<strong>Bezug:</strong> Regierungserklärung (Regierungsprogramm) vom 18. März 1987 (PlPr 11/ 4, S. 63C), Regierungserklärung vom 27. April 1989 (PlPr 11/140, S. 10294C); eingebracht als &quot;Entwurf eines Umwelthaftungsgesetzes - UmweltHG&quot;; siehe auch den textidentischen Gesetzentwurf der Fraktionen der CDU/ CSU und FDP C103 (BT-Drs 11/6454); siehe auch C80<br /> <br /> <strong>Inhalt:</strong> Verbesserung der Rechtsstellung der Geschädigten und Veranlassung der Betreiber von Anlagen zu schadensvermeidendem Verhalten: Einführung einer Gefährdungshaftung für die Bereiche Boden und Luft, Gefährdungshaftung bei bestimmten Anlagen unter Einschluß des Normalbetriebs, Beweiserleichterungen für Geschädigte, Schadenersatzpflicht für Personen- und Sachschäden, Verbesserung der Möglichkeit, Eingriffe in die Natur auf Kosten des Schädigers rückgängig zu machen, obligatorische Vorsorgevorkehrungen für Anlagen mit besonders hohem Risiko, insbesondere in Form einer Haftpflichtversicherung. Bund, Ländern und Gemeinden entstehen erhöhte Kosten für von ihnen betriebene Anlagen.<br /> <br /> <strong>Änderungen aufgrund der Ausschußempfehlung:</strong> In der 2. Beratung zusammengeführt mit dem Gesetzentwurf der Fraktionen der CDU/CSU und FDP C103 (BT-Drs 11/6454)<br /> unter neuem Titel; Umwandlung der Vorlage in ein Artikelgesetz, Umwelthaftungsgesetz als Art. 1 des Gesetzes, Änderungen aufgrund der Stellungnahme des Bundesrates, u.a. Erweiterung der Haftungshöchstgrenzenregelung; Einfügung eines § 32a ZPO betr. Gerichtszuständigkeit und eines § 51 b BImSchG betr. Sicherstellung der Zustellungsmöglichkeit von Schriftstücken.<br /> <br /> <strong>Änderungen durch das Vermittlungsverfahren:</strong> Neufassung von Art. 1 § 5 (Beschränkung der Haftung bei Sachschäden), Streichung von § 8 und Änderung des § 16, Ergänzung von Art. 2 § 32a betr.
