<b>Bezug:</b> Empfehlungen der Enquete-Kommission des Deutschen Bundestages "Chancen und Risiken der Gentechnologie" (BT Drs. 10/6775) <br><br><b>Inhalt:</b> Schutz von Mensch und Umwelt vor möglichen Risiken der Gentechnik zu Forschungs- und zu gewerblichen Zwecken: einheitliche gesetzliche Regelung für gentechnische Arbeiten im geschlossenen System, die Freisetzung gentechnisch veränderter Organismen in die Umwelt sowie das Inverkehrbringen solcher Organismen, Festlegung von Sicherheitsmaßnahmen, Genehmigungserfordernis, administrative Kontrolle und nachgehende Überwachung durch das Bundesgesundheitsamt, die Landesbehörden und die Zentrale Kommission für die Biologische Sicherheit, Gefährdungshaftung, Straf- und Bußgeldvorschriften; Änderung von Nr. 4.11 im Anhang der VO über genehmigungsbedürftige Anlagen, Änderung § 1 Nr. 10 der AbwasserherkunftsVO, Änderung § 15 der GefahrstoffVO, Änderung § 7 des Tierschutzgesetzes, Ermächtigung zum Erlaß von Rechtsverordnungen. Dem Bund entstehen bei der Durchführung des Gesetzes jährlich Kosten von voraussichtlich 3 Mio DM. Den Ländern entstehen zusätzliche Kosten durch administrative Maßnahmen. <br><br><b>Änderungen aufgrund der Ausschußempfehlung:</b> Umfangreiche Ergänzungen und Neuformulierungen gegenüber dem Regierungsentwurf, u.a. Festschreibung der Vollzugszuständigkeit der Länder im Bereich der Anlagengenehmigung, Anzeigeverfahren für Forschungsanlagen in der Sicherheitsstufe I, Durchführung der Genehmigungsverfahren, Berücksichtigung des Datenschutzes, Beteiligung des Bundestages beim Erlaß von Rechtsverordnungen; Änderung der Anlage zu § 3 des Gesetzes über die Umweltverträglichkeitsprüfung. <br><br><b>Nebenschlagwörter:</b> Bundesgesundheitsamt/Aufgaben im Bereich der Gentechnik * Zentrale Kommission für die Biologische Sicherheit/Aufgaben im Bereich der Gentechnik * Gefährdungshaftung/Haftung im Bereich der Gentechnik * Genehmigungsbedürftige Anlage/Streichung Nr. 4.11 im Anhang der VO * Abwasserherkunftsverordnung/Änderung § 1 betr.
