AbwAG; Neufassungsermächtigung. Es entstehen keine Kosten. <br><br><b>Änderungen aufgrund der Ausschußempfehlung:</b> Weitere Erhöhung des Abgabesatzes ab 1. Januar 1995, stufenweise Abbau der Ermäßigung des Abgabesatzes, Erhöhung der geforderten Mindestleistung der errichteten oder erweiterten Abwasserbehandlungsanlage, Konzentration der Verwendung des Abgabeaufkommens auf Problemfälle, keine Aufrechnung der Phosphor- und Stickstoffelimination nach dem Stand der Technik mit der Abgabe. <br><br><b>Änderungen durch das Vermittlungsverfahren:</b> Änderung des § 9 Abs.4 Satz 2 AbwAG: schrittweise Anhebung des Abgabesatzes auf 90 DM bis zum 1. Januar 1999. <br><br><b>Nebenschlagwörter:</b> Phosphor/Einbeziehung in das Abwasserabgabengesetz * Stickstoff/ Einbeziehung in das Abwasserabgabengesetz * Gewässerschutz/ Verrechnung von Investitionen für den Gewässerschutz mit der Abwasserabgabe
